MANILA, March 27, 2014 (AFP) – The biggest Muslim rebel group in the Philippines signed an historic pact Thursday to end one of Asia’s longest and deadliest conflicts, promising to give up their arms for an autonomous homeland. Following four decades of fighting that has claimed tens of thousands of lives, the Moro Islamic Liberation Front (MILF) signed the peace deal with President Benigno Aquino’s government at a high-profile ceremony in Manila. “The comprehensive agreement on Bangsamoro is the crowning glory of our struggle,” MILF chairman Murad Ebrahim said at the signing ceremony, using a local term that refers to a Muslim homeland. “With this agreement the legitimate aspirations of the Bangsamoro and the commitment of the government of the Philippines to recognize those aspirations are now sealed.” The pact makes the MILF and the government partners in a plan to create a southern See MILF REBELS, page 12

MANILA, March 28, 2014 (AFP) – The Philippines said Friday it planned to defy Chinese warnings and pursue a case in the United Nations challenging Beijing’s claim to most of the South China Sea. WASHINGTON – A federal criminal complaint was unsealed in San Francisco on Wednesday by the Department of Justice, charging 26 defendants, including California Senator Leland Yee, with firearms trafficking, money laundering, murder-for-hire, drug distribution, trafficking in contraband cigarettes, and honest services fraud. The complaint included allegations that Yee – a known fixture in the Filipino-American community as he was running for the California Secretary of State post (he quit the race on Thursday) – will facilitate the purchase

and delivery of weapons from Muslim “separatist rebels” from the Philippines. Along with Sen. Yee who represents San Mateo County and part of San Francisco County in the California Senate, the defendants include Raymond “Shrimpboy” Chow, the current Dragonhead, or leader, of the San Francisco-based Chee Kung Tong organization (CKT). DFA: Longer passport processing days in next 3 weeks MANILA, Mar 28 (Mabuhay) – The Department of Foreign Affairs (DFA) on Friday announced longer processing days for electronic passports from April 1 to April 15. Passport applications will take more time to process in the next three weeks due to technical maintenance, the DFA said in a statement. The following are the new e-passport releasing schedules, depending on where the application will be made: 10 to 20 working days for applications at the Office of Consular Affairs (OCA) at the Aseana Business Park along Macapagal Boulevard in Parañaque, and in satellite offices located inside selected malls; 15 to 25 working days for applications in regional consular offices; 5 to 6 weeks for applications in foreign service posts, such as Philippine embassies in consulates.

Passport applications made at the OCA building and in selected malls normally take seven to 15 working days without the scheduled maintenance. The normal processing time for passport applications in regional consular offices, meanwhile, is 10 to 20 working days, while foreign service posts usually take three to four weeks. The DFA assured the public that it is “exhausting all its efforts in providing a better service to the Filipinos, locally and abroad.” “The public’s utmost understanding and cooperation is requested during the implementation of these temporary passport release dates,” it said. Doctors association president sued for tax evasion MANILA, Mar 27 (Mabuhay) – Challenge accepted. The Bureau of Internal Revenue has filed a tax evasion case against outgoing Philippine Medical Association president Leo Olarte for tax liabilities amounting to P2.93 million. This is after the PMA official challenged the BIR to file a complaint against tax-evading doctors instead of portraying the entire medical profession as tax cheats. BIR Commissioner Kim Henares said Olarte is facing charges for willfully evading declaration of income taxes and for several counts of deliberate failure to file his income tax returns and VAT returns for taxable years 2006-2012. Henares noted Olarte is a medical practitioner and lawyer who teaches both medicine and torts and damages at the Far Eastern University and the University of the East. He is a registered taxpayer of Quezon City with business address at the National Children’s Hospital. The BIR chief said Olarte has been deriving

compensation income concurrently from two or more employers for a 7-year period. An alpha list submitted by various withholding agents of Olarte showed that the PMA president earned the following sums from 2006-2012. 2006 – P569,000; 2007 – P221,000; 2008 – P226,000; 2009 – P774,904; 2010 – P715,515; 2011 – P992,298; 2012 – P1,191,576.01 “The law says the only person who does not have to file an income tax return are people who are employed by a single employer, whose taxes have been properly withheld. As you can see, he is employed by several people and he has his own profession so he is required by law to file an income tax return,� Henares said. “Secondly, he is also required by law because he registered himself as a VAT taxpayer. CHED frowns on change in academic calendar MANILA, Mar 26 (Mabuhay) -- For the Commission on Higher Education (CHED), June is still the best time to start the school year. The CHED, in a position paper issued Wednesday, said it “does not advise a change in the academic calendar� for colleges and universities in the Philippines. The position paper, signed by CHED chairperson Patricia Licuanan, stated that improving the quality of education and the competencies of graduates “are much more fundamental than the issue of academic calendars.� “CHED stands firm in its belief that the best way to internationalize or engage

with the global academic community is for higher education institutions to intensify their quality assurance, capacity-building and institutional development programs,� the CHED said in its position paper. The commission made this stand months after two of the biggest universities in the country – the Ateneo de Manila University and the University of the Philippines – announced that they are shifting their academic calendars from June to March to August to May. The University of Santo Tomas, meanwhile, has moved its college opening to July starting next school year. Leeway

The CHED said that colleges and universities have “some leeway� under the law to establish their own calendars, provided that those under the commission will seek its approval. “Higher education instutions can start their academic years at different times. What ought to be the common concern... is providing the requisite academic hours within an academic calendar year,� it said. The CHED, however, said that it “generally prescribes a June start� since it is “better harmonized with the schedule of classes of basic education.� The CHED also said that changing the

class opening from June to August “would not make much of a difference� to mitigate the impact of climate change on the school calendar, since tropical cyclones tend to hit between July and September. “Indeed, class suspensions due to heavy rains and typhoons tend to spike as well from July through October,� the position paper read. The commission further said that some families, particularly those from farming and fishing communities, may find it difficult to send students to school in August, since “agricultural cycles cause them to run out of financial resources� by this time of the year. 175 arrested in Pampanga for telecom scamming MANILA, Mar 28 (Mabuhay) – A total of 175 people, at least 110 of whom are suspected to be Taiwanese, were arrested late Wednesday in Pampanga for alleged involvement in a telecom scamming racket. The National Bureau of Investigation said the scam involved defrauding victims over the phone, Taiwan’s Central News Agency reported early Friday. At least 110 claimed they were Taiwanese while the rest said they were from mainland China, the CNA report said. It added they now face charges including the illegal use of telecommunication facilities. CNA said the NBI arrested the 175 in five locations across Angeles City in Pampanga. Seized in the raids were computers, telecommunications devices, instruction booklets and lists of potential victims, it quoted NBI Director Virgilio Mendez as saying. However, the CNA report said the claims of the 110 who claimed to be Taiwanese could not be immediately confirmed as most did not produce documentation. Malaysia believes the plane was deliberately redirected by someone on board and flown thousands of miles southwards, but nothing else is known. “This is a credible new lead and will be thoroughly investigated today,” Australian Prime Minister Tony Abbott said of the revised search area. Malaysian officials said the new zone was identified following an analysis of radar data by experts from Boeing who have joined an international investigation team in Kuala Lumpur. They took MH370’s estimated speed when it was briefly tracked by Malaysian military radar shortly after it diverted to the west – the last time MH370 appeared on radar. Boeing extrapolated forward to find an estimate of how far the plane would have flown on its known fuel reserves. Earlier satellite data analysis had indicated the plane was last detected in the Indian Ocean. Malaysia’s military has been criticized for not responding by intercepting or taking other steps to monitor the plane. The air force has said the radar image was ignored because it was not deemed “hostile.” The new search area is around 1,850 kilometers west of Perth. Australia is repositioning its satellites to focus on it. Black box deadline As the search moves to the new area, the clock is ticking on the tracking signal emitted by the plane’s “black box” of flight data, which lasts about 30 days. The US Pacific Fleet has moved specialized black box locator equipment to Perth, poised to begin searching once an approximate crash site is established. “It’s critical to continue searching for debris so we can reverse-forecast the wind, current and sea state since March 8th to recreate the position where MH370 possibly went into the water,” said Commander Tom Moneymaker, U.S. 7th Fleet oceanographer. Seeking closure, anguished families of those aboard are desperately awaiting solid evidence that might unlock one of aviation’s greatest riddles. The Bangsamoro region would cover about 10 percent of territory in the mainly Catholic Philippines. The planned region has a majority of Muslims, but there are clusters of Catholic-dominated communities. Muslim rebels have been battling since the 1970s for independence or autonomy in the southern islands of the Philippines, which they regard as their ancestral homeland dating back to when Arabic traders arrived there in the 13th Century. people across large parts of the resourcerich Mindanao region to brutal poverty, plagued by Muslim and Christian warlords as well as outbreaks of fighting that has led to mass displacements. The conflict also created fertile conditions for Islamic extremism, with the AlQaeda linked Abu Sayyaf group and other hardline militants making remote regions of Mindanao their strongholds. The MILF, which the military estimates has 10,000 fighters, is easily the biggest Muslim rebel group in Mindanao, and the political settlement was greeted with relief and optimism in the south. “I am really happy. In the face of all the hardship of our parents, we the next generation hope and pray that Christians and Muslims will have peace,� Mona Rakman, 42, a mother of four who lives close to the MILF headquarters, told AFP.

According to the complaint, as the relationship developed among the primary undercover agent, Chow, and other defendants, the undercover agent informed the defendants that he was interested in generating income from illegal schemes. The undercover agent was inducted into the CKT as a “consultant.� Thereafter, during the course of multiple undercover operations, the undercover agent was allegedly introduced to a number of the defendants in order to launder money, traffic narcotics, traffic in firearms, traffic purportedly stolen cigarettes and liquor and engage in murder-for-hire schemes. The complaint further alleges that Chow also introduced Keith Jackson to the undercover agent. Jackson, the owner and operator of Jackson Consultancy, a San Francisco based consulting firm, is a consultant to the CKT. Jackson and his son, Brandon Jackson, allegedly responded to a request for weapons by the undercover agent, by indicating that Brandon Jackson, and an associate would be able to accommodate his request. Subsequently, Jackson, Brandon Jackson, and Marlon Sullivan sold various types of firearms, and two ballistic vests, to the undercover agent. Additionally, Jackson, Brandon Jackson, and Sullivan allegedly conspired to commit a purported murder for hire scheme requested by the undercover agent, in addition to other illegal activity, including the sale of stolen credit cards and the purported sale of cocaine to Jackson, Brandon Jackson and Sullivan from the undercover agent. Brandon Jackson introduced the undercover agent to Rinn Roeun, one of Brandon Jackson’s sources of supply for firearms. Roeun sold multiple firearms to the undercover agent and during a series of conversations told the undercover agent that he was willing to commit murder for a fee. According to the complaint, in addition to his relationship with Chow, and

the CKT, Keith Jackson is also a close associate of Senator Leland Yee. From at least May 2011 through the present, Jackson has been involved in raising campaign funds for Yee. With respect to Yee, the complaint alleges that over the course of 2012 and continuing to the present time, Yee and Keith Jackson allegedly raised money and campaign funds for Yee’s Secretary of State campaign by soliciting donations from FBI undercover agents, in exchange for multiple official acts, and that Yee and Jackson were involved in a conspiracy to traffic firearms. According to the complaint, starting in May 2011, and continuing for several months, Jackson solicited an undercover agent with the FBI to make contributions to Yee’s San Francisco mayoral campaign. These solicitations allegedly included asking the agent for donations in excess of the $500 individual donation limit. The agent declined to make any donations to Yee, but introduced Jackson and Yee to a purported business associate, another undercover FBI agent. Jackson and Yee then solicited the second undercover agent for campaign contributions. This solicitation resulted in at least one personal donation in the amount of $5,000 to Yee’s mayoral campaign. After Yee lost the Nov. 8, 2011, election, according to the complaint, he had at least $70,000 in debt from that campaign. In connection with efforts to retire the mayoral campaign debt, Yee and Jackson allegedly agreed that Yee would make a telephone call to a manager with the California Department of Public Health in support of a contract under consideration with the second undercover agent’s purported client, and would provide an official letter of support for the client, in exchange for a $10,000 campaign donation. Yee allegedly made the call on Oct. 18, 2012, and provided the letter on or about Jan. 13, 2013. On Nov. 19, 2012, Jackson accepted the $10,000 cash donation.

Who would’ve thought that the senator – a known anti-gun advocate – would be charged as a gunrunner? As someone who would discuss matters with “unknown characters” (who turned out to be undercover agents) wanting to buy firearms so he could raise campaign money?! But he’s been in politics since the late 80s. He seemed to know how to raise funds legally, even if he was reported to be $70,000 in the hole because of his previous loss to the mayoral race in San Francisco, the district he represents as a California senator along with most of San Mateo County. Either that or I’m too naive. On TV, while journalists were interviewing an FBI agent about the ongoing arrests and who they were, the agent rattled some names – there were 26 arrests including the senator – and said “but the big fish is Leland Yee, a California senator.” Seriously, have you met the senator? was my initial reaction. As I try to look at this objectively, it was as if the senator was leading a double life! You see, Fil-Am publishers have endorsed him. Fellow scribes have written rosy comments about him and the way they appreciated the fact that Sen. Yee has been championing so many Filipino issues, including the fight for equity of Filipino war veterans. Many here in Los Angeles have invited him to grace their events and even asked him to give a small talk, which has become routine for him, especially since he’s running for a higher office. Heck, he even administered the oath of newlyinstalled officers of a press photographers club just over the weekend! In a press release, the Department of Justice said: “Yee and (an associate) Keith Jackson allegedly raised money and campaign funds for Yee’s Secretary of State campaign by soliciting donations from FBI undercover agents, in exchange for multiple official acts, and that Yee and Jackson were involved in a conspiracy to traffic firearms.” As if this wasn’t enough to hurt the Fil-Ams, the weapons allegedly will come from “Yee’s contacts” who are

A prominent supporter, Fil-Am Attorney Alma Reyes, was perhaps the most shocked. Reyes has been the most visible person with Sen. Yee in many Fil-Am events in the Southland as of late. But as any legal counsel would say, Reyes’ comment was, “Like everybody else who faces allegations, which is what an indictment is, the honorable senator is entitled to a presumption of innocence.” Reyes added, however, that “We all know that (Sen. Yee) has powerful adversaries because of his popularity. As one of his supporters and as an attorney, I don’t have any indicia of doubt that he will be proven innocent.” As mentioned, Sen. Yee was a favorite to win in November who, even if ethnically he belongs to the minority, but was up against a fractured Latino community. As of this writing, the Senate suspended Yee, along with two other senators facing criminal charges, which has practically ended his political career. On the other hand, if the allegations are true, I dare say that I was fooled like never before, and the FBI must be commended for catching a huge whale.

Under California law, employees should be paid for all hours worked. “Hours worked” is that time during which an employee is subject to the control of an employer. Hence, employees should be paid when required to do the following: preliminary work before they actually start their workday and perform their main job, or postliminary work which are tasks performed after their main job is completed (for example: cleaning or maintaining tools or equipment, removing protective gear, sanitizing or disinfecting, or security inspections after the end of their shift) For preliminary and postliminary work to be paid, it has to be “integral and indispensable” to the employee’s principal activities, or are required by law or company rules. This means an activity must be (1) “necessary to the principal work performed” and (2) “done for the benefit of the employer.” The employees claimed the required security screenings were intended to prevent theft and thus is an integral and indispensable part of the employer’s business. They argue that the time spent for security checks should, therefore, be paid as work hours. The appellate court agreed

that the employees may state a claim for back wages. The employer then appealed to the U.S. Supreme Court. The high court has agreed to review the appellate court’s decision. The case is still pending. Twenty-five extra minutes may not sound like a lot. However, if it occurs regularly over several years, the additional wages owed to the employee may be significant. Moreover, if it happens to several employees, then the employer has saved on labor costs, at the expense of its workers. Employees who spend time under their employer’s control before or after their scheduled shifts should not take their time for granted. They should inquire with experienced employment attorneys to determine if additional wages are owed to them under the law. [C. Senators: ‘Real work’ to start after signing of GPH-MILF peace deal

MANILA, Mar 27 (Mabuhay) – With the final peace pact between the Philippine government and the Moro Islamic Liberation Front (MILF) set to be inked on Thursday afternoon, senators are preparing for the work of passing a law that will embody the agreement. Senator Antonio Trillanes IV, Senate defense committee chairman, said he is anticipating the signing of the comprehensive peace deal with “guarded optimism.” “As a legislator, I have to make sure that this peace accord would not create a bigger mess than it intended to resolve, and that the interests of the other stakeholders are protected as well,” Trillanes said in a text message. The administration senator added that he will give the peace pact “all the support it needs,” since it is President Benigno Aquino III’s “legacy program.” Trillanes, a former Navy officer, earlier said that the Bangsamoro Basic Law, which will be deliberated upon by Congress after the signing of the accord, should be made more inclusive to accommodate some groups “left out” during the peace talks. After 16 years of negotiations, the government and the MILF are set to sign a comprehensive peace agreement at the Malacañang Palace grounds on Thursday afternoon. The signing of the historic peace deal is expected to be witnessed by over a thousand people from both parties, as well as foreign dignitaries led by Malaysian Prime Minister Najib Razak. After the deal is signed, Congress is tasked to pass a law creating the Bangsamoro political entity, which will replace the current Autonomous Region in Muslim Mindanao (ARMM). The legislation is currently being drafted by the Bangsamoro Transition Commission (BTC). Real work ahead Senator Francis Escudero, meanwhile, said that the “real work” to achieve peace in Mindanao comes after the signing of the Bangsamoro peace pact. “I am hopeful that the signing of this agreement will indeed pave the way for lasting peace. The signing though marks not the end, but the start of the real work towards achieving real peace that is merely written in those agreements,” Escudero said in a text message. Senator Grace Poe also said that the peace deal is only an “initial step” toward stability in southern Philippines, which has suffered from decades of armed conflict between government troops and Moro rebels. “The path to peace pursued by this accord requires the unwavering efforts of our people and our leaders to achieve our desired gains,” Poe said in a statement. “We must guarantee a meaningful autonomy that values democracy and takes into consideration the needs and aspirations of the Bangsamoro people under one sovereign Filipino nation,” she added. Senator Nancy Binay, an opposition lawmaker, for her part, pledged to give “utmost priority” to the bill that will be submitted by the BTC. “Lasting peace in Mindanao is what we are praying and working for. I am hoping that the historic signing will end the decades-long conflict, as the MILF has decided to lay down their arms. The signing is a big step towards the peaceful resolution of the conflict in the southern island of Mindanao, which is home to almost 22 million Filipinos,” she said in a statement. (MNS)

Joma Sison on Tiamzons’ arrest: It may be the last straw UTRECHT, The Netherlands, Mar 27 (Mabuhay) – Communist Party of the Philippines (CPP) founder Jose Maria Sison warned President Benigno Aquino III of the serious implications that may result from the government’s supposed violation from previous agreements, the latest of which being the arrest of Benito and Wilma Austria Tiamzon. The Tiamzons, consultants of the communistled National Democratic Front of the Philippines (NDFP), are protected under the Joint Agreement on Safety and Immunity Guarantees (JASIG), according to Sison, referring to an agreement signed in 1995 by the NDFP and government panels. The agreement provides safety and immunity protection for all participants of the peace negotiations, including panelists, consultants, members and staff of both panels. “I hope that the President will think hard about what he’s doing. While he might believe that he will benefit more from arresting and imprisoning political consultants, truth is, it is better for the country when peace negotiations continue. Does he want to be known in history as the President who killed the peace negotiations?” Sison, who has been in exile here for years, explained in Filipino. “The President says he wants to continue with the talks but his actions prove otherwise. While the NDFP does not want to be the one terminating the talks, it is a prerogative that it can take. The arrest of the Tiamzons might be the last straw,” he continued. NDFP peace panel chairman Luis Jalandoni seconded Sison’s declaration. “It might come to the point that the NDFP itself will issue a notice of termination. It is a prerogative of the NDFP as it is also a prerogative of the GRP: to declare the termination of the JASIG and the peace negotiations. But right now, we are awaiting for recommendations, suggestions, requests from the

grassroots. It will have to be a collective decision that will have to be taken very seriously,” he said. Sison and Jalandoni continued to call for goodwill from Aquino, citing an incident in 1994 when Wilma Austria was first arrested. Being under the protection of JASIG, then-President Fidel V. Ramos visited her in the hospital and released her within two weeks. “President Fidel Ramos had the statesmanship to recognize the importance of the peace negotiations that would take place the following month, June 1994 and released Wilma Austria. Now, President Aquino of the government of the Philippines appears to be more interested in imprisoning a few leaders of the revolutionary movement than giving priority to the peace negotiations and complying with the solemn agreement, bilateral agreement, the JASIG,” recalled Jalandoni. He also clarified that it is a mistake for some members of the government panel to say that the JASIG is no longer in operation because the talks are currently on hold. “Alex Padilla or Secretary [Teresita] Deles cannot declare the JASIG inoperative because it is an agreement signed by the panels and approved by the principals. They refuse to comply with it giving various excuses in effect violating the spirit of the JASIG. This most seriously prejudices the peace negotiations,” said Jalandoni. Padilla head the government panel in the peace negotiations with the NDFP, while Deles is the presidential adviser on the peace process. The NDFP has 87 protected individuals under the JASIG. About 25 of whom have been arrested, imprisoned or assassinated. They all carry identification documents that state their names or pseudonyms, identification numbers and pictures signed by Jalandoni and letters of acknowledgment by then government panel Silvestre Bello. Key points on peace pact MANILA, March 27, 2014 (AFP) – The Moro Islamic Liberation Front ended four decades of armed struggle in the Philippines on Thursday when it signed a peace pact with the government. Here are key facts on the MILF and the peace deal: MILF: The MILF has about 10,000 armed followers, according to the military, which makes it easily the biggest Muslim rebel group in the Philippines. It has long fought for an independent homeland for the nation’s Muslim minority to be carved out of the southern Philippines. It split in the 1970s from the-then main rebel group, the Moro National Liberation Front (MNLF). The MNLF had agreed to autonomy, and founding MILF leader Hashim Salamat was intent on fighting for independence. Internal rivalries were another reason for the split. PEACE PACT: TITLE: Called the “Comprehensive Agreement on the Bangsamoro”. The Bangsamoro refers to people who at the time of Spanish conquest and colonization were considered natives or original inhabitants of the southern Philippines. Their descendants and spouses are recognized as Bangsamoro people. Bangsa is a local word for nation. Moro derives from the term “Moors” used by Spanish colonialists to refer to Muslims. AUTONOMY: The MILF drops its claims for a separate state in the southern region of Mindanao and settles for parliamentary self-rule in the Bangsamoro autonomous region. This will be established by 2016. The Bangsamoro will replace another Muslim autonomous region that was brokered in the 1990s with the MNLF, which the government says has failed. DISARMAMENT: The MILF will “gradually”

decommission its forces and put the weapons “beyond use”. A local police force will assume law enforcement functions from the Philippine police and military. POWERS: The Philippine government will retain exclusive powers on defence, foreign policy, currency and citizenship matters. TAXES/REVENUES: The autonomous government will receive 75 percent of all local taxes, fees and charges, 75 percent of revenues from metallic minerals and control of fishing areas up to 12 nautical miles from the coastline. ISLAMIC LAW: The region will not be an Islamic state, rather a secular government. Sharia law will apply only to Muslims and only for civil cases, not for criminal offences. All residents are guaranteed basic rights to life, movement, privacy, and freedom of religion and speech. TERRITORY: To cover five provinces, plus two cities, six towns and 39 villages in the south, comprising about 10 percent of the Philippines’ total land area. ENABLING LAW: Philippine President Benigno Aquino will seek to steer through parliament a “Bangsamoro Basic Law” for the autonomous region by the end of this year. PLEBISCITE: People living in areas to be included in the autonomous region will need to ratify the law in a plebiscite to be held in 2015. TRANSITIONAL AUTHORITY: After the basic law is approved and ratified by the plebiscite, a 15-member “Bangsamoro Transition Authority” will govern the region until a regional parliament is elected. Aquino appoints the members of the transitional authority, but the MILF will have a majority and the chairman. ELECTIONS: A regional parliament, expected to have 50 seats, is to be elected in conjunction with national elections in May 2016.

Obama signs Philippine Charitable Giving Assistance Act WASHINGTON, D.C. – United States President Obama today signed into law a legislative measure that would allow American taxpayers to claim deductions for donations they made to support relief and rehabilitation efforts in the Philippines in the aftermath of Typhoon Haiyan. The enactment of the Philippine Charitable Giving Assistance Act, which would also allow US taxpayers to continue making tax-deductible donations to typhoon victims in the Philippines until 15 April, was immediately welcomed by the Philippine Embassy. “The immediate signing by President Obama of the Philippine Charitable Giving Assistance Act underscores the importance the US Government places on the immediate recovery of typhoon-devastated areas in the Philippines,â€? Ambassador Jose L. Cuisia, Jr. said. The Ambassador thanked President Obama for his prompt action on the measure and lawmakers led by Hawaii Sen. Mazie Hirono and California Rep. Eric Swalwell and their cosponsors for

introducing the measure and ensuring its passage in Congress. “I wish to reiterate the profound gratitude of the Philippine Government and the Filipino people for the generous outpouring of support and solidarity by the US Government and the American people to the victims of Typhoon Haiyan,� Ambassador Cuisia said. The Embassy said the new law was introduced in the House of Representatives by Congressman Swalwell and was co-sponsored by 35 congressmen – 26 Democrats and nine Republicans. It was unanimously passed as House Resolution 3771 on Monday. On the other hand, Senate Resolution 1821, sponsored by Senator Hirono, and supported by Majority Leader Harry Reid and Foreign Relations Committee Chair Robert Menendez, among others, was passed on 6 March. The Embassy, quoting the Office of Senator Hirono, said the new law would allow taxpayers who donate to the relief efforts in the Philippines after the President’s

signature on 25 March and before 15 April 2014 to take the charitable deduction when they file their 2013 tax returns. Taxpayers who donate in this timeframe but have already filed their taxes can amend their tax returns to receive these benefits this year. Without this law, taxpayers can claim a tax deduction for contributions they make to charities, but they receive the tax incentive many months later after they file their tax returns the following year. The law eliminates this delay. Meanwhile, the National Federation of Filipino American Associations (NaFFAA) has commended the U.S. Congress for passing a bill allowing American taxpayers

to deduct from their 2013 taxes any charitable donations to the relief of Typhoon Haiyan victims in the Philippines. In a news released, NaFFAA also thanked President Obama for promptly signing the bill into law. “In addition to what the U.S. has already provided, in terms of massive relief and assistance, this latest action is a welcome opportunity for U.S. taxpayers to express their generosity and humanitarian concern for the millions of people whose lives have been adversely disrupted,� said NaFFAA National Chairman Ed Navarra. “We appreciate what this means to the Filipino people who need our support during their difficult period of recovery.�

US top court rules domestic abusers can’t own guns WASHINGTON, March 26, 2014 (AFP) – The US Supreme Court upheld a federal law Wednesday barring anyone convicted of even a minor domestic violence charge from ever owning a gun. In a unanimous ruling, the nine justices ruled against James Castleman, who argued that his past conviction in Tennessee of misdemeanor domestic assault against the mother of his child shouldn’t keep him from owning a firearm under federal law. Castleman had been charged with illegal possession of a firearm when he and his wife were later accused of trafficking weapons on the black market. One of these weapons was found at the scene of a crime in Chicago. An appeals court in Tennessee had agreed with Castleman’s contention that the Tennessee definition of misdemeanor domestic assault is less strict than the federal one, and that the incident for which he was convicted did not include physical force as described under the federal law. But the Supreme Court overruled that decision. Progressive Justice Sonia Sotomayor said Castleman’s arguments “are unpersuasive� and the court saw “no anomaly in grouping domestic abusers convicted of generic assault or battery offenses to-

gether with the others whom (federal law) disqualifies from gun ownership.� The top court thus upheld the federal law on gun ownership, which is more strict than those of most states. “Women and children are safer today because of the decision by the Supreme Court to enforce the federal law barring domestic abusers from possessing guns as it was intended,� said John Feinblatt, chairman of Mayors Against Illegal Guns. Dan Gross, the president of the Brady Campaign to Prevent Gun Violence, said the ruling “will save countless lives by keeping guns out of the hands of domestic abusers.� “It also reaffirms that guns and domestic violence are a deadly mix, and that we need to make it harder, not easier for dangerous people to get guns,� he added. The decision comes as members of Congress have proposed to strengthen background checks for people trying to buy guns. Efforts so far, however, including those backed by President Barack Obama, have failed to gain traction. In a different case, the top court is soon expected to rule on the legality of buying a gun on behalf of another person whose background check was not previously carried out.

Asian advocate group calls for better college opportunities for all Californians LOS ANGELES – Today, Asian Americans Advancing Justice - Los Angeles called on the leadership of the state legislature to expand educational opportunity for all California students, especially those who are disadvantaged and underserved, in light of the news that, upon the request of State Senator Ed Hernandez, Assembly Speaker John Perez has sent Senate Constitutional Amendment (SCA) 5 back to the Senate without taking action on the bill. News stories also reported that Speaker Perez and Senate President pro Tem Darrell Steinberg plan to create a task force to examine admission to California’s public universities. In response, Advancing Justice - LA released an open letter to Speaker Perez, Senate President pro Tem Steinberg, and other members of the state legislature urging the legislature to focus on expanding educational opportunities for all California students.

“After decades of disinvestment, California’s public colleges and universities are in crisis,� said Stewart Kwoh, president and executive director of Advancing Justice-LA. “Now is the time for a broad, bold, and inclusive solution to this problem – one that must necessarily expand the pie for all California students such as through expanding college slots, instead of just redistributing currently limited resources.� The open letter calls on the legislative leadership to appoint a joint legislative committee that addresses the broader issues of educational access and success, instead of focusing narrowly on admissions. Advancing Justice - LA also urges the speaker and Senate president pro tem to appoint a committee that reflects the diversity of the state – including Asian Americans and Pacific Islanders – and to hold hearings throughout the state, to ensure a broad range of input. “In the past five years,

Chosen by the Kapuso Village Housing Committee composed of representatives from GMAKF, the City Social Welfare and Development, Housing and Resettlement office, City Mayor’s Office, and barangay council, the beneficiaries are primarily those whose houses were completely destroyed by the typhoon. The turnover marks the completion of the 180-unit housing project in the city. Phase I of the project, composed of 120 units in Purok 17, Barangay Mandulog was turned over last April 2013. Each unit is typically designed with a fiber-cement board ceiling, a paved front deck, toilet and bath, a paved laundry area, and provisions for bedroom, living, dining and kitchen facilities. The units were also supplied with home appliances donated by Hanabishi. A community tree-planting was also held on the same day, with staff and volunteers from GMAKF, Phase 1 and Phase 2 beneficiaries, and members of the barangay council planting 350 seedlings along the riverbank near the resettlement area. GMAKF has had numerous rehabilitation projects in the city to address the devastation left by typhoon Sendong. Among these are the construction of a 10-classroom school building in Mandulog Elementary School, and the drilling and installation of a deepwell water facility in Sitio Cabaro, and a Jet-matic handpump in Purok 6, both in Barangay Upper Hinaplanon. Another 2-classroom structure was also erected in the Deus Caritas Village Phase II in Barangay Upper Tominobo, Iligan City. Extra weight in older adults could mean a longer life (Relaxnews) – A new study suggests that current body mass index (BMI) recommendations may be unsuitable for older adults. Caryl Nowson, a professor of nutrition and aging at Deakin University, led a research team that examined the relationship between BMI and risk of death in people 65 and older. The findings indicated the lowest risk was among those with a BMI of about 27.5, which is considered overweight by the World Health Organization. Mortality was said to increase “significantly” among those with a BMI between 22 and 23, the normal weight range. “It is time to reassess the healthy weight guidelines for older people,” Professor Nowson said. “Our results showed that those over the age of 65 with a BMI of between 23 and 33 lived longer, indicating that the ideal

body weight for older people is significantly higher than the recommended 18.5-25 ‘normal’ healthy weight range.” The research team reviewed studies published between 1990 and 2013 that reported on BMI and death risk in people 65 years and up. These studies followed 200,000 people over a 12-year period. Results found death risk increased 12 percent when BMI was between 21 and 22, or the healthy weight range. It increased by 19 percent when BMI was between 20 and 20.9, which is still considered within normal range. However, those with a BMI of 33 to 33.9, or the obese range, had an 8 percent increased risk. “These findings indicate that, by current standards, being overweight is not associated with an increased risk of dying,” Professor Nowson said. “Rather it is those sitting at the lower end of the normal range that need to be

monitored, as older people with BMIs less than 23 are at increased risk of dying.” The professor also noted factors other than BMI need to be considered in terms of ideal body weight. “Rather than focussing on weight loss, older people should put their efforts into having a balanced diet, eating when hungry and keeping active.” Research was published in the American Journal of Clinical Nutrition. Cardiovascular and cancer risks are still higher for those who are overweight. This new study also didn’t take into account factors such as smoking and illness, which can leave people thinner but not healthy. A study published last month in the journal PLOS ONE that looked at the above factors found that a BMI of 22.5-24.99 was the most favorable for mortality risk.

Increasing protein intake may benefit older women (Relaxnews) – A preliminary new study from Purdue University suggests that older women may benefit from eating a diet featuring 29 percent more protein than what’s recommended by current US nutritional guidelines. Current daily recommended protein intake in the US for all women 19 and older is .36 grams for each pound of body weight. If a woman weighs 130 pounds, for example, she requires 46 grams of protein per day. “The current dietary reference intakes for elderly adults rely on data collected from younger people and extrapolated to include elderly people. Also, the scientific method used for the last 50 years to determine protein needs is not an ideal technique for older adults,” said nutrition science professor and dietary protein/ health expert Wayne W. Campbell, who worked with scientists to develop a non-invasive method for testing protein levels. Called the indicator amino acid oxidation method, the test has already been used in children

and young men. For the study, six women ages 80 to 87 years drank beverages featuring 20 amino acids on seven different testing days throughout a three-month period. Amino acid amount in the beverages changed each testing day. Breath tests measured trace isotopes, and urine samples were periodically collected during each eight-hour testing session. “When you don’t have enough of these amino acids in your diet, your body will not be able to produce as much protein,” Campbell said. “When these women ate small amounts of the amino acids, the amount of carbon dioxide containing the tracer isotope was higher in their breath because the phenylalanine was being broken down instead of being used to make proteins. As the amounts of amino acids increased, the amount of carbon dioxide with the tracer was lower because their bodies were able to synthesize more proteins.” Since older adults experience natural muscle loss,

Campbell notes it’s important to determine exactly how much protein they require. Losing muscle causes weakness and instability that can easily impair daily physical abilities and make falling more likely. “As people get older, they need fewer calories so they eat less food and they eat less protein,” Campbell said. “The proportion of calories with protein stays constant unless you dramatically change eating habits, which few people do. More research is needed to determine the best amount of protein for people older than 70 to consume to help retain their functional abilities and health.” The study was published in American Journal of Clinical Nutrition. A study published last month in the journal Cell Metabolism found low animal protein intake among the middle-aged decreased cancer risk, among other adverse health effects, but said that increased protein consumption might protect people over the age of 65.

Olongapo students help shape positive picture of PHL in US WASHINGTON, D.C. – Nine public school students from Olongapo City are helping shape a positive picture of the Philippines and strengthen people-topeople ties with the United States through an educational exchange program with the city of Virginia Beach in Virginia. The nine students make up the first delegation from Olongapo to participate in an exchange program under a sister city agreement with Virginia Beach that was made possible with the help of Ambassador Jose L. Cuisia, Jr. and the Philippine Embassy. The nine students from the Regional Science High School (RSHS) and Olongapo City National High School (OCNHS) arrived in Virgnia Beach last week to participate in the exchange program with Tallwood High School. They are accompanied by Councilor Jong Cortez and teachers Miguel Esporas and Lovella Jarobel. The students, who are staying with foster families in Virginia Beach, are: Thea Ysobel Cortez, Frezniel Bien Salinas, Jonas Exequiel Soriano, John Daniel Mendoza, Ethan Arcelao, Keana McCoy, Via Ronquillo, Juliana Mendoza and Dainty Jewel Manuel. The students paid a courtesy call on Ambassador Cuisia, who initiated the exchange between during a visit to Tallwood High School in Virginia Beach last year. During their call, the students told the Ambassador that aside from discussing Philippine history and culture, they also try to get their American classmates to learn more about the country through song and dance. “I wish to congratulate you, your parents, your schools, and Olongapo City for this milestone in your young academic

lives. I hope youth exchanges like these help build friendships between students, families, schools, and cities as well as renew and reinvigorate our bilateral ties with the United States,” Ambassador Cuisia said. The envoy, who initiated the successful Filipino-American Youth Leaders Program that brings young Filipino-American leaders to the Philippines for discussions with government officials and private sector leaders, said he wanted to come up with a program for the younger generation. “During our visit to Virginia Beach, I learned about the existing program they have with countries like Germany, Israel, and Indonesia, and I expressed my desire to have something similar with the Philippines,” said Ambassador Cuisia. The delegation from Olongapo will be staying in Virginia Beach for two weeks before visiting other US cities. A delegation of 10 students from Tallwood High School will be going to Olongapo for the second phase of the exchange program in June. The Olongapo students, who attend daily classes at Tallwood, describe the experience as “once in a lifetime” and “rewarding.” They also noted some differences in the school system of the two countries. “In the Philippines, students stay put while teachers go around to different classrooms. Here in the US, teachers move from classroom to classroom,” said Keana, a 9th grade student from the Regional Science High School. “We were able to experience classes we don’t have in the Philippines, like French,” said Daniel, a 9th grader from Olongapo

H-1B petition filings begin April 1, 2014 USCIS expects 65,000 visa limit filled in just five days WASHINGTON – U.S. Citizenship and Immigration Services (USCIS) will begin accepting H-1B petitions subject to the fiscal year (FY) 2015 cap on April 1, 2014. Cases will be considered accepted on the date that USCIS receives a properly filed petition with the correct fee. USCIS will not rely on the date that the petition is postmarked. The congressionally mandated cap on H-1B visas for FY 2015 is 65,000. The first 20,000 H-1B petitions filed on behalf of individuals with a U.S. master’s degree or higher are exempt from the 65,000 cap. USCIS anticipates receiving more

than enough petitions to reach both caps by April 7. The agency is prepared to use a random selection process to meet the numerical limit. Non-duplicate petitions that are not selected will be rejected and returned with the filing fees. Due to the high level of premium processing receipts anticipated, combined with the possibility that the H-1B cap will be met in the first 5 business days of the filing season, USCIS has temporarily adjusted its current premium processing practice. To facilitate the prioritized intake of cap-subject petitions requesting premium

WASHINGTON, March 26, 2014 (AFP) – People who are hospitalized in the United States risk acquiring healthcareassociated infections, which kill 75,000 patients per year, US health authorities said Wednesday. Many bacterial infections – which can lead to serious complications from pneumonia and illnesses of the intestinal tract – could be prevented if healthcare workers practiced common hygiene, said the Centers for Disease Control and Prevention. “Although there has been some progress, today and every day more than 200 Americans with healthcare-associated infections will die during their hospital stay,” said CDC Director Tom Frieden. “The most advanced medical care won’t work if clinicians don’t prevent infections through basic things such as regular hand hygiene.” The data, published in the New England Journal of Medicine, came from 183 US hospitals in 2011. That year, the CDC survey found that about 721,800 infections occurred in 648,000 hospital patients. Some 75,000 patients with healthcareassociated infections died during their hospitalizations. The most common infections were pneumonia and surgical site infections (each at 22 percent), followed by gastrointestinal infections (17 percent), urinary tract infections (13 percent), and blood-

The Australian Human Rights Commission gained access to Australia’s main detention centre for asylum-seekers on Christmas Island as part of its National Inquiry into Children in Immigration Detention. Commission President Gillian Triggs said what the team – which included a paediatrician and a child psychiatrist— found was disturbing, with most of the 315 children there at the time having been held for six to eight months. They noted that most of the children were visibly distressed during their recent visit. The children told the inquiry “this place is hell”, “help me get out of here” and “there’s no school, nowhere to play and nothing to do,” the commission said.

To remove this condition, both spouses must file a form I-751 with the USCIS within 90 day period preceding the expiration of the conditional green card along with other supporting documents showing the marriage was entered in good faith. However, sometimes alien spouses

are not able to file this Joint Petition to remove the condition on their green card because the couple got divorced or are in the process of filing a divorce and is having difficulties getting the cooperation of the US citizen spouse. When the alien spouse falls into this situation, it is still possible for them to obtain their permanent green card by filing a waiver. The waiver must be based on one of the following reasons 1) Extreme hardship would result if such alien is removed 2) The qualifying marriage was entered in good faith by the alien spouse, but ‌ has been terminated (divorce), and the alien was not at fault in failing to timely file the joint petition and attend the interview; or 3) The qualifying marriage was entered into in good faith by the alien spouse and during the marriage the alien spouse or child was battered by or was the subject of extreme cruelty perpetrated by the US citizen parent or permanent resident spouse or parent and the alien was not at fault in failing to file the joint petition and attend the interview. KUALA LUMPUR, March 26, 2014 (AFP) – A US law firm said Wednesday it has initiated what it called the first civil legal proceedings over the crash of flight MH370 and said it planned to pursue lawsuits seeking “millions of dollars” for aggrieved families. Chicago-based Ribbeck Law Chartered said it filed a court petition in the US state of Illinois targeting Malaysia Airlines and Boeing, blaming the two companies for the disaster. “We are going to be filing the lawsuits for millions of dollars per each passenger based on prior cases that we have done involving crashes like this one,” its head of aviation litigation, Monica Kelly, told reporters in Kuala Lumpur. The development appeared to mark the start of what legal experts have warned could be a cascade of lawsuits by passengers’ relatives livid over the unexplained disappearance of their loved ones. The plane carried 239 passengers and crew. Kelly said her firm was also talking to several other relatives in China and Malaysia about taking similar action. Ribbeck in a statement said it had filed a “petition of discovery” in Illinois requesting a court to order defendants to provide potential evidence and other information. Pacquiao more motivated after Bradley’s taunts LAS VEGAS, March 25, 2014 (AFP) – Manny Pacquiao is taking extra motivation from taunts by unbeaten Tim Bradley that the Filipino boxing icon has lost the hunger and killer instinct he once displayed with great passion. “The more he says that, the more he inspires me to show the hunger and killer instinct he’s talking about,” Pacquiao said Tuesday. “It’s good for me but not for him I think.” Pacquiao, 55-5 with two drawn and 38 knockouts, will fight Bradley, 31-0 with 12 knockouts, for the American’s World Boxing Organization welterweight title in Las Vegas on April 12. The fight will be a rematch of a controversial Bradley victory by split decision in June of 2012 in which all three judges scored the fight 115-113, two of them for Bradley in what was seen as a robbery from Pacquaio. “You don’t get mad. It’s part of life,” said Freddie Roach, Pacquaio’s trainer. “Revenge is great. That’s what we have a chance to do here. If everything goes right we will knock this guy out.” Bradley has noted how Pacquiao has not stopped a foe since Miguel Cotto in 2009 and has not won a fight inside 12 rounds since dropping Ricky Hatton nearly five years ago, helping rekindle the fires inside the 35-year-old Asian southpaw. “I’m not angry or disappointed at what he told me. I’m happy he told me that,” Pacquiao said. “It inspired me to

train harder and focus on the fight. It will benefit me. “I have not lost the hunger. Sometimes we knock the guy out and sometimes not.” Pacquiao said he sees no more need for a knockout than usual even after the controversial loss to Bradley in their first meeting. “We’re not focusing on the knockout,” Pacquiao said. “The focus is on being more aggressive, throwing more punches. If that outcome comes, it’s fine. I just want to prove that I can have the killer instinct.” ‘we’ll be able to stop him’ Roach says Pacquiao relaxed late in the prior fight after dominating early rounds, he thought, on the judges’ scorecards. This time, there will be no coasting as the 12-round fight goes on. “It was so easy for him in the early rounds,” Roach said. “In the later rounds he wasn’t throwing combinations. He was throwing single punches because he had done so well in the earlier rounds. “We need to be a little more aggressive in this fight. I think if we fight at an aggressive pace in this fight I think we will be able to stop him somewhere along the way. Whatever Bradley brings to the table we’ll be ready.” But, Roach cautions, that does not mean seeking a knockout to appease taunts by Bradley and forget strategy and planning. “We don’t go into fights looking for knockouts. If they come they come,” Roach said. “We’re planning to beat him

NEW YORK, March 28, 2014 (AFP) – General Motors, already facing strong criticism and investigations over its handling of ignition-related recalls, abruptly halted Friday dealer sales of some models of its Chevrolet Cruze compact. No reason was given for the move, which focuses on 2013 and 2014 Cruzes with 1.4 liter turbo diesel engines, according to a GM spokesman. Nor was there any specific information about the number of cars involved, but the model has been popular among people seeking high fuel efficiency. The spokesman said it sold nearly 250,000 Cruzes in all models in 2013, with the turbo “a fraction” of the total. The move comes as GM faces Justice Department and congressional probes into why it took years to recall a number of car models which it knew had dangerous problems with their ignitions. The automaker said 12 people died and more than 30 accidents occurred in relation to the problem, in which the ignition can turn to the off position while driving, shutting down key electrical systems including airbags. Under new chief executive Mary Barra, GM has tried to demonstrate that it moving quickly now on safety issues, announcing a separate recall on March 17 over issues separate from the ignition problem.

Strike-hit Toyota India resumes ‘limited operations’ BANGALORE, March 25, 2014 (AFP) – Japan’s Toyota said in a statement Tuesday that it had resumed “limited production” after unionized employees at its Indian plant refused to return to work following an end to a company lockout. The Toyota workers and the company’s management at two plants near the southern Indian high-tech city of Bangalore are at loggerheads over pay issues, which they have been negotiating for 10 months. “We have started limited operations with the help of non-unionized team members of whom the majority are engineers and supervisors,” Toyota said in the statement issued late Tuesday. However, union president Prasanna Kumar said: “Instead of resolving the issue amicably, management is misusing apprentices to make them work and has

hired contract labor to do our job, which is skilled and involves stringent processes to ensure quality.” Toyota said there was no truth to the union’s claims that it was using apprentices to make the cars or had hired extra nonunionized labour. The unionized employees refused to resume work after the company lifted the eight-day lockout on Monday. The carmaker had said workers could return from Monday provided they signed a good conduct pledge, after suspending some workers over accusations they halted production and made threats to supervisors. Kumar said the workers were refusing to sign the good conduct promise because “it falsely implicates some employees as responsible” for misconduct that resulted in the lockout.

Toyota Kirloskar Motor Private Ltd is the Indian unit of the world’s biggest carmaker. Its Bangalore complex produces some 310,000 autos annually, including Toyota’s flagship Camry sedan, the Corolla, and the Prius hybrid, mostly for the domestic market. Toyota’s union has demanded a pay hike of at least 4,000 rupees ($65) a month, while the company is offering 3,050 ($50), citing tough market conditions with Indian car sales set to fall for a second year in a row. Toyota has ruled out any compromise with the workers. “Discipline is required when you are in an industrial environment with a large number of workers. They need to obey rules,” Toyota Kirloskar Motors Vice
