PHL recalls envoy amid new China sea dispute MANILA, September 5, 2013 (AFP) – The Philippines has called home its ambassador to China for consultations, the foreign department said Thursday amid fresh tensions in a long-running maritime territorial dispute. Foreign department spokesman Raul Hernandez announced ambassador Erlinda Basilio’s trip after the defense department accused China of laying 75 concrete blocks on the disputed Scarborough Shoal in the South China Sea. Defense officials have expressed concern this could be a prelude to building structures at the shoal, 220 kilometers (135 miles) off the main Philippine island of Luzon and within the Philippines’ internationally recognized exclusive economic zone. “She was asked to come home for consultations and will return to Beijing in a few days,” Hernandez told AFP. Speaking to reporters earlier Thursday,

he would not say if Basilio was called home solely because of the alleged Chinese block-laying. The Philippine foreign ministry earlier said President Benigno Aquino had called off a planned trip to China on Tuesday for a trade fair after Chinese authorities imposed conditions on his visit. Hernandez said Manila was still studying whether to lodge a diplomatic protest or consider other options regarding the alleged Chinese activity at the shoal. Chinese foreign ministry spokesman Hong Lei rejected the Philippine allegations on Wednesday, while asserting his country’s sovereignty over the shoal. The outcrop is about 650 kilometers from Hainan island, the nearest major Chinese land mass, but China claims most of the South China Sea including waters near the coasts of its neighbors. MANILA, August 31, 2013 (AFP) – The United States wants to use Philippine bases for extended periods of up to 20 years, a Manila official said Saturday as the two sides are in talks on a wider US military footprint in Asia. The negotiations aim to allow more U.S. troops, ships, aircraft and other equipment to pass through the Philippines, which had hosted tens of thousands of U.S. troops until 1992. “For the Americans, they typically have agreements like these that have a duration of 20 years. Right now, the Philippine delegation is looking at a much shorter duration,” negotiator Carlos Sorreta, a Philippine assistant foreign secretary, said in statement. He gave no specific time frame for the Philippine counterproposal, with the statement adding the “substantive issue of duration” would be “subject to further discussion”. Asked by AFP on Saturday to confirm if the U.S. negotiators had proposed a 20-year agreement with Manila, American embassy spokesman Kurt Hoyer declined to comment. In light of ‘pork’ irregularities, COA urged to hire more auditors MANILA, Sept 6 (Mabuhay) – The Commission on Audit (COA) should hire more state auditors to be able to scrutinize more government agencies, a Senate leader said Friday. Senate Pro-Tempore Ralph Recto said the COA can tap as much as P2.2 billion in the proposed 2014 budget to beef up its current workforce. “If the Ombudsman’s staff is being strengthened, if internal affairs units in the police and the military are being beefed up, then all the more that COA, the public’s whistleblower, must have more personnel,” Recto said in a statement. The COA recently uncovered irregularities in the use of pork barrel funds, including excessive releases to some legislators and the funneling of these funds to legitimate non-government organizations. The COA, a constitutional body with the power to scrutinize all government revenues and expenditures, has a proposed budget of P8.4 billion for next year. According to its budget submission to the Senate, the COA is tasked to audit 19,081 agencies, but only has over 8,734 personnel for 2013. The COA aims to hire 1,000 more employees next year, based on its 2014 spending plan. “Even if COA achieves full staff complement, that would still be below the 1:1 personnel to office ratio,” Recto said. Recto further proposed that the COA “grant additional pay” to state auditors to encourage more accountants to join the commission’s workforce. (MNS)

Palace smells malice, clears Roxas of pork misuse MANILA, Sept 5 (Mabuhay) -- Malacañang smells malice in attempts to tag Department of Interior and Local Government (DILG) Secretary Mar Roxas in the pork barrel scam. Reacting to a report about the Commission on Audit (COA) special audit report, the Palace cleared Roxas of any misdeed and asked instead the concerned NGO to answer why part of the funds were used to give financial assistance to its employees. Presidential spokesperson Edwin Lacierda stressed that Roxas’ name was not among those with unliquidated funds nor associated with bogus NGOs linked to Janet Lim Napoles. “Any responsible reading of the COA report will show: Secretary Mar is not on the unliquidated list; he is not on the self-created NGO list; he is not on the fake or ghost NGO list; he is not the Napoles-related list. In fact, he is not on any list that points to anomaly,” Lacierda said. Lacierda added Roxas is willing to provide documents that would shed light to the use of his Priority Development Assistance Fund (PDAF) when he was still senator. “Si Secretary Mar Roxas, as we understand, is very transparent… If there are any documents that are requested from him, he is willing to provide,” Lacierda said. “This only a P5-million fund that was being stated. I don’t know why this is being made an issue so… In his years of public service, Secretary Mar Roxas has never been tainted with any allegation of anomaly. Palace eyes BIR move requiring display of professionals’ fees MANILA, Sept 5 (Mabuhay) – Malacañang is still studying the proposal to require doctors, lawyers, dentists, accountants, engineers, architects, real estate brokers and other self-employed individuals to disclose their professional fees, a Palace official said Thursday. “The proposal is currently being studied, and already the PH Medical Association has agreed to follow BIR’s proposal to post the rates,” deputy presidential spokesperson Abigail Valte said in a text message to reporters on Thursday. She issued the statement after Internal Revenue chief Kim Jacinto-Henares said the agency will issue a memorandum circular requiring professionals to post a price list of their services prominently in their respective offices. Complaints by irate clients prompted the BIR to come up with the circular, according to the BIR chief, noting some doctors were charging exorbitant fees and additional charges when patients ask for an official receipt. Dead whale shark washes ashore in Cavite MANILA, September 5, 2013 (AFP) – A dead young whale shark has washed ashore in Manila Bay near the Philippine capital, far from the endangered giant fish’s traditional feeding grounds, fishermen and a wildlife official said Thursday. The five-meter (17-foot) corpse took locals by surprise in Tanza, a fishing district near the mouth of the bay, fisherman Edgar Biri told AFP. “It was near the shore, we thought it was some kind of a deadly shark,” he said. “When we approached, we saw it was not moving anymore.” Local fisheries bureau veterinarian Marco Espiritu said he would examine the 300 kilogram (660 pound) carcass to determine the cause of death. “It is unusual to see whale sharks around these parts,” he told AFP. “Their migratory patterns are far from here, but it may have been following food that’s why it came into the bay,” he added. In 2009, he said a dead whale shark about the same size was found at a busy wharf on Manila Bay. Whale sharks (Rhincodon typus), the largest fish species in the world, are slowmoving creatures that can reach 12 meters in length and weigh more than 20 tons, feeding mostly on plankton, small fish and crustaceans.

Solon proposes construction of Pacific Palisades superhighway Route will connect eastern provinces from Bicol to Cagayan MANILA, Sept. 5 (Mabuhay) – The construction of a superhighway linking the provinces of Bicol, Quezon, Aurora, Quirino, Isabela and Cayagan is one of the solutions to decongest Metro Manila, according to a lawmaker. “A superhighway linking the provinces of Bicol, Quezon, Aurora, Quirino, Isabela and Cagayan will cut transportation time and hence facilitate trade among them. Increased trade in these provinces will mean decongestion of Metro Manila because of lesser migration to find better jobs,” said Rep. Aleta Suarez (2nd District, Quezon), author of House Bill 331. Suarez said the Aurora and Cagayan Ecozones linked together means an attractive Pacific side international trading

center. “Overall, the potential positive impact of this project will not only redound to the six provinces involved but to the whole country,” Suarez said. In filing the bill, Suarez cited the policy of the State to prioritize infrastructure projects intended to stimulate and catalyze economic and entrepreneurial activity and development in underdeveloped rural and countryside areas in order to raise the standard of living and improve the quality of life for those living in and by these provinces. “It is also the declared policy of the State to encourage and promote a dynamic and mutually advantageous public-private sector partnership in undertaking major

DND to pursue acquisition of 21 refurbished ‘Huey’ helicopters MANILA, Sept. 6 (Mabuhay) – Despite the failure of the third bidding for the 21 UH-1 “Huey” helicopters for the Air Force, the Department of National Defense (DND) on Friday announced that it will still continue with the program. “While it is unfortunate that we have to declare the (failed) bidding, we are still going to pursue the implementation of this project,” DND undersecretary for finance, munitions, installation and materiel Fernando Manalo said. The lone bidder for the project, the joint venture of Rice Aircraft Services Inc. and Eagle Copters Ltd., was declared ineligible to bid due to its failure to satisfy some documentary requirements.

Pinoy brothers charged in gun smuggling ring One is NYPD officer, the other a Customs and Border Protection officer at LAX; A third brother in PHL also charged in trying to obtain assault, sniper rifles bound for PHL Federal agents have arrested Rex Maralit, a New York City Police Officer assigned to police headquarters in Manhattan, and his brother Wilfredo Maralit, a Customs and Border Protection Officer assigned to Los Angeles International Airport, pursuant to arrest warrants issued in the Eastern District of New York. The two men, along with a third brother, Ariel Maralit, are charged with conspiring to violate the Arms Export Control Act by exporting high-powered weapons from the United States to the Philippines without a license from the U.S. State Department, and with conspiring to engage in unlicensed firearms dealing. The government is coordinating with foreign authorities regarding the apprehension of Ariel Maralit. The arrests were announced by Loretta E. Lynch, United States Attorney for the Eastern District of New York; James T. Hayes, Jr., Special Agent-in-Charge, U.S. Immigration and Customs Enforcement’s (ICE), Homeland Security Investigations (HSI), New York; Craig W. Rupert, Special Agent-in-Charge of the Defense Criminal Investigative Service (DCIS); Joseph Anarumo, Jr., Special Agent-in-Charge, Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF), New York Field Division; and Raymond W. Kelly, Commissioner, New York City Police Department (NYPD). According to the complaint, between January 2009 and March 2013, the defendants engaged in a scheme to smuggle high-powered assault rifles, sniper rifles, pistols and firearm accessories from the United States to the Philippines, where they were sold to overseas customers. Ariel Maralit, who resides in the Philippines, identified customers and sought the assistance of his brothers, both American law enforcement officers, to purchase and ship the weapons for resale overseas. In response to customer orders from the Philippines, the defendants located weapons advertised on firearms-brokering websites and made arrangements to purchase the guns through dealers in the United States. They then disassembled the weapons and smuggled them out of the United States in disguised shipments. According to the complaint, none of the defendants obtained export licenses or federal firearms licenses in connection with the weapons they sold. Instead, they used their knowledge of firearms and their status as law enforcement officers to engage in an illegal international arms trafficking business. On several occasions, the defendants used their law enforcement credentials to obtain discounts on weapons from U.S.-based gun dealers. For example, in an email dated June 21, 2012, Rex Maralit asked a U.S.-based gun dealer whether the dealer had a Special Operations Combat Assault Rifle (“SCAR�) in stock. Upon learning that the dealer had such a weapon available, Rex Maralit requested that the dealer hold the high-powered assault rifle until the following Monday, adding, “One other question do you give discounts to LEO, I am an active PO with the NYPD, please advise.� “LEO� is a common abbreviation for “Law Enforcement Officer,� and “PO� refers to “Police Officer.� The powerful and dangerous firearms that the defendants illegally exported and sold include the Barrett M82A1 .50 caliber semi-automatic rifle, the SCAR, and the FN Herstal 5.7mm semi-automatic pistol. For example, the Barrett M82A1 .50 caliber semi-automatic rifle is a long-range, weapon capable of penetrating body armor, exterior walls of buildings, and even aircraft. The Barrett rifle is favored by specialized military forces due to its extraordinary power and range. The SCAR is a military rifle designed in 2004 at the request of the United States Special Operations Command for a new family of assault rifles to be used by U.S. Special Forces. The FN Herstal 5.7mm semi-automatic pistol is a high-capacity, battlefield weapon capable of firing a projectile

Whistle-blowers answer Napoles’ perjury raps MANILA, Sept 4 (Mabuhay) – “Pork barrelâ€? scam whistle-blowers on Wednesday went to the Manila Prosecutor’s Office to attend the preliminary investigation for the perjury charges filed by businesswoman Janet Lim Napoles. MANILA, September 4, 2013 (AFP) – The Philippines said Wednesday it had spotted more concrete blocks allegedly installed by China within Filipino territory in the South China Sea, raising concerns Beijing is planning to build in the disputed waters. Aerial surveillance has discovered about 75 blocks scattered on a section of the Scarborough Shoal, said defence department spokesman Peter Galvez. “These can be used for platforms (or) foundations, that is why we said earlier this could be a prelude to any other form of construction,” he told reporters. Chinese foreign ministry spokesman Hong Lei rejected the Philippine allegations. “What has been said by the Philippines isn’t true. Huangyan Island is China’s inherent territory,” Hong said in an answer to a question posed by state television CCTV at a press briefing, using the Chinese name for the shoal. “In accordance with the constitution, Chinese government ships maintain routine patrols in waters of Huangyan Island to safeguard our sovereignty over Huangyan Island and to maintain order of relevant waters. That is China’s legitimate

right and interest and it is beyond dispute.” China claims most of the South China Sea, including waters close to the coasts of its neighbors. Scarborough Shoal is a small group of reefs and outcrops about 220 kilometers (135 miles) off the main Philippine island of Luzon, within the country’s internationally recognized exclusive economic zone. The outcrop is about 650 kilometers from Hainan island, the nearest major Chinese land mass. The concrete blocks have raised concerns in Manila that China could be planning construction in the waters, as it did in Philippine-claimed Mischief Reef in another area of the sea, in 1995. “Of course we don’t want a repeat of that,” Galvez told reporters. He added that any building work would violate a 2002 non-binding agreement between China and its Southeast Asian neighbours to refrain from actions or hostile acts that could inflame tensions in the flashpoint region. The Philippines had earlier released an aerial photograph taken Saturday of what it said were about 30 concrete blocks at Scarborough. A second surveillance flight on Monday photographed more blocks scattered over a two-hectare (4.9-acre) section of the shoal, said Galvez, who

Representatives Cresente Paez and Anthony Bravo filed House Bill 2623 to amend Sections 902 and 905 of RA 1937 which limit the rights to engage in Philippine coastwise trade to “vessels carrying a certificate of Philippine registry”. The bill allows foreign vessels to engage in domestic coastal carriage of cargo and passengers within Philippine waters, or at any point within the waters of the exclusive economic zone of the Philippines.

Bullish U.S. hotel chain Microtel to build more inns & suites in PHL Microtel Philippines, part of the Wyndham hotel chain, will build more hotels thereby offering more rooms as it looks to a bullish Philippine tourism industry that is expected to double if not reach 10 million tourists in the next few years. In a U.S. roadshow presentation, Microtel Philippines officials said they plan to expand to the Bicol Peninsula and Subic while the new Microtel branch at the Ayala UP Technohub near the University of the Philippines in Diliman, Quezon City is expected to open later this year. Microtel Philippines Director Albert Banaag who, along with Mindanao Area General Manager Rene Alberto Jorolan flew all the way from Manila, met with Los Angeles-based Fil-Am journalists in Glendale last Tuesday and said they expect to have 25 Microtel Philippines Inns & Suites up from the current number of 11 by 2016. Each Microtel Philippines Inns & Suites has at least 50 “safe and clean” rooms. According to Banaag, the first Microtel in the Philippines was built in Tarlac near Hacienda Luisita in 2006, which was the first international hotel suite chain of its kind to operate in the Philippines. What’s surprising, however, is that while trouble seems to be brewing between the Philippines and China, the Chinese posted the largest increase in tourist arrivals for the first seven months, increasing by 48.58 percent. The descendants of Noah increased in number. There was a lot of in breeding, cousins marrying cousins. Because of this, the average height of Noah’s descendants was four feet, and they were not that smart. However, even though they were short, they had large heads and

were full of pride. As they increased in number, they began to spread eastward and found a fertile area called Shinar. They all spoke a single language called Noahbyte which was a fusion of Chinese and French. They decided to build a city with a tower that “reached to the heavens”. The people of Babel said, “Come, let us build ourselves a city, with a tower that reaches to the heavens, so that we may make a name for ourselves and not be scattered over the face of the whole earth.” Being simple-minded, the Noahbytes thought that heaven was not far above the earth. If only they could build a tower to the sky, they could climb up and be like gods themselves. So, mankind had once again lost sight of God and become arrogant and self-sufficient. They thought that if they could reach heaven by building a skyscraper that would reach the clouds they could become gods once they set foot in heaven. They also thought that everyone of them could live in the building, like a condominium. Each family would have its own condo. After all, it would be the world’s tallest building. But elevators had not yet been invented. According to the architect, it would take a four foot Noahbyte three whole months to walk up the stairs to the penthouse suite. Everyone wanted the ground floor condos and no one wanted any condo higher than the 10th floor. The penthouse suites were being given away for free and there were no takers. How high was the Tower of Babel? Let’s compare it to the tallest building in the world in 1929 which was the Chrysler building in America at 319M. The Taipei 101 was the tallest for six years since 2004 at 508M. Now the record is held by the Burj Khalifa in Dubai at 828M since 2009, replacing the Shanghai Tower at 632M. The tallest building in the world is now being constructed in Changsa, China for completion next year 2014 at 838M. So, given the low tech construction technology of the Noahbytes, probably the Tower of Babel was 150M high. That’s a lot of mud and rocks. God saw this as pure arrogance. He put an end to the people’s delusions of being powerful and important like gods. “If as one people speaking the same language they have begun to do this, then nothing they plan to do will be impossible for them. Come, let us go down and confuse their language so they will not understand each other.” So, God made the people speak many different languages so they could not work together on building the tower. The architect told the engineer to calculate the stress load for the third floor in Spanish. The engineer replied “I don’t understand you” in Mandarin. The foreman told the carpenter to finish the stairs immediately in Japanese. The carpenter replied, “What the f… are you saying” in Tagalog. Female drug trader; 2 youngster gets life sentence: PDEA MANILA, Sept 6 (Mabuhay) -- The Philippine Drug Enforcement Agency said Friday that a 24-year-old female drug pusher was sentenced to life imprisonment after she was proven guilty of selling illegal drugs to college students in Baguio City. PDEA Director General Arturo Cacdac Jr. identified the drug pusher as Marie Flor Rodriguez, who was convicted by Judge Antonio Reyes of Branch 61 of Baguio City’s Regional Trial Court for violation of Section 5 (Sale of Dangerous Drugs), Article II of Republic Act 9165 otherwise known as the “Comprehensive Dangerous Drugs Act of 2002”. Cacdac said that aside from serving lifetime imprisonment, the court also ordered Rodriguez to pay a fine of P5 million. Rodriguez was arrested in a buy-bust operation by operatives of PDEA Regional Office-Cordillera Administrative Region (PDEA-CAR) on June 23, 2011 at Pinsao Pilot Project, Baguio City. Authorities, however, did not catch the dealer or the druglord. In other related development, PDEA said that two youngsters were also sentenced to life imprisonment by a Regional Trial Court in Panabo City after they were found guilty for selling dried marijuana leaves, in violation of Republic Act 9165, or the Comprehensive Dangerous Drugs Act of 2002. Cacdac identified the convicts as Michael Manatad, alias Makaw, 22 years old and a resident of Crystal Plain Subdivision, Panabo City, Davao del Norte; and Jay-Ar Montecillo, alias Don-don, 24, and residing in Lasang, Davao City. The Panabo City court likewise ordered Manatad and Montecillo to pay a total fine of five hundred thousand pesos each.(MNS)

Protecting employee and consumer rights: Are piece-rate employees entitled to overtime pay? Q: I work for a company that manufactures PROTECTING mechanical parts. We are paid per product that we EMPLOYEE & finish. Part of our duties include clean-up and atCONSUMER RIGHTS tending mandatory meetings, which are not paid. I regularly work 10 to 12 hours per day. Am I entitled to overtime pay? A: All non-exempt employees are entitled to overtime pay, regardless of the basis of compensation. Hence, piece-rate workers or pieceworkers are entitled to overtime if they work more than 8 hours per day. Employers may legally compensate employees on a piece-rate basis rather than on an hourly rate. BY C. JOE SAYAS, JR. A piece rate or piece work is a fixed and ascertainable sum which is paid for each completed task or procedure or a piece of work. Examples of pieceworkers are: 1) computer technicians paid on a “per call” basis 2) auto mechanics paid on a “book rate” or “flag rate” 3) nurses paid on the basis of the number of procedures performed 4) carpet layers/roofers paid by the yard of carpet laid or number of roof tiles 5) cable technicians paid by the number of units installed 6) factory workers paid by the factory product completed 7) lab technicians paid based on the number of cases completed Pieceworkers should receive no less than the minimum wage and, when necessary, overtime pay. They must be paid at least the minimum wage for all hours they worked. If pieceworkers spend time doing other work-related activity (such as pick-up or clean-up activities, attending compulsory work meetings, travelling under employer’s control, or being required to wait), the time spent doing this is considered hours worked. If they are precluded, by these activities, from earning their piece rate compensation, they must be paid at least the minimum wage (or an agreed hourly rate) for that period. Pieceworkers working more than 8 hours per day or more than 40 hours per week must be paid an overtime premium. The overtime premium is based on the employee’s “regular rate” which is computed according to specific methods provided by law. If employees work overtime hours but are paid only on a piece rate basis, a question might arise as to whether the employer is using the piece rate method to avoid paying overtime. If so, employees would be smart to consult an experienced employment attorney to determine if they are entitled to additional wages. [C. During the era of the Ancient Kingdoms of the Philippines (900 AD-1571), babaylan guided the spiritual and ritualistic lives of the people in the barangay/community. Babaylan were mostly women who provided healing, wisdom, and vision through their prayers, chants, myths, and personal narratives of the region. When the Spanish conquered the Philippines in 1571, these babaylan lost their place of privilege alongside the ‘datu’ or king and the ‘panday’ or blacksmith, the masterartist of an ancient Filipino society. Along with that the communities lost much of their oral and written traditions. Bulong is a Tagalog word meaning ‘ to whisper’, it

is also the term sometimes used to describe a babaylan ‘prayer’. As often was the case when congregants whisper babaylan prayers through the confessional box, the friars who then were listening to their “sins” made that what was private and personal, then politically accessible to abuse and oppression by the colonizers. Born in 1972 in Manila, Philippines, Eliseo Art Silva moved with his family to the United States in 1989. He was educated at Riverside Community College, Otis College of Art and Design where he obtained his B.F.A. and Maryland Institute College of Art’s Hoffberger School of Painting under the auspices of Grace Hartigan andDominique Nahas where he received his M.F.A. Silva attended the Philippine High School for the Arts where he received the Most Outstanding Visual Artist award, attended Skowhegan School of Painting and Sculpture in Maine and currently resides in Philadelphia, PA and Corona, CA.

The FHA previously required these buyers to wait three years before applying for a mortgage. Buyers who can document they lost their home to foreclosure or filed for bankruptcy because they were laid off or because their income was reduced by at least 20 percent will be eligible to apply for a loan after paying their bills on time for a year, according to the instructions the FHA sent lenders last week. The change is effective immediately until September 2016. Now for the fine print Borrowers will be required to provide documentation showing the loss of income or employment, including termination notices, tax returns and W-2s. The program is designed to help potential buyers who went through a period of financial distress but have been able to get back on their feet and can afford a home again, says Jim Sahnger, a mortgage planner for FBC Mortgage in Jupiter, Fla. “This is not going to work for strategic defaulters,” he says. Speeding up the process The program is especially helpful to borrowers who went through bankruptcy and

foreclosure simultaneously. Often, the lender doesn’t take title of the property until years after the discharge of the bankruptcy, which has delayed the start of the waiting period for many potential buyers, he says. During the one-year waiting period after the foreclosure sale, bankruptcy discharge or short sale closing, the borrower should have: No late housing payments (rent/mortgage). Negligence no excuse for ‘pork scam’ solons – lawyer

MANILA, Sept 4 (Mabuhay) -- Negligence is no excuse for senators and congressmen who gave their pork barrel funds to fake nongovernment organizations, a lawyer said Wednesday. Lawyer Romulo Macalintal said a lawmaker found guilty of allocating pork barrel funds to a fake NGO could still be charged with the crime of malversation of public funds through abandonment or negligence under Article 217 of the Revised Penal Code. “Plunder isn’t the only way a lawmaker can waste taxpayers’ money. It can also be done by neglecting to safeguard public funds,” he said. Macalintal said malversation of P22,000 in public funds is considered a non-bailable offense punishable by life imprisonment. He said lawmakers could go to jail while the case is ongoing unless granted bail by a court if the evidence of guilt is not strong. He pointed out the experience of Jinggoy Estrada who was charged with plunder but allowed to go free on bail because of the evidence. Estrada was later acquitted in the plunder case. The lawyer said senators and congressmen could also face plunder raps if it is proven that the lawmaker accumulated at least P50 million in public funds through a series of actions. Macalintal said private individuals as well as officials of the Department of Budget and Management and the Commission on Audit could also face charges if proven that they connived with public officials in the misuse of public funds. He said NGOs that receive pork barrel funds should liquidate earlier fund releases before they can receive more allocations. He also questioned the practice of some lawmakers of using up all their pork barrel funds because of fear that they will get a smaller budget the following year if they have excess funds. Several lawmakers have been implicated in an alleged P10 billion pork barrel scam involving fake NGOs set up by businesswoman Janet Lim Napoles. (MNS)

CBCP: We are in solidarity with the people vs pork MANILA, Sept 4 (Mabuhay) – The Catholic Bishops’ Conference of the Philippines (CBCP) said it will allow the people to organize protests and mass actions for the abolition of pork rather than taking the lead. In an interview with Radio Veritas, outgoing CBCP President and Cebu Archbishop Jose Palma said the church leadership is happy that the public is taking the lead in the fight against pork barrel misuse. “We are not making a formal statement in the sense of like we are leading or what, people has already organized. Ours is an expression of solidarity, what we are saying is, let people join but we are not organizing that. It’s about time that people manifest their own conviction,” he said. He said the CBCP also supports the “EDSA Tayo” initiative on September 11. He said the CBCP is in solidarity with the people against greed and corruption. Palace remains open for peace talks with leftist rebels MANILA, Sept 5 (Mabuhay) -- The Palace reiterated that the Aquino administration remains open to continuing the peace discussions with the leftist rebels but they must show some goodwill and sincerity. “May National Peace Consciousness this month. The government panel negotiating peace with the NPA said it may resume peace talks with the insurgents if they agrees on a new negotiating framework. Government negotiators added that the

NPA should have a clear agenda for ending violence and bringing peace in the country. Malacanang also condemned this week the NPA’s reported use of landmines particularly in an attack in Compostela Valley on Tuesday that injured seven soldiers. The military claimed that the rebels had used poison-laced explosives in the attack. Asked if the government will consider declaring the NPA a terror threat, Lacierda said he is leaving the decision at the hands of the Armed Forces of the Philippines (AFP) and the national security adviser. The use of non-command-detonated explosives is banned by international laws like the Ottawa Treaty. The military accused the NPA of using landmines laced with poison based on evidence military doctors discovered from the wounds of soldiers. Reports indicated that doctors found traces of human feces and snake venom in wounds of the seven soldiers wounded during Tuesday’s attack. (MNS)

EB-1 Petition: Fast track to permanent residency EB-1 is an employment-based first-preference immigrant visa category reserved for individuals who can demonstrate that they “have risen to the very top of their field of endeavors.” Under the USCIS guidelines, there are three types of EB-1 petitions: 1) a person of extraordinary ability (EB-1A), 2) an outstanding professor or researcher (EB-1B), 3) or a multinational executive or manager (EB-1C). For the purpose of this article, we will only discuss EB-1A, a person of extraordinary ability. EB-1A classification applies to individuals who can prove that they are among the top and most accomplished in the fields of sciences, arts, education, business, or athletics. In order to meet the “extraordinary ability” requirement, the federal law requires the applicant to present evidence of receipt of a major international recognized award such as the Nobel Prize or the Academy Award. However, in the absence of such award, the applicant can also establish the “extraordinary ability” criteria by meeting at least three of the ten criteria listed on the USCIS website. This includes, but not limited to, evidence of receipt of lesser nationally or internationally recognized prizes or awards for excellence, evidence of published material about the

EB-1 immigrant visa category has become increasingly popular because it is one of the most expeditious categories. Unlike employment-based two (EB-2) or employment-based three (EB-3) petitions, green card applicants may have to wait for a long time before one can apply for an immigrant visa depending on which country the applicant is from, th e priority date for EB-1 is current. This means that the individual is immediately eligible to apply for an immigrant visa. Additionally, there is no requirement of a job offer and an employer’s sponsorship. EB-1 is a fast track to per-

manent residency in the U.S. However, EB-1 petitions are complex and it requires extensive documentations. The adjudication process for EB-1 petitions has also become stricter since a 2010 USCIS memorandum relying on a U.S. district court decision, Kazarian v. USCIS. The memorandum instructs adjudicators to use a “two-part approach where the evidence is first counted and then considered in the context of a final merits determination.” USCIS applies the 2nd part of Kazarian in every case. This has resulted in large numbers of petition denials. You need your beauty sleep: study (Relaxnews) – A small new study now confirms that your best beauty trick is to get a good night’s sleep. Findings revealed what you’ve probably seen in the mirror after a rough night: sleep-deprived people look more, shall we say, worn-out, with redder, more swollen eyes, darker under-eye circles, more wrinkles and droopier eyelids and mouths than their well-rested selves. People also looked sadder when sleep-deprived than after a normal sleep, and this apparent sadness was related to looking fatigued, the researchers said. “Since faces contain a lot of information on which humans base their interactions with each other, how fatigued a person appears may affect how others behave toward them,” said Tina Sundelin, author and doctoral student in the department of psychology at Stockholm University in Stockholm, Sweden. “This is relevant not only for private social interactions, but also official ones such as with health care professionals and in public safety.” To conduct their research, Sundelin and a team from Karolinska Institute in Stockholm recruited 10 subjects, who were photographed on two separate occasions: after eight hours of normal sleep and after 31 hours of sleep deprivation. The photographs were taken in the laboratory at 2:30 pm on both occasions. Forty participants rated the 20 facial photographs with respect to various facial cues, fatigue, and sadness. In a separate study announced earlier this year, University Hospitals Case Medical Center in Cleveland, Ohio found that poor sleepers showed “increased signs of skin aging and slower recovery from a variety of environmental stressors,” such as

(Relaxnews) – Are you sitting down? If so, you may want to get up: a new study on prolonged sitting finds that no one is immune from the harmful effects of hours in a chair. Published last week in the British Journal of Sports Medicine, the study saw researchers look at risk factors associated with cardiovascular disease and diabetes, including waist circumference, body mass index, and cholesterol levels in 4,550 American adults. Subjects were divided by gender, socioeconomic levels, and various ethnic groups. After controlling for sex, race, activity levels, and other factors, findings showed that increased risks were present in subjects reporting as little as four hours of sitting a day. Even diet and exercise didn’t offer much help, although the researchers from Pennington Biomedical Research Center in Baton Rouge, Louisiana, did find that risk factors and sitting time were stronger in people who didn’t exercise. The mounting evidence on the health hazards of sitting are troubling, especially for those in careers requiring long hours at the desk. One way to sit less? Get a standing desk, or at least ensure you get regular exercise and take plenty of breaks

Some members of my family seem to avoid healthy foods. It’s not that they hate fruits and vegetables, but BITES they prefer to eat things that are high in cholesterol, sodium, and saturated fat so that tends to be what they have in their fridge and pantry. Estranged couple Cesar Montano and Sunshine Cruz have agreed to share custody of their three daughters Angeline Isabelle, Samantha Angeline and Angel Francheska. Lawyers of Montano and Cruz represented the couple in a hearing on Monday in Branch 78 of the Quezon City RTC regarding the permanent protection order (PPO) filed by Cruz. Cruz and Montano are both working and could not attend the hearing. Cruz is now busy taping for ABS-CBN’s upcoming fantasy series “Galema,” while Montano is also working on a new soap. The lawyers said they are all trying to reach a peaceful formula

for the couple. Atty. Bonifacio Alentajan, the lawyer of Cruz, disclosed the agreement for the schedule of the children. Montano will have the three girls from Monday to Wednesday and Cruz will have them from Thursday to Sunday. The lawyers stressed that this is a court order and is being strictly followed by both parties. Alentajan who is also a godfather to Cruz and Montano, said he feels sad that the marriage has reached this point, adding that no one can say at this point if there is no chance to fix the marriage.(MNS)

Why Melissa Ricks, Paul Jake Castillo broke up Returning home from a six-week vacation in the United States, actress Melissa Ricks finally spoke at length about her break-up with former “Pinoy Big Brother” housemate Paul Jake Castillo. Ricks explained her prolonged vacation overseas was for a program to lose weight, to spend time with her family based there, and “syempre, dahil ang daming nangyari dito, I just had to get away.” The 23-year-old actress, who was last seen in the primetime series “Walang Hanggan,” was all-smiles in relating why she and Castillo had seemed evasive about discussing their separation. Dawn has crush on ‘sons’ Gerald, Coco Dawn Zulueta admitted she has a crush on Coco Martin and Gerald Anderson, who both played as her sons in two different television series. Martin was Zulueta’s son in the toprating series “Walang Hanggan,” while Anderson is the actress’ son on the new show “Bukas Na Lang Kita Mamahalin” which began Monday. Zulueta said it was comedian Vice Ganda who made her admit who among the young stars is her showbiz crush. “Kung sino daw mga crush ko sa mga young actors. After 40 years, legendary Fil-Am rock band Dakila returns to Los Angeles at FPAC 22 Pioneering crossover band and 1st ‘Best Balisong in the West’ competition are latest add-ons to lively festival weekend LOS ANGELES – Dakila, the legendary but, ultimately, short-lived band that both delighted and mystified audiences with their unique Filipino Latin Rock sound, will return to Los Angeles for the first time in four decades. The crossover pioneers perform exclusively at the 22nd annual Festival of Philippine Arts & Culture, September 7-8 at Pt. Fermin Park, 807 Paseo del Mar, San Pedro. “There is a generation of Filipino Americans who mention Dakila with fond reverence,� said Jilly Canizares, FilAm ARTS Executive Director. “(FPAC) is beyond proud to present them after 40 years and now, other generations can see and hear for themselves why they were so popular in their era.� Formed in 1971, the San Francisco-based group uniquely fused rock, funk, soul and Latin to a historic, major label signing and album release on Epic/Columbia (now, Sony Entertainment) Records – among firsts for an Asian American/Filipino American group. Originally comprised of David Bustamante (guitar/ vocals); Rome Bustamante (organ/vocals); Bert Ancheta (guitar/vocals); Fred Ancheta (bass); Frank Magtoto (drums); Michael Gopaul (timbales/vocals) and Carlos Badia (congas), Dakila (Tagalog for “great� or noble�) is perhaps best remembered for its 1972 album S/T. The band were a popular attraction at various musical festivals and concerts, touring the nation with the likes of Malo and Buddy Miles and opening for Cal Tjader, Jose Feliciano and Cheech and Chong among many. It was also at this time that the band was invited to perform at various California universities and colleges at the onset of the formation of Filipino American campus clubs

and organizations. Recently reforming after four decades, the band are being rediscovered by old fans and discovered by new ones. “The last time (the band) played in LA was 1973 and we co-billed with Johnny Nash (“I Can See Dakila Band Clearly Now�) at the Whiskey A-Go-Go on Sunset,� recalls original member David Bustamante. “To say we’re excited at coming back is an understatement. We’re very excited.� In addition, FPAC 22 will also see the debut of the “Best Balisong in the West,� a unique competition highlighting the uniquely Filipino bladed weapon, the balisong. According to filmmaker/editor Paul Factora, the event’s organizer, balisong flipping is a popular subculture amongst martial artists around the world, gaining popularity via exhibition videos on Youtube. The competition will present unique, high-level and crowd-pleasing displays of what many consider to be among the most deadly of bladed weaponry. Once the judgment for legal separation is entered, the parties acquire no more community property and no obligations are imposed on either spouse except for those obligations as set forth in the judgment. Unlike dissolution, the marriage bond remains intact and neither spouse can remarry until the existing marriage is dissolved either by death or judgment. Residency requirements vary for dissolution, nullity, and legal separation. The foregoing is merely an overview of the various options for terminating or altering marital status, and accordingly, it is advised that you consult with an experienced attorney to further explore which of the above options is best to pursue. The Philippines earlier said the proposed framework had been tabled by the United States as the talks began in Manila in mid-August. Specific time frames were absent in the agreed minutes of the August 29 meeting in Washington, a copy of which the Philippine foreign department released to the press Saturday with Sorreta’s statement. “The sides continued discussions, and made significant progress on... Article XIII (Entry into Force, Duration, Termination, and Amendment),” the minutes said. It said the US would host the next round of talks in the second week of September. Philippine officials have said an increased US presence was part of Manila’s efforts to build a credible defence posture as it faces territorial disputes at sea with China. Manila accuses China of aggressively pushing its territorial claims over most of the South China Sea, including waters close to Philippine shores. The United States, meanwhile, wants arrangements similar to what it has with Australia and Singapore as it seeks to bolster its ties across Southeast Asia, partly to counter China’s growing military power. US Defense Secretary Chuck Hagel said in a visit to Manila on Friday that the two allies were moving towards an agreement, while stressing that Washington was not seeking to build permanent bases. The United States once held Clark Air Base and Subic Naval Base, both near Manila, but was forced to hand them back in 1992 amid growing anti-US sentiment and a rental dispute. A new accord in 1999 allowed troops to return to the Philippines for joint military exercises every year. CHICAGO, September 4, 2013 (AFP) - US auto sales accelerated to the best pace since October 2007 as major automakers posted double digit gains Wednesday and forecast more growth in the months to come. Total industry sales rose 17 percent when compared with August 2012 while the sales pace jumped to an adjusted, annual rate of 16.1 million, according to Autodata. That’s up from 15.8 million in July and the first time the sales pace topped 16 million since the US auto industry sank into a deep downturn that led to the bankruptcies of General Motors and Chrysler. “The news is even more positive than the overall numbers imply, as individual car buyers, not fleet sales, are behind the surge,” said Michelle Krebs, an analyst with

automotive site Edmunds.com. “The stars are aligned for strong retail sales: great new product, widely available cheap credit, and a desire and need by car buyers to purchase a new vehicle to replace their likely aged one.” Ford economist Ellen Hughes-Cromwick said that while it was not time to get “irrationally exuberant,” recoveries in the housing and jobs market and a historically high average age for vehicle on the road “should give us some good support going forward.” While the short-term outlook for the industry remains quite good, Kelly Blue Book analyst Jack Nerad cautioned that “the overall economic recovery is weak and fragile, so another shock could send sales back.” “Right now, based on three years of pent-up demand, an

NEW YORK, September 4, 2013 (AFP) – He’s a top 10 Swiss player, hits a mean one-handed backhand that has left John McEnroe purring and his name isn’t Roger Federer. For once, Stanislas Wawrinka, so often Federer’s Davis Cup wingman, has outshone the 17-time Grand Slam title winner whose US Open ended in a fourth-round humbling. Wawrinka, meanwhile, has reached the quarter-finals for a second time after his maiden run to the last eight in 2010. Back then, he beat Andy Murray in the fourth round and on Thursday will meet the defending champion again for a place in the US Open semi-finals. If 28-year-old Wawrinka ever suffered an inferiority complex in the Federer discussion, he shed it when he pushed world number one Novak Djokovic in a pulsating Australian Open fourth round match in January. Djokovic prevailed in a five-hour duel, but Wawrinka

had led 6-1, 5-2 at one stage. “I think I am playing my best tennis ever,” said Wawrinka, a close friend of Federer, with whom he won an Olympic gold medal in doubles in Beijing in 2008. “I also think the title in Portugal (Oeiras claycourt event in April) against David Ferrer helped my confidence pass the next level. Since then, I’m feeling really good on the court,” said Wawrinka, who made the last eight in New York by beating fifth-seeded Czech Tomas Berdych. John McEnroe once described Wawrinka as having “the best one-handed backhand in the game today” and Wawrinka has been employing that weapon to increasingly effective use this year and in recent seasons. In 2013, he won the title in Portugal, was runner-up to Rafael Nadal in Madrid, Ferrer in Buenos Aires and Nicolas Mahut at ‘s-Hertogenbosch. He also enjoyed a quarter-final run at the French Open, where he was beaten in straight sets by Nadal. His success this year reflects the slow-burning devel-

opment of his career – it took him five years to make his first quarter-final at a major, his run to the last eight in New York in 2010. His passage to the quarter-finals this year is the first time that Wawrinka has gone deeper into a Grand Slam than Federer.“It’s a different situation, for sure. I’m really happy with the year and what I’m doing right now, but I would prefer to have him (Federer) still playing in the tournament,” said the ninth seed. “I was sad for him when he lost, because he’s a good friend and I like when he’s winning Grand Slam titles. I hope he will come back stronger.” Wawrinka, coached by former world number two Magnus Norman, could find himself battling with Federer to reach the World Tour Finals in London, the end of season showpiece which features the top eight men. WASHINGTON, September 4, 2013 (AFP) – The NFL players union is taking action to reduce the number of drunk driving incidents involving its members by teaming up with smart phone transportation app maker Uber. The partnership announced Wednesday will see NFL players in 17 of the 31 cities that have teams able to use the Uber app to summon rides for themselves or family members. Drunk driving incidents involving players have made many headlines, including a crash last December in which Dallas Cowboys defensive lineman Josh Brent was behind the wheel and teammate and friend Jerry Brown died. Brent has pleaded not guilty to intoxication manslaughter but could face up to 20 years in prison if convicted. A statement released by the NFL Players Association said every player in the league will receive key chain cards containing ride credits for the specially tailored program. NFLPA player representative Zak De Ossie of the New York Giants said the partnership is not only good for players but can also promote responsibility among fans by example. The deal is a first with a sports organization for Uber, whose technology is available in 40 cities worldwide. Some US cities, including Houston and Miami, don’t allow use of Uber’s Global Positioning System-based technology because of regulatory issues. “Many professional athletes love and have used Uber organically so this was a great opportunity to help raise awareness about our technology while helping the NFLPA tackle a serious issue,” Uber co-founder and chief executive Travis Kalanick said.
