PET-FRIENDLY PENSACOLA

As pooches make their way into homes, hearts and families across the globe, they make their way into our communities as well. Recently named one of the best small cities in the United States by National Geographic Travel, the publication specified the Pensacola Bay Area, in part, because of the many restaurants that allow pups and the many pet shops and grooming spots.

Pensacola has always been a prodog city. Today, many restaurants with outdoor dining areas allow dogs to hang with their humans while enjoying a bite or a drink. We have compiled a curated list of local parks, trails, bars, restaurants, events and activities that are pet-friendly. If you don’t see a destination on the list, that doesn’t mean they don’t have space for your pet — just call ahead and ask.

Finally— a cat café! Just before going to print, we learned that Pensacola is finally getting its first cat café and we couldn’t be more excited. Here’s what we know. The Coastal Cat Café will be located on W Garden Street and will work with local shelters to rescue and re-home adoptable cats in our community. While the opening date has yet to be announced, Coastal Cat Café will be hosting a Pop-Up Cat Café at Perfect Plain+Garden & Grain on August 20 from 11 am to 3 pm. CITY OF PENSACOLA RECYCLING UPDATE

The City of Pensacola is evaluating changes to recycling and sanitation services for City Sanitation customers, with a goal of improving services and minimizing ineffective recycling efforts.

The City of Pensacola Sanitation Services Department currently uses ECUA’s Materials Recycling Facility to process recyclable materials from City Sanitation customers. Starting Oct. 1, 2023, the city will no longer use ECUA’s facility and will end citywide curbside recycling for City Sanitation customers.

After Oct. 1, the City of Pensacola will continue to work proactively to determine an effective recycling solution with ECUA, which may include opt-in curbside recycling services and/or a staffed drop-off recycling facility in partnership with ECUA.

The City of Pensacola will continue to offer the recycling drop-off center on Summit Boulevard after Oct. 1, providing containers for residents to continue to recycle eligible items including cardboard, plastic, glass and more.

The decision to end curbside recycling was the result of several factors, including:

• Recycling from City Sanitation customers averaged more than 50% contamination when delivered to ECUA’s recycling facility, resulting in the loads being rejected and taken to the landfill instead of being recycled as intended.

• Due to rising costs associated with recycling, ECUA increased its drop-off rates for municipal customers including the City of Pensacola’s Sanitation Depart-

ment. In order to continue mandatory curbside recycling service for all customers, the city would have needed to increase rates for all City Sanitation customers.

• This change will allow the city to evaluate the effectiveness of recycling and determine the most viable solution. The city’s goal is to ensure that customers who want to recycle can have confidence that their efforts are as effective as possible. What are the next steps?

• The city is working on details for a oneyear pilot program that will be implemented after curbside recycling ends on Oct. 1, 2023.

• This pilot program may include opt-in curbside recycling services, or the option for customers to have curbside garbage collection twice a week in lieu of recycling.

• Additional details will be announced to customers as they are finalized, and before the changes are implemented.

PERDIDO LANDFILL TO CLOSE SEPT. 2-4

The Perdido Landfill, located at 13009 Beulah Road in Cantonment, will close Saturday, Sept. 2 through Monday, Sept. 4 while crews install the landfill’s new scale house building. The landfill will re-open for regular hours Tuesday, Sept. 5.

Residents are encouraged to bring any

large loads that require manual offloading are asked to deliver loads no later than 4:30 p.m. Large loads delivered after 4:30 p.m. will not be accepted until regular hours Tuesday, Sept. 5.

On Tuesday, Sept. 26, from 10 a.m.-2 p.m., the Escambia County Board of County Commissioners and the City of Pensacola are hosting the Real Change community partner event at the Brownsville Community Center. Real Change is a free event that focuses on opioid addiction education and introduces attendees to the various resources available in the community.

Attendees will receive a variety of free services, including:

• Free lunch

• Transportation to and from the event courtesy of ECAT (must be wearing the Real Change wristband)

• Free haircuts

• Community supportive services

• Florida ID services

• Veteran supportive services

Additionally, attendees will learn about Escambia County’s CORE program, which is a one-of-its-kind addiction and opioid recovery program.

COURTS GRAPPLE WITH DEATH PENALTY CHANGE

TALLAHASSEE — A new state law lowering the number of jurors required to recommend death sentences has spurred a rash of litigation, triggered conflicting judicial rulings and infused an additional level of uncertainty in capital cases.

The changes have caused what numerous attorneys called “chaos” in the death-penalty system.

The law allows death sentences to be imposed based on the recommendations of eight of 12 jurors, an easier threshold than a previous requirement of unanimous jury recommendations. The change — prompted by Parkland school shooter Nikolas Cruz receiving a life sentence after a jury did not unanimously recommend death — gave Florida the lowest death-penalty jury standard in the nation.

Allowing 8-4 recommendations is the latest in a series of changes in the capitalsentencing process since a 2016 U.S. Supreme Court decision in a case known as Hurst v. Florida. The ruling found that the state’s death-penalty process was unconstitutional.

In October 2016, in the similarly named case of Hurst v. State, the Florida Supreme Court interpreted and applied the U.S. Supreme Court ruling and said unanimous jury recommendations were required. The Legislature responded in 2017 by putting such a unanimous requirement in law.

Amid uncertainty over whether the unanimity requirement should be applied retroactively to older cases, justices ordered resentencing for about 150 Death Row inmates who were sentenced based on recommendations by non-unanimous juries. Before 2016, inmates could be sent to Death Row based on majority — or 7-5 — jury recommendations.

About 90 resentencing proceedings were completed under the unanimity requirement before this year’s law went into effect. More than three-fourths of those proceedings resulted in life sentences, with prosecutors often not asking for the death penalty in the resentencings.

When Gov. Ron DeSantis signed the 8-4 law this spring, nearly five-dozen Hurst resentencing cases were pending. That has led to disputes about which standard should apply.

“Undoubtedly, the new statute will plunge Florida’s death-penalty system into further instability and chaos,” Maria DeLiberato, executive director of Floridians for Alternative to the Death Penalty, told The News Service of Florida. “This knee-jerk change, in an understandably emotional case (the Cruz case), is causing complete destabilization of Florida’s death penalty.”

The Legislature approved the change after an ideological shift in recent years on the Florida Supreme Court. Shortly after DeSantis took office in 2019, he appointed justices who established a conservative majority. The court in 2020 reversed course on the death penalty and said unanimous jury recommendations were not necessary.

The unanimity requirement remained on the books, however — until this spring, when state lawmakers passed the law responding to the Cruz life sentence. DeSantis, who championed the change to a lower standard, signed the legislation on April 20.

The change is affecting Death Row inmates preparing for resentencings because of the Hurst decision. The unanimous standard was in place when the resentencings were ordered, leading their attorneys to argue it should continue to apply in the cases.

The new law also is having an impact on cases involving defendants accused of committing murders before DeSantis signed the law. Their attorneys also maintain the 8-4 threshold should not apply retroactively.

“Here we go again, with changes of laws that create different categories of people that are being treated very differently, which has to be a violation of the Constitution. And then, we’re looking at the overreach or the overstep as a result of very emotional, traumatized community and the play of politics in the death penalty, which is just horrifying, but we know it’s very political,” Hannah Gorman, a professor who is director of The Balanced Justice Project at Florida Interna -

tional University’s College of Law, said in an interview.

The dispute over applying the 8-4 standard, in part, involves what is known as the “ex post facto” clause in the state and federal constitutions.

Defense attorneys contend that applying the new standard to cases initiated before April 20 would violate the ex post facto clause because the standard represents a substantive change in the judicial process.

Prosecutors, however, maintain that the lower threshold amounts to a “procedural” change and therefore should apply in such cases.

Judges — including in the same judicial circuit — are divided on the issue.

In the 10th Judicial Circuit, Judge Kevin Abdoney last month rejected prosecutors’ request to apply the 8-4 standard in the sentencing of Bryan James Riley, who was charged with four counts of first-degree murder in September 2021.

Abdoney, a Polk County-based judge, found that the new law “moved the goalposts” on the state’s death-penalty process.

“In the same stroke of the pen, the Legislature has reduced friction on the path toward death while increasing it on that toward life. As a result, the risk to a defendant confronted with the possibility of being executed that he will actually meet such an end is greater now than before. Shouldering the defendant with such increased risk not present at the time he allegedly committed his crimes substantially implicates ex post facto concerns,” Abdoney wrote in a July 12 ruling.

But three weeks earlier in the same circuit, Judge Angela Cowden ruled that the 8-4 standard should be used in the sentencing of Zephan Xaver, who was accused of killing five women during a bank robbery in 2019.

“In defendant’s (Xaver’s) case, the change in the law has increased his chances of receiving the maximum sentence he already faced; however, it has not ‘change(d) the punishment, (or) ‘inflict(ed) a greater punishment, than the law annexed to the crime, when committed,’” Cowden, who is based in Highlands County, wrote on June 26, partially quoting a legal precedent.

Both judges’ analyses were rooted in prior court rulings on the ex post facto issue.

As circuit judges grapple with which standard should apply, a number of appeals have made it to the Florida Supreme Court. But a “lead” case — if there will be one — has not emerged.

Lawyers for Attorney General Ashley Moody argue that the new law should apply to “all defendants whose penalty phases” will occur after April 20.

A Supreme Court case drawing attention is the appeal of Leonard Gonzalez, a Death Row inmate ordered to be resentenced following the Hurst decision. Gonzalez, who was convicted in the 2011 murders of an Escambia County couple, is appealing a circuit judge’s ruling that called for the 8-4 standard in resentencing.

Gonzalez’s case includes a number of twists, with Moody’s lawyers initially asking justices to weigh in on the retroactivity issue.

“Capital trials and Hurst resentencings are being stayed and delayed awaiting guidance from this (Supreme) Court regarding the constitutionality and proper application of the recently amended death penalty statute. This court should address these issues as quickly as possible to prevent any further delays,” Charmaine Millsaps, a senior assistant attorney general, wrote in a brief filed June 19.

But just weeks later, another one of Moody’s lawyers filed a motion asking the Supreme Court to dismiss the case, arguing that Gonzalez’s appeal raised issues “best addressed in a post-trial direct appeal.”

The court rejected the state’s request, and the case remains pending.

Melanie Kalmanson, an attorney who publishes the Tracking Florida’s Death Penalty blog, pointed to the state’s filings in the Gonzalez case to demonstrate what she called “widespread chaos” in the deathpenalty system.

“There’s some indication that even the state is not sure how they want to address the litigation about the new statute,” she said.

TALLAHASSEE — The chairman of the special district that oversees Walt Disney World properties on Wednesday defended a move to eliminate perks that provided access for district employees and their families to the entertainment giant’s parks.

During a meeting of the Central Florida Tourism Oversight District Board of Supervisors, two district firefighters and a retired firefighter questioned the decision about park passes and discounts.

The decision, announced Monday, was another twist after the newly created Central Florida Tourism Oversight District succeeded the former Reedy Creek Improvement District amid a feud between Gov. Ron DeSantis and Disney. The Reedy Creek district was closely aligned with Disney.

The firefighters said Wednesday that the park-related benefits were long viewed as an incentive to work for Reedy Creek. Pete Simon, a lieutenant paramedic with the Reedy Creek Fire Department, said when the district changed hands, firefighters supported the move because they were “being stonewalled” by former district leaders and that “we were told that our jobs and our benefits were safe.”

“When I was applying here and got a job offer, I sat down and did a pros and cons list,” Simon said. “My top three pros were a step (pay) plan, better insurance because we offer dental and vision, and the kicker for me was that I’d be able to take my family to the parks, my three little girls to the parks. This benefit is intangible and intergenerational.”

But district board Chairman Martin Garcia said the policy discriminated in favor of one business in the district over others. Also, he said the park-related benefits weren’t equitably used by employees and that the policy could be illegal.

“We looked and found that in some years, only 30 percent of the employees use the passes,” Garcia said. “Other years it was 50 percent. And I think the highest utilization was 67 percent. So, we were paying as a district, or the old board was paying, for passes that some of our employees weren’t even using.”

Garcia added that employees with larger families drew larger benefits than those with smaller families or who were single.

As a compromise, Garcia said the district is considering a measure to “gross up” all employee wages by $1,425.

Separately, the district needs to determine the impact of the change to retired employees, who left with the belief of lifetime passes, Garcia said.

Reedy Creek Fire Department firefighter Aaron Clark told the board he sought to work for the district, where his father worked for 26 years as a firefighter.

“This has been a generational benefit that I was able to have growing up,” Clark said.

“I now have three girls of my own --- (ages) 6, 3 and 1,” Clark added. “When entering this field, my goal was to become a firefighter with Reedy Creek. And one of the biggest draws was the chance to be that dad that was able to make those same memories.”

Disney is battling in state and federal court with the Central Florida Tourism Oversight District and DeSantis about a series of issues. Disputes began after the company opposed a 2022 law that restricted instruction about gender identity and sexual orientation in schools.
