GOOD DAY, DARLING

FORMER MAGNOLIA OWNERS OPEN NEW

What once started as a quaint beverage cart for fueling pilates students has now evolved into East Hill’s newest cafe and brunch spot—Good Day, Darling (GDD).

Though the cafe is new to the East Hill neighborhood, GDD’s roots run deep in the community. The cafe is spearheaded by local entrepreneurs, Bill and Kiley Manning. The couple have spent the past decade establishing some of Pensacola’s beloved community spaces like The Magnolia and Wild Lemon Pilates.

“Bill and I were in our late 20s when we opened our first little neighborhood bar, The Magnolia. We had a ton of fun and learned a lot in the 11 years we were open. Over the course of that time, we opened our two pilates studios (Wild Lemon Pilates) in East Hill, flipped some houses and Bill became a Real Estate Agent at Kuhn Realty,” Kiley explained.

In November 2022, the couple permanently closed The Magnolia to take a break from the restaurant industry to focus on their other businesses and spend time traveling.

Never considering the possibility of getting back into the food and beverage business, the Mannings and their team decided to set up a small beverage cart in front of one of their pilates studio locations to

provide pilates students with a quick and healthy drink or snack before and after classes. The team named the small beverage cart “Good Day, Darling,” which made its official debut this past August with the help of cart manager Sara Didlake.

The beverage cart became a huge hit, and it wasn’t long until it had reached its maximum serving capacity. The Manning’s soon realized that their intended break from the food and beverage industry might be ending a little sooner than anticipated. The couple’s small food and beverage cart had quickly grown into a bustling side businesses.

“It takes a whole lot of people who care a whole lot about what they do to create and cultivate a small business.”

“Two weeks after opening our coffee cart, my friend, Danielle Mullet, shared with me that she was planning to close her business, The Daily Squeeze. I refused to accept that information because I loved The Daily Squeeze and frequented the shop for cold-pressed juice,” Kiley said. “Together, we made a plan to expand the coffee cart into The Daily Squeeze location and take over juicing operations. We suspended operations at the coffee cart to build out the cafe.”

Kiley and her team plan to continue The Daily Squeeze’s cold-pressed juice program and the bottle reuse program, purchasing all of the glass bottles in backstock from The Daily Squeeze. Just five weeks after the team took over operations at The Daily Squeeze, GDD’s first brick-and-mortar cafe celebrated its official opening. The new neighborhood cafe is located in The Daily Squeeze’s former location at 901 N. 12th Ave. in East Hill.

Since opening on November 13, the cafe has been serving up an assortment of delicious bites and specialty crafted beverages. GDD focuses on using only high-quality and fresh ingredients, with menu options ranging from espressobased drinks, juices and smoothies to sandwiches, salads, pastries and more. A variety of their food and beverage options are made freshto-order, with some fresh menu items and drinks already prepared for grab-and-go meals from the “Good To Go” cooler. Fans of The Magnolia will be happy to know that the cooler will also be stocked with Magnolia favorites like rose

made soups.

Community Garden. We would love to expand offerings as we build the business over the next several months,” Kiley explained.

The cafe supports local when it comes to its coffee, too. The coffee beverages served at GDD are made using ingredients from small local businesses. Their drip coffee and cold brew comes from Pensacolabased Alla Prima Roasters, and their espresso beans come from Nova Espresso in Mobile, Alabama.

“It takes a whole lot of people who care a whole lot about what they do to create and cultivate a small business. We are forever grateful to our incredible team for pouring so

much love and talent into this project, and to Danielle for the opportunity to build on the legacy she and her team created with The Daily Squeeze. We want this place to feel like it was always here and for the neighborhood to create memories with loved ones over a sip and a snack at Good Day, Darling for years to come,” Kiley said.

CITY AWARDED $140,800 IN GRANT FUNDING

The City of Pensacola has been awarded a $140,800 planning grant from the U.S. Department of Transportation’s (DOT) Safe Streets and Roads for All program to conduct a comprehensive roadway lighting safety assessment through the Illuminating Safety in Pensacola project.

The project's assessment will include a deficiency analysis, inventory needs, and best practices for effective lighting installations that address safety for vulnerable users during dark conditions and improve the safety and security of all road users, including those in wheelchairs and other mobility devices. The supplemental planning effort will address the need to study improved and expanded lighting options — a top priority identified in the city's 2023 Active Transportation Plan.

"This planning grant will allow us to conduct a city-wide lighting assessment

and address our city's generational lighting issues in a data-driven way," Pensacola Mayor D.C. Reeves said. "I'm very thankful to our Public Works team and DOT for helping us secure this grant and improve safety throughout Pensacola."

This funding is in addition to the $176,000 DOT grant that the city was awarded in November 2023 to pilot and evaluate temporary roadway enhancements and traffic calming activities, such as shared lane markings and curb extensions on Gonzalez Street. The 2023 funding was also awarded to conduct road safety audits at key intersections on the city’s High Injury Network to analyze crashes and identify engineering countermeasures using a safe systems approach.

The Escambia County Tourist Development Council was created in accordance with Florida Statutes through County Ordinance 77-34, and revised by County Ordinance 89-7. The council’s duties are to review each proposal for expenditure of funds to determine if it complies with the Tourist Development Plan as outlined in the ordinance. The ordinance provides that the council is to review all expenditures of revenue from the trust fund; expenditures that the council believes to be authorized are to be reported to the county commission and the Florida Department of Revenue.

Members shall be owners/operators of motels, hotels, recreational vehicle parks or other tourist accommodations in the county and subject to the tax, and/or individuals involved in the tourist industry or who have demonstrated an interest in development but are not owners/ operators within the tourist industry. Council members serve a four-year term of office and meet quarterly for approximately two hours.

DELTA AIR LINES TO RE-LAUNCH SEASONAL NONSTOP

AGING IN PLACE: PENSACOLA HABITAT FOR HUMANITY AND PUBLIX CHARITIES TEAM UP FOR CRITICAL HOME REPAIRS

Pensacola Habitat for Humanity’s Community Development Program received significant support to its Aging in Place program with a recently awarded $125,000 grant from Publix Super Markets Charities.

This generous award will help the affiliate provide vital services to older Americans, including grab-bars, zero-entry doorways and showers, wheelchair ramps, weatherization initiatives, critical repairs and accessibility modifications designed to enable homeowners to remain safely in their owned homes.

It’s the season of giving, and Navy Federal Credit Union is celebrating its 17th year of the Dollars for Doers Program, which awards 100 grants at $1,000 each to qualified nonprofit organizations where employees volunteer their time. The program has surpassed over $1.7 million in total impact since its inception. This year, 33 nonprofits across Escambia and Santa Rosa counties received grants through the program, providing $33,000 in philanthropic impact to Northwest Florida.

“Our team members are extremely committed to living our core value of championing community,” said Kim Aderholdt, VP, Greater Pensacola Operations at Navy Federal. “More than two dozen nonprofits in our area benefited from the Dollars for Doers program this year, which speaks to how devoted our employees are to fostering community connections and prospering important causes.”

Community Service Champion Elizabeth Haymans was selected for a grant this year in honor of her volunteer work with the Escambia County Public Schools Foundation for Excellence. As a longtime leader for Navy Federal’s School Partnerships Program, Haymans manages the credit union’s Take Stock in Children partnership, which pairs students with Navy Federal mentors who help them develop soft skills for early careers.

“Dollars for Doers allows us to lean into the credit union’s philosophy of people helping people,” said Haymans, Project Manager at Navy Federal. “We’re putting an investment back into our children, schools and communities through these programs and donations of time, treasure and talent.”

In addition to the Dollars for Doers program, Navy Federal empowers its

employees to serve their communities through 8 hours of paid volunteer leave annually. In 2023, more than 4,500 team members serving at the credit union’s Pensacola Campus donated nearly 30,000 volunteer hours to their community through this employer benefit.

A portion of Saddle Club Road will be closed to through traffic permanently beginning Mon., Jan. 13. This permanent closure is for the installation of stormwater improvements. This closure will not impact access to homes in the area, but residents may experience delays due to equipment and the installation process.

The project is anticipated to take 365 days to complete, weather permitting. In November 2023 Santa Rosa County Board of County Commissioners approved an agreement with the Florida Department of

Emergency Management to accept $397,145 in federal funding to acquire and demolish the flood-prone structure at 6060 Saddle Club Road with no local match required. The structures on the property have since been demolished to allow for additional stormwater drainage capacity to alleviate repeated flooding and reduce the risk of flooding for residents in the area.

MLK DAY CLOSURES, CHANGES TO SANITATION COLLECTION SCHEDULE

Live trees are a festive and fragrant holiday decoration for many families during the Christmas holidays, and Santa Rosa County Public Works offers an environmentally friendly option for disposal. Residents who would like to "treecycle" their tree for mulch may drop off their clean Christmas trees in the designated areas listed below by Jan. 20:

• Central Landfill - Household Hazardous Waste facility, 6337 Da Lisa Road, Milton

• Pace Fire Rescue District – 4773 Pace Patriot Blvd., Pace

Residents who wish to drop off their live tree will need to remove any tinsel, lights, and ornaments from the tree before dropping it off. Remember, never burn your Christmas tree in a fireplace or wood stove. Pines, firs, and other evergreens have a high content of flammable turpentine oils. Burning trees

may contribute to creosote buildup and risk a chimney fire.

NAVFAC SOUTHEAST AWARDS $23.3M DEMOLITION CONTRACT FOR NAS PENSACOLA

Naval Facilities Engineering Systems Command (NAVFAC) Southeast awarded a $23.3 million firm-fixed-price, design-bidbuild construction contract on December 18 to RQ Construction LLC of Carlsbad, California, for the demolition of various facilities at Naval Air Station (NAS) Pensacola in Pensacola, Florida.

Demolition projects are essential for modernizing infrastructure, improving safety, and creating space for new development.

“This contract award will enable NAS Pensacola to remove existing antiquated infrastructure, allowing critical sustainment funding to be spent on active infrastructure while reducing safety risks associated with the derelict structures,” said Cmdr. Brianna Jackson, Public Works Department Pensacola officer in charge. “We are very excited to have received funding to clean up the selected infrastructure that was severely damaged during Hurricane Ivan in 2004.”

The project includes the demolition of multiple existing buildings at NAS Pensacola and NAS Saufley Field, as well as the surrounding site areas. Work will involve utility disconnections, incidental related tasks, and the removal and disposal of hazardous materials.

Demolition efforts will include disconnecting utilities within the designated limits of disturbance and removing site elements adjacent to building structures. Each facility marked for demolition will be fully

removed, including footers and below-grade foundations. The site will then be restored and graded to match adjacent conditions, preparing it for future development. Associated demolition tasks will address civil, architectural, hazardous materials, and electrical components.

The contract was competitively procured through the SAM.gov website, with three offers received.

Work will be performed in Escambia County, Florida, and is expected to be completed by May 2028.

NAVFAC Southeast oversees the planning and design of facility projects, offering essential services in contracting, construction, leasing, environmental management, maintenance, and contingency support, all of which are crucial for meeting the needs of the Navy and the Department of Defense within the Southeast Area of Responsibility. The “Keep the Wreath Green” fire safety campaign is a collaborative initiative with the City of Pensacola to promote fire safety during the month of December. POT RULING AFFECTS POLICE SEARCHES

In what could be a first-of-its-kind ruling in Florida, an appeals court Tuesday said a drug-sniffing dog's alert did not justify police searching a car because the dog could not differentiate between medical marijuana and illegal pot.

The ruling by a three-judge panel of the 5th District Court of Appeal in a Lake County case could add complexity to police searching vehicles without obtaining warrants.

The case stemmed from a Groveland police officer in September 2020 stopping a Lyft car for speeding and tag lights that weren’t working. The officer subsequently called for a drug-sniffing dog, Polo, which alerted to the presence of drugs when it walked around the car.

Officers searched the car and found a bag that contained marijuana, crack cocaine, ecstasy and methamphetamine, leading to the arrest of a passenger, Stephon Ford, according to Tuesday’s ruling. Ford tried to get the evidence suppressed by arguing that the dog could not differentiate between illegal marijuana and medical marijuana or hemp.

A circuit judge refused to suppress the evidence, but the appeals court backed Ford’s argument. While other drugs were also found, the appeals court said it is possible that Polo alerted to marijuana in the bag. The pot that was found was not medical marijuana.

“At the time when Polo alerted to a target substance in the Lyft vehicle, the police officers had no way of knowing whether Polo had detected an illegal substance (marijuana, cocaine, heroin, or methamphetamines) or a legal substance, namely the THC in hemp or medical marijuana that was properly prescribed and in the possession of a bona fide medical marijuana card holder.

… Whether the substance Polo smelled was legal or illegal was not readily apparent, and thus his alert, alone, could not provide the probable cause needed to justify a warrantless search,” said Tuesday’s main opinion, written by Chief Judge James Edwards.

Judge Jordan Pratt wrote a concurring opinion that said Tuesday’s ruling and a 2024 decision by the appeals court in a case about a police officer smelling marijuana show that “cannabis legalization carries collateral consequences.” Florida voters in 2016 approved a constitutional amendment that broadly allowed medical marijuana,

though pot remains illegal under federal law and in other circumstances in Florida.

Pratt wrote that under Tuesday’s decision, “dogs trained to alert on cannabis can no longer provide the sole basis for a stop or search.” Nevertheless, he said police could continue to use alerts by drug-sniffing dogs to provide a basis for searching cars.

“An alert by a dog trained not to alert to cannabis — or to alert to cannabis differently than it alerts to other drugs — can still on its own supply probable cause,” Pratt wrote.

“And for another thing, even without such canine training, an undifferentiated alert can supply probable cause when combined with an officer’s questions ruling out the presence of lawful cannabis. Officers easily can be trained to ask such questions in conjunction with a dog’s undifferentiated alert.”

Judge John MacIver concurred with the result of the majority opinion, though he did not sign on.

Edwards described the case as being “of first impression,” which generally indicates it is the first time the issue has been decided. Tuesday’s ruling, however, cited an August ruling by the full 5th District Court of Appeal that said a police officer could not use smelling marijuana as the sole basis to search a car and arrest a man.

In the Groveland case, Ford pleaded no contest to drug charges and was sentenced to 68 months in prison after the circuit judge denied his motion to suppress the evidence, Tuesday’s main opinion said. Ford, however, reserved the right to appeal.

While the appeals court agreed with Ford on the suppression issue, it upheld his conviction because of what is known as a “good faith” exception. It said the exception applied because the circuit judge followed what was legal precedent at the time.

But Edwards wrote that Tuesday’s ruling will apply in the future in the 5th District, which is based in Daytona Beach and includes areas such as Jacksonville and Ocala.

“Is the undifferentiated alert behavior of a properly trained police drug-sniffing dog sufficient to supply the sole probable cause for a warrantless search of a car, when that K-9 officer, while trained to alert to THC among other substances, cannot distinguish between illegal pot and legal medical marijuana or hemp? In other words, is that sniff up to snuff?” Edwards wrote. “Going forward, that dog won’t hunt.”

PLAINTIFFS FIGHT MOODY REQUEST IN AGE VERIFICATION CASE

Plaintiffs pushed back Monday against a request by Florida Attorney General Ashley Moody to temporarily halt a lawsuit challenging the constitutionality of a new law requiring age verification for access to websites with adult content.

The Free Speech Coalition, an adult-entertainment industry group, and other plaintiffs also asked Chief U.S. District Judge Mark Walker for a preliminary injunction to block the law from being enforced while the case plays out. Moody last month filed a motion seeking a stay of the lawsuit while the U.S. Supreme Court considers a similar challenge to a Texas law. If granted, Moody’s motion would allow the Florida law to remain in effect at least until the Supreme Court rules in the Texas case. But the plaintiffs, who contend the Florida law violates First Amendment rights, said the lawsuit should move forward. The law took effect last week.

“The state should not be allowed to make use of procedural tools to perpetuate a constitutional violation free of judicial oversight,” the plaintiffs’ attorneys wrote in a filing Monday.

The plaintiffs also filed a separate request for a preliminary injunction. Walker said in an order Tuesday that he will rule on Moody’s motion for a stay before dealing with the preliminary-injunction request.

Lawmakers passed the age-verification requirements during the 2024 legislative session, with supporters saying the law is designed to keep minors from viewing pornography online. The law was part of a broader bill (HB 3) that also seeks to prevent children under age 16 from opening social-media accounts on some platforms. That part of the bill also has drawn a constitutional challenge.

UNIONS BACK BENEFITS IN WORKPLACE SHOOTING

As the Florida Supreme Court prepares to hear arguments, a major police union and other labor groups are backing the general manager of an Orlando rental-car agency in a dispute about workers’ compensation insurance benefits after he was shot.

Attorneys for the Florida State Lodge Fraternal Order of Police and other unions filed briefs Monday urging the Supreme Court to overturn a decision that rejected benefits for Mohammed Bouayad. A divided panel of the 1st District Court of Appeal said Bouayad had not shown a “causal link” between the injuries he suffered and the work he performed for Value Car Rental.

Bouayad was walking between the Holiday Inn Orlando-International Airport hotel, where his rental-car kiosk was located, and an office in a separate building on June 28, 2019, when he was shot seven times by an unidentified person.

In its friend-of-the-court brief, the Fraternal Order of Police argued that the case “will significantly impact law enforcement officers’ ability to obtain workers’ compensation benefits when injured by an unidentified assailant.”

“In this case, the First District Court of Appeal concluded that because Mr. Bouayad failed to establish a work-related motive for his shooting, his claim was not compensable,” the police union’s attorneys wrote. “Requiring a (workers’ compensation) claimant to prove an assailant’s motive or purpose imposes an impractical and unreasonable standard. Motive is often unknowable in cases of workplace violence, as perpetrators may escape detection or exercise their Fifth Amendment right to remain silent. Further, the absence of evidence regarding a motive does not negate the fact that employment-related factors can place a claimant in harm’s way.”

The Supreme Court said in October that it will hear the case, though it has not announced a date for the arguments. The appeals-court panel, in a 2-1 decision, sided with Value and the rental-car company’s insurer, Normandy Insurance Co., in August 2023.

The appeals court’s majority opinion said Bouayad “did not meet his burden to prove that the injuries he suffered arose out of the work he performed for Value.”

“The sole cause of his injuries was that he was shot,” said the opinion, written by Judge Lori Rowe and joined by Judge Thomas

Winokur. “At most, the work he performed for Value placed Bouayad in the wrong place at the wrong time. This is not enough to establish occupational causation.”

But the Fraternal Order of Police brief said the rationale of the decision could lead to scenarios where law-enforcement officers would be denied workers’ compensation benefits.

“Under the First DCA’s analysis, a law enforcement officer who is walking to his vehicle from the station to go on patrol and is shot in a drive-by by an assailant that is never caught may not be entitled to workers’ compensation benefits because the act of walking to his vehicle did not cause the officer to be shot,” the brief said.

Meanwhile, a brief filed on behalf of the North Florida Building and Construction Trades Council and locals of the Teamsters, the International Brotherhood of Electrical Workers and the International Association of Sheet Metal, Air, Rail and Transportation Workers said the appeals-court decision could lead to lawsuits over workplace injuries. The workers’ compensation system is designed, in part, to keep disputes out of court.

“If not reversed, there is a great probability that many more employees injured on the job will have access only to tort litigation against the employer who employed the injured worker (personal health insurance usually exempts health care for insureds injured on the job),” attorneys for the four unions wrote.

In defending against the claim, Normandy Insurance cited a confrontation the day before the shooting between a man and Bouayad’s wife and son over an alleged debt, according to court documents. The man was not charged in Bouayad’s shooting.

The dispute about benefits went before a judge of compensation claims, who sided with Bouayad. That led Normandy Insurance to take the dispute to the Tallahasseebased appeals court.

“The question for the JCC (judge of compensation claims) was — did the work Bouayad performed for Value — walking between Value’s facilities — itself cause him to be shot seven times at close range?” the appeals court’s majority opinion said. “There is no question that the walking itself did not cause Bouayad’s injuries. Rather, it was the act of the shooter that caused his injuries. So how can it be said that his injuries arose from the work Bouayad performed?”

COULD DRAG SHOW CASE BE MOOT?

“The Supreme Court will hear argument in (the Texas case) in less than a month, on January 15, and in keeping with its usual practice will issue its final opinion by the beginning of July at the latest,” the motion said. “That is barely six months, after which this (Florida) lawsuit could freely proceed with the benefit of the Supreme Court’s authoritative ruling in that case.”

The lawsuit centers on part of the law that applies to any business that “knowingly and intentionally publishes or distributes material harmful to minors on a website or application, if the website or application contains a substantial portion of material harmful to minors.” It defines “substantial portion” as more than 33.3 percent of total material on a website or app.

In such situations, the law requires businesses to use methods to “verify that the age of a person attempting to access the material is 18 years of age or older and prevent access to the material by a person younger than 18 years of age.”

The lawsuit raises objections about how the law would apply to minors and adults, including saying it “demands that, as a condition of access to constitutionally protected content, an adult must provide a digital proof of identity to adult content websites that are doubtlessly capable of tracking specific searches and views of some of the most sensitive, personal, and private contents a human being might search for.”

The lawsuit also alleges that the law does not properly differentiate between older minors and younger children.

In addition to alleging violations of First Amendment rights, the lawsuit contends that the law violates due-process rights, the U.S. Constitution’s Commerce Clause and what is known as the Supremacy Clause.

Pornhub drew national attention last month when it said it would block people in Florida from having access to the site because of the law.

As an appeals court considers the constitutionality of a 2023 Florida law aimed at preventing children from attending drag shows, it also is looking at another question: Is the case moot after an Orlando restaurant that challenged the law closed and said it plans to reopen elsewhere?

An attorney for operators of the restaurant, Hamburger Mary’s, filed a brief Monday at the 11th U.S. Circuit Court of Appeals arguing that the case is not moot. The brief said Hamburger Mary’s, which closed the Orlando location in June, has continued to produce drag shows with other venues and plans to host shows when it reopens in Kissimmee.

The brief said Hamburger Mary’s provided information in June to Florida Department of Business and Professional Regulation Secretary Melanie Griffin, the defendant in the case, about the plan to reopen.

“Once reopened, HM (Hamburger Mary’s) intends to operate the restaurant using the same drag-centric business model and age policies as its Orlando location,” attorney Melissa Stewart wrote in Monday’s brief. “Because the act (the 2023 law) charges Secretary Griffin with state-wide enforcement of the law, HM will face the same concrete risks of unconstitutional enforcement at its Kissimmee location as it did in Orlando.”

A three-judge panel of the Atlanta-based appeals court heard arguments in the case in October but on Nov. 26 directed both sides to file briefs about Hamburger Mary’s plans to reopen and whether the “current appeal is moot in light of those plans.” Attorneys for the state will file a brief by Jan. 21.

The state appealed in 2023 after U.S. District Judge Gregory Presnell issued a preliminary injunction against the law because he said it violated First Amendment rights.

The law, dubbed by sponsors the “Protection of Children” bill, would prevent venues from admitting children to adult live performances. It defines adult live performances as “any show, exhibition, or other presentation that is performed in front of a live audience, which, in whole or in part, depicts or simulates nudity, sexual conduct, sexual excite -

ment or specific sexual activities, … lewd conduct, or the lewd exposure of prosthetic or imitation genitals or breasts.”

Regulators would be able to suspend or revoke licenses of restaurants, bars and other venues that violate the law. Also, it would prohibit local governments from issuing public permits for events that could expose children to the targeted behavior.

While the law does not specifically mention drag shows, it came after Gov. Ron DeSantis’ administration cracked down on venues in South Florida and Central Florida where children attended drag shows. It also came amid a series of controversial laws passed by Republicans in Florida and other states about transgender-related issues.

In issuing the preliminary injunction, Presnell wrote that the law “is specifically designed to suppress the speech of drag queen performers” and the state “already has statutes” that protect children from seeing obscene performances.

“Defendant professes that a statewide preliminary injunction would ‘harm the public by exposing children to ‘adult live performances,’” Presnell wrote. “This concern rings hollow, however, when accompanied by the knowledge that Florida state law, presently and independently of the instant (2023) statutory scheme, permits any minor to attend an R-rated film at a movie theater if accompanied by a parent or guardian. Such R-rated films routinely convey content at least as objectionable as that covered by (the 2023 law).”

Hamburger Mary’s said in 2023 that it had run “family friendly” drag shows for 15 years. In the brief Monday, Stewart wrote that Hamburger Mary’s has faced “frustrating delays” but continues to plan to reopen in Kissimmee.

The brief partially quoted a legal precedent that said a case is moot only when it is impossible for a court to grant “effectual relief” to the winning party.

“Not only is it possible for this court to grant HM effectual relief, it is more essential than ever for HM’s future,” the brief said. “Reopening any restaurant in a new location is a monumental task; HM is reopening Hamburger Mary’s amidst litigation that will determine whether its core business model is legal in the state of Florida.”
