H

ome is where the heart is, but for most of us, home is where our dog is. The Pensacola Humane Society is celebrating its 80th year of improving the lives of local pets for its annual October pet adoption event, Barktoberfest. This pet-friendly adoption event offers members of the community a place to come together over their shared love for canines and felines alike. Hosted in October each year, this community adoption event brings together animal welfare organizations from across the Gulf Coast in support of our local Humane Society. This year’s Barktoberfest will be held Sunday, October 29 from 10 am to 4 pm at Seville Square located at 311 E. Government Street in downtown Pensacola. Drawing an estimated 4,000 attendees each year, this no-cost community event brings together pets and pet owners, local businesses and animal welfare organizations to support the Pensacola Humane Society and its mission of helping animals in need. The Pensacola Humane Society was originally founded in 1943 and became Pensacola’s first no-kill shelter in 1985. It grew from a single employee shelter to an organization

with a committed staff, volunteer group and multiple fundraising events to help spread their mission of helping suffering animals and making the city of Pensacola a no-kill community through education and dedication. If you’re interested in lending a helping paw, visit pensacolahumane.org to learn more about donating, volunteering and foster parenting opportunities. Barktoberfest is expected to host a dozen local food trucks and a beverage booth, which will supply a variety of both adult and non-alcoholic beverages. You and your pet will find fun around every corner with special drinks and treats. Emerald Coast Utilities Authority will also be onsite with its mobile refillable water station that provides clean water so Florida’s fur-ocious heat will not stop us from enjoying this once-a-year event. This fun-filled day not only includes food and beverages for both you and your pet, but also a variety of fun contests where your furry friend can show off their Halloween costume and their super paw-ers by competing in the ulti-mutt costume contests for both small and large dogs, doggy doppelganger owner look-alike contests and many more. There will also be a yappy hour beer drinking contest for this festival’s Oktoberfest counterpart that provides a muttfriendly brew so that you and your furry friend can indulge in this month’s festivities. If competing is not your furbaby’s strong suit, there will be many other events to enjoy with man’s best friend such as paw-casso face painting, pup-arrazzi photo booth, bone appe-treat pool and more. Make sure to dial in to the Pensacola Police’s K-9 aw-mazing obstacle course demonstration. Attendees and their pooch will also get to participate in p et-fr iendly activities provided by F l o r i d a’s f i r s t- e v e r d o g event company, Wolfgang. The animals showcased at this

event will be up for adoption through the Pensacola Humane Society, the Escambia County Animal Shelter and the Santa Rosa County Animal Shelter, so you may even get to bring home the purrrrfect friend. Typically, about half of the adoptable canines and felines end their spook-tacular day by being adopted by an attendee. So, if you meet your new furry

roommate, visit one of the adoption tables to learn more about adoption opportunities. While admission is free, donations to the Humane Society are more than welcome. Pups, bring your humans so you can both meet some new friends, try some tasty treats and rock some fan-favorite Barktoberfest merchandise sold at the festival. Don’t forget to mark your

calendar for the Humane Society’s fur-tastic event. Remember to keep all dogs on a leash for your pet’s and everyone else’s safety, and most importantly, make sure you have a bow-wow of a good time. COMMUNIT Y NEWS UWF AWARDED $1.6 MILLION GRANT TO SUPPORT STUDENTPARENTS The University of West Florida Educational Research Center for Child Development received a $1.6 million, four-year grant from the U.S. Department of Education to assist Pell-eligible and Pell-recipient studentparents with the costs of childcare. This is the largest grant the University has been awarded to offset childcare costs for students. In addition to securing the grant, UWF’s Educational Research Center for Child Development also accomplished the near-impossible feat of a perfect review panel. “This grant allows student parents to persist in their degree while simultaneously laying a lasting foundation for their child’s future education and development without the financial burden of rising childcare costs,” said Kaley Devito, associate director of the ERCCD. “This is a great accomplishment for the center.” The Child Care Access Means Parents in School, known as CCAMPIS, grant is helping parents like Hanna Klump, whose four children are currently enrolled at the ERCCD while she works to earn her bachelor’s degree in exercise science. Klump, who is a U.S. Navy veteran, decided to use her military benefits to enroll at UWF three years ago. At the time, she had one child. Since she became a UWF student, her family has grown in size. She says it wouldn’t have been possible to continue her studies without the ERCCD and this grant, which allows her family to pay a small portion of the total cost of childcare for her four children. “Being a full-time student and mother of four, I don’t have the time to work to pay for childcare; my husband works full-time

as well,” Klump said. “I wouldn’t have been able to get this far in my bachelor’s degree program without the center and the financial security of this grant.” Klump will graduate in December and plans to start UWF’s master’s program in exercise science in the spring. She’ll continue to use the center as a graduate student. She said within the last four years the staff have become like family to her. “When I was in and out of the hospital pregnant with twins a year and a half ago, everyone was so helpful, and we really relied on their care,” Klump said. “They have been like family to us, and I would say all the families that use the center would say the same. Every day my kids are around people who really care about them, and it will be bittersweet when they outgrow the center.” The UWF grant supports ERCCD parents with 50 to 90% off childcare fees. The total financial support is dependent upon several personal factors including the number of classes the student is enrolled in, how many children are enrolled at the center and whether they are the single head of the household. Students must be in good academic standing. UWF’s ERCCD has been around since the early 1970s and has been the first educational experience for thousands of children. ERCCD is a Gold Seal Quality Care Program, which means it has been acknowledged as a childcare facility that has gone above the required minimum licensing standards to become accredited. RESTORE MYIP AMENDMENT 3 PUBLIC COMMENT PERIOD OPEN NOW Escambia County has released its RESTORE Act Draft Multi-Year Implementation Plan Amendment 3 for a 45-day public comment period beginning Oct. 16, 2023 until Dec. 1, 2023. MYIP Amendment 3 proposes alterations of two projects and the addition of eight new projects. The two alteration projects include the Escambia County Workforce Development program and Little Sabine Bay Restoration program. The eight new projects include: • Perdido Key Public Beach Access Property Acquisition and Construction • Pensacola Bob Sikes Fishing Pier Rehabilitation • Cantonment Community Center Construction • Palafox Complete Street - Construction • South Navy Boulevard Improvements • Bayou Grande Watershed Management Plan • O.C. Phillips Bridge Replacement • Carpenter Creek Headwaters - Carpenter Creek Watershed Management Plan Site 16 Background In April 2010, the Deepwater Horizon oil platform exploded, killing 11 workers and leading to the worst environmental disaster in U.S. history. As a result, the RESTORE Act was signed into law in 2012, directing 80% of administrative and civil penalties back to the impacted areas of the Gulf Coast through the Gulf Coast Restoration Trust Fund.

The U.S. Department of Treasury serves as the administrator of the RESTORE Act Direct Component, one of five funding streams through the RESTORE Act. In Florida, RESTORE Direct Component projects are selected and implemented by the 23 Gulf Coast counties, contingent on compliance with the RESTORE Act and acceptance by the U.S. Department of Treasury. To ensure projects are consistent with the RESTORE Act and obtain broad-based participation in the project selection process, Treasury requires submittal and acceptance of a Multi-Year Implementation Plan. The U.S. Department of Treasury approved Escambia County’s Initial MYIP on Oct. 20, 2017, which included 10 projects selected by the Escambia County Board of County Commissioners. The first amendment to the MYIP was approved by the U.S. Department of Treasury on June 16, 2020, which included modification to three projects included in the Initial MYIP and the addition of eight new projects. The second amendment to the MYIP was approved by the U.S. Department of Treasury on Aug. 16, 2021, which proposed the addition of funds to one existing project and the addition of a new project. The RESTORE Act and the U.S. Department of Treasury require the county to complete a 45-day public comment period to obtain broad-based participation from the public prior to the submittal and approval of MYIP Amendment 3. Escambia County will take all public comments under advisement and reflect those comments in the public comment section of this document following the public comment period closure. The new full-service hotel features a restaurant and bar as well as two large meeting room spaces. SMP Architecture of Pensacola served as the designer for the hotel project. The newly completed Hilton Garden Inn is located at 8 S. 9th Avenue in, adjacent to Aragon Square.

SINGING IN THE STREETS WITH THE CHORAL SOCIETY OF PENSACOLA AND THE PENSACOLA CHILDREN’S CHORUS Two Pensacola favorites join forces for a fun and fabulous community singalong The Pensacola Museum of History is known for its many exhibits portraying the uniqueness of the city’s past, but during Foo Foo Fest, it will transform into the setting for a spirited community singalong. The Choral Society of Pensacola and the Pensacola Children’s Chorus teamed up for a spectacular Foo Foo event this year, Singing in the Streets, which will bring the performance off the stage and into the community. “At the Choral Society of Pensacola, our mission is to provide the community with a diverse set of singing activities,” said Peter Steenblik, its artistic director. “This event lets us come out from behind the curtain and make music in the community in a less formal environment.” Alex Gartner, artistic and executive director of the Pensacola Children’s Chorus, echoes Steenblik’s excitement about creating an opportunity for a community-wide singalong, which will be held flash mob-style on the steps of the Pensacola Museum of History. “We really wanted singing to be the focus of our event for Foo Foo Fest, and not in a typical performance where the audience comes in and just consumes the art but rather participates in it themselves,” Gartner explained. “Singing in the Streets is a great opportunity for all of Pensacola—and those in from out of town—to perform collectively as a group and just have a good time around song.” Singing on the Streets will include a variety of well-known songs for the crowd to perform, from Broadway hits to Disney favorites, all of which will be led by the Pensacola Children’s Chorus and Choral Society of Pensacola and the musical accompaniment of piano, guitar, and drums. “We’re trying to turn the traditional performance model on its head because we really want people to recognize that their voice is valuable and important and can be part of the music making,” Gartner added. The singalong is free to the public and scheduled for Thursday, November 2 at 6:00 p.m. Gartner is excited about the opportunity for entire families to enjoy the lighthearted event together, which speaks—or rather sings—to the community’s appreciation of the arts. “Arts and culture are really an essential heartbeat of our community,” Gartner said. “We are so fortunate to have what we have here in Pensacola. It’s unique and special, and Foo Foo Fest does a great job of bringing everyone together for this two-week period. We’re thrilled at having the opportunity to put together a musical celebration for Foo Foo that can engage our entire community.” And as Steenblik points out, collaborative events like this are made possible because of

the grants given by Foo Foo Fest. “We love getting the chance to collaborate with other organizations, and Foo Foo Fest is what affords us that opportunity,” Steenblik said. “Foo Foo gives organizations in Pensacola the opportunity to build artistic bridges with others within our community, and we’re so thankful for it.” About ACE Art, Culture and Entertainment, Inc. (or ACE) is a non-profit organization that will receive Federal, State of Florida, Escambia County, City of Pensacola, corporate, foundation and personal funds to disperse through equitable granting processes to arts, culture and entertainment organizations throughout Escambia County, Florida. Our General Operating Grant Program requires eligibility for an organization to have been in existence for at least 24 months and be IRC Section 501(c) (3) organizations. Our Mini Grant Program requires eligibility for an organization to be a Florida Non-Profit with its primary location in Escambia County, FL. About Pensacola Foo Foo In 2014, Art, Culture, and Entertainment, Inc. (ACE) approached the Escambia, Florida County Commission with the thought of securing grant monies to be distributed among various arts/cultural organizations in the Pensacola area. Just an idea then, Foo Foo has since morphed an annual 12-day celebration that occurs during the first two weeks of November. It is generally bookended by longtime Pensacola cultural events — the Great Gulf Coast Arts Festival and the Blue Angels Homecoming Airshow at NAS Pensacola. Foo Foo highlights and invites guests and locals alike to experience and enjoy the plethora of Fall arts and cultural events that occur in Pensacola, with a mission of enhancing the overall quality of life for all of Pensacola. About the Pensacola Children’s Chorus The Pensacola Children’s Chorus (PCC) is a non-profit, community-based arts education program which uses music and performance to inspire and nurture a new generation of young leaders. Serving 300 young musicians from over 60 schools across Northwest Florida and Southwest Alabama, PCC uses music education to provide opportunities for personal growth, friendship, and community service. Formally established in 1990 as a program of the Pensacola Symphony, the nowindependent organization continues to pursue diversity of talent, repertoire, and performance to enhance and enliven the cultural fabric of our community. To fulfill its role as the preeminent regional youth music education program, PCC presents a full season of outreach, educational programs, and performances each year for thousands of children, youth and adults.

EAST GARDEN DISTRICT BEGINS TRANSFORMATION A collaboration between Catalyst HRE and the Pensacola Community Redevelopment Agency (CRA) funded the early stages of the transformation of the East Garden District. The first step in the transformation involved reworking North Jefferson Street between Chase and Garden Streets and renovating space for The Well Floridian Lounge, located next to Perfect Plain Brewing Company. One of these developments also included a new home for Union Public House. The popular dining destination opened in late August after previously operating out of a renovated 1934 cinderblock building once occupied by the Salvation Army. Developers have also recently announced a 175,000-square-foot, 9-story Tapestry Collection hotel by Hilton that will be located at the intersection of Jefferson and Chase streets and will include around 150 rooms, as well as suites with luxury amenities. The hotel’s design includes an “urban chic” firstfloor lobby, lobby bar, full-service restaurant, second-floor ballrooms, meeting rooms and a fitness facility. Guestrooms and suites will occupy floors three through eight. The ninth

floor will feature an indoor/outdoor rooftop restaurant and bar overlooking downtown Pensacola and Pensacola Bay. The hotel is the future centerpiece of a renovation that includes 20,000 square feet of repurposed properties along Garden Street and 30,000 square feet of new mixed-use developments. Developers are also in the process of working through the design of a new building located in the current parking lot space on North Jefferson Street next to Papa’s Pizza, which will host a ramen noodle bar type-restaurant. A new Cajun restaurant is also being planned for the corner of East Garden and North Palafox in a space previously occupied by the Pensacola News Journal. The plan is to activate the entire district with new restaurant and retail uses. To the north of the new ramen restaurant, developers are also working on designs for a three-story, four-unit residential building they hope to build. Plans for the 9-story Hilton hotel currently remain in the planning phase, and developers are optimistic they will break ground by the end of the calendar year.

Other spine-tingling tunes include “This is Halloween,” “Monster Mash” and “Transylvania Mania.” “Hauntcert promises to be an evening of musical enchantment that captures the spirit of Halloween in an unforgettable way,” Alex Gartner, Artistic & Executive Director, said. “We wanted to provide the community with a fun, festive event with engaging activities that both young and old can enjoy.” Hauntcert has a run time of 35 minutes, and will feature additional activities specifically with families in mind. Between the 3:30 and 6:30 showings, kids are invited to go trick-or-treating throughout the Saenger Theatre. During the concert, children in the

audience will have the opportunity to join the performance on-stage during the Costume Conga Line, where they can show off their best costumed looks. BRUCE BEACH PARK ON TRACK TO BE COMPLETE NEXT YEAR As construction is close to completion on the first phase of Bruce Beach, Pensacola will now look to begin the project’s second phase. The Pensacola City Council agreed to transfer $1.8 million in Community Redevelopment Agency (CRA) funds to begin construction on phase two of the park. Since Hurricane Sally, the city has been in talks with the Federal Emergency Management Agency to receive disaster funds to rebuild the park’s seawall, which was badly damaged in the storm. Questions of whether the damage was caused by the storm or a runaway barge from Skanska have held up FEMA from awarding money. The second phase of Bruce Beach went out for bid in June of this year, and two construction firms submitted bids for the project. The lowest bid from Biggs Construction Company, Inc. came in at approximately $4,495,466 million with the required 10 percent contingency fund, for a total cost of $4,994,991 million. Phase two includes planting many of the 194 planned trees in the park and building wall terraces, a mound overlook, a rock

scramble, a sand volleyball court, a picnic area and a kayak launch. With engineering, design and other line items for the project, the total cost is projected to be $5.6 million. The CRA currently has $3.7 million budgeted for Bruce Beach. The City Council approved funding the first phase of the project in May 2022 for $6.9 million also to Biggs Construction Company. The first phase included the construction of a central plaza with a walkway surrounded by trees leading to the sandy beach shore, a shade structure, two public lawn areas with seat walls, a learning garden with plants and play structures for children and a pedestrian bridge over Washerwoman Creek connecting the park to Community Maritime Park. In August, the CRA voted to move forward with the second phase of construction, awarding the lowest bid to Biggs Construction Company, Inc. for a total of $4,994,991 million. The total cost for the Bruce Beach Park project will now be more than $12.5 million. With construction set to begin on phase two, Bruce Beach Park is anticipated to open in 2024.

THE WESTMORE TO BRING 328 NEW APARTMENTS AND GROCERY STORE TO GARDEN STREET A block of Spring Street in downtown Pensacola will get a facelift as part of a new grocery store and apartment development that the Pensacola City Council unanimously voted to support in May of this year. The new Westmore Apartments will bring 328 apartment homes, a 37,000-square-foot largescale grocery store and a 750-space parking garage with 175 spaces reserved for grocery store customers. Louisiana-based Bearing Point Properties is building the development that developers also hope will include a 54-unit luxury condo development called the Waverly. In May 2022, the City Council voted unanimously to approve a development agreement that pledges $1.5 million in CRA

funds as an incentive to upgrade a block of Spring Street between Garden and Romana Streets. The developer will build and pay for the Spring Street improvements at a cost of $2.4 million before being reimbursed by the city with the $1.5 million incentive payment. The plan calls for upgrading landscaping along Spring Street and shifting the center of the road about 50 feet to the east, which will add a sharper curve in the street, allowing trucks to make deliveries to the grocery store. John Buzzell with Bearing Point Properties told the CRA board that they are working on updating designs to Spring Street that will include some type of bike lane to the street, though he could not say specifically what it would look like at this point.

NINE-STORY HOTEL PROPOSED ATOP DOWNTOWN PALAFOX POST OFFICE BUILDING Pensacola architects Brian Spencer and William Brantley presented conceptual plans for a new nine-story, 159-room hotel at the corner of Palafox and Romana streets to the Pensacola Architectural Review Board in July. The new tower would be built over the historic corner building that dates to the 1880s and currently houses a post office. The historic building would be incorporated into the new nine-story building that would be 136 feet tall and feature a 161-space, sevenlevel parking garage in the rear of the building. The proposed hotel would also have a rooftop pool with views overlooking Pensacola Bay. If the proposal moves forward, the 1990s post office expansion would be demol-

ished while the 1880s portion of the building would be kept. Spencer said the design would preserve the “historic load-bearing brick facades yet incorporate new modern architecture and structural framing systems side by side.” Drawings presented to the ARB are still in an early stage and do not reflect the final colors or brickwork of the building but only the concept of what the architectural designs will be. Before the project can move forward, building developers still need to seek additional ARB approval for the completed design along with authorization to demolish the 1990s addition to the building.

TALLAHASSEE — Saying that notices sent by the state “border on incomprehensible,” attorneys for Medicaid beneficiaries fired back this week in a potential class-action lawsuit alleging Florida has not provided adequate information before dropping people from the health-care program. The plaintiffs’ attorneys are asking U.S. District Judge Marcia Morales Howard to issue a preliminary injunction that would require reinstating coverage to people dropped from the program in recent months and ending additional terminations until adequate information is provided. “Due process guarantees an adequate notice that ‘fully informs’ the enrollee of the case against them so they can decide whether to request a pre-termination hearing,” the attorneys wrote in a 15-page brief Monday, partially quoting a legal precedent. “The notices in this case border on incomprehensible. As a result, people incorrectly decide not to appeal, or lose the right to benefits pending appeal, and must then scramble to figure out next steps.” The lawsuit, filed in August in Jacksonville, stems from a process that the state started this spring to determine whether more than 5 million people enrolled in Medicaid remained eligible for benefits. The process was a result of the end of a federal COVID-19 public-health emergency. A filing this month by attorneys for the state said 2.5 million “redeterminations” had been conducted since April, with more than 1.7 million people found eligible and nearly 830,000 found ineligible. The redetermination process is expected to continue for months. The Oct. 6 filing by attorneys for the Florida Agency for Health Care Administration and Department of Children and Families disputed that the state had violated beneficiaries’ rights and said the judge should deny the plaintiffs’ requests for an injunction and to treat the case as a class action. “Plaintiffs’ requested injunction upsets the apple cart with respect to millions of people: those who were found ineligible for full Medicaid whom plaintiffs demand be reinstated, and those for whom eligibility re-determinations would be halted during the pendency of this litigation,” the state’s attorneys wrote. “DCF’s (the Department of Children and Families’) administration of a multibillion-dollar program cannot simply pivot overnight to accommodate chaos of that magnitude.”

An Oct. 30 hearing is scheduled. The federal government declared the public-health emergency in 2020 as the COVID19 pandemic began. Medicaid is jointly funded by the federal and state governments. As part of the emergency, Washington agreed to pick up more of the tab for the program. But in exchange for the extra money, states had to agree that they wouldn’t drop people from the Medicaid rolls during the emergency. Florida’s program grew from about 3.8 million beneficiaries in January 2020 to nearly 5.8 million in April of this year, at least in part because people who might not otherwise be eligible for coverage could not be dropped. With the end of the emergency, the state began redeterminations, and the Medicaid rolls had dropped to about 5.25 million in August, according to data on the Agency for Health Care Administration website. But the lawsuit, advocacy groups and Democratic lawmakers have criticized the process and what they say is a lack of adequate notice before benefits are cut off. “Defendants’ (the state agencies’) primary argument seems to be that the content of DCF’s termination notice does not matter because the wild goose chase triggered by that notice (e.g., repeated calls to the call center, sorting through previous notices from months before, and general statements of program information), could eventually amount to adequate notice if an enrollee gets accurate information from DCF staff and figures out how to put all the puzzle pieces together,” Monday’s brief said. “The court should reject this version of due process because it ignores controlling law.” But state officials last week defended the process while testifying before the state Senate Health and Human Services Appropriations Committee. “Our top priorities here are that we want to ensure that if you are eligible, you maintain your coverage and if you’re not eligible, that you are provided with alternative options for what may be available for you to choose from,” Casey Penn, a deputy secretary of the Florida Department of Children and Families, told lawmakers. The plaintiffs in the lawsuit are a mother and daughter from Jacksonville and a mother and daughter from Miami-Dade County. Their full names are not included. The Agency for Health Care Administration runs most of the Medicaid program, but the Department of Children and Families is heading the redetermination process.

CNN SHIELDED FROM PUNITIVE DAMAGES IN DOCTOR LAWSUIT JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — A divided appeals court Wednesday blocked a physician from seeking punitive damages in a lawsuit against CNN over reports about deaths of children in an open-heart surgery program at a Palm Beach County hospital. A panel of the 4th District Court of Appeal said Michael Black, the former head of the pediatric open-heart surgery program at St. Mary’s Medical Center, had not met a legal requirement of showing “actual malice” to pursue punitive damages in a defamation lawsuit he filed against CNN and two reporters. The 2-1 ruling does not end the underlying defamation lawsuit but prevents potentially hefty punitive damages. It overturned a decision by a circuit judge that would have allowed Black to revise the lawsuit to seek punitive damages. “Because we conclude Dr. Black failed to support his claim for punitive damages with evidence providing a reasonable basis to conclude that CNN published the reports with actual malice, we reverse the circuit court’s order,” the ruling, written by Judge Jeffrey Kuntz and joined by Judge Cory Ciklin, said. “We express no opinion on the viability of Dr. Black’s underlying defamation claim.” The lawsuit centers on 2015 reports by CNN that said the St. Mary’s pediatric openheart surgery program had a death rate from 2011 to 2013 that was more than three times the national average. The rate was calculated by dividing the number of deaths by the number of surgeries. St. Mary’s and Black disputed the reports because they said CNN’s calculation of the death rate was not adjusted to reflect the “risk profile of the patients and the complexity of each surgery,” Wednesday’s ruling said. Black alleged that CNN excluded such

information “from its reporting to support a false claim that the surgical program’s mortality figures were ‘shocking’ or ‘alarming,’ and to falsely portray him ‘as a callous, incompetent, and dishonest surgeon responsible for the preventable deaths of many of his patients,’” the ruling said. “In doing so, Dr. Black alleged that CNN knowingly disregarded journalistic ethics to publish their ‘sensational’ story in pursuit of financial gain and journalistic awards.” But the appeals-court majority pointed to a 1974 U.S. Supreme Court decision that said actual malice must be shown for plaintiffs to receive punitive damages in defamation lawsuits against media defendants. “Dr. Black’s proffer (of evidence) focuses solely on CNN’s mortality rate analysis,” Wednesday’s ruling said. “He does not challenge CNN’s reliance on any other source in its reporting. And even limited to the use of the raw mortality rate, at most, CNN knew experts disagreed about the rate’s significance. For these reasons, Dr. Black’s proffer does not reflect facts from which a fact finder could find that CNN had published its reports with actual malice or had entertained serious doubt that its reports’ overall message was false.” Judge Martha Warner dissented, writing that Black provided evidence that gave a “reasonable basis” for being able to pursue punitive damages. “The death rate led CNN — and its readers — to the conclusion that Dr. Black’s program was seriously deficient even though CNN’s reporting was based on the raw data death rate, which CNN knew, based upon its prior reporting and consultation with experts, was misleading and inappropriate,” Warner wrote. In addition to CNN, Black filed the lawsuit against reporters Elizabeth Cohen and John Bonifield.
