100 ART SALE RETURNS TO ARTEL GALLERY

ince 2019, Artel Gallery, a local nonprofit arts organization dedicated to supporting emerging artists across the region, has been throwing an annual event like no other—the Keep It 100 art exhibition. Back for its fourth year, the Keep It 100 exhibit features original pieces of work by more than 80 local artists. Taking place November 21 through January 6, this unique exhibit has grown to become an integral part of the arts community and is widely celebrated by both artists and art lovers alike. The exhibit offers members of the community the chance to shop for one-of-a-kind art pieces, all priced at $100. Not only does the exhibit make art accessible and affordable to individuals from all walks of life, it also supports local artists during the holiday season. Keep It 100 has grown to become an annual tradition for the gallery.

Artel Exhibition Director, Hope Mastroianni, said the exhibit was designed to provide all types of art lovers with the opportunity to grow their private collections at an affordable price. “We moved this year’s Keep It 100 to the end of the year so that art would be more available to purchase as Christmas gifts,” Mastroianni said. There are no thematic requirements for Keep It 100, except that each piece entered must be for sale and priced at $100. The exhibit will feature original pieces of work in a variety of mediums, including sculptures, paintings and photography. “Each year, we have anywhere from 100 to 140 entries, but only about 80 to 90 make it into the show,” Mastroianni explained. “The exhibition is judged, and cash awards are presented for first through third place winners, Best of Show, Most Experimental and Honorable Mention.” Founded in 1993, Artel Gallery is a volunteer-run organization dedicated to fostering art appreciation

throughout the region. Its mission is to provide a continuous forum for quality experimental and contemporary art exhibitions and programs dedicated to the enrichment and education of the community. Neither a co-op or a retail gallery, Artel is an experimental institution and is the only one of its kind in Northwest Florida. “All exhibitions at Artel change every six weeks. The Vault accepts applications through the year and the Award Alcove is reserved for the artist who won Best of Show from the previous show. Artel now has a new exhibition room, which will host five solo shows, four of which will be themed shows for everyone to enter,” Mastroianni said. The annual Keep It 100 exhibit will be on display November 21 through January 6 at Artel Gallery at 223 Palafox Place in downtown Pensacola. The exhibit is open to the public and free to attend. ODD COLONY EXPANDS TO EAST HILL WITH NEW BIERGARTEN AND EATERY By Madeleine Davis

dd Colony Brewing Co. is expanding its roots with the opening of a neighborhood biergarten, cocktail lounge and kitchen called The Burrow. Located on the lower floor of the historic Sacred Heart Hospital building in East Hill, the new venue is slated to open mid December. Longtime friends and Pensacola natives, CEO and founder Blake Foster and co-founders Brett and Beth Schweigert have worked tirelessly for the last five years to bring their ideas and dreams to fruition. After an unforeseen halt in construction, The Burrow’s setbacks will force the restaurant to open later than originally expected, as it was initially planned to open in the spring of 2023. Owners plan to keep the historic hospital’s gothic charm, while adding in some wilderness elements that align with Odd Colony’s idiosyncratic aesthetic. The Burrow will feature an 8,000 squarefoot outdoor area, which will also serve as home to a cabin-esque outdoor bar. The kitchen menu will be cultivated by Amy Potmesil, a community culinary celebrity in Pensacola, who has ties to restaurants like Union Public House, The Well and The Nest General Store. Potmesil has been hosting pop-ups featuring

potential menu items at Odd Colony’s original downtown location until The Burrow’s official grand opening later this month. “The food program will be elevated fast casual, synchronized harmoniously with our brewing ethos by utilizing local agriculture and creating a true sense of place. There will be a large tapas style menu, handhelds and some elevated evening offerings,” Foster said. There are also plans to reveal a unique brunch menu in the near future. Assistant General Manager and Bar Lead Erin Cuneo has handcrafted a cocktail menu that is only available at The Burrow. Customers enjoy some of Odd Colony’s signature brews, but The Burrow will have a small brewing system that will offer a handful of new beers for their patrons to try. Foster expressed Odd Colony’s excitement for this new adventure. “Our entire team loves the outdoors. Being able to enjoy a meal, beer, cocktail, or glass of wine in the fresh air is something we have not had downtown. Also, adding the element of an in-house kitchen gives us abundant opportunity to explore tying in our food and beverage programs harmoniously,” Foster said. The Burrow intends to keep the same integral design as Odd Colony, as the company hired many of the

same local contractors to transform it into the biergarten of their wildest dreams. More specifically, they rehired Losobe Woodworks, who have worked on Lily Hall, Union Public House, Craft Gourmet Bakery and many more local favorites. Other local companies like Spoon & Hook, Specialty Ceilings and Integrated Solutions have also lent a helping hand in cultivating The Burrow. “Our goal is to always create a uniquely immersive OC experience for our guests. That being said, we attempted to venture into a new territory and create a new thread to the greater Odd Colony fabric. We share some elemental crossover but we believe this will be a truly unique spin on the Odd Colony brand,” Foster said regarding the team’s excitement about their new location. NAVY FEDERAL CREDIT UNION DELIVERS GIFTS TO 590 INDIVIDUALS THIS HOLIDAY SEASON

BELLVIEW MIDDLE TO BECOME A COMMUNITY PARTNERSHIP SCHOOL

Navy Federal Credit Union employees made the holidays a little brighter for 121 local families in Escambia and Santa Rosa counties this year through the annual Project Neighbors: Holiday Giving Program. Team members use paid volunteer hours to shop for items, wrap them and deliver gifts to families. Navy Federal is proud to support volunteers in their community service efforts. “Navy Federal helped me in a way that I didn’t know was possible,” said a Project Neighbors recipient. “I am very grateful for this company.” Project Neighbors is part of Navy Federal’s flagship School Partnerships Program, which partners with local public schools and nonprofit organizations, like Big Brothers Big Sisters, The Arc Gateway and Boys and Girls Club, to identify families in need during the holiday season. “Being able to help families have a happy holiday brings my team and I such joy,” said Elizabeth Haymans, Project Coordinator at Navy Federal. “To deliver gifts, to show others this community cares, to ensure so many children get to experience the joy of the season, it

Bellview Middle School will become the third school in Escambia County to adopt the innovative Community Partnership Schools™ model this year with partnerships among Children’s Home Society of Florida, Community Health Northwest Florida, Escambia County School District and the University of West Florida. The partnerships are announced as the next step in growing the successful model first implemented in Orlando at Evans High School in 2012 and expanded to more than 40 schools statewide, transforming tens of thousands of lives. The effective Community Partnership Schools™ model requires at least 4 core partners – including the school district, a healthcare provider, a nonprofit organization and a college or university – to agree to a 25-year commitment to the school and community, impacting generations. Founded by the Children’s Home Society of Florida and the University of Central Florida, the Community Partnership Schools™ model engages core partners, collaborating with local nonprofits, businesses, the faith community, and other stakeholders. Together, they operate within schools to tackle crucial barriers to learning, such as food insecurity, poverty inadequate access to affordable healthcare, behavioral health services, and heightened rates of violence and crime, among other identified challenges. Children’s Home Society of Florida received $80,000 in state grant funds after being selected by UCF’s Center for Community Schools to launch a community partnership school at Bellview Middle, in addition to local financial contributions to support this initiative. “We are excited about our partnership with the Children’s Home Society of Florida,” remarked Escambia County Public Schools Superintendent Keith Leonard. “The addition of Bellview Middle School to our Community Partnership schools will provide our students, families and the entire community surrounding Bellview Middle with wraparound services second to none.” “Expanding our reach to include Bellview Middle, a Community Partnership School, represents a direct impact on the lives of over 600 additional students and their families within Escambia County,” said Lindsey Cannon, Executive Director of Children’s Home Society of Florida. “Through collaborative efforts with our core and community partners, we’ve established a vital support network for students and families as they embark on their educational path at C.A. Weis Elementary, a Community Partnership School, progress to Bellview Middle, and culminate their journey at Pine Forest High, also a Community Partnership School. This continuum guarantees consistent support throughout their educational pursuits and we are thrilled to contribute to the collaborative efforts aimed at enriching our local community.” The first step toward implementation is the planning phase, which includes a community needs assessment. Students, teachers, parents and community members identify their primary needs and challenges, the results of which will determine the services and solutions that will be brought into the school. Other critical components of this model include a focus on parental and family engagement, as well as comprehensive health and wellness efforts. “As a Federally Qualified Health Center, we

LANDRUMHR 5K RAISES $15,000 BENEFITTING LAKEVIEW CENTER In a check presentation at Lakeview Center’s December board meeting, LandrumHR presented a donation of $15,000 from the proceeds of their inaugural 5K Run/Walk event held in October. The event promoted awareness of the link between physical and mental health. “LandrumHR was inspired to create an event that features exercise as a way to improve mental health,” said Britt Landrum, III, CEO of LandrumHR. “And because of the great work they do with mental health services, partnering with Lakeview was the perfect fit. We’re excited about the community’s response to our first year,” continued Landrum, III, “and we are already looking forward to our second annual event set for October 19, 2024. According to the National Institutes of Health, exercise improves mental health by reducing anxiety, depression, and negative mood and by improving self-esteem and cognitive function. These health benefits can be achieved with as little as 30 minutes of moderately intense exercise – like brisk walking – three times a week. “The generous support of the LandrumHR team and event sponsors will help benefit the more than 24,000 adults and children served every year through Lakeview Center,” said Allison Hill, CEO of Lakeview Center’s parent company, LifeView Group. “We see people in some of their most vulnerable moments, and funds raised from this event will help us fulfill our mission of ‘helping people throughout life’s journey’.” Prizes were awarded at the 5K for the top male and female racers with additional prizes for specific age groups. Richard Mayberry won first place in the male category and Tia Guidry, with Lakeview Center of Walton County, won first place in the female category. Most importantly, $15,000 was raised to support services and programs offered by Lakeview Center, a non-profit that has been serving the community for almost 70 years. to outpatient counseling, psychiatry, trauma care, treatments for substance misuse, and 24/7 support for those with serious mental illnesses. SANTA ROSA COUNTY CLERK OF COURT TO BEGIN PERFORMING MARRIAGE CEREMONIES IN THE RECORDING DEPARTMENT The Santa Rosa County Clerk of Court will offer the services of performing marriage solemnization or ceremonies beginning Jan 2, 2024. Individuals will be able to get married in the Recording department, the same place they apply for their marriage license. Recording Department is located at 6495 Caroline St, Milton, Fl 32570. This service will be performed in house by a deputy clerk for the fee of $30.00. That is in addition to any other fees associated with the marriage license. Florida residents

must wait 3 days or have proof of premarital counseling by an approved provider. This does not apply if BOTH applicants are out of state residents. This service will also be available at the Clerks office at the South Santa Rosa Service Center, located at 5841 Gulf Breeze Parkway, Gulf Breeze, Fl 32563. BROWNSVILLE SILVER SENIORS BUILDING STRONG COMMUNITY WHILE SERVING OTHERS They may call themselves the Brownsville Silver Seniors, but this growing group of strong, supportive and fun women represents much more than just the Brownsville community. Meeting at Escambia County’s Brownsville Community Center twice a week, the close-knit group of women ages 55 and over includes members from throughout the county, including Beulah, Bellview, Ensley, Ferry Pass, Warrington, Eastside, Westside, and of course – Brownsville. The Brownsville Silver Seniors began meeting in January 2023, quickly growing from a small group of about 10 members to more than 50 members in less than a year. Anyone 55 and older is welcome to join the Brownsville Silver Seniors, which offers a variety of activities for seniors including games, crafts, exercises, karaoke, prayer and devotional time, birthday and holiday parties, luncheons, outings, and much more. Although their membership is currently only women, President Callie Moye said men are more than welcome. “We do a lot of great things here,” Moye said. “I think once people come – one day they come in and say they just want to check us out, and at the end of the day, they’re ready to join.” Their overall goal is to enhance the lives of senior adults, along with the lives of anyone they interact with, while spreading kindness and positivity wherever they go. The Brownsville Silver Seniors are becoming a recognizable positive force in the community, often spotted in their golden yellow t-shirts while visiting local churches, volunteering, or attending community events. “We are so fortunate to have such a strong, spirited group of women bringing life into the Brownsville Community Center and into our entire community,” District 3 Commissioner Lumon May said. “These ladies have a wealth of knowledge and history in the greater Pensacola and Escambia County area, and I am incredibly proud to be able to host them each week at the Brownsville Community Center. The Silver Seniors have already brightened our community significantly in their first year, and I am excited to see what they do in the future as they continue to grow.” The mission statement of the Brownsville Silver Seniors is “To provide senior adults with fun and positive opportunities to fellowship, respect, encourage, love, and uplift one another through peaceful interactions for improved and enhanced lives in a safe and nurturing environment.” Moye said faith plays a significant role in the Silver Seniors’ mission, and they strive to provide a fun, supportive atmosphere for seniors each time they meet. “We try to put God first in just about everything that we do here, and we base it on love,” Moye said. “We try to show one another love. The main thing is because the women, the seniors, they’re home within their communities, they’re lonely, they don’t have anything to do. So when they come out, we want to have some sisterhood that we can

just embrace each other and just have fun and enjoy each other.” The Silver Seniors have already built a strong sisterhood, with members supporting each other through sickness and loss, while also celebrating the good times together along the way. “It is a beautiful thing, because we do support each other,” member Angelena LeRoy said. “When one hurts, we all hurt. When one has joy, we all have joy. So we have really created a bond here that no one can replace.” As the group continues to grow, one of their main goals is to find more ways to give back to the community, whether it’s through mentorships or just lending a helping hand wherever they can. The Brownsville Silver Seniors recently began their first mentorship for a young mother who was living on the streets with her five small children, in need of everything from housing to socks for her babies. Together, the seniors were able to provide her with a carload of diapers, clothes, and other essential items, also helping her find housing and a job. “Meeting the young lady, we could tell she was down on her luck – but she was so appreciative,” member Lee Snow said. “One thing we learned when talking to her is that she’s a very smart young lady that had just run into hard times. So those are the kind of things that we are trying to do. She just needed someone to show her some love.” The Silver Seniors will continue following up with the mother to mentor her and make sure she meets the goals they set together to help her and her children have a better future. “It was and is, for us, an act of love and giving back to our community,” member Vinesta Lyles said. “And of course, we are females, we are Black women, and we have come through some hard times. So we understand, and we are willing to reach out and to give a hand up.” As they approach their one-year anniversary and look to the future of the Brownsville Silver Seniors, the members plan to continue to offer fun activities, along with new additions such as technology classes to help seniors with computers and smartphones. But most importantly, they want to keep giving back and making a difference in the community. “When people see us out there with those yellow shirts, they recognize us, and they know we are out there for a good cause,” Snow said. The Brownsville Silver Seniors meet every Tuesday and Thursday from 11:30 a.m. to 1:30 p.m. at the Brownsville Community Center, located at 3200 W. De Soto St. Anyone 55 and older is welcome. ESCAMBIA COUNTY INSTALLS NEW PLAYGROUNDS AT SEVERAL COUNTY PARKS Escambia County Parks and Recreation has installed four new playgrounds this year at several neighborhood and community parks throughout the county, with four additional playgrounds planned for 2024. A new playground and exercise equipment were also installed at the Escambia County Extension Services building, providing additional play and recreational opportunities in the north end of the county. The new playgrounds provide a variety of play features for children of all ages to enjoy, including slides, climbing structures, exercise equipment, interactive games, musical instruments, and more. TALLAHASSEE — With the mother of a transgender girl testifying that it would be “devastating” if the child could not get treatment, a federal judge Wednesday began a trial in a constitutional challenge to Florida restrictions on such things as puberty blockers and hormone therapy for transgender people. The mother, a St. Johns County resident identified by the pseudonym Jane Doe, was the first witness in what is expected to be a multiday trial in the challenge to a state law and rules approved by the Florida Board of Medicine and Florida Board of Osteopathic Medicine. The law and rules block transgender minors from receiving puberty blockers and hormone therapy to treat gender dysphoria, while placing additional restrictions on treatments for adults. Jane Doe, a plaintiff in the case, said her 12-year-old daughter was identified as a male at birth but was diagnosed by a pediatrician with gender dysphoria at age 4. The girl has not started treatment with puberty blockers but has received care from endocrinologists as the family prepares for such a step. The mother testified that her child has “never, ever wavered from who she is” and that her life would be “turned upside down” if she was denied treatment. “It would force her to be someone that she’s not,” Jane Doe testified. Gov. Ron DeSantis and the Republicancontrolled Legislature passed the law (SB 254) during this spring’s legislative session. In part, it barred doctors from approving puberty blockers and hormone therapy for treatment of minors with gender dysphoria. It also required adults seeking hormone therapy or surgeries for gender dysphoria to sign informed-consent forms crafted by the medical boards. Also under the law, only physicians — not nurse practitioners — are allowed to approve hormone therapy, and it banned the use of telehealth for new prescriptions. Florida is among numerous Republicancontrolled states that in recent years have approved proposals targeted at transgender people, with some of the highest-profile debates about banning treatments for transgender minors. Florida contends that such treatments are unproven and risky for minors — despite support for the treatments from major medical organizations. DeSantis has called such treatments “child mutilation.”

‘GAMECHANGING’ SENATE HEALTH PLANS APPROVED A Senate committee Tuesday unanimously approved two high-profile bills that supporters say would help expand access to health care and spur innovation in Florida. The bills approved by the Senate Health Policy Committee, are a top priority of Senate President Kathleen Passidomo, R-Naples, for the 2024 legislative session, which will start Jan. 9. One of the bills (SPB 7016), carried by Senate Health Policy Chairwoman Colleen Burton, R-Lakeland, would make wide-ranging changes such as expanding residency

During opening arguments Wednesday, Mohammad Jazil, an attorney for the state, said the “state has every right to dictate some of the norms for medical treatment” for gender dysphoria, which the federal government defines clinically as “significant distress that a person may feel when sex or gender assigned at birth is not the same as their identity,” But Thomas Redburn, an attorney for the plaintiffs, accused the state of “invidious discrimination” against transgender people. He said, for example, the state has not barred puberty blockers and hormone therapy to treat other types of conditions. “The state has singled out transgender people for disparate treatment without any adequate justification,” Redburn said. Redburn also pointed to statements by Republican lawmakers, including the use of words such as “mutilation.” He said the state has “decided people should not be transgender.” But Jazil said the plaintiffs will not be able to prove that the restrictions were motivated by “animus” toward transgender people. He said, for instance, that the plaintiffs only cited statements from a few of the 160 lawmakers. “Animus is a pretty high bar,” Jazil said. While it was not addressed during the opening arguments, the state also is pointing to an August ruling by a panel of the 11th U.S. Circuit Court of Appeals in an Alabama case known as Eknes-Tucker v. Governor of the State of Alabama. The panel overturned a preliminary injunction that a district judge had issued against an Alabama ban on puberty blockers and hormone therapy for transgender minors. “Plaintiffs don’t have a case after EknesTucker v. Governor of the State of Alabama,” Florida’s attorneys wrote in an opening line of a brief filed last month in advance of the trial. But attorneys for the plaintiffs wrote in a brief that a request is pending for the full 11th U.S. Circuit Court of Appeals to hear the Alabama case and that “the Florida law is different both in scope and history.” The 11th Circuit hears cases from Florida, Alabama and Georgia. Hinkle in September cited the Alabama ruling as he declined to issue a preliminary injunction against the parts of the Florida restrictions affecting transgender adults. Hinkle in June issued a preliminary injunction against the part of the law preventing puberty blockers and hormone therapy for children, with the injunction applying to minors who are plaintiffs in the lawsuit. The state has appealed the decision.

Senate Health and Human Appropriations Chairwoman Gayle Harrell, R-Stuart, called the bill “game-changing.” It also includes such things as making it easier to license foreign-trained physicians and expanding loan-repayment assistance for physicians and dentists who remain in the state to practice. “This is the most-creative, innovative way to really change Florida and put us on the map as the number-one health care state in the country,” Harrell said. The other bill (SPB 7018), carried by Harrell, would create a “Health Care Innovation Council” to help oversee a proposed low-interest loan program for innovative projects. The Senate wants to spend $75 million a year on the program over the next decade.

The ruling by a three-judge panel of the 1st District Court of Appeal involved a state law that applies to firefighters, law-enforcement officers and correctional officers and says certain conditions such as heart disease are presumed “to have been suffered in the line of duty unless the contrary be shown by competent evidence.” Seminole County firefighter Chad Braden, who had a history of cardiac problems, tested positive for COVID-19 on Dec. 27, 2020, according to the ruling. He suffered a heart attack on Jan. 24,

A judge of compensation claims accepted the argument that COVID-19 caused the heart attack and transplant but said “Seminole County failed to rebut the presumption of work causation by proving that Braden contracted the virus outside of work,” according to Wednesday’s ruling written by appeals-court Judge M. Kemmerly Thomas. The appeals court said it found “competent evidence supports the JCC’s (judge of compensation claims’) determination that Seminole County failed to rebut the statutory presumption.” Judge Lori Rowe agreed with the result, though she did not fully sign on to Thomas’ full opinion. Chief Judge Timothy Osterhaus wrote a concurring opinion.

TALLAHASSEE — A federal judge on Tuesday heard arguments as Walt Disney Parks and Resorts tries to keep alive a lawsuit alleging the state unconstitutionally retaliated against the entertainment behemoth because of Disney’s opposition to a controversial education law. U.S. District Judge Allen Winsor is considering motions by Gov. Ron DeSantis’ administration and the Central Florida Tourism Oversight District to dismiss the lawsuit, which stems from the overhaul of a special taxing district that for decades essentially gave Disney self-governing power over its theme parks and neighboring environs. DeSantis clashed with Disney after the company’s leaders in 2022 spoke out against a law restricting instruction on sexual identity and gender orientation in schools. At the governor’s direction, the Republicancontrolled Legislature replaced the Reedy Creek Improvement District with the Central Florida Tourism Oversight District, whose board members are appointed by DeSantis. Disney’s lawsuit alleges the changes punished the company for political speech and violated the First Amendment. But lawyers for the governor and the Central Florida Tourism Oversight District board disagreed Tuesday. “These laws are, on their face and in substance, ordinary, standard, regulatory provisions that regulate, what? They regulate special districts. They don’t even regulate directly Disney,” attorney Charles Cooper, who represents the Central Florida Tourism Oversight District board, told Winsor. “That dooms their free speech claim.” The Legislature and DeSantis in 2022 approved a law that called for eliminating the Reedy Creek district and five other special districts, with the dissolution scheduled to take effect in 2023. But in February, they revisited the issue and replaced Reedy Creek with the Central Florida Tourism Oversight District. The laws did not target Disney, Cooper said. “We don’t have a situation here where these laws have singled out this particular plaintiff,” he said. “Neither statute that is before you explicitly singles out Disney.” David Costello, a state deputy solicitor general, urged Winsor to dismiss DeSantis and Florida Department of Commerce Secretary Alex Kelly as defendants in the case. But Daniel Petrocelli, who represents Disney, told Winsor that the governor is “front and center” in the alleged retaliation against Disney. “What is it you want the governor to not do, that you fear he might do?” the judge asked Petrocelli. “Well, we don’t want him to make any more appointments,” Disney’s lawyer responded.

The court also could block DeSantis from giving direction to the board or taking action to control it, Petrocelli added. “He’s effectively, de facto in control” of the board, Petrocelli said. The board appointments are “allegedly unlawful,” Petrocelli argued, because the law creating the new board was aimed at punishing Disney. Winsor also asked what would happen if the new board was dissolved. “Is it a statutory revival scheme?” the judge asked, referring to returning to previous laws. “Yes, because the (new) statute … would be ineffective,” Petrocelli said. Under the previous laws, the Reedy Creek board was elected by Disney and a small number of other property holders in the district. “As a practical matter, somebody’s going to have to fill the void,” Petrocelli said. Winsor said he would issue a ruling on the motions within the “next couple weeks.” DeSantis, who is seeking the Republican nomination for president in 2024, has made the battle with Disney a frequent talking point as he travels the country and spars with GOP opponents. DeSantis targeted Reedy Creek after Disney issued a statement vowing to fight the 2022 education measure, which opponents called the “don’t say gay” law. “Our goal as a company is for this law to be repealed by the Legislature or struck down in the courts, and we remain committed to supporting the national and state organizations working to achieve that,” the company said in a March 2022 statement. After Reedy Creek was replaced, Disney filed the lawsuit in April and revised it in September. Jonathan Hacker, another attorney for Disney, told Winsor during Tuesday’s hearing that the law unconstitutionally retaliated against Disney for expressing a political viewpoint. “This is as clear a case of retaliation against protected speech as the court will ever see,” Hacker said. But Costello argued that Disney wouldn’t regain control over the special district if Winsor blocked the laws. “I think its (Disney’s) real gripe is that it lost its prior district and there’s a new one now in its place,” Costello said, adding that Disney’s is arguing that it is being harmed “by the mere existence of the law.” Winsor pushed him on the issue, however, saying Disney alleges that the new board is taking actions that damage the company. “It’s not just, ‘Our feelings are kind of hurt,’” the judge said. Costello said Disney hasn’t detailed “specific harms” and can’t directly tie DeSantis to the board’s actions. “There isn’t de facto causality here,” he said.

During the Zoom After recommending in October that a North Florida judge receive a 30-day suspension and a public reprimand because of improper discussions with a prosecutor, a state investigative panel Tuesday said it has started an inquiry into new allegations of misconduct by the judge. The investigative panel of the Florida Judicial Qualifications Commission asked the state Supreme Court to put on hold the October case involving Liberty County Judge Kenneth Hosford. The motion said “additional matters have come to the attention” of the panel. “Because these new matters may impact the resolution of this case, and to avoid prejudice to the parties, the commission respectfully requests that this (Supreme) Court stay the proceedings in the present (October) case until the investigative panel has concluded its inquiry into the new matter,” the motion said. The panel did not disclose the nature of the new allegations. The October case involved a discussion that Hosford had June 15 with an assistant state attorney after a hearing held on Zoom. The panel’s findings said Hosford addressed “concerns over the prosecutor’s decision to decline to file charges in a theft

meeting, while addressing his displeasure with the way the prosecutor had declined to prosecute the case, Judge Hosford also admits to having provided investigative advice to the detective investigating the crime, including suggesting to the detective that he might get a search warrant to obtain more evidence of the crime.” The findings said Hosford also “made other comments clearly evincing a bias in favor of law enforcement.” The investigative panel and Hosford agreed that he should receive a 30-day suspension without pay and a reprimand and recuse himself from criminal matters for three months, according to court documents. The Supreme Court has ultimate authority to decide discipline for judges. But the Florida Public Defender Association and the Florida Association of Criminal Defense Lawyers have expressed concerns about the agreement. In a document filed at the Supreme Court, the public defender association said “the transcript indicates a clear preference for and bias towards law enforcement and prosecutors which creates a wellfounded fear that defense attorneys and their clients will not receive a fair and impartial opportunity in court.”
