Firmly rooted as one of the largest manufacturing companies in Northwest Florida Gulf Cable and its parent company WTEC Energy, have obtained another 30 acres in Santa Rosa County with plans for expansion.

In December 2023, Santa Rosa County officials broke ground on the new facility that will be built on eight acres in the Santa Rosa Industrial Park located at 5689 Industrial Blvd. in Milton, Florida.

Gulf Cable/WTEC currently employs more than 300 individuals in the Santa Rosa Industrial Park. This additional property on Armstrong Road will be used to construct a 160,000-square-foot manufacturing facility that will house and facilitate the growth of their operations.

Within the next three years, if all goes as anticipated, the company will occupy 1.2 million square feet of building space and employ between 600 and 800 people, according to Kevin Bate, the executive president of Gulf Cable’s parent company WTEC Energy.

The company serves diverse markets including renewable (solar

and wind), irrigations, electric utility (distribution and transmission), oil and gas (refineries and production) and petrochemical.

“Gulf Cable is exactly the kind of company we want to be located in the Industrial Park,” Santa Rosa County Commissioner Bob Cole said. “The company is expanding and hiring more people as they continue to grow. They are the perfect industry for Santa Rosa County.”

Gulf Cable, which has been in Santa Rosa County since 2006, is a leading manufacturer of insulated, high-voltage cable that is shipped all over the country for use at solar and wind energy generation sites.

With business already booming, Bate has estimated that by 2030 the renewable energy markets his company supports will be spending a total of $5 trillion worldwide.

According to Shannon Ogletree, Executive Director, and Erica Grancagnolo, Associate Director of Santa Rosa County EDO, “Employment at this facility will increase by more than twenty additional people paying a salary of at least $41,000. This is 115 percent of the 2020 Santa Rosa County Average Wage. We anticipate that capital investment at the site will be approxi -

mately $3,000,000. That’s a big win for Santa Rosa County.”

Gulf Cable last expanded its Milton operations in 2021 when it broke ground on a 160,000-squarefoot building close to an existing campus. At that time, Bate estimated their company would invest around $3 million and add 20 to 30 employees.

“Gulf Cable has been in Santa Rosa County for a number of years now and thanks to the business climate here and the support we receive from the economic development office we are continuing to grow” Executive Vice President, WTEC Energy Innovation Kevin Bate said.

Bates explained that the company has manufacturing facilities located across the South, but that this, and will continue to be, their largest. The the company has manufacturing facilities all across the South, however, this is and will continue to be their largest.

In a statement he made at the groundbreaking, Commissioner Dave Piech said he was very proud of the work done by the Santa Rosa Economic Development Office.

“When it comes to economic development, we can all be very confident that we have the best team

on the job,”

Piech said. “This is the second major ground breaking we’ve attended in less than a year and I expect there are more to come. I can’t wait to see what the future holds for economic growth in our great county.” Bate explained that Gulf Cable will also introduce a new product to the market within the coming year that is anticipated to create the need for minimum of an additional 200 new jobs at the facility. Also, it’s a financial benefit as well.” said Ahum Dhruv the 2023 winner of FPL’s FIRST Robotics Scholarship. “The scholarship allows me to use my time in other regards and I wouldn’t be able to do that without FPL.”

The FPL Robotics Scholarship is open to all public and private high school students across FPL’s service area who have two or

more years in a FIRST Tech Challenge or FIRST Robotics Competition. Interested students can submit their application here or at FPL.com/Education under STEM Grants and Scholarship. The application period will be open from March 18 - May 15, 2024.

FRIENDS OF THE WEST FLORIDA PUBLIC LIBRARY ANNOUNCES NEW SPONSOR –MY PENSACOLA CREDIT UNION

The leaders of the Friends of the West Florida Public Library (FWFPL) and My Pensacola Credit Union are excited to announce that My Pensacola CU has become an official, annual sponsor of the FWFPL for 2024.

The FWFPL is a nonprofit organization whose members promote public interest in the Library by supporting educational programs for adults and children, promoting the use of the libraries’ resources and services, receiving and encouraging gifts and bequests to the West Florida Public Library, supporting the Library in developing library services and facilities for the community, and supporting the freedom to read as expressed in the American Library Association Bill of Rights.

The primary way the FWFPL does this is through fundraising book sales held 3 or 4 times a year. While the books sold are donated, these events have costs, including administrative expenses, supplies (such as the bags used on Sundays) and the price of a rental truck that is needed to move pallets of books from the Friends’ warehouse to the library location on Spring Street.

My Pensacola CU’s leadership also believes that a strong library system is an indication of a strong community. When the Credit Union heard about the sales, they realized they could help keep more of the funds raised dedicated to library support by assisting the Friends by covering the book sales’ operational costs.

“When I was first approached about this possibility, I was thrilled to find out this local business that has been here for 70 years was interested in partnering with us in our 50th year!” said Linda Williams, FWFPL President. “Conversations have already started about ways we will be able to work together to encourage public support for our mission to advocate for literacy and learning as well as supporting our library systems.”

STATEWIDE PROSECUTOR AT ISSUE IN VOTER FRAUD FIGHT

TALLAHASSEE — The state on Tuesday urged a South Florida appeals court to overturn a ruling that dismissed a high-profile voter fraud case against a convicted felon who cast a ballot in 2020 in Broward County.

But an attorney for the convicted felon, Terry Hubbard, argued that a Broward County circuit judge correctly tossed out the charges because Florida’s statewide prosecutor did not have authority to pursue the case.

Hubbard’s case, heard Tuesday by a panel of the 4th District Court of Appeal, was one of 20 that drew widespread attention when Gov. Ron DeSantis and other top state officials in 2022 announced charges alleging convicted felons had violated elections laws by casting ballots.

Circuit Judge George Odom in December 2022 dismissed the charges against Hubbard because he said the statewide prosecutor only had jurisdiction to prosecute crimes that occur in more than one judicial circuit — an issue that also arose in other cases involving the convicted felons facing charges.

But Alison Preston, a state deputy solicitor general, argued Tuesday at the appeals court that Hubbard’s alleged crimes involved two circuits because he registered and voted in Broward County, and the information was transmitted to the Department of State in Leon County. Broward County is in the 17th Judicial Circuit, while Leon County is in the 2nd Judicial Circuit.

“His aim was to vote in the 2020 election,” Preston said. “That is one of the most-important transactions someone can engage with the state in. But for Mr. Hubbard, we allege that that transaction was criminal because he knew that he couldn’t vote and yet he registered and did anyway.”

But Craig Trocino, an attorney for Hubbard, argued that the appeals court should uphold Odom’s ruling because the Broward County state attorney, not the statewide prosecutor, had authority to prosecute such alleged crimes. Trocino disputed that alleged crimes occurred in Leon County, describing the role of the Department of State as “ministerial.”

“The Florida Constitution is very, very clear that local states’ attorneys have exclusive jurisdiction to prosecute singlecircuit crimes in their jurisdiction,” Trocino said. “Only when it branches out does the

OSP (the Office of Statewide Prosecution) get involved.”

The attorneys also disagreed about a law approved in 2023 by the Legislature and DeSantis to try to make clear that the statewide prosecutor has jurisdiction in such cases.

Trocino argued the law does not apply to Hubbard’s case, at least in part because it passed after the charges were dismissed and after the state filed a notice of appeal. But Preston contended the law was a “procedural” change that should apply.

The panel, made up of Judges Melanie May, Dorian Damoorgian and Jeffrey Kuntz, asked a series of questions but did not indicate how — or when — it will rule.

Florida voters in 2018 approved a constitutional amendment aimed at restoring the rights of convicted felons who have completed terms of their sentences. The amendment did not apply to people with convictions for murder or sex offenses. Hubbard had been convicted of sex offenses, according to court documents.

Odom’s ruling said Hubbard initially completed a voter-registration application in July 2019 in Broward County. The county supervisor of elections submitted the application to the Department of State, and Hubbard was issued a voter-identification card in August 2019.

Hubbard submitted a second application to Broward County in February 2020, and he voted by mail in the November 2020 election, according to Odom’s ruling.

DeSantis and other Republican leaders in recent years have made a major issue of trying to stop what they say is voter fraud. Those efforts included creating a controversial state Office of Elections Crimes and Security, which critics have derided as the “election police.”

The charges against Hubbard and the other 19 convicted felons were announced in August 2022, less than three months before a general election that included DeSantis winning another term.

But the statewide prosecutor’s involvement spurred a series of challenges. A footnote in a brief filed in December by Hubbard’s attorneys said the legal question was also pending in five other appeals-court cases in various parts of the state.

Groups such as the American Civil Liberties Union, the NAACP and the Brennan Center for Justice signed on to friend-ofthe-court briefs supporting Hubbard in the appellate fight.

DESANTIS SIGNS BILL TARGETING

TALLAHASSEE — After speaking behind a placard that said “stop illegal immigration,” Gov. Ron DeSantis on Friday signed three bills that proponents argue will be deterrents to undocumented immigrants coming to the state.

The measures, approved during the legislative session that ended last week, seek to crack down on the use of what are known as “community” identification cards, strengthen criminal penalties for people who previously have been deported and stiffen punishments for repeatedly driving without licenses.

“We really appreciate what people are doing who are wearing the (law enforcement) uniform to help keep our communities safe. So I think these bills will go a long way to helping make their job easier and make them even more effective,” DeSantis said during a news conference at the Polk County sheriff’s office.

Perhaps the highest-profile bill (HB 1451) is designed to further curb community identification cards. The bill will prevent counties and municipalities from accepting community IDs if the cards were issued by groups that have provided such identification to people who are in the country illegally.

The cards, which typically are issued by non-profit organizations or other non-governmental groups, cannot be used for purposes such as driving or voting but are intended to serve as an alternative form of identification.

Broward County, for example, authorized the use of community ID cards in 2021. Legal Aid Service of Broward County runs the Broward Community ID Project, providing cards to people who can prove they reside in the county.

“Any resident of Broward County can apply for a community ID card. This ID is especially useful to formerly incarcerated persons, foster youth, transgender persons, the homeless, new immigrants, refugees, or anyone who might face difficulties obtaining a state-issued ID. Immigration status will not be asked,” the organization’s website says. Before signing the bill, DeSantis referred to community IDs as “rogue identifications.”

TALLAHASSEE — With the Florida Supreme Court deciding whether an abortion-rights constitutional amendment should go on the November ballot, Attorney General Ashley Moody’s office and abortion opponents are urging justices to consider another part of the state Constitution that they say could apply to “unborn children.”

Moody’s office Monday raised the possibility of filing an additional brief about what is described as the “natural persons” provision of the state Constitution. A day later, the group Susan B. Anthony Pro-Life America urged justices to order briefs on an “expedited basis.”

The proposed constitutional amendment seeks to ensure abortion rights, but the Supreme Court would need to sign off on its wording before the issue could go on the ballot. Justices look at issues such as whether the proposed wording would be clear to voters and would not address more than one subject.

The ballot summary of the proposal says, in part: “No law shall prohibit, penalize, delay, or restrict abortion before viability or when necessary to protect the patient’s health, as determined by the patient’s healthcare provider.”

The filings this week stem from questions that Chief Justice Carlos Muniz raised during Feb. 7 oral arguments on the proposal. Those questions involved whether the “unborn” are covered by part of the Constitution that says, in part, “All natural persons, female and male alike, are equal before the law and have inalienable rights, among which are the right to enjoy and defend life and liberty, to pursue happiness.”

In his questions, Muniz appeared to suggest that the court might not be able to decide on the wording of the proposed abortion-rights amendment without also looking at whether voters would understand that it could affect the “natural persons” provision of the Constitution.

“If sort of the bare minimum is that people need to be on notice as to what does the Constitution do now and what are you proposing to change, can we evaluate that without taking a position on whether the current Constitution legally, not morally or politically or whatever, but legally, speaks to this issue of any kind of rights for the unborn under this declaration of rights provision?” Muniz said.

Later, Muniz said the proposed constitutional amendment “kind of assumes that the Constitution as it exists right now is silent as to any rights of the unborn. And I don’t know if that assumption is correct.”

“The concern Chief Justice Muñiz expressed was that the proposed abortion amendment could have the effect of dramatically curtailing the scope of the ‘right to enjoy and defend life’—an effect not disclosed in the ballot summary,” Forrester and other lawyers in Moody’s office wrote.

In its filing Tuesday, Susan B. Anthony ProLife America said the Supreme Court “should accept the attorney general’s offer of supplemental briefing and order all interested parties to brief these issues on an expedited basis.”

Attorneys for the group Liberty Counsel, which opposes the proposed constitutional amendment, made two filings last month that addressed Muniz’s comments. One of those filings came after a controversial Alabama Supreme Court opinion about embryos created for in-vitro fertilization.

“Directly relevant to Chief Justice Muñiz’s questions, the Alabama Supreme Court noted that an unborn child qualifies as a human life, a human being, and a person,” Liberty Counsel, which is representing the group Florida Voters Against Extremism on the constitutional amendment issue, said in the filing.

As of Wednesday morning, Florida justices had not indicated whether they would order briefs on the issue. The court is supposed to decide by April 1 about whether the proposed constitutional amendment will go before voters in November.

The political committee Floridians Protecting Freedom, which is sponsoring the proposed constitutional amendment, had not made a filing about the possibility of additional briefs.

But during the Feb. 7 arguments, Courtney Brewer, an attorney for Floridians Protecting Freedom, noted the attorney general hadn’t raised the issue in opposing the proposed amendment.

“What you would be asking amendment sponsors to do is to think of all the ways that another provision of the Constitution might be interpreted and to somehow communicate that to the voters,” Brewer said. “I think in that instance, we would really lose the clarity and what the Constitution requires a proposed amendment to say.”

Floridians Protecting Freedom announced the initiative in May after the Republicancontrolled Legislature and Gov. Ron DeSantis approved a law that could prevent abortions after six weeks of pregnancy.

But during legislative debate last week, Democrats defended the use of community IDs.

Rep. Anna Eskamani, D-Orlando, said law-enforcement officials have backed the use of community IDs. Eskamani said the cards “can help residents who are experiencing homelessness” and “can help link some of our most-vulnerable residents to resources.”

Rep. Johanna Lopez, D-Orlando, said “restricting access to valid identification jeopardizes public safety.”

The bill builds on a measure approved last year that prohibited local governments from providing money for issuing identification cards to undocumented immigrants.

During the appearance Friday in Polk County, DeSantis also signed a bill (SB 1036) that will increase criminal penalties for immigrants who are arrested for felonies after illegally re-entering the U.S. following deportation for earlier crimes. Also, he signed a measure (HB 1589) that will increase penalties for driving without a valid license more than once.

“In the state of Florida, if you have been deported and you come to this state, and enter our state and you’re here illegally, and you commit crimes, we are throwing the book at you,” DeSantis said about the bill dealing with previously deported people.

DeSantis also said the driver’s license measure is a deterrent for illegal immigrants to travel to Florida.

“We don’t recognize drivers’ licenses from other states that have been issued to illegal aliens. So, that’s smart,” DeSantis said. “But you still have people that come and drive without a license. One of the big cures we can do for illegal immigration is to make sure people that are doing that are facing serious consequences.”

The ACLU of Florida, however, has argued that the drivers’ license measure “disproportionately impacts and targets undocumented immigrants who the state refuses to allow to obtain a valid Florida driver license, and thus forces them to subject themselves to criminal penalties for the simple act of driving their children to afterschool activities or doctor appointments.”

During the hearing, state Senior Deputy Solicitor General Nathan Forrester said Moody’s office had not taken a position on the issue. But in the filing Monday, Moody’s office said it “stands ready (to) file a supple-

TRIBE WETLANDS PERMITTING CASE PUT ON HOLD

TALLAHASSEE — Amid battles in two courts about a 2020 decision by the federal government to shift wetlands-permitting authority to the state, a judge Monday put on hold a lawsuit filed by the Miccosukee Tribe of Indians of Florida.

U.S. District Judge K. Michael Moore approved a request from U.S. Department of Justice attorneys for a stay of the Miccosukee Tribe lawsuit after another federal judge last month ruled that the permitting authority had been improperly transferred to the state and should be vacated.

The issue is being closely watched by business and environmental groups because it affects permitting for a wide range of development projects that affect wetlands. The U.S. Army Corps of Engineers usually holds the permitting authority, but the federal government transferred the power to the state in late 2020, about a month before former President Donald Trump’s administration ended.

The Miccosukee Tribe filed its lawsuit in 2022 against the U.S. Environmental Protection Agency to challenge the transfer. The lawsuit, filed in South Florida, alleges, at least in part, that the transfer violated the federal Clean Water Act.

That case came after the Center for Biological Diversity, Defenders of Wildlife, the Sierra Club, the Conservancy of Southwest Florida, the Florida Wildlife Federation, Miami Waterkeeper and St. Johns Riverkeeper filed a lawsuit in 2021 in Washington, D.C., challenging the transfer.

Florida has intervened in both cases to help defend the transfer.

In the Washington, D.C., case, U.S. District Judge Randolph Moss on Feb.15 found that actions by the EPA and the U.S. Fish and Wildlife Service in approving the

permitting shift violated the federal Endangered Species Act.

While Moss vacated the transfer, legal wrangling has continued. In part, that is because he said the state and the federal government could seek a stay of his ruling. He also did not decide certain legal issues in the case.

The state on Feb. 26 filed a motion for a stay of Moss’ decision. The judge has not ruled on the motion and has scheduled an April 4 conference in Washington. The environmental groups have opposed a stay.

Attorneys for the state also have urged Moss to issue a final judgment, which would help clear the way for an appeal.

In a three-page order Monday, Moore issued a stay of the Miccosukee Tribe case until April 17. Moore wrote that he would be “unable to grant meaningful relief” if Moss issues a final judgment vacating approval of the permitting transfer in the other case.

The tribe objected to the stay, in part because it said its case was based on different issues — including the Clean Water Act — than the decision in the Washington, D.C., case.

The law firm Longman, Lewis & Walker, which represents clients on land-use and environmental issues, posted an update Friday on its website that said “we are likely to be in a holding pattern until after the parties meet on April 4” in Washington, unless Moss issues a ruling. The cases involve what are known as section 404 permits.

“During this period, no state 404 permit applications are being processed and, accordingly, many people are in limbo as to whether to file their permit applications anew with the (U.S. Army) Corps or wait on relief from the court,” Lewis, Longman & Walker attorneys Michelle Diffenderfer and Katherine Hupp wrote in the update.
