LARGEST AND OLDEST CRAFT BEER EVENT

Pensacola’s largest and oldest craft tasting beer event is back for its 28th year. The annual Emerald Coast Beer Festival will return to the streets of downtown Pensacola on September 6 featuring more than 200 beers.

Organized and hosted by the Escambia Bay Homebrewers Club and Seville Quarter, the Emerald Coast Beer Festival has earned its reputation as the longest running beer festival on the Gulf Coast.

The Emerald Coast City Beer Fest in Seville Quarter features over 200 craft beers for sampling, featuring more than 50 Gulf Coast breweries and microbreweries.

With multiple vendors, the Emerald Coast Beer Festival features an abundance of local craft beers to sample.

“We usually have about 250 to 300 different beers and other adult beverages to serve,” Escambia Bay Homebrewers Club Treasurer Jim Martin said. “Although Goldring is the main distributor, there are many independent breweries from different areas that attend the event. We expect about 65 breweries and homebrew clubs. Most are from Florida, Alabama, Louisiana and Mississippi. Others come from all over the country.”

Hosted by the Escambia Bay Homebrewers Club and Seville Quarter, the Emerald Coast Beer Festival holds the title of the longest running beer festival on the Gulf Coast. Originally started by the Florida Brewers Guild, the festival was taken over by the Escambia Bay Homebrewers Club back in 1999.

Since then, the festival has grown, multiplying the number of attendees.

“We have grown from 176 attendees the first year to 2,500 the year before COVID,” Martin explained.

The Homebrewers Club started with some craft beer lovers in the spring of 1985, back when the craft brew scene only happened in the garages and basements of enthusiasts. Today, it consists of more than 100 members who craft all types of adult beverages including beer, wine, mead and cider. Since its establishment in 1985, the club has developed connections with other homebrew clubs across the country.

In 2023, the Emerald Coast Beer Festival attracted nearly 2,300 attendees, and according to event organizers, they are anticipating at least 2,500 individuals to attend this year’s event.

The festival will also feature a variety of tasty brews and craft beverages from more than a dozen regional homebrew clubs, as well as

several major regional beer distributors. Attendees will also be able to purchase food from local food truck vendors and enjoy live music performed across several stages.

“Guests can choose from more than 200 different types of beverages to sample at the event, including seltzers, wines, meads and beers,” Martin said.

The 2024 Emerald Coast Beer Festival will be held on September 6 from 5:30 pm to 8:30 pm at Seville Quarter in downtown Pensacola.

With two types of admission tickets available, attendees will have a wide range of fun activities available throughout the day.

For $35, individuals can purchase a general admission ticket that allows attendees to sample over 200 craft beers, receive a 28th anniversary sampling glass, listen to live music, visit various food vendors and gain exclusive

entry to the event after-party inside Seville Quarter.

For $80, individuals can purchase VIP admission tickets, which includes everything from general admission, but also gives ticket holders early access to the festival with entry beginning at 5 pm, along with hors d’oeuvres, mead tasting and complimentary craft spirits from local distilleries. The Escambia-Santa Rosa Bar Association (ESRBA) recently held its annual installation banquet. Circuit Judge Gary Bergosh conducted the installation of the 2024-2025 Executive Council and Young Lawyers Division (YLD) officers and members. The association also recognized several of its members for their service to the profession and community.

The 2024 Judge Ross M. Goodman Civility and Professionalism Award was presented to Karen Sunnenberg. Established in 2021, the award is bestowed to an ESRBA member whose dedication to civility, professionalism, and ethics exemplifies the character, commitment to the profession and to the administration of justice of Judge Ross Goodman, the inaugural recipient. The 2024 Michael A. Doubek Community Service Award was presented to Valerie Prevatte. The award is presented to a member or group of members of the EscambiaSanta Rosa Bar Association in recognition of volunteer service to the community.

Michelle Nguyen was recognized as the recipient of the 2024 Young Lawyers Division William S. Meador Award. The award is given each year to a young attorney who distinguishes themselves by their commitment to our community through charitable and civil service. The award was established in 2005 to honor the legacy left by William Meador of practicing law with integrity, sincerity and courtesy while recognizing his commitment of giving back to the community.

The 2024-2025 Escambia-Santa Rosa Bar Foundation officers and directors were elected by the membership at the banquet. Newly elected officers are D. Steve Traylor, Jr., president; Jodi Dubose, vice president; and Cameron Gore, secretary/treasurer. The Foundation presented a special award to Stephen Echsner in recognition of his many years of service to the Foundation. Echsner served on the board of the Foundation for 24 years, including 17 years as president.

The Escambia-Santa Rosa Bar Association is a nonprofit voluntary organization for attorneys and judges in Escambia and Santa Rosa Counties in Florida. The Association has approximately 600 members. Pensacola International Airport is excited to announce a major upgrade to parking facilities with the installation of advanced License Plate Recognition (LPR) technology. This new system, provided by industry leaders TIBA Parking and Gorrie-Regan, is set to make parking at the Airport easier and more efficient than ever before. With this upgrade, PNS is replacing its old ticket dispensers and pay-in-lane devices with state-of-the-art LPR equipment. The new system will streamline the parking experience by automatically recognizing license plates at entry and exit. This means faster, more convenient access to and from the Airport's parking areas.

Pensacola International Airport Director of Finance Laura Amentler shared her enthusiasm for the project, “We are excited to bring these enhancements to our customers. Build team registrations and sponsors are being accepted now for PensaCan 2024 – an event led by the American Institute of Architects (AIA) Florida Northwest to fight hunger in our community. This year, PensaCan will take place October 4 through October 11. Teams are strongly encouraged to register now, though teams will be accepted through September 5.

PensaCan is a competition where local businesses, architectural firms, organizations, and amateur groups create impressive structures made entirely out of full cans of food that are then donated to Manna to feed the hungry in Northwest Florida. Businesses, organizations, civic clubs, schools, or any other groups are welcome to register their teams for PensaCan 2024! Build teams are encouraged to design food structures for display at Cordova Mall, however permissible off-site locations, such as offices, are also acceptable. Digital designs are welcome too.

Sponsorship tiers start at just $200 (the equivalent of providing 120 healthy meals for neighbors in need) and go up to $1,000 (the equivalent of providing 600 healthy meals for neighbors in need).

PensaCan sponsors can sponsor a single build team or the event as a whole. All sponsorship levels include (at minimum) recognition on event signage (displayed in

Cordova Mall October 4-11) and Manna’s event webpage.

Following a week-long display of the structures (and posters with images of digital designs and off-site builds) at Cordova Mall, all food is then donated to Manna for distribution to our hungry neighbors in need in Escambia and Santa Rosa counties.

A panel of judges will vote on the structures on Friday, October 4, in categories such as Best Nutrition Award, Best Graphics Award, Structural Ingenuity Award, and more. And, People’s Choice Award votes will be accepted online at mannahelps.org October 4 through October 11.

About Manna Manna’s mission is to offer emergency food assistance, service the food-related needs of vulnerable populations, and engage the entire community in the fight against hunger. A local grassroots organization with no national affiliation or government funding, Manna provided food to 86,890 people last year. ESCAMBIA COUNTY GRANT SUPPORTS PSC KIDS

COLLEGE IN CENTURY

Escambia County was proud to support the Century Kids College at Pensacola State College this summer, which provided an opportunity for elementary students ages 6-12 to experience educational and engaging summer camp programming free of charge.

The Escambia County Board of County Commissioners provided $15,000 to fund the program in Century through a Community Partner Funding grant, allowing PSC to provide programming to 60 students in the Century area for three weeks over the summer. The PSC Century Kids College programming included a sport, an art, and a STEM (science, technology, engineering, and mathematics) camp, with a variety of hands-on activities for children.

"I'm very excited that we were able to support this program and provide an opportunity for these students to have a fun, engaging, and educational summer camp experience at no cost to their families," District 5 Commissioner Steven Barry said. "Programs like this should be available to all students in our community, regardless of income level, and I'm very pleased that we

accomplished that goal thanks to this exciting partnership with Pensacola State College. I'd like to thank PSC and every person who worked together to ensure these students had a fantastic summer camp experience."

Funding provided by Escambia County covered the costs of a program coordinator, program teachers, classroom supplies, and lunches for camp participants. The PSC Century Kids College aimed to provide a summer camp experience to an area with limited opportunities for elementary-age children, especially in the summertime.

"Kids College is a great way to introduce future students and their parents to PSC," said Dr. Ed Meadows, Pensacola State College President. "We are very grateful for the financial support of Escambia County so we could make this educational opportunity available in Century."

SEEKS APPLICANTS FOR THE ESCAMBIA CHILDREN'S TRUST

The Escambia County Board of County Commissioners is seeking applications from county residents to be nominated for gubernatorial appointment to the Escambia Children’s Trust. To be considered, applicants must submit the completed Escambia Children’s Trust application and questionnaire for gubernatorial appointments with an optional resume by 5 p.m. on Wednesday, Sept. 4.

The Board of County Commissioners will nominate three applicants per vacancy to be submitted to the Governor for review and potential appointment. Following the Board’s selection, the County Administrator will notify the Governor’s Appointments Office of the selected applicants and additional steps from the nominees may be required.

To be considered for the Escambia Children’s Trust, Florida Statute criteria include

the requirement that nominees have been residents of Escambia County for the previous 24 months and are willing to submit an annual Statement of Financial Interests Form. Florida Statutes also require that gubernatorial appointments are representative of the demographic diversity of the County’s population.

Per Section 125.901, Florida Statutes, the Escambia Children's Trust shall consist of 10 members, including:

• The superintendent of schools;

• A School Board member as appointed by the School Board;

• The Department of Children and Families District Administrator, or his or her designee;

• A judge assigned to juvenile cases as appointed by the Chief Judge;

• A County Commissioner as appointed by the Board of County Commissioners; and

• Five members appointed by the Governor from candidates nominated by the Board of County Commissioners to serve a fouryear term.

Small business owners and suppliers are invited to connect at the Pensacola Supplier Development Exchange Tuesday, Sept. 10, for a free event featuring opportunities to market goods and services directly with local and state buyers.

The event will take place from 9 a.m. to 2 p.m. at Sanders Beach-Corinne Jones Resource Center, located at 913 S. I St. in Pensacola. CHRIS WATTS SELECTED AS ESCAMBIA COUNTY EMS CHIEF

Escambia County is pleased to introduce Chris Watts as the new EMS Chief starting Monday, Aug. 19. Chief Watts joins EMS with over 13 years of emergency medical service experience.

As EMS Chief, Chief Watts' duties will include managing the annual EMS budget, developing goals and objectives for EMS, planning and conducting research, ensuring compliance with Federal, State, and local laws, and complying with regulations, codes and standards.

Chief Watts joins Escambia County EMS with years of leadership and management experience, previously serving as the Operations Manager with Medstar Ambulance in Clinton Township, Michigan. In that role, he oversaw service across 13 counties across the Southwest-Central Michigan region, including the city of Detroit. As the Operations Manager, Chief Watts oversaw nearly 1,000 employees and managed a budget of over $10 million.

Following his time in Michigan, Chief Watts moved to Alabama to serve as a Flight Paramedic and Base Lead with Air Methods in 2022 and as a paramedic with Newman's Ambulance in Mobile in 2023. In addition, Watts served as a relief paramedic with Escambia County EMS.

"I am excited to serve as the new EMS Chief for Escambia County EMS," Chief Watts said. "I am eager to explore the many

opportunities to work with the EMS and Public Safety teams to continue to provide exceptional service to the citizens and visitors of Escambia County. We are prepared to meet the challenges and expectations that will arise for our team. This is an exceptional team of individuals who have dedicated a great deal of time and energy to our community, and I am excited to continue with this team in a leadership role."

Chief Watts earned his Bachelor of Arts from Wayne State University and will graduate in December with his Master of Business Administration. He has earned numerous certifications, including Basic Life Support, Advanced Cardiac Life Support, Pediatric Advanced Life Support, and Advanced Burn Life Support. Additionally, Chief Watts holds a Paramedic License in Alabama, Arizona, Florida, Georgia, Michigan and Mississippi. He's also a Nationally Certified Paramedic through the National Registry of Emergency Medical Technicians.

JOYFUL NOISE! GOSPEL COMPETITION ENTRY DEADLINE HAS BEEN EXTENDED TO SEPT. 15

WSRE PBS has been awarded a Foo Foo Festival grant to present a three-day music event featuring New York’s award-winning gospel choir, Sing Harlem, and a regional gospel competition. The Joyful Noise! Gospel Celebration will take place Nov. 8-10 with the gospel competition held on Saturday, Nov. 9, from 12 p.m. to 5 p.m. at the Pensacola High School Auditorium. Admission is free.

WIDENING IMPROVEMENTS TO COUNTY ROAD 164 BEGIN MONDAY, AUG. 19

Widening improvements to County Road 164 began Monday, Aug. 19. Work will take place in three phases and is expected to be completed by Friday, Sept. 20.

Phase A:

Crews began widening County Road 164 between Highway 97 and Green Village Road Monday, Aug. 19. This portion of road will be closed to through traffic. Local motorists and school bus traffic will have access to County Road 164. All through traffic will detour from Highway 97, east on Gobbler Road to Green Village Road, then south to County Road 164. Phase A was expected to be completed by Saturday, Aug. 24.

Phase B: Crews began widening County Road 164 from Green Village Road toward County

Road 99 Monday, Aug. 26. This portion of road will be open to local traffic only. Through traffic will be detoured north on Green Village Road, east on Gobbler Road, then south on County Road 99 to County Road 164. Phase B was expected to be completed by Friday, Aug. 30.

Phase C: Crews began widening County Road 164 near North Pine Barren Road Tuesday, Sept. 3. Traffic will be reduced to a single lane controlled by a flagging operation. Phase C is expected to be completed by Friday, Sept. 20. Motorists are encouraged to use caution when traveling through work zones. This total represents more than a 100% increase in projects from the previous fiscal year, with 123 projects completed since Oct. 1, 2023, compared with 57 projects completed in the previous year. With additional pending projects and applications, the county expects these numbers to increase even further before the end of this fiscal year on Sept. 30, 2024.

These programs are implemented using State Housing Initiatives Partnership, or SHIP, funding that Escambia County receives each year, which is designated for assisting low- and moderate-income residents with a variety of housing-related needs. Many of these residents would be unable to complete repairs or purchase homes without this financial assistance, making these programs vitally important for Escambia County residents.

“We are continuing to see an increased need in our community for housing assistance, particularly for residents who are living on low and often fixed incomes,” Neighborhood Enterprise Division Manager Garett Griffin said. “These programs are focused on helping those who are most in need, and we will continue to exhaust our state funding to ensure we are assisting as many people as possible. Our team has worked incredibly hard this year, and I’m proud of the number of people we’ve been able to help and the lives that are being changed for the better through these programs.”

Several county residents who received assistance this year have shared their stories and highlighted the positive impact the county programs have made in their lives, including

a new home for an 84-year-old resident, two new homes for longtime Cantonment residents, a new home for a retired resident, and wheelchair ramps to help two county residents maintain their independence.

The $3.2 million in assistance for fiscal year 2023-2024 includes the following:

• Homebuyer/Purchasing Assistance: $1,287,500

Demo and Replacement: $520,700.75

• Housing Repair: $856,289.66

• New Construction: $554,900

With all the Homebuyer/Purchasing Assistance program funding already expended for this fiscal year and FY 20242025, the county has temporarily paused applications for that program until additional funding becomes available. Other assistance programs are continuing to move forward in the meantime, with over $328,000 in additional funding encumbered for active projects, along with dozens of files currently in the application and bidding process for the remainder of this fiscal year.

“While we hate to run out of funding for any assistance program, this demonstrates that our programs are successfully providing low-income families with resources and support that may not otherwise be available to them,” Griffin said. “We recognize that the need in our community is great, and our staff remains committed to working hard every day to help improve the quality of life for residents who need a helping hand.”

DESANTIS SAYS PARK PLANS NEED ANOTHER LOOK

Trying to quell a bipartisan uproar, Gov. Ron DeSantis said Wednesday that “halfbaked” plans to bring golf courses, resortstyle lodges and pickleball courts to state parks will be revamped.

DeSantis said the Department of Environmental Protection will gather more public input before it could move forward with what is dubbed the “Great Outdoors Initiative.”

“Here's the thing, I'd rather not spend any money on this, right?” DeSantis said during an appearance at the Polk County Sheriff’s Office Operations Center in Winter Haven. “I mean, if people don't want improvements, then don't do it. And so, that'll be something that citizens could be able to do.”

DeSantis added that he didn’t expect plans to advance this year from the department.

“They're going to go back and basically listen to folks,” DeSantis said. “A lot of that stuff was just half-baked, and it was not ready for prime time when it was.”

Critics of the initiative were pleased, but cautious, about DeSantis’ statements.

Friends of the Everglades put out a news release saying, “Our state parks are safe --for now.”

“We won't rest easy until the so-called Great Outdoors Initiative is completely dead,” said Eve Samples, executive director of Friends of the Everglades.

Vote Water, also among the environmental groups leading the charge against the proposal, said that, while the proposal hasn’t been completely halted, DeSantis “blinked.”

The uproar started after the department this month issued a news release announcing the initiative and later used social-media posts to briefly outline plans for nine parks. Perhaps the biggest target of opponents was a proposal to add three golf courses at Jonathan Dickinson State Park in Martin County.

DeSantis on Wednesday contended that plans were “leaked” to create a “narrative.”

“It was not approved by me,” DeSantis said. “I never saw that.”

The Department of Environmental Protection’s news release about the plans was titled, “DEP Announces 2024-25 Great Outdoors Initiative to Increase Public Access, Recreation and Lodging at Florida State Parks.”

“Today’s announcement reinforces the DeSantis Administration’s record support for conserving our natural landscapes and

commitment to ensuring every Floridian can visit and recreate at Florida’s state parks,” the news release, dated Aug. 19, said.

A series of meetings had been planned this week across the state. But they were postponed Friday after opposition grew quickly from environmental groups, residents and Democratic and Republican lawmakers.

State lawmakers in 2011 also briefly targeted Jonathan Dickinson State Park for a golf course before a similar uproar scuttled legislation.

Tuskegee Dunes Foundation, a littleknown organization linked to the new Jonathan Dickinson golf proposal, announced over the weekend it was pulling its plans as “we did not understand the local community landscape and appreciate the clarity.”

The foundation, registered as a corporation in Delaware, lists an Oklahoma address shared with the non-profit veterans group Folds of Honor.

DeSantis met with Folds of Honor founder and CEO Dan Rooney on August 10 and said Wednesday the group could still consider rehabilitating an existing “rundown or abandoned” golf course in the region as a way to help military members and first responders.

DeSantis also defended the golf course proposal at Jonathan Dickinson, saying it was being “misrepresented” as taking away unsoiled land from the 11,500-acre park, which was once a military base.

“There were almost 1,000 buildings on that base back in the day. There's still some of the remnants of it,” DeSantis said.

The Jonathan Dickinson land was used for secret radar training during World War II. Called Camp Murphy, the facility was closed in 1944, turned over to the state in 1947 and became a state park in 1950. Few aspects of the camp remain visible to park visitors.

Also drawing heavy bipartisan criticism were proposals to construct lodges with up to 350 rooms at Anastasia State Park in St. Johns County and Topsail Hill Preserve State Park in Walton County. The Topsail Hill plans also included four pickleball courts and a disc golf course in an “underutilized” area.

Additional cabins, pickleball courts or disc golf were also proposed for Oleta River State Park in Miami-Dade County, Honeymoon Island State Park in Pinellas County, Camp Helen State Park in Bay County, Dr. Von D. Mizell-Eula Johnson State Park in Broward County, Grayton Beach State Park in Walton County and Hillsborough River State Park in Hillsborough County.

FEDS FIRE BACK IN GUN SALES LAWSUIT

The Biden administration this week urged a U.S. district judge to toss out a Florida lawsuit challenging a new federal rule that requires more gun sellers to be licensed and run background checks on buyers, disputing state arguments about lost tax revenue from gun shows.

U.S. Department of Justice attorneys filed a 27-page motion Monday seeking dismissal of the lawsuit, which Florida filed in May and revised this month. The rule, which the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives finalized in April, is an outgrowth of a 2022 federal law, known as the Bipartisan Safer Communities Act, that made changes to the longstanding background-check system.

Florida contends that the rule violates another federal law, the Administrative Procedure Act. In the revised lawsuit, the state argued, in part, that the rule has led to lower attendance at gun shows — resulting in reduced tax revenue from purchases of admission tickets.

But the Justice Department attorneys blasted the argument in this week’s motion to dismiss, saying the state did not “provide a basis for inferring a causal link between the rule and the myriad decisions about whether to attend certain gun shows made by individuals whose conduct in no way implicates the rule.”

“Indeed, there are plenty of reasons why Floridians might elect not to attend a particular gun show — e.g., a general increase in firearms prices, changes in purchasing preferences, poor advertising or show management, bad weather, et cetera,” the motion said. “And Florida’s complaint wholly fails to plausibly establish that the rule was instead the cause of the … decline in gun show attendance that the state alleges.”

But the revised lawsuit, filed Aug. 12 by Attorney General Ashley Moody’s office, said the state’s “asserted injury — lost tax revenue — is clear and ongoing.”

“Ordinarily, gun shows in Florida during the summer months of June, July and August enjoy high attendance rates — often hosting thousands of people at a single show,” the lawsuit said. “But since the challenged rule went into effect on May 20, attendance at these summer gun shows across the state has decreased precipitously. In some parts of Florida, total attendance at such shows have dropped by as much as 50 percent, costing the state revenue from the 6 percent sales tax it would have earned on each admission ticket.”

JUDGE BACKS ABORTION CLINIC LICENSE

An administrative law judge Wednesday ruled that Florida should approve a license for a Pensacola abortion clinic, after regulators last year rejected the application because of what they alleged were problems at a now-closed clinic in Louisiana.

Judge Yolonda Green issued a 40-page recommended order siding with July Medical Services, LLC, which challenged a decision by the Florida Agency for Health Care Administration to deny the license.

July Medical Services, which does business as Hope Medical of Pensacola, submitted an application in March 2023 to operate a clinic that would provide abortions and other services, such as ultrasounds, contraception and counseling.

But the Agency for Health Care Administration denied the application after obtaining information from Louisiana officials about the similarly named June Medical Services, LLC, a Shreveport, La., clinic that closed in 2022 and has ties to July Medical Services. The agency cited a “pattern of deficient performance” at the Louisiana clinic in its decision about the Pensacola license, according to Green’s ruling.

The judge, however, concluded that “AHCA failed to demonstrate that any ‘pattern of deficient performance’ on the part of June Medical, a separate entity, should be attributed to July Medical. Therefore, the license should be issued.”

“The operation history of June Medical raises some concerns about their compliance with state regulations,” Green wrote. “It also raises concern about the safety of patients. However, based on the evidence of record, there was no threat or actual harm to patients. All the deficiencies proven were corrected. Based on the foregoing, the competent substantial evidence establishes that June Medical’s Louisiana deficiencies did not establish a pattern of deficient performance.”

Green added that the Florida agency “argued that denial of July Medical’s application for an abortion clinic would be to protect the general health, safety, and physical and emotional well-being for patients. Yet AHCA disregarded there was no harm to any (Louisiana) patient’s well-being and the state of Louisiana renewed June Medical’s license each year that it was licensed.”

The ruling does not assure that a Florida license will be issued. Under administrative law, the recommended order will go back to AHCA for final action.

But it comes as Florida voters prepare to decide in November whether to pass a ballot measure that seeks to enshrine abortion rights in the state Constitution. It also comes nearly four months after a state law took effect preventing abortions after six weeks of pregnancy.

The ruling said July Medical Services is owned by Michael Rothrock, whose late mother, Robin Rothrock, founded the Louisiana clinic about 1980 and operated it until she died in 2010. Ownership of the clinic went to Robin Rothrock’s estate, with her son becoming executor in 2011. Green’s ruling said that July Medical Services’ administrator, Kathaleen Pittman, served as administrator of the Louisiana clinic.

The Florida agency initially approved a license for the Pensacola clinic but later said the approval was in error because a required site inspection had not been completed, Green wrote. The inspection was conducted in May 2023 without any deficiencies found.

But the agency issued an initial notice of intent to deny the license application in July 2023 and a revised notice in September. That came after Kim Smoak, a deputy secretary of the agency, reached out to the Louisiana Department of Health for information about June Medical, according to Green’s ruling.

The Louisiana agency provided documents about deficiencies and alleged deficiencies at the Shreveport clinic from 2004 to 2021, the ruling said.

Green said Louisiana citations against the clinic “consisted of lack of documentation in personnel files, lack of board meeting minutes, and inadequate documentation to verify physician's orders failed to demonstrate diligence. Most of these violations were non-repeated offenses.”

She also cited an incident in which the clinic did not report to authorities that a 14-year-old patient had been impregnated by a 17-year-old, a crime in Louisiana. But Green said that “incident alone is not sufficient to establish a pattern of deficient performance.”

In addition, Green wrote that Michael Rothrock was not the owner of the Shreveport clinic and did not operate it.

“Even if there were evidence to support Mr. Rothrock being responsible for June Medical’s performance, he clearly was not responsible for performance during the period from 2004 through 2011, which was before he became executor of the Robin Rothrock estate,” Green wrote. “Executors are fiduciaries who are responsible for carrying out the deceased person's final wishes and acting in the best interests of the beneficiaries.”

The gun-show issue is important, at least in part, because Florida is trying to use lost tax revenue to establish legal standing in the case. Essentially, Florida contends the rule is causing it to suffer damages. Standing is an initial hurdle that plaintiffs must clear, and the Justice Department argues the lawsuit should be dismissed because Florida doesn’t have standing to challenge the rule

When the rule was finalized, the Biden administration said the changes were designed to close “loopholes” in the system that requires licensed gun dealers to run background checks. An overview posted on the White House website said “a growing number of unlicensed sellers continue to sell firearms for profit to complete strangers they meet at gun shows and online marketplaces, which has been a critical gap in the background check laws.”

In part, the rule changed a definition of being “engaged in the business” as a firearms dealer who needs to be licensed, according to court documents filed by Justice Department attorneys. The revised definition applies to a “person who devotes time, attention, and labor to dealing in firearms as a regular course of trade or business to predominantly earn a profit through the repetitive purchase and resale of firearms. The term shall not include a person who makes occasional sales, exchanges, or purchases of firearms for the enhancement of a personal collection or for a hobby, or who sells all or part of the person’s personal collection of firearms.”

Justice Department attorneys argued in this week’s motion that the definition closely tracks the 2022 law. But in alleging violations of the federal Administrative Procedure Act, the state contended that the “Biden Administration now seeks to exploit the minor changes to federal law enacted in the BSCA (Bipartisan Safer Communities Act) to implement President Biden’s preferred policies by executive fiat.”

While a majority of states rely on the FBI to conduct background checks, the Florida Department of Law Enforcement handles checks in Florida. In the lawsuit, the state argued that the rule would force the FDLE to conduct more background checks, requiring more resources.

But in the motion to dismiss, Justice Department attorneys called that a “self-inflicted harm.”

It said “any harms Florida suffers from conducting background checks result from its voluntary decision to perform services that the federal government is otherwise willing to perform (and does perform for the majority of states) for free.”

The lawsuit, filed in Tampa, is assigned to U.S. District Judge Charlene Edwards Honeywell.

REGULATORS WEIGH TAMPA ELECTRIC RATES

Florida regulators Monday dug into a proposal that would lead to Tampa Electric Co. raising base electric rates, with representatives of consumers and businesses arguing the proposal should be scaled back.

Tampa Electric is asking the Florida Public Service Commission to approve a $287.98 million increase in 2025, followed by increases of $92.37 million in 2026 and $65.47 million in 2027.

Jeff Wahlen, an attorney for the utility, told commissioners that the proposal balances a series of issues, including helping Tampa Electric provide reliable service to customers.

“Tampa Electric is responsible and accountable for keeping the lights on,” Wahlen said. “Balancing the factors needed for safe, reliable and cost-effective electric service is not easy.”

But Patricia Christensen, an attorney with the state’s Office of Public Counsel, which represents consumers in utility cases, argued that the increase in 2025 should be a maximum of $73 million. Also, she said the amounts could be lowered in the subsequent years.

“TECO’s list of proposed projects provides platinum solutions to normal stainless steel customer concerns,” said Christensen, an associate public counsel.

Base rates make up a major part of customers’ monthly electric bills, and rate cases play out over months and involve voluminous amounts of information. The Public Service Commission’s hearing on the Tampa Electric proposal is expected to last throughout this week, Chairman Mike La Rosa said.

The Tampa Electric hearing started after the commission last week approved a settlement in a Duke Energy Florida case. The Duke settlement, which was unanimously approved by the commission, will increase base rates by $203 million in 2025 and $59 million in 2026.

As an indication of the high stakes involved in the Tampa Electric case, numerous groups and Walmart are taking part. Those groups include the Florida Retail Federation; the Florida Industrial Power Users Group, which represents large electricity users; the Sierra Club; the federal government; fuel retailers; Florida Rising;

and the League of United Latin American Citizens of Florida.

The proposal includes seeking money for a series of projects, including upgrading existing power plans and adding solarenergy facilities. Like Wahlen, Tampa Electric President and CEO Archie Collins told the commission that the utility balances numerous issues, describing it as a “juggling act.”

“We need the rate increases we have requested so that we can continue to perform well today and to ensure that the company is taking the steps to insulate our customers from higher costs tomorrow,” Collins said.

It quickly became apparent Monday that one key issue during the hearing will be the utility’s return on equity, a closely watched measure of profitability. Tampa Electric’s proposal seeks approval of a targeted return on equity of 11.5 percent.

Utilities often argue that an adequate return on equity is needed to attract investor money. But attorneys for some of the parties Monday said Tampa Electric’s proposal is excessive and that lowering it would save money for customers.

Robert Scheffel Wright, an attorney for the Florida Retail Federation, argued that Tampa Electric’s targeted return on equity should not exceed 10.3 percent — the amount that was approved last week in the Duke Energy Florida settlement.

“Tampa Electric is in the same exact business as Duke Energy Florida,” Wright said. Collins, however, said he did not think the Duke return on equity was relevant because it was the result of a settlement, which involves "a series of gives and takes."

Tampa Electric has about 840,000 customers in west-central Florida, making it the state’s third-largest utility behind Florida Power & Light and Duke. Before the hearing started, the senior-advocacy group AARP Florida presented petitions to the commission opposing the Tampa Electric proposal.

“That’s a lot of money for people on a fixed income,” Kathleen Mayorga, an AARP Florida volunteer, said. “That makes a difference in whether or not you can afford your prescriptions, whether or not you can feed your family.”
