For those who may be unfa miliar with the America’s Cup and its significance, the race essentially serves as the Super Bowl of the sailing community. Yacht clubs from across the world participate by compet ing in a race to take home the oldest trophy in inter national sport, the Ameri ca’s Cup. The competition dates back to 1851, which is before the modern Olympic Games began. Led by President of Sail ing Operations and Skipper Terry Hutchinson, American Magic will train in Pensac ola for the duration of the winter season aboard their boat, the Patriot. Patriot is an AC75 racing yacht, with a 68-foot-long hull and t-shaped foils that allow the boat to reach top speeds. According to Hutchin son, Pensacola’s water ways are ideal for training.

“The sailing conditions in Pensacola Bay are perfect for developing the AC75. The team has the choice to train in the Bay or outside in the Gulf, providing a vari ety of conditions and sea states to advance and build our high-performance race boat. Coupled with the local community support, this makes Pensacola the ideal U.S. training venue,” Hutchinson said. This year is not the first time that the American Magic team has trained on the Gulf Coast. The team also spent time training in Gulf waters in 2018, 2019 and 2020. In 2019 and 2020, the team trained for the most recent America’s Cup, AC36 (the 36th Amer ica’s Cup), which was held in New Zealand last year. Patriot made the trek from New Zealand to Pensacola this past June. Pensacola is an optimal training desti nation for sailors due to its diverse environmental conditions.“The37th America’s Cup is set to take place in Barce lona, Spain. Pensacola Bay and the Gulf of Mexico will provide NYYC American Magic with similar wind and sea conditions, allow ing the team to develop for the competition efficiently,” Hutchinson said, adding that the warm temperatures of the Gulf Coast allow the team to train for 12 months out of the year, where that may not be possible in places with cooler climates. Pensacola Yacht Club’s Commodore, Tom Pace, also spoke to the area’s geographical benefits, “The return of American Magic certainly has a great deal to do with the warm and open interaction with the City, County, Port Authority and many locals, but at the very center of this decision to base in Pensacola again is due to our natural deepwater bay,” Pace said. Both the City of Pensac ola and the community alike have extended their support for the members of the American Magic team. Though only eleven sail ors can sail on their boat, the American Magic team consists of over 160 people including sailors, boat build ers, engineers and more. The Pensacola community has provided team members and their families with a warm welcome and excite ment for their return.

When asked about his upcoming plans as the permanent county admin istrator, Moreno notes there is still a lot of work to be done, but with the right people in the right positions, anything is possible. “One of my biggest priori ties is filling the 51 vacancies in public works,” Moreno says. “We recently signed an MOU with the union to increase the starting pay to $18.81 an hour in our public works department. With this pay raise, I’m hopeful we can recruit quality candidates. We have identified grants we want to go after, including ones that will help with the county’s homeless population. Now that we’re stable in our directorships, it’s time to level out and fly.” Escambia County commends and congratulates Wes Moreno on his selec tion as Escambia County Administrator.

Community Submission Escambia County is pleased to announce Wes Moreno’s selection as the permanent Escambia County Administrator. A discussion was held at the Aug. 11 Committee of the Whole workshop and Moreno’s hire was confirmed during the Aug. 18 BCC meeting.Moreno’s career with Escambia County spans 35 years, beginning in June 1987. Moreno was initially hired on as a Maintenance Worker I in the county roads department. From there, Moreno progressed through to Equipment Operator I and II. He later went through the corrections and law enforcement academies to receive certi fications in both fields. As a result of his certification in the corrections academy, Moreno managed crews and inmates on several projects including rights-of-way, drainage, sidewalks and more. He became the Public Works Director in 2007 and was instrumental in shifting the department’s culture and working closely with engineering on the completion of several high-priority projects.Inaddition to his robust experience in public works, Moreno served in the county engineering department from 1997 until 2007. He managed large projects and received statewide recog nition for his work. During his time with engineering, he was promoted to the Chief of Construction Manage ment and Engineering II, a role directly underneath the county engineer. He has assisted both the roads and engineer ing departments in hurricane responses, gaining firsthand experience in service to his community. Moreno also became Deputy County Administrator in 2019. “Wes Moreno has been a dedicated public servant for more than 35 years in Escambia County, Florida, and he knows this community and this county,” said District 1 Commissioner and Chairman Jeff Bergosh. “He has distin guished himself over his time in Escam bia County; he has a track record of clear, honest communication and seam less interaction with stakeholders both within the county and the community at large. Wes has proven himself to be an exceptional leader and an effective administrator over the last 14 months since he was brought up to this posi tion on an interim basis during a time of significant tumult locally. And during that time his demeanor and dedicated work ethic has allowed for many signif icant milestones to occur, including the

On Wednesday, Aug. 17, Escambia County Emergency Communications telecommunicator Melanie McGlothren received the “Telecommunicator Quality Performance Award” from quality assur ance provider Replay Systems. On April 7, 2022, McGlothren took an medical emergency 9-1-1 call from a local restaurant. The caller advised that acid had been splashed into the manager’s right eye. Throughout the call, McGlothren maintained control of the conversation, conducted a good flow of the phone call while following all proto cols and asked key questions about the specific type of complaint. McGlothren gave important instruc tions to the caller prior to the first responders’ arrival, including instruc tions to continue flushing the eye with water. She also provided first respond ers critical information that quickly lead them to the location of the patient. Replay Systems reviews and eval uates the performance of Escam bia County telecommunicators’ 9-1-1 calls. As a result of the April 7 inci dent, McGlothren scored a 100%. The quality assurance provider added that McGlothren’s performance was a “fine jobOverdone.”the past 12 months, McGlothren has had 56 quality performance reviews, scoring an average of 99.61%. “I am very proud of Melanie,” said Emergency Communications Division Manager Andrew Hamilton. “She’s been an invaluable part of our Emergency Communications team for many years and has handled countless 9-1-1 calls in a professional and supportive manner.” Escambia County Emergency Communications congratulates Melanie McGlothren on receiving the “Telecom municator Quality Performance Award,” and commends her for her dedication to the citizens of Escambia County.

Escambia County Emergency Manage ment is pleased to introduce Scottlin Williams as Escambia County’s newest Emergency Coordinator. Williams succeeds Travis Tompkins, who previously served as Emergency Coordinator before accepting his current role as Emergency Manager.Prior to joining ECEM, Williams served for two years as a broadcast meteo rologist at CBS 12 News WJTV in Jackson, Miss. While in Jackson, she covered many severe weather events on-air. Williams often chased storms throughout central Mississippi and the Gulf Coast, and she provided hurricane coverage during Hurri cane Sally. Williams also developed her own weather segment while at WJTV, “BrainStorms: Science with Scottlin.”

FEDS BACK CHALLENGES TO FLORIDA ELECTIONS LAW

In issuing the stay, the appeals court, in part, said Walker’s ruling did not seem to be appropriately focused or limited, as previous court deci sions require. Walker, as an example, described discrimination in the state dating back to voting laws enacted after the Civil War, calling it a “grotesque history of racial discrimination.”

“Stakeholder capitalism is not about politics,” Fink wrote. “It is not a social or ideological agenda. It is not ‘woke.’ It is capitalism, driven by mutually benefi cial relationships between you and the employees, customers, suppliers, and communities your company relies on to prosper.”DeSantis said Tuesday that “some of the ESG funds have performed poorly, because they’re more focused on ideol ogy rather than helping the people that would benefit from strong returns.”

Larry Fink, CEO of the BlackRock asset-management firm and a leader in the use of the metrics, said in his 2022 letter to corporate executives that companies using ESG standards are “performing better than their peers.”

“You need to have an economy that functions like an economy tradition ally has functioned, not where all these big private actors are putting thumbs on the scales of all these political issues or infusing the economy with political ideology,” DeSantis said. “Yes, we see this all tends to go one way. But even if it went other ways, it’s just not a healthy thing.”Patronis said he expects other states will follow. “I look at the dysfunction that we’ve had in Washington,” Patronis said. “The lack of listening to the public. Pounding people with inflation problems. And the (Biden) administration, their solution is adding more IRS agents to the solution just to harvest more dollars.”

In its brief last week, the Justice Department raised the possibility of the appeals court sending the case back to Walker to re-address the law as it relates to past discrimination.

Florida faces a Sept. 21 deadline for filing a petition to ask the U.S. Supreme Court to take up a case about a 2021 state law that would crack down on socialmedia giants such as Facebook and Twit ter. Justice Clarence Thomas last week granted the state’s request for an exten sion to file the petition in the closely watched case. Without the extension, a deadline would have expired Monday, according to the request filed by the state. A three-judge panel of the 11th U.S. Circuit Court of Appeals in May upheld most of a preliminary injunction that U.S. District Judge Robert Hinkle issued last year blocking the law. Hinkle and the appellate panel ruled that the law violated First Amendment rights. The law, approved by the Republicancontrolled Legislature and Gov. Ron DeSantis, targeted companies such as Facebook and Twitter over decisions to remove politicians and other users from the social-media platforms. DeSantis made a priority of the issue after Twit ter and Facebook blocked former Presi dent Donald Trump from their platforms after Trump supporters stormed the U.S. Capitol on Jan. 6, 2021. The law, in part, sought to prevent the platforms from banning political candidates from their sites and to require companies to publish — and apply consistently — standards about issues such as banning users or blocking their content. Companies could face penalties for violating restrictions in the law. For example, companies that remove political candidates from plat forms could face fines of $250,000 a day for statewide candidates and $25,000 a day for other candidates. Tech-industry groups NetChoice and the Computer & Communications Industry Associa tion challenged the law, and Hinkle in June 2021 issued the injunction, calling the law “riddled with imprecision and ambiguity.”

The decision by DeSantis, Moody and Patronis requires the agency to update an investment policy statement to ensure decisions are based solely on “pecuniary factors” and not to consider the “furtherance of social, political or ideological interests.”

Incoming state House Speaker Paul Renner, R-Palm Coast, has called ESG practices a national-security issue and a pocketbook issue, saying “global elites” are “weaponizing American capitalism against us.”

The state, the Republican National Committee and the National Repub lican Senatorial Committee took the case to the 11th U.S. Circuit Court of Appeals after Chief U.S. District Judge Mark Walker ruled that parts of the law were intended to discriminate against Black Floridians, a key voting bloc for Democrats.Withahearing scheduled Sept. 15, Justice Department lawyers filed a friend-of-the-court brief last week arguing that the Atlanta-based appeals court should uphold Walker’s conclu sions that parts of the law (SB 90) violated the federal Voting Rights Act.

— Florida leaders moved forward Tuesday with prevent ing state pension-fund investment deci sions that promote “social, political or ideological interests.” Gov. Ron DeSantis, Attorney General Ashley Moody and state Chief Finan cial Officer Jimmy Patronis took aim at investment practices that involve what are known as “environmental, social and governance ratings,” which can include such things as taking into account climate change. The three Republicans, who serve as trustees of the State Board of Admin istration, approved a resolution that directed pension-fund managers against using so-called ESG ratings when investing state money. DeSantis, who frequently criticizes “woke” politics, said the intent of Tues day’s move was to keep pension systems from becoming “roadkill in somebody’s ideological agenda.” He also criticized ESG activities at places such as the World Economic Forum, an invitationonly event in Davos, Switzerland.

While Walker issued an injunction against parts of the law, the appeals court in March placed a stay of the ruling. That effectively means the disputed parts of the law are in effect during this year’s elections as the legal battle continues.

When race and party are tightly intertwined, polarized voting patterns can provide a powerful incen tive to enact restrictions that, by design, bear more heavily on minority voters. Indeed, when a legislative majority acts to entrench itself by targeting voters by race because those voters are unlikely to vote for the majority party, that purpose ‘constitute(s) racial discrim ination’ that both the Constitution and Section 2 prohibit,” the brief said, partially citing a legal precedent.

The Justice Department brief last week said the appeals court should uphold Walker’s ruling that parts of the law were “motivated, at least in part, by racially discriminatory intent in viola tion” of what is known as Section 2 of the Voting Rights Act.

More than 2.1 million Floridians have voted by mail or at early-voting sites ahead of Tuesday’s primary elections. Those totals did not include updated numbers Monday from Broward and Duval counties. In-person early voting ended this weekend. A panel of the 11th U.S. Circuit Court of Appeals overturned a district judge’s ruling that former Officer Mario Badia was entitled to immunity from allega tions of excessive force and battery. The panel upheld immunity for Badia on a claim of false arrest.

“Every day that HB 5 remains enforce able, Florida patients in desperate need of post-15-week abortion services are being turned away and forced to attempt to seek abortions hundreds of miles or more out of state, to attempt abor tions outside the medical system, or to continue pregnancies against their will,” a 30-page emergency motion said. Leon County Circuit Judge John Cooper last month issued a temporary injunction against the 15-week abortion limit, saying it violated a privacy right in the Florida Constitution. The state quickly appealed, which, under legal rules, placed an automatic stay on the temporary injunction. A panel of the appeals court rejected a request by the abortion clinics and the doctor to vacate the stay — effectively allowing the 15-week limit to remain in effect while legal battles continue. The documents filed Friday, in part, urged the Supreme Court to vacate the stay. The appeals-court panel, in a 2-1 ruling, said the clinics and the doctor had not shown irreparable harm from the nearly total ban on abortions after 15 weeks.While the ruling stemmed from a request to vacate the stay, the majority of the appeals court also signaled that it did not agree with the underlying tempo rary injunction issued by Cooper.

Gov. Ron DeSantis and the Florida Cabinet on Tuesday approved a series of land deals, including a $37.8 million plan to conserve nearly 12,000 acres in DeSoto and Hardee counties. The state will pay Carlton Horse Creek Partners, LLC, for what is known as a conserva tion easement on 11,958 acres. Gener ally, conservation easements shield land from development, while allowing continued use for such things as agri culture. A Cabinet agenda item said the DeSoto and Hardee property, Horse Creek Ranch, has been used by the Carl ton family for cattle ranching and other agricultural and recreational purposes since the mid-1800s. “The conservation of Horse Creek Ranch will protect in perpetuity the wildlife and water that flows through the ranch, across South west Florida into Charlotte Harbor,” the agenda item said. “About half of the property is in improved pastures and the remaining portion is in natural condition.” In addition to the purchase approved Tuesday, the Southwest Flor ida Water Management District is acquiring 4,358 acres as part of the proj ect, the agenda item said. Among the other deals approved by DeSantis and the Cabinet was paying $7.75 million for a conservation easement on 3,634 acres in Okeechobee County. In all, DeSan tis and the Cabinet approved projects to conserve about 19,800 acres in various parts of the state, according to Audu bon Florida. The deals came through the Florida Forever conservation program and the state’s Rural & Family Lands Protection Program.
