Whether you’re a seasoned athlete or just looking to get out and get moving, there are a host of free activities and recreational offerings available throughout the community to help you work on your fitness. The City of Pensacola’s Parks and Recreation Department hosts free pilates and yoga classes throughout the year at both the Community Maritime Park and Bayview Community Park. With 93 parks boasting more than 600 acres of parks and open recreation space, there are plenty of low- and no-cost ways to work on your fitness without the commitment of a monthly gym membership or the use of expensive workout equipment.
From yoga classes to pickleball, we have rounded up a handful of free exercise activities and programs right here in our city to help you get fit without breaking the bank.
TAKE A HIKE Down a Local Nature Trail
Did you know that there are more than 20 miles of hiking trails to explore on the University of West Florida (UWF) campus alone? Located on the westernmost 600 acres of campus, these diverse and challenging hiking and biking trails provide a great way to get out and get moving at your own pace. The Edward Ball Nature Trail is one of the most popular trails on campus. This half-mile boardwalk meanders through Thompson Bayou over a hardwood swamp that is home to mammals, birds, fish and a variety of reptiles, including an occasional American alligator. The trailhead is located just behind Crosby Hall (Bldg.10) and Bldg. 11.
The newly completed Shoreline Wetlands Trail in Gulf Breeze is another great place for a hike. The elevated boardwalk is more than a third of a mile over wetlands to the beach shoreline, traveling through ecosystems abounding with wildlife. The project includes ADA parking and an ADA beach access ramp, and an uncovered nature viewing gazebo
with bench seating. The boardwalk is located just across from the dog park at Shoreline Park in Gulf Breeze.
GO FOR A STROLL
Through Historic Downtown Pensacola or Visit a Nearby Pedestrian Trail
Take a stroll through downtown’s Historic Pensacola Village, along Palafox Street or down the America’s 1st Settlement Trail to explore our City’s rich history. The 1st Settlement trail takes you through more than 260 years of history and has twenty different stops along the way with more than seventy points of interest. You’ll see sites from as early as 1756, when the Spanish built Fort San Miguel in what’s now downtown Pensacola.
The City of Gulf Breeze has also recently completed a major pedestrian infrastructure project to improve walkability and provide a safe place for people to run, walk, ride or roll. This new, multi-use pathway, better known as ‘the loop,’ stretches along the entire length of Shoreline Drive and Fairpoint Drive. If you’re feeling a bit more adventurous and want to take in some beautiful scenery along the way, consider taking a stroll down the new pedestrian pathway, which spans the entire length of the Pensacola Bay Bridge. The 10-foot-wide lighted path includes six scenic overlooks, each with shaded seating areas that provide panoramic views of the bay.

Stir Up Some Friendly Competition on the Court
Visit a local pickleball, disc golf, tennis, basketball or racquetball court with a group of friends or family and stir up some friendly competition. There are numerous municipal facilities and city recreation centers located throughout both Pensacola and Gulf Breeze equipped with a variety of fields, courses, courts and even skateparks. Head to the Fricker Community Resource Center for just
$1 and shoot some hoops, work on your skills or participate in a pick-up game of basketball with friends. You can also visit the Gulf Breeze Community Center, UWF or Roger Scott Athletic Complex to play disc golf, tennis, pickleball and more. Bayview Park in Pensacola is also equipped with numerous tennis and basketball courts that are free and open to the community. You can stop in at the new Bayview Outdoor Pursuits Center, which offers equipment rentals for things like kayaking, stand up paddle boarding, canoeing, pedal boats, bikes and more.
LET THE GOOD TIMES ROLL Bike, Skate or Scoot at a Community Slow Ride Event
Join Bike Pensacola for the most popular bike ride in town—the Slow Ride. Each month the community is invited to come out and explore the quiet, scenic streets of Pensacola’s many historic neighborhoods for a fun and leisurely ride. During Slow Ride events, participants will also learn about bicycle laws, safety and skills to help keep rides safe and enjoyable. There is no charge for the ride and no registration required. Each Slow Ride is about one hour and ten minutes long, at a casual pace. The upcoming March Slow Ride will be co-sponsored by Ciclovia, which brings its “open streets” event to downtown Pensacola Saturday, March 25, so be sure to mark your calendars! RECENTER YOURSELF At Wellness in the Park
The City of Pensacola Parks and Recreation Department has partnered
with local fitness studios to offer free one-hour outdoor yoga and pilates sessions in city parks as a part of its Wellness in the Park Series to help promote wellness, balance and strength. Both programs are led by certified instructors and are open to all ages and levels of experience. All you need to bring is your own mat and any other accessories you like to use. Free Yoga in the Park sessions are held on the first Sunday of each month at 9:30 am at Bayview Park located at 2001 E. Lloyd St. in Pensacola. Class instruction is presented by Breathe Yoga and Wellness Center. Free Pilates in the Park sessions are held on the third Sunday of each month at 10:30 am at the Community Maritime Park in front of the amphitheater stage located at 301 W. Main St. in Pensacola. HOP ON THE CIRCUIT Visit the LeaP Trail
Not just for fitness junkies, LeaP Trail is an inclusive activity space that improves the quality of life for our community. It’s a place for athletes, family fun and people of leisure. LeaP Trail is used by runners, joggers, skateboarders, dog walkers and bicyclists—couples, families, children and the elderly. The trail consists of three components. The track begins just near the Pensacola International Airport and ends on Jerry L. Maygarden Road in Pensacola. The LeaP Trail features the Baptist Healthcare Workout Circuit with six workout stations at various intervals along the trail to provide a full body workout. The Greater Pensacola Chamber Foundation’s Leadership Pensacola (LeaP) Class of 2018 chose to pursue LeaP into Fitness, a project in partnership with the City of Pensacola and the National Fitness Campaign (NFC), to provide fitness courts to the Pensacola area as their annual class project.Pensacola is now home to three National Fitness Campaign (NFC) Fitness Courts™ which offer a free, outdoor, bodyweight fitness program designed for adults of all ages and fitness abilities. The first of three courts was opened to the community on April 27, 2018 at the Vince J. Whibbs Sr. Community Maritime Park. Sea Turtle Nesting Season Ends on High Note
The 2022 Sea Turtle Nesting Season officially ended on Nov. 1, 2022. The county celebrated 39 nests this season, the highest since 2016 with an average success rate of 63%. A quiet hurricane season contributed to above-average numbers, with fewer nests lost to erosion and tidal impacts than in previous years. However, artificial lighting still negatively impacted 65% of nests, causing hatchling disorientation.
Sea Turtle Conservation Program volunteers contributed over 1,200 hours, including 540 morning patrols and countless hours spent monitoring and assessing nests. Volunteers also engaged 966 people in sea turtle education and conservation through public events across the county, and sea turtle educational messages reached over one million people through online and digital channels.

Marine Resources Division Removes Seven Derelict Vessels in 2022
Marine Resources staff received $57,000 in grant funds and removed seven derelict vessels from county waters in 2022 in partnership with local law enforcement and Florida Fish and Wildlife Conservation Commission. Two vessels remain pending removal, with an additional $15,000 in grants from FWC.
Derelict vessels pose serious environmental and safety risks and create navigational hazards. For this reason, abandoning a vessel or allowing it to become derelict are considered criminal offenses and can have serious penalties, including jail time. Once a vessel is officially declared derelict or abandoned, Marine Resources staff works with local marine
contractors to remove the vessel and pursues restitution in coordination with law enforcement and state agencies.
MOSQUITO CONTROL Winter Mosquitoes
It’s likely we won’t mosquitos in December and January in Escambia County, with the exception of those unseasonably warm Florida days. Many mosquitoes make it through the winter months by remaining in the larval stage. Female mosquitoes lay eggs toward the end of the fall, and those eggs will remain dormant until spring. The eggs are carefully placed in damp soil and will not hatch until conditions become favorable again, when the temperature rises and plenty of rain begins to fall. There are even quite a few species of mosquitoes that can live as adults through winter. Our typical winter temperatures average above 50 degrees Fahrenheit, which is above minimum threshold for keeping mosquitoes warm enough to mate, reproduce and thrive.
Mosquito eggs are almost invisible in deep wet grass, small puddles, and large leaves that can hold water. They can ride out the cold in ponds and neglected swimming pools, and can be found along the edges of containers.
To reduce the number of mosquitoes that are able to make it back when the warm weather does occur, empty any standing water that collects in tarps, toys, birdbaths, gutters, machinery, and pots. Be sure to also rake and dispose of leaves to ensure small pockets of water are emptied.

Escambia Soil and Water Conservation District Partnership
On May 23, 1940, the Perdido Soil and Water Conservation District was established. The name formally was changed to the Escambia Soil and Water Conservation District on May 16, 1995. The District

The Escambia County Board of County Commissioners is seeking applications from county residents to serve on the Escambia Children’s Trust. Applications are available online at MyEscambia.com or in person at the Ernie Lee Magaha Government Building, located at 221 Palafox Place, 4th floor. The application consists of several parts: an Escambia Children’s Trust application, a questionnaire for gubernatorial appointments and an optional resume. Both applications must be completed and submitted together to be considered for an appointment. The deadline to apply is Jan. 18, 2023, by 5 p.m. CST.

On Nov. 3, 2020, 61% of participating voters in Escambia County supported the creation of the Escambia Children’s Trust to be funded by an increase in ad valorem taxes of up to a maximum of 0.5 mil. The Escambia Children’s Trust will provide early childhood education, safety, developmental, preventative, health, and well-being services, including after school and summer enrichment programs.
The ECT is responsible for assessing the needs of the children in the county and developing a strategic plan for addressing unmet needs, which must then be submitted to the Board. The ECT, like the county, must also go through the process of adopting a millage rate and budget in accordance with Florida’s Truth In Millage (TRIM) Act, and the ECT must submit an annual report to the Board as required by Florida law.
To be considered for the ECT, Florida Statute criteria include the requirement that nominees have been residents of Escambia County for the previous 24-month period and are willing to submit an annual Statement of Financial Interests Form. Florida Statutes also require that gubernatorial appointments are representative of the demographic diversity of the county’s population.
The Board of County Commissioners will nominate three applicants to be submitted to the Governor for review and potential appointment. Following the Board’s selection, the County Administrator will then send a letter to the Governor and the Governor’s Appointments Office with the list of three nominees to be considered for appointment to the ECT. All of candidates will be notified of their nomination. In accordance with Florida Statutes, the Governor then has 45 days to make a selection or request a new list of candidates.
Per Section 125.901, Florida Statutes, the Escambia Children’s Trust shall consist of 10 members, including:
• The superintendent of schools;
• A School Board member as appointed by the School Board;
• The Department of Children and Families District Administrator, or his or her designee;
• A judge assigned to juvenile cases as appointed by the Chief Judge;
• A County Commissioner as appointed by the Board of County Commissioners; and
• Five members appointed by the Governor from candidates nominated by the Board of County Commissioners to serve a four-year term.

was formed by residents for the purpose of promoting and encouraging the wise use, management and general conservation of the soil, water and related natural resources of Escambia County.
The Florida legislation passed SB 1078 earlier this year, which now requires each member of the Board to have a minimum of 10 years of agricultural related experience. As we move into 2023 and the new board members assume their roles, it is the goal of the Escambia County Natural Resources Conservation (NRC) Division to assist in a smooth transition of leadership, as well as assist in any future projects that the board might endeavor. NRC has taken the first step in making this a lasting partnership by updating the Memorandum of Understanding with the Escambia County Soil and Water Conservation District. This accomplishment allows NRC to clearly define how they can and will help the District when needed. With all the new faces and changes being made within the District, NRC is eagerly looking forward to all that will be accomplished together.
Prescribed Fire Management at Jones Swamp Wetland Preserve
NRC is preparing for the upcoming winter prescribed burn season in the Jones Swamp Wetland Preserve. The staff successfully burned 43 acres of an upland longleaf/slash pine stand in Jones Swamp last winter and is targeting a similar amount this coming winter. A Florida Certified Prescribed Burn Manager on staff will oversee the burn with assistance from the Florida Forest Service. The public will be notified in advance of any potential burn days, weather permitting.
Winter is an ideal time for prescribed burns, where land managers intentionally set small, lowintensity fires that mimic natural fires caused by lighting. Prescribed burns keep the understory open to allow grasses and other small plants to dominate the landscape. Ash keeps the soil fertile and encourages new plant growth in the spring. By reducing fuel loads and keeping the understory clear, land managers reduce the chances of a larger, more dangerous wildfire.

Jackson Creek Stream Restoration Project
The RESTORE Team is happy to report that the
Jackson Creek Restoration Project is nearing completion. This creek restoration is another one of the critical projects contributing to the remediation of Bayou Chico. Jackson Creek waters lead directly into Bayou Chico. Once Complete, this project with improve water quality and habitat within Jackson Creek. The project is expected to be complete in early spring of 2023.
WATER QUALITY AND LAND MANAGEMENT DIVISION
Data Portal
Escambia County Water Quality and Land Management opened a new web-based portal in December 2022. The new portal proves public access to much of the surface water quality data routinely collected by the county. Samples are samples at over 50 unique surface water stations located throughout the county. Stations are monitored monthly for fecal indicator bacteria (Enterococci or E. coli) and field parameters (temperature, pH, dissolved oxygen, dissolved oxygen saturation, specific conductance, salinity, and turbidity). At least 40 of these stations are also being monitored every other month for nutrients (Total Kjeldahl Nitrogen, nitrate/nitrite, total nitrogen, total phosphorus), residuals (total suspended solids), and chlorophyll-a. The public data poral is still a beta version. We are very much interested in public comments and feedback. Check it out and let us know what you think!
RESILIENCY PROGRAM
Results from the Archaeological Survey of Navy
Outlying Field 8
In December 2022, a cultural resources assessment survey was completed at the Navy Outlying Landing Field (NOLF) 8, by the cultural resource consulting firm SEARCH. The project included archaeological survey and historic architectural resources survey of the entire 525-acre property.
The archaeologists documented one late nineteenth to early twentieth century home site (8ES05596), which produced historic period architectural remains, bottle and jar fragments, ceramic vessel fragments, and various metal hardware. The investigation also documented the NOLF 8 itself as a mid-to late-twentieth century historic landscape (8ES05595) along with a previously identified fire and rescue station (8ES04107) associated with the landing field.

The Escambia-Santa Rosa Bar Foundation, the philanthropic arm of the Escambia-Santa Rosa Bar Association, is currently accepting grant applications for 2023. Grants are awarded to organizations that successfully demonstrate how a proposed program aligns with one or more of the tenets of the mission of the Foundation, which are to foster greater accessibility to the judicial system, improvements to the overall quality of the administration of justice, lawrelated education and increased public awareness of the judicial system and improved management and operation of the court system. “The Foundation is committed to supporting the community while furthering our mission,” said Foundation President Shekka Drayton. “We encourage all organizations whose initiatives align with our mission to apply.”

JON LACHNEY RECEIVES JANUARY 2023 EMPLOYEE OF THE MONTH
The Escambia County Board of County Commissioners is pleased to recognize Jon Lachney, Personnel Clerk in the Human Resources department, as the January 2023 Employee of the Month. The board recognized Jon’s selection at the Jan. 5 BCC meeting.
Jon’s career with Escambia County began in November 2021. As the Personnel Clerk, Jon is primarily responsible for UKG functions. He guides department supervisors on submitting, editing, and approving employee timecards, building custom reports, and submitting job requisitions through the UKG system. He also assists county team members in the UKG system by teaching them how to view paystubs, apply for positions and update personal information. In addition, Jon creates each new hire badge and responds to inquiries regarding badge access throughout county facilities.
Another one of Jon’s duties includes maintaining the personnel file room. He coordinated the digitization of personnel records in Human Resources by participating in vendor demonstrations, managing proposals, and creating spreadsheets outlining vendors’ cost of services to determine the best and most cost-effective option.
Additionally, Jon recently worked with the Public
Safety and Information Technology departments to create a report of emergency assignments of county personnel. The report added emergency assignment sections in UKG to indicate which employees were in safety-sensitive or CDL positions, allowing Human Resources to assist in facilitating random drug screenings.
“Jon is always upbeat and is dedicated to his duties while working with county departments,” said Crystal Dadura, Escambia County Human Resources Director. “He uses a practical and data-driven approach to deliver excellent customer service to all county employees and constituents. As a result, his supervisors consistently receive positive feedback from staff. He has been an incredible asset to our Human Resources team. We look forward to his continued success within the department.”
Outside his duties with the county, Jon is an active member of First Pentecostal Church of Pensacola, playing guitar in the music department for services, conferences and revivals.

STATE ACCUSED OF VIOLATING ORDER IN EDUCATION CASE

TALLAHASSEE — Plaintiffs challenging a state law restricting how race-related concepts can be taught in higher education accused Gov. Ron DeSantis’ administration Wednesday of violating a federal judge’s order that blocked parts of the law from being enforced.
Chris Spencer, one of DeSantis’ chief lieutenants, late last month directed state education leaders to require colleges and universities to “provide a comprehensive list of all staff, programs and campus activities related to diversity, equity and inclusion and critical race theory.” Florida Education Commissioner Manny Diaz, who oversees state colleges, and state university system Chancellor Ray Rodrigues are supposed to submit the responses by Friday.
Spencer’s memo pointed to the 2022 law, which DeSantis dubbed the “Stop Wrongs To Our Kids and Employees Act,” or “Stop WOKE Act.” The law lists a series of race-related concepts and says it would constitute discrimination if students are subjected to instruction that “espouses, promotes, advances, inculcates or compels” them to believe the concepts.
Professors and students from state universities challenged the law in a pair of lawsuits, arguing that it has created confusion for faculty and is an unconstitutional infringement of First Amendment rights.
Chief U.S. District Judge Mark Walker in November granted a preliminary injunction preventing the state from enforcing the law, calling it “positively dystopian.”
Plaintiffs in one of the cases asked Walker on Wednesday to “compel” the state to comply with his ruling. The motion argued that “compliance with” Spencer’s memo “would violate the preliminary injunction order.” The plaintiffs also sought “further clarifying” from Walker that the order “enjoins defendants from taking any actions pursuant to” Spencer’s memo.
DeSantis, who cruised to re-election in November and is widely viewed as a top Republican presidential candidate in 2024, made the law a priority last year and has continued to target “trendy ideology” on campuses, including during his Jan. 3 inaugural address.
Faculty members who violate the law could be fired, and a “substantiated violation” of the restrictions would make schools ineligible for what is known as performance funding.
The memo from Spencer, director of DeSantis’ Office of Policy and Budget, required colleges and universities to provide details about funding used to support programs addressing diversity, equity and inclusion and critical-race theory, a concept which maintains that racism is embedded within American institutions.
That included providing “a comprehensive list of all staff, programs and campus activities related to diversity, equity and inclusion and critical race theory.” Also, colleges and universities were required to detail “costs associated with the administration of each program or activity,” including a description of the activities, paid positions and how much of the money is provided by the state.
The motion filed Wednesday pointed to Walker’s Nov. 17 order, which prohibited the Board of Governors from enforcing the law against any university.

More than 84,000 Florida residents have died of COVID-19 since the pandemic started in 2020, with the total increasing by nearly 1,000 in the past month, according to a report released Friday by the state Department of Health. The report showed that a reported 84,176 residents had died of COVID-19 as of Thursday. That was up from a reported 83,201 deaths in early December.

“As the Executive Office of the Governor prepares policy and budget proposals ahead of the 2023 Legislative Session, it is important that we have a full understanding of the operational expenses of state institutions,” Spencer wrote in the memo.
Wednesday’s motion included an email exchange in which Sara Hinger, an American Civil Liberties Union of Florida attorney who represents the plaintiffs, raised concerns about Spencer’s memo.
“As you requested, we can confirm that our clients intend to comply with the injunction … requiring them to refrain from enforcing the enjoined provisions, so long as it remains in force,” John Ohlendorf, an attorney with the Washington, D.C.-based Cooper & Kirk, PLLC firm who represents the state, wrote to Hinger on Monday.
But Hinger pressed Ohelndorf about the memo.
“Our understanding is that actions are underway to collect information to provide to the governor’s office currently, impacting our clients and raising immediate concerns regarding compliance with the injunction,” she responded.
“We see no basis for any claim that compliance with the governor’s request to gather and provide information raises concerns regarding compliance with the injunction,” Ohlendorf wrote back. “If you disagree, please advise as to your basis for concluding otherwise.”
Hinger laid out the plaintiffs’ concerns in a message Tuesday, saying the collection of the information was an enforcement of the law.
“Given our difference of opinion and the urgency of this matter, we will file seeking the court’s assistance,” she wrote.
The plaintiffs’ motion said the threat of funding losses is creating a “chill” on campuses.
“The potential to withhold institutional funding is a principal mechanism for inducing compliance with the state’s preferred orthodoxy of viewpoints in the classroom,” the motion said. “By its express terms, the executive memorandum’s effort to collect information on instructors’ programs is undertaken pursuant to the Stop W.O.K.E. Act, which this court has already held that plaintiffs are likely to prove unconstitutionally discriminates on the basis of viewpoint, contains vague requirements, and impermissibly chills instructors’ free speech and the rights of students to receive information, thereby interfering with academic freedom.”
Compiling information about instructors’ programs “could only further the chill engendered” by the law “that the court sought to remedy” through the preliminary injunction, the plaintiffs’ lawyers argued.
The state university system, the education department and DeSantis’ office did not immediately respond to requests for comments about Wednesday’s motion.
JUDGE REOPENS FIGHT ON TRANSGENDER ATHLETE LAW

TALLAHASSEE — After an appeals court upheld a school-board policy that prevented a transgender male student from using boys’ bathrooms, a federal judge has reopened a legal battle about a 2021 Florida law that bars transgender female students from playing on women’s and girls’ sports teams.
U.S. District Judge Roy Altman on Friday issued an order reopening the transgender-athlete lawsuit, which had been on hold for nearly a year as the 11th U.S. Circuit Court of Appeals considered a challenge to the St. Johns County School Board bathroom policy.
A sharply divided appeals court on Dec. 30 upheld the bathroom policy and indicated that similar legal reasoning could apply to disputes about transgender female athletes. Attorneys for the state and a Broward County middle-school student challenging the transgender-athlete law filed a joint motion Friday to reopen the case, prompting Altman’s order.
Altman also approved a partial schedule that the parties had suggested, with the state given a Feb. 10 deadline to file a motion to dismiss the lawsuit.
“The parties submit that this proposed schedule will afford them the necessary time to fully consider the (bathroom policy) decision and other legal developments and to place this matter before the court (Altman) in a manner that best assists the court,” the joint motion said.
Attorneys for the transgender female Broward County student, identified by the initials D.N., filed the lawsuit in June 2021, after the Republican-controlled Legislature and Gov. Ron DeSantis approved the transgender-athlete ban. The lawsuit contends that the ban is unconstitutional and violates a federal law known as Title IX, which prohibits discrimination based on sex in education programs.
In a 2021 court document, attorneys for the state argued that the law was aimed at helping ensure athletic opportunities for girls and women who want to play interscholastic or college sports.
“Men’s and women’s athletic teams, separated by sex, are more than a long-standing social custom; they protect and foster the equal opportunity of girls and women to participate in athletics,” the document said. “Courts have long accepted that boys and men are physiologically different from girls and women, and that male athletes, if permitted to compete with, would displace and exclude female athletes.”
But the lawsuit said the law (SB 1028) is “part of a
wave of anti-transgender bills” across the country and would “stigmatize this teenager and separate her from her peers and teammates.” It said D.N. plays soccer and volleyball.
“SB 1028, ironically titled the ‘Fairness in Women’s Sports Act,’ has nothing to do with fairness or equality for girls or women in sports,” the lawsuit said. “By excluding transgender girls and women from girls’ sports teams and forcing them, if they want to play sports at all, to join a team that matches neither their gender identity nor their current physical status, the bill discriminates on the basis of sex and transgender status in violation of the United States Constitution and Title IX.”
Altman placed a stay on the lawsuit early last year, citing the long-running St. Johns County bathroom case, which was pending at the 11th U.S. Circuit Court of Appeals. In that case, transgender male student Drew Adams challenged the policy after being prevented from using boys’ bathrooms at Nease High School.
“We share the parties’ (apparent) conclusion that the Eleventh Circuit’s … decision in Adams may materially affect the result in our case,” Altman wrote in issuing the stay.
The Atlanta-based appeals court, in a 7-4 ruling on Dec. 30, rejected a district judge’s ruling that supported Adams. The majority opinion also said that “affirming the district court’s order (in the Adams case) would have broad implications for sex-separated sports teams at institutions subject to Title IX, including public schools and public and private universities.”
The decision, written by Judge Barbara Lagoa, added that “equating ‘sex’ to ‘gender identity’ or ‘transgender status’ would also call into question the validity of sex-separated sports teams.”
Lagoa, a former Florida Supreme Court justice, also wrote a concurring opinion that focused on the issue of transgender females playing sports and the definition of “sex.” She wrote that “had the majority opinion adopted Adams’ argument that ‘sex,’ as used in Title IX, includes the concept of ‘gender identity’ or ‘transgender status,’ then it would have become the law of this (11th) Circuit for all aspects of the statute.”
But Judge Jill Pryor wrote a lengthy dissent, saying that “the majority opinion misuses the term ‘biological sex,’ contradicting unchallenged findings of fact that reflect medical science and oversimplifying — indeed, excising — the role of gender identity in determining a person’s biological sex.”

But attorneys for DeSantis, the Florida Department of Transportation and state Chief Financial Officer Jimmy Patronis filed motions last week to dismiss the case. Circuit Judge John Cooper, who rejected an earlier version of the lawsuit in November, is slated to hold a hearing Friday on a revised complaint.
The case focuses primarily on $12 million that lawmakers included in the state budget for the Department of Transportation to carry out a “program to facilitate the transport of unauthorized aliens from this state.”
The DeSantis administration contracted with Vertol Systems Company, Inc. to transport two planeloads of migrants on Sept. 14 from San Antonio, Texas, to Martha’s Vineyard, with a stop in the Northwest Florida community of Crestview.
The lawsuit said that under the U.S. Constitution, “Congress is vested with exclusive power over immigration and naturalization. Under that and other constitutional and statutory authority, the federal government has exclusive authority to enact and enforce regulations concerning which immigrants to admit, exclude, remove or allow to remain in the United States.”
But in a motion to dismiss the case filed last week, attorneys for DeSantis and the Department of Transportation argued that Pizzo does not have legal standing to pursue the lawsuit. The motion said, in part, that Pizzo had not “alleged that he suffered any special injury.”
Because of lags in reporting, it is unclear when the additional deaths occurred. The new report also showed an increase in reported COVID-19 cases.
During the week of Dec. 30 through Thursday, the state had a reported 31,633 cases, compared to 23,939 reported cases the previous week. As another comparison, the state had a reported 12,365 cases during the week that started Oct. 28, according to Department of Health data.
The Department of Transportation paid $615,000 to Vertol for the flights. Also, three additional Vertol purchase orders of $950,000 each are listed on a state contracting website for “relocation services.”
The flights spurred a national controversy and came as DeSantis, widely considered a possible 2024 Republican presidential candidate, often criticizes federal immigration policies.
