PAWSITIVELY FALL FUN PENSACOLA HUMANE SOCIETY’S ANNUAL BARKTOBERFEST

October is the time of year for crisp cool weather pumpkins, tricks, treats and everything in between, but for the Pensacola Humane Society (PHS), October is also a time to celebrate and support all our favorite furry friends. Join PHS this Halloween for one of the area’s favorite pet friendly festivals and mega adoption events: Barktoberfest at the Community Maritime Park.

The Pensacola Humane Society organizes and hosts Barktoberfest each year as part of its annual fundraising efforts to help support and raise aware ness of its mission. This year’s Barktoberfest event will be held Sunday, Octo ber 30 at the Community Maritime Park located at 301 W. Main Street in downtown Pensacola.

The event will feature a variety of tasty foods and beverages from a variety of local vendors and food trucks, as well as PHS vendor information, adop tion booths, pet-centric boutiques, multiple pet businesses, local veteri narians, fun pet accesso ries and more.

“We will host a vari ety of contests, small dog races, local food trucks, pet centric vendors, fun merchandise, and so much more. Everyone planning to attend should expect this to be a howlin’ good time,” Fischer said.

A series of fun pet contests will also be held as part of this year’s festivities starting at 11

am on the amphitheater stage. There will be both a morning and an afternoon session, with the afternoon session beginning at 2 pm.

The obedience and agil ity demonstrations, along with the “Moose’s Mutter Speedway” small dog race, are always a big hit for pets and pet parents alike.

The popularity of the costume contests has grown over the years so the PHS will be continuing the tradition and adding in other fun contests such as a pie eating and a food tasting contest. The food tasting contest will be judged by a

This Barktober fest event is to promote community education and outreach and serves as one of three major fundraisers and adoption events of the year for the Society. The PHS also invites other area animal welfare organiza tions to join the event for adoptions and fundraising of their own.

This year’s Barktober fest “Presenting Pawt ner’’ is the Pensacola Ice Flyers. Last year, the PHS received support from 20

different sponsors, and according to Fischer, the organization is on track to hit that same number with room for even more.

COLD WEATHER MONTHS

As colder weather starts to set in, Escam bia County Fire Rescue would like to encourage residents to practice space heater safety and know the potential risks associated with home heating equipment. Home fires occur more in the winter months than any other time of year. According to the National Fire Protection Association, heating equip ment is one of the leading causes of home fire deaths and space heaters account for four out of five home heat ing fire deaths.

“Escambia County Fire Rescue encourages everyone to have a working smoke alarm,” says Escambia County Fire and Life Specialist Ray Melton. “As colder weather arrives, any home using natural gas or any alternative fuel source should have a carbon monoxide alarm and have chimneys inspected and cleaned prior to using them.”

Melton also discourages the use of kitchen stoves to heat homes, and emphasizes the importance of never leaving candles unattended. “If you use a space heater, plug them directly into the wall outlet instead of an extension cord or power strip,” he says. “Space heaters should have at least three feet of safety space to prevent fires in your home or office.”

Follow these tips to stay safe while heating your home:

Have heating equipment and chim neys cleaned and inspected annually by a qualified professional.

• Keep anything that can burn at least three feet away from heating equip ment, like the furnace, fireplace, wood stove or portable space heater.

• Portable space heaters should be turned OFF every time you leave the room and before going to bed. Never plug a space heater in a pow er strip.

Install carbon monoxide detectors to

avoid carbon monoxide poisoning.

• Never use an oven to heat your home.

For portable electric heaters:

• Place them on a solid, flat surface, away from high traffic areas and doorways.

• Use and purchase heaters with an automatic shut off so if they are tipped over they will shut off.

Plug power cords directly into out lets and never into an extension cord.

• Inspect for cracked or damaged, broken plugs or loose connections; replace before using.

Heating Fire Facts:

• Most home heating fire deaths (86%) involved stationary or por table space heaters.

The leading factor contributing to home heating fires (27%) was fail ure to clean, principally from solidfueled heating equipment, primarily chimneys.

• The leading factor contributing to ignition for home heating fire deaths (54%) was heating equip ment too close to things that can burn, such as upholstered furniture, clothing, mattress, or bedding.

• Nearly half (48%) of all home heat ing fires occurred in December, January and February.

Practicing these home heating safety tips will help keep our community safe and warm during the winter months.

ESCAMBIA COUNTY MARINE RESOURCES WATERWAYS MANAGEMENT WORKSHOP

Zarzaur Law, P.A., a catastrophic personal injury and wrongful death law firm based in Pensacola, Florida, announced today that the firm’s senior partner and founder, Joe Zarzaur, has filed a lawsuit on behalf of a minor plaintiff in Santa Rosa County against Gulf Breeze United Methodist Church, The Alabama-West Florida Conference of the United Methodist Church, Pastor Dan Morris, Executive Pastor Kenneth York, and Youth Pastor Ryan Walsh.

The suit alleges that Zarzaur Law’s minor client was sent explicit messages on church devices and ultimately sexu ally assaulted by its Youth Pastor Ryan Walsh. This conduct occurred between October 2019 and February 2020. This month youth Pastor Ryan Walsh pled guilty to lewd and lascivious battery, using a computer to facilitate or solicit the sexual conduct of a child, and giving obscene material to a minor, and was sentenced by Judge Clifton Drake to 15 years in a state penitentiary.

The lawsuit alleges that Church and Conference officials negligently hired, trained, and supervised the Youth Pastor

Escambia County’s Engineering depart ment will begin the Jackson Street Sidewalk Project in District 2 start ing November 2022. During this time, Chavers Construction, Inc. will install sidewalks within the south right-of-way along Jackson Street from 65th to 75th avenues.

The Jackson Street Sidewalk Proj ect consists of clearing and grubbing, mailbox replacement, grading, excava tion and installation of approximately 1,930 linear feet of sidewalk, util ity adjustments, driveway approach replacement, access ramps, valley gutter, striping and sod. Work will take place Monday-Friday from 7 a.m. until 5 p.m. and is expected to be completed

The suit alleges that these actions allowed the Youth Pastor to have access to youth in the church community and it permitted him to use all forms of social media (many times on church devices) to communicate with minor children. The suit describes the disgusting conduct of the youth pastor, including his explicit text messages between himself and the 13-year-old victim.

Escambia County Marine Resources will hold a Waterways Management Work shop Monday, Nov. 14 at 5:30 p.m. at the Central Office Complex, 3363 W. Park Place, room 104. Members of the public are invited and encouraged to attend. Held in conjunction with the Marine Advisory Committee, the workshop is designed to identify opportunities to improve Escambia County’s waterways to allow for better access, usage and environmental resources. In order to gain public input, citizens are asked to

complete a survey to identify the issues of greatest concern and prioritize action items. The survey is open from Friday, Oct. 21 until 5 p.m. on Monday, Nov. 7. Survey responses will be collected and presented at the workshop.

The Marine Resources division works to provide access to safe, healthy and productive waterways. The division works with federal, state and local agen cies, Escambia County residents, visi tors, and other stakeholders to fulfill its mission.

FDOT: U.S. 90 BRIDGE REPLACEMENT OVER SIMPSON RIVER

Construction crews have temporarily shifted eastbound traffic to the west bound bridge over Simpson River. The shift is expected to be in place through March 2023. During this time, there will be two westbound lanes and one east bound travel lane using the westbound bridge. Due to the traffic shift, there will not be dedicated bike lanes on the bridge. Drivers are urged to use extra caution as they will be temporarily sharing the bridge with cyclists. Drivers are also reminded that the speed limit is 35 mph through the work zone.

All activities are weather-dependent and may be delayed or rescheduled in the event of inclement weather. Driv ers are reminded to use caution, espe cially at night, when traveling through a work zone and to watch for construc tion workers and equipment entering and exiting the roadway.

Areas that are impacted during construction will be returned to their previous state. Access to adjacent prop erties will be maintained, although there may be short periods where a drive way or entrance is temporarily blocked during construction.

JUDGE REFUSES TO BLOCK EDUCATION LAW

TALLAHASSEE — A federal judge has refused to block school districts from carrying out a new state law that restricts instruction on gender identity and sexual orientation in classrooms, rejecting arguments by parents, students and a non-profit organization.

The ruling Thursday by U.S. District Judge Wendy Berger was the second time in less than a month that a federal judge has turned down a challenge to the law. U.S. District Judge Allen Winsor on Sept. 29 dismissed a separate case, though he said plaintiffs could file a revised version.

Berger, who is based in Orlando, issued a 28-page decision that denied a request for a preliminary injunction against the law. Berger also dismissed the case but, like Winsor, said the plain tiffs could file a revised version.

The law, which has drawn nationwide attention, prevents instruction on gender identity and sexual orientation in kinder garten through third grade and requires that such instruction be “age-appropri ate … in accordance with state academic standards” in higher grades.

Republican lawmakers this year titled the measure the “Parental Rights in Education” bill. Opponents labeled it the “Don’t Say Gay” bill.

Lawyers for the parents, students and non-profit group filed the lawsuit in July against the school boards in Orange, Indian River, Duval and Palm Beach counties. In a motion for a preliminary injunction, they argued the law “was enacted with the purpose to discrimi nate and has the effect of discriminat ing against LGBTQ+ students and those with LGBTQ+ family members.”

They alleged violations of speech, equal-protection and due-process rights and pointed to steps that the school districts have taken to try to comply with the law (HB 1557).

But Attorney General Ashley Moody’s office and the school boards argued that Berger should reject the motion for a preliminary injunction, in part because the plaintiffs did not have legal standing.

Berger’s decision Thursday denied the injunction on a series of grounds, including describing the lawsuit as a “shotgun pleading” and saying the plaintiffs “fail to specify what policy or custom of each defendant supports liability” under the U.S. Constitution.

“Instead, plaintiffs dedicate their time exclusively to arguing that the under lying law is unconstitutional, without specifying any causal link between the actions of these defendants and the alleged deprivation of a constitutional right,” Berger wrote. “On this basis alone, the court finds that plaintiffs have failed to show a likelihood of success on the merits on any of the claims they attempted to allege in the first amended complaint (the lawsuit).”

Berger also said the plaintiffs had not shown they had standing. As an example, a married same-sex Indian River County couple, David Dinan and Vikranth Reddy Gongidi, are plaintiffs on their behalf and on behalf of their children, identified by the initials K.R.D. and R.R.D.

Teachers in six counties hit hard by Hurricane Ian are slated to receive $2 million from the Florida Disaster Fund, Gov. Ron DeSantis said Friday. ing to Berger’s ruling. But the judge rejected the argument, saying they had not alleged an “injury in fact.”

“Although they make vague allega tions regarding their self-censorship at school events before the law went into effect, they fail to state any detail as to how they wished to exercise their rights since the law actually went into effect or might wish to exercise their rights in the future,” wrote Berger, who served as a state appellate judge before being appointed to the federal bench by former President Donald Trump.

Other plaintiffs include Orange County residents Jennifer and Matthew Cousins and their four children, includ ing a seventh-grade student, S.C. who is gender non-binary. They argued that the law would chill speech at school and could result in increased bullying of S.C.

But Berger found they had not shown standing.

“Plaintiffs have not pointed this court to any policy or procedure from Orange County that they allege has resulted in any increase in bullying that S.C. might experience at school,” Berger wrote. “While the court is sympathetic to the Cousins’ fear that their child may be bullied, it is simply a fact of life that many middle school students will face the criticism and harsh judgment of their peers. S.C. is not alone in this regard. Indeed, middle school children bully and belittle their classmates for a whole host of reasons, all of which are unacceptable, and many of which have nothing to do with a classmate’s gender identity.”

The plaintiffs are represented in the case by attorneys from Lambda Legal, the Southern Poverty Law Center, South ern Legal Counsel and the law firm of Baker McKenzie LLP. They issued state ments Friday criticizing Berger’s ruling and vowing to continue fighting the law.

“The court’s decision is wrong on the law and disrespectful to LGBTQ+ fami lies and students. HB 1557 suppresses wholesale the speech and identities of LGBTQ+ students and their families,” Kell Olson, a staff attorney at Lambda Legal, said in a statement. “It sends a message of shame and stigma that has no place in schools and puts LGBTQ+ students and families at risk. The students and families at the heart of this case have experienced more bullying in the months since the law went into effect than ever before in their lives, but the court dismissed their experiences of bullying as ‘a fact of life.’ The court’s decision defies decades of precedent establishing schools’ constitutional obli gations to protect student speech and to protect students from targeted bullying and harassment based on who they are.”

Angela Vigil, a partner and executive director of pro bono practice at Baker McKenzie, said the plaintiffs “look forward to continuing the fight against this unjust and dangerous law. We plan to show the court and the state the harm caused to children and families by this law is destructive in so many ways for education, community, families and, most importantly, children.”

Other plaintiffs in the case are Will Larkins, a senior at Orange Coun ty’s Winter Park High School, and the non-profit CenterLink, Inc., which has members including LGTBQ commu nity centers in Orange, Duval and Palm Beach counties. Berger gave the plain tiffs until Nov. 3 to file a revised lawsuit.

FLORIDA JOBLESS RATE DOWN TO 2.5 PERCENT

TALLAHASSEE --- Florida’s alreadylow unemployment rate dipped to 2.5 percent in September, though the numbers don’t take into account economic effects from Hurricane Ian.

A state economist said Friday that October numbers likely will show an impact from the Category 4 storm, which made landfall Sept. 28 in South west Florida, but wouldn’t speculate on potential changes.

The Department of Economic Oppor tunity released a report showing the September rate down from 2.7 percent in August and July. The September rate represented an estimated 266,000 people out of work from a labor force of 10.7 million.

“What else is new? We’ve been outpacing the nation on almost every thing for the last few years,” Gov. Ron DeSantis said Friday during a campaign event at ATMAX Equipment in Tampa. “Of course, part of the reason that was the case is because every governor had to make decisions about how they were going to look out for people over the last few years.”

The 2.5 percent rate, the lowest for the state since October 2006, is based on data collected before the hurricane made landfall and crossed Florida.

Adrienne Johnston, the Depart ment of Economic Opportunity’s chief economist, said in a conference call with reporters that analysts are looking closely at the impact of the storm.

“Our team has been looking at past storms, and we’ve seen tremendous vari ation across different storms and how they’ve hit our state,” Johnston said. “So, we don’t want to speculate just yet.”

Florida saw a spike of initial jobless claims after Hurricane Ian, with the number increasing from 4,269 during the week the storm made landfall to 14,934 during the week that ended Oct. 8, according to U.S. Department of Labor estimates. The number of new claims dipped to 11,078 last week.

Florida was among 11 states that reported dips in unemployment rates in September. The others were Alaska, California, Delaware, Hawaii, Mary

land, Massachusetts, New Jersey, New Mexico, New York and Pennsylvania.

Rates in nine other states went up. They were Arizona, Idaho, Iowa, Maine, Minnesota, Nebraska, Oklahoma, Rhode Island and Wisconsin.

The U.S. Department of Labor esti mated on Oct. 7 the country added 263,000 jobs in September, with the national unemployment rate dropping from 3.7 percent to 3.5 percent. That matches the national rate in February 2020, when the COVID-19 pandemic started to damage the global economy.

While job growth has slowed from the start of the year, the number of jobs added nationally was slightly higher than anticipated, indicating the economy was plodding through increased infla tion and higher interest rates.

A recent report by the state Depart ment of Economic Opportunity projected Florida employment exceed ing 10.8 million workers in 2030.

“This amounts to a statewide compound annual growth rate of 1.04 percent across the next eight years,” Johnston said. “The fastest growing occupations are those related to health care, and STEM (science, technology, engineering and math) activities.”

Over the past year, the state’s growth rate was 4.5 percent.

In that time, Florida has seen the most growth in the leisure and hospital ity sector, which was hard hit early in the pandemic.

Among metropolitan statistical areas, the lowest unemployment rate in September was in the Crestview-Fort Walton Beach-Destin region, at 2.2 percent, followed by the Panama City and Miami-Fort Lauderdale-West Palm Beach areas, both at 2.3 percent.

The Jacksonville, Tampa-St. Peters burg-Clearwater and Pensacola regions were each at 2.5 percent. The OrlandoKissimmee-Sanford market was at 2.7 percent.

The highest rates were in the Sebring area at 4.1 percent, Homosassa Springs at 4 percent and The Villages at 3.9 percent.

The statewide unemployment rate is seasonally adjusted, while the regional rates are not.

A federal appeals court Friday rejected former Central Florida Congressman Alan Grayson’s arguments that groups and political operatives defamed him during his unsuccessful 2018 campaign to return to the U.S. House. A threejudge panel of the 11th U.S. Circuit Court of Appeals upheld a district judge’s ruling against Grayson, who in 2020 filed the lawsuit against the political-action committees Progress Tomorrow, Inc. and United Together Inc., the non-profit group No Labels, Inc., No Labels founder Nancy Jacob son and her husband, Mark Penn. The lawsuit stemmed from ads that Prog ress Together published during Gray son’s unsuccessful primary race in 2018 against U.S. Rep. Darren Soto, D-Fla. The lawsuit alleged that the other groups, Jacobson and Penn worked through Progress Together. The ads raised ethi cal questions about Grayson’s work as a hedge-fund manager while he was in Congress and allegations that he had abused his ex-wife. Grayson submitted no evidence from which a jury might plausibly infer that the defendants distributed statements ‘with knowledge that (the statements) were false or with reckless disregard of whether (they were) false or not,’” the ruling, by Chief Judge William Pryor and Judges Barbara Lagoa and Andrew Brasher, said, partially quoting a U.S. Supreme Court precedent. “The defen dants’ mailings and online postings cite source materials, including an official congressional report, articles in wellknown newspapers and magazines, and police reports.” Grayson ran again for Congress this year but lost in an Aug. 23 Democratic primary.
