Integration of the Profession of Landscape Architects into the Regime of Automatic Recognition under the Professional Qualifications Directive (2005/36/EC, PQD). Activity Report on behalf of the European Federation for Landscape Architecture (EFLA) April 2010 • Information gathering regarding evaluation and modification of PQD. and Strategy development to integrate the profession of Landscape Architects (incl. Report and information for delegates and presidents at EFLA General Assembly in Brussels by Fritz Auweck • Through the European Federation for Landscape Architecture (EFLA) and in cooperation with the Federal Chamber of German Architects (BAK), the Landscape Architects have analysed the possibility of integration of the profession into the regime of automatic recognition under the Professional Qualifications Directive (Directive 2005/36/EC, PQD). This study details specific educational standards (curriculum and duration of training), on the existence of the profession in the 27 EU Member States (and beyond) as well as on existing barriers for professional mobility in both cases of temporary provision of services and establishment in other Member States. The results of the study prove that the profession is facing serious problems in market access when working abroad. These problems are essentially based on alleged nonexistence of the professions in the host Member State, on deliberate delays of administrative procedures, on alleged obligations to cooperate with professionals already established in the host Member State and finally on discrimination due to the nationality of the incoming professional. 3.Report regarding actual development to EFLA members by Fritz Auweck

September 2011 • Meeting of EFLA president Nigel Thorne, ECIA president Joke van Hengstum, ECTP Vice president, Dominique Lancernon, Prof. Niebergall BAK Germany, Dr. Jobi office de liaison Brussels with Mr. Tiedje and handing of Position Paper and the arguments for the suggested extension of the automatic recognition regime of PQD • EFLA position paper to Green Paper “Modernising the Professional Qualifications Directive (COM (2011) 367 final). EFLA suggested in the course of the evaluation of the PQD a more flexible model for recognition of the professional qualifications, granting at the same time full market access. The European Commission considered the findings of the mentioned study and finally included flexible models of recognition via Common Training Frameworks (Art. 49a) and Common Training Tests (Art. 49b) of the Proposal COM (2011) 883 final. • 4.Report regarding actual development to EFLA members by Fritz Auweck November 2011 • Public conference on the modernisation of PQD in Brussels, observed by Dr. Jobi • 5.Report and Information for delegates and Presidents at EFLA GA in Tallinn by Fritz Auweck, announcement of necessary lobby work in 2012 • Minimum standards of LA education, comparable with Art.11 PQD architects voted by EFLA GA • 6.Report regarding actual development to EFLA members by Fritz Auweck December 2011 • EU commission publishes proposal for a Directive of the European parliament and the council amending PQD is published – Art.49a and Art.49b offer a good possibility for Landscape Architects to reach automatic recognition. Both models provide for an enhanced recognition of professional qualifications as well as market access under the following preconditions (Art. 49a and 49b): 1. Profession regulated in at least nine EU Member States 2. Common training framework and Common training test include educational standards of at least nine EU Member States 3. Both models are open to membership of further EU Member States and were established on a non-discriminatory basis While both models are welcomed by the profession, the reference to the assessment of Educational Standards via the European Qualification Framework (EQF) under Art. 49a remains incoherent and should be replaced by recurring to the system of Art. 11 PQD. This system based on five qualification levels is already part of the PQD and has proven to be reliable means for the mentioned assessment of qualifications in practice.

EFLAs Suggestion: Replace the reference to the EQF in Art. 49a by the reference to Art. 11 PQD. Arguments: No need for a new assessment system under the PQD, as system of Art. 11 has proven to be reliable and accepted by competent authorities. System of EQF does not allow for a coherent assessment of qualifications, as its transposition into National Qualification Frameworks in the 27 EU Member States differs considerably and is not yet accomplished in all EU Member States.
