WHO DOES WHAT? Funeral – Your focus in the early days will probably be on the funeral. You will be helped through that process by many different people. The Estate – After somebody has died, their money and assets are known as their estate. An executor will deal with the estate if the deceased left a Will. If a Will has not been set in place, then Letters of Administration need to be taken out. We can help you with this Inquest – The coroner may hold an inquest. The purpose of an inquest is to establish who died, when, where and how they died. We can represent you at the inquest and help you through the process. Criminal Prosecution – The police or the Health & Safety Executive are likely to be heavily involved after a fatal accident.

If the evidence they gather supports a prosecution, a case will be brought to court. We can explain this process for you. We will obtain the police and HSE file as soon as the case is closed. Interim Payments – Whoever was responsible for the death will probably be insured. We will deal with their insurance company to try and persuade them to release funds to help you get by in the early days, particularly if there has been loss of earnings or if you need to pay for child care for example.

WHO CAN CLAIM? A claim can be brought by anybody who is legally entitled to represent the deceased's estate. If there is a Will this will be an executor. If there is no Will, a claim can be brought by an immediate family member, such as the widow or widower, a child

Any person who was living with the deceased in the same household immediately before the accident, for at least 2 years;

A parent of the deceased or anyone treated by the deceased as a parent;

Any biological child of the deceased or anyone treated by the deceased as a child of the family eg. a step-child;

Any person who is or is the child of, a brother, sister, uncle or aunt of the deceased.
