NAME AND OBJECTS 1.1 NAME OF ASSOCIATION The name of the Association shall be ‘THE BAROSSA, LIGHT AND GAWLER FOOTBALL ASSOCIATION INCORPORATED’. 1.2 OBJECTS (a) To conduct an Association to arrange and promote games of Australian Rules Football. (b) To adhere to the laws of football as set down by the Australian Football League, South Australian National Football League and the South Australian Country and Metropolitan Affiliated Leagues Council. (c) Such other objects as may be determined but at all times to have in mind the best interests of the game. 1.3 INTERPRETATION In this constitution, unless there is something in the context inconsistent therewith, the following interpretation shall apply – (a) Association means the Barossa, Light and Gawler Football Association Inc. (b) Association/League means any other Association or League, including non-affiliated bodies, other than the South Australian National Football League. (c) Colts means Modifieds, Little League, Junior Colts, Senior Colts. (d) Seniors means both A-Grade and Reserves. (e) Association Commissioners comprise the Association Tribunal. (f) Clubs means Clubs playing in this Association. (g) Manager means the Football Operations Manager. (h) Voting on all decision making matters, at any meeting, shall be one vote per Club. (i) Official includes Directors, Football Operations Manager and other Club persons as detailed in the BLG Operations Handbook. SECTION 2. MEMBERSHIP 2.1 CLUBS The Association is made up of the following Clubs – ANGASTON, BAROSSA DISTRICT, FREELING, GAWLER CENTRAL, KAPUNDA, NURIOOTPA ROVER, SOUTH GAWLER, TANUNDA, WILLASTON 2.2 SUBSCRIPTION AND REGISTRATION FEES (a) Each Club shall subscribe to an annual fee to be fixed at the Annual General Meeting and paid by 30th June in each year. (b) Clubs shall register their respective players in all grades with the Association. The registration fee to be fixed at the Annual General Meeting each year and to be paid by the 30th June of each year. 2.3 CLUBS WITHDRAWING FROM ASSOCIATION. (a) A Club desiring to leave the Association and transfer to another Affiliated League shall lodge a written application with the Manager who shall forward it immediately to the Affiliated Leagues Investigation Committee. 47


(b) Any application to transfer must be in writing to the Manager by 30th September in any year and the Manager to advise Directors and all Clubs of the application. (c) A Club requesting a transfer must satisfy the Directors that it is not obligated in any way to the Association. 2.4 ADDITIONAL CLUBS Additional Clubs may be admitted into the Association under the following conditions – (a) All applications for admission into the Association must be in the hands of the Directors not later than 90 days prior to the Annual General Meeting for consideration. (b) Such applications must be approved by the Affiliated Leagues Investigation Committee. (c) Each Club then accepted by a clear majority of existing Clubs shall pay to the Association an entrance fee to be fixed by the existing Clubs and Directors. 2.5 CLUB COLOURS (a) Each Club shall register its colours with the Association, priority of registration to determine exclusive rights to wear such colours. Only registered colours shall be worn by the respective players in Association matches. In the event of clash of colours or change of colours or design, approval must be sought from the Directors and their decision will be binding. 2.6 LIFE MEMBERS (a) The Directors may create a life member of the Association in recognition of services rendered but shall not create more than three (3) Life Members in any one year. (b) A Club can recommend to the Directors a person for consideration for Life Membership in recognition of service to the Association. Such recommendation to be submitted to the Directors by 31st August in any year. 2.7 PATRONS (a) Patrons of the Association shall be appointed at the Annual General Meeting each year with a maximum of five (5). SECTION 3. MANAGEMENT OF ASSOCIATION 3.1 DIRECTORS (a) The Directors shall consist of PRESIDENT, VICE PRESIDENT, and three other DIRECTORS elected at the Annual General Meeting. Those elected shall hold office for a term of two (2) years – the President and two (2) Directors being elected in ‘odd’ years and the Vice President and one (1) Director being elected in ‘even’ years. The positions shall be advertised at least thirty (30) days prior to the Annual General Meeting with applications closing 14 days before the said meeting. A Director shall not hold an official position with any Club. (b) The Directors have power to develop policy, administer, and control the affairs of the Association which must be endorsed by the Committee of Management (c) Directors decisions can be confirmed or rescinded at a meeting of the Committee of Management. (d) The Directors shall have power to make decisions and advise the Clubs in writing in the event of any doubt or difficulty in interpreting the rules contained in this constitution / by-laws or any matter, which may bring the game into disrepute. Such decision shall be final and binding on Clubs subject to a right of appeal to the Committee of Management. At all times the Directors must be impartial and have the best interests of football and the Association in mind. (e) A retiring Director may stand for re-election without the requirement of re-applying. (f) In the absence of a member of the Board of Directors, the Board may temporarily appoint a person as a Proxy Director. 3.2 COMMITTEE OF MANAGEMENT (a) The Committee of Management shall comprise two (2) delegates from each Club. (b) The Committee of Management has the ultimate responsibility of the Association and can override any decisions made by the Directors (c) Voting at meetings shall be on a club basis with each Club entitled to one vote only. The Chairperson of the meeting shall have a casting vote only. (d) Meetings of the Committee of Management can be attended by all Directors, a representative of the Barossa, Light and Gawler Umpires Association, a representative of the Junior Development Committee and any other person invited at the discretion of the Chairperson. They can participate in discussion under 48


the Chairperson’s guidelines but are ineligible to vote. 3.3 FOOTBALL OPERATIONS MANAGER (a) A Manager shall be appointed by the Directors according to the contract and/or conditions as required by the Association. The Manager shall not be a voting member of any meeting of the Association and shall not hold an official position with any Club. (b) The Manager shall be appointed for a two (2) year term alternate to the tenure of the Association President. (c) The duties of the Manager shall be contained in a job description, which will be drawn up by the Directors and circulated to all Clubs. (d) The Manager shall be the Public Officer of the Association. 3.4 COMMISSIONERS (a) At least six Association Commissioners each of whom shall not be registered officials of any Club shall be appointed at the Annual General Meeting, one of whom will be appointed Chairman by the Commissioners. Three at any one time shall constitute the Association Tribunal. (b) The Commissioners shall have power to enquire into, hear and determine any charge made against player or match official, which is subject of a report of a breach of the Laws of the game and Laws of the Association. The decision by the Commissioners shall be final. ( c) The general procedures implemented by the Commissioners at any hearing are included in the BLG Operations Handbook and can be revised at any time upon recommendations from the Commissioners. 3.5 PERMIT TRIBUNAL (a) The Permit Tribunal shall consist of a quorum of three (3) Directors who have the right to use discretion in the application of the rule relating to clearances. (b) Decisions of the Permit Tribunal shall be final and binding on all parties. 3.6 JUNIOR DEVELOPMENT OFFICER. (a) A Junior Development Officer shall be appointed by the Directors according to contract and/or conditions as required by the Association. 3.7 UMPIRES COACH (a) An Umpires Coach shall be appointed by the Directors according to contract and/or conditions as required by the Association. 3.8 AUDITOR (a) The Auditor shall be appointed at the Annual General Meeting. (b) The Auditor shall have power at all times to examine the books and documents of the Association and shall complete an audit of the financial statements prior to their submission to the Annual General Meeting. 3.9 MEETINGS (a) ANNUAL GENERAL MEETING The Annual General Meeting of the Association shall be held no later than the 15th day of December in each year at which meeting the following business will be transacted: • Presentation of Annual Reports An Audited Balance Sheet. A Home & Away Match Program • Election of Directors • Appointment of Auditor Patrons Commissioners • Any other business as listed on the agenda. (b) GENERAL MEETINGS The Association shall hold a minimum of four (4) General Meetings between the Annual General Meeting at such time and places, as the Association shall from time to time determine. (c) SPECIAL MEETINGS • The President and Vice-President may call a Special Meeting of the Association at any time of the year. 49


• Upon request in writing signed by not less than five (5) Clubs the President shall convene a Special Meeting provided such request provides the nature of the business to be brought forward at such meeting. • Such meeting shall transact only the business set forth in the requisition calling the meeting. (d) QUORUM At any general meeting of the Association a majority of members of the Committee of Management shall form a quorum. One Director of the Association must be present to chair the meeting. If a quorum is not present within half an hour of the appointed time of holding such meeting, the meeting shall lapse (e) NOTICE OF MEETINGS Fourteen days notice of any meeting shall be given to the Directors and Secretaries of the Clubs, such notice shall specify the place, date and time of the meeting. (f) CHAIRPERSON In the absence of the President or Vice-President at any meeting, a Chairperson shall be selected from one of the Directors. (g) VOTING Voting at any meeting shall be by simple majority except for matters pertaining to Constitutional changes. Voting to be by show of hands unless a ballot is demanded by at least three (3) Clubs. The President or any other person presiding at the meeting shall have a casting vote only. (h) ADJOURNMENTS Any meeting of the Association may be adjourned to such time and place as shall be determined by the majority present at the original meeting, or at any adjournment thereof. (i) RESCINDING RESOLUTIONS A motion to rescind or vary a resolution which has been carried by the Association may be carried, but subject to the following conditions – • If the motion, which is sought to rescind or vary, has been passed in the current year, such motion to rescind or vary shall not be carried unless at least six ninths of the Committee of Management votes in the affirmative. • If the motion, which is sought to rescind or vary, has been passed or adopted in any previous year, such motion may be carried by a bare majority of the Committee of Management at any meeting. At an Annual General Meeting of the Association any resolution previously passed may be rescinded or varied by a bare majority of the Committee of Management. 3.10 FINANCIAL (a) An account in the name of the Association shall be kept at a Bank or Financial Institution to be operated as decided by the Association. (b) All income derived by the Association shall be the property of the Association and shall be applied as directed by the Committee of Management. (c) Any deficiency in Association funds shall be made good by the Clubs. 3.11 SUB COMMITTEES (a) The Association may by resolution of any meeting, delegate any of its powers to Sub-Committees, consisting of one (1) or more persons as it shall think fit to appoint, and may recall or revoke any such delegation or appointment. SECTION 4 MATCH PROGRAMME AND CONDITIONS 4.1 MATCH PROGRAMME (a) A programme of minor round matches and dates set for major round matches shall be endorsed at the Annual General Meeting. Minor round matches shall be played on the grounds of the first named club. In case of emergency a change of oval to be decided by the Directors. Match times to be reviewed from time to time and included in the BLG Operations Handbook. (b) If the scores shall be tied at the conclusion of full time in any major round match in any grade, the tiebreaker provisions as hereinafter provided shall apply. (c) Pursuant to Rule 4.1(b) above the tiebreaker will proceed as follows: • At the conclusion of full time or any period of further play there shall be a three (3) minute break. • Teams shall change ends and play five (5) minutes (time on shall only apply in A-Grade games) followed by a three (3) minute break • Teams will change ends and play a further five (5) minutes and 50


• Should the scores still be tied at that time then the same format shall be repeated until a decisive result has been achieved. Details of the Tie Breaker provisions shall be set out in the BLG Operations Handbook. 4.2 MATCH CONDITIONS (a) Association shall conduct and arrange competition for the grades and the following age qualifications shall apply • A-Grade Open age • Reserves Open age • Senior Colts Under 17 at midnight on 30th June of previous year • Junior Colts Under 15 at midnight on 31st December of previous year • Little League Under 13 at midnight on 31st December of previous year • Modifieds Under 11 at midnight on 31st December of previous year • Mini Modifieds Under 9 at midnight on 31st December of previous year, with minimum age to play Under 9 to be 6 years of age as at 31st December of previous year (b) Every player playing for a team in the Association shall wear the Club’s registered uniform and shall wear a number clearly displayed on the back of the jumper. (c) In the event that the colours of shorts as registered by two Clubs taking part in the minor round are identical or of a similar basic colour, the home team shall wear the colours registered as first selection. (d) With major round matches the colour of shorts to be worn shall be determined by the position the teams occupied on the premiership table at the end of the minor round the team occupying the higher position shall have their choice of their registered coloured shorts. (e) The Committee of Management shall determine the number of players who will play in each Grade in all Association Club matches. 4.3 ASSOCIATION TEAMS AND SELECTION (a) There shall be an Association Team Selection Committee of four members one of whom shall be the Coach. (b) The selectors shall be selected annually by the Directors. (c) Standing orders to apply for the time being, relating to Association teams and selection will be included in the BLG Operations Handbook. (d) The non-playing selectors each year shall set the conditions for the Association Inter League matches. Any player or Club found guilty of neglect of duty in respect to these conditions and their responsibilities shall be dealt with as the Commissioners see fit. 4.4 GROUNDS FOR MAJOR ROUND MATCHES All major round matches to be on a nine year rotation basis, this is to include the Grand Final. This is subject at all times to the standard of the club’s ground and facilities and any other conditions that the Directors deem to be relevant. The programmed club will host the final on a ground that the Directors and the host club are happy with. 4.5 FORFEITURE OF MATCHES (a) A Club forfeiting a match for any other reason shall notify the Manager of its reason for forfeiting, and the Association may accept the explanation, or deal with the Club, as it may think fit. (b) In the event of a club forfeiting a match, the match shall be awarded to the opposing team. The club forfeiting the match shall be debited with 60 points “against” on the premiership table. The club receiving the forfeit shall be credited with two premiership points and 60 points “for” on the premiership table. (c) In the case of a Club forfeiting a match the Directors have the power to place a fine on the Club taking into consideration the circumstances involved and the amount of notice given as to the reason for the forfeit. In addition to the fine the Club may be required to pay the subscribed Umpire’s fee. SECTION 5 UMPIRES 5.1 UMPIRES COMMITTEE (a) There shall be an Umpires Committee consisting of five (5) members one of whom shall be the Umpires Coach. The other four (4) members to be elected for a one-year term by the available registered umpires by March 1st each year. (b) The Umpires President (or proxy) shall act as a liaison between the Committee of Management and the Umpires. 51


(c) The Umpires Committee shall each year appoint an Umpires Selection Board who will be responsible for the appointment of • Field Umpires for all Grades for Minor Round and Major Round matches • Boundary Umpires for Senior games in the minor round • Boundary Umpires for all matches in the Major Round 5.2 UMPIRES REMUNERATION (a) Field Umpires and Senior Boundary Umpires remuneration shall be recommended by the Directors and approved by the Committee of Management and shall be payable by the home Club. Other Umpires fees shall be fixed by the Clubs concerned except in the Major Round when the Association will be responsible for all umpiring payments. 5.3 UMPIRES MATCH REPORT (a) The Field Umpire may furnish a match report, which must be received by the Manager not later than three (3) days after each match. A full copy of the report and any other information furnished must be available to the relevant Club or Clubs on request. 5.4 GOAL UMPIRES – MAJOR ROUND (a) Goal Umpires for major round matches to be selected by the Manager in consultation with the BLG Umpires Coach / Coaches. SECTION 6 REPORTS 6.1 REPORTS BY UMPIRES (a) In the event of an Umpire officiating in a match laying a charge alleging any infringement of the Laws of Australian Football by any player or match official named on the team sheet, the said charge must be laid in accordance with the Laws of Australian Football and the Association. With any report by an umpire the following procedure will apply: • A charge against a player or match official must be in writing clearly stated on the Official Umpires Report Form, and handed to the relevant Team Manager of both Clubs engaged in the match immediately following the completion of the game. • A charge against other than a player or match official must be in writing and clearly stated in the Umpire’s match report. • The procedure and timing as to the notification of any reports by Umpires to the Manager and Clubs involved to be set out in the BLG Operations Handbook. • The Manager to verbally inform the Club or Clubs involved as soon as possible together with details of the time and date for the charge to be heard. • An Umpire’s report of a player or any match official, as listed on the team sheet, shall be heard by the Commissioners. Any other reports by an Umpire shall be heard by the Directors. 6.2 REPORTS OTHER THAN BY UMPIRES (a) A charge, other than a charge made by an Umpire, alleging any infringement of the Association rules and laws of the game, or any action which brings the game into disrepute may be laid by a player, official of the Association or an official of an Affiliated Club against a Club, player, official of the Association or an official of an Affiliated Club. (b) The procedures and timing to be followed for any such reports shall be the same as in rule 6.1(a) – Reports by Umpires. SECTION 7 REGISTRATION AND QUALIFICATIONS 7.1 REGISTRATION OF PLAYERS AND OFFICIALS (a) Clubs shall register their respective players in all grades with the Manager by the 30th April of each year. The maximum number of senior registered players shall be 80. Players can be registered with the Manager after 30th April and added to the Clubs list of registered players up until June 30th. All additional registrations must be completed on the prescribed registration forms A detailed explanation of player registrations is included in the BLG Operations Handbook. (b) Registered Colt players must qualify under the age limits or school grades as set out in rule 4.2(a) 7.2 QUALIFICATION OF PLAYERS (a) No player shall be qualified to play in this Association unless he has been duly registered. (b) All players must provide their correct full-time address for the purpose of being registered as a player by the Association. 52


(c) No player shall be registered after 30th June in any year. This rule shall be binding except in special circumstances including the legitimate transfer in employment or business of the player concerned. In this instance application can be made in the form of a statutory declaration to the Permit Tribunal who may grant or refuse the permit. (d) No Club shall play a player who is unregistered or for any other reason is unqualified. The Manager shall scrutinize all team sheets and any Club breaking this rule shall forfeit the match and/or receive an appropriate fine but does have the right of appeal. This Clause does not over ride breaches of Import Rule 7.7 7.3 TEAM QUALIFICATIONS (a) In every match the list of players with their respective numbers must be exchanged by an official of each opposing Club and only players so listed shall be qualified to play, and shall for all purposes be deemed to have played in such match. (b) No player can be named on a team sheet unless he participates in the game as a player. If a player is named and does not participate the relevant Club may lose the points from the game and / or an appropriate fine. (c) No player can play for a League Club and an Affiliated Club in the same four (4) day period. (d) If a colt plays in both a Colt’s match and a senior game on the same day he shall be deemed to have played colts. (e) If a player plays in both A-Grade and Reserves on the one day he is deemed to have played A-Grade. (f) No player can play in both A-Grade and Reserves on the same weekend during major round matches. (g) Subject to sub-Rules 7.3(i) and 7.3(j) of this Rule for a player to be eligible to play in a particular grade in major round matches that player must have played in at least three (3) minor round games, each played on separate days, either in that or a lower grade but not in a higher grade for which eligibility is sought. (h) A senior player who plays in more than four (4) minor round A-Grade games during the last nine (9) minor round games of the season shall not be permitted to play in Reserves major round matches except in the circumstances as outlined in rule 7.3 (i) (i) If both the A-Grade and Reserves are playing in the major round the following will apply: • If both teams are playing on the same weekend the reserve qualification in rule 7.3 (h) will not apply and a senior player can play in either A-Grade or Reserves. (j) In extraordinary circumstances, contrary to 7.3 (g) (h) and (i) above, a Club can apply to the Permit Tribunal for a player or players to play in the Major Round without the necessary qualifications. 7.4 DISQUALIFIED PLAYERS (a) No Club shall play a player who is under disqualification by any Australian Football Authority. Any Club knowingly playing a disqualified player shall forfeit the match in which it plays such a player. (b) No player, match official, official of the Association or official of an Affiliated Club while under disqualification shall be allowed inside the oval rail where football is played by any Club on that day. This shall apply whether the game is in progress or not. A disqualified Coach may appeal to the Commissioners for permission to enter the oval area for purpose of coaching his team. (c) A player of any grade who has been found guilty and suspended of an offence during the minor round shall not be eligible for the Association best and fairest award of the same year. (d) A player of any grade who has been found guilty and suspended of an offence during the major round shall not be eligible for the Association best and fairest award in the following year. (e) Any club in breach of non payment by the due date of any fee or fine imposed by the Tribunal, shall incur a further penalty of an amount no greater than the original fine/fee. 7.5 CLEARANCES (a) No player shall be permitted to play in this Association until he has obtained a Clearance from the Club and the Association / League in which he last played, on an Affiliated Leagues Form. (b) A player wishing to be cleared to another Club within the Association can only be cleared under the following circumstances • Appointed as A-Grade coach • By mutual agreement of both Clubs • By showing just cause and appeal to the Permit Tribunal in accordance with guidelines in the BLG Operations Handbook, whose decision will be final. 53


• All clearances must be lodged by June 30th each year except where a permit has been granted in accordance with rule 7.2 (c). (c) No player registered for a Club in this Association shall, in the same season qualify for a Club in another Association/League other than a South Australian National Football League Club without first being cleared by his Club and the Association. (d) A player in this Association can play with a Club in a mid-week Association and shall not be required to obtain the relevant clearance. (e) Clearance for a returning player – • A Player who is cleared from this Association to another Association \ League can only return to the Club from where he was cleared in this Association. (Note to be included in BLG Operations Handbook stating the details to be adopted for the operation of this rule.) • In the case of a player currently playing or having played with a SANFL or AFL Club he must return to the Club with which he was last registered within this Association. If that player is subsequently cleared from this Association to another Association / League he can only return to the Club from where he was cleared in this Association. 7.6 APPEALS (a) CLEARANCES: Any Club or Player making an appeal relating to a clearance from another Club within the Association, the following shall apply: • The appeal must be in writing • It must be forwarded to the Manager together with a copy to the other Club involved. • The Manager to provide the Permit Tribunal with full details of the appeal. • The Permit Tribunal to meet within two (2) weeks of receiving the appeal. (b) APPEALS OTHER THAN CLEARANCES: With appeals other than relating to clearances the procedure in 3.1(d) will apply. (c) APPEAL BOND: A bond of $100 must be lodged by any Club making an appeal. The Directors have power to determine if the appeal is frivolous or inconsistent with the rules in the BLG Operations Handbook and if so the Club could lose the bond and or a fine imposed. Should the appeal be upheld the bond would be returned. 7.7 PLAYER EQUALISATION SCHEME a) The BLGFA shall adopt the APPROVED PLAYER POINTS SYSTEM (APPS) under Regulation 32 of the SACFL Regulations as its Player Equalisation Scheme. (b) The APPS will relate to the A-Grade competition. (c) TOTAL POINTS RATING FOR CLUBS (1) Each club will be allocated a Total Points Rating based on the average number of A Grade games a club has won at the end of the minor round over the preceding two seasons. (2) The process of allocating these points to each club shall be based on a formula that shall be determined by the Committee of Management and shall be incorporated in the Operations Handbook. Any ongoing amendments to the formula shall require a six ninths majority at a meeting of the Committee of Management. (3) A club wishing to vary its allocated Total Points Rating may forward a submission to the Directors any time between the end of the minor round of each season up to and including the 31st January of the following year. The Directors decision on the outcome of the submission shall be final. (4) In exceptional circumstances, the Directors shall have the discretionary power to vary a club’s Total Points Rating to that as determined by the formula. (5) Clubs must not field players in it’s A Grade team in any game which exceed the total points allocated to that club. Penalties to apply. GENERAL SECTION 8 8.1 SOLICITOR (a) The Directors shall have power to appoint a solicitor upon such terms and for such period as the Directors shall direct 8.2 WINDING UP AND DISSOLUTION 54


(a) In case it shall appear at any time advisable or necessary to dissolve the Association, a Special Meeting shall be called for that purpose. A motion to proceed with the dissolution must be passed by a seven-ninths majority of the Committee of Management. The affairs of the Association to be wound up in such manner as the meeting shall direct. 8.3 ALTERATION OF RULES (a) No Rule in this constitution of the Association shall be made or altered or rescinded or added to except by resolution of the Association. (b) The change must be passed by a six-ninths majority at the Annual General Meeting or at a Special Meeting called for that purpose. (c) Fourteen (14) days’ notice of such meeting and the proposed changes must be given by the Manager to Club Secretaries. 8.4 INTERPRETATION OF RULES (a) In the event of any doubt or difficulty arising as to the meaning of any rule in this constitution or by-law in the BLG Operations Handbook, or any question arise as to their interpretation, the Directors shall have power to pronounce a decision and advise the Clubs in writing. The decision shall be final and binding, subject only to affirmation or reversal at a meeting of the Committee of Management. 8.5 BY LAWS (a) The Directors shall have power from time to time to make by-laws not inconsistent with these Rules for the efficient working of the Association. All by-laws to be revised prior to the start of each football season and confirmed by the Committee of Management before being included in the BLG Operations Handbook. 8.6 SECTION 25 OF ASSOCIATIONS INCORPORATION ACT The BLG Association shall have all the powers conferred by section 25 of the ACT. BYE LAW 2012 (Approved Delegates Meeting held 14/2/2012) On the conduct of a count indiscretion under Law 5.5.3., Laws 5.5.3 (a) and 5.5.3 (b) be invoked and the score at the time of the count be recorded. The game should then continue and the events surrounding the count be reviewed by the BL&G Tribunal at its normal time of meeting. If the Tribunal deems that the team with additional players on the playing surface had gained an advantage then Law 5.5.3. (c) should be enforced.
