PRESIDENT’S MESSAGE by Robert J. Thompson LET’S HAVE SOME FUN! Please join us for BCBA Night (Day) at the Yard on Sunday, August 21 at 1:35 p.m. when the Orioles host the Houston Astros!! We have 60 tickets available in the “Flight Deck” section at the stadium. Tickets are $50 each and include a $15 voucher that can be used for food & merchandise purchases at the game. This is a great opportunity to mix and mingle with your colleagues and to watch the first-place Orioles in their quest for a pennant! COURTHOUSE SECURITY. Most of us are in and out of the courthouse so often that we take its security and safety for granted. Up to now, we’d simply flash our ID cards, the Sheriff’s Deputy would check the expiration date and (usually with a smile and a “Good Morning, Counsel”), waive us in.... But those days are over. As of July 29, even those of us who possess a valid MSBA Courthouse

ID card will have to be screened and pass through a magnetometer as we enter the Circuit Courthouse here in Towson. I am not proud to tell you that upon hearing this news several weeks ago, my first thought was about my own inconvenience. But while I was thinking about it, trying to come to terms with it, I happened to read a blurb in the ABA Journal about two women who were killed outside an Arizona courthouse by a grandfather who was in the middle of a custody and visitation dispute with his grandchild’s mother and grandmother. Reading that story reminded me that while my own convenience may be a big deal to me, in the scheme of things, it’s not really all that important after all. Sometimes I think all of us are susceptible to losing perspective on the fact that our clients and

PRESIDENT’S MESSAGE Continued from page 1 their families may be going through the most difficult and trying times in their lives when we are accompanying them to the courthouse. Sometimes I think we might forget that people struggling through those desperate times in life may momentarily lose their judgment and decide to take matters or “justice” into their own hands by bringing a gun or a knife (or heaven knows what else) to the courthouse out of the mistaken belief that it will give them an advantage. And while most of us view the courthouse as a safe place and even a second home to some extent, it’s good to be reminded that because of the things that happen inside the courthouse every day, it can be a magnet for desperate people who may be tempted to do desperate and stupid things. So, while it may lengthen our days by requiring us to leave the office a few minutes earlier on court days; while it will doubtless be a source of aggravation and inconvenience for all of us at one time or another, let’s take a moment to think about our own safety, the safety of our clients, their families, and others involved in their cases. And last but not least, let’s think about the safety of our friends and loved ones who work inside the courthouse.

TOWN HALL MEETING The Circuit Court will hold Town Hall Meetings on civil, non-domestic cases on Monday, September 12, 2016 at 12:30 p.m. in Courtroom 15 (4 th Floor) and another date to be selected at 5 p.m. in Courtroom 12 (3rd Floor), County Courts Building, 401 Bosley Avenue, Towson, MD 21204. No registration/RSVP is required. The purpose of the meetings is to discuss and get input from attorneys who handle civil, non-domestic cases regarding anticipated changes in the Court’s Civil Differentiated Case Management Plan. The Town Hall Meetings are being offered at two different times, in order to provide attorneys the opportunity to attend when most convenient.

FAMILY DIVISION MEETING HIGHLIGHTS - JULY 2016 Clarification: Mutual Consent Divorce – Supplementing the discussion in the update sent on June 23, 2016, parties who seek a divorce on the ground of Mutual Consent do not need to plead that the parties live separate and apart; nor is any proof of separation required at the uncontested hearing. Note from the Mediation Office – The mediators have been mediating financial as well as child access issues in pro se cases. Upon request from the attorneys, they will mediate the financial issues in attorney-represented cases. The attorneys may attend the financial portion of the mediation. Please note that this service is not designed for complex financial matters. Expedited School Enrollment Policy Between July 5 and August 31, 2016, the Circuit Court for Baltimore County will have a Family Division Judge available to review contested school enrollment issues on an expedited basis. The school enrollment issue must be raised in an appropriate pleading or petition in order to be considered. The matter will be considered on an expedited basis only in cases where the Defendant (s) have been served and the case is already at issue. The party/attorney seeking expedited relief must provide reasonable notice to the opposing side that the party/attorney will be filing a Petition for Expedited Hearing regarding the school enrollment issue. The original of the Petition must be filed with the Clerk’s Office. The party/attorney will be advised which Family Law Judge is handling School enrollment issues that day. It is incumbent on the party/attorney to contact the assigned Family Law Judge’s Chambers for further direction on handling the request. In order to assist the Judge reviewing the Petition, it is recommended that the Petition include the following information: (1) Whether there is an existing Order covering custody and schooling, and the provisions of that order; (2) The child’s enrollment history, and the proposed change; and (3) The basis for the request for expedited hearing on the issue. The assigned Judge will first determine whether expedited review is warranted. If the request for expedited review is denied, the matter will be scheduled for hearing under the regular protocol. If the assigned Judge determines that expedited review is warranted, the Judge may first attempt to resolve the dispute through consultation with counsel or referral to the Office of Family Mediation. If an expedited hearing is ordered, it will be scheduled within ten (10) days before a Family Law Judge.

BAR FOUNDATION REPORT JUDICIAL PORTRAITS by John B. Gontrum

Your help is still needed in assisting the Foundation in funding the portraits of several deceased Circuit Court Judges. The Baltimore County Bar Foundation exists as an independent charitable organization with missions to foster and maintain the honor and integrity of the profession of the law; to improve and to facilitate the administration of justice; to enhance and improve the image of lawyers; and to promote the study of the law and research therein, and the diffusion of knowledge thereof.

A few years ago a request was made to the Foundation to act to provide for those wishing to donate funds in order to honor deceased members of the Circuit Court Judiciary by having their portraits made and placed in the court house. The Foundation board believed that this was an appropriate task under its charter. To date, funds have been donated in varying amounts for portraits of Judges Jenifer, Brannan, Hinkle and Jacobson. Judge Buchanan’s portrait was fully funded by his family. Other portraits have been funded privately. Unfortunately, although each portrait costs a very reasonable $4,100, the funding has not gone as hoped, possibly because the pool of attorneys familiar with the deceased jurists has grown smaller with the passing of time. Judges Jenifer and Brannan, for example, both passed away decades ago. Consequently, the Foundation is in need of funds in order to cover the cost of completion of the portraits. A gift of any size would be appreciated, and would be tax deductible. At this point the Foundation owes $16,400 for the portraits commissioned, and less than a third of that has been received. We believe that the traditions initiated in Courtroom Five are important in establishing the continuity of the bar and the role of these individuals in the history of the county. We appreciate any consideration you might give to this appeal.

IMPROVEMENTS TO THE 2015 BALTIMORE COUNTY CODE The 2015 Baltimore County Code was just published by the Municipal Code Corporation and replaces the 2003 Code produced by the American Legal Publishing Corporation. Three improvements have been made and they are the following: Section numbers appear on the top corner of every page. There is a preface starting on page ix that is designed to help readers understand how to read the code. The binders of the two volume set are dark blue and now have the year of the code stamped on both the spines and the front covers. The Law Library also holds previous versions of the Code extending back to the beginning of Home Rule and beyond.
