BDAV Member projects have scooped the pool in the 2018 National Building Design awards, with 13 winners and commendations featured from Victoria. This includes the coveted National Building Design of the Year 2018, which was won by Melbourne Design Studios for their ‘No Two The Same’ apartment project in Richmond. The project also received the BDAV’s 2018 Building Design of the Year 2018, which is a great achievement for MDS. Seven BDAWA member projects and three BDAQ member projects were also recognised in the NABD Awards. ‘No Two The Same’, which was the subject of our cover story in the August 2018 edition of Intersect, is a contemporary, highlycrafted design that reflects the craftsmanship associated with the area’s industrial past, sitting comfortably within the surrounding urban fabric. It is a minimalist, but warm and welcoming house design; both the natural and urban environments blend seamlessly together.

The project consists of six bespoke, luxurious, highly contextual, urban residences that pay homage to their historic inner-city location in a sustainable and contemporary manner. The individual residences that make up the development all have unique architectural and interior qualities while maintaining a congruency of a well planned village. High-level ESD principles and design for longevity were key drivers of the project. With its sustainable design approach, the
project successfully delivers an abundance of natural light and ventilation, as well as a strong connection with nature via a central courtyard and north-facing gardens. Other sustainability features include natural, recycled and sustainable materials, rainwater harvesting, solar water heating, efficient heating systems, and water saving fixtures. The use of recycled bricks brings a direct sense of the heritage locality deep into the heart of the dwelling, while the handcrafted façade operable shutters create interest. Continued page 9.....

The clever design and detailing, connection to the landscape and surrounds, and the blurring of the boundaries between public and private spaces create a tranquil oasis in the heart of the bustling inner suburbs. The omission of a front fence and semi-permeable façades blur the boundaries and allow for more social interaction within the community. The planning response, the design of the layout, the interior design, the design execution, the thoughtful and respectful use of materials, this really is the end result of all these design elements coming together. Further, in a project that fully challenged the resolve of the building designer, Melbourne Design Studios have exceeded expectations. This project also won awards for Best Multi-Residential Design up to 6 Dwellings and Best Residential Interior Design in the NABD’s 2018 Awards, adding to the accolades already achieved by this outstanding project. SPICE Spice (pictured below), in Oaks Beach, QLD (north-east of Bundaberg), a bespoke holiday home designed by BDAQ member, balay Vandyke, won Best Use of Timber in this year’s NABD Awards. It had previously won the BDAQ Residential Project of the Year 2018. The judges observed that Spice is an expression of functional luxury, spiced up in abundance with earthy elements like timber and natural stone - a biophilic delight! With an exquisite attention to detail and enveloped in natural light throughout, the home is a generous and thoughtful living space where serenity is just one look away from the sandy shores of Oak Beach. It is a house that pleases the eye and sparks the feeling of adventure to far off places, secluded from the rest of the world. CLAREMONT RESIDENCE The Claremont Residence in Claremont, WA (a suburb of Perth), by BDAWA member, Mata Design Studio, won Best Alteration/Addition Residential Design - over $800K construction cost in this year’s NABD Awards. It had previously won the BDAWA Design Excellence Award 2018. The judges described it as an extremely well-considered design response demonstrating restraint, confidence, with many creative solutions. The new and altered building form is respectful to the existing building conforming with the heritage listed requirements. The materials palette delicately dances around the 1910 building form, with design details complementing the classic façade with subtle materials, colours and textures. The materials, including black steel, oak timber floors, slate roof shingles, marble and floor mosaics, are all in keeping with the building’s traditional history. A stainless steel kitchen delivers a modern entertainer’s professional zone, which incorporates a unique skylight around the main exhaust canopy. Cool greys and subtle white trims allow the art and materials to stand on their own. A unique lighting design which incorporates LED lighting throughout, for the owner’s extensive art collection, utilises warm white internally, whilst the external lighting incorporates cool white which complements the moon light. The end result demonstrates excellence in the attention to every detail. Peter Lombo was recognised for 25 years’ membership at BDAV’s 2018 Annual Dinner in August. He was installed as the BDAV’s Treasurer at last month’s AGM. We thought it was timely to get to know a little more:
Q: What is/are your favourite project/s that you have worked on, and why? A: My family home - Shaftsbury Street, Coburg. Designing and building my own house on Shaftsbury Street, Coburg after then 15 years of design and development experience in my own style was my proudest and most fulfilling achievement. It featured many favourite design ideas and of course the exterior was face blockwork, many hand cut by myself and with only one brick layer, we only laid a few bricks a day. I believe that although the house was completed in 2003 it has successfully stood the test of time. Q: To date, my biggest business/design challenge has been?
Who else would build a government building below ground and allow you to walk all over them. Q: My favourite international building is? A: Dubai. It’s not one building but a cluster series of buildings which create the city. Many of my favourites exist within the cluster.
A: Succession planning. Q: My words of wisdom for a student building designer are? Having started my own design practice - Archsign - 25 years ago, it has seen its challenges come and go, but there was always a possibility of someone who has been with me now for 19 years to lead Archsign into the future. Q: My favourite finish is? A: Face brickwork, experimenting with any colours, textures, bonds and three-dimensional patterns. It’s a versatile material that lends itself to many styles even though it dates back to ancient times. Q: The architectural style of the home I grew up in?
A: Building design is a great platform for a career that can take you anywhere, whatever you do, do it well. Experience is gold; just be patient. Q: When I was a child I wanted to be? A: A furniture designer. I loved working with timber when I was in high school, but my father preferred I did not get my hands dirty. I now have manicured office hands.
A: Mediterranean.
Q: Outside of work, I am passionate about?
Growing up in a typical Italian family of five, our home was built in 1975 by my father, with Australian/Italian influences in the design. I am sure that one day the house will be heritage listed.
A: I have travelled to many countries around the world and my future goals are to attend ALL the BDAV study tours. Fusion cuisine is my style of cooking. When I retire I hope to have a food truck to pass the time.
Q: I joined the BDAV because? A: At the time that I joined 25 years ago I was a sole practitioner and had no-one to turn to for advice in the industry. The BDAV was a tremendous support and have been ever since. I can return the favour and be a mentor for others as a member of the BDAV committee. Q: My favourite Australian building is?
Q: At the moment I am reading? A: Great cities of the world. A coffee table book with more pictures than words. Melbourne is featured. Q: My life in four words? A: NEVER EVER GIVE UP.

Workplaces: Wellness + Wood = Productivity
“Until recently, we’ve really not had a whole lot of evidence to support that common hypothesis that having things like wooden surfaces in the office would be good for your wellbeing.”*
“What I found and got really excited about was that there’s a really strong association between the presence of wood and wellbeing. I’ve rarely seen a data set or a study which has shown such a clear link.”*
“If you’re a worker and you could see no wooden surfaces at all from your workplace, 53% of that type of worker was satisfied with what was going on in their workplace. When you move that up to having eight or more wooden surfaces - we’re talking things here like wooden chairs, wooden panelling on the walls, wooden floorboards, even quite small wooden items- but if you get to eight or more, then 82% of people were satisfied with their work.”*

A C O N C R E T E S O LU T I O N TO B U I L D I N G S I T E WA S T E BDAV Immediate Past President, Lindsay Douglas, believes that sustainable construction should be part of a project’s tender requirements, with the relevant contractors working together to develop a waste management plan.
The construction industry is one of the largest consumers of natural resources, with a third of all building and demolition waste going to landfill. The preservation of our environment is a responsibility many industries are taking on board, but individually we can also play a part in reducing our footprint. I’ve been involved in the building industry for many years and I’ve seen a lot of waste from old buildings being demolished and poor disposal of building materials. To address this serious environmental issue, it is critical to reduce waste on building sites. In addition to minimising landfill and reducing air and water pollution, the result is a more sustainable, efficient and safer building process. It may sound like an idealistic concept, but it’s much easier to reduce building site waste and implement a sustainable construction process than many people realise. My advice? Ask your builder to make sustainable construction part of the tender requirements and get your design team, builder and relevant contractors together to collectively develop a waste management plan. For an effective waste management plan, the following measures should be addressed: 1. Develop a plan for the building site Take the time to map out the building site. Consider how site disturbance can be minimised, how erosion can be reduced and how site sediments can be secured. If the site isn’t pre-planned and storm-water isn’t diverted away from the work area, run off from the building site can spread to adjacent properties and across the street, potentially contaminating waterways, silting up streams and blocking storm-water systems. A well-planned building site will include barriers to trap coarse sediment at all points where storm water leaves the site, as well as diversion channels and waterproof coverings to protect materials that may erode. 2. Reduce unnecessary waste It is important to review orders and measurements with a critical eye to reduce excess quantities of materials on site. Improving the accuracy of your orders reduces wasted natural resources and ensures a cheaper, more efficient build.

You can also reduce unnecessary waste by ensuring building materials are stored in a secure location with minimal exposure to weather conditions and construction activity. This is best achieved by identifying specific locations on the building site where vulnerable materials, such as sand and soil, can be protected and where hazardous items, such as paint chemicals, can be contained. 3. Reuse as many materials as you can Determine if a home needs to be completely demolished and rebuilt or if the existing property can be renovated. Renovating is the more sustainable option, as more materials can be re-used and it creates less energy emissions than building a house from scratch. Before purchasing new materials for a project, attempt to co-ordinate concurrent projects so that left over materials from one building site can be re-used on another. By keeping temporary materials in good condition, such as timber hoarding, barriers and rails, they can be dismantled and re-used on many projects. If you have salvaged items from your project that are still fit for purpose, you could return them to suppliers, or sell or donate them to industry contacts or community organisations who can put them to good use. 4. Recycle materials where possible From bricks and tiles to steel and glass, there are many building materials that can be recycled. It is important that architects and building designers guide material selection for the project, noting which materials can be recycled, determining how much waste certain materials are likely to produce and how this can be handled. Keep materials for recycling clean and dry and ensure each item is disposed of in separate waste bins with appropriate signage. All builders have a duty of care to ensure all waste produced on site is handled legally and safely. Local councils, regional waste authorities and waste recycling contractors can help determine how each waste bin can be recycled. While an efficient waste management plan takes time, preparation and commitment from everyone involved, the efforts and costs involved are recouped through reduced waste disposal costs, a more efficient construction process and the positive outcome of a safe, sustainable and efficient home.

Dominique Hunter was recently installed as BDAV President
Dominique Hunter was installed as BDAV President at the BDAV’s Annual General Meeting held last month. After a two-year term, former President Lindsay Douglas has passed the baton to Dominique to lead the Association as the 17th President. She will work closely with Vice-President Ingrid Hornung and Treasurer Peter Lombo to support our members and the wider design professional community. Dominique brings more than 20 years’ design expertise and industry knowledge to the role, and has served on the Committee of Management for 12 years, having held both the Treasurer and Vice-President positions. She said she is delighted to have been appointed to lead the Association and is looking forward to driving the BDAV’s longterm objectives. “I am passionate about creating efficient design solutions, great business management and the broader design industry. I am deeply honoured to lead the BDAV’s Committee of Management,” she said.
Dominique’s ambition is to help the Association shape a cohesive design industry, built on teamwork and collaboration amongst all design parties. She will drive the celebration of good building design through education, advocacy and communication. Driven by classic design, Dominique’s expertise lies in space planning and creating an optimal living space that maximises the surrounding environment with sustainable features. She is the founder and design director at Hunter and Richards and is a Victorian Registered Building Practitioner.

Bunjil Place wins Grand Prix in the 2018 Australian Timber Design Awards
Melbourne’s City of Casey’s spectacular new entertainment precinct, Bunjil Place, added the Grand Prix Award at last month’s Australian Timber Design Awards (ATDA) to its impressive list of achievements. Other winners on included Jackson Teece with the sustainability award, sponsored by Planet Ark, and Tasmania’s Inspiring Place which received the 2018 Dangerous Designs prize for their project Lily Pads. The recipient of international acclaim and extensive editorial coverage, Bunjil Place, was designed by Francis-Jones Morehen Thorp, structural civil and façade engineered by Taylor, Thomson Whiting and built by Multiplex with funding from the City of Casey and the Australian Government. An example of a new concept in community buildings, the 24,500sqm project is described by the architects as ‘An inclusive hybrid form of public building, reflecting and embracing our diversity.’ Describing the design process, the architects said they “began to conceive this project as an extended public ground place and a broad sheltering roof, below which we could gather the hybrid uses of the library, theatre, exhibition and also gathering itself. The architecture began to form around the idea of an organic meeting of many paths, literal pathways but also paths of life. This gathering takes place under the protective and sheltering wings of a great roof”.
“I would like to thank all the entrants for their great work,” said Eileen Newbury, National Program Manager for WoodSolutions and National Marketing and Communications Manager for Forest and Wood Products Australia, the industry services company that resources WoodSolutions, the Platinum sponsor of the event. “It was interesting to see an increase in the number of larger residential and commercial projects, which is a reflection of the growing use of timber building systems in these sectors. It is a trend we expect to continue as more people become aware of the many benefits of timber and more accustomed to designing and building with it,” Ms Newbury concluded. Now in their 19th year, the Awards promote and encourage outstanding timber design. They are open to builders, designers, architects, engineers and landscapers: to anyone involved in the design or building of structures that feature timber. A Rising Star Award is available to students and entrants aged 35 or under.

The result is a graceful confluence of forms, the sweeping curves of the roof embrace the spaces beneath, coming to a dramatic focus at the entrance where, depending on one’s point of view, two magnificent pillars, each a jigsaw of interlocking timber members, reach down from the roof to touch the ground or rise to meet the flowing arched structure above it. Aveo Norwest, a ten-storey residential apartment building made of cross laminated timber (CLT) and glulam, received the Planet Ark sponsored sustainability award. Built by Strongbuild, the use of timber is estimated to have reduced the project’s carbon emissions by 2,700 tonnes, compared to a traditional concrete and steel structure. Lily Pads, by Tasmanian firm Inspiring Place received the Dangerous Designs award. Set within the Royal Tasmanian Botanical Gardens, the Lily Pads comprises three circular, overlapping timber-decked platforms that cascade over three levels to reach the surface level of the pond, each platform diminishing in size as it nears the water.

The Victorian Building Authority has received a higher than expected number of company registration applications since 1 July 2018 and, as a result, has revised its original processing timeframes. Currently, timeframes for processing these applications are six to eight weeks. In response, the VBA is implementing a range of improvements to reduce application processing times to two to three weeks. The VBA expects these improvements will be in place within four weeks.

A C C E S S I B L E H O U S I N G O P T I O N S PA P E R The Australian Building Codes Board has released an Accessible Housing Options Paper for public consultation. The Options Paper provides a preliminary menu of options and costings on the possible inclusion of a minimum accessibility standard for housing in the NCC. The intention is to seek broader stakeholder input and refine the details of the objectives, options and terminology that will be considered in a formal Regulatory Impact Statement. Accessible housing is defined as any housing that includes features to enable use of people either with a disability or through their life stages. Currently, the NCC does not set out any accessibility requirements for Class 1a buildings (houses, townhouses, row houses, etc). Contrastingly, Class 2 buildings (apartment buildings) are required to provide accessible paths of travel to the door of each individual apartment on at least one floor. However, the NCC does not set out accessibility requirements to the internal parts of individual apartments within a Class 2 building.

The Accessible Housing Options Paper seeks community and industry input into possible options to expand minimum building standards for accessibility for single dwellings and multistorey residential apartments. Little bits that can make a big difference to your town planning outcomes
NEW COMMERCIAL 3 ZONE On 29 August 2018 the Victorian State Government approved Planning Scheme Amendment VC149 introducing the Commercial 3 Zone into the Victorian Planning Provisions. The new zone is part of the Victorian Government’s broader program of Unlocking Enterprise is a Changing Economy, seeking to consolidate ‘Enterprise Precincts’ throughout Melbourne. Enterprise Precincts are local areas to champion new enterprise, diversity of employment, and product and process development in dense, accessible and amenity-rich precincts. The focus of the precincts is also to promote innovative and enterprising mixed-use precincts, with niche and creative industries, start-up businesses and businesses leveraging off automation, post industrialisation and the digital economy. The new zone seeks to implement the State Government’s Planning Strategy Plan Melbourne Implementation Plan Action 8, to unlock enterprise in a changing economy. The purpose of the Commercial 3 Zone includes: – To provide for a range of industrial, commercial, office and other employment generating uses which support the mixed-use employment function of the area. – To promote collaborative and high-quality working environments which support the area through good urban design and high-amenity, accessible and well-connected places. – To provide opportunities for limited retail uses which are complementary to the role and scale of the area. – To provide the option for limited residential uses that do not undermine the primary employment and economic development focus of the zone.
Under the table of uses in the zone provisions, many Commercial and Industrial uses are Section 1 uses (no permit required), including: •
Food and drinks premises up to 150sqm leasable floor area;
•
Industry (limited to certain uses and buffer distances);
•
Manufacturing sales;
• Office; •
Research centres.
Dwellings and residential buildings are Section 2 (permit required) uses, conditional upon not exceeding 35% of the gross floor area of all buildings on site, or a variation if specified in the schedule to the zone. The residential component of any proposal will need to be assessed against the provisions of Clause 54, 55 and 58 (ResCode) depending on the form of that residential component. With some exceptions, shops up to 200sqm and warehouses up to 500sqm leasable floor area are also Section 2 uses. Buildings and works applications that are located more than 30 metres away from certain sensitive uses are exempt from notice and 3rd party review rights (application advertising and objector appeals). The new zone essentially provides for a mix of uses with a primary focus on non-residential uses, the complementary but limited role of shops and other associated retail uses, food and drink premises, and places of assembly. However, residential uses too are permitted providing such uses do not undermine the primary employment and economic development focus of the zone. It is now for local councils to start the process of identifying the location and scope of Enterprise Precincts, either in existing or planned urban areas, and to

These areas will likely be traditionally industrial manufacturing areas which have lost their historic industrial tenants, and are now suitable for smaller enterprises. Background documents to the Planning Scheme Amendment have identified a number of such areas in inner and middle metropolitan Melbourne, which have the potential to be affordable locations for a wide range of commercial and cultural activities, ranging from small scale manufacturing through to co-work office spaces, health and fitness facilities, creative industries and cultural facilities. This latest amendment bolsters the extent to which solar panels are protected under the Victorian Planning Provisions by inserting new requirements into Clause 32.04 (Mixed Use Zone), Clause 32.05 (Township Zone), Clause 32.07 (Residential Growth Zone), Clause 32.08 (General Residential Zone), Clause 32.09 (Neighbourhood Residential Zone), Clause 34.01 (Commercial 1 Zone), and Clauses

54 and 55 for assessing the impact of new development on existing residential rooftop solar energy facilities. Of particular interest to permit applicants is the fact that the abovementioned zones now require the decision maker to consider: The impact of overshadowing on existing rooftop solar energy facilities on dwellings on adjoining lots in a General Residential Zone, Mixed Use Zone, Neighbourhood Residential Zone, Residential Growth Zone or Township Zone. To assist decision makers in assessing the impact of overshadowing on existing rooftop solar energy facilities the following provisions have been updated: •

In addition, the decision guidelines associated with Standards A7, B10 and B35 have been altered and now require the decisionmaker to consider: – The extent to which an existing rooftop solar energy facility on an adjoining lot is overshadowed by existing buildings or other permanent structures. – Whether the existing rooftop solar energy facility on an adjoining lot is appropriately located. – The effect of overshadowing on an existing rooftop solar energy facility on an adjoining lot. The above changes are a significant shot-in-the-arm for the protection of existing solar panel facilities within residential areas. However, any impact from overshadowing will still need to be balanced against any strategic support for higher density development on the affected land.

R E D D O T S : C H A N G E S P R I O R T O V C AT, C H M P S , GARDEN AREAS, ZONING Over the past few months there have been a number of Red Dot decisions relating to changes to planning provisions that occur prior to a VCAT hearing, which will be of interest to readers. Red Dot decisions are decisions of the Victorian Civil and Administrative Tribunal (VCAT) which are of note because of perceived interest or significance, or their unusual or controversial nature.
Aquadonis Pty Ltd v Kingston CC [2018] VCAT 1407 involved a planning permit application for a mixed use development which included three or more dwellings. The permit applicant had lodged an appeal under Section 79 of the Planning and Environment Act 1987, against Council’s failure to make a decision within the prescribed time. At the time of the hearing, a Cultural Heritage Management Plan had not been provided, and it was queried whether the Tribunal had the jurisdiction to hear the matter, given Council could not make a decision on the application until a CHMP had been provided. This decision referred to an earlier VCAT decision Stanley Pastoral Pty Ltd v Indigo SC which found that because a CHMP had not been provided for the proposal (where it was required) the Council processing clock had not begun to run and therefore VCAT did not have the jurisdiction to consider the matter. In Aquadonis Pty Ltd, circumstances were considered to be different from those in Stanley Pastoral Pty Ltd because at the time the permit application was lodged and when the appeal was lodged, the subject site was not within an area of cultural heritage significance and did not require a CHMP. Between lodging the appeal and the hearing date, the 2007 Aboriginal Heritage Regulations were revoked and the Aboriginal Heritage Regulations 2018 commenced. The maps outlining the relevant areas of cultural heritage significance had expanded to include the subject site. Because the appeal was lodged prior to the requirement for a CHMP, the Tribunal found it still had jurisdiction to consider the matter, and that the requirement for a CHMP introduced on 23 May 2018 did not have the effect of removing jurisdiction (ie retrospectively having the effect that Council’s 60 day timeframe had not begun to run). The takeaway message here is to check CHMP requirements prior to lodging an appeal, in case your subject site requires a CHMP where it may not have when you lodged the original planning permit application to Council.

2426 Grenville Pty Ltd v Bayside CC [2018] VCAT 1338 involved an application to develop an apartment building and a discussion relating to the mandatory garden area requirement. The proposal included a habitable floor level below the existing ground level, with bedrooms serviced by sunken or tiered courtyard gardens. The Garden Area requirements are mandatory provisions for the Neighbourhood Residential Zone and General Residential Zone, introduced in March 2017, amended and clarified by definition in 2018. In Grenville Pty Ltd, Clause 32.08-4 in the scheme at the time of Council’s refusal included a requirement that “a lot must provide the minimum garden area at ground level” and Council did not consider that the tiered gardens and provision of courtyards within the lower ground level were provided “at ground level”. After the appeal was lodged and prior to the hearing the definition of “garden area” in all planning schemes was amended, removing the requirement for the garden area to be provided “at ground level”. The Tribunal found that the definition of garden area at the time of the hearing was essentially all areas of a site that do not include the elements excluded by the definition. The definition does not (now) specifically require the garden area to be provided at ground level and the zone requirements do not require that the garden area be provided only at ground level.
•
a permit application must be decided in accordance with the provisions of a planning scheme in force on the date the application is decided.
•
All the provisions of the GRZ, including clause 32.08-6 and the schedule to the GRZ, ceased to apply to the decision when the land was rezoned NRZ on 15 June 2017.
In summary, the applicant lost the benefit of the transitional provisions of the General Residential zone when the site was rezoned to Neighbourhood Residential zone.
The Tribunal found that the garden areas provided at lower ground level in the proposal did not come within any of the exclusions in the garden area definition and should therefore be included in an assessment of garden area.
O’Kane v Macedon Ranges SC [2018] VCAT 1562 involved an application to construct eight dwellings on a lot in a Neighbourhood Residential Zone. After lodging the planning permit application, but prior to Council’s decision, the Planning Scheme was amended twice to: •
Include varied Clause 55 standards to the schedule to the zone; and later to
•
Change the underlying zoning from General Residential Zone to Neighbourhood Residential Zone with varied Clause 55 standards in the schedule to the zone.
The question of law was whether or not Clause 32.09-6 (transitional provisions under the GRZ which “kept” Clause 55 provisions for applications lodged prior to 13 April 2017) preserved the applicable Clause 55 standards under the General Residential Zone in force when the predecessor of that clause (ie Clause 32.08-6) commenced. The Tribunal found that it did not. Accordingly, the current standards in the schedule to the Neighbourhood Residential Zone applied. In particular the Tribunal found that: •
The transitional provisions in the GRZ related to Clause 55 (ResCode) only, not the full provisions of the GRZ;

QUICK DECKS
S TA I R H E L P
If you are rocking an iPhone and recently updated to IOS 12 you may have noticed a new app appear called Measure. Measure is a native app to the IOS update which provides an Augmented Reality measuring feature. Using the camera and an onscreen pointer you can pan around an object and the dimensions will be calculated by the app. So, if you get caught without a tape measure and need to do some quick measuring, this should get you out of trouble. I think it’s fair to say a bit of sense checking would be a good idea; and I certainly wouldn’t recommend relying on this for a joinery site measure! It also has a very intuitive dual circle level feature, which actually seems pretty accurate.
Anyone involved in site works or perhaps even quantity take offs for decks (and I suppose to some extent timber sub-floors - you may need to have a play with it to see if you can get it to work) may benefit from the Quick Decks app. Essentially a calculator for all the materials required to build a deck. Simply add in the size of the deck you intend to build, the preferred spans and spacings and it will work out the rest, everything from a material take off right down the how much concrete is required for the stumps and how many nails you need to buy. Anyone working in this space might find this tool very useful as a quick calculator – and perhaps even rely on it completely after a few test-runs to make sure you get the same results the old way you calculate things.
Stair help is a handy little stair calculator. Designed to assist you to establish all the necessary measurements for a stair. Simply add in the variables and let the app do all the calculations and represent it in an easy to read diagram. Probably not much use to you if you’re sitting in front of your CAD machine. However if you’re on site or have some plans out on a boardroom table and need a few dimensions to assist you to work out what space you have or need – this app could be a handy one to keep on your device for reference. The good news… Copyright is automatic!
If there is no agreement, the client may still have an implied licence to use the work they have commissioned and paid you for.
If you are the creator of a design or drawing, you automatically own copyright in that artistic work, and the legal right to be acknowledged as the original creator of the design in the work. If someone else breaches your copyright, they may face legal penalties or potentially be ordered to pay damages and costs in court.
Disallow unwanted implied licences by ensuring all designs have your letterhead on the page together with the © symbol. You may even wish to state no licence is granted or implied to further communicate copyright is not being licenced.

Copyright ownership stays with you (or your firm if you are an employee) as the designer until/unless you assign or licence that design to a client or third party. Look carefully at your client designer agreement to ascertain exactly when, if and how copyright passes from you to your client, and what the conditions are, and ensure that you fully understand and are happy with those terms.
Do not copy a design you have seen and redraw it with some changes. This will still be an infringement of that design if it is substantially similar. Instead, consider your project and the space carefully - what design qualities would be most suited to it?
It is standard that the building designer retains copyright ownership in their work and licences copyright to the client; however, this can vary.
If it is absolutely necessary to use someone else’s design, or a substantially similar version of that design, you must seek permission to do so. You will have to inform them of any changes you intend to make. W H AT T O D O I F Y O U T H I N K Y O U R C O P Y R I G H T M AY B E INFRINGED
C O N S I D E R T H E ‘ W H AT - I F S ’ Sometimes you may be commissioned for a design and complete the work, however the client later wants to extend on that design. Ensure your agreement with clients is clear as to what is contemplated for each project, and whether there is an implied licence or not for the client to expand on that design at a later stage.
If you have had your copyright infringed, it is a good idea to seek advice before you do anything else. Sinclair + May regularly advise clients of their rights in respect of copyright infringement and provide strategic guidance as to how to deal with the issues that arise. Once a project is completed, you may still hold moral rights in your designs - which clients must respect. The most recently finished building within the premier business park in Melbourne’s Northpoint Enterprise Park is a state-of-the-art, $32 million, 148-bed aged-care facility, Epping Gardens. This stand-out aged care development may appear to be an unusual inclusion within a business park that until recently has predominantly housed commercial and industrial buildings. It is, in fact, a reflection of the growing trend for business parks to work towards including suitable community-focused facilities within their built environments to support and service local residents as well as workers that are drawn to the area for employment. Epping Gardens in Epping, Victoria is a state-of-the-art aged care facility with an inviting homely feel, whilst also blending with its industrial surrounds. Creating this blend of aesthetics and emotions was a unique challenge. To manage this significant task, Heritage Care commissioned Thexton Smith Architects as the designers, McMullin Property as the property developers and APM Group as the builders of their newest aged-care facility. The design challenge facing Thexton Smith Architects was to integrate an aged-care residential home into its surrounds of the 120ha predominantly industrial and commercial Northpoint Enterprise Park. Whilst the area is overwhelmingly industrial, the location of Epping Gardens is within its community-focused precinct, is surrounded by a beautiful wetland, and a growing health hub, including the Epping Medical Centre across the road and Melbourne’s Northern Hospital less than five kilometres away. Since they wanted to keep it warm and inviting, and residential in nature, Nolan Smith, Director and lead architect at Thexton Smith said they chose materials that would have a nice reference and harmony with the industrial zone. The materials palette chosen by the architects was mostly industrial and included precast panels and brick inlay for the external façade, weathering steel to the service wing, and generous use of Blackbutt timber both inside and outside, for a softening effect. “While the timber and bricks were quite residential in nature, the precast panels and weathering steel were industrial”, said Nolan.

This Epping Gardens development within Northpoint Enterprise Park was one of strategy for Heritage Care, giving them the opportunity for significant space within one of the state’s most dominant growth corridors with a projected population expected to increase by 52% in the next decade. Epping Gardens sits on Willandra Drive, Epping, alongside a new child-care facility, operated by Eclipse Child Care. Next to this and currently under development is the $70 million hotel development by the Mantra Group which will be a 214-room hotel, featuring both hotel rooms and apartments, a café/ restaurant, brewhouse, conference and meeting facilities, gymnasium, and an open car-park containing 143 marked bays and secure bicycle storage. Across the road from the Mantra is the Epping Medical Centre, a custom-built, three-story medical building. It was recently announced that this building will soon also house four operating theatres and a 30-bed day procedure centre. There is also a $250M private hospital development, of up to 360 beds, to be built along-side the Epping Medical Centre, opposite Epping Gardens. Owner/Operator: Heritage Care
The outcome is exceptional. Residential living has been harmonised with an industrial vibe. The atmosphere is warm and welcoming whilst the building does not look out of place with its industrial surrounds to one side or the extensive wetlands to the other.
