Schiff defeats Garvey to claim Feinstein's Senate seat

As expected, Democratic Rep. Adam Schiff scored an easy victory over Republican former Dodger Steve Garvey and will claim the U.S. Senate seat previously held by the late Dianne Feinstein. Schiff, D-Burbank, was considered a heavy favorite throughout the campaign to win the seat in Democratheavy California, although both he and Garvey each earned about one-third of the vote during the March primary election.

Both candidates actually appeared twice on Tuesday's ballot — once in the race to fill out the remainder of Feinstein's term, which ends in January, and again in the race for another six-year term.

The latest vote tally as of early Wednesday morning showed Schiff with about 59% of the vote to Garvey's 41% in both races.

Schiff spoke to supporters gathered at his campaign headquarters Tuesday night to claim victory, saying he was replacing a "giant" in the U.S. Senate in Feinstein.

"I am so humbled to be your next United States Senator," he said. "Thank you California. I will spend every day trying to repay the trust that you have placed in me by serving this golden state with all my heart and soul."

A vocal opponent of Donald Trump, Schiff said that regardless of who won the presidency in Tuesday's election, "we know there will be serious challenges facing the state of California and

the country. Regardless of the outcome, regardless of the way people may have voted, I want to make one thing clear — as your senator I am committed to standing up for every Californian. ...

"And my promise to you is that I'm going to deliver on day one, week one, year one, and keep on delivering for this amazing state," he said. "Because together there is no challenge that we cannot overcome. We leave no community behind. We do not stop, we do not rest until all our citizens have a safe place to live, clean water to drink, clean air to breathe, safe neighborhoods to raise their children, good hospitals, clinics and healthcare and the best public schools in the world.

"In pursuit of this dream for all our people I will not rest, California. In the Senate I will be a champion and voice for all Californians, whether you voted

for me or not, whether you live in the big city or a small county, whether you grew up here or came to America searching for a better life. We are going to build more affordable housing so you aren't forced to choose between your rent and putting food on the table.

"We are going to ensure that our fellow neighbors do not have to sleep on the street. We are going to help hard-working families by lowering costs. We are going to fight tooth and nail to protect abortion access and defense democracy and our freedoms."

Garvey, meanwhile, spoke to his supporters in Rancho Mirage and thanked them for their work during the campaign.

"In baseball, like in many professional sports, there's a tradition of members of the opposing team to congratulate the winners," he said. "Often times with a hand-

shake on the field or even a visit to the opponent's clubhouse. ... In that same spirit I congratulate Congressman Adam Schiff on his victory. Using their enormous power the voters have elected him the next U.S. senator from California. And I respect that and wish him good choices for all of the people in the years to come. ...

"I want you to know that despite the outcome that when the counting is over we will have gotten the fourth most number of votes in the country. This means that everyone in California does have a voice. And it will only grow louder and louder."

Some Southland congressional races remain too close to call

With Southern California in the national spotlight over the battle for control of the House of Representatives, numerous local congressional races remained too close to call Wednesday as vote-counting continued.

In Orange County's 45th congressional district, incumbent Rep. Michelle Steel, R-Huntington Beach, held a narrow lead with 52.5% of the vote over Democrat Derek Tran. Steel had an edge of about 11,000 votes.

It was unclear how many ballots still remain to be counted in the various congressional districts.

The 45th District race featured heated exchanges, with Steel, who is Korean, at one point saying she was "more Vietnamese" than Tran, an Army veteran who said his "parents fled the Communist regime in Vietnam."

Vietnamese voters are a key Republican bloc in the district, and Steel in the past has allied herself politically with former Orange County Supervisor Andrew Do, who resigned his seat and pleaded guilty to a federal bribery charge last week.

In the 47th Congressional District, Republican former Assemblyman Scott Baugh held a roughly 3,000-vote lead over Sen. Dave Min, D-Irvine. Baugh had 50.6% of the vote as of Wednesday morning, while Min had 49.4%.

Baugh lost to Rep. Katie Porter, D-Irvine, in the race two years ago.

State sues Norwalk over ban on new homeless shelters, housing

The state has sued Norwalk over the city's law forbidding new homeless shelters and other housing developments, officials announced Monday.

The state in October officially declared Norwalk to be in violation of state housing requirements, cutting off funding to the city for housing and anti-homelessness projects.

"The Norwalk City Council's failure to reverse this ban, despite knowing it is unlawful, is inexcusable," Gov. Gavin Newsom said in a statement. "No community should turn its back on its residents in need."

In August the Norwalk City Council OK'd an ordinance that put a 45-day moratorium on emergency shelters, single-room occupancy units, supportive housing and transitional housing. Newsom responded in September with a warning that Norwalk's housing ban was in violation of state law and a call for the City Council to reverse its policy decision.

The council, however, held its ground and voted to extend the moratorium for an additional 10 months. That move paved the way for Monday's lawsuit filing in Los Angeles Superior Court.

The city of Norwalk issued a prepared statement after the lawsuit was served Tuesday evening.

"We are reviewing the complaint and want to emphasize that Norwalk remains committed to addressing homelessness through partnerships," officials said. "The City is disappointed with the state’s approach as it was hopeful that it could reach a resolution without litigation. The City will nevertheless continue to reach out to state stakeholders in its approach to forge partnerships in line with Attorney General Bonta’s statement supporting collaborative solutions to these important issues."

Norwalk Mayor Margarita Rios has defended the council’s shelter ban, citing public safety concerns.

“The City Council is committed to safeguarding the interests and public safety of Norwalk residents while retaining local control over land use decisions,” Rios said in a statement last month. “Our ordinance was specifically designed to protect residents by promoting responsible development. However, our experience with housing programs, particularly Project Roomkey, which placed a substantial number of homeless individuals with high acuity needs, near homes, schools, and public spaces, has raised significant concerns.

“This project has negatively impacted public safety and community well-being,”

Rios said. “We urgently need improved communication and collaboration from the state to address these issues; we must tackle this in a spirit of cooperation rather than under the threat of penalties.”

In a September statement, she said, "Gov. Newsom's threats of a lawsuit overlook Norwalk's long-standing and effective efforts to address homelessness. The city has made significant strides, including opening affordable housing for homeless veterans, supporting L.A. County's Homekey project, funding its own homelessness engagement teams, and being one of the few cities in L.A. County with a dedicated Social Services Department to assist people experiencing homelessness. Norwalk also hosted one of the largest Project Roomkey sites during the pandemic.

"Despite these efforts, Norwalk has received no Measure H funding, forcing the city to use its own resources to manage the fallout from abandoned state-mandated programs, which puts both residents' safety and the city's finances at risk," the statement continued. "We urge Gov. Newsom to recognize Norwalk's proactive measures and provide direct resources to support its ongoing efforts."

Norwalk officials based the shelter and housing moratorium on the Housing

Crisis Act, which allows cities and local governments to ban housing facilities when "an imminent threat" to public health and safety exists. State officials rejected the claim that a public safety threat exists.

State officials said Norwalk has issued permits for 175 housing units during the current housing element cycle, which is just 3.5% of its assigned allocation of 5,034 units required to make sure communities have an adequate housing supply.

California Attorney General Rob Bonta said in a statement that the "lawsuit should come as no surprise. Despite receiving several warnings, the city of Norwalk has refused to repeal its unlawful ban on new supportive housing for our most vulnerable residents. Enough is enough.

"Every city and county in California has a legal obligation to help solve our homelessness crisis," Bonta said. "We have not, and will not hesitate, to ensure that everyone with the power to approve or disapprove housing takes their duties seriously."

State attorneys claim the Norwalk ban on shelters violates several laws, including the Housing Crisis Act, Affirmatively Furthering Fair Housing enacted in 2021 and the Housing Element Law.

Aballot measure that will roll back decadeold criminal justice policies in California and toughen penalties for some offenders was easily approved by voters, but another effort to expand rent- control protections was soundly defeated.

Proposition 36 received the lion's share of attention among the 10 statewide propositions on Tuesday's ballot, with backers calling it an overdue effort to toughen penalties and crack down on smash-and-grab robberies and repeat theft offenders, but detractors contending it would strip away millions of dollars in funding for critical mental health, drug treatment and rehabilitation programs while leading to mass incarceration.

The primary thrust of the measure is to toughen penalties for some drug offenses and thefts. The proposition — which won support of roughly 70% of voters as of Wednesday morning — will change the California criminal code to charge certain drug possession and thefts under $950 as felonies, primarily for defendants with prior convictions for similar crimes.

Those offenses were reduced to misdemeanors under Proposition 47, which was passed by California voters 10 years ago as the state was plagued with prison overcrowding.

A divided Los Angeles County Board of Supervisors in September took a formal position against the measure.

A motion by Supervisors Holly Mitchell and Hilda Solis against the proposition argued that the voterapproved Proposition 47 provides millions of dollars for programs such as housing services, mental health care, substance use disorder treatment, and job training, and passage of Prop 36 would "result in a loss of funding for Los Angeles County programs that provide alternatives to incarceration and necessary supportive services to communities."

The motion contended the measure would lead to increased incarceration rates, higher court costs, and enforcement of punitive measures that would take away funding from programs aimed at reducing recidivism and crime.

Barger, however, argued in favor of Prop 36, saying it "will reinstate accountability on crimes destroying the quality of life of law-abiding people in Los Angeles County."

"I believe this proposition isn't about overturning Proposition 47 in its entirety," she said. "Proposition 36 was created by a group of bipartisan state legislators. It's focused on modifying legal loopholes that repeat offenders exploit as they manipulate the system to avoid legal consequences."

In other statewide ballot measures:

-- Proposition 33 was aimed at expanding local governments' ability to impose rent control to more types of housing by repealing the Costa-Hawkins Rental Housing Act, a 1995 law that restricts rent control housing in the state. Under CostaHawkins, cities cannot impose rent control over singlefamily housing or developments built after 1995.

As of early Wednesday, it was heading to defeat, with more than 62% of votes saying no.

Backers said the measure would provide critical protections for tenants struggling to make ends meet, particularly seniors on fixed incomes. Critics, including the Howard Jarvis Taxpayers Association, argued Prop 33 would make the state's housing shortage even worse by discouraging construction of new rental housing. Opponents said California voters have defeated two similar measures already in 2018 and 2020.

-- Nearly 57% of voters were backing Proposition 2, which would authorize $10 billion in state bonds for repair, upgrade and construction at K-12 public schools, while also expanding eligibility for financial hardship grants for small and disadvantaged school districts. recaptured the U.S. presidency Tuesday, defeating Vice President Kamala Harris with 51% of the popular vote and 292 Electoral College votes, the Associated Press reported.

Harris, a Democrat, received 47.5% of votes nationwide totaling 67,039,246, compared with Republican

Trump's 71,893,987. Harris received 224 electoral votes.

Trump's victory was due largely to swing- or battleground-state voters in Pennsylvania, Ohio, Florida, Georgia, North Carolina, Wisconsin and Michigan favoring the former commander in chief.

At 2:10 a.m., a business in the 900 block of South Fifth reported a female subject assaulted an employee and fled in a vehicle. While officers were on their way to the business, they located the female subject. She was positively identified. She was arrested and taken into custody.

At 10:51 a.m., a victim called from a business in the 1800 block of California to report that his trailer loaded with equipment was stolen. This investigation is continuing.

At 12:27 p.m., a resident in the 800 block of West Walnut called to report that someone had attempted to steal his vehicle. This investigation is continuing.

At 1:22 p.m., officers were dispatched to a business in the 600 block of West Foothill regarding an assault. Officers arrived and determined that the suspect pushed the victim and fled the scene. This investigation is continuing.

At 4:18 p.m., a victim in a grocery store in the 100 block of West Foothill reported her wallet was stolen from her shopping cart and was later used at a store in Duarte. This investigation is continuing.

At 8:12 p.m., officers were patrolling the area of Primrose and Evergreen when they saw a suspicious vehicle parked in the area. An investigation revealed the vehicle had been reported stolen days prior. The vehicle was removed from the stolen vehicle system and returned to

the registered owner. This investigation is continuing.

At 11:05 p.m., a passerby in the 400 block of West Olive reported that she saw someone looking through a window of a residence. Officers arrived and made contact with a subject who matched the description given by the witness. The subject displayed symptoms of intoxication and refused to comply with the officer's instructions. The suspect was arrested and transported to the MPD jail to be held for a sobering period.

Oct. 25

At 12:18 a.m., a resident in the 800 block of West Colorado reported that her daughter, who was reported missing five days ago, had returned home.

At 5:55 a.m., officers were dispatched to the area of 5th and Huntington regarding two subjects standing next to a vehicle with a broken window. Officers arrived, but the subjects were gone. Officers made contact with two subjects nearby and an investigation revealed one subject was reported missing and the other subject was in possession of drug paraphernalia and a concealed dagger. A computer search revealed one subject had a warrant for his arrest. The subject was arrested and taken into custody.

At 8:40 a.m., a vehicle theft was reported in the 600 block of Fano. This investigation is continuing.

At 2:31 p.m., officers were dispatched to the 200 block of East Pomona regarding a disturbing subject. The subject

was gone prior to officers’ arrival. An investigation revealed the ex-husband came to her house, was arguing and refusing to leave. When the police were called, the ex-husband vandalized the victim's vehicle. This investigation is continuing.

At 6:39 p.m., an injury traffic collision was reported in the area of Ivy and Olive. One driver complained of pain and was transported to a hospital for treatment.

At 7:27 p.m., a battery was reported in the 100 block of Los Angeles. Officers arrived and determined that the victim was slapped by the suspect. The suspect was arrested and taken into custody.

At 10:42 p.m., officers approached two individuals in the 1600 block of South Myrtle who were in the park after hours, in violation of a Monrovia Municipal Code. A search of one individual revealed drug paraphernalia. The subject was identified and issued a citation for possession of drug paraphernalia and for being in the park after hours.

Oct. 26

At 2:36 a.m., an officer patrolling the 1500 block of South Myrtle saw a vehicle commit a traffic violation. A traffic stop was conducted and the driver was contacted. The driver displayed signs and symptoms of being under the influence. A DUI investigation revealed the driver was under the influence. The driver was arrested and transported to the MPD jail to be held for a sobering period.

At 9:50 a.m., officers were dispatched to the area of Myr-

tle and Colorado regarding a subject yelling. Officers arrived and made contact with the subject who was determined to be highly intoxicated. He was arrested and transported to the MPD jail to be held for a sobering period.

At 11:25 a.m., a resident in the 500 block of East Lemon reported a fight between a male and female subject. Officers arrived and made contact with the subjects. The male subject had visible injuries. An investigation determined the female subject was the aggressor. She was arrested and taken into custody.

At 12:17 p.m., a security guard from a shopping center in the 600 block of West Huntington reported a possible vehicle burglary. An officer arrived and confirmed that the vehicle had been forcibly broken into. The registered owner was contacted. This investigation is continuing.

At 12:56 p.m., a victim in a store in the 100 block of West Foothill reported that her wallet was stolen from her purse while one of the suspects distracted her with a conversation. This investigation is continuing.

At 1:25 p.m., a resident in the 500 block of Almond called to report that her daughter was at her home and refusing to leave, in violation of a court order. Officers arrived and made contact with the daughter. A computer search confirmed the court order and revealed that she had several bench warrants. She was arrested and taken into custody.

At 2:45 p.m., an employee from a store in the 1600 block of South Mountain reported a grand theft that had occurred several days prior. This investigation is continuing.

At 7:05 p.m., Sierra Madre PD officers assisted with a suspicious vehicle in the 200 block of North Mountain. MPD officers arrived to take over the investigation and determined the subject was heavily intoxicated. He was arrested and transported to the MPD jail to be held for a sobering period.

At 7:10 p.m., officers were dispatched to a burglary alarm in the 700 block of Norumbega. When officers arrived they

noticed the rear sliding glass window was shattered. Officer cleared the residence and did not find anyone inside. The residence was ransacked and it was unknown what was taken at the time. This investigation is continuing.

At 9:16 p.m., officers were dispatched to a fight in progress in the 900 block of South Fifth. Officers arrived and located two subjects that matched the description. Both subjects were heavily intoxicated and argumentative. The subjects were arrested and transported to the MPD jail to be held for a sobering period.

Oct. 20

At approximately 9 a.m., in the 700 block of West Longden Avenue, the victim walked outside and discovered three of her vehicle's tires on one car and two tires on a second car had been slashed. The victim checked her Ring Camera and discovered at approximately 4:20 a.m., an unknown suspect wearing a dark colored hooded sweatshirt walking onto her driveway toward her vehicle. Due to the angle of the cameras, they did not record the suspect slashing her tires.

Oct. 21

At approximately 7:02 p.m., an officer responded to 10 E. Huntington Drive (Drive in Liquor) regarding a report of a male subject being aggressive towards customers. Upon arrival the officer contacted the male subject who exhibited symptoms of alcohol intoxication. The male subject complained that he was suffering from asthma. The officer transported him to Arcadia USC Hospital for treatment. Once the treatment was completed the male subject was transported to the Arcadia Police Department jail where he was booked for being drunk in public.

Oct. 22

At approximately 5:59 p.m., officers responded to 102 E. Huntington Drive (7-Eleven) regarding a subject that was just assaulted. The officer’s investigation revealed the suspect held the victim at knifepoint and demanded her purse. The victim ran from the suspect

into the business. The suspect followed the victim and when he caught up to her, he struck her with his fist multiple times on the face. The suspect stole the victim's wallet from her purse and was last seen riding his bicycle southbound on First Avenue. The victim was transported to Arcadia USC Hospital for her injuries.

Oct. 23

At approximately 11:15 a.m., an officer arrested a male transient at 211 E. Foothill Blvd. (Ralphs) for trespassing. The store manager had previously reported the male for trespassing and for being verbally aggressive towards staff members.

Oct. 24

At approximately 12 p.m., officers responded to 400 S. Baldwin Ave. (The Shops at Santa Anita, Lululemon) regarding a theft that had just occurred. The reporting party provided a suspect vehicle description, and the vehicle was located in the area of Baldwin Avenue and Foothill Boulevard. A traffic stop was conducted, and the reported stolen property was recovered inside the vehicle. Additional property stolen from other stores and booster bags were also located. A field show up was conducted and the suspects were positively identified by the reporting party resulting in their arrest.

Oct. 25

At approximately 1:52 a.m., officers responded to the area of Second Avenue and Colorado Boulevard regarding a report of a male that had been stabbed. An investigation revealed that a local transient had sustained an injury, but due to being under the influence of an unknown substance, incoherent statements, and uncooperative behavior, the facts could not be confirmed. The male was transported to USC Arcadia Hospital for treatment.

Oct. 26

At approximately 7 a.m., officers responded to a FLOCK alert of a stolen vehicle in the parking lot of 5 W. Live Oak Ave. (Starbucks). The female driver was taken into custody without incident. The male passenger was taken into custody for a felony warrant.

Long Beach to host community meetings for Orange Avenue Backbone Bikeway Project

The City of Long Beach Department of Public Works will host two community open house events on the Orange Avenue Backbone Bikeway, a project that will transform Orange and Alamitos Avenues into a safer, more accessible multimodal corridor. The meetings will be held on Saturday, Nov. 16, from 2 to 3:30 p.m. at the Cal Rec Community Center at Ernest McBride Park (1550 Martin Luther King Ave.) and Wednesday, Nov. 20, from 6 to 7:30 p.m. at the EXPO Arts Center (4321 Atlantic Ave.). In the Vision Zero Action Plan, Orange Avenue was identified as one of the city’s minor arterials with the most traffic collisions resulting in pedestrians being killed or seriously injured. Planned safety and accessibility improvements throughout the corridor include protected bike lanes to form a continuous bikeway, protected intersections, highvisibility crosswalks, and other accessibility improve-

Buena Park choir coach pleads guilty to sex assaults on 2 boys

A former boys' choir vocal coach in Buena Park pleaded guilty Tuesday and was immediately sentenced to 24 years in prison for sexually assaulting two boys. Roger Alan Giese, 49, pleaded guilty to 20 felony counts and one misdemeanor count related to the assaults on two boys, according to court records. He was given credit for 3,558 days behind bars. Giese was freed on $200,000 bail in 2003 in his original case involving the 13-year-old boy, but by 2007 he had disappeared and an arrest warrant was issued for him in March of that year. He was tracked down in England in 2012 thanks to a tip generated by an "America's Most Wanted" episode about his disappearance. After years of fighting extradition, Giese was returned to the Southland in August 2018. Part of his custody credits included 513 days spent behind bars in England, according to court records.

Anaheim declines Hills Preserve apartment, commercial space project

A proposal for apartments and commercial space in east Anaheim was rejected early Wednesday, Oct. 30, by a majority of Anaheim’s City Council, citing the amount of development proposed and

fire and evacuation concerns. Known as the Hills Preserve, the project called for a sevenstory building with 498 upscale apartments and an adjacent 40,000-square-foot commercial building with uses still to be determined. The proposal also included 50 acres of preserved open space. The Council voted 5-2 to deny the project, with Mayor Ashleigh Aitken and Council members Jose Diaz, Natalie Rubalcava, Steve Faessel and Natalie Meeks, who represents District 6 in east Anaheim where Hills Preserve was proposed, making up the majority.

Propane semi-truck leak prompts evacuation order in Pine Cove

A large propane semi-truck with an active leak prompted an evacuation order in Pine Cove Saturday, the Riverside County Fire Department announced. The leak was reported just after 9:30 a.m. Saturday in the 53100 block of Mountain View Drive. An evacuation order was issued for the residences on Mountain View Drive and residences on Walters Drive were advised to shelter in place. The fire department hazmat team was on-scene mitigating the leak, which was slowed down significantly just before noon. The leak was mitigated by 1:40 p.m. and the evacuation order, as well as the shelter in place order were lifted, according to the fire department.

Pair admit perpetrating dozens of thefts across region

A man and woman who perpetrated a series of thefts at Inland Empire stores and other locations, netting more than $120,000 in stolen goods,

both pleaded guilty Monday to a half dozen counts of organized retail theft and were immediately sentenced to two years' felony probation.

Giovanni Munoz Leon, 51, and Nury Alejandra Herrera Palacio, 32, both of Ontario, admitted the charges during a status hearing at the Southwest Justice Center in Murrieta Monday. It was unclear whether Leon and Palacio reached plea deals with the Riverside County District Attorney's Office, or made their admissions directly to Superior Court Judge Jeff Zimel. Along with the terms of probation, the judge ordered both defendants to serve three months in a sheriff's work release program, as well as directed Palacio to pay $22,487 in victim restitution. According to sheriff's Sgt. Robert Thomas, the defendants snatched a number of beauty products from the shelves of a Lake Elsinore outlet in late August, then proceeded to flee the location without paying. The estimated loss to the business was $3,000. Thomas said that the ensuing investigation did not turn up sufficient evidence to reveal the perpetrators' identities, but Leon and Palacio returned to the same store on Sept. 28 and grabbed $2,000 in merchandise before fleeing again. This time, investigators were able to procure enough information to identify the thieves, he said. "They determined that from June to October of this year, Leon and Palacio were responsible for over 50 thefts within California, totaling $123,000 in (stolen) merchandise," the sergeant said.

Earlier this year, as part of Regional Parks 60th anniversary celebration, park hours were extended to 8 p.m. during the summer when daylight was extended. Streetlights return to 2 San Bernardino neighborhoods

In October, the City of San Bernardino installed approximately 96 streetlights to two neighborhoods in the northern part of the city. San Bernardino Public Works crews activated the last set of lights last week, bringing a new walkability and sense of security to area residents. The City Council has also recently approved $1.5 million in addition to a $250,000 grant from the U.S Department of Energy to upgrade approximately 500 streetlights across the city to solar power to reduce lighting costs and eliminate the risk of copper wire theft.

Rezoning is required by State law to ensure that there are enough sites with adequate densities to meet the housing need in the upcoming eight years. During the Housing Element process, the City assessed a number of sites in its Sites Inventory that would be able to accommodate the City’s assigned 2021 Regional Housing Needs Allocation (RHNA) of 4,612 units (1,154 very low, 638 low, 686 moderate, and 2,134 above moderate). With units entitled and under review, as well as anticipated ADUs, the City has adequate capacity for its RHNA units. In addition, the City has the option to pursue additional sites suitable for residential development through rezoning opportunities on City Identified Parcels. The City identified ten candidate sites that may provide opportunity to accommodate the shortfall housing need to comply with SB 166 (no net loss), if rezone efforts were undertaken (Housing Element Rezoning Efforts). With a lower income RHNA of 1,792 units, vacant and underutilized sites, including three sites for potential rezoning, provide additional capacity to satisfy the RHNA requirement while providing a buffer of 485 units for a total of 2,277 low/very low-income units. The rezoned sites will meet the requirements of Government Code §65583.2, including but not limited to a minimum density of 20 units per acre, minimum site size to permit at least 16 units on site, and zoned to allow ownership and rental housing by-right in which at least 20 percent of the units are affordable to lower income households. The proposed action includes changes to the City’s General Plan and Zoning Map to implement the City’s certified Housing Element. The changes are summarized in the Candidate Site Identified to be Rezoned to Accommodate Shortfall Housing Need Table.

NOTICE IS HEREBY GIVEN, that the City Council of the City of El Monte will hold a public hearing for the consideration and first reading of an ordinance to adopt a military use equipment policy (“Policy”) as required by Assembly Bill 481 (“AB 481”).

DATE OF HEARING: November 19, 2024

TIME OF HEARING: 6:00 P.M., or as soon thereafter as the matter may be taken up by the City Council that evening.

PROPOSAL: The City Council will consider adopting a Policy as required by AB 481. AB 481 was signed into law on September 30, 2021, and requires law enforcement agencies, including the El Monte Police Department, to adopt a Policy in order to take actions relating to the funding, acquisition, or use of military equipment as that term is defined by state law. The City’s proposed Policy is available for review at https://www.ci.el-monte.ca.us/672/Assembly-Bill481-Military-Equipment-Use. In order to approve the Policy, the City Council must find that the military equipment identified in the Policy is necessary; will safeguard the public’s welfare, safety, civil rights and civil liberties; and that any purchases of military equipment is reasonably cost effective. If adopted, the Policy will be reviewed annually by the City Council, and an annual Military Equipment Report will be prepared for and reviewed by the City Council.

INVITATION TO BE HEARD: The Public Hearing will be held before the City Council of the City of El Monte on November 19, 2024, at 6:00 p.m. or as soon thereafter as the matter may be heard that evening. RSM mayor pleads guilty to misdemeanor in election case

Mayor Carol Gamble pleaded guilty Friday as expected to a misdemeanor charge related to her nominating petitions and was ordered to perform 160 hours of community service.

Gamble turned in nominating petitions for her reelection to the City Council that violated the law because she did not personally witness the signatures, prosecutors said. If she is reelected Tuesday, she cannot take office and the city will have to hold a special election, prosecutors said.

Her attorney, Paul Meyer, characterized the situation as a mistake and said she immediately agreed to cooperate with law enforcement.

"As soon as she learned of the error, she contacted the city to correct it," he added. "The law did not allow a correction. She consulted two expert election attorneys who confirmed that the law does not permit correction at that time. She had her lawyer notify the (District Attorney's Office) of her decision to admit the mistake and to resign if elected."

Meyer pointed out that officials "who learned of the error held the information until the deadline for correction had passed. That was their right to do so. Such is politics in today's world."

Gamble "issued a statement admitting her error. She voluntarily agreed to return all her contributions, and has done so," Meyer said. "She said she would resign if elected. None of that is required by today's plea. It is all voluntary."

Meyer said Gamble is "embarrassed," and added that she "is a wonderful and respected woman who devoted decades to create and grow a city she loves. She appreciates having been able to work overtime for decades in service. She thanks everyone for the huge outpouring of support, and shock at the way the law works here."

Prosecutors said Gamble, a four-term mayor, agreed to plead guilty to a misdemeanor, perform 160 hours of community service and serve one year of probation.

"American democracy relies on the absolute integrity of the electoral process," Orange County District Attorney Todd Spitzer said

in a statement. "Voters must have total confidence that every election is being carried out in a fair and unbiased manner. Interference in the electoral process in any manner and at any stage jeopardizes the will of the people being carried out while eroding the trust of voters that their vote counts."

Spitzer added, "I refuse to allow our electoral process to be subverted and exploited by anyone. The decision to file criminal charges against the candidate prior to an election is not a decision I made lightly but given the risk to the electoral process as well as the potential of the city of Rancho Santa Margarita having to pay for a special election should Gamble be re-elected, there was no choice but to file criminal charges prior to the election and alert voters of her ineligibility to run for City Council."

Fullerton City Council candidate Scott Edward Markowitz pleaded guilty earlier this month to a misdemeanor for the same crime and was sentenced to 160 hours of community service.

Bird flu found in Los Angeles County wastewater for 1st time

For the first time, H5 bird flu has been detected at one of Los Angeles County's wastewater sampling sites, health officials said Friday.

Low levels of H5N1 showed up in samples from the A.K. Warren Water Resource Facility in Carson, according to data provided by the LA County Department of Public Health and independent research organization Wastewater Scan.

H5N1 is a type of avian influenza that has been spreading nationwide among birds and mammals, including seals, foxes, cats and cows, according to health officials. There were no reports of human H5N1 cases in LA County, and the overall risk of catching the virus remains low for residents. Currently there is no evidence of sustained human-to-human transmission of H5N1 in the U.S.

"Public Health is actively

engaging key risk groups such as dairy and meat processing sites to identify possible sources of H5 avian flu in wastewater," according to a department statement.

"The virus may have been introduced into wastewater by discarded contaminated animal products, infected wild bird droppings entering the sewage system, or animal infection."

The health department regularly samples wastewater for infectious diseases, officials said. H5 has been detected in Northern and Southern California wastewater and 203 California dairies, and 16 human cases of avian flu have been reported in the state. This has local, state and federal health officials "watching the situation closely," according to the county.

"This is the first time these bird flu viruses have been found to be spreading in cows," the Public Health

Department statement said.

While the current risk of transmission residents is low, officials suggested these practices when around animals or when consuming animal products:

- Do not eat raw milk, raw cheese and undercooked meat.

Avoid unprotected contact with sick or dead animals, or materials contaminated with bird feces. The virus spreads other birds, pets or mammals through contact with infected feces or eating infected animals.

- Do not handle wild birds and observe them only from a distance. If you have to touch wild birds, even if they look healthy, thoroughly and frequently wash hands and consider wearing a mask that fits well. Some birds may carry the virus while appearing to be in good health.

- Report sick or dead birds to local animal control agencies for possible collection and testing. "Sick birds or animals may not have flu-like symptoms, but instead may

be unable to fly, have seizures, have difficulty walking or be found dead," according to the county health department.

- Prevent wild birds from entering areas that house pet birds or poultry livestock. Also ensure wild birds can't defecate downward into holding areas for pet birds or livestock.

- Remove bird feeders and communal birdbaths to lessen the risk of bird-tobird virus transmission.

- Keep pets away from sick and ailing birds. "There is some risk of the virus being transmitted to mammals such as dogs, cats, and wild mammals, especially if they eat infected, uncooked birds," according to the health department.

Symptoms of an H5N1 infection in humans may include:

- cough, sore throat, runny or stuffy nose, muscle or body aches, headaches, fatigue;

- fever or feeling febrile, though officials noted that infection flu viruses do not always cause fever;

- eye redness, known as conjunctivitis;

- shortness of breath or difficulty breathing; and

- diarrhea, nausea and vomiting.

Schiff, 64, ran his campaign on a platform of protecting democracy. In June of last year, Schiff was censured by the Republican-led House on a party-line vote for comments he made during the investigations into Trump's ties to Russia. Schiff took the censure by Republicans as a badge of honor.

"From abortion and reproductive care to LGBTQ equality and the ability to vote — all of these inherent rights are under assault. We need to preserve and protect our rights and freedoms — and yes, expand them — not take them away, as reactionary MAGA Republicans and a partisan Supreme Court have successfully done over the last few years."

Schiff said he will also tackle the twin crises of housing affordability and

homelessness.

"We simply do not have enough housing that's affordable, and because of that, we have seen a dramatic rise in people experiencing homelessness," Schiff said. "We need to build hundreds of thousands of units of affordable housing each year in California alone, and help those struggling to pay for housing every day."

He added that the government needs to dramatically change how it approaches homelessness, not only to prevent people from ending up on the streets but also to find effective methods of housing them.

One of the main components of Schiff's campaign was his affordability agenda.

"California working families are facing an affordability crisis. And we can do something about it," Schiff said.

"Corporations are raising the prices of goods with little oversight and swallowing up their competition. We need federal price gouging rules, better antitrust enforcement, and to drive down the costs of prescription drugs and gas — all while protecting and empowering workers."

Garvey, 75, faced an uphill battle, as a Republican hasn't won a Senate race in the state since 1988. However, Republicans have a history of conveying star quality into statewide victories. Arnold Schwarzenegger used his star power to become California's governor from 2003 to 2011.

Throughout the campaign, Garvey leaned into his baseball career.

"I never played for Democrats or Republicans

or independents. I played for all of you," Garvey said in a video launching his campaign last year. "It's time to get off the bench. It's time to get back in the game."

Garvey's entrance into the race gave Republicans a name recognized by many Californians.

"Our campaign is focused on quality-of-life issues, public safety and education," Garvey said, adding that solving the homelessness crisis is one of his top priorities.

"We can't just offer temporary fixes; we need to dig deep and provide comprehensive care that includes mental health, addiction treatment, and affordable housing," Garvey said on his campaign's website. "This issue is about restoring hope, dignity, and humanity to our fellow Californians that are struggling on our streets."

The former baseball player said his focus was also on public safety.

"I fully back our law enforcement and believe in the power of community policing and innovative crime prevention," Garvey said. "I'll work towards building strong partnerships between law enforcement and communities."

Calvert, R-Corona, in Riverside County's 41st District was also being closely watched, with the incorporation of more liberal Palm Springs changing the dynamics of the district.

Calvert, who was first elected in 1992, defeated Rollins, 52.3%-47.7%, in 2022. As of early Wednes-

day morning, Calvert was leading with 50.5% of the vote, holding a roughly 2,100-vote lead over Rollins.

In northern Los Angeles County, the 27th District race between Rep. Mike Garcia, R-Santa Clarita, and Democrat George Whitesides, a former NASA chief

of staff, remained touchand-go as returns were tallied.

But Garcia pulled ahead late, and as of Wednesday, he had 51.2% of the tally, and a roughly 5,000-vote lead.

The pair spent heavily on advertisements in the waning days of the

campaign, with the candidates trading barbs on abortion rights, immigration and crime. The district has traditionally been a conservative stronghold, but thanks in part to the 2020 redrawing of the district boundaries, Democrats now outnumber Republicans, but the large

number of independent voters could turn the tide.

In other tight races, Rep. Young Kim, R-Anaheim, defeated Democrat Joe Kerr in the 40th congressional district, with 56.8% of the vote. In the 49th district, which straddles Orange and San Diego counties, Rep. Mike Levin, D-San

Juan Capistrano, had 50.9% of the vote, compared to 49.1% for Republican Matt Gunderson. Levin had a roughly 5,000-vote lead.

The outcome of many of the races might not be known for several days as vote-counting continues and late ballots continue to arrive.

Lamanda Park Specific Plan

PROJECT DESCRIPTION: The Planning & Community Development Department has prepared a new Specific Plan for the Lamanda Park area. The recommended Lamanda Park Specific Plan (LPSP) covers areas in the 2003 East Colorado and the 2000 East Pasadena Specific Plans. The recommended LPSP will result in a unique plan vision for Lamanda Park, with goals, policies, permitted uses, and design, development, and public realm standards that will shape the built environment for the plan area and implement General Plan Land Use policies. The recommended LPSP will require the following approvals: General Plan Map Amendment, Specific Plan Adoption, and Zoning Map Amendment and Zoning Text Amendment. PROJECT LOCATION: The recommended LPSP area generally encompasses the area between the 210 freeway to the north, Roosevelt and Vista Avenues to the west, Colorado Boulevard to the south, and Kinneloa Avenue to the east (Map 1).

ENVIRONMENTAL DETERMINATION: An addendum to the 2015 Pasadena General Plan Environmental Impact Report (GP EIR) (State Clearinghouse No. 2013091009) to address the potential sitespecific environmental impacts associated with the proposed LPSP has been prepared in accordance with the California Environmental Quality Act of 1970 (CEQA) (Cal. Public Resources Code Section 21000, et. seq., as amended) and its implementing guidelines (Cal. Code Regs., Title 14, Section 15000 et. seq., 2016). This Addendum has been prepared and will be processed consistent with CEQA Guidelines (Cal. Code Regs., Title 14, Section 15162 and Section 15164). The addendum found that the proposed LPSP will not result in any potentially significant impacts that were not already analyzed.

PLANNING COMMISSION RECOMMENDATION: On August 28, 2024, the Planning Commission recommended that the City Council approve the proposed LPSP, including the General Plan Map Amendment, Specific Plan Adoption, Zoning Map Amendment, Zoning Text Amendment, and EIR Addendum as presented by staff, with five recommendations as outlined below:

1) Insert specific language to protect existing street trees throughout Lamanda Park.

2) Require new and improved projects to include pedestrian walkways from arterial streets to main building entrances.

3) Initiate pilot investments to be implemented and funded by the City within the first year of the Specific Plan’s adoption with a minimum budget allocation of $50,000.

4) Incorporate additional pedestrian crosswalks along Colorado Boulevard.

5) Incorporate a potential linear park along the former railroad right-of-way.

The Commission also requested staff review options for providing pedestrian access from Walnut Street to the Home Depot entrance.

NOTICE OF SOLICITATION OF APPLICATIONS TO FILL AN ALTERNATE MEMBER VACANCY FOR UNEXPIRED TERM ON THE PASADENA RENTAL HOUSING BOARD

Notice is hereby given that, in accordance with Pasadena City Charter, Section 1811, a Pasadena Rental Housing Board has been established to administer and enforce Article XVIII of the City Charter, “The Pasadena Fair and Equitable Housing Charter Amendment”. The Board is comprised of eleven (11) members consisting of seven (7) Tenant Members, and four (4) At-Large Members. In addition, there are two (2) alternates, one serving as the alternate for the Tenant Members and one serving as the alternate for the At-Large Members.

There is an unscheduled vacancy resulting from the resignation of Aaron Markowitz. The Pasadena City Council is now soliciting applications from candidates seeking to fill this vacancy and serve the remaining balance of the term, which expires on May 24, 2027. The City Council will appoint an alternate Tenant Member who may reside anywhere in the City.

Alternate tenant members and members of their Extended Families may not have owned, managed, or had a 5% or greater ownership stake in rental units in Los Angeles County in the three years prior to applying to this position.

The Board’s duties include making rules and regulations to implement Article XVIII of the City Charter, setting allowable rent increases, determining and publicizing the Annual General Adjustment in rents, appointing hearing officers, conducting hearings on petitions for rent adjustments for individual properties, adopting a budget, pursuing civil remedies against those who violate Article XVIII of the City Charter, holding public hearings, establishing a schedule of penalties for violations of Article XVIII of the City Charter, and establishing and maintaining a registry of rental housing in Pasadena. An Alternate Tenant member may only participate in the absence of a primary Tenant Member during a meeting.

The City encourages interested residents of Pasadena to apply for appointment to the Board. In addition to a completed application, applicants must circulate a nomination petition and gather a minimum of 25 qualified signatures from residents living in the same Pasadena Council District as the applicant. A declaration of financial interests of the applicant, and of his or her Extended Family members, is also required and will be a public record. Hochman defeats Gascón in LA County District Attorney race

Los Angeles County will be getting a new district attorney, with former federal prosecutor Nathan Hochman handily defeating incumbent George Gascón, whose progressive policies swept him into office four years ago but made him a target of critics who accused him of being soft on crime.

Semi-official results from Tuesday's election showed Hochman with 61.5% of the vote, and Gascón with 38.5%.

Gascón has defended his record while in office, denying allegations that his policies have led to an increase in crime and insisting that statistics show actual drops in many categories. But Hochman disputed that claim and said he would ensure people serve appropriate punishment for their crimes.

"We'll go back to just two things — the facts and the law," Hochman told his supporters gathered in Beverly Hills Tuesday night. While the votes were still being tallied, he told his backers that "the voices of the residents of L.A. County have been heard and they're saying enough is enough of George Gascón's policies and they look forward to a safer future."

The Association of Deputy District Attorneys, which represents county prosecutors, hailed Hochman's victory as a "pivotal moment in the fight to return balance and accountability to the justice system and to prioritize public safety in a county that has seen a dangerous decline under the failed leadership of George Gascón."

There was no immediate statement from Gascón. But Cristine Soto DeBerry, executive director of Prosecutors Alliance Action, issued a statement praising his dedication to public service and said Hochman's win does not mean the end of a more progressive approach to criminal justice.

"This election is in no way a rejection of reform," DeBerry said. "If it were, Nathan Hochman wouldn't have had to conceal his right-wing past and run on a more balanced approach to prosecution. Ironically, Hochman demonized DA Gascón while embracing many of his policies.

Now, we'll make sure he's held accountable for the promises he made to pursue reform and a balanced approach."

During a recent debate hosted by KNX News and the Los Angeles Times, Gascón highlighted his progressive policies — several of which he implemented once he took office in 2020 — such as limiting extra-long sentences for people accused of using a gun or being a gang member, prosecutions of juveniles as adults and no

committed.

According to the California Department of Justice, violent crime is

well with the death penalty, sending juveniles to adult prisons and addressing police misconduct — all

longer seeking the death penalty, though he later revised some of his policies.

But Hochman said such policies have led to an increase in crime across the county and said he would revoke several of Gascón's directives.

Hochman touted his "hard middle approach" to crime, stating that it will not lead to mass incarceration but rather cases would be reviewed individually and punishment is proportional for the crime

up about 8% from 2019 to 2023 countywide, but in Los Angeles violent crime decreased by about 6%.

"We should not be worse than any other DA's office out there. The LA County DA's Office used to be the gold standard by which all other DA's offices had measured," Hochman said.

Gascón pushed back, saying the District Attorney's Office was previously known as the "most carceral county in the country." He said there were issues as

things he has worked to undo.

Gascón insisted that his office has been holding criminal accountable for their crimes, including retail and residential theft.

"The reality is that the problem of policing certain crimes is not unique to our county," Gascón said during the debate. "Frankly, it's not unique to the moment, but the job of the district attorney is not to police. The job of the district attorney is to prosecute,

nesses that he said have led to increased concerns from residents and business owners over public safety.

"We need to send a very strong message of enforcement, accountability and ultimately deterrent to those residential burglaries, and if they're coming, for instance, overseas from Chile or from Venezuela, we have to work with the federal government," Hochman said.

Gascón survived two attempts to recall him, and during his tenure has also been accused by 20 prosecutors of workplace retaliation.

Gascón said his office has a 90% filing rate related to residential burglaries, emphasizing that suspects in such crimes are being held accountable.

He also pointed to his tougher stance on prosecuting law enforcement officers accused of misconduct or excessive force.

Gascón touted "moving the needle" in 125 cases that have led to some convictions.

Gascón commented that Hochman may not be capable of handling such cases, referencing his challengers' endorsements and campaign contributions from unions representing law enforcement officers.

Hochman noted he was a co-founder of the Los Angeles Sheriff's Foundation, which raises funds to support the department.

"When I speak to police officers, I make it crystal clear, if you cross the line, you will be prosecuted," Hochman insisted.

During his campaign, Hochman touted what he calls his "Blueprint for Justice" that he says would "restore safety and justice to our county."

As part of his blueprint, Hochman vowed to "restore the purpose of the District Attorney's Office to fairly, effectively, and vigorously prosecute those who break laws in Los Angeles County based on the evidence and the law."

Hochman said he would also "restore the integrity and independence of the district attorney by not making decisions based on a party affiliation or political ideology but solely on the facts and the law."

Gascón, meanwhile, said he intended to continue looking at the criminal justice system "not with a rear-view mirror but looking forward."

"When you listen to my opponent, you're listening to code talk for mass incarceration," Gascón said during the recent debate. "You're often listening to someone that believes — from a very privileged point — that he has the answer for the rest of our community, and is very willing to take us back to where we were before."

Music entertainment entrepreneur Zach Poag will be the featured speaker at the next MADIA meet-up on Wednesday, Nov. 13, from 6:30 to 8:30 p.m. to take place at Tanner Research, located at 1851 Huntington Drive, Duarte.

The initial product from GogoPix is Vibe-Stream, www. Vibe-Stream.tv, that distributes fully-licensed music videos for consumers to watch.

One of the things that makes GoGopix special is that their system also offers a streaming cloud service that allows any company or creator to manage their video catalogs to reach consumers. Metro to launch first phase of bus lane enforcement program

Drivers in L.A. are gettinga60-day warning period that started Friday related to an enforcement initiative aimed at cracking down on vehicles parking on Metro bus-only lanes and zones.

Metro and the city's Department of Transportation have implemented the first phase of its joint bus lane enforcement pilot program. Cameras were installed on 50 select buses along lines 720 and 212, servicing Wilshire Boulevard and La Brea Avenue, respectively.

Following this initial period of warning and outreach, citations will be issued for bus lane violations.

"Our buses carry hundreds of thousands of people every single day," Metro Board Chair and L.A. County Supervisor Janice Hahn said in a statement.

"It's not fair that a single car blocking a bus lane can hold up a busload of people," she added. "Those riders deserve to reach their destinations safely and on-time. This new ticketing system is important, and I hope people don't take the risk, and [instead] move their cars out of the bus lanes."

In early October, the L.A. City Council approved an ordinance establishing fines for drivers who park in bus-only lanes and zones. Penalties start at $293, and can increase to $381 for late

payment, followed by an increase of $406 for subsequent failure to pay on time.

Both agencies will provide outreach to residents to inform them of the enforcement program. There will be payment options available for low-income individuals, once the 60-day warning period is over.

According to the Metro, vehicles that block bus lanes and stops can result in delays and disruptions for dozens of people relying on public transportation.

Cameras were installed behind bus windshields -- one will use "computer vision" to detect vehicles on the roadway and traffic lanes, while another will record license plates of the violating vehicle.

LADOT traffic officers will review video and verify the accuracy of the images before issuing a ticket. Evidence of a violation will be stored for six months before being destroyed, and any images unrelated to a violation will be destroyed

within 15 days, according to Metro.

"Our partnership with Metro to deliver dedicated bus lanes across the city has already improved service reliability for thousands of Angelenos who rely on public transit to get where they need to go everyday," LADOT General Manager Laura Rubio-Cornejo said in a statement. "This new program will help our officers ensure we continue to realize those benefits as we expand bus lanes to additional routes across our transportation system."

The agencies are expected to announce Phase 2 of the pilot at a future date, which will add cameras to select buses along lines 910 and 950 (the Silver line), and line 70, which serves Olive Street/ Grand Avenue.

Cities such as San Francisco, Oakland, New York City, Washington D.C. and Philadelphia use similar technology to keep their bus lanes and stops clear of vehicles.
