South Coast Property Specialists (Carlene Franzen) Tips: How Should the NSW Real Estate Industry be Regulated? Did you know that NSW Fair Trading currently regulates approximately 40 industries in NSW, one of which is the Real Estate Industry? It is also es-mated that Real Estate is probably the largest of these industries contribu-ng around $10 billion to the state’s tax revenue. The Real Estate Ins-tute of NSW (REINSW) has been pushing for some -me for the industry to be regulated in a different way as it doesn’t feel that NSW Fair Trading has the capacity and exper-se to oversea such a large and important industry. Specifically, the REINSW supports the idea of a “property services commissioner” who would head up a specific regulatory authority focused on the industry. REINSW CEO Tim McKibbin made a number of quotes in rela-on to this issue including: “Making Fair Trading the regulatory authority for the industry is an experiment that has failed because it lacks the core competencies for an industry as complex as property. The efficiencies this structure was supposed to deliver have not come to pass. It requires the exclusive focus of an authority with real industry experience and a commitment to stakeholder engagement. Unfortunately, this environment, with Fair Trading at the helm, does not exist today. For most people, a real estate transac-on will be the largest they ever make. The people of New South Wales deserve an authority exclusively focused in this area, like other states have.” According to Mr McKibbin, the current bill which is before parliament (Property Services Council Bill) will not only bring NSW up to date with regulatory models used in other states, but will also align the property industry with the legal and building services industries.
