Client Testimonials I reached out to you during the most stressful time of life for both my loved ones and myself - horror had occurred to my dear loving mother. My mom had fractured her hip and due to her frail health and advanced age required risky hip replacement surgery. Many issues legal and otherwise arose which I could not personally resolve. You not only resolved each and every one, but you continue to do so now, over 4 years later. You always display extreme sincerity, compassion and friendship, using your vast experience and confidence in your ability, to continually bring satisfaction, positive results and a tremendous sense of relief and comfort to my loved ones and myself. You have gone out of your way to visit Mom on multiple occasions in her Nursing house and we love you for it. As an attorney, friend, and a great man, I could not possibly hope to know anyone more phenomenal. The three greatest men I have ever known are my dear departed father, my dear departed father-in-law and Ely Rosenzveig. – Jeff D.

Your heart is a hard-working muscle that never stops, and as you get older, it may need to work even harder to do its job. According to MedlinePlus, the heart experiences signs of aging just like the rest of the body: Its natural “pacemaker” loses cells and may slow down, the heart wall thickens, and the heart valves may stiffen, causing heart murmurs. Heart conditions such as abnormal rhythms are more common in elderly people. However, by taking care of your heart and living healthily, seniors can support this crucial organ and keep it strong.

Here are four key tips for seniors to maintain Heart HealtH:

♥ 1

♥ 2

Watch your Blood pressure and Cholesterol According to MedlinePlus, it becomes more important as you age to monitor any changes in heart health. If you're in overall good health, have your blood pressure checked annually. If you have heart disease, diabetes or kidney problems, your doctor may suggest monitoring your blood pressure more closely. You should have your cholesterol levels checked every three to five years, or more often if your doctor advises it. Discuss any changes in your cholesterol or blood pressure with your doctor, and make plans to address these changes. Healthy Diet and lifestyle The Mayo Clinic advises a diet rich in fruits, vegetables, lean proteins and whole grains. Medline Plus also advises cutting back on saturated fat and cholesterol, and maintaining a healthy weight. Foods high in fiber may also be useful in keeping your blood cholesterol levels low. If you smoke, talk to your doctor about quitting, and avoid excess alcohol.

Get out and about: leisure activities The American Heart Association cites a study published in its journal, “Circulation: Journal of the American Heart Association,” which found that seniors who participate in light-to-moderate leisure activities have a significantly decreased risk of atrial fibrillation, a heart rhythm disorder. Some leisure activities that were found to reduce risk include gardening, outdoor chores, golf, dancing and walking. High-intensity exercise was not found to yield the same benefits, the American Heart Association reports. You can also participate in an ongoing cardiovascular workout, such as swimming or bicycling. Consult your doctor prior to undertaking these activities. omega-3 supplementation According to SeniorJournal.com, omega-3 fish oil supplements appear to have a protective effect against cardiovascular disease in seniors. In particular, the fish oil supplements may help prevent massive and fatal heart attacks, Senior Journal.com reports.

However, for many seniors without a spouse, Valentine’s Day can be a lonely day filled with sorrow. Love from children, grandchildren, other relatives and pets can help seniors get through the day. There are so many ways to bring happiness to seniors on Valentine’s Day. Up for some ideas? How about taking them out to lunch or breakfast? Taking your favorite senior to a matinee movie. Have flowers delivered, or bring them by yourself if you live nearby. Get the kids involved – seniors love homemade cards – and make sure they include a picture. Just be there for them: Your time, thoughtfulness and presence can add happiness to a day that may have otherwise been lonely. You can really make their day special. So don’t forget your favorite seniors(s) on Valentine’s Day!

Staying “in the mood Sex matters throughout your life and can actually take on an increased importance in your senior years. For older men and women, the benefits of good sex can be extensive: It can increase circulation, reduce anxiety, release pain-killing endorphin and help you relax. Still, senior sex can present challenges, and you may feel discouraged by physical or emotional issues in your way. But these problems are not insurmountable. With a better understanding and an open mind, you can enjoy a gratifying sex life well into your later years. Here are some tips for seniors to think about. Remember, it’s never to late to restart a stalled sex life!

Communication: Sex drives can be naturally stalled as you face the realities of aging, but it’s possible to overcome. Talk to your partner about your issues, whether they’re physical or emotional. Explain the anxieties you are feeling, ask for and accept reassurance, and continue the conversation as issues develop. Don’t worry about performance: Fretting over how you will perform, or whether you are worthy of sexual attention from your partner, can lead to impotence in men and lack of arousal or orgasm in women. So, really, just do it — you may be surprised with your pleasure and satisfaction level — even if you weren’t “in the mood. Sex can improve mental & physical health: Senior sex can burn fat, cause the brain to release endorphins, and drastically reduce anxiety. Through its health-improving benefits, a good senior sex life can add years to your life.

Take your time: Without pressing workloads or young children to worry about, many seniors have far more time to devote to pleasure and intimacy. Use your time to become more intimate. Start with a romantic dinner—or breakfast— before lovemaking. Having an experience together, sexual or not, is a powerful way of connecting intimately. Keep flirting: Being playful with your partner is important for a good sex life at any age, but can be especially helpful if you’re a senior. Tease or tickle your partner— whatever it takes to have fun. With the issues you may be facing physically or emotionally, play may be the ticket to help you both relax.

Looking for a Valentine’s Day gift for the senior citizen in your life? Even better, how about a gift bag. Gift bags don't have to be expensive. The key here is to show your special senior citizen how much you care about them. Remember, Valentine's Day can be a lonely holiday for the elderly, especially if they have lost a spouse. So think of them on Valentine's Day. Here are some great gift bag ideas: Handwritten Note or Poem: You can write a note or poem to the senior citizen letting them know how much they mean to you. Either of these would be special to include in the Valentine's Day gift bag you create for them. You might want to place this note or poem inside an envelope before you put it inside the gift bag. Gift Card: Sometimes seniors visit the shopping mall either with family, friends, etc. If you know that they like to stop for a snack at the food court, a gift card for one of the food court restaurants might be a gift to place inside the Valentine's Day gift bag. Even a $5 gift card among the other gifts in the gift bag would be nice. Key Chain: If the gift bag is for your mother, a key chain that reads, "World's Best Mom" or a comparable sentiment could be a gift to include in the gift bag. Similarly, if the gift bag is for your father, a key chain that reads, "World's Best Dad" or a similar sentiment might be a gift to place in the gift bag. If the gift bag is for another relative try to purchase a suitable key chain for that senior citizen. A Box of Blank Note Cards: The senior can write a little note to send greetings to family and friends for birthdays, anniversaries, etc. It would be nice to include a book of postage stamps with this gift. Puzzle Books: If the senior enjoys word puzzles, such as word searches and crossword puzzles, a few of these books might be nice to include in the gift bag. Weekly or Daily Planner: Sometimes a senior citizen might need a place to jot down various appointments. Either a weekly or daily planner would be a good gift to place in the affordable gift bag. Hope that the ideas given in this article helped you decide on the gifts to include in the affordable Valentine's Day gift bag for the senior citizen on your gift-giving list.

Heart Disease and Exercise: Becoming Heart Smart

During the Holidays, Sound Shore Medical Center’s (SSMC) Ludington Adult Day Program’s staff and registrants enthusiastically greeted members of the younger set, fouryear-olds from the Junior Wonders Nursery School in Pelham, NY. Escorted by their teachers and the School’s Director, the adorable pre-K students visited the seniors to offer Season’s Greetings and sing holiday songs, including "We Wish You a Merry Christmas", "Jingle Bells" and "Dreidel-Dreidel-Dreidel". In deciding to introduce their students to community service early, the School’s staff realized that transportation for 20 students would require renting a bus. At a cost of more than $200, a raffle was launched to help defray the costs. So not only did the children practice their three songs for weeks before their performance, they were actively involved in selling raffle tickets. The trip to Ludington provided a number of learning experiences as well as a fun time for the children. The joy on the faces of the fragile seniors at Ludington and those of the children made the event well worth the effort. After the applause and good wishes, the children were treated to juice and cookies as well as big hugs from the Ludington registrants. This was a lovely gesture that brought joy to all concerned and promises to be an annual affair. Ludington’s Adult Day Services Program is a medical model that provides rest for caregivers and allows seniors and individuals with chronic conditions, who need some medical help – but not around the clock – to remain in their home setting while receiving daytime support.

Heart Disease. What does it mean? Why is it a big deal? And how does physical activity and exercise play a role in keeping your heart healthy?

your risk of developing heart disease include diabetes, high blood pressure, high cholesterol, sedentary lifestyle, smoking, and obesity.

At times, it can be such an ambiguous term. Thousands of individuals this year will leave their doctor’s office with the new diagnosis of heart disease. Many will learn that they are at continued and greater risk for a heart attack and/or a stroke. Coupled with a slew of other terms/conditions like hypertension and high LDL/HDL- it can all be very overwhelming.

Heart disease unlike some conditions, can be prevented, and even reversed through lifestyle changes. Increased physical activity/exercise alone can make a huge impact on your heart health. This lifestyle change by itself, or in combination with good nutrition and medication compliance can: • Decrease blood pressure and cholesterol • Improve the heart’s pumping efficiency and overall body circulation

Heart disease, also known as cardiovascular disease, is the leading cause of death in America. It refers to several types of heart conditions that involve the heart’s arteries and its ability to beat, pump, fill, and supply oxygen filled blood. Examples of such conditions are coronary artery disease, arrhythmias (irregular heart beats), and heart failure.

• Reduce symptoms of angina, fatigue, and shortness of breath

Complications of heart disease include stroke, angina (chest pain), and heart attacks. Conditions and behaviors that increase

positive effect. According to American Heart Association, 30 minutes daily- which can be broken up into three, 10-minute intervals can provide heart health benefits. Simple adaptations like taking the stairs, doing house chores yourself, or walking instead of driving to the corner store can make a difference too! The key is to keep moving.

Heart Smart Exercise Tips: Obtain MD clearance before starting an exercise program. ALWAYS have a warm up and cool down period. For endurance building, increase duration before intensity. If you primarily strength/resistance train, add a 10-20 minute aerobic component. Interval training is very beneficial. Written by Dr. Delali Goka, PT, DPT, coowner of A Healthier You, LLP. Volunteers needed for Westchester County’s EITC Assistance program

Once again, Westchester County will be launching its annual program to help lowand moderate-income residents qualify for federal and state earned income tax credits (EITC). And once again, it needs volunteers to help with the effort. “This is an important program that helped 6,604 residents obtain refunds totaling $7.5 million on their 2011 tax returns,” said County Executive Robert. P. Astorino. “Crucial to the success of the program is the work of volunteers who actually do the tax returns.” Volunteers will be trained beginning in January and asked to donate time between Jan. 2 and April 15 at one of the designated tax assistance sites in Yonkers, Mount Vernon, Ossining, White Plains or Peekskill. The hours of operation of each location will vary, with daytime and evening hours and some weekend hours. Individuals interested in volunteering can sign up online at www.westchesterputnamonestop.com or EITC site. The federal and state credits are tax refunds for working people with low or moderate incomes. Together, the credits can be up to $7,764 to families earning less than

$51,000. The amount a family gets varies depending on the number of children in the household and the amount of earnings. The EITC can supplement the wages of lowand moderate-income earners and reduce taxes for those who qualify. The county's EITC Assistance program is part of a broader Volunteer Income Tax Assistance (VITA) program, a national initiative sponsored by the IRS and the state Office of Temporary and Disability Assistance. It is a collaborative effort of the following county departments and community organizations: Office of the County Executive; the county departments of Social Services, Senior Programs and Services and Consumer Protection; the One-Stop Employment Center; the Westchester Business Council; the American Association of Retired People (AARP); Educational Opportunity Center; Westchester Community Opportunity Program; The United Way of Westchester and Putnam Counties; the Inter-faith Council for Action; Urban League of Westchester; Child Care Council of Westchester; and the Westchester Hispanic Coalition.

Healthy Tips for Seniors to incorporate into your daily life for a

Healthy Heart! Eat Healthy - Limit unhealthy fats and cholesterol Of the possible changes, limiting how much saturated and trans fats you eat is the most important step you can take to reduce your blood cholesterol and lower your risk of coronary artery disease. A high blood cholesterol level can lead to a buildup of plaques in your arteries, called atherosclerosis, which can increase your risk of heart attack and stroke. Eat less butter, full-fat dairy and fewer fatty meats and fried foods. Replace them with olive or canola oil, nuts and seeds, natural peanut butter, trans-fat-free margarine, fatty fish and avocados. Foods loaded with omega-3 fatty acids are beneficial to your cardiovascular system like salmon, sardines, halibut, olive oil and soybeans. Watch Your Weight One of the easiest ways to maintain a healthy weight is to control the size of your portions. Don’t eat more than 2 to 3 oz. of meat per meal and 1/2 cup of pasta or other starch. Get Active Daily exercise will help keep your heart healthy. The American Heart Association recommends at least 30 minutes of aerobic activity per day to get the heart pumping and improve heart health. Add Fiber Every Day A high-fiber diet fills you up and helps prevent inflammation of the arteries. The healthiest sources of fiber include fruits, vegetables, whole grains and nuts. Lower Your Sodium Eating a lot of sodium can contribute to high blood pressure. It’s suggested to not take in more than 2,300mg of sodium per day, which is about 1 tsp. of salt. Manage Stress Try taking several deep breaths and slowly exhaling a couple of times a day and take time each day to do something YOU enjoy doing- even for 5 minutes.

Don’t Smoke and Drink in Moderation Don’t smoke, stay away from second hand smoke. Drink only in moderation: one drink for women, two for men per day.

Blood Detective Fitness Secrets Exercise is fun, it feels good and it helps fight disease: What more could baby boomers ask for? In this article I will not only outline precisely why exercise is so important, but also how to really know whether you, as a baby boomer, will benefit in the long-term from your exercise efforts. At the end of each of the subsections below I have outlined for you special tests that I call, Blood Detective Bio-Markers that are tests and evaluations that prove if your exercise efforts will likely improve your quality and length of life. Exercise performance often results in better fitness, but fitness alone without long-term benefits like reduced risk of disease and improved quality of life‌your ability to do what you want to do‌would be an incomplete triumph. Hidden Benefits of Exercise Flabby flesh and unflattering bulges lead many people to start exercising, but the biggest benefits of exercise occur beneath the surface. Exercise boosts immunity, improves mood and helps stave off conditions such as heart disease, cancer, depression, osteoporosis and type 2 diabetes. It can also reverse some of the signs and symptoms of aging. Blood Detective Bio-Marker Tests to consider: White blood cell functional test, bio-impedance test (measures percentages of muscle, water and fat in the body and metabolic rate), autonomic nervous system measurement (for stress effects upon the nervous system), bone density test (sonogram method not using radiation), HgA1c (measures blood sugar over several weeks in one measurement), C-peptide (measures insulin output). The Heart Is The Key! The heart is one of the biggest beneficiaries of regular exercise. It's a muscle and, like skeletal muscles, it needs exercise to stay healthy. Exercise makes the heart stronger and more efficient, so it has to beat less to pump blood throughout the body. It also lowers the amount of fat and “badâ€? cholesterol (low-density lipoprotein, or LDL) in the blood, clears out plaque that can accumulate in the arteries, helps reverse arteriosclerosis (artery hardening) and lessens your risk of having a heart attack or stroke. Blood Detective Bio-Marker Tests to consider: Arterial Stiffness Test (measures hardening of arteries not blockage), Cardiobeam Tech. Evaluation (measures over a dozen cardiovascular parameters non-invasively), VAP Lipid Measurement (most accurate blood fats tests available).

More Exercise Equals Less Cancer More and more studies are also showing that people who exercise regularly have a decreased risk of developing cancer, particularly colon, prostate and breast cancer. Exercise helps prevent colon cancer by speeding the digestive process, which prevents food and toxins from sitting in the gut. It may also help prevent breast cancer by reducing fat deposits the body uses to create estrogen, which some tumors thrive on. Blood Detective Bio-Marker Tests to consider: Colon Cancer Blood Test Screening, urinary indicant (a test of absorption), estradiole, estriole and estrone blood and/or saliva testing, testosterone measurements, SHBG, homocysteine, CRP and ferritin testing.

Exercise and Diabetes Because hard-working muscles use glucose for energy, exercise can also help prevent and control type 2 diabetes. Type 2 diabetes develops when the body stops responding to insulin, which normally facilitates the entry of glucose into cells. When glucose can't get into cells, it remains in the bloodstream, where it can cause damage. When people exercise, their muscles use glucose for energy, which helps reduce blood sugar levels. Exercise also helps people control their weight, which is important because overweight people are at a greater risk of developing type 2 diabetes. Blood Detective Bio-Marker Tests to consider: Bio-impedience testing, C-peptide, serum insulin, homocysteine, CRP,

RBC-magnesium, immune profile, autonomic nervous system evaluation, arterial stiffness testing and a comprehensive hormone evaluation. Lose The Right Kind of Weight There's also one condition everyone experiences that exercise helps to manage: aging. As you age, your body begins losing lean muscle mass, oxygen uptake ability and bone density. But this degeneration isn't inevitable. Muscles, bones and the cardiovascular system respond to the stress of exercise by getting stronger. Blood Detective Bio-Marker Tests to consider: Bio-impedance testing, lung spirometry evaluation, pulse ox and C02.

Exercise and Mood And don't worry if you're impatient, and think it will take too long to see these health benefits. Exercise has a mood-altering effect, relieving anxiety, raising energy levels and increasing sexual interest. It increases the body's levels of serotonin, a chemical that causes good feelings and decreases incidents of depression, and beta-endorphine, a chemical that's more potent than morphine. In fact, this release can occur just 12 minutes into a workout, which should keep you hooked long enough to reap the other rewards. The 30th Annual Senior Citizens Hall of Fame Awards Cuban-born Isabel E. Villar of White Plains, the founder and executive director of El Centro Hispano since 1974 and a founder of the Westchester Hispanic Coalition, received top honors at the 30th Annual Senior Citizens Hall of Fame Awards Luncheon last month. “The Senior Citizens Hall of Fame has been a tradition in Westchester for three decades,” said County Executive Robert P. Astorino. “Our honorees are extraordinary. Individually and as a group, they strengthen our communities and are true role models for us all. Isabel Villar is a remarkable example of just such a person.” Villar is one of 51 Westchester residents age 60 and older from the “Class of 2012” who will be inducted at a festive luncheon in the hotel's Main Ballroom from 11:30 a.m. to 3 p.m. “I feel very special,” Villar said about the recognition. “I never forgot my beginnings. To get such a prestigious award is wonderful. I never thought I'd be in that category. This can only happen in the United States of America.” Five of this year's honorees are 90 or older, including Kitty Geissler of Tarrytown, who recently turned 100.

The Senior Citizens Hall of Fame is sponsored by the Westchester Public/Private Partnership for Aging Services, the Westchester County Department of Senior Programs and Services (DSPS) and the Westchester County Department of Parks, Recreation and Conservation. This year's event is co-sponsored by VNSNY CHOICE Health Plans, CenterLight Healthcare and a partnership from the Hebrew Home at Riverdale, which includes the Harry & Jeanette Weinberg Center for Elder Abuse Prevention and ElderServeHealth. In addition, The Upper Class LLC, a Westchesterbased family business that specializes in trips for seniors and boomers, is donating two day-trips to each of the six top honorees. DSPS Commissioner Mae Carpenter said that the Senior Citizens Hall of Fame showcases how much seniors contribute to the quality of life in Westchester and inspire others to follow their lead. “They show that age is never a deterrent to being a vital member of our society,” she said. “In fact, it's an advantage because of the life experiences they bring with them. It's also terrific that they exemplify the neighbors-helping-neighbors approach of our signature Livable Communities Initiative.”

The Senior Citizens Senior Hall of Fame was started by former Westchester County Executive Andrew P. O'Rourke who led the county from 1983 to 1997. Its purpose is to honor those who have contributed their energies and talents as professionals and volunteers to make significant and enduring contributions to enhance the quality of life countywide or in their home communities. Seniors are nominated to the Hall of Fame by members of the community and the winners are selected by a screening committee composed of past Hall of Fame honorees, members of the Senior and Older American Advisory Councils and the DSPS staff. The names of the honorees are engraved on plaques that are permanently displayed at the DSPS office in Mount Vernon.

ATTORNEYS AT LAW Many Years of Experience Protecting the Legal Interests of the Elderly & Special Needs Populations

Why should I spend money hiring attorneys to do asset protection planning for me and my loved ones? Currently, the monthly cost for nursing home care in New York ranges between $10,000-$15,000, and properly certified home health attendants (nurse aides) can cost as much or more for round- the-clock home care. Statistically, it is likely that most people will need either or both of these care options as they grow older. It is critical that you plan appropriately to best minimize the strain that elder care costs may have on your estate, and to help put you in the best position possible to qualify for benefits that are largely covered by the government, under Medicare or Medicaid. Our firm has attorneys with extensive experience in developing tax-effective action plans for our clients that help protect their assets from government imposition. We have also been very successful in negotiating the complex bureaucratic minefield in which Medicaid is now mired. We have achieved remarkable results for our clients on a host of Medicaid related issues, from obtaining Medicaid approvals for coverage of home care and institutional care benefits, to very accommodative resolutions of Medicaid spousal recovery claims, where the office of Medicaid aggressively pursues the non-institutionalized (i.e., or “community”) spouse for Medicaid benefits provided.

Why should I have a lawyer prepare my will? If you die without a Will, the law, not you, determines how your assets are divided and to whom they are given. A poorly drafted Will may result in a sizeable chunk of your assets not ending up where you want them to go. We are an experienced law firm that can expertly craft your will to address your long-term care, tax, estate planning, and asset protection planning issues. It is in your best interest that planning be done properly so as to minimize the tax burden on your estate. Our experience and skill in the fields of Trusts, Wills, and Estates enables our firm to uniquely tailor estate planning to your individual needs. We will review your entire estate and draft a personalized plan that will best direct the disposition of your assets after death, whether through your Will, or by means of testamentary substitutes (trusts, joint-asset ownership with right of survivorship, or by beneficiary designation in life insurance policies, annuities, or individual retirement accounts).

My father is having difficulty caring for himself. I am afraid he will no longer be able to live on his own. I am worried about finding the money to pay for his care, whether he stays at home or moves to an assisted living facility or nursing home. What do I do?
