Client Testimonials I reached out to you during the most stressful time of life for both my loved ones and myself - horror had occurred to my dear loving mother. My mom had fractured her hip and due to her frail health and advanced age required risky hip replacement surgery. Many issues legal and otherwise arose which I could not personally resolve. You not only resolved each and every one, but you continue to do so now, over 4 years later. You always display extreme sincerity, compassion and friendship, using your vast experience and confidence in your ability, to continually bring satisfaction, positive results and a tremendous sense of relief and comfort to my loved ones and myself. You have gone out of your way to visit Mom on multiple occasions in her Nursing house and we love you for it. As an attorney, friend, and a great man, I could not possibly hope to know anyone more phenomenal. The three greatest men I have ever known are my dear departed father, my dear departed father-in-law and Ely Rosenzveig. – Jeff D. I hired Ely to assist with my parents estate planning and it was a wise decision. He is a true expert in navigating through complex elder care law and procedures. His guidance was invaluable and his communication excellent. I would strongly recommend his services.

claim there is a problem with your information that might somehow sully your good name. In the online world, unless you know for sure with whom you are dealing, you must assume that you could have landed on a ‘look-a-like’ site trying to scam you. – Seniors who use social networking sites that cater to older users are targeted with quizzes and surveys that often have very invasive questions about your health, wealth, and personal lives. Quizzes are created for revenue. Ask yourself who profits from you answering the questions and who else gets to see your answers. Understand that any information posted in these quizzes is likely to be used by many companies.

Answer a medical quiz and you may find your insurance claims, even your ability to get insurance, are affected. Quizzes can also generate targets spam ‘offers’ based on your answers. – Online dating is becoming very popular for seniors, some of whom have lost a partner due to death or divorce. While this is an excellent way to meet new people, it is also a way for predators to find potential victims. Their goal may be to get your money, or inflict physical or emotional harm. Confidence tricksters make their living by building trust – and a lonely senior who has perhaps had a long relationship with one partner and is now seeking another person to share life with is often a very easy target.

The internet creates excellent opportunities for Westchester County seniors to meet people, conduct business, plan travel, access records, stay in touch with friends and family, and support hobbies and entertainment interests. You can learn how to take advantage of the opportunities without falling prey to predators so you can have peace of mind when you go online. Here are some important things to remember for seniors surfing the Web: - Every age group has unique vulnerabilities in addition to general Internet risks, and seniors are no exception. Few entirely new types of crime are created to target seniors; the issue lies in how existing crimes are tailored specifically to exploit older Internet users. - Though many seniors are very computer savvy, many more are not. Often their computers are not properly secured. Even when you have installed security software, it is critical that you set up automatic updates, turn on a firewall, use secure passwords, and so on. If you do not feel that you are able to set up your computer’s security, it may be well worth hiring a computer technician from a reputable company to review your settings for security and fix any problems you may have. – You have a wealth of experience in judging the character of people you meet in person, but you have probably developed fewer skills for assessing the character of the people and companies you meet online. You are typically more trusting and respectful of official looking material than younger generations, so are more apt to fall for scams. And you are more worried about notices that

Live Richly. You’ve Earned It. Benjamin Franklin, one of our Founding Fathers wrote: “wealth is not his that has it, but his that enjoys it.” In harmony with this thought, we encourage our clients to enjoy the wealth they worked so hard to build. We want them to protect it of course, but not squander it. We urge them to live richly; to enjoy the golden years of retirement. In the end, true wealth is not about money, but about the experiences we share with those we love. To learn more, call us at 845-627-8300 or visit easternplanning.com

We’ve heard about it before and, unfortunately, some of us have experienced it. When a senior citizen, a loved one, falls the consequences can often be very traumatic. Individuals that are 65 years of age or more have a one-in-three chance of falling over the next year. In many cases, this type of fall can injury severely and even lead to death. However, many of these falls can be prevented. Proper lighting, movement of furniture, and good shoes can go a long way in preventing a fall. Sure, many seniors tend to get stubborn in their older age. And we love them for that, among other things. Keep in mind, these falls don’t “just happen.” They can be avoided. In this issue of Boomers & Beyond, we provide a guide to preventing senior falls, at home, on the go or in an assisted-living facility. It’s just another very important story in this informative issue. Enjoy it! And thank you so much for reading and supporting our publication.

Keep Cool: Hot Weather Safety For Seniors Summer heat waves are particulary dangerous for senior citizens. It is hard to stay cool and safe without air conditioning, but for many people, especially senior citizens, hot weather can be very dangerous and even deadly. Older people are at high risk for developing heated-related illness because the ability to respond to summer heat can become less efficient with advancing years. Fortunately, the summer can remain safe and enjoyable for everyone who uses good, sound judgment. Heat stress, heat fatigue, heat syncope (sudden dizziness after exercising in the heat, heat cramps and heat exhaustion are all forms of “hyperthermia,” the general name given to a variety of heat-related illnesses. Symptoms may include headache, nausea, muscle spasms and fatigue after exposure to heat.

If you suspect someone is suffering from a heat-related illness: – Get the victim out of the sun and into a cool place, preferably one that is air-conditioned. – Offer fluids but avoid alcohol and caffeine. Water, fruit and vegetable juices are best. – Encourage the individual to shower, bathe or sponge off with cool water. – Urge the person to lie down and rest, preferably in a cool place. Heat stroke is especially dangerous for older people and requires emergency medical attention. A person with heat stroke has a body temperature above 104 and may have symptoms such as confusion, combativeness, bizarre behavior, faintness, staggering, strong rapid pulse, dry flushed skin, lack of sweating, possible delirium or coma. The temperature does not have to hit 100 for a person to be at risk for hyperthermia. Both an individual’s general health and/or lifestyle may increase the threat of a heat-related illness. Health factors which may increase risk include: – Age-related changes to the skin such as poor blood circulation and inefficient sweat glands. – Heart, lung and kidney diseases, as well as any illness that causes general weakness or fever. – High blood pressure or other conditions that require changes in diet. For example, people on salt restricted diets may increase their risk. However, salt pills should not be used without first asking a consulting doctor. – The inability to perspire caused by medications including diuretics, sedatives, tranquilizers and certain heart and blood pressure drugs. – Taking several drugs for various conditions. It is important, however, to continue to take prescribed medication and discuss possible problems with a physician. – Being substantially overweight or underweight. – Drinking alcoholic beverages.

When it comes to their well-being, older adults shouldn’t act like victims to aging. They should be active— physically, socially, and spiritually. To slow down the physical and mental decline that comes with age, drugs and exercise aren’t enough. According to several studies, a lifestyle makeover is necessary. It’s never too late to go healthy. Anybody, young or old, can successfully redesign the way they live to be healthier. While we don’t have a say in our own genetic makeup, greater than 50 percent of our mental and physical health status is related to lifestyle. You can even start small: ride public transportation, reconnect with a long-lost friend, join a ballroom dance class, or follow guidelines on how to safely move around the community. The point is, try something new and be willing to learn.

Take control of your health. Appreciate the relationship between what you do, how you feel, and their impact on your well-being. As we age, even deceptively simple or downright mundane pursuits like reading the newspaper, cooking a potluck dish, walking the dog, or going to church have a powerful influence on our physical and mental health. Here are some tips to stay young and healthy.

Know thyself. The guiding principle of Socrates rings just as true today as it did in ancient Athens. Lifestyle changes are most sustainable when they fit into the fabric of your everyday life -- your interests, schedule, and self-concept. Identify supports on your journey that are strong enough to counterbalance the obstacles you face. Set goals that are challenging but still realistic enough to be achieved.

Anticipate how chronic conditions may affect your plan. Over 70 percent of seniors age 65 and older have a chronic condition, such as hypertension, heart disease, diabetes, arthritis, COPD, or cataracts. Don’t let these impede your progress. Before a big game, elite athletes visualize their performance in their minds’ eye. So too should you be prepared for the potential ways you might have to adapt or improvise. And, of course, consult your physician in advance about any new activities.

Living longer can also mean living better. Our research demonstrates that maintaining a mix of productive, social, physical, and spiritual activities as you age can lead to increased vitality, social function, mental health, and life satisfaction, along with decreased symptoms of depression and self-reported bodily pain. Even better, activity-centric lifestyle interventions to ward off illness and disability may also be more cost-effective and have fewer negative side effects than prescription drugs.

Unfortunately, there can often be bickering between siblings when it comes to their parents’ inheritance. That’s often what happens when money is involved, in this case, $30 trillion – the amount of money boomer parents are expected to leave to their children over the next 30 to 40 years. That could mean you will be among those leaving a tidy sum to those you love. And you want to do it right. Here are five ways to make sure you do.

Manage expectations with open communication. A recent survey from Fidelity Investments showed that adult children underestimated the value of their parents’ estates by a tidy $100,000. Parents should give kids a basic sense of where they stand financially — always noting that the situation can change if more money needs to be spent on their own medical care — as well as clear instructions about whom to contact and where important papers are kept. Level the playing field. One of the most frequently asked questions by anyone leaving an inheritance is whether they have to treat the kids equally. Experts say it certainly helps. Do the distributing yourself. For instance, if you have, say, a $200,000 life insurance policy, don’t name the oldest child beneficiary and trust. You divvy it up among the siblings. If you distribute unequally, explain yourself. There are reasons parents do this — perhaps one child earns significantly more than another, and therefore needs less — but it can lead to resentment. Use a trust to eliminate uncertainty. If you want to make sure your children use the money wisely, consider putting it in trust with a few strings attached. Many estate planning attorneys recommend distributing the assets in chunks (typically one-third at age 25, one-third at age 30 and one-third at age 35).

Baby Boomers:

A name that families have learned to trust with the care of their loved ones.

Are Vitamin Supplements Really Necessary? By Dr. Michael Wald, The Blood Detective Board Certified Nutritionist Integrated Medicine of Mount Kisco, P.C 914-242-8844

Baby Boomers – Take care of yourself! If nutritional supplements are so beneficial for baby boomers, then why do many mainstream medical physicians seem to frown against the use of nutritional supplements? Often I’ve heard from my baby boomer patients that their primary healthcare providers have said something like this, “Nutritional supplements are unnecessary when one consumes a balanced diet”. This response makes a few important questions, including: What is a balanced diet and why are many mainstream physicians seemingly opposed to nutritional supplementation? A balanced diet, to put it frankly, is a myth. When I ask most of my patients their thoughts about what a balanced diet is, most of them answer, “Well, I eat a diet that has fruits and vegetables, not too much meat and sugars”. Although on the surface this answer seems quite correct, and certainly may be part of balanced diet, a balanced diet is one that fits the needs of the individual. Mainstream doctors mean well, but they can’t tell you what there training has not taught them. Survey’s by the National Health Sciences state that most medical school curricula provide not even the minimum hours of basic nutrition training. Dr. Michael Wald is director of nutrition at Integrated Medicine of Mount Kisco. He can be reached by calling 914-242-8844 (Ext. 1). Website: www.intmedny.com & www.Blooddetective.com. Twitter: https://twitter.com/drmichaelwald Baby Boomers & Nutritional Deficiencies Should baby boomers take nutritional supplements? The answer to this question is a strong YES! Even if you think you have a healthy, balanced diet, study after study demonstrates that upwards of 70% of the United States population has half-a-dozen or more nutritional deficiencies. The SAD or Standard American Diet is sadly, just that…sad and inadequate to meet even our most basic nutritional needs in some areas of nutrition. Increased intake on average of simple sugars in junk foods, high read meat intake, inadequate intake of fruits and vegetables and even air pollution can all add up to nutritional deficiencies and quality of life issues including: more heart disease and cancer, chronic fatigue, brain-fog, muscle aches and pains and obesity and over-weight. Baby Boomers – pick your disease! Depending upon the specific nutritional deficiency, any number of health issues, including fatigue, memory and recall, immunity and overall senseof-wellbeing can be affected. There are also a large number of degenerative conditions that result from a lifetime of nutritional deficiencies, including osteoporosis, iron and other types of anemia’s (deficiencies), cardiovascular disease, several cancers, diabetes, arthritis and dementia (memory). Baby boomers are the largest segment of the United States population who are experiencing the ravages of nutritional deficiencies first hand. Sadly, mainstream doctors are not trained, and inadequately refer, to clinical nutritionists mainly because they fail to recognize or consider the often subtle or hidden signs of nutritional deficiencies in their patients. What is even odder is that virtually any health problem can be caused by nutritional problems, or at the very least, may result in nutritional imbalances.

Celebrated artist Frances Manacher approaches her 100th birthday at Drum Hill

Frances Manacher, a resident at Drum Hill Senior Living Peekskill, will turn 100-years-old on April 19th next year. Talk about a milestone. Talk about longevity. Talk about a treasure. Manacher’s secret to enduring nearly a century? Well, there are no secrets, just simple words of wisdom. Pick the right grandparents, Manacher said with a laugh. She had loving ones. Don’t ever make mountains out of mole hills, added Manacher. Translation: Don’t sweat the small stuff.

As for Manacher’s last pearl of wisdom: Concentrate on your similarities with people, focus on what you have in common, what you can agree on. Not your difference. Manacher is the closest thing to a celebrity at Drum Hill, which combines the privacy of spacious individual apartments with security and dependable services at an outstanding value. In this caring environment, each resident has the opportunity to explore new activities, discover new friendships, and continue to lead an active lifestyle with the advantage of less household responsibility. Manacher was an accomplished artist. She is the first female artist to display her work in India. Manacher’s work has also been exhibited at the Museum of Modern Art, the Passedoit Gallery in New York and the Tirca Karlis Gallery in Mass. There is also a permanent exhibition at the Jewish Museum of New York that features her work. Manacher has received sparkling reviews from, among other publications, the New York Times. Some of her paintings and press clippings hang on that walls of her Drum Hill apartment wall. Manacher has even given some of her paintings, which have been displayed around the world, to Drum Hill.

“I’m not a great painter, I’m not a bad painter,” Manacher said. “It’s given me a good life and I enjoy what I did. A lot of wonderful things have happened be through art.” Manacher discovered her natural talent as an artist in her late teens, when she started sketching for designers. Then one summer soon after, Manacher was painting in the garden of her Croton vacation home when a neighbor took notice and set her up with an art dealer he knew in New York City. The rest, as they say, is history. Indeed, Manacher had some career. She’s had some life and Drum Hill can’t wait to celebrate Frances’ 100th birthday with her next year. Located in historic Peekskill, New York, Drum Hill Senior Living Community offers gracious and affordable independent living overlooking the spectacular Hudson River Valley. Combining the privacy of individual apartments with the comforts and services of a senior community, Drum Hill provides an innovative housing alternative for those 62 years of age and over. Drum Hill features 120 apartments filled with fascinating and accomplished residents. The compassionate and caring staff helps to provide a secure environment. Supportive services and amenities allow time for new interests and friendships to form. All in all, Drum Hill boasts an atmosphere which encourages independent seniors to thrive.

ATTORNEYS AT LAW Many Years of Experience Protecting the Legal Interests of the Elderly & Special Needs Populations

Why should I spend money hiring attorneys to do asset protection planning for me and my loved ones? Currently, the monthly cost for nursing home care in New York ranges between $10,000-$15,000, and properly certified home health attendants (nurse aides) can cost as much or more for round- the-clock home care. Statistically, it is likely that most people will need either or both of these care options as they grow older. It is critical that you plan appropriately to best minimize the strain that elder care costs may have on your estate, and to help put you in the best position possible to qualify for benefits that are largely covered by the government, under Medicare or Medicaid. Our firm has attorneys with extensive experience in developing tax-effective action plans for our clients that help protect their assets from government imposition. We have also been very successful in negotiating the complex bureaucratic minefield in which Medicaid is now mired. We have achieved remarkable results for our clients on a host of Medicaid related issues, from obtaining Medicaid approvals for coverage of home care and institutional care benefits, to very accommodative resolutions of Medicaid spousal recovery claims, where the office of Medicaid aggressively pursues the non-institutionalized (i.e., or “community”) spouse for Medicaid benefits provided.

Why should I have a lawyer prepare my will? If you die without a Will, the law, not you, determines how your assets are divided and to whom they are given. A poorly drafted Will may result in a sizeable chunk of your assets not ending up where you want them to go. We are an experienced law firm that can expertly craft your will to address your long-term care, tax, estate planning, and asset protection planning issues. It is in your best interest that planning be done properly so as to minimize the tax burden on your estate. Our experience and skill in the fields of Trusts, Wills, and Estates enables our firm to uniquely tailor estate planning to your individual needs. We will review your entire estate and draft a personalized plan that will best direct the disposition of your assets after death, whether through your Will, or by means of testamentary substitutes (trusts, joint-asset ownership with right of survivorship, or by beneficiary designation in life insurance policies, annuities, or individual retirement accounts).

My father is having difficulty caring for himself. I am afraid he will no longer be able to live on his own. I am worried about finding the money to pay for his care, whether he stays at home or moves to an assisted living facility or nursing home. What do I do?

St. John’s Riverside Hospital Awarded two Genentech Foundation grants for Community Breast Health Education, Outreach, & Screening St. John’s Riverside Hospital has been awarded two Genentech Foundation grants totaling $20,000. The awarded grants are purposed for the education, outreach and screening of breast health in the Yonkers Community. Breast cancer rates in our community are disturbingly high because too many women do not seek and receive appropriate education on the need for breast health screening and detection services. In response to this significant need, St. John’s Riverside Hospital (SJRH) operates four interconnected programs to address breast health and cancer detec-

tion in our community. They include: a breast health community education and outreach program; a comprehensive screening program; two patient navigation programs; and a fully integrated breast treatment program at two of our hospital sites. SJRH cancer services are certified by the American College of Surgeons’ National Accreditation Programs, as both a Breast Center, and as a Community Hospital Cancer Program. Genentech Foundation funds will be used to assist St. John’s Riverside Hospital’s outreach efforts to improve Black and Hispanic women’s access to

education about the importance of and the need for breast screening. In addition to providing a continuum of breast care services, funds will also support our patient navigation programs that provide screening and care coordination by connecting women with breast cancer to treatment, support groups, transportation services, and additional resources. St. John’s Riverside Hospital along with its partner Genentech Foundation is committed to providing the Yonkers community minority women with education and screening services in support of breast health.

A SMILE FOR LIFE Altadonics Dentures Falls don’t “just happen,” and people don’t fall because they get older. Often, more than one underlying cause or risk factor is involved in a fall. A risk factor is something that increases a person’s risk or susceptibility to a medical problem or disease. As the number of risk factors rises, so does the risk of falling. Many falls are linked to a person’s physical condition or a medical problem, such as a chronic disease. Other causes could be safety hazards in the person’s home or community environment. Here is a guide on how to avoid them and keep seniors’ safe:

Risk Factors Muscle weakness, especially in the legs, is one of the most important risk factors. Older people with weak muscles are more likely to fall than are those who maintain their muscle strength, as well as their flexibility and endurance. Your balance and your gait -- how you walk -- are other key factors. Older adults who have poor balance or difficulty walking are more likely than others to fall. These problems may be linked to a lack of exercise or to a neurological cause, arthritis, or other medical conditions and their treatments.

Blood pressure that drops too much when you get up from lying down or sitting can increase your chance of falling. This condition -- called postural hypotension -- might result from dehydration, or certain medications. It might also be linked to diabetes, neurological conditions such as Parkinson’s disease, or an infection.

Compassionate, comprehensive & customized services • Medication Management • Escort to and from Appointments • Bathing Services • Companions/Sitters • Grocery Shopping/Errands

Foot problems that cause painful feet, and wearing unsafe footwear can increase your chance of falling. Backless shoes and slippers, high-heeled shoes, and shoes with smooth leather soles are examples of unsafe footwear that could cause a fall. Not seeing well can also result in falls. One reason is that it may take a while for your eyes to adjust to see clearly when you move between darkness and light. Most Falls Happen at Home Although falls can happen anywhere, well over half of all falls happen at home. Falls at home often happen while a person is doing normal daily activities. Some of these falls are caused by factors in the person’s living environment. A slick floor or a poorly lit stairway may lead to a fall.
