Client Testimonials I reached out to you during the most stressful time of life for both my loved ones and myself - horror had occurred to my dear loving mother. My mom had fractured her hip and due to her frail health and advanced age required risky hip replacement surgery. Many issues legal and otherwise arose which I could not personally resolve. You not only resolved each and every one, but you continue to do so now, over 4 years later. You always display extreme sincerity, compassion and friendship, using your vast experience and confidence in your ability, to continually bring satisfaction, positive results and a tremendous sense of relief and comfort to my loved ones and myself. You have gone out of your way to visit Mom on multiple occasions in her Nursing house and we love you for it. As an attorney, friend, and a great man, I could not possibly hope to know anyone more phenomenal. The three greatest men I have ever known are my dear departed father, my dear departed father-in-law and Ely Rosenzveig. – Jeff D. I hired Ely to assist with my parents estate planning and it was a wise decision. He is a true expert in navigating through complex elder care law and procedures. His guidance was invaluable and his communication excellent. I would strongly recommend his services.

Jewish Home Lifecare Celebrates 11th Sarah Neuman Gourmet Tasting Event On Sunday, May 6th, 180 foodies gathered at Century Country Club in Purchase, NY, for the 11th Sarah Neuman Gourmet Tasting. Sponsored by the Friends of Sarah Neuman, the event raised more than $60,000 earmarked for special programming to enhance the quality of life of elders living at Sarah Neuman Center in Westchester. During the course of the evening, participants sampled the signature cuisines from 12 of the most renowned restaurants and bakeries in Westchester, all of which donated their food for the cause, including Club Car, Douro, La Panetiere, La Provencal, Moscato, Plates, The Willett House, Turkish Maze, Lisi’s Luscious Desserts, Susan Ryan Cakes and 4 O’Clock Cookie. New York Times Food Columnist and cookbook author Melissa Clark shared inside cooking tips, talked about the relationship between food, health and aging and responded to questions as she prepared a roasted salmon dish in front of the crowd. During her remarks, Sarah Neuman Board Chair Lisa Feiner highlighted the exciting renovations taking place on the Sarah Neuman Campus, which will feature the Green House® model of care. She emphasized how the transformation “will fundamentally change nursing care in Westchester by providing elders with more independence, dignity and choice.” Additionally, event founder, Honorary Chair and Sarah Neuman Board Member Pat Jacobs announced that she was underwriting a dining room and living room for the new Sarah Neuman Pavilion 1 building, in memory of her husband, former Sarah Neuman Board Chair Dick Jacobs.

Kathleen Donahue, Beverage Manager, Willett House, holds a photo of her mother, Mary, who spent the last two years over her life at Sarah Neuman Center. “At Sarah Neuman, she made many friends, was active and was no longer isolated like she had been when she lived alone in her Yonkers apartment. She was livelier than she had been in years.” Kathleen, who lives just a few blocks away from Sarah Neuman, visited her mother several times a week; the other residents and staff quickly became her “second family.” Not only did she arrange and pay for lunch at Willett House for her mother and the 60 residents over a period of several months, Kathleen hosts pizza parties for the residents and often volunteers. During the Gourmet Tasting, Kathleen arranged for a generous donation from Willett House – roasted filet mignon on garlic toast points and a choice of sauces.

It is something most of us avoid and often never get around to preparing. But everyone, young and old, wealthy or middle-class, needs an estate plan. By having an estate plan you offer your family members peace of mind during any potential difficult periods. An estate plan addresses not only the transfer of wealth at death, but also important end-of-life decisions, and guardians for minor children. A well-written estate plan can also avoid probate and provide tax savings. In this issue of Boomers & Beyond, we feature the law firm of Ely J. Rosenzveig & Associates, P.C. in White Plains. Ely Rosenzveig and his son, Ariel, practice in all areas of elder law, including trust and estate planning, administration, and litigation, tax counsel, asset protection and special needs planning, Medicaid, Medicare, and Social Security disability benefits, guardianships, long term care planning, spousal recovery claims, and Medicaid lien resolutions. Father and son pride themselves on an unyielding commitment to the zealous advocacy of their clients’ interests. After all, estate planning is an important of all of our lives. Put simply, everyone needs some kind of an estate plan. That means you. Enjoy the issue and the great weather.

Salute to Seniors is a hit, again This salute was, once again, a success. The 45th annual Salute to Seniors was recently held at the Westchester County Center in White Plains, complete with live Motown and Caribbean music, acrobats, more than 100 businesses and government agencies with products and services of special interest to older adults and a Health and Wellness Fair guaranteed to inspire better lifestyles. The Salute was sponsored by the Westchester Public/Private Partnership for Aging Services and three county departments: Senior Programs and Services, Parks and Public Works and Transportation. It drew about 3,000 people. DSPS Commissioner Mae Carpenter said the Salute always takes place in May because it’s Older Americans Month, and this year’s theme is “Unleash the Power of Age.” “I love that theme,” Carpenter said. “Older Americans have lots of power they can use to enhance the quality of life for their communities and for themselves. Seniors who join us at the Salute will get a head start in learning how to do just that.”

The Wartburg Adult Care Community in Mount Vernon provided transportation to the Salute for senior groups and other seniors who live in apartment buildings in southern Westchester. Live entertainment was provided by three newcomers to Salute this year. Guests relaxed and reminisced to the Motown sounds of Linwood Peel, former lead singer for the Drifters, as he performs their unforgettable classics such as “Under the Boardwalk” and “There Goes My Baby.” Enjoy the catchy Caribbean rhythms of Steel Passion, a steel drum band, and be thrilled by the acrobatic duo from WOWfactor Talent. Also new was the “Age of Champions,” a documentary about five competitors who sprint, leap and swim for gold at the National Senior Olympics. They include a tennis player who is 100 years old and grandmothers who play a spirited game of basketball. The award-winning film will be shown at 11 a.m., and is sponsored by Healthways Silver Sneakers Fitness program, which aims to increase physical activity in older adults.

Schaffer Rehab Patient Defies Odds Sound Shore Medical Center of Westchester Schaffer Extended Care Center patient’s determination and expert rehab prove to be strong medicine, making the seemingly impossible, possible In her compromised condition, rehab started at the bedside with the therapist manipulating her limbs and restoring muscle memory. After a rigorous schedule that included as much as two, 1 ½ hour sessions of physical therapy and a half hour of occupational therapy each day, Arguiarro progressed from learning to stand to

taking her first steps in March. Now after seven months, Arguiarro walked out of Schaffer. “This is just one of the many heartwarming stories that unfold when a patient’s desire and the expertise of the dedicated Schaffer staff join forces – proving that working together the seemingly impossible is possible”, said

Susan A. Sales, Vice President for Long Term Care/Administrator of Schaffer Extended Care Center. “Ms. Arguiarro’s will to walk again along with a dedicated Schaffer team resulted in an outcome that defied the odds, and we’re delighted to have been part of her road to recovery.”

provided

Earlier this spring, Valentina Arguiarro walked out of Sound Shore Medical Center’s Schaffer Extended Care Center after seven months of intensive rehabilitative therapy.. In the process, Arguiarro’s inspirational story, was complete. This feel good story isn’t only about Arguiarro, 76. It’s about a rehabilitation department whose staff was dedicated to making the seemingly impossible, possible. With the support of her family, friends and her faith as well as the expertise of an exceptional Schaffer staff, she has defied the odds and inspired many in the process. Last September, Arguiarro was admitted to a borough hospital for shortness of breath. That re-

sulted in a six-week stay and conditions that didn’t permit her return home to her role as the primary caregiver for her aunt. Arguiarro now required caregivers of her own. Having family in the New Rochelle area, she found herself transported to the suburbs for her rehabilitation and intensive physical therapy. A combination that would hopefully restore strength to her weakened limbs and return her to the long walks she loved. For a career woman, who retired after 40 years with JP Morgan Chase as a Vice President, being bedridden was not in the plans. Her will to walk again was as fierce as was the dedication of her chief physical therapist in Schaffer’s rehabilitation department.

Live Richly. You’ve Earned It. Benjamin Franklin, one of our Founding Fathers wrote: “wealth is not his that has it, but his that enjoys it.” In harmony with this thought, we encourage our clients to enjoy the wealth they worked so hard to build. We want them to protect it of course, but not squander it. We urge them to live richly; to enjoy the golden years of retirement. In the end, true wealth is not about money, but about the experiences we share with those we love. To learn more, call us at 845-627-8300 or visit easternplanning.com

Learn to Think, Eat and Be Healthy at Burke Rehabilitation Hospital’s Senior Fitness Day Did you know that physical activity is one of the most important things you can do for your health? It can help control your weight, reduce your risk of cardiovascular disease, strengthen your bones and muscles, and increase your chances of living longer. As you grow older, it is important to continue taking part in physical activities. A recent study at the University of Illinois Urbana-Champaign found that senior citizens who integrated physical activity into a daily routine began to see an improvement in physical fitness, as well as a raised self-esteem. Burke Rehabilitation Hospital encourages seniors to participate in physical activity and educates them about the numerous benefits associated with participating in a daily fitness routine. To bring this message home, Burke will be hosting the 2013 Senior Health and Fitness Day from 8:30 a.m. to 4 p.m. on May 29.

The event will be held in the Rosedale Room of the Billings Building on Burke’s campus, 785 Mamaroneck Ave. in White Plains. The day’s activities include fitness classes, education seminars and self-improvement information sessions aimed at enhancing daily living. "Health and fitness is important throughout our lives but becomes especially important as we age,” said Heather Massimo, director of the Fitness Center at Burke. “We want to motivate and encourage people to continue to perform activities of daily living.” Senior Health and Fitness Day is free and open to the public, with lunch included. Due to space limitations, registration is required. To register, please call Heather Massimo at (914) 597-2578 or e-mail HKEELER@burke.org. Equal Access Campaign Launched: It’s Good Business County Executive Robert P. Astorino joined Joe Bravo, executive director of the Westchester Independent Living Center (WILC), and four county organizations recently to officially launch Equal Access Westchester, a campaign devoted to promoting accessibility for people with disabilities throughout Westchester County.

The Equal Access Westchester Web site provides information on accessible transportation, dining, shopping, lodging, and recreation venues in Westchester County; ADA (Americans with Disabilities Act) information; tax incentives for businesses; Westchester County's Livable Communities Initiative, and more. Equal Access provides opportunities for communities to adapt to the needs of their ever changing demographics and to serve the interests of ALL of their residents. It provides varied business opportunities that serve and are friendly to people of ALL ages and capabilities. And, Equal Access provides an expanded customer base for businesses.

The campaign is designed to help businesses learn how “equal access is good business.” A key tool is a new Web site: Equal Access Westchester. Equal Access Westchester is a unique partnership of the Westchester County Human Rights Commission, Westchester County Department of Senior Programs and Services, Westchester County Office for the Disabled, Westchester County Tourism & Film, and the Westchester Independent Living Center who were united by a mutual commitment to provide accessibility information to Westchester's business community. “This initiative is about expanding opportunities for the disabled and business owners,” said Astorino. “Menus in small type or stores without ramps can keep customers away. Equal Access provides business owners with information and tools they need to make disabled customers satisfied and repeat customers.” “This partnership can be a turning point in accomplishing the goal of equal access for persons with disabilities in Westchester,” Bravo said.

Senior tips for keeping cool and safe in the Here comes the heat, as in the summer. Of course, everyone enjoys a little summer fun. However, high temperatures can take a toll on health. Seniors especially should take extra care to keep cool and hydrated during hot, humid days. Here are a few tips for enjoying the summer weather while keeping comfortable and safe: Clothes – Wear light colors and light materials such as linen and cotton. Materials such as rayon and polyester tend to trap heat close to the skin. – Wear loose fitting clothing. – Wear a hat with a wide brim to protect the face.

Home – Stay indoors during extremely hot weather. – Lower shades, blinds, or close drapes on the east side of your home during the morning hours and the west side during the afternoon in order to keep your home or apartment as cool as possible. Use a fan in the rooms where the windows are covered. – If you do not have air conditioning in your home, go to your local Council on Aging/senior center, Aging Service Access Point, mall, movie theater or library in order to stay cool. continued on next page

ATTORNEYS AT LAW Many Years of Experience Protecting the Legal Interests of the Elderly & Special Needs Populations

Why should I spend money hiring attorneys to do asset protection planning for me and my loved ones? Currently, the monthly cost for nursing home care in New York ranges between $10,000-$15,000, and properly certified home health attendants (nurse aides) can cost as much or more for round- the-clock home care. Statistically, it is likely that most people will need either or both of these care options as they grow older. It is critical that you plan appropriately to best minimize the strain that elder care costs may have on your estate, and to help put you in the best position possible to qualify for benefits that are largely covered by the government, under Medicare or Medicaid. Our firm has attorneys with extensive experience in developing tax-effective action plans for our clients that help protect their assets from government imposition. We have also been very successful in negotiating the complex bureaucratic minefield in which Medicaid is now mired. We have achieved remarkable results for our clients on a host of Medicaid related issues, from obtaining Medicaid approvals for coverage of home care and institutional care benefits, to very accommodative resolutions of Medicaid spousal recovery claims, where the office of Medicaid aggressively pursues the non-institutionalized (i.e., or “community”) spouse for Medicaid benefits provided.

Why should I have a lawyer prepare my will? If you die without a Will, the law, not you, determines how your assets are divided and to whom they are given. A poorly drafted Will may result in a sizeable chunk of your assets not ending up where you want them to go. We are an experienced law firm that can expertly craft your will to address your long-term care, tax, estate planning, and asset protection planning issues. It is in your best interest that planning be done properly so as to minimize the tax burden on your estate. Our experience and skill in the fields of Trusts, Wills, and Estates enables our firm to uniquely tailor estate planning to your individual needs. We will review your entire estate and draft a personalized plan that will best direct the disposition of your assets after death, whether through your Will, or by means of testamentary substitutes (trusts, joint-asset ownership with right of survivorship, or by beneficiary designation in life insurance policies, annuities, or individual retirement accounts).

My father is having difficulty caring for himself. I am afraid he will no longer be able to live on his own. I am worried about finding the money to pay for his care, whether he stays at home or moves to an assisted living facility or nursing home. What do I do?

How to Survive the SQUEEZE of the Boomers Generation

5 Tips

1 2 3 4 5

Update your financial goals regularly: As your family situation evolves, you may need to reassess your target retirement date and the amount of savings you are planning to amass for retirement. Dependent parents and children may translate into financial obligations for you, and the sooner you plan for them, the better. Maintain control of debt: Saying that you’ll eliminate debt from your life may not be a realistic goal. A more achievable bogie may be to steer clear of new debt. With uncertainty approaching, you may want to avoid the lure of your dream home in lieu of a more secure future for your family. Consider what you really need rather than what you want when making major buying decisions requiring long-term financial commitments. Discuss care options with your parents: It may be difficult to approach your parents with this topic, but planning early can pay off both financially and emotionally. If you explore possibilities while your parents are still healthy, more options may be available – plus, your parents can help you work toward mutually desired goals. Protect your assets with insurance: Revisit your disability and life insurance coverage to make sure your family is protected in case you are no longer able to work or suffer an untimely death. Long-term care insurance for you or your parents may also be an option to help offset the asset-draining cost of nursing home or home health care. Put yourself first: As you count down to the end of your career, make sure your retirement plan remains a high priority among your financial obligations. While you can finance many things in life, it’s hard to put retirement on a credit card. Don’t be a Sandwich Generation martyr by putting your own needs after those of your adult children or aging parents. You’ll be a much more valuable parent and child with your own financial house in order.

Sound Shore Extended Care Center earns 4-Star Rating Sound Shore Medical Center recently announced that its Schaffer Extended Care Center’s 4-star ranking in the recently released Centers for Medicare & Medicaid Services report. This Medicare Nursing Home ranking system offers consumers the ability to compare nursing homes. Using health inspection ratings over the last three years, in 10 Quality Measures, the Centers for Medicare and Medicaid assigns stars for the level of quality. This assessment reviews a facility’s performance including staffing with attention to the number of Registered Nurses, Licensed Practical Nurses and Nursing Aides per resident/per day. The Centers for Medicare & Medicaid Services’ report confirms that nursing homes affiliated with hospitals and those that are not-for-profit usually score higher than their counterparts. Both of these benefits apply to Schaffer. The 4-Star Overall Rating - which includes 4 stars in each of the 10 areas of measure – places Schaffer in the top 1/3 of more than 16,000 nursing homes nationally.

Speaking about the Centers for Medicare & Medicaid Services recent report, John R. Spicer, President and CEO of Sound Shore Medical Center, said, “While the Center’s Rating System provides a benchmark, individual’s considering placement for a loved one should still rely on their personal reaction during an onsite visit. A reaction to an in-person observation is vital and should include considerations, such as: Are the residents engaged? Is there good interaction between patients and care staff? Is the facility orderly and clean? Is the staff open to your questions? Can you see your loved one in this setting?” He concluded, “These ratings should help guide a selection, but they should be only one of many factors that determine a placement decision.” “A decision about extended care placement for a loved one is complex. But using the rating system to choose a top-scoring - 4 or 5 star - extended care provider, along with several on-site visits may make the decision a little easier for concerned family members”, commented Vice President for Long Term Care/Administrator of Schaffer Extended Care Center, Susan A. Sales.

HOLES

for your health

There are many health benefits associated with playing golf: Cardiovascular fitness: If you walk a golf course, you earn all the benefits of walking. If you walk your entire 18-hole course, you are traveling nearly five miles. Even if choose to use a golf cart, there’s significant enough benefit from the walking you will do from the cart to the hole. Strength and flexibility: Swinging a golf club is an excellent strength builder, developing flexibility, agility and coordination. These are important qualities to develop when you’re young, but absolutely essential to develop and protect as you get older. Aging: As we get older, it’s harder to get up, to get moving in the morning, to walk up stairs. The flexibility you develop through golf, and the strength you get from the walking, swinging, and other movements will likely help you age more gracefully. Make a friend: Golf is a social game. There’s plenty of time to chat with new friends and get to know new ones. Making friends can help a player’s mental outlook and an overall feeling of well being. Some studies have shown that seniors that remain social and friendly live up to six years longer than those that don’t. Better sleep: Experts say you sleep better when you get regular physical activity, and better sleep benefits your day-to-day activities. And, perhaps, your golf game.

Phelps Memorial Hospital Center’s Vitality Initiative for Seniors

Recent graduates of the Living Well program with Moderators Martin Yablonski of the Westchester County Department of Senior Programs and Services (far left) and Lori Patsey of Open Door Family Medical Centers (far right).

The Phelps Vitality Initiative brings health, wellness and aging-in-place programs to seniors in the community. The gatherings are all free and open to the public. Following are descriptions of the Vitality programs that seniors are enjoying at Phelps:

A&J Home Care, Inc. A name that families have learned to trust with the care of their loved ones.

The Breakfast Club is a social gathering for adults in their second half of life, which meets once a month (except in August and December) on Thursday mornings from 8:30 to 10:30 am. Each Breakfast Club includes a presentation on a health topic, a nutritious breakfast and some light exercise. Cool Conversations is a group that meets after the Breakfast Club to engage in some lively conversation on a variety of interesting topics. The program is meant to be social as well as intellectually stimulating. Mind Games is a fun way to stimulate various cognitive functions – memory, problem solving, focus and speed. If you are you having trouble remembering things or feel that you are easily confused, come join the fun! The Memory Game, Boggle, Set and Sporcle are just a few of the games played, one Wednesday afternoon a month. Senior Steps offers participants health screenings, nutrition education, exercise and special events. The club meets on the first and third Tuesdays of the month from 10 – 11:30 am. Living Well, sponsored by the Westchester County Department of Senior Programs and Services, is a series of six workshops designed to help seniors manage their chronic health problems. Participants get the support they need, find practical ways to deal with pain and fatigue, discover better nutrition and exercise choices, understand new treatment options, and learn better ways to talk with their doctor and family about their health. The Vitality Newsletter is a bi-monthly publication specifically for seniors. To receive the newsletter, either by mail or email, contact Ellen Woods at 914-366-3937 or ewoods@pmhc.us. For more information about any of these programs, call 914-366-3937.
