ritain’s vote to leave the EU undeniably cast a shadow of uncertainty over the country,

However, in the months that have past since Brexit, are we finally starting to see some stability in our economy following the initial shock? The housing market in our core areas was largely unaffected by the vote, despite my initial concerns. In the last three months, we have seen our strongest results of the year for both sales and lettings. Whether you’re a landlord, house-buyer or vendor, you will no doubt have your own feelings on the matter and your current status may or may not be influenced by the impending exit. In a bid to shed some light on the topic, we have collated analysis from some of the industry leaders as they identify key trends and behaviours since June. Turn to page 10 to learn more. NLA responds to RICS’ call to reverse stamp duty surcharge

Newly-elected Trump may impact on London’s housing market ollowing Donald Trump’s victory in the US presidential election, estate agents and market analysts have been reviewing the potential repercussions for Britain’s housing market. Amongst some of the theories, some believe that an indirect consequence of this shock result may be an influx of American buyers in London – and possibly even more permanent American residents offended by Trump’s policies. The election result, combined with a weaker Sterling post Brexit in June, has made London an attractive city for prospective buyers. However, it may not just be fleeing Americans that flock to London. Samuel Blake, Residential Partner at Montagu Evans, comments: “We consider that London could benefit from Trump’s policies. However, we believe the impact is likely to come, not from fleeing Americans, but from wealthy people who would have considered a move to New York

City, in particular from the Middle East, Europe and China.” Jean Liggett, Ohio-born Chief Executive of the UK’s Properties Of The World, says Trump’s success may lead to significant stock market de-stabilisation, but that London’s housing market may benefit. “Investors [may] seek to migrate their portfolios from the US to a more secure and predictable market – the UK. This may even mean that the Sterling could rise in value. Only time will tell how the US property market – and others around the world – will respond to his election victory,” she says.

Says: “As with Brexit, I expect to see confidence in the housing market knocked slightly in the shorter term, but this will coincide with the quieter period over the festive season. However, I don’t expect to see this having any effect at the lower end of the market ranging from £80k to £300k, a slight slow down from £300k to £500k and a bigger drop off in properties over £500k.

Commenting on RICS’ call to reverse the stamp duty surcharge on additional homes, Richard Lambert, CEO of the National Landlords Association (NLA), said: “The stamp duty surcharge for second home purchases was nothing more than a crowd-pleasing policy from a Government that was dead set on championing homeownership at all costs. However, it frankly isn’t raising any money for the exchequer, so it makes sense for Mr Hammond to reverse it and give private residential investors the opportunity to help ease the housing crisis. This Government should be commended for setting out a programme for building one million homes by 2020 and it needs to put the effort into making sure this is

Property supply falls in October Four out of five UK towns and cities experienced a drop in property supply in October, with the number of new listings down 6.9% on average across the UK, according to the latest Property Supply Index from online estate agent, HouseSimple.com. In September, supply levels were up following the summer’s traditional property market lull. However, in October – a typically busy month for property market activity – new property listings fell in 81% of towns and cities.


1 in 3 UK homeowners regret DIY Home services marketplace Plentific.com’s latest survey has found that over a third (35%) of UK homeowners have regretted the results of a DIY project and wish that they had called in a professional to handle it. Depending on the size of the project, many attempt the work unsupervised in an effort to save money. However, according to Plentific’s statistics, 1 in 3 find their results less than pleasing, and in retrospect, would have chosen to hire a specialist instead. Could this mean the demand for trade professionals can only continue to grow? The younger generation struggle most with DIY, as half (48%) of those aged 18-34 said they have regretted their past results. This high percentage may be down to them being relatively fresh on the property ladder and having yet to gain the relevant experience in DIY. It seems 18-34 year olds would save time, effort and enjoy a more pleasing end result by hiring in a specialist.

Minimum space standards will squeeze renters One of London’s leading property consultancies has warned that plans to introduce minimum space requirements for rooms in the private rented sector will ultimately harm renters. Under new measures designed to target ‘rogue’ landlords, the Government is proposing a mandatory standard of 70ft2 for rooms and a wider licensing of rental properties, which it says will stop the exploitation of tenants. However, Julian Goddard, Head of Residential at

Daniel Watney LLP, cautioned the suggested regulations would harm renters willing to compromise on space in order to save money, and also didn’t reflect recent technological changes. Julian said: “While well intentioned, these minimum space requirements for the rental market will do little to help people looking for cheaper options to live, especially in ultracompetitive locations like London. They also fail to recognise the huge shifts in technology that mean we are increasingly ‘assetlight’. From streaming music on Spotify to watching films on Netflix, people are owning less and less physical copies and relying more and more on digital services, reducing the need for storage space. Housing policy should be made for the future, not the past.”

Befriend your tenants for financial returns Landlords who invest in building relationships with their occupiers will see a 1.9% increase in financial returns, new academic research shows. The findings of the three-year PhD research by Dr Danielle Sanderson from the University of Reading confirm a link between customer satisfaction and property performance. The research provides quantitative evidence to show that a rise in occupier satisfaction by one level (on a five point scale) will typically improve total returns by 1.9% a year.

1 in 5 landlords too embarrassed to admit it Can't sell? Don't want to sell? Property owners who are struggling to sell their home have been offered a lifeline, with the launch of a new service that makes short-term letting effortless. My Property Host is a property management service that handles every aspect of letting out a property on Airbnb. It takes care of everything, from creating the advert to taking bookings, greeting guests and cleaning up afterwards. My Property Host’s Managing Director, Elena Lopez, explains: “Airbnb’s one Achilles heel is that it offers no proper insurance cover as part of its letting agreement, making insurance a worrying blindspot for hosts. My Property Host is a complete management service designed to make the whole Airbnb process effortless and worry-free. With the property market still unsettled following the Brexit referendum, homes are taking longer to sell and many would-be sellers are holding off on putting their property on the market until things calm down.”

This is according to a recent poll of almost 800 residential property investors. Across the UK, more landlords in the East of England and the East Midlands said they were embarrassed to admit it compared to any other region. At the other end of the scale, the English regions with the fewest embarrassed landlords were the South East and Yorkshire and Humber. Approximately 400,000 of the UK’s two million landlords avoid telling people what they do. The NLA says that despite bad press, the majority of tenants are satisfied with their current landlord and tenancy.

440,000 landlords to be forced up a tax bracket from April 2017 More than 400,000 landlords who pay the basic rate of tax will be forced into a higher tax bracket from April next year as planned changes to landlord taxation come into force. The changes, once fully phased in by 2021, will mean landlords will no longer be able to deduct mortgage interest payments or any other finance-related costs from their turnover before declaring their taxable income. All landlords could be at risk of seeing their tax liability increase regardless of their existing rate of tax.

Third of landlords worried by Brexit More than a third of landlords (35%) think that leaving the EU will have a negative impact on their ability to attract tenants in the future, according to findings from the NLA. The findings also show that 39% believe Brexit will have no significant impact on their business; 21% are unsure; while 5% believe it will have a positive impact. The research follows Theresa May’s announcement that the process of leaving the EU will be triggered by March 2017.

Online Estate Agents Just like the travel industry, the property market is becoming increasingly dominated by the internet. Online estate agents may market themselves to be cheaper, but can they really provide a high-quality, personal service that customers have come to expect with traditional high street agents?

here’s no question that selling your home is an extremely stressful and expensive time. In a bid to take the hassle out of this process and venture down a more economical route, more and more people are turning to online estate agents as an alternative solution, but how do online agents differ from high street branches and will they ever be a viable option? Relatively speaking, the process is not all that different. Traditionally, the way in which you sell your house (if you are using a traditional estate agent) is that the agent will come round and carry out a property valuation. Online agencies will also offer a physical valuation, however the person who carries this out will normally cover a vast area, such as the whole of the South East, rather than just a specific town or village. This can lead to inaccurate valuations as the sales rep will not know the area and buyers in that area as well as a local estate agent. As well as physical property valuations, some online estate agents will also offer an online property valuation where you simply input your property information into a valuation tool.

An account manager will then get back to you with a guide price. Your home will also be marketed in exactly the same way. Someone will visit the property and take photographs, create floorplans and a brochure and advertise via the same portals. However, there’s the upfront flat fee. There is not a standard industry fee, as such, with online

agents – it will differ from agent to agent – but the cost can be as low as £395, regardless of how much your home sells for – that’s if it sells at all. You will have to pay even if that company doesn’t end up selling your house. High street agents, however, will charge a percentage of the selling price (the average estate agent fee is 1.3% according to conveyancing

firm, MyHomeMove). On paper, selling online will save you money, yet it’s worth remembering that an online agency has less incentive to negotiate the best possible price for you. This is not to mention the potential headaches that will come from liaising with buyers and solicitors. Some online agents will act as the middleman for you, but you would need to check the terms of your agreement or pay an additional fee.

Working 9 till 5? Another aspect that vendors seem to favour with the online route is the around-the-clock service. By using an online estate agent, vendors find one of the main benefits is being able to access the site or schedule in a viewing at a time that suits them. Online agencies pride themselves on being flexible and convenient – call centres are open outside of working hours and on weekends, so you don’t have to wait for a high street branch to open.

Although some online agents will assign you a personal account manager, this is not standard. This may mean you might end up having several points of contact or no contacts at all. It is here that you will really get to

see whether the service is as smooth as it claims to be. With high street estate agents, you have one point of contact throughout the whole process. You will build a good relationship with that agent, they will know your concerns and hesitations, understand your needs, they will have your best interests at heart and they will, of course, be incentivised. Some

people just like the reassurance that they are dealing with a ‘real’ person.

Insider insight By choosing a local high street agent, you are also paying for their local knowledge. This will pay dividends when it comes to the value and, ultimately, sale of your home. Local high street agents will be aware of

All of this market insight will impact hugely on achieving the best possible selling price of your home. What’s more, a traditional high street estate agent will normally have access to a large number of local buyers and will know the areas they are interested in. That being said, even if you’ve got the perfect package – a home with bags of potential, a proactive marketing strategy and a committed team behind you all the way – unfortunately, it doesn’t always pan out. With high street estate agents, you are tied into a contract. A Sole Agency Agreement is the most common type of estate agent contract and it means that the estate agent is the only agent with the right to sell your home during the term of the contract. If you aren’t getting the results you want, this will leave you both in a difficult position. One of the greatest advantages of online estate agents is the freedom to use multiple agents. Generally, there are no contract terms, therefore you, as the vendor, are well within your rights to instruct other agents if you wish. This is down to the fact you have already paid them a fee.

As technology develops, more and more companies will start to offer accessible and affordable online packages. However, when it comes down to it, it is personal preference. If you’re looking for a personal service with a consistent and knowledgeable point of contact, high street estate agents are well positioned to offer you this. You need to ask yourself what matters to you the most, and who is more likely to deliver the results. 

With many re-evaluating their objectives, changing their strategy, moving to limited company ownership or focusing on capital appreciation, they are ultimately continuing to invest.” 

Despite the fearmongering and confusion which has surrounded the topic, Plentific’s statistics show that homeowners are now more relaxed about the idea of spending money on their property. Interestingly, our research highlights the current nervous property market in London, with a quarter of Londoners ready to cash in and sell up.” *Research from Opinium via online surveys. Matthew Groves, Maidstone Branch Manager at Ben Siggins Estate Agents, reveals why he’s so passionate about Maidstone and reflects on the current property market.

What is your favourite part of Kent and why? M: I actually love where I live and that’s why I am so passionate about the properties I market and deal with. Maidstone and the surrounding areas offer everything from cosmopolitan living to the rolling fields of the countryside and beautiful country pubs.

What do you find is the most common misconception with customers buying or selling a property? M: I think buyers and sellers alike are completely unaware of the fantastic market conditions regarding the current interest rates and property prices available. It now creates many options, where the door is now open to move to that better home and release equity or get your foot firmly on the property ladder with the fantastic mortgage deals available.

If you were not an estate agent, what would you see yourself doing? M: I would love to be a model and get paid loads of money for being seriously good looking – but that will never happen!

After a few years, I returned and worked for the large corporate estate agent, Your Move. I entered the company as office junior and worked up to become a valuation/ branch manager. What do you enjoy most about working in the property industry? M: I love the aspect that every day is different and the property market is always changing. When you are not selling properties, what do you like to do in your spare time? M: When I have spare time I love to spend it relaxing and unwinding with my partner and daughter and the new addition to the family, Blue, who is our Husky puppy.

How do you anticipate the property market to perform over the next 12 months? M: I expect the market to steadily creep upwards due to the low interest rates and huge demand for property, which isn’t going to go anywhere soon. 

What would be your dream home? M: My dream home would be a rural barn conversion

As a landlord you have three main responsibilities: • Maintenance Pipework, appliances and flues must be maintained in a safe condition. • Gas safety checks A 12-monthly gas safety check must be carried out on every gas appliance and flue. • Record You must provide your tenant with a record of the annual gas safety check within 28 days of the check being completed, or to new tenants before they move in. 5

A guide to letting your property Thinking about letting your home or investing in a buy-to-let property? The process can be a complex one i.e. the legal procedures, but the rewards can be handsome if you get everything right.

Notify your lender

If you already have a residential mortgage, you are obliged to inform your lender that you are intending to let your property. Your lender needs to give you formal ‘Consent to Let’ before you can do this. Your decision to let may mean that you are put onto a higher Buy-to-Let interest rate. If you fail to notify your lender that you are letting out your property, this will put you in breach of your mortgage agreement. You may also need to obtain permission elsewhere. For example, from your leaseholder if the flat is held on a long lease. 2

Gas safety

As a landlord, you have legal responsibilities to your tenants regarding gas safety. Landlords’ responsibilities are included in the Gas Safety (Installation and Use) Regulations 1998. This law aims to ensure that all gas appliances, fittings and flues featured in the property are safe.

Fire safety

As a landlord, it is your duty to follow the required safety regulations. You must provide a smoke alarm on each storey and provide a carbon monoxide alarm in rooms with a usable fireplace or wood burner. It is

Before any alterations are made to your property in preparation for tenants, make sure you have the necessary planning permission. This may be needed if you are converting a property

to an HMO (i.e. a house in multiple occupation). This is something you should consider if you are going to have more than two tenants, who are not members of the same family, in the property.

If you are going to do any building work to the property, it is vital to check whether you need approval under the Building Regulations. Your builder or architect will be able to advise you on how to comply. Be aware that Building Regulation approval and planning permission are not the same and, therefore, have to be applied for separately.

Energy performance

Where a dwelling is being let, an Energy Performance Certificate (EPC) will be required. The certificate will show the energyefficiency levels of a property, so a prospective tenant is able to determine and compare the relative financial running costs of renting your property. A copy of the certificate must be given to any tenant who moves in to the property. To obtain a certificate, your property must be assessed by an accredited energy surveyor. There are plenty of providers who offer a EPC – simply shop around online to find one that suits you.

Essentially, you are running a business and therefore it is important that you keep clear records. Not only will it mean you’re organised and up to date, but you’re also required to keep certain documents by law and for tax purposes. As well as any receipts, bank statements and invoices, you must remember to keep a logbook of all gas and electrical safety certificates, the property’s energy performance certification, safety information regarding the property’s furniture and furnishings, plus a fire safety risk assessment form if applicable.

Know the law

The private rental market is a legal minefield. In today’s ‘compensation culture’, it is vital that you are fully aware of your legal obligations, and remain up to date with legislation which is forever changing. The Association of Independent Inventory Clerks is still experiencing frequent enquiries regarding new

legislative changes, such as those involving smoke alarms (refer to Fire safety for further guidance). While it’s important to comply with trading standards to welcome new tenants, it’s also essential that you adhere to a strict process when evicting current occupants. Failure to use the correct methods will result in significant delays and consequent rental losses. It is recommended to always seek legal advice first. 11

Choosing an agent

Letting agents can help new and experienced landlords with every aspect of the letting process. Some landlords will choose a letting agent to simply market a property and then take over the management of their rental property once a tenant is in place. Other landlords prefer the entire process and would rather take on all of the responsibilities themselves. Agents usually charge letting fees on a monthly basis. Letting fees are usually payable in advance of the term of agreement. The size of the fee depends on the level of service required, and is usually a percentage of the rent.
