KOSKOFF Koskoff & Bieder (Koskoff) is a three-generation law firm that has been fighting to protect the rights for Connecticut families and individuals for over 80 years. The nationally known firm has secured historic victories in court, established groundbreaking changes in the law to protect the people in Connecticut and successfully handled thousands of substantial cases on behalf of people who have suffered serious personal injuries and wrongful death through the fault, negligence, wrongdoing or carelessness of others.

“My grandfather was a big believer in fighting for the underdog and for regular people. He believed with every bone in his body that the role of the lawyer was that of a fighter with only one objective: to serve the best interests of his clients,” said Josh Koskoff, the third generation Koskoff that leads the firm today. “My grandfather was a bit of a gambler but not in the traditional sense. He bet on the goodness of people, especially people who sat on juries. There was no fight too hard or challenging and no opponent too powerful or influential that would deter my grandfather from representing someone who had been unjustly wronged. He thrived on taking cases that others felt were unwinnable or too difficult.”

In 2022 alone, Koskoff solidified its reputation as one of the most resilient and prominent law firms in the United States, obtaining several historic victories and litigating and resolving civil matters from catastrophic injury and wrongful death to sexual abuse to civil rights and defamation. These victories included:

• Koskoff lawyers successfully bringing to conclusion its groundbreaking representation of nine families of

victims killed at the Sandy Hook School against Remington Arms Corp., the manufacturer and the marketer of the AR-15 used in the shooting that took the lives of 26 people, including 20 first grade children. The case was deemed unwinnable by “legal experts” when it was filed in 2014 because of a special immunity that gun manufacturers were given by the government that protected them from lawsuits. But the Koskoff team fought through the immunity and the results were historic: they not only obtained a massive settlement of $73 million, but also secured the right to make the documents they discovered in the case public. The precedent-setting case is the first time in U.S. history that a gun manufacturer has been held accountable for a mass shooting.

• Koskoff lawyers securing one of the largest settlements by the State of Connecticut—nearly $10 million—for the criminal neglect and abuse of a psychiatrically impaired patient at a state mental institution in a case that shed light on systemic inadequacies in the state’s care of vulnerable psychiatric patients. In addition to the settlement, the case resulted in substantial systemic changes that will protect future patients from similar neglect.

• Koskoff lawyers winning a historic victory on behalf of the Connecticut descendant of an enslaved father and daughter who were abused and photographed by a Harvard scientist in 1850. Harvard University will now face accountability for its seizure of their photos taken in 1850. In this precedent-setting claim, Koskoff aims to hold Harvard liable for negligent and reckless emotional distress for

their treatment of both the plaintiff and her ancestors.

• Koskoff lawyers securing the largest defamation verdict in American history against Alex Jones on behalf of 14 family members of those killed in the Sandy Hook School shooting and a first-responding FBI officer. The plaintiffs suffered years of mental, emotional and psychological torment as a result of Alex Jones’ false claims that the shooting was a staged hoax perpetrated by the government in order to take away people’s guns, and that the families and children were actors or weren’t real. After a monthlong trial, the jury returned a verdict against Jones of $965 million, and the court awarded punitive damages that brought the verdict to nearly $1.5 billion.

“Both my dad and grandfather believed in using the legal system to do good things for people who needed you,” said Koskoff. “We work collaboratively in a creative process designed to tackle challenges in our individual cases. We call on each other’s experience, knowledge and insight all the time and the only competition is a competition to come up with the best suggestion or strategy for a given problem. The combination of elevating the service aspect of our profession over business considerations, and collaboration over competition, has been a critical ingredient in our success at serving the interests of our clients. It also allows us the latitude to take on risky cases against powerful interests, cases that often present significant and daunting legal challenges but where the wrongdoing compels a challenge and the impact to an individual, family or community is profound.”

METRO MAP

In order to collect feedback on firm and attorney work within specific regions, Best Lawyers curates “metro areas.”

For research purposes, smaller and more rural cities located within a reasonable distance to larger cities are combined into single geographical regions—metro areas—to help us collect as much feedback and data for specific individuals, firms, and practice areas as possible. We also award “Lawyer of the Year” accolades through these metro area distinctions.

ABOUT US

For more than four decades, Best Lawyers lists have been compiled by conducting exhaustive peer-review surveys in which tens of thousands of leading lawyers confidentially evaluate their professional peers. If the votes for an attorney are positive enough for inclusion in Best Lawyers, that attorney must maintain those votes in subsequent polls to remain on the list for each edition. Connecticut’s “Clean Slate” Act Could Bolster State Workforce

ON JANUARY 1, 2023, almost two years after state lawmakers proposed it, Connecticut’s Governor Ned Lamont signed Public Act No. 21-32, or the “Clean Slate” Act, into law. Once enacted, the law dissolved roughly 44,000 low-level drug convictions, specifically cannabis possession, as a part of the state’s automated erasure system launch. The law grants automatic erasure for any class D or E felony convictions between 2000 and September 30, 2015, or 10 years after the court’s last judgment of the individual in question.

With that, the Clean Slate law’s provisions for automatic erasure only affect individuals with misdemeanors or low-level felony records. They will not apply to those convicted of sexual offenses, domestic violence or firearmrelated crimes. With parts of the law still waiting to take effect, there are many changes state employers must prepare for to remain compliant with future employment and hiring practices.

Even before the Clean Slate Act was successfully passed, Connecticut already had conviction-based employment legislation set in place. In 2016, state lawmakers enacted the “Ban-the-Box” law, which prohibited employers from denying individual employment solely based on that applicant’s prior arrests, criminal charges or convictions listed on an application. Additionally, any job application containing questions concerning criminal history must

include a notice notifying the applicant that they are not required to disclose any information. The Clean Slate Act expands upon these provisions by not only applying to prospective applicants but also current employees by prohibiting employers from discriminating against individuals with an expunged criminal record.

“This is really great news for employers because there are 100,000 open jobs and not enough people to take those jobs. It’s so important that as people come out of our corrections system, they have the opportunities to make use of job training programs. It is a small step, but an important step to start erasing disparities, segregation and inequities that still exist in our state,” stated Lieutenant Governor Susan Bysiewicz, as reported by the Hartford Business Journal.

According to state lawmakers, employers who violate the provisions of the Clean State Act may face discriminatory practice claims, severe monetary fines or an employee-filed complaint that could bring about legal action in the Connecticut Superior Court. Sooner rather than later, Connecticutbased employers should consider the impact these laws will have on longstanding employment structures by briefing all personnel involved, namely those responsible for hiring, interviewing and onboarding. With that, employers may need to also review and revise their current equal employment opportunity policies and any active job applications to fit the new law’s criteria.

Of her practice area, McGarrity stated: “I enjoy working with and developing long-term relationships with a broad range of clients across multiple industries while meeting the challenge of a constantly evolving employee benefits landscape. Over the past year, employers and benefits professionals have grappled with employee recruitment and retention, rising benefits costs, hybrid and remote work models and the lingering effects of the COVID-19 pandemic. At the same time, there have been significant judicial and regulatory developments in the field of employee benefits affecting employers and their businesses. It is my role to help clients successfully navigate these complex planning considerations, and avoid compliance pitfalls, so they can better focus on everyday business concerns.”

McGarrity attributes knowing her audience to her continued success within the practice area. For McGarrity, being able to listen to clients effectively, understand their problems and distill often complex legal matters into clear, strategic advice can be paramount and make all the difference in the result of a case. “A great attorney always knows their audience and can adopt a multifaceted perspective while shaping effective communications that drive action,” McGarity stated.

McGarrity is also an active part of other initiatives outside the courtroom. She is a regular contributing author to her firm’s online blog, Data Privacy + Security Insider, and provides lectures nationwide on health care reform, ERISA and ongoing HIPAA issues. She was also recently appointed ViceChair of the firm’s Diversity, Equity + Inclusion committee. Of her firms’ work, she stated, “I am incredibly proud of Robison & Cole’s commitment to increasing representation in leadership and the field of law.”

Securing Justice in the Aftermath of Tragedy

Koskoff Koskoff & Bieder has always fought for truth. In 2022, the firm exposed how an infamous opportunist weaponized lies and misinformation at the expense of families still grieving those taken in the Sandy Hook Elementary School shooting. After several years and various challenges in and out of the courtroom, the firm’s advocacy resulted a historic $1.4 billion verdict in Connecticut Superior Court that hopefully marks an inflection point in America.

DECEMBER 2022 MARKED 10 YEARS since the horrific mass shooting at Sandy Hook Elementary School in Newtown, Connecticut in 2012. That unfathomable tragedy–in which 20 six-and seven-year-old children and six adult school staff members were killed by a lone gunman–devastated the quiet New England community and the entire nation.

As the grieving families began the lifelong healing process, they were further pained when Infowars owner and conspiracy theorist Alex Jones falsely and repeatedly claimed on his broadcasts that the shooting was a hoax and that the victims were actors in a plot to destroy gun rights in the U.S.

“The families endured awful harassment that started on Infowars and permeated their lives,” says Christopher Mattei of the law firm Koskoff Koskoff & Bieder (Koskoff). Located just 20 miles away from Newtown, Koskoff had roots in the community and

8 | CONNECTICUT

represented many of the plaintiffs in a liability suit against the manufacturer of the weapon used in the shooting.

Fifteen individuals targeted by Jones’ remarks (including one FBI agent whom Jones had accused of being an actor) had endured enough of the broadcasted lies and harassment, and in 2018, Koskoff lawyers Christopher Mattei, Josh Koskoff, Alinor Sterling and Matt Blumenthal led the charge in the defamation suit against the infamous conspiracy theorist.

“Due to Alex Jones’ lies,” Mattei notes, “Infowars listeners were tormenting surviving family members in-person and online—with some being called ‘liars and frauds,’ while others received threats of death and rape. There was no way we could let this continue and were determined to stop it at the source.”

Despite the severity of the charges, Jones continued to use Infowars as a platform to antagonize the Koskoff team and the plaintiffs. On one installment of his show, Jones referred to Mattei and announced a $1 million bounty for his “head on a pike.” A former Assistant United States Attorney, Mattei had tried high-profile cases in the past that received national media attention— but suddenly found himself targeted by the defendant and his hostile audience.

“[Jones] had done similar things in the past and we knew it could have real-life repercussions,” says Mattei, who has been recognized in The Best Lawyers in America® for Personal Injury Litigation – Plaintiffs since 2020. “It concerned my family a bit and our firm’s staff who are amazing but not accustomed to being in the middle

of controversy. It was very upsetting and disturbing for them.”

Jones was sanctioned by the court for the statement and lost his special motion to dismiss, which he appealed to the Connecticut Supreme Court and also lost. Superior Court Judge Barbara Bellis cited inappropriate conduct by Jones’ attorneys regarding depositions and the “callous disregard of their obligation” to turn over financial and web analytics data.

Though Jones eventually conceded that the shooting was not a hoax in a separate trial in Texas, he displayed courtroom antics in Connecticut that transcended typical legal maneuvers. Most notably, he referred to Judge Bellis as a “tyrant” and unsuccessfully tried to remove her from presiding over the case. Following additional over-the-top stall tactics by Jones’ lawyers in court, Judge Bellis issued a default in the lawsuits, one of the harshest sanctions possible.

With Jones’ inability to win established, the trial in Connecticut Superior Court commenced in Fall 2022 to determine damages. Throughout the hearings, Koskoff’s trial team stood in the unenviable position of questioning the uncooperative and oftentimes combative defendant. Their poise, professionalism and ability to remain on point clearly convinced the jury of the harm Jones had caused.

On October 12, 2022, the jury awarded a historic $965 million in defamation and emotional distress damages to be paid by Jones and his company, Free Speech Systems (parent company of Infowars).

“Once the testimony came out at trial, it was a revelation to the world about both

what these families had gone through, and also just how endangered their lives had become,” Mattei notes. “Some had to move and others were being confronted in person and intimidated by Jones’ audience. These lies deprived the families of their ability to grieve properly and unleashed a decade of fear and abuse that compounded their unimaginable loss.”

In November 2022, Judge Bellis also temporarily blocked Jones from transferring or moving assets out of the U.S. at the request of the plaintiffs who claimed Jones would attempt to avoid payment. Just one week later, the judge ordered Jones and Free Speech Systems to pay an additional $473 million in punitive damages to eight of the plaintiff families as well as the FBI agent.

Though Free Speech Systems had already filed a bankruptcy claim in August 2022 and Jones later filed for Chapter 11 personal bankruptcy protection in Texas in December, the filing noted that the estimated worth of Jones’ assets was between $1 and $10 million, with liabilities between $1 and $10 billion. Koskoff has aligned with a bankruptcy firm in Texas to ensure that justice is carried out and that Jones does not avoid compensating the plaintiffs.

“The results will stay on everyone’s minds,” Mattei says. “Every time Alex Jones’ name is mentioned, so will be the verdicts and the damages. We showed in court that there are real consequences for projecting lies and misinformation and our case hopefully helps society-at-large understand the threats and risks that misinformation poses. I hope it stands out as an inflection point for how we deal with this in the future.”

THE PEOPLE’S PERSONAL INJURY ATTORNEYS

Representing only plaintiffs

PERSONAL INJURY | MEDICAL MALPRACTICE

Few law firms in Connecticut represent only plaintiffs—people who have been harmed or killed due to negligence. The Reardon Law Firm is one of them. For decades, the attorneys have relentlessly fought to achieve the best possible results for victims of negligence. They don’t handle real estate closings or estate planning, and, most importantly, they never defend insurance companies or corporations.

Founder Robert I. Reardon, Jr. remains at the helm, and Kelly E. Reardon is the managing partner.

Partners Joseph M. Barnes and John J. Nazzaro and Associate Kelsey L. Johnson complete the team. Daily, they tackle complex cases involving such matters as medical malpractice, catastrophic injury, sexual abuse and product liability, including medical devices.

Together, the team has secured a record of multimillion-dollar verdicts and settlements. They will not stop until clients receive the best possible outcome and can face a future with hope.

THE REARDON LAW FIRM, P.C. 160 Hempstead St. New London, CT 06320 PH: (860) 442-0444 PH: (860) 444-6445 reardonlaw.com

THE FIRM

Rutkin, Oldham & Griffin is a well-established boutique matrimonial law firm with a team of attorneys who exclusively practice family law. We provide sophisticated legal services to clients in all areas of family law and have extensive experience resolving high net worth cases with innovative solutions. Our attorneys work diligently to solve problems and attain the most favorable results for clients while maintaining their privacy with the utmost discretion and compassion.

COMPLEX DIVORCES & CUSTODY DISPUTES

We routinely navigate clients through high-stakes divorce. The majority of our clients have challenging cases due to complex property division issues or because alimony, child support and custody are being contested. Our depth in this niche is well known and differentiates Rutkin, Oldham & Griffin from other firms. We limit the number of cases we take to ensure that all clients receive the highest quality of service and personal attention.

“ONES TO WATCH” RECOGNITIONS

These recognitions are given to attorneys who are earlier in their careers for outstanding professional excellence in private practice in the United States. Our “Ones to Watch” recipients typically have been in practice for 5-9 years. Our methodology for determining these awards remains the same as it did when Best Lawyers was founded more than 40 years ago: peer-review. Lawyers are the best resource to provide feedback on the caliber of work performed by their peers. “Ones to Watch” is not a seed list to Best Lawyers and all hopeful candidates must be nominated and vetted by their peers recognized in Best Lawyers. Visit bestlawyers.com/ones-to-watch for more details
