Texas Lawmakers Authorize Initial Framework for Wind and Solar Projects

KNOWN AS THE top U.S. state in oil and natural gas production, Texas is currently going through a renewable energy boom, with many state lawmakers pushing for legislation that would increase the overall construction and operation of wind and solar energy projects in the near future. The proposed legislation, referred to as S.B. 624 and its companion, H.B. 3707, would require all currently active wind and solar energy facilities in Texas, even those in

the midst of construction, to apply for government permits with the Public Utilities Commission. Once granted a permit, facilities that fall under this scope will be subject to regular environmental assessments and public hearing requirements, allowing for more transparency within the state’s already formidable energy sector. This meteoric shift in regulatory approach is one of many necessary changes for the state. According to legal experts, the public’s interest is heavily rooted in the

protection of native wildlife, increasing overall water quality across the state and defending untouched land against the harsh impacts that non-renewable energy generating facilities, such as coal manufacturing or oil production, often have on the environment.

Fossil fuel advocates across the state remain wary of the potential cost associated with such a drastic redirection in policy, though. Irfan Khan, assistant professor of electrical and computer engineering at Texas A&M, believes that once all necessary systems are set in place, costs will level out for customers across the state. “Texas is rich in wind speed and rich in sun. While there is a lot of initial investment, after the wind turbines are erected, the cost of wind is cheaper. Currently, the grid cannot handle all the renewable energy that already exists in Texas. If we do not have transmission lines to support the renewable energy that feeds to the grid, then it’s useless,” stated Khan, as reported by EcoWatch.

Texas, which is quickly becoming the leading state in wind power, is currently on track to eclipse California with the largest solar capacity in the U.S. by the end of this year. Well before Congress passed the Inflation Reduction Act in 2022, which featured roughly $360 billion in clean-energy subsidies meant to support solar and wind development, the idea of incorporating more renewable technologies into the state’s power grid was already a topic of much debate.

With these bills still in the early stages of the legislative process, renewable energy developers, climate change activists and energy investors are expected to play a massive role in the outcome of this environmental plan. As it stands, Texas ranks the highest in electricity consumption yearly out of any state, meaning continued efforts to preserve fossil fuel usage could severely limit the federal government’s goals of eliminating carbon from the country’s national power system entirely.

Jessie Adams, on March 21, 2019, went to her doctor for an epidural steroid injection to alleviate the chronic back pain she was experiencing prior to a trip out of state for a funeral. Almost immediately, she could feel a difference but not in the way that was expected. The pain intensified, with accompanying loss of feeling in her legs. Her symptoms pointed to the likelihood that the injection had nicked a blood vessel, causing Jessie to hemorrhage, says Simmons.

The staff at the clinic monitored her condition before ultimately determining she needed to be transported to Texas Health Presbyterian Hospital in Flower Mound for care. Once arriving

in the emergency room, an MRI was immediately ordered. However, the vital procedure not only did not occur “STAT” as ordered, but it also was delayed by more than 90 minutes.

“In a medical emergency such as this, time is of the essence to prevent significant permanent injury, including paralysis,” says Lyons. “But the staff ignored the hospital policies. The person responsible for the MRI even clocked out after being told that it was needed to be done immediately.”

By the time Jessie finally went into surgery later in the evening, the damage had already been done, permanently rendering her paraplegic.

When the case went to trial under Texas law, Lyons & Simmons faced the need to meet a stringent standard of proving “willful and wanton negligence” (which mirrors gross negligence) on the part of the hospital. This higher standard makes emergency room cases very difficult for plaintiffs to recover.

“There was a conscious disregard for patient safety that was impossible to dismiss,” says Simmons. “The failures were not just those of one person but of multiple staff members throughout the chain of care who failed Jessie. We were determined that the hospital be held accountable and force them to confront the systemic changes needed.”

THEyear 2023 marks 30 years since the tragic siege of the Branch Davidian compound near Waco, Texas, by the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives. For Dan Cogdell, a Houstonbased criminal defense attorney, this event was a defining moment: Cogdell achieved an acquittal for his client in the murder trial of 11 Branch Davidians involved in the standoff. Now, this trial is being revisited in the new Showtime miniseries, “Waco: The Aftermath,” which offers a fresh perspective on an important moment in American history and a pivotal one in Cogdell’s career.

“After trying hundreds and hundreds of cases for 40-plus years, I’m suddenly an overnight sensation,” jokes Cogdell of the miniseries, in which he is portrayed by the actor Giovanni Ribisi. “I never knew anybody else would want to be me, much less get paid to be me—it’s flattering and disconcerting all at the same time.”

Reflecting on the significance of the Waco siege, Cogdell believes that it marked a turning point in American history leading to greater division and distrust between the government and its citizens. “I didn’t perceive it back then, but certainly

retrospectively, I think that was the beginning of the great division in our country,” he says.

“At the time, around 50% of the people we polled believed the Branch Davidians were completely guilty simply because of their religious beliefs, while the other half were outraged by the government’s conduct. I think you can draw a straight line from there to what happened on January 6, 2021, when otherwise law-abiding citizens stormed the

overreach in his current practice, though not necessarily to the extent of storming down his clients’ home or business with tanks. Instead, he sees the government filing multiple charges against his clients to gain leverage during plea negotiations, engaging in unnecessary discovery disputes or violating their prosecutorial obligations imposed by the law. “One could argue that I’m more sensitive to this issue because I’ve seen such incredible,

capital because they believed a false election had taken place and the government was taking away their rights. I had to laugh when I saw that Donald Trump even picked Waco as the place to launch his 2024 presidential campaign.”

While Cogdell has shifted his focus from “blood and guts work” like the Waco case to white-collar crime, he still observes government

outrageous government misconduct in my past. But the fact remains that government prosecutors are still trampling people’s rights every day. Prosecutorial violations don’t always manifest themselves in the form of a tank or tear gas, but they can be just as insidious to obtaining justice if that misconduct isn’t exposed. I’ve made it my mission to put a stop to that.”

Legendary lawyer Frank Branson: A Lifetime of helping consumers in time of need

LAX HIRING AND TRAINING practices by the U.S. trucking industry have contributed to a crisis on our roads and highways.

On interstates and freeways across the country, preventable crashes, injuries and deaths involving large trucks are at or near record levels. The 5,601 fatality crashes involving large trucks reported in 2021 reflect a more than 50% increase since 2009, according to the most recent statistics from the National Highway Traffic Safety Administration. The grim statistics have increased despite decades of safer vehicles, better-engineered lanes, drunken driving crackdowns and government-sponsored safe-driving campaigns.

“When the trucking industry cuts corners on safety, roadway deaths increase. It is that simple,” said trial lawyer Frank L. Branson, founder of Dallas-based Law Offices of Frank L. Branson. “Drivers are overworked and many lack experience and basic safety training. When trucking companies put inexperienced and unqualified drivers on the road in trucks that need repairs, you

A Historic Agreement in the Aftermath of Tragedy

Two-time “Lawyer of the Year” Daniel J.T. Sciano represented certain plaintiffs from the 2017 Sutherland Springs shooting, finally reaching an agreement to settle with the U.S. Department of Justice this year. Sciano offers insight on how stronger laws can prevent repeat tragedies.

WITH A POPULATION OF 600, Sutherland Springs, Texas, was a picturesque, tranquil sort of rural American town. But that all changed on November 5, 2017, when a masked gunman entered the First Baptist Church of Sutherland Springs and opened fire with an AR556 semi-automatic rifle, killing 26 and injuring 22 others before ending his own life after a brief chase.

The mass shooting was the deadliest of its kind in Texas history and became the fifth-deadliest in the U.S. It was also the deadliest shooting in an American place of worship. Investigations revealed that the shooter had a well-documented history of making threats of physical violence, researching methods of carrying out violence and a conviction for assaulting his wife and infant stepson.

Despite mandatory reporting requirements, the United States Air Force (USAF) failed to report the shooter’s history of violence to the FBI database, which allowed him to purchase the AR-556—a weapon of war—from a federal firearms licensee. That would not have occurred if the USAF had done its due diligence.

Having rightfully concluded the USAF authorities had failed to properly report to the National Instant Criminal Background Check System (NICS), the more than 75 victims and their families turned to the nation’s best legal minds to file suit against the government—one of whom was Tinsman & Sciano co-founder and CEO Daniel J.T. Sciano. Sciano was a natural choice as an advocate. In Texas,

“This case puts a spotlight on the cadre of loopholes of the NICS,” he says. “Preservation of life is a bipartisan issue. Legislators who truly want to ensure the safety of their citizens need to take action that closes this loophole and others and provides the funding to enforce gun laws on the books.”

In February 2022, a federal district court judge issued a remarkable $230 million verdict and ultimately ruled that the Air Force was 60% responsible for the shooting in the civil trial, as evidence showed the military branch failed to report thousands of violent felons to NICS. The government appealed, and in April 2023, a tentative settlement was announced for $144.5 million.

NICS was designed to prevent convicted criminals from purchasing or possessing firearms. Sciano notes that though the shooter voluntarily admitted himself into a mental health facility and discussed his intent to commit mass violence, he exploited the law that did not (and still does not) mandate that information be conveyed to the FBI database—a gaping loophole in the regulations designed to combat gun violence. These loopholes added to the flagrant errors that permitted the shooter to buy the weapon used in the massacre.

“We all agree that the people who have these mental health issues should not have access to guns. But the shooter knew how to play the system, and so do others out there,” Sciano says. “That is truly dangerous. There are reasonable restrictions that can be passed to prevent the wrong people from committing these tragedies with weapons of war to which they should never have access. We need to do more. Our children deserve it.”
