Residential Tenancies Act in Victoria A
s MANY tenants and landlords would be aware, the Residential Tenancies Act 1997 (RTA) is currently in the process of being reviewed. While a change to the duration of tenancies covered by the Act has already been introduced into Parliament, the majority of the proposed options are still being considered by Consumer Affairs Victoria and the Andrews Government. It’s imperative that any future legislation governing the private rental market is fair and balanced
for all stakeholders – not just tenants. Changes that overwhelmingly favour the demand side of the transaction will severely impact on the long-term sustainability and viability of the private rental market. More than 70 per cent of the proposed options in the RTA Options Paper favour tenants and involve the loss of multiple landlord rights. These proposed options include the removal of the landlord’s right to end a tenancy – whether that is at the conclusion of a fixed-term
agreement or during a periodic (month-to-month) tenancy. Tenants, however, would retain the right to end the tenancy at any time. It was also proposed that tenants should be able to make non-structural modifications without the consent of the landlord. This could be anything from additional internal walls, painting the entire rented premises or concreting the backyard. Property modifications have a substantial impact on the value of a rental premise, with the
option not requiring tenants to return the property to its original condition at the conclusion of the tenancy. Landlords would also lose the right to object to pets. At present there are quite a few landlords who allow pets, but it’s important that this right remains. A pet can cause considerable damage to a property and some properties are simply not suitable for pets, particularly apartments. Given the cost of housing in Victoria, a rental property is a sig-
nificant financial asset for landlords. The majority of the state’s property investors are ‘mum and dad’ investors with one or two rental properties. If legislation removes necessary protections for landlords, these investors may opt to exit the rental market or increase rents as an additional security measure.
