Santa Monica Boulevard Reconstruction Begins Jan. 11 By Victoria Talbot The North Santa Monica Boulevard (SMB) reconstruction project is finally set to begin Jan. 11 on the western side of the City. The project will take 18 months to conclude, including the rebuilding of the roadway between Doheny Drive and Wilshire Boulevard to replace the centuryold drainage and install fiber-optic cable and new street lighting. The project will be built in east and west segments with four phases for each segment designed to minimize traffic disruption and maximize business access. Throughout most of the project four lanes of traffic will remain

open as work is conducted in the curb lane and sidewalk areas. However, about one-third of the project will be while the roadway is removed and replaced, during which two or three lanes will remain open. During those times, traffic will detour onto South Santa Monica Boulevard and the traffic will be available for southbound traffic. Street parking along South Santa Monica Boulevard between Beverly Drive and Wilshire Boulevard will be temporarily removed. By Laura Coleman The Board of Education is poised to adopt a resolution to issue its final set of Measure E bonds, in the amount of $141 million, at its upcoming formal meeting on Tuesday. The money will be used to continue renovating Beverly Hills High School and El Rodeo school. The school district estimates that it requires an additional $260 million to fully renovate all five schools. A bond for that amount, Measure Y, narrowly missed the

two-thirds vote needed to pass in last November’s election. “I am so pleased that the district is moving in the right direction by selling bonds to continue the construction at our various school sites,” said board VP Lisa Korbatov. “I know that Measure Y was hugely supported by more than 64 percent of our constituents, and sadly didn’t meet the two-thirds threshold. It is my fervent hope that we put up another bond in June 2018 and finish the modernization of our (see ‘SCHOOL BOND’ page 16)

School District was scrambling for school security after abruptly losing its contract with EBI (Evidence Based Inc.). On Aug. 5, 2014, Rosen told the City Council that BHPD was unable to provide security for the schools because of budget cuts. He advocated the district hire EBI, citing the number of former BHPD officers working for the company. Then in November 2014, EBI abruptly withdrew services when the district failed to make a scheduled payment on time, according to EBI founder John McLaughlin, forcing the firm into bankruptcy. City Council To Review 332336 North Oakhurst Project By Victoria Talbot Plans for a four-story condominium development located partially in Beverly Hills and partially in Los Angeles, slated to replace a three-story 1930s apartment building in a potential historic district, will be on the City Council agenda Tuesday, facing a groundswell of grassroots opposition from local residents. Concerned Citizens of Beverly Hills and Beverly Grove have created a website with a petition at www.preserveoakhurst.org in protest of the proposed development, with the hopes of preserving the historic neighborhood of early Beverly Hills. By Victoria Talbot Beverly Hills Police Captain Mark Rosen is the subject of a workplace harassment complaint that claims abusive conduct, retaliation, intimidation, sexual harassment and “quid pro quo,” meaning the officer was advised that if he voiced his opinion there would be negative consequences. The complaint, filed Wednesday with the City, has also been filed with the Equal Employment Opportunity Commission by Field Training Officer (FTO) Andrew Myers regarding events that occurred in the department from Feb. to Dec. 2015. At the time, the Beverly Hills Unified

The project first drew attention when the group filed a Writ of Mandate challenging the approval by the City of Los Angeles that would have resulted in the demolition of the structure that fronts in Beverly Hills. Opposition to the project came on many fronts, including the eviction of long-time, at-risk residents on fixed incomes and height and density issues that vary from Beverly Hills to Los Angeles. 9000 Wilshire Boulevard Commercial Project

The City of Beverly Hills has prepared a Draft Environmental Impact Report (Draft EIR) for a proposed commercial office project located at 9000 Wilshire Boulevard as more fully described below. The Planning Commission will hold a public hearing to review the Draft EIR on January 26, 2017 at 1:30 p.m., or as soon thereafter as the matter may be heard. The purpose of this meeting is to review the content and adequacy of the Draft EIR. The merits of the project will not be discussed at this meeting, and no decisions will be made with regard to the Planning Commission’s approval or denial of the project. At a future date, a separate, noticed public hearing will be held by the Planning Commission to review the merits of the proposed project and take action on the approval or denial of a Development Plan Review Permit for the project. Project Location: The property is located in the City of Beverly Hills, at the southwest corner of the intersection of Wilshire Boulevard and S. Almont Drive. The 15,876-square foot site consists of two parcels that are currently developed with two commercial retail buildings and a paved parking lot. The address for the project site is 9000-9010 Wilshire Boulevard, and the Assessor’s Parcel Numbers are 4331-028-003 and 4331-028-004. Project Description: The proposed project would involve demolition of the existing commercial buildings and the removal of the paved parking lot. The two-story building on the east side of the site is currently occupied by an antique/art shop, and the one-story building on the west side of the site consists of three retail spaces that are occupied by a café, vape shop/lounge, and an insurance office. After demolition, a new commercial office development with a 14,558 square-foot building footprint would be constructed, which would consist of three stories of commercial office development (for a total of 31,702 square-feet of floor area) and four levels of subterranean parking. The project would also include a rooftop lunchroom, drought-tolerant landscape, bike storage, and a total of 91 on-site parking spaces. The project would be 45 feet in height plus an additional 15 feet due to the proposed rooftop structures and would have a floor area ratio (FAR) of approximately 2.0. The project site is currently zoned C-3 for general commercial uses, and the proposed use of the site for a commercial office development would not require amendments to the City’s General Plan or the Beverly Hills Municipal Code. Environmental Review: In accordance with the California Environmental Quality Act (CEQA), the City of Beverly Hills has prepared a Draft EIR to analyze potential environmental impacts associated with development of the project. Specifically, the Draft EIR analyzes the following potentially significant environmental effects of the project: • Cultural and Tribal Resources • Transportation and Traffic Based on the studies in the Draft EIR, with mitigation, no significant environmental effects are anticipated regarding transportation and traffic as a result of the project. However, environmental effects to cultural resources would remain significant and unavoidable after implementation of required mitigation. The project site does not appear on the Hazardous Waste and Substances site “Cortese” list. Public Review and Comment on Draft EIR: The Draft EIR is being circulated for the required 45-day public review period, from January 6, 2017 to February 20, 2017. Beverly Hills’ ‘Visionary Women’ Embarks On Second Year By Laura Coleman For the five ladies behind Visionary Women, shining a light on issues confronting women is a societal imperative. Just two years old now, the Beverly Hills-based non-profit organization has been steadily demonstrating its commitment to engaging women in critical issues both close to home and abroad. “I feel that women thrive in communities amongst other like-minded women and this is where their voices amplify and they feel empowered in their lives,” explained author Angella Nazarian, the organization’s founder. Through a series of intimate salons–there is generally just space for 200–attendees are afforded the opportunity to hear from speakers who are actively engaged in helping women achieve their full potential. Past speakers include: Cherie Blair, whose eponymous foundation helps women build small and growing businesses in developing and emerging markets; 2011 Nobel Peace Laureate Leymah

Gbowee, who helped bring an end to the Civil War in Liberia; and Legendary Producer Brian Grazer, whose road to success was punctuated by female mentors. And while the topics of past salons have ranged the gamut, from sex-trafficking in California and overseas to gender discrimination to women in the arts with a discussion that included artist Julie Mehretu, all are geared to inspire local women to help make changes for the greater good by using their voices. In tandem with the engaging salons, the organization donates all proceeds to targeted women’s initiatives and has gathered a series of sponsors that support various organizations that tie into the mission behind Visionary Women. “The goal of the Visionary Women is really to create a platform for dialogue on issues specific to women,” explained VW President Shelley Reid, who also works as an EVP with MGM Studios. “We are hoping to be able to become the premiere leader in that space of presenting internationally and

Board Of Education Struggles To Reach Consensus On How To Reduce $5M From Budget By Laura Coleman About the only thing the five members of the Board of Education clearly agree on with regard to next year’s budget is that reductions are not going to be pretty. Later this month, the board will consider various options on how to shave $5 million from the upcoming budget – and keep it off for years to come. Yesterday morning the members of the board proffered various ideas on how to reduce expenditures ranging from shutting an entire school (i.e. Hawthorne) to renegotiating the salary formula for teachers’ raises to asking the community to fund a parcel tax. Whatever the idea – no matter how far out of the box it may be – the board expects to wrestle with it during an

upcoming budget study session later this month. “These options are going to be very unpopular,” expressed Spitz, underscoring that he anticipated push-back from the unions and parents. “Unless we cut our expenditures by $5 million, the sky is falling.” The board learned last month that the district was projected to have $4.3 million in deficit spending this year and $4.6 million for the 2017-18 fiscal year. Spitz predicted that the most likely result of the board’s decisions would be to increase class sizes and eliminate certain classes and programs. Board member Noah Margo emphasized that it was important to explore closing down Hawthorne. “Taking one school offline would easily solve your money

problems,” he said. In addition, experts have told the district that in order to successfully renovate Hawthorne it would be necessary to move the students from the buildings for a two-year period. Spitz said he asked for yesterday’s discussion to be agendized so that his fellow board members could at least attempt to get on the same page and offer a unified vision of just what the district must confront to the community. According to the district’s Chief Administrative Officer La Tanya Kirk-Carter, the board has until March to figure out how to shave the money from the budget, at which time she needs to submit next year’s budget to the Los Angeles County Office of Education. NEW YEAR’S HANGOVER — On Jan. 1, neighbors looked on as BHPD safely removed family members from the home and then, with guns drawn they brought out a male wrapped in just a towel. Lt. Lincoln Hoshino said that the suspect was a transient who entered a home where juveniles were present in the 400-block of Spalding Drive at about noon. He then proceeded to take a shower. Jason Paulino, 32 of Placerville, was arrested on burglary charges.

Metro Gets $1.5B In Federal Funds To Complete Purple Line Extension Through Beverly Hills By Matt Lopez One of the final major acts of the Obama Administration will be to gift funding to the Metropolitan Transportation Authority to help complete its “Subway to the Sea.” Transportation officials announced Wednesday that $1.5 billion in federal grants and loans will be directed to help extend the Purple Line through Beverly Hills and Century City. The first section of the line is under construction between Wilshire/Western and Wilshire/La Cienega, and the second section will run 2.6 miles further with two new stations at Wilshire/Rodeo and Century City. The third section would run to Westwood and is still in the planning stages. The just-announced federal fund-

Combined with Metro's $836 million local match from Measure R funds and more from the recently passed Measure M, the second section of the Purple Line is funded for around $2.5 billion, L.A. Mayor Eric Garcetti’s office said. The federal funding comes on top of the November passage of Measure M, Metro’s “Forever Tax” which is an indefinite extension of a half-cent sales tax increase in L.A. County.

Children’s Hospital Los Angeles Marks 300th Liver Transplant

At 7 months old, Donovan Daniels may not understand for some time just how serious his medical condition, biliary atresia, really is. It may be years before he knows he was the 300th pediatric liver transplant ever performed by doctors at Children’s Hospital Los Angeles (CHLA) and USC’s Keck Medicine. But one day he’ll know his father Dejon Daniels went under the knife so that a portion of dad’s liver could help him live a longer, healthier life. In the meantime, Dejon and Donovan's mother Jessica Valdepeña got a glimpse of what that life might look like, thanks to a meeting with a young woman named Lydia Hand. Lydia, now 18, was CHLA's first living donor liver transplant patient. As an infant, she was also diagnosed with biliary atresia, a rare life-threatening disease where bile ducts cannot expel bile from the liver. In 1998, Lydia received a liver from her grandmother. Today, she’s a college freshman majoring in music, and says her donated liver is still going strong. “It’s pretty amazing how far she has come,” says Jessica. “I want Donovan to grow up and

have a bright future just like Lydia is having” CHLA’s Liver and Intestinal Transplant Program has grown to become one of the largest in the country – the hospital is a consistent leader in the volume of living donor liver transplants performed nationwide among pediatric centers, with success rates well above national averages. “But statistics are not the real story,” says Daniel Thomas, MD, medical director of CHLA’s Liver and Intestinal Transplant Program. “It is seeing patients like Lydia Hand grow, accomplish, and live to be a happy

young woman with a life full of dreams and hopes.” Coincidentally, the same team that worked on liver patient #1 also treated patient #300. Dr. Thomas is both Lydia’s and Donovan’s hepatologist, while Dr. Yuri Genyk was their transplant surgeon. “Donovan’s success is the culmination of the knowledge and skills from the 299 liver transplants that preceded him, including Lydia’s,” says Dr. Genyk, surgical director of CHLA’s Pediatric Liver Transplant Program and associate professor of clinical surgery in USC’s Keck School of Medi-

cine Division’s of Hepatobiliary Surgery and Abdominal Organ Transplantation. “It speaks to the expertise and dedication of the entire liver transplant team.” When Donovan’s parents brought him to CHLA in October, doctors told them Donovan urgently needed a new liver. Dejon volunteered and was found to be a match. The transplant took place Nov. 18, with Dr. Genyk performing both parts – Dejon’s surgery at USC in the morning and Donovan’s transplant at CHLA several hours later. Lydia and Donovan’s family met in Donovan’s hospital room on Dec. 1, the day he was discharged. “I’ve heard all the stories about my transplant from my family, but to actually see and hear what their family is going through is a special experience” says Lydia. “Donovan is me, I was once him, and it’s incredible to know that hundreds of other kids have received this life-saving procedure at CHLA in the years between us,” Lydia said. By the day Donovan left the hospital, CHLA doctors had already performed three more pediatric liver transplants.

HBO Documentary On Debbie Reynolds, Carrie Fisher To Premiere Saturday By Matt Lopez A documentary chronicling the relationship between entertainer Debbie Reynolds and her daughter, actress Carrie Fisher, will premiere Saturday, Jan. 7 on HBO. Bright Lights: Starring Carrie Fisher And Debbie Reynolds, directed by Alexis Bloom and Fisher Stevens, weaves together the relationship of Reynolds and Fisher through interviews, photos, video footage and vintage home movies. The film culminates with Reynolds preparing to receive the 2015 Screen Actors Guild’s “Lifetime Achievement Award,” which Fisher presented to her mom. Both Reynolds and Fisher tragically died last week, just one day apart. Fisher died at 60 after going into cardiac arrest on a flight, and just a day later Reynolds – who according to son Todd Fisher was heartbroken over Carrie’s death – died while planning her funeral. The film premiered at the 2016 Cannes Film Festival on May 14 and was recently screened at the AFI Fest on Nov. 13. It was set to premiere on HBO in March 2017, but the network pushed up the air date after Reynolds and Fisher’s deaths.

Specifically choreographed for five of the museum sites, and with original music by Chris Westlake, it’s “about an artist being pulled in different directions,” says Jonas. The two previously performed works on the bill include In a Room and Obstacles which debuted in March. Obstacles has special significance for Jonas. It was inspired by his friendship

The pair reconnected and after interviews with Smith and Jonas’ creative team, the result is a duet where Jonas embodies the disease, with dancer Marissa Labog, who co-choreographed the work. Accompanied by Philip Glass’ music and Smith’s recorded voice, the piece is about “obstacles and how you get through it,” says Jonas.

The City of Beverly Hills relinquished authority on the project at a special meeting of the City Council called last Feb. 12 when they declined to file an appeal of a pending Mitigated Negative Declaration, rendering Los Angeles the lead agency in a 2-2 vote, with then-Mayor Lili Bosse absent. At that meeting, Assistant Director of Community Development Ryan Gohlich provided a brief project summary that minimized the property’s historic value and the community’s expressed desire to be considered for an historic district to preserve the neighborhood character. Residents have negotiated the proposed project as a hybrid to incorporate essential design elements into the plan, but despite repeated negotiations, developers have produced a 52-foot high structure that was approved by Beverly Hills’ Planning Commission. Beverly Hills has recognized the architect, Edith Northman, as a Master Architect, whose structures are subject to review by the Cultural Heritage Commission prior to demolition. The buildings represent three of nine properties on the east side of the 300-block of North Oakhurst that have been recognized by both cities surveys as part of a potential historic district. Northman was one of the only female licensed architects working in Los Angeles in 1927. A survey of the Historic Resources Group for the City of Beverly Hills said, “The North Oakhurst Residential Historic District is significant as a notable concentration of Period Revival style multi-family residences of the 1930s. Various local architects and builders contributed to the district. . . One hundred percent of the residences contribute to the district’s significance, making the North Oakhurst Residential Historic District a cohesive representation of the Period Revival style multi-family residences.” The project was approved at the Central Area Planning Commission in Los Angeles last March, and a California Environmental Quality Act (CEQA) appeal was filed by resident Steve Mayer.

“In failing to evaluate this proposed project through an EIR (Environmental Impact Report), the City of Los Angeles, as the Lead Agency, is in violation of CEQA and will be vulnerable if the project is approved through the current MND (Mitigated Negative Declaration,” said the appeal. “One of the major problems with this project is that the city of Los Angeles did a wholly inadequate job of analyzing the impacts of the project on the City of Beverly Hills,” said Mayer’s attorney, Jamie Hall of Channel Law Group. “For example, the City of Los Angeles required the developer to pay fees to Los Angeles for parks and schools. Beverly Hills was completely left out of the equation. It's really shocking that the city of Beverly Hills is allowing itself to be treated like a step child.” Residents would use parks and services in Beverly Hills. The proposed project will be several feet higher than neighboring buildings, and out of character with the neighborhood, say residents. Critics say it will open the door for developers to evict other long-term residents and build more such developments. “You can't build a project like this, especially one that is fundamentally out of scope with the neighborhood, without adopting mitigation measures for the City of Beverly Hills. The bottom line is that the developer needs to mitigate the impacts to the Beverly Hills and that includes a reduction in height and incorporation of the historical elements of the existing buildings," said Hall. The issue of preserving neighborhoods in Los Angeles has become so heated that residents have formed The Coalition to Preserve LA and the Neighborhood Integrity Initiative, a grassroots initiative that seeks to reform the L.A. Planning and land-use system. Last January, L.A. Mayor Eric Garcetti announced the appointment of a new Planning Director, Vincent Bertoni. Bertoni, who served briefly as planning director in Beverly Hills, was a citizen activist to preserve his own neighborhood. On Tuesday, the Beverly Hills City Council will review the Planning Commission’s decision on the proposed project.

In a letter, police officers were informed, “Effective immediately, EBI will no longer provide security at any of the schools. FTOs are instructed to immediately resume primary responsibilities as school liaisons to address all concerns for the schools within their beats," it said. At the time department employment was down by at least ten officers, reported thenCity Manager Jeff Kolin. The events surrounding EBI led to the discovery that Snowden had masterminded the district’s campus security using EBI, then a small security firm he contacted in Irvine. After establishing a relationship, he funneled his retiring officers to EBI with a plan to retire to a position as the head of EBI’s campus security, said McLaughlin. Snowden, he revealed, was also being paid $2,500 per month in “consultation fees,” from EBI that did not appear on his Form 700 financial disclosures. Prior to Snowden’s involvement, the firm was generally employed in security consulting and risk assessment. On Feb. 2, 2015, Lt. Lincoln Hoshino held an “unannounced meeting” with Myers regarding what he refers to as the “ongoing internal rhetoric at BHPD,” allegedly referring to the EBI disclosures. Myers says that Lincoln’s discussion included his suggestion for a “lateral move to another agency.” Myers reports that he responded that he loved his BHPD job. Myers then alleges that on Feb. 5 at roll call, Patrol Officers were instructed not to leave their school posts during morning or afternoon drop-offs if an Automated License Plate Reader (ALPR) alerted them that an embezzled or stolen vehicle was discovered. “I believe the above advisement to be an unlawful order and in violation of the Beverly Hills Police Department policy,” writes Myers. That day, an ALPR alert was confirmed and a “high risk felony stop” was conducted. Myers assisted two other officers on the stop. The next day at Roll Call, Myers expressed his, “displeasure in front of others,” regarding the previous day’s “direct orders regarding not leaving your school post to respond to an ALPR alert.” Present were, “newly hired officers, cadets, other officers, detectives,” and Sgt. David Tomlin, who invited Myers into a conversation with Sgt. Donald Chase behind the Watch Commander desk. In that conversation, he says that Tomlin told him that, “negative behavior needs to stop as it is finding its way to the Second Floor (Captain’s and Chief’s offices).

“This is for career survival,” he says he was told. For the next year, Myers alleges he was subject to hyperscrutiny, denied trainees, routinely humiliated in front of trainees and other officers and denied assignments routinely assigned to Field Training Officers. On two occasions, Capt. Rosen allegedly told Myers he wanted to take his “FTO stripes” away. Myers was denied trainees who were then assigned to nonFTO officers who could not access the LEFTA computer system to document the trainees’ Daily Observation Reports (DOR). Rosen, claims Myers, told other FTOs that Myers “was on a ‘Time Out.’” Thus, trainees’ advancement was delayed while the City paid for FTO services that were denied by Rosen. At one point during the period of alleged abuses, Rosen allegedly told another officer, “I wish I could give Andy [Myers] a hug,” leading to the sexual harassment complaint. The comment proved extremely offensive to Myers. “I fear the administration for retaliation on anything I do or say, as working at BHPD is a hostile work environment,” wrote Myers in May, 2015. “The arbitrators’ opinions speak for themselves,” said attorney Susan Jerich of Silver, Hadden, Silver & Levine. A former San Francisco ADA and Assistant US Attorney, her practice is now defending public safety officers, including Officer Joe Vela at BHPD. “The level of unfair and ethically questionable conduct that defined the Vela investigation and actions by the Department far exceeds anything I have witnessed. The hearing officer’s opinion, that vindicated Vela, was an affirmation that this type of misconduct is intolerable. For example, when describing the matter and those involved the hearing officer previously used terms such as “thinly veiled threat”; “retaliation”; “not credible” and “abuse of discretion,” she said. The complaint, like those of Sgt. Richard Ceja, Officer Stanley Shen and Officer Joe Vela, shows a pattern under Snowden that had repercussions throughout the department. “Prior to the Vela matter, two other officers met with discipline,” said Jerich. “Both were fired and each appealed their discipline. Both were reinstated by different hearing officers who also characterized the Departmental conduct in much the same way the Vela hearing officer did in his 32-page opinion.” Settlements were also awarded to former Police Officer Association Board Members Officer Finn McClafferty, Sgt. Brian Weir and Officer Michael Publicker, that ended with their

retirements. The settlement amounts and legal fees are estimated to be in the millions. “I have never seen this rate of overturned findings,” she said. Each case is long and complicated enough for many to lose interest, one of the many patterns that emerges. Under Snowden, say BHPD sources who wish to remain anonymous for fear of retaliation, issues arose when an officer chose to follow protocol that holds a police officer to a higher standard of integrity to uphold the law, rather than to “toe the line” for the Chief. When those officers did not support Snowden, they were subjected to reviews ordered by Rosen and undertaken by Sgt. Subin, Professional Standards Unit (PSU). PSU officers ideally conduct objective investigations with clear disciplinary outcomes. According to sources, the officers were isolated, humiliated, denied duties, subjected to fear and intimidation for long periods of time and to intense scrutiny. Investigations seemed instead to provide a predetermined outcome. Vela, Ceja and Shen won their arbitrations and each officer was reinstated. Three separate arbitrators said that officers who testified against them were guilty of lies of omission, untruthful and lacking in credibility. Under Snowden, some were promoted or received special assignments associated with increases in compensation. BHPD is now under the direction of Chief Sandra Spagnoli whose strategic plan will overhaul and remake the department, but remnants of the old administration doggedly persist. Sources report that retaliations are ongoing, though to a lesser degree. As seen in the recommendations provided by Management Partners following Snowden’s retirement, there were problems. The report urged BHPD to initiate a review of the department’s promotional practices and involve employees to create clear, measurable standards to be achieved to be considered for promotion with written competencies and associated factors. Employees indicated that they did not feel they had sufficient opportunities to develop their skills to compete for promotions to special assignments. Chief Sandra Spagnoli, “has taken the Management Partners report and implemented some of the recommendations and she is in the process of implementing others,” said City Attorney Larry Weiner. “It is typical for any chief to come in and remake the department. She is putting her stamp on the department.” Weiner acknowledged receipt of the complaint but could not comment on it.
