By Tricia Arend At a hearing on Wednesday, Los Angeles Superior Court Judge Ann Jones denied the City of Beverly Hill’s request for a final judgment on Measure 2P or a temporary restraining order against Measure 2P which would have temporarily prevented the City from implementing 2P. A two-hour free parking initiative, Measure 2P passed by 68 percent when put on the ballot for City voters in last month’s election. “The City wanted to end this matter and this case once and for all by having Judge Jones issue judgment, however, Judge Jones had different ideas,” said Steve Reyes of Kaufman Legal

Bean has two daughters, Celeste an 11th grader at Beverly High and Alyssa a 6th grader at El Rodeo. Bean’s interest in the BHUSD began a few years ago when his daughter Celeste decided to go to Beverly High after attending Page private school for elementary and middle school. “I attended a budget presentation a few years ago and saw what I thought was some less than good advice to a previous board,” Bean said. “That’s when I started paying a lot of attention and becoming engaged.” In his professional career, Bean owns his own management consulting firm. Arthur Marx Dead At Age 89 Prolific playwright/author Arthur Marx, son of legendary comedian and former Beverly Hills resident Groucho Marx, died yesterday morning at his Century City home of natural causes. He was 89.
Born in New York in 1921, Marx spent his early years on the road with his father and uncles, Harpo, Chico and Zeppo, during the Marx Brothers’ vaudeville tours. By the early 30s, the clan (see ‘MARX,’ page 9)

Retirement Plan Discussed The Board of Education voted 3-2, with Boardmembers Myra Lurie and Jake Manaster dissenting, to hire Keenan Financial Services to analyze the benefits of implementing a Supplemental Early Retirement Plan (SERP) Tuesday. The district attempted this plan last year and lost money. However if more
than half of the teachers that retire do not need to be replaced, the district stands to make about $1.5 million over five years. Those who qualify for early retirement must be 55 years of age or older and have a minimum of five years full-time employment as a certificated (see ‘SERP,’ page 15)

NOTICE OF AVAILABILITY of RECIRCULATED DRAFT ENVIRONMENTAL IMPACT REPORT The City of Beverly Hills has prepared a Recirculated Draft Environmental Impact Report (EIR) for a proposed new 44 unit condominium building (Residences at Saks Fifth Avenue). The EIR was previously circulated for public review between November 15, 2010 and January 18, 2011, and is being recirculated as a result of changes to the levels of significance associated with several impact areas. The following impact areas were changed from Class III (less than significant) impact to Class II (significant but mitigable) impacts: • Aesthetics • Land Use and Planning The abovementioned changes to impact areas, as well as other edits and clarifications, are shown in strikeout/underline within the text of the Recirculated Draft Environmental Impact Report. The project site is located between the 100 blocks of South Camden and South Peck Drives, immediately south of the commercially-zoned properties fronting on Wilshire Boulevard. The project site is identified as 125 South Camden Drive, and occupies six lots totaling approximately 1.12 acres in size. The proposed project would result in the demolition of the existing surface parking lot located behind the Barney’s retail store, and permanent vacation of a portion of the north-south alley that runs through the center of the project site. The new structure would be a six-story, 44-unit residential building with a two-level subterranean parking garage with 127 parking spaces. The net floor area of the proposed building would be 118,840 square feet, which results in a net floor-to-area ratio (FAR) of 2.44 to 1. The project includes approximately 16,220 square feet of communal and private open space that would be provided in the form of courtyards and terraces. The proposed project would be 66-feet and six stories in height at the northern portion of the site, adjacent to the 85-foot tall Barney’s retail building to the north of the project site. The project would then step down to 55-feet and five stories in the middle portion of the site. In the southern portion of the site, the project would step down to 45-feet and four stories, adjacent to the existing multi-family residential development to the south. Of the six lots proposed for development under the project, the four northern lots are currently zoned R-4-P (Residential Parking Zone) and the two southern lots are zoned R-4X2 (Multiple Residential Zone). The R-4-P zone allows for either multi-family residential development or commercial parking facilities (but not both within the same project), and the R4X2 zone allows for multi-family residential development. The project consists strictly of multi-family residential development, and is therefore compatible with the permitted uses for the project site. The height limit for the two northern lots is 55-feet or five stories, and the height limit for the four southern lots is 45-feet or four stories. Proposed development on the two southern lots complies with the established height limits, but development on the four northern lots exceeds the established height limits. Approval of the project requires approval of: a Vesting Tentative Map, a Zone Change to amend the Municipal Code to establish a new overlay zone (which allows for increased height and building length), the Multiple Residential Planned Development Overlay Zone (MR-PD); a General Plan Amendment to reflect the proposed overlay zone and to exceed the 60-foot height limit identified in the General Plan; a Development Plan Review to construct the project; and an amendment to the City’s Streets Master Plan to allow for an alley vacation for a portion of a public alley that bisects the project site. The Draft EIR analyzes the following potentially significant environmental effects of the project: • Aesthetics • Land Use and Planning • Air Quality • Noise • Greenhouse Gas Emissions • Transportation and Circulation PUBLIC REVIEW AND COMMENT ON THE RECIRCULATED DRAFT EIR The Recirculated Draft EIR is being circulated for a 25-day public review period, from April 15, 2011 to May 9, 2011. Amplified Noise Complaints Discussed At Hearing

Political Strategist Kuwata Dies Veteran Democrat political strategist Kam Toyo Kuwata died Monday at age 57. The native Californian earned a degree in political science at USC and then moved to Washington to join the staff of the late Sen. Alan Cranston. In 1992, Kuwata became a strategist for Sen. Dianne Feinstein and helped her win several reelections. When contacted by The
Courier, Sen. Feinstein stated: “I am deeply saddened at the passing of Kam. California has lost a sharp political mind, and I’ve lost a loyal, dear friend of more than 20 years. “I could always rely on his great sense of humor, good advice and compassion for the people of California. I will miss him.” Kuwata is survived by his mother and brother, Kal.

Tricia Arend: New Face At The Courier The Courier has announced the appointment of Tricia Arend as a staff reporter. Arend attended the State University of New York at Buffalo, where she majored in English and psychology and minored in marketing while working as an editor at Buffalo newspaper The Spectrum.
Following graduation, she worked as a staff reporter at The Long-Islander, a publication founded by Walt Whitman in 1838, for almost two years. After moving to Los Angeles in March 2009, Arend was employed by a private investigation agency, but has now returned to journalism at The Courier.

The BHPD’s surveillance unit last Friday arrested Jackson, one of three gang members responsible for “knock knock” burglaries in Beverly Hills and Los Angeles. The trio used a common method of operation: knocking on the front door of
a residence, if there is no answer, two of them would ransack the home looking for jewelry, money and guns. BHPD had Jackson under vehicle surveillance in South Los Angeles the morning of his arrest. Once Jackson exited his vehicle at a convenience store in the area of 115th Street and South Vermont Avenue, officers took the opportunity to attempt to safely place him into custody. s anybody here named Topsy? We’ve always liked the name. In school, a classmate was Topsy, and at the New Jersey shore town where we summered a Topsy became a friend. She visited with our neighboring family that included Grace Kelly and her beautiful sisters, sunned and swam at the same beach, and we loved hearing Topsy’s mom call out her name.

Tawny’s a California beauty wed to magnate Jerry, the hugely successful co-founder and CEO of the American semiconductor manufacturer Advanced Micro Devices, whose motto is “people first, products and profits will follow.”

A VIP reception was held Wednesday for the honorees, Founding Families and sponsors of this month’s Beverly Hills Education Foundation Apple Ball. The reception was hosted by Robert Zarnegin at The Peninsula Beverly Hills. This year’s Apple Ball will honor district teachers and administrators, The City of Beverly Hills with the Metropolis award and Candace and Clif Smith with the Clark Kent and Lois Lane award. The Justice League of America award will be presented to the following district teachers: Loren Newman and Stuart Horowitz of Beverly Hills High School, Elizabeth

as early as fall 2012. “There’s only one high school in the world known by name internationally and it’s Beverly Hills High School,” Beverly Hills Education Foundation Chair Jonathan Prince said. “We’ve always thought as a district there is value to that name but we weren’t able to monetize it.” Due to the approval of a trademark custodial agreement between the BHUSD and the BHEF, it is not the BHEF’s responsibility to find the best deal possible for the district at the highest quality. “The beauty is because we’re a nonprofit and (making money for the district is) our job, any contract we enter, the money flows straight through us back to the district,” Prince said. Prince stressed two important aspects of the custodial agreement between the two. First, the money earned on the Beverly Hills High School brand will be going to the district as a whole, not just the high school. Second, the high school has it’s own t-shirts and other apparel and any deal struck by the BHEF will in no way affect school made apparel, Prince said. had become film stars and moved to Hollywood. Arthur Marx served in the Coast Guard during World War II and began his career at MGM. Marx began his Hollywood career working at MGM. While screenwriting there, he authored his first novel The Ordeal Of Willie Brown, which was loosely based on his own experiences as a nationally ranked junior tennis player. In 1954, he wrote Life With Groucho, the first of several books that dealt with his father and their sometimestempestuous relationship. By the early '60s, Marx teamed with his father’s former writer Robert Fisher. The duo then collaborated for more than 30 years, turning out several Bob Hope films, including Eight On The Lam, A Global Affair, I'll Take Sweden and Cancel My Reservation. They also wrote episodes for numerous TV sitcoms such as McHale's Navy, My Three Sons, Petticoat Junction and The Mothers-in-Law. The duo later did The Impossible Years, which ran on Broadway for three years and then became a David Niven movie. Marx and Fisher continued in TV throughout the '70s, writing episodes for three Norman Lear comedies All In The Family, The Jefand fersons, Mau- de and Love American Style and Alice. and after a conversation about mutual passions including kids and public schools, they began to discuss what became the preliminary ideas for a partnership. “When I reported back to our board, we had interest from Cherokee, what we were most thrilled by was that a company that size with that reputation, with that amount of expertise, would be coming after us,” Prince said. “It made us think we were worth something, that they were taking us seriously and for us to realize we would get a fair and good deal.” Branding dollars are an untapped source of revenue for the district. It is money that they don’t receive now and could greatly benefit from in the future. “We have nothing now and at least this helps us get something,” Board President Lisa Korbatov said. “We got to start somewhere and we have to start sooner than later.” Members of the board are ecstatic about the idea of branding and new found revenue. “I am so excited about the possibilities that this new partnership which BHEF represents for our students and District,” Board Vice President Brian Goldberg said. “We are very fortunate to have so many creative people who volunteer their time and talents to make our schools so special.”

Beverly High’s Robotics Team Competes At L.A. Regional Robotics Competition By Dupé Aleru Beverly High and 63 other high school Robotics teams competed in the L.A. Regional FIRST (For Inspiration and Recognition of Science and Technology) Robotics Competition at the Long Beach Convention Center, recently. In this year’s “Logo Motion” game, competing teams were required to design three robots each, on a flat, 8.2-by16.5 meter (27-by-54-foot) field. As if that wasn’t enough, teams were then required to hang plastic shapes (triangles, circles and squares), on their scoring grid, in a two-minute-and-15second match, in order to earn points. In addition, the robots can also deploy mini-bots that would climb vertical poles for a chance to earn additional points.
With the help of engineers from NASA’s Jet Propulsion Laboratory, aerospace and other higher education companies, students were given six weeks to design, build, program and test their robots to meet the season's engineering challenge. The BHHS team was the only one to win three honors—regional finalist, Industrial Safety, and the Innovation in Control awards. Beverly students did a wonderful job representing its team, school and the community. A high interest in the team was generated when the team assembled a robot in one day for the City Honors School from Inglewood—which Beverly now adopted and will act as mentors for them in the future.

noise curfew was too early. Southwest Homeowners Association President Ken Goldman said the Southwest Homeowners Association supports the idea of a permit process. Goldman said they do not have a problem with the occasional party in the neighborhood, but a problem with frequency. “It seems to me if you have a party with more than 30 people and have amplified sound then get a permit from the City,” Goldman said. “At least at that point you know okay that address this is their fifth party this month with amplified sound.” Senior Planner of Community Development, Michele McGrath, said a problem with implementing a permit process is the City will need to hire an ad-

Another problem with a permit process is the issue of insurance. “If the City is issuing a permit, the City would expect the party host would have insurance that would indemnify the City so the City is not liable if there are problems,”McGrath said. Not everyone has problems with amplified noise in their neighborhoods. Resident Nazy Zarabi said her and her husband invite their neighbors to the parties they throw and have never had a complaint. “I have to say that it has brought our neighborhood together,” Zarabi said. There are two additional hearings that will take place on May 9 at 7 p.m. and May 24 at 9:15 a.m. in the Council Chambers at City Hall.

Group APC, who is representing 2P proponent Marcia Caden. “The voters spoke very clearly on election day that they wanted two hour free parking in the city of Beverly Hills,” he stated, adding that the discussion at Wednesday’s hearing was “important because there is hope that the wishes of the voter will be respected.” Alleging it would increase a Parking Enterprise Fund “deficit”, the City Council fought the measure and attempted to ban it from the March ballot by suing in Superior Court. Judge Jones previously ruled the measure as unconstitutional as an improper imposition on administrative matters on Jan. 4. Three days later, on Jan. 7, the California Court of Appeal granted a temporary stay of the decision, blocking the decision and allowing for the presence of the measure on the ballot. The Court of Appeal returned the lawsuit to the Superior Court in March. This week, Judge Jones set a hearing date for April 29 to revisit the issue after additional briefing. The decision will be made at this expedited hearing as to whether Measure 2P will be treated as valid in the interim pending a final hearing, said City Attorney Larry Wiener. “It’s good that we’ve gotten an expedited schedule to hopefully get direction from the trial court as to whether 2P should be implemented pending a final decision,” Weiner said. “The question is what do we do while we’re waiting.” Last week, City Council discussed the options available under Measure 2P, including eliminating flat fees after 6 p.m. and leasing or selling structures to private operators before appointing a subcommittee to address the questions 2P raises. The subcommittee is scheduled to report back to the City Council at the next Council meeting, to be held on April 21, Wiener said.

sified staff to operate at minimum staffing level. By upping the class size ratio to 1:22, the district can potentially save $434,705, based on the district’s average teacher salary of $90,941. This would still be less than the state average. FCMAT also recommended the district polices and procedures regarding instructional
aides. The district currently has a multitude of aides that need to be monitored and directed. This will assist the aides in giving better and more organized assistance to those students who need them. Though the FCMAT report offered over $1 million in cuts, the board as a whole has not seemed interested in cutting
the special education program. “I recommend making some cuts to special education during the whole second interim debate and my colleagues were very hesitant to make any of the cuts FCMAT recom-

Park Rangers brought snakes and turtles from the Greystone estate to engage children. Electronic waste was collected and inspected for reusable parts. Defense attorney Glenn Briggs told jurors during final arguments last week that store video from Christmas Eve and Christmas Day 2008 showed no customers present during three transactions during which Betson claimed she was processing refunds. He said that in one of those cases, she put the refund slip in her back pocket. Betson, 48, said outside the courtroom that she was pleased with the verdict. She said she has been unable to get another job because prospective employers ask her why she was fired and do not offer her employment when she tells them she was accused of taking money from Rite Aid. The board voted to eliminate one full-time adult education office manager position, one adult education senior clerk position, one adult education secretary and one adult education clerk and reduce one adult education position and one purchasing assistant position from full-time to parttime. The district will still offer English as a Second Language (ESL) classes through the now minimal adult education program. The teachers for the ESL classes are credentialed and would have had to be notified by March 15. The teachers are paid at an adult school certificated rate, which is less than certificated union members are paid, and together will cost approximately $110,000 for salary and benefits for 28 hours a week of work. The ESL program costs the district approximately $135,000, $60,000 of which is paid for through a federal grant. ESL students currently pay a $20 registration fee. BHUSD ESL teacher Esther Caporale said ESL classes help those who aren’t fluent in English to help their children, boost their self esteem and succeed in business. The ESL classes used to be self-sustaining and did not encroach on the general fund. “Although I entirely understand that due to budget cuts (the board) needs and wants to close adult education in general, I am here on behalf of our ESL students to ask for help to keep the ESL classes open,” Caporale said at the board meeting Tuesday. “Removing ESL would impact us in many significant ways. A Look At The Sacramento Scene

By Steve Frank Did you know that Gov. Jerry Brown claims to own three guns? Democrat Speaker of the Assembly John Perez owns a gun. Sen. Dianne Feinstein usually carries her gun with her. The State Assembly just ordered all its security detail to carry a gun. Yet, at the same time elected officials, some of whom have armed bodyguards—for instance, all the constitutional officers of California have armed CHP officers assigned to them— do not believe you should be allowed to carry a gun, and certainly not be allowed to “open carry.” Current California law gives the county sheriff the right to set the criteria by which an honest citizen may carry a gun. In Orange County, Sheriff Hutchens has nullified or ended dozens of carry permits. California is a “May Issue” state; the decision to grant a CCW (carry a concealed weapon) permit being granted (or refused) at the discretion of the county sheriff or police chief. Some sheriffs/chiefs issue on a reasonable basis, others can be next to impossible to persuade. Many of them operate illegal policies that are ripe for a challenge. In most counties you need a psychology examination, a background check, gun safety courses, special exams and more. Then you get to pay a hefty fee each year for the constitutional right to protect yourself. I do not need to note, but will, that criminals pass no test, pay no fees and use their weapon for harming honest citizens. Special interests and most Democrat-elected officials prefer good citizens walk the streets of our state totally unprotected from criminals. Current California law says if you carry a concealed weapon you need a permit. But, if you have a holster and show your weapon openly, it is legal under the law. A group of gun enthusiasts who want to be safe have taken to wearing their gun in public places and those they do not, by signage, prohibit it. They have done this in Los Angeles, Alameda and Sacramento counties. While the police were called, to arrest these supporters of the Constitution, state law prohibited the arrest or harassment of those willing to protect themselves. Altadena Assemblyman Anthony Portantino has introduced legislation (AB 144) that would ban most people from open carrying in California. This bill would stop folks from exercising their constitutional rights to openly carry a weapon. He does not believe in concealed weapons permits, even though very few are issued. He refuses to note that his colleagues carry guns, with or without a permit. Portantino refuses to admit celebrities, athletes and folks who want to protect their families carry a concealed weapon. I attend lots of political meetings. Several older ladies carry guns in their purses, and know how to use them. They refuse to be a victim of criminals and government efforts to make them victims. Why concealed and/or open carry? When a shooting occurs in a restaurant, in front of a grocery store or in a school board meeting, do you want the criminals to be comfortable in knowing that thanks to government, the attendees are totally unprotected? I had been a guest on Bill Maher’s former Politically Incorrect. One issue was should people carry guns in churches. My response was simple, criminals do not care it is a church, if they want to shoot one person or many people. Because I attend a church or Temple, should I be fodder for a nut with a gun? In short, I said, I would rather be judged by 12 than carried by six. Do you want to protect yourself or be a victim? Remember this, when seconds count, the police are just minutes away. This is your life, choose protection or allow yourself to be a victim. Your choice, not government’s. LETTERS I was dismayed at seeing in The Courier last week that the City Council is not only going to appear on an upcoming episode of The Real Housewives Of Beverly Hills but had approved
use of our BH shield in this unbelievably tacky show. Former Mayor Delshad had even given a proclamation from the City in chambers which was filmed to be used on this program. We have spent a lot of time
Rabbi Jacob Pressman MITZVAH: THE GOOD DEED One of the best things about growing old –yes, there are some!–is that sometimes it brings out the best in other people. There used to be a cliché about what Boy Scouts of America were supposed to do–like help an old lady cross the street. Now sometimes such aid was very welcome; and sometimes it was summarily rejected, as when a 50year-old woman would say, “Let go of my arm. I’m in a hurry. I am not an old lady!” The fact is that the training in being of assistance to others was a very good thing. After a lifetime of being strong, in charge, of helping others I am now learning what it usually, but not always, means to be appreciative of assistance. Now that I am in the 90s, I have noticed that an astonishing cross section of people is solicitous of my needs. Yes, I have actually had perfect strangers ask to take my arm and help me cross the street, step out of an automobile, step up from the street to the curb. Often I am burdened with some heavy package and am delighted when someone offers: “Here, let me carry that for you.” I let them. When I am in someone else’s automobile, I appreciate hearing: “May I help you fasten your seat belt?” In the passenger’s seat it is often very difficult to buckle up, because it needs bending back your left hand to do so. So I cheerfully let someone do it for me, and am not only secure and obeying the law
but I often get a hug from the good person, male of female, who is straining to catch the lock. Sometimes I find myself in a line of people waiting to perform some routine act. Often one or more persons ahead of me will turn and say, “Get in front of me.” I do. Because in order to perambulate safely I may use a cane or a walker, invariably someone will offer me help, fold up my walker and help me get seated at a restaurant or in and out of a car. They then graciously stow my cane or walker in the trunk of the car, or the corner of some public place. What I have discovered is that these good Samaritans feel good about what they are doing. One of the meanings of the ubiquitous Hebrew word Mitzvah is the “good deed” when we are kind and decent to a fellow human being. Our tradition teaches that we should try to perform a hundred Mitzvahs a day. I hope the Boy and Girl Scouts and other youth groups are being taught the importance of the Good Deed, because I, for one, am the grateful beneficiary of the kindness of others. They put the gold into the Golden Years. So, my faithful reader, should you ever have the impulse to assist me in coping with growing old, do not repress it. I am not embarrassed to take your help. I love it – and you!

Lois Hirt ****** Last week the FCMAT (Fiscal Crisis and Management Assistance Team) delivered a devastating analysis of the Food Services Department with Debi Deal of FCMAT admitting never having seen a district in worse
shape. Deficiencies from cash handling, record keeping and compliance with federal and state guidelines were identified. It was reported that Food Services has for some time been a drain and encroachment on the General Fund. The BHUSD has been forced to take precious resources out of our classroom and subsidize the mismanaged Food Service program. One of the recommendations embraced by Dr. Alex Cherniss, assistant superintendent of Business Services, is to hire a full-time Food Services director. As concerned parents and residents, we should say “not so fast!” Lisa Korbatov often reminds us “insanity is repeating the same thing over and over again, and expecting a different result.” It is not simply enough to hire someone, we need to hire the right person. Regretfully, BHUSD has ample precedent for hiring the wrong people. Case in point, Maria Hunsaker, former director of Food Services, hired by Sup. Jeff Hubbard with the then board of Lurie, Demeter, Roston, Milan and Mishkaty. She finally
“resigned” after two filed audits. Former Assistant Superintendent of Business Services Cheryl Plotkin, hired by “our own Gwen Gross” and the board comprised of Brien, Brucker, Roston, Lurie and then promoted by Sup. McVeigh, resigned under a cloud of suspicion. And let’s not forget Karen Christiansen . . . . two guesses who hired her? Jeff Hubbard, Karen Christiansen, Maria Hunsaker, Cheryl Plotkin. . . . . We would do well to remember these names . . . . . With our past hiring history, we should heed Dr. Brian Goldberg’s advice and hire an outside consultant until such time as we get our house in order. There is no simple fix as it’s not as if we could simply hire a CPA to bring financial order to BHUSD. Part of the problem is we are hampered by the demands of a state mandated bureaucracy.
