The City Council of the City of Beverly Hills does hereby ordain as follows: Section 1. Section 8 is hereby added to the Rate Ordinance to read as follows: “Section 8.

Section 6-1-113 of Title 6, Chapter 1, Article 1 of the Beverly Hills Municipal Code is hereby amended and restated to read as follows:

“6-1-113: DEBT TO CITY: The amount of any utility charge or penalty imposed by the provisions of this chapter shall be deemed a debt to the city. An action may be commenced on behalf of the city in any court of competent jurisdiction for the amount of any delinquent utility charge or penalty. In addition, delinquent charges and all penalties thereon, when recorded as provided in Section 54355 of Chapter 6 of Part 1 of Division 2 of Title 5 of the California Government Code, shall constitute a lien upon the real property served, except that no such lien shall be created against any publicly-owned property. Such lien shall continue until the charges and all penalties thereon are fully paid. The Director of Administrative Services and Chief Financial Officer is hereby authorized to prepare and record a list of delinquent unpaid charges and penalties in the form and manner prescribed by California Government Code Section 54355, as may be amended from time to time, or any successor statute.” Section 2. This ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The ordinance is not a “project” and is therefore exempt from CEQA pursuant to Section 15378(b)(4) of Title 14 of the California Code of Regulations. Section 3. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase in this Ordinance or any part thereof is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared unconstitutional, or invalid, or ineffective. Section 4. Publication. The City Clerk shall cause this Ordinance to be published at least once in a newspaper of general circulation published and circulated in the City within fifteen (15) days after its passage, in accordance with Section 36933 of the Government Code; shall attest and certify to the adoption of this Ordinance and shall cause this Ordinance and the City Clerk’s certification, together with proof of publication, to be entered in the Book of Ordinances of the Council of this City. Section 5.

Effective Date. This ordinance shall go into effect and be in full force and effect at 12:01 a.m. on the thirty-first (31st) day after its passage.

Gala Raises Money For Young Musicians Foundation Bike Ad Hoc Committee Discusses CELEBRATING YOUNG MUSICIANS—Some Potential Routes, Racks For City 2,000 patrons attended Young Musicians Foundation’s 57th annual Gala Concert on Jan.15 at the Dorothy Chandler Pavilion. Reflecting its “Celebrating the YMF Legacy” theme, the concert offered a varied and exciting repertoire of classical and contemporary compositions. In total, five guest conductors led the YMF Debut Orchestra’s 70 musicians, ages 15-25, and 20-plus local alumni. In addition to John Williams, guest conductors included Richard Kaufman, Teddy Abrams, Joey Newman and YMF alumnus Michael Tilson Thomas. YMF’s Humanitarian Award was presented to Beverly Hills’ resident Lawrence N. Field, founder and principal of NSB Associates and long-time YMF board member. David Weiss, YMF alumnus celebrating 50 years of involvement with YMF, received the Living the Legacy Award. All proceeds raised at the event will benefit children and youth ages 8 to 25 who receive music education, scholarships, pre-professional musical training and performance opportunities. By Marla Schevker The Traffic and Parking Commission’s Bicycle Ad Hoc Committee met Wednesday to discuss bicycle routes, the installment of bicycle racks around the City and the bicycle rack-on-request program. Department of Public Works Administrative Intern Elias Massoud said after visiting each site, he thought the City should add new bicycle racks at five of the eight parks, four of the seven mini parks and one of the six schools throughout Bev-

erly Hills. These locations include La Cienega Park, Roxbury Park, Crescent Drive Mini Park and Beverly Hills High School. After people in attendance raised concerns, Massoud and Transportation Planner Martha Eros said they will go back and look at the locations deemed to not need bike racks including the Beverly Canon Gardens. Eros said specific dimensions were used to determine whether a location warranted a new bicycle rack (see ‘BICYCLES,’ page 13)

REMODELED LIBRARY—The Children’s Division of the Beverly Hills Public Library will be closed to public access from Feb. 4 to 6 and relocated to the second floor of the library beginning Feb. 7 as the City begins to renovate the library. Extras Beat Rivals, Qualify For Sectionals The BH AYSO U12 Extra team took up where it left off at the end of last year, beating Santa Monica and Pacific Palisades in the Regional Championship games last weekend. Having already won the Turkey Tournament as well as winning all the games in the BH Sportsmanship Cup, The Extras took Pacific Palisades in their opening game 7-0. In the second game, the team faced one of its biggest

rivals, WLA, a team it had beaten twice before. WLA scored in two quick counter attacks and won 3-2, handing BH its first loss. The final game was played Sunday morning against Santa Monica, which had beaten WLA 4-1 the day before. The boys took the previous day’s defeat as motivation and won 3-0. In the regional championship final, after finding themselves trailing with a cost-

ly mistake early in the game, the boys had fought to a 2-1 lead at half time. The second half found the team short handed after player Stutz Elliot was injured, and missing scoring opportunities. Hollywood Wilshire ultimately prevailed 5-2. The team is coached by Head Coach Louis Maarfi as well as Leon Zekaria, with Carla Pennington as team administrator and Rick Minars as trainer.

Korman Communities Purchases Crescent Site Korman Communities has acquired a site at 155 N. Crescent Dr. for $85 million on behalf of its subsidiary, AKA Beverly Hills which develops flexible-stay residences catering to celebrities, international leisure and business travelers and

upscale consumers. Korman Communities will invest $10 million to convert the property from traditional rentals to fully-furnished luxury residences where rates will start at approximately $400 per night with a minimum of 30

days. Renovation plans include a newly upgraded lobby and the addition of a lounge, café, fitness center and outdoor space for residents’ use. According to Larry Korman, principal of AKA and Ko(see ‘KORMAN,’ page 18)

BH Photo Red Light Program Still In Effect Despite Dissolving In L.A. By Marla Schevker Although the photo red light camera program in Los Angeles has been disbanded, Beverly Hills’ program is still alive and well. “We find it’s a very effective tool for traffic enforcement,” BHPD spokesman Lt. Mark Rosen said. According to Rosen, the BHPD gave 20,365 photo red light tickets in 2011. In the three years since the City began the photo red light program, it gives out approximately 1,600 tickets a month. After Recovering From Recent Surgery, Joel Pressman Returns To BHHS Duties Joel D. Pressman, chair and director of vocal music at Beverly High and a member of that school’s faculty for 35 years, has returned to his duties in the music department this week after successfully recuperating at home from emergency surgery in December. The 1967 BHHS graduate has performed on the Broadway stage and sang

at both Kennedy Center in Washington and Lincoln Center in New York. Locally, he has been a long time fixture at the High Holidays’ services at Wilshire Boulevard Temple and Temple Beth Am. Pressman’s duties at the high school include directing its much-lauded Madrigals and Minnesingers plus other award-winning choral groups there.

Located a mile from the campus, in Bel-Air, the garden and home on two acres were donated to the University of California in 1965 by Edward W. Carter, once chair of the UC Board of Regents, and his wife, Hannah Carter. Bill Noble, the Garden Conservancy's director of preservation, said the garden was a rare example of a Japanese garden designed for private use, now open to the public. Edward Carter died in 1996. Hannah Carter vacated the residence in 2006 and died in 2009. In Sept. 2010, a judge cleared the way for a possible sale, granting UCLA’s request to set aside the obligation to maintain the garden in perpetuity so the academic intent of the Carters’ gift can be fulfilled. “The sale of the estate and the garden allows us to ensure that we meet the intent of the Carters to directly benefit UCLA’s academic mission through their generous gift,” said Rhea Turteltaub,

Those interested in preserving the garden, however, believe the university has not done enough to save it. “UCLA has not been welcoming of efforts to enter discussion if there were ways to identify others who would partner with UCLA to retain ownership,” Noble said. The university’s decision to sell is part of a larger effort to sell underutilized properties to generate revenue for core educational programs, according to a university statement. The Conservancy and the California Garden and Landscape History Society have written a letter to Chancellor Gene Block expressing concerns about the sale. The Bel-Air Assn., a homeowners group, and the L.A. Conservancy, have called for alternatives. ARTS & E N T E RTA I N M E N T Giatas To Resign From McCallum Post By Frances Allen We had known about it for months, but the formal announcement made it official: Ted Giatas, the immensely knowledgeable and dedicated president/CEO of the Palm Desert’s McCallum Theatre, has resigned, effective at the end of this season’s performances. To call this a major loss would be an understatement; just look at the numbers. When Giatas was appointed to his post at the McCallum, the theater was $7.5 million in debt and terminal. Under Giatas’ tenure, the McCallum became profitable, retired its debt and expanded its endowment fund from $1.2 million to $12 million. And he performed the dual tasks of managing the theater and building a commit-

ted donor base–all the while booking world renowned talent to perform on stage at the state-of-the-art 1,100-seat venue. We don’t know where the arts will take Giatas when he leaves the Desert in a few short months, but can report that a paint brush and easel Ted Giatas will be part of his future. We wish him well, and may all his canvasses be as pretty as the state in which he leaves the live theater in the Desert.

Initially proposed to add meeting space and widen bathrooms in the community center, the proposed project adds nearly 1/2 an acre of inside space with an 11,000 square foot new multipurpose room suitable for banquest, approximately 580 square feet less of meeting space and about an additional 36 square feet for bathrooms. Although open to the idea of a community meeting, Brucker told The Courier in December that some items were open to be scaled back but some could not be eliminated entirely.

So far, the mayor has not proposed any actual changes. “We have to be cautious when people say, ‘well eliminate the kitchen or the gym or the tot lot,’” Brucker said. “Some things you can’t eliminate. You can’t eliminate a kitchen in the community center due to health codes. “When you’re dealing with active adults you have to have a place to store fruit juices, it’s a part of the code. Maybe an option (with the gym) is to scale back the basketball facility to something more of an assembly hall like what we have now. These are all options that we’ll let the community give us guidance on.” A mass e-mail sent out by resident Nancy Barth criticized the project and encouraged

Defense attorney Salvatore P. Ciulla countered that while mistakes were made, Hubbard did not commit a crime. ”He’s going to put his job on the line and possibly go to jail?’ Ciulla asked. “It makes no sense.” Ciulla also said he believes prosecutors may have waited too long to file the case against Hubbard, although Huntsman said district officials did not know of any possible wrongdoing until the summer of 2009 and the statute of limitations was not violated. Hubbard, 54, is charged with three counts of misappropriation of public funds. Huntsman said the school board never authorized two payments of $10,000 each or a $500 monthly car allowance that were paid at Hubbard’s behest to Karen Anne Christiansen, a former facilities director for the district. Christiansen’s contract included a $150 monthly car allowance, and all changes to the contract were supposed to be made in writing, Huntsman said. The prosecutor said Hubbard had email exchanges with Christiansen that suggested a "special relationship" existed between the two. Ciulla described the emails between Hubbard and Christiansen as "tongue- in-cheek inappropriate comments." But he said the communications do not demonstrate a romantic relationship existed. Christiansen was tried last year and convicted of four counts of conflict of interest for negotiating contracts between the school district and a firm with which her company had a consulting agreement, and for backing a school bond measure that benefited her firm. The 53-year-old woman was sentenced earlier this month to four years and four months in state prison, but was allowed to remain free on $400,000 bail while her appeal is pending. Hubbard also allegedly directed that another employee, Nora Roque, who was then working as a human resources

Rosen said for the system to engage, the light has to be red for a full 2/10 of a second and the car has to be on the sensor behind the limit. “If the light is yellow and you’re already into the intersection, it’s not going to take your picture,” Rosen said. “If the light just turns red, it’s not going to take your picture. It has nothing to do with speeding, (the camera) will take your pic-

ture if you go straight through the intersection against the red, make a left turn against the red or make a right turn against the red.” The potential tickets go through a vetting process both with the vendor and then with a BHPD police officer. “We don’t issue a lot of tickets because it doesn’t meet our criteria,” Rosen said. “For example, if the light is red and someone slams on their breaks and stops a little bit late for the intersection but they do stop, technically they ran that red light, but we don’t issue that ticket; same thing with a right turn. The residents have four main points ignored by the DPSS so far for the proposed “Bridges to Recovery” treatment facility at 777 Sarbonne Road in Bel Air. First is the business reputation of the owner; second is the high pricing that is considered predatory; third is the license and whether it is appropriate for the type of services offered by the facility; and fourth is the safety and well being of patients at the facility and the residents in the area. The Courier will address the first two points today and the other two next week. Bridges to Recovery owner Aron Abecassis has been a Beverly Hills resident for the last 15 years. In addition to owning three Bridges to Recovery centers in the Pacific Palisades, Santa Monica and Bel Air, he also owns other companies including Abecassis Management Inc. and Abecassis Investments LP. Through a review of DSS records and civil litigation, The Courier saw evidence of many lawsuits against Abecassis and many complaints filed against the Bridges Facilities. According to DSS records, the facilities have received dozens of complaints including the Pacific Palisades Bridges to Recovery operating without a qualified

administrator in November 2008; staff not being properly vetted with criminal record clearances in the Santa Monica Bridges to Recovery throughout 2010. All of the violations were settled either through correction, fines or both. Abecassis said the lawsuits were a result of his work as a landlord. He said small-claims lawsuits were nothing out of the ordinary in the real estate business, where there is a high volume of exposure to lawsuits. “As a result of being a landlord and having to deal with someone who is destructive to your unit, we end up having to deduct a lot of the expenses or damages out of people’s security deposits,” Abecassis said. “No one likes to loose any security deposit and often they go to small claims court. I have never ever been found guilty of anything of any substance.” A letter to resident attorney Peter Gutierrez from Latham & Watkins written by DSS Community Care Licensing Division Jeffrey Hiratsuka said these complaints filed with the DSS were considered normal. “It is true, CCLD has received complaints of non-conforming conditions at those facilities’, and some of these allegations contained in those complaints have been substantiated by CCLD,” the letter said. “All cited non-conforming conditions at those facilities were not serious in nature and have been corrected. It is very com-

mon for licensees of large capacity ARF’s to be cited for intermittent and non-chronic, non-conforming conditions.” The owner appears to be charging a high premium for the exclusive Bel Air location. Treatments at the Pacific Palisades and Santa Monica facilities start at $45,000 but the treatments at the Bel Air facility start at $70,000. Comparatively, the Aurora Las Encinas hospital in Pasadena has a mental health program in which a seven day stay for psychiatric issues costs approximately $5,880. Gateways Percy Village Adult Residential Facility, a non-profit facility, offers a six to nine month stay for approximately $3,000 to $5,000 a month excluding medication. When broken down, a one-week stay at the Bel Air Bridges to Recovery costs about $17,500. Abecassis said the pricing is evaluated by the market from competing facilities and based on cost but that they offer partial scholarships to those in need. “We have an extensive amount of individual therapy we provide for our clients and there’s a formula we have based on the cost,” Abecassis said. “We provide a lot of scholarships for people who can’t afford our prices, up to half depending on the circumstances.” For the second half of the story, see next week’s issue of The Courier.

At this time; Gruen Associates have finalized construction documents for the Wilshire Boulevard/Whittier Drive location; and it will be the first “test” site for installation that will be transmitted to the PreQualified Bidders on/before Monday March 5, 2012. The PROJECT involves monument construction in conjunction with associated landscaping, concrete and street paving work at four heavy-traffic locations throughout the city. The PROJECT will be constructed in four phases. Phase 1 is the Wilshire/Whittier location. Some of the features of the new Gateway Monuments will consist of decorative concrete and/or stone paving, specialized stone cladding work, street furniture and elaborate landscaping. The work consists of demolition and enhancement of four major intersections/raised medians within the City of Beverly Hills. The current estimate for the Wilshire/Whittier installation is approximately $850,000. WHY WON’T THEY LISTEN? Elected leadership can be difficult. At what point do elected officials rely solely on his or her own judgment? When do they listen to the citizens? Striking that balance is often not easy. If an elected official requires consensus to proceed, nothing will ever get done. Cities, counties, states and the nation will stagnate. Our system is designed to make final decisions tough – not to prevent action but to try to ensure actions taken are wise or at least generally supported. “Gridlock,” the bugaboo of the mainstream media, is exactly what is designed into the system. Locally, however, it is presumed that citizens have direct contact with their elected officials so that their officials – often neighbors serving largely as volunteers – truly reflect the views of the citizens. There is no law that requires this, only a respect for the views of others. When officials go off the path, elections to renew or reject the service of someone who holds office are the remedy. In Beverly Hills, we’ve seen in the last decade strong divisions of opinion, mainly centered on a couple of development projects. Each project went to a vote of the people to receive a narrow approval. The Montage Beverly Hills project won a squeaker and The Beverly Hilton Revitalization Project won an even narrower victory. The City Council endorsed each of those and the voters upheld those decisions. The Montage was built and is proving to be exactly what was promised. The Beverly Hilton is stalled from the economy. With the Montage, the main objection–traffic–has proven to have been a false argument. The height–another huge argument of opponents–seems to be a non-issue now. With the Beverly Hilton, we’ll see. At the time these issues were fulminating, various councils tried to pass new taxes, destroy free parking, and otherwise act against the wishes of the people. In each case, when those issues went to the voters, the voters rejected them. The Courier opposed new taxes and strongly defended our tradition of two-hour free parking. The motivation of the council in trying to stick it to us with new taxes and fees was the same – the insatiable demand for new revenues to pay City employees unreasonable wages and astronomical retirement benefits all the while granting 13 weeks paid time off. The notion was and remains – an abuse of the people. However, at least in those cases there was a financial imperative driving the process. If the City Council decided it would continue these pay practices, at least the insistence on new revenues was

understandable. We disagreed with the policy but the theory, at least, made sense. Where we as citizens need to draw the line firmly is when ego projects of some neighbors who have long served in government lead to abusing our City. Right now, there is no citizen support for a huge new “community center” at Roxbury Park. This park–our only real City park–sits in the middle of a 100 percent residential neighborhood. It is our only green space of any size. While the neighbors and residents throughout the City protest the plans, the City Council majority of Mayor Barry Brucker, Vice Mayor Willie Brien and (of course) member Julian Gold, are steamrolling the process to build a local version of “LA Live.” Hugely troubling is the fact they are building commercial banquet facilities there to compete with our hotels and restaurants, as well as space for all-night basketball and who knows what else. In the plans they released, there is utterly inadequate parking. “Park you cars on Olympic,” they say. That’s brilliant. There is no “environmental impact report” under way because the City’s long-time outside paid city attorney “concluded” one is not needed. That is a subterfuge. Reform councilwoman Lili Bosse knows the law cold and she is appalled, as is fellow reformer John Mirisch. Unfortunately, they are always outvoted. The reality is the Roxbury plans have been drawn and contracts are done. The project is going forward. We believe that Brucker and Brien want to be elected – again. For Brucker, again and again and again and again. He will have spent four terms in City government – two on the school board and two on the City Council. Part of his school board legacy has spent the last two years in the criminal courts and his administrative decisions nearly wrecked our district. We watched last year as he personally rejected plea after plea from virtually every interest group in the City to protect Beverly Hills High School from the MTA tunnel in open council session. If any of us believe that elected officials must balance personal ego with the wishes of the people, we have only one way to enforce that. We will have an election in Beverly Hills and it will be up to the people to enforce the balance they demand. Right now, the City Council majority is off-balance and determined to force things on us that are NOT driven by a financial imperative. It will be up to the voters to decide whether or not this continues.

Rabbi Jacob Pressman BIGGER IS NOT NECESSARILY... Somehow we have become obsessed by the concept that bigger is necessarily better. We take pleasure in watching statistics grow. I insist that “it ain’t necessarily so!” The luxury liner, Costa Concordia, is big, almost twice the size of the old ship, the Titanic, which also sank. Still, in the shallow waters off the Tuscan coast of Italy, she capsized with substantial loss of lives and property. Years ago, the largest man-made object in the sky, the Graf Zeppelin, crashed and burned before the horrified eyes of the world. In the process of transporting human lives, bigger is not necessarily better. Faster is not better. The desire of people to get there faster has resulted in the building of faster vehicles. We watch terrified as racing cars crash, freeways create pile-ups, and hundreds of human lives are jeopardized in the pursuit of speed. Wealthier is not necessarily better. It raises many questions: “How much does a person really need? $1 million? $2 million? $450 million?” And if we want to see it, it is usually all on paper or in a computer somewhere. We can’t feel it, count it out, and show it to others. Are we going to use it, other than acquiring more or running for office? I will admit it is better than poverty, any day. Costlier is not better. A Maserati can turn into junk in a moment when struck by a wee Fiat. Huge mansions can be leveled by earthquake or firestorm or flood. So, what is better? Love is better. Love and respect nature, animal, vegetable and mineral. Love your fellowman, regardless of race or creed. Above all, love and be true to yourself, and then, as Shakespeare said: “Thou cans’t not then be false to any man.
