By Laura Coleman The Beverly Hills community celebrated education last Thursday night at the Beverly Hills Education Foundation’s kick-off fundraiser at Fleming’s Prime Steakhouse, which raised over $45,000 directly for schools. Fleming’s picked up the entire tab for the 160-plus guests who enjoyed a five-course dinner featuring wines by the Frank Family Vineyards at Thursday night’s “Red Carpet” event, which was co-sponsored by The Courier. “We know that their support will serve as an example,” (see ‘FLEMING’S,’ page 14)

renovated Community Center. “We’re very supportive,” said PETS 90210 Director Bill Crowe, whose organization has helped find homes for over 4,000 rescue animals through adoption events at Roxbury Park the past eight years. The $25,000 budget proposed for the construction of a 14,400-square-foot off-leash enclosure in northeast Roxbury Park, which takes over the croquet lawn, is not part of the City’s $14.4 million redevelopment plan for Roxbury Park, which includes $1.3 million for park site improvement. Many of the roughly 100 residents at Monday's town hall emphasized the need for a dog park in Beverly Hills, which would give apartment-bound neighborhood dogs without access to backyards the opportunity to run free, in addition to serving as the social nexus for pet owners and pooches. “A dog park is probably to-
day's town center,” said Beverly Hills Croquet Club President Xandra Kayden, whose club will take over one of the greens currently used by the Beverly Hills Lawn Bowling Club. City Publicist Jessica Emerson said that of 51 people who responded to a questionnaire at the town hall, 37 supported the creation of a dog park. Although the majority of Monday night’s 34 speakers supported a dog park, some, such as Human Relations Vice Chair Rochelle Ginsburg, voiced concern it could change the character of a neighborhood park. South West Beverly Hills Homeowners Association President Ken Goldman said that all of the members he represented were opposed to bringing a dog park to Roxbury. Lifelong resident, homeowner and dog owner Jackie Kassorla said she was surprised to see the range of emotions. “It’s a sensitive matter, coming up with the best space in Beverly Hills,” she said."

The world has avowed that “never again” will the Holocaust happen – indeed, President Barack Obama marked International Holocaust Remembrance Day on Sunday by pledging to “stay true to the principle of ‘Never Again’” and oppose any tyrant or dictator who commits crimes against humanity – but ongoing genocides in Darfur, Sudan and Congo illustrate that 68 years after the liberation of Auschwitz on Jan. 27, where over 1 million Jews were killed solely on the basis of religion, human beings are still slaughtering each other. Roughly 30 minutes before the legendary force behind Sophie’s Choice and Schindler’s List took the stage, Lustig confided to The Courier that he believed the voices of the six million Jews killed in the Holocaust would be stamped out over time. “I’m a very pessimistic person,” he said. “I think 20 or 30 years after we die, it will be forgotten. “People will not remember.” For the past seven years Lustig has been hosting the Zagreb Jewish Film Festival, another example of how the Croatian-born Jew, tattooed in Auschwitz with the number A3317, is committed to preserving the Jewish narrative. Mensch Foundation founder Steven Gieger said the Yiddish word “Mensch” is the best compliment you can give a person. Beverly Hills Temple of the Arts Rabbi David Baron, one of the speakers on Tuesday, said it was critical to keep the memory of the Holocaust etched in the collective mind. Other speakers included Daniel Pearl Foundation President Judea Pearl, Loyola Law professor Stanley Goldman, German Consul General Bernd Fischer, and American Jewish University professor Michael Berenbaum. Branko called his two-part miniseries devoted to World War II, The Winds of War and War and Remembrance his most important work in a career marked by producing stories that underscore the human condition and its intrinsic frailties and strengths. “Day by day we are less and less survivors,” the 80-year-old Auschwitz Concentration Camp survivor told just over one hundred people in the audience Tuesday night. “The problem is that I’m afraid that one day, after all of us will be gone… “I want to ask you, what have you done, that this will never happen again?”

The list of new landmarks includes: Virginia Robinson Estate and Garden,1008 Elden Way, Greystone Mansion, 905 Loma Vista Dr., Beverly Hills WILDLIFE–Beverly Hills resident Betty Denitz stands beside her new National Wildlife Federation sign which certifies she maintains an official wildlife habitat. The federation this month recognized that her modestly sized home and garden has all the elements necessary to attract wildlife, such as the bird baths and citrus trees that encourage visits by Monarch butterflies, hummingbirds and Blue Jays. “What’s exciting is that this whole thing is supposed to cut down on global warming,” Denitz told The Courier. Horace Mann Bricks Go Up For Sale For School Fundraising Effort By Laura Coleman The Beverly Hills Board of Education unanimously voted to support the sale of $100 engraved bricks by the Horace Mann PTA at its Jan. 22 board meeting. “It’s a call to action,” Boardmember Lewis Hall said before voting in support of the fundraising campaign to support

When the retail employee opened the jewelry case to let the suspects look, a third suspect appeared brandishing a handgun and demanded jewelry from the retailer. The format will run the gamut of how to dress for job interviews and special events; how to apply make-up and pick out the appropriate clothes; wear high heels; proper table etiquette while dining; and the body language needed to give speeches or simply to relate to other individuals. “Life usually gives a person a few ‘can’t miss’ opportunities but you have to be ready to take advantage of these because they come along so rarely,” states Djadenko. “The show will attempt to bring out the inner beauty of each individual while at the same time restoring some of the glamour of old Hollywood.” While developing plans for the KristiD Show, she is currently hosting on Merci TV’s international satellite while also serving as an image consultant for Global Private Funding. Equipped with a temporary visa, she landed at LAX and headed straight to her new home in Beverly Hills. Soon after her arrival, she met her now mentor, Jimmy Sedghi, who has guided her burgeoning career ever since. The latter is a local business consultant and a former diplomat who had established the first Iranian radio station in America. He later became a confidant of the late Shah Mohammad Reza Pahlavi and the royal family. Prior to the Iranian Revolution, he organized a tour to Iran of a number of Hollywood stars including Elizabeth Taylor, Connie Stevens, and Cloris Leachman. While he is currently prepping a new reality series called The Real Shahs Of Beverly Hills; The Pride Of America, his prime focus is on the launching of the KristiD Show. “Kristina is a tremendous talent and has the ability of bringing out the best in those she reaches,” states Sedghi. “It’s her purpose to instruct people to only become winners in their particular careerpaths nd the art of living.” It would seem Kristina Djadenko has been reaching for the stars all her young life, but, now perhaps, the stars are reaching for her.

SoCal Connected, KCET’s nightly news program, garnered two awards including “Best News Public Affairs Program“ and “Best Investigative Reporting.” In addition, KCET’s new transmedia cultural journalism initiative Artbound, received
two awards for “Best Entertainment Reporting” and “Best Internet News Reporting.” The Golden Mike recognizes excellence in broadcast journalism. Last year, SoCal Connected received four Golden Mikes. Pickford, Queen Of The Movies, Subject Of New Book, Screening To celebrate the release of Mary Pickford: Queen Of The Movies, co-published by The University Press of Kentucky and the Library of Congress, the book’s editor Christel Schmidt will host a screening of Beverly Hills’ pioneer Mary Pickford’s 1918 feature Johanna Enlists at 7:30 p.m., Wednesday, Feb. 13 at The Hollywood Heritage Museum, 2100 N. Highland Ave. Based on the short story The Mobilization Of Johanna by Robert Hughes, Johanna Enlists features Pickford playing a young girl who encounters an army regiment training near her father’s farm. Schmidt will also sign copies of her book in which film historians shed new light on the icon’s life and legacy. It features more than 200 color and black and white illus-
trations, including photographs and stills from Pickford’s personal collections housed at the Library of Congress and the Academy of Motion Picture Arts and Sciences. Schmidt explores rarely discussed areas of the star’s life and career, including her interest in the archival film movement, her role as a national icon during World War I, and her marriage to Douglas Fairbanks. Academy Award-winner Kevin Brownlow looks at Pickford’s work as a producer, and Beth Werling discusses her costumes. In a city known for the glamour of its lavish black-tie soirées, nothing sets the bar higher for elegance, sophistication and world class entertainment than the Palm Springs Art Museum’s annual major fundraising gala. Just ask any of the 400 guests who paid $750 per person (and up) to attend this year’s SRO event. The evening’s activities were divided into four components. Arriving guests were greeted atop the museum’s grand entrance stairway–enhanced for the occasion by multi-hued carpeting that set the event’s Pucci-design theme–by gala co-chairs Georgia and Jerry Fogelson along with Roberta Holland, president of the Museum Associates Council. First stop for guests: the Houston Atrium and its lavish reception where glamorously-attired art patrons mixed and mingled, barely noticing the troupe of entirely-clad-in-gray mimes roaming through the space, seemingly oblivious to the crowd around them. The museum’s Annenberg Theater was the next stop where guests were regaled with a masterful performance by a quartet called Under the Streetlamp. The name has its origin from the mid1900s, when groups of guys (primarily) would huddle on street corners in New Jersey, New York and Philadelphia – under the streetlamp – and try out their acappella harmonizing of rock ‘n’ roll, doo-wop and Motown hit songs. Under the Streetlamp (Michael Cunio, Shonn Wiley, Michael Ingersoll and Christopher Kale Jones) pay homage to that time more than halfcentury ago with their flawless voices reprising the timeless songs of what they refer to as the “Great American Radio Songbook.” It was a masterful, high energy evening brought to the Desert by four veterans who have stared in various productions of the Broadway hit Jersey Boys, a musical history of Frankie Valli and the Four Seasons. Singing along with Under the Streetlamp and its seven-piece band builds up an appetite, so after the group’s performance, guests returned to the museum’s main level for a sit-down dinner in the main-floor Annenberg Wing, now transformed into an elegant super club featuring Pucci-inspired custom-designed table centerpieces and overhead mobiles. During dinner, violinist Brittany Cottover performed a medley of contemporary hits, making her way among the diners while the Houston Atrium was made ready for the New Sensation Band who provided music to dance the rest of the night away. Want to be part of the fun? The museum’s annual gala may be over until next year, but the ex-
citing fundraisers presented by the museum’s various auxiliary councils are sure to make for a series of upcoming, fun-filled programs. On Feb. 21, the museum’s Architecture and Design Council presents a Mad Men-themed party at the museum’s soon-to-be-renovated Architecture and Design Center in Palm Springs. An Art of Shopping fundraiser featuring fashions, jewelry and lunch at Cuistot, one of Palm Desert’s premier restaurants, will be held on Feb. 25. The Western Art Council always provides unique, impressive funders such as the Mar. 2 dinner in Jim Houston’s home, featuring Robert Redford and honoring artist Dan Namingha. On Mar. 23, Photography Collection Council models its annual fundraiser at a private residence in Palm Springs, after the famous 1966 Truman Capote “Black and White Ball.” If paying taxes will deplete the amount of your disposal income, then the “99 Bucks Art Sale,” on April 13 at Hotel Zoso in Palm Springs, will be just the thing to suit your budget. But did you know every year, millions of pounds of produce–a quarter of all food crops–are left un-harvested, plowed under or destroyed? The reasons: cosmetic blemishes, overproduction or dwindling market price. In 2001, Desert resident Christy Porter saw this waste of edible, nutritional produce and knowing that about 40 percent of the children in the Coachella Valley live in poverty along with nearly a quarter of all adults, decided to do something to alleviate the problem; and the nonprofit Hidden Harvest was born. The organization collects and distrubutes unwanted produce to Valley agencies to feed the hungry. Using refrigerated trucks, each delivery is tailored to the food bank, soup kitchen or food pantry’s days and hours of service to ensure the produce arrives at its freshest. It has become so effective, (rescuing more than 11 million pounds of produce since 2001), and been recognized by former President Bill Clinton and featured on the Clinton Health Matters Initiative’s web site. Jerry Brown’s Prop. 30 fund redistribution effort which ignores cities like Beverly Hills. “Our children have learning disabilities and impairments just like any other area. Our people jus expect more and demand more and want more.” Mayor Willie Brien said he has been a “strong supporter of our schools dating back to when my kids were in school.” Beverly Hills lawyer Katherine Cohan, who has two small children in BHUSD schools, said: “We need to come up with resolutions as to how we can fund schools so we won’t have that problem next year and the year after.” Candidates were also asked by host and Muni League chairman Thomas White about various issues facing the City, ranging from Metro attempting to tunnel under Beverly Hills High School to the T-Zone at Santa Monica Boulevard and Wilshire Boulevard. Lives With Berlin Artificial Heart Last December, the FDA approved use of the life-saving Berlin Heart device for children nationwide. Children’s Hospital Los Angeles (CHLA) now has at least one or two patients on the device at any given time. A recent sucess story is 11year-old Milan McMillan, who suffered from Dilated Cardiomyopathy. A healthy-appearing child, she had complained of abdominal pains and was prescribed an anti-acid medication a few months preceding a family barbecue in July when she was experiencing shortness of breath, chest pain, and abdominal pain. She awoke from sleep with shortness of breath, palpitations, and her “heart racing.” Her parents took her to a local hospital, stating she “didn’t look right.” The emergency physician there detected a heart murmur, EKG abnormality, and decreased heart function by echocardiography and she was transferred to CHLA’s Cardiothoracic Intensive Care

Unit (CTICU). “I could never imagine something like this in a million years,” said Milan’s mother Karen. “She was an active member of the YMCA, in water aerobics, karate and basketball.” After four months in the hospital, she had the device implanted in September by Cardiothoracic surgeon Dr. Cynthia Herrington. About the size of a softball, the device rests outside the body connected to the heart with tubes and attached to a pump and external drive.
Dr. Herrington also did the successful heart transplant in December and Milan was able to go home for the holidays after being on the heart transplant list for “quite a while.” At the time she was one of more than 250 children nationwide awaiting a heart transplant. “A bridge to transplant,” as Herrington describes it, the Berlin “is an amazingly good device,” she says. “Kids do well and it keeps children alive to get a transplant.” Read the full story at www.bhcourier.com

Section 1. On December 13, 2012, the Planning Commission held a duly noticed public hearing, which was continued to the following meeting on December 20, 2012, at which the Planning Commission adopted Resolution No. 1660, recommending that the City Council amend the Zoning Code to establish a process by which deviations from development standards occurring as a result of construction can be approved if certain findings are met. On January 8, 2013, the City Council held a duly noticed public hearing, received public testimony, and thereafter introduced this Ordinance. Section 2. This Ordinance was assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. It has been determined that adoption of this Ordinance would not have a significant environmental impact and is exempt from CEQA pursuant to Section 15061(b)(3) of Title 14 of the California Code of Regulations. The City Council hereby finds that it can be seen with certainty that there is no possibility that the adoption and implementation of this Ordinance may have a significant effect on the environment.
Section 9. The City Council shall review the impacts of this ordinance and whether to modify or repeal the ordinance within one year after the effective date. Adopted: January 24, 2013 Effective: February 24, 2013

An applicant may seek a determination that a project substantially complies with the zoning code if, after a development project has been approved, a building permit has been issued and the City has approved placement of the footing, it is discovered that the project as constructed does not meet the requirements of the zoning code or conditions of approval. A substantial compliance determination may be approved, with or without conditions, for the zoning code standards listed in the table included in this section if the reviewing authority makes all of the following findings: 1. That requiring strict compliance with the zoning code would create substantial financial hardship for the applicant; 2. That the items that deviate from the code would not exceed the permissible deviations stated in the table included in this section; 3. That approval of a substantial compliance determination would not result in substantial, adverse impacts to neighboring properties; 4. That approval of a substantial compliance determination would not pose a threat to life or safety; 5. That the circumstances surrounding the request for a substantial compliance determination do not indicate that the applicant intended to deviate from the zoning code standards. Nothing in this section shall allow the amount of front yard paving, the floor area of a building, or the height of a building to exceed the limitations in the zoning code. Nothing in this section shall authorize any encroachment onto the public right-of-way or onto neighboring properties. The reviewing authority for a substantial compliance determination shall be the director of community development. If, in the opinion of the director an application merits review by the planning commission, the director may refer such application to the planning commission and the planning commission shall serve as the reviewing authority for such application and shall conduct a noticed public hearing regarding the requested substantial compliance determination.

The Director of Public Works, from time to time as he deems appropriate but no less often than once every two years, shall determine if any adverse effect upon the surface of the city is occasioned or is in danger of being occasioned by reason of the removal of oil, gas, or other hydrocarbon substances from the subsurface of the city pursuant to a well regulated by the provisions of this article or pursuant to a well, no part of which is located within the city but which drains a subterranean oil or gas pool, part of which is in the city. In the event the Director of Public Works observes any such adverse effect or danger, the Director may order the immediate suspension of further production from such well or wells as may be located entirely or partly within the city, and, in the event of such an order, production on such wells shall be suspended by the permittee or other operator immediately upon receiving notice of such order. The permittee or other person lawfully producing oil or gas or oil and gas or any other hydrocarbon substance from any such well may appeal to the council. The council, upon good cause being shown by the permittee or such other person, may vacate or modify the order of the Director of Public Works, or, if no part of the well is in the city, the council may direct the city attorney to immediately commence such actions or proceedings as may be necessary for the abatement, removal, and enjoining of further drilling operations which adversely affect property within the city in the manner provided by law and to take such other action and to apply to any court having jurisdiction to grant such relief as will restrain or enjoin any person from drilling or producing any such well.

CONGRATS TO FLEMING’S, BHEF AND US... THE COURIER Last week, Beverly Hills’ newest restaurant threw a “welcome” party that met or exceeded the highest standards and expectations of our community. Fleming’s newest outpost, on North Beverly Drive, generously funded a sold-out event for the Beverly Hills Education Foundation. The evening raised $45,000 for our public schools. The Courier jumped in with both feet as media sponsor, providing coverage, promotion, video and photography. We were proud to do it. The evening’s entry price was substantial, but everyone we spoke with said “The price was worth it.” To make no mistake, Fleming’s paid for all food, beverage and service (all were absolutely outstanding). The excellent dinner wines were a gift from the Frank Family Vineyards, headed by former Disney television chief Rich Frank. He and his wife, KABC’s Leslie Miller, both attended. The red carpet arrivals, the standing-room-only crowd, the beautiful new restaurant–and the fabulous hors d’oevres and dinner–all combined to make it a magical evening. BHEF President Annette Saleh thanked the supporters, Fleming’s partner-owner Tai Nguyen and chef partner Brandon Powell, and The Courier for their support. The event was a huge “win” for Annette who fought hard for the event along with executive director Matt Zarkufsky. Kudos as well to the entire BHEF board and dinner committee. Applause all around. The evening proved that when new businesses come to Beverly Hills to be part of Beverly Hills, they are welcomed enthusiastically. We thank Fleming’s for its generous gesture of good will and commitment to be part of our City. ******************************
INVESTIGATIONS VS. LOBBYISTS
The past two weeks The Courier published – without editorial comment – the actual cost to Beverly Hills taxpayers of our City government staff. What we have not yet published is what all of the categories of pay and benefits actually add up to. We’re trying to do the arithmetic. “Math is hard” when you are trying to interpret bureaucratic gobbledygook about pay and benefits. We’ve asked the questions, but the answers we received were not particularly helpful. What is The Courier now doing? By next week, we will have done the math. We will report the totals. In the meantime, we caution our readers during this election cycle to look to the sources of information. The Courier follows the practice of “double sourcing” all our information, or, as in the case of city finances, reporting directly from official documentation we believe to be trustworthy. When The Courier reports facts, they are facts. We believe that the straight facts we have published prove that the employees of the City of Beverly Hills are not poor, underpaid “civil servants” who have given up a financial pot of gold to serve us. They are well paid, given amazing benefits, awarded a huge pension and lots of time off. We have more staff in this City per capita than any other in California (in this calculation we exclude police, fire and paramedic – this City demands and gratefully pays for the best in public safety). We support top pay for public safety. We do not support featherbedding and massive pensions that will consume all our money within the next 10 years. The pay and pension issue is serious, as is the battle against the Metropolitan Transit Authority’s two tunnels underneath Beverly Hills High School. The outcome of both issues will determine the fate of our City. Unfortunately, we have some paid lobbyists in and around our City who keep attacking those who defend us while they promote those who would sell us out. (Just look at who paid for what.) The Metro tunnels are not an issue for Beverly High only. Just this past week, neighbors of the proposed La Cienega and Wilshire station – touted by Mayor Willie Brien as being “without controversy” – are now learning that their very existence is threatened by the massive excavation planned by Metro at that location. According to Metro, an open trench nearly 2,000 feet or more long and nearly 100 feet wide will take all of Wilshire for up to seven years. Plus, the big dirt haulers 24/7 in and out. How will our signature “Restaurant Row” fare? How will the adjacent medical buildings fare? How will the historic Fox Wilshire – now the Saban Theater – survive? Metro told these people there would be no open ditch, no damage to foundations – that it will all be just fine. That is not true, as they are now learning. With Metro, when certain council candidates say: “Oh, pooh, pooh, there’s nothing wrong,” you need to look at who is supporting them. Where does their campaign money come from? Are they running to represent Beverly Hills or running “for the greater good of the region”? These are fair questions. The Courier endorsed Vice Mayor John Mirisch last week because we know for a fact where he stands. We also know where at least one of his opponents stands on this, and it is not with Beverly Hills. That conclusion will be obvious to all readers in the next few weeks, if not already obvious, based on that candidate’s own statements and votes. None of this will be spun, invented or made-up by The Courier. What we can expect, however, is that the paid mouthpieces of Beverly Hills will chime in. What you will not see, however, is any facts coming from them to back up the pandering. Our City faces these two controversies that will determine our future as a City. The Courier asks that you truly look at the facts. Rabbi Jacob Pressman THE HONEYMOON IS OVER! The millions who packed the Washington mall to witness the swearing-in of President Barack Hussein Obama for a second term have returned to their usual routines. The cleaning crew has picked up the trash left by the cheering crowd. The Democrats, Republicans and what have you have resumed their bickering about the policies of our government and plans are being laid out for the next national elections two years ahead. The unwieldy wheels of governing this great republic have returned to their grinding, and the citizens have now turned their attention to the sports, market, Oscars and climate, which regularly claim our attention. What a wonderful country is ours! We never seem to lack some national issue to command our attention so we can choose up sides and take opposing positions to those of us who care. The statistics of the percentage of us who engage in these activities vary little. There is a huge body of our citizens who never seem to get involved and leave it to the rest of us to make the decisions that affect their lives, seemingly confident that the activists will do the right thing. One statistic, which encourages me, is the age of the activists seems to be dropping. The young adults who register and become involved in the political process are increasing in numbers. Candidates are no longer simply senior citizens already entrenched in politics. I see more fresh-faced and college bred politically active younger candidates surfacing to take the place of some who have been in office too long. I see the emergence of people of all the races and colors eager to serve in the public arena. Unless the Old Guard stonewalls them, we shall soon find them a majority among our political leaders. The above gives me hope for our great republic and regret I shall be here to witness it. But – carry on without me!

A few weeks back I received a letter from the BHPD regarding the City's possible intention to install an AT&T Outdoor Distributed Antenna System. The letter explains AT&T would not be installing just one antenna but close to 100 all over our neighborhood. (I wonder what other cell companies have done in B.H.). An attached map indicated where the installations would be placed. When I read point #14, I grew quite alarmed as it talks about the RF Radio Frequency fields, and the radiation exposure of just one antenna. Well, if one emitted radiation how much radiation exposure would 100 be doing? Shouldn't this be considered a health concern since it is the cumulative effect of radiation whichposes health risk. Lili Bosse and John Mirisch really listened and are now researching my inquiry. They deserve a great deal of credit for making sure we are living in a healthy, safe environment. Rachel Kashi ****** Reading the entire pay/benefit packages of employees of the City of Beverly Hills which includes the unbelievable retirement packages of every City employee,(3 percent of the average of the highest 3 years multiplied by each year of service up to a maximum of 30 years service or 90 percent of salary), is both disgraceful and shocking. This is especially so knowing Beverly Hills renters and property owners will ultimately carry the burden of paying these pension benefits that dwarf the retirement of all but the very richest private citizens. To me it brings to mind the lyrics of the song Everybody Knows by gifted singer/songwriter Leonard Cohen: “Everybody knows that the dice are loaded....Everybody knows the good guys lost....Everybody knows the fight was fixed....The poor stay poor, the rich get rich....Thats how it goes....Everybody knows.” To correct these unaffordable, unfair benefit packages will not be easy. The entire City bureaucracy with few brave exceptions will fight against any lessening of these golden packages on steroids. They will use disinformation, threats, work stoppages and God knows what else in this coming fight. They will be aided by their usual City Council allies who always seem to know what is best for the City, the cost be damned.Thank heaven The Courier continues to expose important issues like the Roxbury Park boondoggle and this even more important issue threatening to bankrupt either the City or its citizens–or perhaps both.
