name of that Asian nation, while Mayanmar is the name used by the despotic government regime in power. As our government had not yet recognized its legitimacy, we Americans were still calling the country by it’s traditional name.
Jones To Be Honored By Palm Springs Women In Film and TV Shirley Jones will be honored by Palm Springs Women in Film and Television at the organization's awards gala, organizers announced Wednesday. Area Fault Investigation Report outlines many of the hazards associated with the tunneling project, such as fault rupture, gas explosion and ground settlement, Exponent’s overarching opinion is that neither report demonstrates the presented findings as based on rigorous risk assessment(s) on these subjects. Specifically, no attempt is made to quantify or even qualitatively assess the potential risks from these scenarios. No quantitative nor qualitative risk assessments have been presented to either a) estimate the likelihood of such events or b) characterize the potential severity of such events to the public. “. . . It is Exponent’s view that the alternative Constellation Boulevard station, while generally in a more favorable location with regards to faulting issues, is instead faced with potential methane gas hazards which could represent at least as great a hazard to the public as the faulting hazards associated with the Santa Monica Boulevard station. In the absence of a quantitative risk assessment, the choice between the stations is more likely to be made on the basis of risk perception rather than risk quantification. Additional steps can and should be performed at both station locations to better quantify the seismic and gas hazards at these locations . . . “The proposed tunneling project has been characterized as having a low probability of causing disturbance to overlying structures based on the application of a simplified methodology for assessing such hazards and optimistic assessments of tunneling proficiency using pressure-face tunnel boring machines (TBMs). Frequent reference is made to previous favorable experience in the Los Angeles Basin using such de-
vices. Such references, however, have little meaning in the absence of detailed data from the earlier projects. “Even if the actual ground disturbances turn out to be as low as anticipated, the subway tunnels are projected to extend beneath older neighborhoods that are underlain by old, fragile water lines that could experience damage as a result of even minor soil disturbances. Special precautions will be needed to safeguard these lines from damage during construction. Gas hazards will not be insignificant for the proposed project. Most of the narrative in the reports focuses on gas hazards within the tunnel segments during construction. Almost no attention is paid to the potential for gas releases to the surface as a result of tunneling activities or to the future safe operation of the Constellation station, which would extend into geological deposits that have been closely associated with gas hazards at other locations in the Los Angeles Basin. “Substantial shortcomings exist in the efforts carried out to date to locate early wildcat wells along the proposed subway alignments, especially in the vicinity of BHHS. The reports are mute regarding the potential surficial hazards of encountering well casings during drilling or the ramifications of having to stop drilling and remove a casing while the TBM is parked beneath a sensitive structure. It is Exponent’s opinion that unknown factors such as these will preclude tunneling beneath the high school while in session. With regards to future construction of deep foundations in the vicinity of subway tunnels, the reports are somewhat vague and address only the concerns raised by BHHS. Other stakeholders along the route may also anticipate future construction activities that could be potentially impacted by the
B E V E R LY H I L L S M A I N N E W S presence of underlying subway tunnels.” MTA obtained the consent of Beverly Hills in 2006 to dig its Westside Subway Extension through the City routing under Wilshire Boulevard continuing under Santa Monica Boulevard. In October 2010, MTA suddenly switched its plan by placing the tunnel under Beverly High in order to benefit Century City developers. MTA’s own ridership studies showed that the original route – with a station on Santa Monica Boulevard–was preferable. The MTA seismic study, if accurate, shows some earthquake faulting from thousands of years ago that might impact the Santa Monica location. MTA has used that report to argue that it must tunnel under Beverly High. The MTA study also purported to show faulting under Beverly High. To date, the actual trenching reveals no such faulting. The Beverly Hills Unified School District Board of Education is opposing the tunnel under Beverly High. MTA’s board is expected to vote on a final EIR toward the end of next month. The study supports the conclusions and positions of the BHUSD’s Board of Education, its experts and attorneys in opposing MTA’s plans for a tunnel under Beverly High. It is not known whether reform City Council members John Mirisch and Lili Bosse will now be able to obtain a third vote on the council from Mayor Barry Brucker, Vice Mayor Willie Brien, M.D., or Councilmember Julian Gold, M.D., to defend Beverly High from the MTA’s plans. The Courier obtained these excerpts from City staff on the basis they would not be identified. The Courier submitted its California Public Records Act demand to obtain a copy of the complete final report.
SURVIVOR MITZVAH—The Museum of Tolerance played host to the Survivor Mitzvah Project’s humanitarian effort to help the last survivors of the Holocaust as a part of Holocaust Remembrance Day, Jan. 26. Preservationists Meet To Discuss How To Save The Hannah Carter Japanese Garden Bel Air residents and garden lovers met at the Community Magnet School auditorium to discuss what they could do to save the Hannah Carter Japanese Garden, which UCLA is making plans to sell, Tuesday. The garden was designed by Nagao Sakuri and Koichi Kawana and constructed between 1959 and 1962. The Carter family donated it to UCLA in 1964. Edward Carter, once chair of the UC Board of Regents, died in 1996. Hannah Carter vacated the residence in 2006 and died in 2009.

Repairing The World, One Coin At A Time Mount Sinai Memorial Parks and Mortuaries—hoping to shift consciousness toward helping others in a time when the world desperately needs it —has gone to a new level in social responsibility by going back to the basics. In a nod to Jewish tradition, they are distributing “Tzedakah”—or charity—boxes throughout California, Arizona and Nevada. “We want to make giving personal again. We want it to be from the heart and meaningful,” said Mount Sinai Memorial Parks and Mortuaries General Manager Len Lawrence. “We’re encouraging the Jewish community to create centers of kindness somewhere in their home, office or place of business, dropping coins into the box whenever they can, and then donating the proceeds to the charity that moves them the most.”
”If you’re like me, you may remember those blue tin Tzedakah boxes that sat on the kitchen counter when you were a kid,” Lawrence continued. “I used to drop coins into the box because it made me feel good and I felt like I was doing my part.” By providing space for inscription on every box, Mount Sinai is also encouraging donations in honor or in memory of a loved one. Tzedakah: A different kind of charity “Tzedakah,” although translated into English as “charity,” is somewhat different in meaning. While “charity” generally denotes giving out of generosity and a desire to help the less fortunate, Tzedakah is motivated by the need for justice and righteousness. Giving to the poor in the Jewish tradition is
an obligation because it is simply the only just and righteous thing to do. According to the Talmud, a central text in Judaism that
records rabbinic discussions of Jewish law and ethics, the mitzvah—or good deed—of giving Tzedakah is equal to all of the commandments in the Torah. Tzedakah also goes hand in hand with “Tikkun Olam,” or “repairing the world,” a fundamental precept of the religion. “By giving Tzedakah, even in very small amounts, we are repairing the world piece by piece, or in this case, coin by coin,” Lawrence explained. “The world can’t be made whole unless everyone participates in the healing.” The chai of giving Chai is the Hebrew word for life, and in Jewish tradition is the value of 18. Therefore, a “chai packet”—18 cents in
coins—will be included with every Tzedakah box distributed as symbolic of Mount Sinai’s dedication to life, the needs of the living and the mitzvah of giving. “The chai packet is our way of getting the recipients involved in the mitzvah of giving as soon they receive our box,” says Lawrence. ful career as an Emmy-nominated documentary filmmaker, works with individuals and families to capture their legacies and life stories. Often written as gifts to be passed on to children and families, these books are also homages to the uncommon heroism of “ordinary” people. In Remembering Joe, the pen is passed from one generation to the next as each family member contributes their individual and unique experiences of Gould as a husband, father, and grandfather, creating a nuanced, touching and colorful portrait of a unique man. Dorothy Gould recounts her husband’s humble beginnings as the son of poor Jewish immigrants and his ascent in L.A. from restaurant worker during the depression to owner of Gould & Co. Transportation, and later his career in banking. Together with a group of investors, he founded Hollywood National Bank (later acquired by U.S. National Bank), and then became president of one of its branches in Beverly Hills. He managed to run a model bank in the middle of all the financial industry difficulties, remaining unscathed by the indictments that came down against C. Arnholt Smith, chairman of the holding company. Gould was called in by regulators to put failing banks on a stronger financial footing. In his wildest dreams, he never imagined he–a man who never graduated high school–would achieve so much success. After retiring from banking, he worked with his son at David L. Gould Company. Arriving at 6 a.m. in time to
open the office, he worked there until three years before his death. It was a wonderful opportunity for father and son to bond and David, together with Marc, share “Lessons Learned from My Father” in another part of Remembering Joe. Stephens’ interest in documenting legacy began in 1996, when persuaded her mother to write her memoir. She wanted to capture her mother’s life against the tapestry of the changing role of women in the 20th century. Though initially resistant to her daughter’s pleas, her mother eventually relented allowing Stephens to conduct interviews over a 2-year period. In 2000 she published her mother's life story through her own imprint. Working on the memoir deepened her relationship with her mother, and when the latter died in 2006, she read passages from her mother’s book at the funeral. The importance of transmitting values and legacy to the next generation is at the source of Stephens’ work. Big Miracle–A Whale Of A Great Family Film

Big Miracle is the heartwarming story of three gray whales–a mommy, a daddy and an adorable baby (that is, if you can call a 15 foot, ton weighing mammal, a baby), who are trapped beneath 5 miles of arctic ice. It seems the other whales had already made their departure but someone failed to tell the mommy and daddy they were leaving for a body of water that does not freeze over. Either that, or they had a lousy travel agent. At any rate, their harrowing escapade in 1988, captured the interest of the entire world. There is actual footage of three network anchors–Dan Rather, Tom Brokaw and Peter Jennings–keeping America posted on the efforts to save the desperate whales as time is of the essence. Inspired by true events, it’s pretty easy the tell which are actual and those manufactured for the sake of the film that stars John Kasinski (Adam) as a TV reporter in Anchorage, Drew Barrymore (Rachel) as a Greenpeace activist and Ted Danson (J.D. McGraw) who is an oil executive and the bane of Rachel’s existence. As gray whales deep dive for 3 to 6 minutes and surface sprouting 3 to 5 blows, the anxiety builds to free them as quickly as possible. The other side stories that don’t amount to much. However, kids attending the theatres throughout America (and hopefully there will be many) will be thoroughly transfixed with the collective humanitarian efforts to save the whales. It is as wholesome a family movie as I have seen in a long time. There is a lot to criticize but coming in the midst of werewolves, macabre killings, comedies bordering on pornography, Big Miracle is a welcomed arrival. And, that isn’t a fish tale!

BURMA (Continued from page 1)
It took only a moment for me to decide to travel there–and, my hope was I might be able to meet an important woman in the politics of Burma, Aung San Suu Kyi. This country, which had been so closed to much of the outside world, had come to an auspicious time in its history and seemed to be interested in opening up normalization of relations with the West. In fact Secretary of State Hillary Clinton was due to visit Burma shortly before my own travels there. Everywhere I have traveled in the “third world” the past few years, there is evidence of Chinese activity. From friends who have lived in Yangon (formerly Rangoon) for 10 years I learned about China's activity in the north of Burma. Yes, roads were built, but also huge concessions were sought in terms of natural gas, minerals and gemstones. It was clearly an auspicious time in the modern history of this region. The new movie The Lady tells the history of Aung San Suu Kyi very well. Her father, Aung San was a commander of the British Independence Army who was assassinated with his entire cabinet just prior to achieving Burma's independence from British colonial rule–when this daughter was only 2. Educated abroad, she married an English academic
and was raising two sons in England when she received a call that her mother had a serious stroke. Retuning to Burma to care for her mother, she became involved in the democracy movement beginning to emerge and being brutally suppressed by the government. Her first speech, outside Burma's most important Buddhist Shrine, the Shwedagon Pagoda in Yangon, was attended by several thousand people-–and then the reigning government saw her as a serious threat. Daughter of a national hero, carrying her father's name as part of her name, she became the rallying force for this new anti-government movement. Following her mother's death, she remained in Burma to carry on with the family tradition of serving her people. The story is well known of her years under house arrest (1989-2010), of the government’s unwillingness to grant visas to her husband and sons when the husband was terminally ill at the age of 55, and of the Nobel Prize awarded her, in absentia, with her eldest son giving her acceptance speech. Her dedication to freedom and democracy and her people has long been an inspiration the world over–but would it be possible to meet her and speak with her during my visit to her homeland? With dedicated efforts on the part of the museum, our extraordinary art historian
Olivier Bernier, and the local guide who knew her well, we were given a set time on a Sunday morning–her only personal rest time–to visit with her in her home–the very place she had so long been under house arrest. It meant chartering a special plane to meet the time schedule, and planning ahead as to how to best utilize the time we were so graciously given. It was very clear we must not ask any political questions nor anything that might put her in danger. Thus, each of us would be personally introduced to her, with our personal credentials and a few minutes to speak to her, and then she would speak to our small group, followed by another opportunity to speak to her informally over tea. Aung San Suu Kyi, a tall, stately and serenely beautiful woman, very poised and dressed in a colorful but simple national dress of her country, with the traditional fresh flowers she always wears in her hair, entered the room to welcome us. She met us one by one, responding to our individual credentials with an amazing amount of knowledge about the various fields of our endeavors. I was able to ask her two important questions –first about whether she had started training her staff for the important positions they will soon begin, once elected to Parliament–and she replied the training has already begun.
Then I asked about the education of the children, which is so sorely lacking, particularly in outlying regions. Many boys and girls are sent to monasteries during the school year–both for food and education–rather than for becoming life-long priests and nuns. She told me it is a huge problem, as there are no supplies or books, and she asked if I might be able to help in organizing a shipment of pencils, paper, and crayons for the school children. This is a project which would have to involve shipping to the American Embassy in Yangon as soon as our new ambassador is in place. I hope to bring this issue to our Board of Education and to BHEF to see if our children can participate in helping those of Burma/Myanmar. She told us of surviving her long years under house arrest by teaching herself to meditate each day and calm her mind. Along with a small radio, it was all she had to occupy herself. Fortunately, her doctor was able to visit and bring her books occasionally. We too brought her books. It was exciting and inspiring to meet this woman who has suffered so much, but still stands so strong in her resolve to move her country toward democracy and improve the lives of her people. It was a truly memorable and meaningful experience at a historic moment.

and residence, which can be sold separately or together, are valued at approximately $15 million. “Consistent with the agreement, $4.2 million from the proceeds of the sale will be used to establish professorships and endowments for programs across campus, from the arts to medicine to management,” Waugh wrote. “Any additional revenues from the sale of the residence and the garden will be available for other campus priorities at the discretion of the chancellor.” UCLA will not put any covenants or requirements calling for the garden to be maintained or preserved. Hannah Carter’s oldest son, Jim Caldwell said he felt if the home, which he said was appraised at $12 million, was sold, a portion of the proceeds could be used to maintain the garden. UCLA Spokesperson Phil Hampton said through the gift agreement UCLA could sell both the residence and the garden if the residence could not be used for what it was intended: either a home for the chancellor or a guest house for UCLA visitors. Hampton also mentioned a bid package will be made available this month. He said the property was available to be sold last Fall but was instead held until the university could reach out to Bel Air residents and “preservation minded individuals and groups” to let them know of UCLA’s plan. Caldwell spoke at the meeting on behalf of her five children. timeline for the community to keep in the loop of the process which will be transparent and will reflect the vision of our community.” Bosse told The Courier she has demanded that City staff provide her with its timeline to revise the project so she and fellow reform Councilmember John Mirisch can monitor what is happening with the project. Brucker banned both Bosse and Mirisch from the Roxbury ad hoc liaison committee, which means they will not be included in any staff or other non-public meetings about the revisions. Bosse said she publicly requested a timeline because the community has spoken on their priorities and vision for the park and need to be kept in the loop. Brucker refused to commit on the issue by stating “the timeline is important but my priority is to handle the Roxbury situation expeditiously yet responsibly to allow time for proper analysis, community involvement and outside expertise.“ Brucker has publicly denied there is any real disagreement
over the planned project despite the citizens' protests at last Thursday's council meeting. “Our council is committed to transparency as we have always been,” Brucker said. “When we establish the timeline, this whole community will know about it. As soon as the liaisons meet with the architects, designers, staff and other interested parties, they’ll be providing us with timelines that are realistic.” Bosse said with the countless meetings and thousands of hours of staff time spent, the community deserves to be informed step-by-step. “This needs to be an open and transparent process where the community is aware of the meetings that the liaison will have on the issue so they can participate if they would like,” Bosse said. Community member and parent Alma Ordaz gave a response that seemed to reflect most public opinion. She said that while she supports the renovation provided it stays on budget, she said she thinks a timeline is critical for keeping the staff in line and the community involved and informed. One of the few powers granted a “mayor” of Beverly Hills by its governing documents is to appoint various committees. In practice, those “ad hoc” committees conduct virtually all of the work related to a specific topic and generally control the process leading to a full council vote. Brucker's exclusion of Bosse and Mirisch came after the heavily attended open meeting on the Roxbury project last Thursday. His continued refusal to balance views on the committee occurred despite a request from community
members to replace either Brien or Gold with one of the reform members who have raised multiple questions about the handling of the project, its scope, size, cost and impact on city's premier park. Southwest Homeowners Association President Ken Goldman, who spoke at the meeting, said while he believes that Brien and Gold are capable of reducing the size of the project, they both have supported a larger facility than a majority of the community wants. “I think in general when a community has voiced different opinions, a liaison committee should be put together to reflect all of the community opinions if at all possible,” Gold-

man said. “This has zero to do with anyone’s integrity, this has everything to do with a fair representation of the different view points in the community.” Brucker said he chose Vice Mayor Dr. Willie Brien and Councilmember Dr. Julian Gold as the liaisons because they were currently the designated council liaisons to the Recreation & Parks Commission and the only councilmembers with previous Recreation & Parks Commission experience. “Back in December, we realized the bids were $2 million over budget. It was clear we needed further input from the community as to their vision with respect to size, scope and programmatic offerings all within our budget constraints,” Brucker said. “Although all councilmembers expressed interest in being designated liaison, I as mayor assigned it to our council’s Recreation & Parks liaisons. Unless someone can provide a compelling reason why these two councilmembers could not perform their duties with the utmost integrity and professionalism then my decision stands." Bosse said she was disappointed neither she nor Mirisch were appointed to the liaison committee. “I felt very strongly that this
BEVERLY HILLS would be a wonderful way to bring our community together on this divisive issue and would have provided a very balanced approach,” Bosse said. “(Brien and Gold) had supported the expanded project while John (Mirisch and) I had not, so to have one from each perspective work together, we could come to a fair compromise.” The council's usual majority of Brucker, Brien and Gold previously approved plans for the huge project which was then put out to bid. When the bids came in higher than expected, the majority regrouped. Changes to the plans are now expected but not assured. Even with reductions, The Courier has learned that the council majority intends to invade City general funds in an amount up to $8 million to pay for the project. Acting on behalf of the council majority, City Attorney Larry Wiener previously opined that an environmental impact report was not required by law. Bosse, former head of the Planning Commission and an expert on the law, continues to dispute that conclusion. Without an EIR, citizens have no real power to contest the project short of a voters' referendum.

Fine Italian Fare With Korean Flare Perfect For Romance t Erbe Matte, Chef Louis Kim has put a lot of thought into his Valentine’s Day menu. “Food is the second most intimate thing after love,” says restaurant Manager Young Beck. “If you look at the courses (right) you’ll see dishes that contrast, yet all complement each other.” A successful Valentine’s Day menu, Beck says, has to be playful, aesthetically pleasing, “something you can interact with, and yes, even sexy.” • So the first course is a riot of colors—red purple and crimson—with a playful take on the apples with crunchy, crispy walnuts. • In the second course, the shallots give sharpness while the raisins are sweet, and the sweet bread is creamy. “It’s almost an aphrodisiac,” Beck says. • The chapaghetti is cooked in the spinach juice giving it a green hue to contrast with the black sauce, which is sweet and salty, to round off the earthiness of the spinach. “Slupring the noodles is also messy and fun,” Beck adds. • With the langoustines, “you have to get in there with your hands,” Beck adds. “Yet the soup is so delicate.” • While the grilled beef is “very masculine,” the dessert ties the whole meal together. The tartness of the aged balsamic, sweetness of the mouse and berry flavor accented by thyme, “finishes off the meal in a euphoric way,”Beck concludes. Korean background informs his take on Italian food, meaning he uses classic Italian dressings and sauces, but Korean combinations and ingredients others don’t. “Erbe matte” translates loosely as “wild herbs.” Every dish at Erbe Matte is from scratch, to order. Dishes like the Pancetta di maiale brassato, pork belly with cucumber, dill, cranberry, curry and cherry tomato in a Mediterranean cream sauce; and Penne Al Oxtail, pasta with oxtail in a rosemary tomato sauce, feature meats that are braised for three to four hours. A classically trained chef who studied in 40 countries, Kim started cooking at 19, and graduated from the KyoungJoo Hotel Management School, and ChoDang University where he earned a B.A. and a master’s degree in culinary science and arts. He worked at the Four Seasons in Singapore and Milan, Hotel Okura, and

So he has the background and 30 years experience. What sets Kim apart from others is his passion—"cooking from the heart and soul," he says. "When you cook for your children, after you wash everything, then you care about the food and how you prepare it," Kim says. That’s his approach at Erbe Matte where the slogan is “hand-crafted food and drink.” To introduce diners to the restaurant, Erbe Matte now serves a gourmet lunch buffet from 11:30 a.m.-2 p.m. Monday-Thursday featuring two appetizers, three salads, the restaurant’s always fresh-baked bread and a side of pasta (a recent offering was pasta with crawfish and clams); all for $9.99. The rotating buffet menu might include menu staples like the ginseng salad with generous portions of the root, or the chop salad. With four restaurants in Korea; two italian—one fine dining, one casual— and two sushi establishments, Erbe Matte is Kim's first restaurant venture in America. So in 1988 the Sinatras founded what is now the Frank Sinatra Starkey Hearing Foundation Celebrity Invitational golf tournament, supporting the Barbara Sinatra Children’s Center at Eisenhower Medical Center, which the Sinatras had founded two years earlier to provide therapy for children suffering from physical, sexual and emotional abuse. And, because of generous support from the Sinatras, their friends and supporters, no child is ever turned away because of a family’s inability to pay. The take-away from his informal talk: our lives, and history, are entwined. The Ambrose event was prelude to the Palm Springs Air Museum’s annual fundraising gala, this year taking place on Friday, Feb. 10. Here, guests—dressed in black-tie or military dress uniforms—will enjoy cocktails and dinner surrounded by vintage warbirds. The evening’s theme is “Hollywood in the Skies” and honors the Tuskegee Airmen, subjects of the George Lucas film about their exploits, Red Tails. There are not many Tuskegee Airmen still alive, but we have it on good authority that a majority of those still among us will be in attendance. Frankly, it is they who honor us by their presence. However, if you think that the Coachella Music Festival is Mecca for pop music artist and their fans, second only to Woodstock as the Temple Mount for rap, rock and heavy metal icons, then hold on to your wallets. Each year literally tens of thousands of young and used-to-be-youngbut-still-loving-it adults flock to the Empire Polo Grounds in Indio for a long weekend of non-stop musical performances. Tickets are always sold-out and the crowd is immense. So, in a classic case of “be careful what you wish for,” the promoters of the Coachella Music Festival had what they thought was a good idea: Run the music festival over two consecutive weekends with each featuring the same line-up of stars and the same performances, just different fans. The promoters loved the idea because it would bring in twice the money; local hotels, motels and businesses liked the idea for the same reason; and polo ground neighbors just cringed. But you have to take your hat off to the promoters. Imagine getting nearly 100 famous (just ask your child or grandchild) music ar tists and groups to coordinate their schedules for two back-to-back weekends. And Dr. Dre and Snoop Dogg, they are the headliners of the two weekends and will perform on April 15 and 22.

ouba Karubian, born in Tehran, Iran, was the fourth of eight children born to Khalil Haghani and Monireh Nehorai. She passed peacefully days before her 92nd birthday in her Beverly Hills home which she had shared with her husband Rouhollah. Touba had been a Beverly Hills resident for over 50 years. She was most often described as “amazing” - a grand hostess and a charming woman who loved and was loved by many. A recognized artist, an acclaimed poet, and a dedicated philanthropist, Touba was an inspiration to her family and to the community alike. A lover of the arts, her education included Sage College in Tehran. Her fluency in English and French facilitated a position with Voice of America in Tehran at the age of nineteen. She later received a degree from the New York School of Interior Design where she was the top student in her class. She travelled extensively. Her collection of antiques and objects d’art displayed in Touba-Kay Galleries at the corner of Wilshire Boulevard and Robertson Boulevard was a hallmark of good taste for 3 decades. Touba’s community work was extensive. Her dedicated fundraising efforts and commitment to causes brought her accolades and respect from both the community and the numerous charitable organizations in which she participated. She was co-founder and an early President of the Iranian Jewish Women’s Organization of Southern California, and President of the Iranian Committee for Support of Medical Research Chapter #1445 of The City of Hope for which she raised millions of dollars as a one-person chapter; she was a member of B’nai Brit and sat as a Board Member of the National Council of Jewish Women. She is survived by her three loving children, Vida Foroutan, John Karubian and Guitta Karubian, her son-in-law Manuchehr Foroutan, her sister Pari Matz, her grandchildren Lailee, Dahlia, Jordan, Vanessa, Natalia, Daniel, Laela, Nathan and Sara, and her great-grandchildren Noah, Lola, Olivia and Stella. The family chose a private funeral at Mount Sinai where she is now lying alongside her beloved husband. In lieu of flowers, the family asks that a charitable donation be made in her name to the Alzheimer’s Foundation (www.alz.org)

A five-year Capital Improvement Plan (CIP) will be developed and updated annually, including anticipated funding sources. Capital improvement projects are defined as infrastructure or equipment purchases or construction which results in a capitalized asset and having a useful (depreciable) life of two years or more. The CIP will attempt to include adequate funding to support repair and replacement of deteriorating infrastructure and avoidance of a significant unfunded liability. Proposed capital projects will be considered through the Authority budget development process and reviewed and prioritized regarding accurate costing (design, capital, and operating) as well as for overall consistency with the Authority’s goals and objectives. The Authority’s Executive Director or his designee will then identify financing sources for the highest-ranking projects. Capital project contract awards will include a fiscal impact statement disclosing the expected operating impact of the project and when such cost is expected to occur. Pay-as-you-go Capital Improvement Plan financing should account for a minimum of 50 percent of all capital improvement projects for each five-year planning period. Pay-as-you-go financing is defined as all sources of revenue other than Authority debt issuance, i.e., fund balance contributions, developer contributions, grants, endowments, etc. Pay-as-you-go financing should generally be considered as the preferred option. However, the potential for debt issuance that provides additional economic and/or strategic values could be considered as recommended by the Executive Director or his designee.
Debt Service costs in order to control fixed costs and ensure expenditure flexibility. Debt financing should not exceed the useful life of the infrastructure improvement with the average (weighted) bond maturities at or below thirty years, unless otherwise authorized by the Board of Directors. A ratio of current assets to current liabilities of at least 2/1 will be maintained to ensure the Authority’s ability to pay short-term obligations. Section 5. Reserve Policies General Fund All fund designations and reserves will be evaluated annually by the Executive Director or his designee for longterm adequacy and use requirements in conjunction with development of the Authority’s balanced five year financial plan. It is a goal of the Authority to obtain and maintain a general operating reserve in the form of cash, of at least 40% of operating revenues. The first 25% shall be considered a contingency reserve to cover normal seasonal cash flow variations, as well as unforeseen emergency or catastrophic impacts upon the Authority. Funds in excess of 25% may be used for short term economic investment in the community when justified by projected financial return to the Authority and specifically authorized by the Board of Directors, upon recommendation of the Executive Director or his designee. One-time revenue windfalls should be designated as a reserve or used for one-time expenditures. The funds are not to be used for on-going operations. To the extent such funds are not required for current expenditures, one-time expenditures and/or capital improvements such funds should be maintained as operating reserves or used to reduce debt.

The Authority shall endeavor to maintain reserves equal to 90% of the estimated net present value of such liabilities. Contingency Reserves, to be determined annually by the Executive Director or his designee, will be maintained to offset unanticipated revenue shortfalls and/or unexpected expenditure increases. Contingency reserves may also be used for unanticipated and/or inadequately budgeted events of an emergency nature. Use of contingency funds shall be approved at recommendation of the Executive Director or his designee. Budget Reserves are presented in the Comprehensive Annual Financial Report (CAFR) in the Financial Statement section designated as unreserved fund balance. Section 6. Audit Policies An annual audit will be performed by an independent public accounting firm with an audit opinion to be included with the Authority’s published Comprehensive Annual Financial Report (CAFR). The Board of Directors will maintain a standing committee of its members to serve as the Audit Committee to provide oversight and review of the annual and special audits of the Authority. The Committee will meet at least twice annually with the Authority’s independent auditor, once for a pre-audit meeting, and once for a review of the final audit results. Internal audit activities will be guided by the Audit Committee. The results of these audits are then presented to the Board of Directors Audit Committee for consideration and later reported to the full Board of Directors for its review and consideration. Should conditions necessitate an urgent internal audit of a particular area, the Audit Committee will be advised and the results of the audit will be reviewed with the Committee. BRIEN, FOR CONFIRMING WE’RE CORRECT The Courier is very pleased Vice Mayor Willie Brien, M.D., a frequent critic of The Courier’s coverage of City issues, implicitly endorsed our coverage of his and Mayor Barry Brucker’s failing machinations about Roxbury Park. At last Thursday’s open City Council session where over 150 residents spoke or attended, Brien used his wrap-up speech to condemn “outsiders” and “those who would divide our community,” meaning, of course, The Courier. What he did not do was dispute, correct or contradict any of our reporting. To us, that means that his Nixonian personal slur (“McCarthy-ite”?) was the only thing he could think of, thus conceding our accuracy. Disregarding for a moment that such a tactic on his part is really beneath him – or at least certainly beneath the image he conveys – whenever the only thing you can say is that the messenger is a bad guy, you’ve confirmed the message. Our message has always been clear about Roxbury, as it has been about Beverly Hills issues in all cases. We support full public disclosure, actual transparency, and listening to the people. For those who try to hide the ball, manipulate the release of information, and carefully orchestrate City matters, that drives them crazy. It apparently makes fine people say and and do very un-fine things. Well, Dr. Brien is a public official and this is the newspaper of record of Beverly Hills. We will examine his actions and statements while in office about official affairs. As our vice mayor, just because he says something does not necessarily make it so. (Please believe though, that if he tells us something about orthopedics, we absolutely will believe him.) As for residency, The Courier was born and reared in Beverly Hills. It has never left the City. It lives in Beverly Hills and works for Beverly Hills. True, its actual residence is on Olympic – not above Santa Monica Boulevard – but we don’t believe Dr. Brien really meant that people living below Santa Monica are not entitled to be heard. He certainly implied that residents without his and Mayor Brucker’s version of a hereditary pedigree should not speak or be heard. After all, that’s pretty much what he said. Interesting that Dr. Brien does not disqualify City Manager Jeff Kolin from speaking. Mr. Kolin lives outside Beverly Hills in a home financed by Beverly Hills. Of course we should legitimately hear from our city manager and every other person who contributes to Beverly Hills or participates in our affairs. We do not believe discrimination of this sort is proper. As for the specifics of Roxbury, The Courier had to force release of the Roxbury Master Plan through a California Public Records Act demand. We saw – as did hundreds of residents when they were given the chance by City staff – a project on a scale completely out of proportion to historical uses of Roxbury Park. We noted a huge public room suitable for banquets. Then, our reporter confirmed with one of the designers of the complex that in fact and in truth banquet capability was included in the project. Brucker and Brien now deny it, but that’s what their own designer/architect/staff member (we promised confidentiality to the source) said. It is true that had we applied our normal skepticism about anything City staff tell, we might not have published that revealing admission. So, maybe we should have refused to take at face value what a City-hired person told us. What we still cannot agree with is holding the seniors hostage over Roxbury. The truth is former City Manager Rod Wood and his then-council refused to fix the bathrooms or fix up the meeting rooms. Instead, the false choice we were given under the Master Plan was a huge new complex or nothing at all. Until last Thursday, that was still our only choice. Given the years that have passed and the more than $1.4 million spent just on plans, why couldn’t someone at City Hall allocate $50,000 – $100,000 to fix up the bathrooms? (True, it should only take a fraction of that, but then this is our City government’s budgeting.) We certainly have no apologies about disclosing the manipulation by city attorney Larry Wiener, at the behest of Brucker and Brien, of the California Environmental Quality Act (CEQA) to avoid preparation, circulation and approval of an environmental impact report for the project. Wiener said we don’t need one; Lili Bosse says we do. We believe Bosse, but you be the judge. We also believe that whether or not one is legally required, in a small city like Beverly Hills where everyone is so close, respect for the views of others would seem to demand that City officials err on the side of compliance. The usual majority did not. We also have no apologies about publicizing the proposed 40-foot-plus height of the proposed complex or the serious under-parking built into the plan. Finally, we have no apologies for reporting that the final plans were approved. They were. That’s why the City put them out to bid. You don’t put final working drawings out to bid unless you have first approved them. The only reason they have not been put into action is that the bids came back too high – a fact we promptly and accurately reported. The fact is that this community is “divided.” It is divided between Brucker, Brien, and councilmember Julian Gold, on the one side, and just about everyone else on the other. The Courier did not do that. If we did, well, publishing the truth about City Hall actions before it’s too late for the the people to do anything about it is exactly what we do, even if it divides Dr. Brien’s world. Now that The Courier has again caught them with their hands in the cookie jar, they finally seem to be willing to listen to the people. We pushed the council majority to this point, along with hundreds if not thousands of concerned Beverly Hills residents and community members, not to mention reform Councilmembers Lili Bosse and John Mirisch who have tried to do the right thing. If the council majority follows through, that will be a good thing no matter how we got there. So, for this proud Beverly Hills resident – The Courier – thank you, Dr. Brien for showing how accurate our reporting has been. We’re also glad you noticed.

I could add: “Nasty, mean spirited, vicious, mendacious and a great many other pejorative adjectives to describe the muck and the mire through which the current candidates for the presidency of our beloved nation are dragging us. How embarrassing! How shameful! If only out of this morass might come some constructive plans to improve the economy, increase employment, raise the quality of life for the have-nots and bring it closer to the level of the have-italls, it would be a blessing. Instead, each and every candidate, to a greater or lesser degree, is spending millions to find the Achilles heel of the others. Public forums and public debates have a place in our society, but they have degenerated into comic Punch and Judy shows with the doll-like T.V. proscenium arching over them all to the delight of the moderator and, often, to the confusion of the viewer. With 10 months yet to go before Election Day, and the summer doldrums intervening, I think the candidates should give themselves and us a few months of quiet during which those now in office can pay attention to the problems and constructive plans of the moment. Then let us give thoughtful attention to casting our ballots in November, not in anger but in hope.

Are you aware of the Beverly Hills false alarm fees for BHPD response which have been in effect since July 1, 2011? •First offense $123.10 •Second offense $246.20 •Third offense $369.40 (The first fee is waived if one participates in “alarm school” on-line) For some reason, the City doesn’t like “round numbers.” There is a $37.30 fee for returned checks and $29.20 fee for late payment. My questions are: Has this policy reduced false alarms? (They say it was 5,000 per year) If it has, has the City been able to reduce police department staff? The fees seem a bit punitive. apple orchards is now nothing more than an extension of NYC. A park, much like Roxbury, changed as well. Some change can be a good thing, but too much can rob a place of its true culture and history. Beverly Hills has lost some of that in the 30 years since I first came here on a vacation in the 1980s. Now there is much talk and finger pointing about plans to change Roxbury Park. Throw in heated accusations and you have a great divide at a time when we should all be coming together. After all, the future of Beverly Hills demands it. Everyone needs to take a step back, take a deep breath and talk about what will be gained by more changes, or should I say, what will be lost. Roxbury Park is a beautiful place that offers something for everyone. It has that culture and history that I just wrote about. Changes are not needed. Nor are they welcomed. The good people of this City want a future that is like the past. A place to be proud of that others continue to envy. A place with a park like Roxbury, where our citizens can feel like home. George Vreeland Hill ****** Who is responsible to sign off on the new fence being installed around the greenspace between Santa Monica Boulevard and Civic Center Drive? If this were on my property I would have the installers yank it and try and get it right. The fence posts are not aligned and not of the same height. They do not look like the image Beverly Hills portends to portray. And this fence will be there for a couple of decades at least. The intentions were no doubt good but the execution is lacking. If the same party is going to re-fence the much more visible island in the middle of Santa Monica immediately west of Doheny hopefully there will be some supervision and oversight. Millions of drivers a month, millions of photographs a year are snapped here. Who is responsible to protect the image of the City on public grounds? David Reid
