HALL OF FAME WALK — Newly-elected Pro Football Hall of Fame wide receiver Terrell Owens joined the Beverly Hills Walk With the Mayor on Monday for what was perhaps the biggest turnout ever. Walkers visited Sunrise Assisted Living and the Alzheimer’s Association’s headquarters in Beverly Hills. Owens said that he joined the walk in honor of his grandmother Alice Black, who suffered from dementia before her death. Owens wrote on his Instagram page: “A BIG THANK YOU to the #BeverlyHills Mayor [Lili Bosse] for inviting me to participate in the Walk with the Mayor to raise awareness for #Alzheimers and #Dementia as we kicked off Celebrate Kindness Week. I had a great time.” Owens, the second-leading receiver in NFL history behind only Jerry Rice, will be inducted into the Pro Football Hall of Fame in August.
Residents To Have Last Word, Says Sunshine Task Force By Victoria Talbot Residents will finally have the last word on development projects if a recommendation from the Sunshine Task Force is approved by the City Council. The proposal is a major victory for residents who currently must remain silent after a rebuttal or staff report that might be misleading on City Council decisions. It could also be a major victory in their battle for sustainable, sensible development that preserves neighborhoods in an arena where
developers have long had the upper hand. Applicants typically bring their best arguments, and sometimes their most egregious claims, after the last public comment period and prior to council deliberation, leaving frustrated residents who are muted by an arrangement that gives the applicant an unfair advantage, according to members of the Sunshine Task Force. By Matt Lopez A group of Bel-Air residents are taking celebrity megamansion developer Mohamed Hadid back to court over the illegal construction at his 901 Strada Vecchia project. In a filing on behalf of Bel-Air Residents Joe and Beatriz Horacek and John and Judith Bedrosian, the group’s attorney Victor de la Cruz states that the residents are appealing an Erosion Control Plan approved by the Los Angeles Department of Building and Safety (LADBS) in 2017 “that is nothing more than an illegal scheme aimed at disguising significant amounts of grading that require discretionary
entitlements and California Environmental Quality Act review for the entire project.” The residents are appealing an Erosion Control Plan approved by LADBS allowed 2,283 cubic yards of grading, which the filing says brings the total amount of grading at the site to date to 14,199.69 cubic yards – all without a single valid grading permit having ever been issued to the project. “Approximately 17,000 cubic yards of grading has now taken place at the Site without the issuance of a single valid grading permit or required discretionary (see ‘901 STRADA VECCHIA’ page 17)
By Laura Coleman In the wake of another school shooting this week, which left 17 dead at a Florida high school, the importance of school safety is being felt acutely across the nation. In Beverly Hills, a previously scheduled Town Hall led by Beverly Hills Police Chief Sandra Spagnoli (slated to begin Thursday evening, just after the Courier’s deadline), was set to discuss crime trends, crime prevention and commu-
nity/neighborhood safety. Spagnoli insists that Beverly Hills schools remain safe. “I feel strongly that our collaboration with the schools has made both our public and private schools safe,” she said. While the Town Hall was not being done in partnership with the Beverly Hills Unified School District, which is responsible for educating the vast majority of local students, (see ‘SCHOOL SAFETY’ page 13)

Beverly Hills High Fields Four National Merit Finalists By Laura Coleman Beverly Hills High School seniors Jonathan Artal, Jamie Kim and twin brothers Jason and Brian Harward, who were named 2018 National Merit Scholarship semifinalists in September, have all advanced to finalist standing in the competition. They were among roughly 16,000 semifinalists in the 63rd annual National Merit Scholarship Program. According to the program, about half of the finalists will win one of 7,500 National Merit Scholarships worth more than $32 million. “Being able to represent Beverly in a nationwide scholarship contest is a good feeling, I’m so proud to represent

Former Ambassador And Movie Star John Gavin Dies At Age 86

Two Firefighters Injured In Bel-Air Housefire By Matt Lopez A house fire in Bel-Air last Thursday left two firefighters hospitalized with burn injuries. The blaze occurred in a 7,500 square-foot home at 10835 Bellagio Rd. and was first reported around 5:27 p.m., according to Amy Bastman of the L.A. Fire Department. The LAFD’s Erik Scott said a knockdown was declared around
8:01 p.m. According to Scott, one firefighter suffered burns to his face and hands while another was burned on his ears. Scott said the homeowners, children and a nanny were alerted to the blaze by the home’s smoke alarms. Everyone made it out of the home unscathed and firefighters were seen on television
cameras bringing out belongings from the house they were able to retrieve and giving them to the homeowners. The LAFD dispatched 107 officers to the scene. The house’s roof collapsed during the place. Scott said the cause of the fire is still being looked into by arson investigators.
By John L. Seitz Acknowledged as one of Hollywood’s handsomest actors during his movie heyday in the 1950s and 1960s, John Gavin died last Friday in his Beverly Hills home at age 86. Born in Los Angeles on April 8, 1931, he attended St. John’s Military Academy, Villanova Prep, and graduated from Stanford with degrees in economics and Latin American Affairs. After serving in the Navy as an intelligence officer aboard the aircraft carrier Princeton during the Korean War, he joined UniversalInternational Pictures, where he was cast opposite leading actresses — Lana Turner in Imitation Of Life, Sophia Loren in A Breath Of Scandal, Susan Hayward in Back Street, Katharine Hepburn in The Madwoman Of Chaillot, Janet Leigh in Psycho, and Julie Andrews in Thoroughly Modern Millie. He appeared as Julius Caesar in the studio’s legendary Spartacus. Gavin was slated to play James Bond in the early 70s, but after losing the parts to Sean Connery and then Roger Moore, his movie career ebbed and he began to appear in various TV series’ such as The Love Boat and Fantasy Island.
After serving as president of the Screen Actors Guild, he became increasingly involved in inter-American political affairs as a special adviser to the secretary general of the Organization of American States, and then promoting American and Latin American film production for the Alliance for Progress. For five years, he was ambassador to Mexico under President Ronald Reagan and after that went on to a successful business career with the Atlantic Richfield as a public relations executive, president of Univisa Satellite Communications–the former parent of the Spanish-language television network Univision, and then a director of various capital investment and financial consulting companies. He is survived by actress Constance Towers, his wife of 44 years, two children and stepchildren and several grandchildren.

Social Studies Teacher Drew Stewart Tapped To Fill BHHS Assistant Principal Vacancy By Laura Coleman Beverly Hills High School Social Studies teacher Drew Stewart has been promoted to interim assistant principal at BHHS effective this week. The position had been vacant since the beginning of the year when Superintendent Michael Bregy moved former BHHS AP Chris Regan to Beverly Vista to serve as its interim principal after the school’s former Principal Christian Fuhrer was placed on administrative leave.

By Laura Coleman Beverly Hills Unified School District’s prospects for finally triumphing in its legal battle against former BHUSD facilities chief Karen Christiansen could not have been better following Wednesday’s Court of Appeals’ hearing in the case of Strategic Concepts LLC v. Beverly Hills Unified School, according to BHUSD attorney Fred A. Fenster of Greenberg Glusker Fields Claman & Machtinger LLP. “The panel clearly understood the purpose of Section 1090 and that Karen Christiansen’s actions violated its conflict of interest prohibitions which justified [her and her company’s] termination,” he said. The reach of Government Code Section 1090 – the very code that a jury used to convict Christiansen of criminal behavior six years ago after she used her BHUSD position to enter into a sole-sourced contract with the company she founded, Strategic Concepts, LLC – is at the heart of overturning a 2015 verdict that now has her owed in excess of $23 million. On Wednesday, Presiding Judge Arthur Gilbert for the Court of Appeals of the State of California’s Second Appellate District posed the following question to begin the hearing: “Isn’t this appeal simply a matter of deciding whether or not Government Code, Section 1090 applies to the contracts that Karen Christiansen entered

By Matt Lopez Traffic in Southeast Beverly Hills was gridlocked last Thursday night, Feb. 8, after a pedestrian was rushed to the hospital after being struck by a vehicle. The incident occurred around 9:20 p.m. near Olympic Boulevard and Beverwil Drive, according to
BHPD. The pedestrian, whose identity has not been revealed, was transported to CedarsSinai Medical Center. According to police, the crash was not a hit-and-run and no arrests were made. The intersection re-opened early Friday morning.

Fragrance Company Creed To Open Boutique In Beverly Hills By Laura Coleman The scent of success was in the air this week following JLL’s announcement that it had signed a lease with international fragrance company Creed for a flagship boutique inside the 1930’s brick facade building at 9533 Brighton Way in Beverly Hills. Located on the corner of Brighton Way and Camden Drive, between Rodeo Drive and Camden, the location marks Creed’s first California location. Creed is set to occupy the building’s corner suite this fall, joining some of the world’s premier retail brands including Isaia, Berluti and Vhernier. According to a JLL report, having a store on Rodeo Drive has long been a staple of luxury brands’ marketing strategies. “The Beverly Hills Triangle is a

By Matt Lopez After selling off numerous properties and stakes in its entertainment endeavors, the Dalian Wanda Group’s ongoing fire sale has moved into the sporting arena. On Wednesday, the Chinese conglomerate announced it has sold a 17 percent stake in Spanish soccer club Athletico Madrid. The sale was made to Israeli billionaire Idan Ofer for an undisclosed sum, reports Reuters, bringing Wanda’s sales tally over the last year to about $16 billion. Chinese billionaire Wang Jianlin’s Wanda Group purchased a 20 percent steak in Athletico Madrid in 2015 for around $56 million, becoming the first mainland Chinese company to invest in a top European soccer club. Jianlin said in January that Wanda
would continue to seek avenues to reduce debt “through all available means.” According to S&P Global Market Intelligence, offshore groups either fully or partly-owned by Wanda have around $10.7 billion in outstanding long-term debt. Wanda has been under pressure to shed assets since the Chinese government late last year began cracking down on overseas acquisitions that were completed by running up large debts. With major purchases over the last few years such as AMC Theatres ($2.6 billion), Legacy Entertainment ($3.5 billion) and major real estate developments in London, Australia and Beverly Hills (One Beverly Hills) – Wanda had been one of the country’s biggest acquirers. The powerful agent at WME, Ed, who represented Denzel Washington, Mel Gibson and others, opened his huge property with its vast lawn and pool house to more than 500 friends and the Who and Who of our company town. Gossiping and laughing a lot while dining on Along Came Mary’s beckoning buffets. Some of us visited in the kitchen with his mom Angelina, who eyed us all with a wary gaze.

City Council To Consider Canon/Wilshire Closure For Metro At March 6 Meeting By Victoria Talbot A proposal to close Canon Drive at Wilshire Boulevard for at least two years during Metro construction will be discussed Mar. 6 by the City Council. The proposal is a mitigation measure for the Wilshire/Rodeo Purple Line Extension station construction and would be implemented in the fall. The station box will span Wilshire Boulevard between Beverly and Crescent Drives, with on-street work west of El Camino Drive and east of Rexford Drive. The City and Metro have conducted extensive public outreach, reaching out to the businesses including the Montage Hotel, Coldwell Banker, Spago and Citizen restaurants at stakeholder’s meeting Jan. 9 that included the Beverly Hills Chamber of Commerce and Conference and Visitors Bureau, and a public community outreach meeting Jan. 10 and Feb. 7. Public notices were mailed by the City Jan. 22 to all the business on N. Canon Drive between Wilshire and S. Santa Monica Boulevards and adjacent areas north and south of Beverly and Crescent Drives on Jan. 22. The Beverly Hills Chamber of Commerce mailed notices to the entire business community Jan. 23 The North Canon Drive Closure Feasibility Study which will be presented to City Council will also include a traffic impact analysis report and recom-
mendations for council consideration. The closure was acceptable to businesses concerned about the impact of noise and the disruption of on-again, off-again closures, which could create uncertainty and affect business traffic. A sound wall will help to mitigate impacts and there would be a cul-de-sac created by the closure on Canon. The center of the cul-de-sac would become parking spaces, accessible for vehicles traveling north after circling the cul-desac. The design for the cul-de-sac will be determined by City Council. One design encompasses six parking spaces, and another has 11 spaces, to replace those lost to construction. Metro’s Construction Relations Manager Casey Shuda said that there is a phase of construction when Wilshire will also be closed. As with the La Cienega Station, the closures would take place on 12-15 weekends from Friday at 9 p.m. to Monday at 6 a.m. That would happen in early 2019. Metro would “avoid the volume weekends,” including High Holidays, awards weekends, Fourth of July, Christmas, and New Year’s as was the case with the La Cienega station construction. Traffic would be impacted on nearby intersections. Suggested mitigations could include timing of traffic lights, possible left-turn lanes, an additional traffic signal at Crescent Drive and Clifton Way and other measures.

Could Property Coin Become The New Real Estate Cryptocurrency? By Victoria Talbot Property Coin may one day soon become the new trend in real estate. That’s what Andrew Jewett and his partners Matt Miles and Rudy Cortes are banking on. Jewett and Miles are the co-CEOs and Cortes is the COO of Aperture Real Estate, a South Bay start-up real estate investment and technology company offering Property Coin as a new form of cryptocurrency. With bitcoin surfacing as a legitimate, albeit volatile, new currency, Aperture hopes to make their assetbacked Property Coin a significant opportunity for investors. Co-founders Jewett and Miles share a background as Wall Street investment bankers in the real estate industry. They moved to the West Coast and became part of a senior management team for “the largest purchaser of foreclosed properties in the US,” said Jewett. “We founded Aperture in 2016 to capitalize on the opportunity we saw to implement unique and innovative sourcing and process management technology into a market that has traditionally lagged behind the innovations of the technology industry,” said Jewett. They use their knowledge and data to find distressed properties that could be turned around with added value and flipped. Aperture also creates short-term loans for construction to contractors or brokers, for turnaround properties. Together, said Jewett, these are the assets that back their cryptocurrency, adding asset stability to their currency and “revolutionizing the way real estate is transacted.” Bitcoin cryptocurrency has made some headway in the real estate market with the first real estate cryptocurrency purchase last month, a $270,000 Miami condo. But high-value individuals remain largely unconvinced, according to some sources. The cryptocurrency system remains vulnerable to whiplash fluctuations and hacking. Bitcoin investors know that the value can fluctuate wildly, but the value of real estate is set at a specific point in time and remains stable. Aperture backs Property Coin with real estate assets, adding the element of stability to the venture. Perhaps Aperture will turn the tide. By month’s end, the company plans to launch their Initial Coin Offering (ICO). 100 percent of the proceeds from the Property Coin ICO will be invested in real estate property or loans through the Property Coin purchasing entity. Each Property Coin holder will own a fractional percentage of all assets in the Property Coin purchasing entities (LLC, PCX and affiliates), and will be entitled to 50 percent of the net profits from Aperture investments. lion tokens for their ICO. But unlike the wildly speculative bitcoin market, Aperture is bringing “a currency backed by assets,” said Jewett. He plans to raise $150 million in the first round to buy properties and write loans. Aperture targets the “most liquid and affordable markets with the most buyers,” said Jewett. Their purchases are in cities such as Charlotte, Memphis, Nashville and Dallas, rather than Miami, New York City or Beverly Hills. “We buy it, fix it up and sell it to a family. We’re socially responsible. We offer homes to veterans, people with disabilities… we involve local charities and housing non-profits.” “We flip houses. We write loans. It’s a far more stable, less volatile option for crypto investors. It’s understandable.”

CHLA Heart Transplant Patients Gather For Emotional Reunion This month, The Heart Institute at Children’s Hospital Los Angeles (CHLA) celebrates the 25th anniversary of its pediatric heart transplant program, the first dedicated pediatric heart transplant program in a free-standing children’s hospital in Southern California. To date, CHLA surgeons have helped provide new hearts to more than 130 children, and counting. The program launched in 1993 under the leadership of Dr. Vaughn Starnes, professor and chair of the Department of Surgery at USC’s Keck School of Medicine. “We are proud to mark a quarter century of giving children with the most complex
heart conditions a new start,” he said. Today, the Heart Institute's heart transplant program is led by medical director JonDavid Menteer, MD, and surgical director Cynthia Herrington, MD. On Monday more than 35 CHLA patients, ranging from 1 to 37 traveled from as far as San Francisco for a moving reunion with their CHLA medical family—surgeons, cardiologists, nurses and other caregivers. Many are now grown and working as speech therapists, nurses and surgical technicians, hoping to inspire the younger generation of CHLA pediatric heart transplant patients.

Dentist Arrested In Beverly Hills Murder Of His Mother By Matt Lopez A prominent Southern California dentist was arrested this week in the October strangulation death of his 67-yearold mother in an alleged murder that police say was motivated by financial gain. Daniel Yacobi, 36, of Los Angeles was arrested Monday and was being held without bail on suspicion of murder. The incident occurred on Oct. 10 at his mother’s home in the 600 block of North Roxbury Drive, when Beverly Hills police and fire units responded to a call of a woman unconscious and not breathing. Violet Yacobi, 67, was pronounced dead at the scene. According to a release from the BHPD, after combing over physical and digital evidence, authorities ruled the death a homicide and began to suspect that her son Daniel was responsible for his mother’s death, with money as his main motivation. The suspect ran a well-
reviewed dental practice in Sherman Oaks, which averaged 4-1/2 out of five stars on Yelp, although there had not been a review left for him since July 2015. Daniel wrote a chilling Facebook post on what would have been his mother’s birthday on Jan. 8 – well before he was arrested – extolling her virtues. As of Thursday, the tribute was still publicly available on his Facebook page. “Today marks the day that my mom would have been 68 years old and not a day goes by that I think about her. She was an amazing mom who wanted nothing more than to see her children and loved ones happy around her and would do all in her power to achieve it,” Daniel wrote. “She had an everlasting presence that made those around her feel comfortable and joyous seeking her companionship and love.” Yacobi was arraigned at the Airport Courthouse on Wednesday.

late last month for Sandro Zaninovich, founder of the Beverly Hills Chamber Orchestra, at Church of the Good Shepherd, where he was a onetime parishioner. Zaninovich, 83, died following a long illness, at Beverly Hills Senior Care. Born in Croatia, Zaninovich graduated from the Zagreb Academy of Music in 1961. His first professional position was as conductor of the Zagreb Radio Symphony Orchestra. He moved to the U.S. in the late 1960s where he attended UCLA and received his master’s degree and Ph.D. candidacy in music. In 1972 he founded the Beverly Hills Chamber Orchestra, serving as its music director and conductor. Attorney Jerry Glaser recalled meeting Zaninovich at a birthday party his ex-wife arranged for him at his home where Zaninovich brought a group of musicians. “We both shared a love of music and became friends,” says Glaser. “Sandro said he wanted to form a chamber music orchestra and needed some help. I helped him draw up nonprofit documents for the organization that became the orchestra.” Glaser joined the board that

was formed to help fund seasons of concerts at Greystone Mansion. The concerts proved popular and were chronicled numerous times in the Courier. “The concerts were lovely, outside in the beautiful courtyard setting,” said Glaser. Zaninovich often led his own compositions. An awardwinning composer he wrote works for orchestra, piano, violin and cello, chamber music, music for theatre, TV and educational video productions. and cellist Jeffrey Solow. Organists Lawrence Strohm, and Zeljko Marasovich played Albioni’s Adagio in G Minor, a piece Zaninovich frequently programed in his concerts, at his memorial, Jan. 29. His daughter, violinist Sandra Zaninovich, played his Hvar Nocturne. A violinist with the Palisades Symphony, and a graduate of El Rodeo and BHHS, Sandra Zaninovich survives her father, along with her brother Igor. Beverly Hills High Boys, Girls Basketball Team Reach CIF Playoffs By Matt Lopez It’s playoff time for the Beverly Hills High boys and girls basketball teams. The Norman boys team began the playoffs Wednesday with a 71-53 rout of Buena Park in the first round of the CIF Southern Section Division 2AA playoffs. BHHS trailed 20-12 after the first quarter, but went on an 18-7 run in the second to pull ahead for good. BHHS (20-8) is set to host Capistrano Valley tonight at 7 p.m. at
the Swim Gym. If the Normans win, the quarterfinals would be played on Tuesday. On the girls side, the BHHS girls team (19-5) was set to open CIF Division 3A play Thursday against Golden Valley in a game played after the Courier's press time. If BHHS wins, the second-round would be played Saturday against either Granite Hills or Murrieta Mesa.
Los Angeles will be the center of the basketball universe this weekend as athletes and celebrities descend upon L.A. for the 2018 NBA All-Star weekend, being hosted at Staples Center. The NBA All-Star game will be played Sunday, but there are plenty of other sporting events and parties leading up to the big game this weekend to get yourself in the sporting spirit.

Golf: Tiger Woods Finishes One-Over In Roller-Coaster Return To Los Angeles A lost ball, some errant drives and some "really silly bogeys" added up to a one-over-par 72 for Tiger Woods in his return to Riviera Country Club in Pacific Palisades on Thursday. The 14-time major champion, playing just his second US PGA Tour event since spinal fusion surgery last April, was erratic off the tee. sometimes used that “last word” as an opportunity to denigrate residents who are without recourse. In some cases, City staff has misled councilmembers, minimizing resident’s concerns or impacts. The Sunshine Task Force has proposed a measure that would allow residents the opportunity to dispute points advanced during an applicant’s rebuttal, which has historically ended public comment and questions unless a councilmember requests clarification from a speaker. Thus, residents could have the opportunity to clarify or correct issues on the record before public comment is closed and after the applicant has put forth their final rebuttal. The proposal will come to the City Council at the March 6 meeting. The issue brings a new measure of fairness to the people most impacted by proposed construction but will also apply to all commissions. “I have personally experienced numerous skewed facts…. Which has led to skewed deliberations, and in my opinion, skewed decisions, as the opportunity to correct the record does not currently exist,” wrote Debbie Weiss in a letter. Staff, she wrote, can also present “incomplete or inaccurate information” that has an enormous impact on council deliberations. Weiss pointed out that residents “are held to the 3 minutes.” In the Lago Vista deliberations, she pointed out that the
Section 1090 does not apply because his client was a private person who was simply trying to negotiate the best deal she could with the BHUSD. Fenster maintained that such matters are irrelevant in considering whether Section 1090 has been violated. “Strategic Concepts LLC should not be permitted to reap a multi-million-dollar profit at the public’s expense due to the conflict of interest and use of her insider influence to obtain the contracts in which she was financially interested,” he said. The Court of Appeals decision is expected to be published within 90 days.
Developer’s presentation and rebuttal totaled 83 minutes, while residents could only watch. In her letter she referred to an incident at the Aug. 13, 2016 City Council meeting when attorney Alan Hearty, representing the Loma Linda Trust and billionaire developer Francesco Aquilini, was allowed to unleash a lengthy personal attack on Weiss. Hearty spoke for several minutes, charging that Weiss is a “developer” because she is building her own single-family home in Malibu that is 10,000 square feet. The home is on property that constitutes 35.4 acres of mostly flat land and does not incorporate cantilevers or off-pad floor area, does not alter landforms, and doesn’t impact neighbors on a narrow, winding street above or below on a hillside. Weiss, who opposes the project because she feels it threatens the health and safety of her children and her neighborhood, was unable to respond to the allegations, which had no bearing on the Loma Linda project. Furthermore, Weiss’s character was not on the agenda. Most recently, Hearty accused the City Council of “pandering” to the “disgruntled neighbors,” and threatened legal action against the City, though the firm is already suing over the Hillside Ordinance on behalf of the Loma Linda project. Mayor Lili Bosse countered that decisions on the Loma Linda project would not be influenced by legal action on behalf of the applicant, but by the right action on behalf of the City.

A maximum of 6,000 cubic yards of grading are allowed without discretionary entitlements, which makes it puzzling that Hadid was ever allowed additional grading at the site. “Simply put,” writes De la Cruz in the lawsuit. “LADBS erred in allowing Mr. Hadid to subsume grading under an erosion control plan to somehow evade discretionary review.” In 2015, LADBS inspectors cracked down on the property, ruling all unapproved construction, which they said included features like retaining walls, concrete decks and an underground theater, were to be removed. In the time since, as the case toiled in the court system for nearly two years, Hadid eventually pled no contest to misdemeanor charges stemming from the illegal construction at the site. All the while, as Hadid has allegedly tried to bring the project into compliance, resi-
dents say work has apparently been continuing at the site. Last October, LADBS officials confirmed to the Courier they ordered the removal of new elements inside the home – including ceiling lights, detailed woodworking, furniture and paintings. These incidents appeared to fly under the LADBS’ radar until it was brought to their attention by a group of determined residents who took street-level pictures of the work inside the house. De la Cruz and the group of Bel-Air residents believe that the Erosion Control Plan is simply a way for Hadid to continue work under the nose of inspectors. “They’re essentially trying to hide the ball on all the grading quantities,” De la Cruz told the Courier by phone Thursday. “What we’re saying is that Hadid needs to request all these entitlements from the city, and I think he’s concerned about it because he doesn’t want a public process.” De la Cruz said the project simply cannot go forward without discretionary review and
In recent years, residents impacted by overdevelopment have become increasingly sophisticated. “They’re not just residents,” said one source. “They’re activists.” Together, these resident activists are working to change the ordinances that govern development and seem to favor developers over residents. The Sunshine Task Force will also recommend that the City expand their public outreach and notification from 500 feet of a proposed construction site and the block face, to 1,000 feet and the block face. The additional notification area is significant. In areas where irregular topography, larger lot size and narrow, twisting streets can impact more distant neighbors, such as the Hillside Area, a project in one area of a street can impact neighbors on the entire street and hillsides above and below the proposed project. It can also be significant in areas where traffic impacts can be felt blocks away when density is increased in a built-out environment, as happened with the 9200 Wilshire Blvd. project. The task force also proposed that noticing for items that will appear on the City Council or Planning Commission agendas should be 20 days in advance, rather than the current 10 days. Notices, sent by mail, often arrive only days before the Planning Commission or City Council meeting, leaving residents at a distinct disadvantage when preparing their opposition. As residents have become
much savvier, they hire their own experts to argue finer points that a less sophisticated opposition might not have recognized in the past. To allow time for experts to confirm or dispute traffic, architectural, engineering and geological issues, the task force will ask the City Council for the increased notification time. Making legislative advocacy more transparent is another area where residents are making headway. In the past, developers would have targeted former mayors as lobbyists, which has raised deep objections in the community. Recently, however, residents with deep ties to the community but with no connection to planning or land use issues have been recruited, using personal relationships within the community and the City government as leverage in development, in exchange for salaries and bonuses. The Sunshine Task Force has also recommended that legislative advocates who have registered using forms prior to the effective date of the new ordinance, February 9, should be required to complete the new forms with the additional information, including estimated fees. The Task Force recommended that forms submitted in the past year be updated, capturing most of the active developments in the City. A week later Shooshani was unhappy to find that the proposed Basement Ordinance, which has been in the commission for more than a year, included provisions for basements throughout the City of Beverly Hills, and not just in the Hillside Area. “If I would have known that, I wouldn’t have voted for it,” he said. The proposed ordinance includes a definition of “basement” and its application to the maximum square footage or FAR, that is citywide. The ordinance has been to the Commission multiple times. The City Council may also discuss the requirement for additional training for planning commissioners, who assume a quasi-legislative capacity when they accept a position on the commission.

It was a wonderful evening as the documentary award-winning An Ordinary Couple, starring Bernardo Puccio and Orin Kennedy, had its Beverly Hills premiere at All Saints Episcopal Church. When the film ended, there was overwhelming applause and cheers... even bravos!...from the sold-out audience of more than 300. Intertwining themes of love, marriage and politics, the film delivers humor, the occasional touch of drama, and a deeply personal look at the pair’s 40+ plus year relationship. These men live a life that’s anything ordinary! Famed interior designer Puccio was born in Alabama and after arriving in California, became a pal of Lana Turner, Elizabeth Taylor and others in the Hollywood set. New Yorker Kennedy came here to be an actor but ended up as a successsful TV location executive. In fact, he is now chairman emeritus of the Location Managers Guild International. The film was directed by Jay Gianukos and Susan Barnes. All Saints’ Rev. Steve Huber was the event’s emcee, which also also featured a musical performance by the Gay Men’s Chorus of L.A. From Palm Springs in the west to Indio in the east, real estate developments that were lying fallow the past decade are showing new life renovated by renewed enthusiasm and … money. The Agua Caliente Band of Cahuilla Indians is in the planning stage for expanding its existing high-rise hotel, resort and casino in Rancho Mirage by adding hundreds of new hotel rooms and greatly increasing the gaming space. The expansion of the band’s facility is spurring plans to add increased activities to two of its other projects. The first major announcement was made by the tribe last fall, and provides for expansion of gaming space 68,000 square-feet of additional floor space. A new casino to be built just north of the existing venue will also contain a newly constructed Tribal Cultural Museum and spa. But, not all the growth is on tribal land. The tribe has announced a large-scale investment in Cathedral City–the first time a gaming facility will be off the existing reservation made possible pursuant an agreement made with the city about 18 months ago. ****** The city of Indian Wells has given the go-ahead (and $5.5 million) for the TMC Group to begin developing 130-million hotel/condominium project on land adjacent to the highly successful Indian Wells Tennis Gardens. The project will combine a five story, 139-room boutique hotel, 56 condominiums and 31 vacation villas. The fivestory hotel will have a rooftop pool, bar and restaurant, but be hard pressed to make a return on its investment when across the street the popular Renaissance Esmeralda hotel and spa averages about 85,000 unsold room nights a year, and that does not include the vacancy figures from the nearby Hyatt hote1. ****** Each year, the Barbara Sinatra Children’s Center produces its much-heralded “Champion Honors” luncheon on March 9 at which a worldclass sports figure is interview. LETTERS TO THE EDITOR Parking spaces have always come at a premium in Beverly Hills. However, it seems like some people feel they are entitled to stand guard in the actual space on the street, holding it for their friends until they arrive to park there. I call them parking space bullies because they have no trouble intimidating some who just want to park his or her car when they find a space. They use all methods of stalling and hassling while they insist on standing watch in the street to claim their space as a prize. This has happened to me on South Beverly Drive a couple of times and to someone I know on North Canon Drive just last Saturday. A young woman refused to get out of the way and told my friend she was rude for actually trying to park her car. Fearing that she would be accosted my friend let it go and moved on. This situation is apparently nothing new and needs to be addressed. Beverly Hills is know for its strong, capable and reliable police department. I hope BHPD is aware of these parking space bully bandits and can explain to anyone trying to hijack empty parking spaces that there are rules and laws to obey. They can’t act like vigilantes and disrespect other people who are just going about their business. It is time to end this nonsense before someone really gets hurt. They might try being considerate and treat others a little nicer. Frances Terrell Lippman ****** After serving on the board of the Theodore Payne Foundation for Wild Flowers and Native Plants, Inc., I don’t think the trees selected to replant Parcel 13 (Brisbane Box and Bailey Acacia, both native to Australia), are the best choices for our particular environment. Yes, those are hearty plants able to survive a harsh environment with low water needs once established--and they are pest-resistant. But this means their leaves won’t serve as food for insect larvae, which in turn serve as food for birds. We need (both in City plantings and in our yards) to use those native California plants which grew here before we arrived. Surely there has to be a suitable tree among them! Daniel Fink ****** One of the things I most vividly remember about a long-ago trip to Tijuana is how music poured from every shop on to the sidewalk and into the streets. That cacophony–along with the strobe-lights and blaring horns was intended, no doubt, to attract shoppers. Now this repulsive practice has, I hear all too vividly, been adopted by Beverly Hills. While Tijuana I am sure has many fans, I cannot see that Beverly Hills is in any way improved by its emulation. I, for one, have managed for 60 years to shop here without the “stimulation” of other people's taste in muzak. In fact, I find it so unpleasantly intrusive, it just makes me want to do my shopping as quickly as possible, and get out of town. Gone, then, are the days of casually meandering from one store to another. I urge the City Council to restore to the streets of our shopping district the dignity it deserves–and can the canned “music.” Sara R. Willen ****** With the unfortunate rise in mass shootings in this country that also involves schools, it is comforting to know that the BHUSD and our police are protecting us so well. However, proper prevention begins in the home and community. We are a caring City that puts emphasis on raising young people to be responsible adults to make good decisions based on sound judgment. That seems to lack in areas where lesser guidance leads to problems. Where open communication is not in the home, we must always be aware of the outside world, because lessons must be learned from it, even if we feel that “those problems” are not here. They will be if we rest on our safety nets. Knowing so many good people here as I do, I am confident that Beverly Hills will always be a place where we are all truly caring leaders. BHPD Chief Sandra Spagnoli is quite correct in identifying police, schools and parents as critical to student safety. But there is a fourth and increasingly important component. It is the students themselves and a culture of, “if you see something, say something,” as it relates to other students. In a number of recent cases, school violence never took place because a student heard or saw something that concerned or frightened them enough to report it to an adult. The student report was taken seriously and further investigation revealed a tangible and immediate threat. This happened two weeks ago in Pennsylvania. A 14 year old overheard another student's threats to shoot classmates and told his parents who contacted police. Police determined that the threatening student had access to a range of lethal weapons and was planning to kill at least four other students. The student that made the report was remarkably mature and was not “ratting out” someone. As a substantial benefit, he will not have to live with the consequences of an actual shooting and not having said something. Sometimes heroism is easy. No one doubts BHPD's ability to respond rapidly and appropriately to an incident. But that is, by its nature, reactive and generally after a perpetrator has done some level of damage. So too with lockdown drills, school emergency response planning and teacher training; necessary but not sufficient. As remote and problematic as the risk might seem in our community, students need to be taught at school and at home that threats have to be taken seriously. This is not simple nor trivial in the world of maturing psyches, bullying and complicated interpersonal relationships. But students need to understand that they might be the ones best positioned to save themselves and their classmates by acting responsibly to, “if you see something, say something.” David Seidel ****** To keep the record straight, the “camera” accomplishment was a project of Nancy Krasne who sadly lost in the last election–with her we had a real friend of the people. The news is that we are going to have 600 cameras in Beverly Hills to decrease crime. I assume they will be continually monitored. Would the cameras note all the violations including never enforced dogs without leashes, bicycles on sidewalks or Segways or smoking in the streets, speeding and not stopping on stop signs? The Beverly Hilton is once again seeking to modify an existing law. Why is it just not told that there are City regulations with which it must comply? If there will be any existing permit changes to occur, it should take place after the next election with five City Council members who don't have to recluse themselves for “hiring” friends and not necesarily best qualified individuals. The Friars' Club is again wasting City employees' time in trying to obtain nonexistent permits and seeking a change of the rules in order to obtain such, helped by Thomas Levyn, a former councilmember who made $500,000 while working for “us” on the deal between Beny Alagem and Merv Griffin in the sale of The Beverly Hilton. This brings us to “lobbying.” No previous nor present City Councilmember should be allowed to lobby in our City.
