A former Beverly Hills Unified School District superintendent was sentenced yesterday to 60 days in jail for misappropriating public funds by authorizing payments -- including a $20,000 stipend -- to an employee without the school board’s approval.

Los Angeles Superior Court Judge Stephen A. Marcus also ordered Jeffrey Hubbard, 55, to pay $23,500 in restitution to the school district as well as a $6,000 court fine, and to complete 280 hours of community service and serve three years on probation.

“I do think this is an important case because the defendant violated a position of public trust,” Marcus said.

The proposed lease financing will provide funds for the acquisition and installation of pay-by-foot automated machines to be installed in parking garages owned by the Parking Authority of the City of Beverly Hills (the “Parking Authority”), and the repair to and rehabilitation of such parking garages, including the re-concreting of the floors and the replacement and repair of the roofs. Additionally, the proposed lease financing will provide financing for the Alternative Retiree Medical Program (“ARMP”), and may also be used to finance other capital expenditures approved by the City Council if proceeds of the lease financing remain available after all expenditures for the Parking Authority and the ARMP have been made. In connection with the lease financing, the City will lease certain real property to the Financing Authority, and the Financing Authority will lease such property back to the City.

Those wishing to comment on the proposed lease financing may either appear in person at the public hearing or submit written comments which must be received by the City Council prior to the public hearing. Written comments should be sent to the City Clerk, City of Beverly Hills, 455 North Rexford Drive, Room 290, Beverly Hills, CA 90210.

Alley Proposed to be Vacated

This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City, and the project qualifies for a categorical exemption pursuant to Section 15301(c) (Class 1) of the Guidelines.

Specifically, the proposed project would result in minor changes to the City’s existing circulation system by vacating a small segment of existing alley. The vacation will not impact circulation patterns and will not cause any expansion of the existing system.

At the public hearing, the City Council will hear and consider all comments. All interested persons are invited to attend and speak on this matter. Written comments may also be submitted and should be addressed to the City Council, c/o City Clerk, 455 N. Rexford Drive, Beverly Hills, CA 90210. The comments should be received prior to the hearing date.

Please note that if you challenge the Council’s action in regards to this matter in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City, either at or prior to the public hearing.

Alex Cherniss To Leave BHUSD For LACOE Job

By Marla Schevker Assistant Superintendent of Business Services Alex Cherniss will be leaving the BHUSD to become the Los Angeles County Office of Education chief business officer within the next few weeks.

Superintendent Gary Woods announced Cherniss’ intent to leave via eblast on Wednesday and the Board of Education will be putting together a transition plan at Tuesday’s meeting to determine Cherniss’ last day in the dis-

trict.

As the LACOE CBO, Cherniss will oversee the budgets of 80 K-8 districts and 13 community college districts, which totals approximately $22 billion in expenditures, (see ‘CHERNISS,’ page 8)

He was approached by LACOE to take the position and said that LACOE’s interest in him is a reflection of all of the “great work” happening throughout the district.

Board President Brian Goldberg said he’s both disappointed and excited for Cherniss’ move to LACOE.

Oscars To Air This Sunday Sunday’s 84th Academy Awards ceremony will be held at the Hollywood & Highland Center.

Though based in Beverly Hills, the Academy’s annual gala is never held in the City.

and when George Christy asked if I’d like to jot down my observations about some of the shows I’ve seen, I jumped at the opportunity. Little did I know then that I would be stepping into the hornet’s nest known as Porgy And Bess, which is currently packing them in at Broadway’s Richard Rodgers Theatre.

Hubbard was convicted Jan. 23 of two counts of misappropriation of public funds involving the money given to Christiansen, but acquitted of a third misappropriation count related to another employee.

The judge ordered Hubbard to be taken into custody immediately after imposing the sentence, while noting earlier that he would not be shocked if the former superintendent was quickly released from jail.

BEVERLY HILLS After being asked if he wanted to give something to his wife before he was taken into custody, Hubbard responded that he wanted to give her “lots of love.”

Hubbard had faced a maximum of five years behind bars, but Deputy District Atty.

Max Huntsman asked the judge to impose a county jail term rather than state prison. In court papers, he cited the “amount of loss” and Hubbard’s lack of prior criminal record.

“I do believe what he did was grossly inappropriate,” the prosecutor told the judge.

Defense attorney Salvatore P. Ciulla maintained that his client had “no financial gain” as a result of the money that was given to Christiansen, urging the judge to consider the “gigantic” consequences his client has faced as a result of his conviction.

“It has ruined him financially,” said Hubbard’s attorney, who called his client “a good man.”

Hubbard was fired from his job as superintendent of the Newport Mesa Unified School District one day after he was convicted of illegally authorizing two payments of $10,000 each and a $500 monthly car allowance to Christiansen, a former Beverly Hills Unified facilities director.

Christiansen’s contract had specified a $150 monthly car allowance and provided for all contract changes to be made in writing.

Hubbard’s attorney said the defense intends to appeal.

“I don’t think the jury got it right,” Ciulla told reporters outside court.

Board President Brian Goldberg said he hoped Hubbard’s sentence would send a message to public employees around the state that breaking the public trust can and will have consequences.

“While I get no gratification in seeing someone else suffer, I am pleased that Hubbard will never be able to harm another public school district in California, and the parade of lemons that he was a part of now ends for him; unfortunately others who participated and benefited from his malfeasance still have positions in other districts,” Goldberg said.

Christiansen, who was tried separately last year, was convicted of four counts of conflict of interest for negotiating contracts between the school district and a firm with which her company had a consulting agreement, and for backing a school bond measure that benefited her firm.

She was sentenced Jan. 5 to four years and four months in state prison, but was allowed to remain free on $400,000 bail while her appeal is pending.

“It’s fun,” Rosenzweig told The Courier. “I think they raise the flag to the City in both a domestic and international way. We know the viewership of those events is huge.”

He told the council, “If we ever were going to have [a float], this would be the time to do it.”

Beverly Hills will be celebrating its centennial on Jan. 28, 2014. The celebration will begin mid-2013 and extend throughout 2014.

The 100th Anniversary Committee has begun initial brainstorming of possible activities to take place during the celebration. These possible events include a television documentary to be sold to the History Channel or Bravo, a Rose Parade float, a Macy’s Thanksgiving Day Parade Float, special magazine sections in popular magazines including Vanity Fair or Travel & Leisure, a Centennial Ball, commemorative merchandise and even the dedication of a small pocket park as Centennial Park. The events are still in the early planning stages and

nothing has been solidified. “(It’s) a testimonial to the strength of the City and what the City has managed to do over its 100 year history,” Rosenzweig said. “It is a flag waving event for our City, good for the City, good for the City’s treasury, feel good for our residents and all in all it works for us on many levels. “ Rosenzweig said although the City will be providing the 100th Anniversary Committee $250,000 per year for the next three years, it will also need to raise hundreds of thousands of dollars.

All residents of Beverly Hills, past and present, will be welcome to participate. There will be a form on the website for people who are interested to fill out and get involved. Rosenzweig said he envisioned at least two committees, a work committee and an honorary committee. Interested residents should visit www.beverlyhills.org.

Rosenzweig recently stepped down as the executive VP of Playboy Enterprises where he was responsible for all nonmagazine related activities of the company which recently went private. He also headed its movie production company and has served on many Beverly Hills civic boards and organizations.

Adjectives and accolades that tumbled from the open-mouthed “fortunate ones” sitting in the front rows of the Parisian runway when the 2012 Spring ready to wear collection from the house of Lanvin was unveiled. Reportedly lead designer; Alber Elbaz sought his inspiration from the heavens above and Dante’s burning inferno far, far below.

His highly acclaimed "Angels in Hell" collection is made up of opposing elements; that in the hands of this genius and powerhouse of talent, work incredibly well. Elbaz has combined hard and soft textiles, joining sleek, minimalist silhouettes and metal and leather accents with soft, flowing fabrics to create a look that, according to Fashion Etc., can be described as “angelically elegant and demonically chic.” This exciting detour from the normally well-behaved, perfectly polished aesthetic enjoyed in Lanvin’s past collections, shakes things up rather nicely, giving us more than a hint of dark

attitude, gads of architectural tailoring, sublime detailing, and a good measure of plain and simple sexiness. A dark, sultry wantonness courses through the veins of the entire collection that give the pieces a raw energy and a sense of urgency and spontaneity. An exposed arm defines the sexy appeal to a romantic blouson, drapey silken trousers are ventilated by slashed seams, hip hugging jet pencil skirts are rucked up and peek-a-boo gashed, and “nothing to hide” vulnerably sheer goddess dresses are cinched, twisted and draped over second-skin bodysuits.

women and classical sensibilities also come heavily into play in his creative process. “I love and respect women” he told our fashion director, Tawny Sanders during his recent trip to Beverly Hills.

“I work mostly with women and you know, our logo for Lanvin is a mother and a daughter. I’ve always said, ‘It’s not a lion, and it’s not a horse. It’s a mother and a daughter.’ I find the logo very emotional. For me, almost everything we do has to be like a dress that your mother wore and that you are going to wear. This is how we bring the emotion into it.” In keeping with Lanvin’s mother/daughter designs, Alber has created his first line of children's clothing for his “Petite Fille” clients which are now available in the Beverly Hills and Malibu boutiques.

Bosse and Mirisch caught the matter, listed as a “consent calendar” item (meaning no discussion and no separate vote).

Bosse objected to the city manager’s ability to spend that much taxpayer money without the express consent of the

council.

Mirisch questioned whether City staff negotiated every project under the larger contract to ensure the City is consistently getting the best value. Maloyan said it does.

After some changes to take into account these objections, the council approved the engineering agreement, not to exceed $750,000 over the next three years.

City staff must return to the council each year and report whether the City is still getting the best rate or if they can find a different engineering firm with better prices. In other words, the agreement becomes year-to-year.

Bosse amended the consent calendar item to limit the spending of the city manager to a $50,000 maximum per project before needing further City council approval.

Maloyan said the three-year contract was for “efficiency of staff” even though the City adopts a budget one year at a time.

He said that any time the council asks for a study to be conducted, such as when the council asked staff to look into bollards when examining if stoplights needed to be put at the intersections of Sunset Boulevard at North Camden and Bedford and Roxbury Drive, staff can engage one of the pre-approved consultants.

If City staff did not have this option available, Maloyan alleged it could take three to four months to get council’s approval to find a firm to conduct the studies.

The Engineering Division of the Public Works and Transportation Department uses consultants like Psomas for professional design services. This agreement enables staff to initiate projects with Psomas through Dec. 31, 2015.

Have you ever felt honored to be among certain people? No, not celebrities, but people who in real life made positive, significant and lasting differences to our lives.

Such was the feeling experienced by others and me recently as the Palm Springs Air Museum held its major fundraising gala honoring the Tuskegee Airmen … the all African-American Army Air Corps unit who saw heavy action in the skies above Europe during WWII. They are also the men portrayed in Red Tails, the recently released George Lucas movie.

Named after the Alabama town where they trained, the Tuskegee Airmen were a product of the racial segregation that pervasive at the time. Yet these loyal men did not desert and deemed it their mission to serve their country, as it was for the other men of their generation who took up arms.

The ranks of the Tuskegee Airmen have shrunk over the years, but 10 of these, heroic individuals were on hand for the museum’s “Hollywood in the Skies”gala, which was really about their courage in the skies … and on the ground.

In addition, the museum renovated a vintage P-51 Mustang fighter plane, complete with red tail and nose art, for the occasion. It was a replica of the actual plane flown by Lt. Col. Bob Friend and during the pre-dinner cocktail hour, each airman, felttipped pen in hand, autographed the aircraft’s tail.

SPIN, SPIN, SPIN: WHY WON’T THEY READ President Barack Obama just proposed a massive new tax hike on American businesses – $250 billion over 10 years. That’s a huge hike. How did the “mainstream media” report it? As a tax “reduction!”

The news pages of The New York Times, Los Angeles Times and even The Wall Street Journal hyped the “rate reduction” rather than netting that against the other provisions. Yes, apparently the President calls for a small reduction of the tax rate for certain corporations – from 35 to 28 percent – but the rest of the proposal raises taxes relentlessly. OK. President Obama likes to raise taxes. He wants to hit everyone in this country who earns money. But his proposal simply did not reduce corporate taxes.

His “fine print” boosts dividend taxation to over 44 percent because of what would become “triple taxation” (the company pays overseas taxes on income, the company pays U.S. taxes on income, and the dividend recipient pays taxes on the dividends.) U.S. companies which operate overseas and pay taxes over there, would now get taxed on the taxes they paid “over there.” For every provision the Congress has written to try to encourage US business, the mainstream media call that a “loophole” or “tax break.”

In fairness, a lot of this does comprise “inside deals” crafted by lobbyists.

But with this particular tax proposal, the net result is a huge increase in taxes. That is the message, but it is not.

Is the problem that news reporters of the mainstream media cannot read? Or won’t they?

The Wall Street Journal case is particularly interesting. One would think the leading newspaper of American business would have reporters who read the fine print before going to print. The WSJ’s editorial page writers did that – they read the whole proposal. The whole proposal raises taxes – massively. The front page reporter missed that.

So, is “journalism” a “profession” peopled with people who read the whole story, or just “reporters” to parrot the spin from the PR guy (or gal) reading the press release?

We believe that most reporters are open or closet leftists whose personal leanings tilt nearly over backwards to socialism. It’s just the way they are, even those few who vote Republican. It’s the norm.

The Courier could write a ridiculously left-leaning article and never get criticized, but let us print something “in the middle” – or better yet, one where we’ve done our homework – and we’re engaging in “yellow journalism.” Public officials, big companies and big unions pay big to spin their messages. They generally don’t like us because we try very hard not to accept the “spin” but rather to research the factual basis of what we’re told. We just don’t take their word for it.

The Courier tries to read the whole story and we anger those who try to get us to buy their story line.

Right now, of course, our favorite topic is the MTA tunnel under Beverly Hills High School because it truly threatens the future of this City. The MTA gets apoplectic when we connect the dots. Supervisor Zev Yaroslavsky singles us out for public criticism. We knew its “seismic study” was “faulty” (excuse the pun) because we read its methodology and asked questions. We looked beyond their conclusions to see how they reached those conclusions. We consulted experts in the field who confirmed what we suspected: the MTA seismic study was not professionally defensible. It was haphazard, incomplete and failed to employ the best techniques to get the best data. With this kind of testing, there are many levels of inquiry. MTA used the least reliable. The Beverly Hills Unified School District, on the other hand, is employing about the toughest level of inquiry – expensive trenching.

MTA should have done this, but then that would lead to the result the MTA did not want. Now, the City of Beverly Hills’ experts have gone over MTA’s work and found it lacking.

So how should The Courier report this? Should we report what MTA tells us or should we look behind what they did and assess the accuracy and completeness of their findings (which is what we did)? The Courier always tries to look behind what anyone tells us. That angers some local politicos who now use every opportunity to trash us, but that’s okay. We’re still telling the truth and when it comes to readership, we’re far ahead and pulling away.

The New York Times, Los Angeles Times, and The Wall Street Journal front pages should have read the President’s entire proposal. They should have connected the dots. They should have done their homework and not just relied on the White House spin. This goes for all presidents regardless of party and for all public officials’ pronouncements. It is what newspapers are supposed to do but seldom do any more. After all, how many tax lawyers are reporters these days?

But if they’re not, or won’t talk to some, they should not accept spin from anyone. We don’t.

LETTERS Well here we go again, the new interest of Brucker’s and Brien’s (where is Gold?) is the Greystone mansion. They want to overload our private streets with more people, raise the noise level, increase the number of tourist buses, as if we don’t have enough during the day, enhance the notoriety of the City thereby increase crime and discomfort for the residents.

The question is why? Haven’t they learned enough from the failures at Roxbury Park? What is disturbing is that in both of these scenarios, the trio wants catering services. Is there is a “caterer issue” that someone in this City/Council has something to gain by it?

We will soon have a theater in Santa Monica, this should be enough for our City, or have we become mama’s boys and need to be spoon fed in all aspects of life?

The bathrooms in La Cienega Park, Beverly Hills High School and Roxbury Park are disgusting. These places need repair,

improvement and security cameras. Streets that not need paving, get paving, streets like Santa Monica that are in need of prompt repair are ignored.

Instead the triumvirate is looking for massive constructions.

Do we really need another exercise facility or place to eat or some misguided people are giving them another mission?

There are so many more urgent needs in the City; for one, BHFD lacks the equipment or means to come to our aid in a large earthquake. Brucker knows this well. There is no enforcement of noise as the officers are too busy.

Issues such as segways on our sidewalks which are potentially dangerous was tabled last summer as a non important issue. We must wait until someone gets trampled by one of them. Cyclists in the triangle are another serious problem as well as dogs without a leash or for that matter, dogs in restaurants. All of these issues are against the law. Remember.. recall is an option. at Santa Monica Boulevard and Doheny Drive has been acquired and will be finally made an attractive gateway to the City after years of being a fenced-off mess.

I am a little disappointed we are considering constructing walls and two 22-foot towers however to mark the entrance.

I’m not even convinced an architectural element is really warranted: trees, landscaping and the iconic shield sign would in my opinion not only harmonize better with the residential character of our side of that intersection but would be far more elegant, serene and representative of us as “Tree City USA.” I heard at the study session our City Council mentioning Mies van der Rohe’s famous quote “less is more.” I would also add Louis Sullivan’s adage “form follows function.”

Walls and towers don’t say “welcome,” they say who goes “there?” But sincere thanks to staff and the council for moving forward on upgrading this neglected entrance to the City.

Rabbi Jacob Pressman MAY I HAVE A WORD WITH YOU? Let us take a breather from the wretched news of the day and think about some of the words we use daily. The fancy name for such study is called Etymology.

May we start with “hello?” What are we saying when we say “hello?” My big dictionary doesn’t really know. Let’s call it our common salutation or greeting. Most languages use something clearer. In England some say “good day”and pronounce it “goodbye.” The French say: “bon jour” (Good day). Italians say “buon giorno” and “buona sera.” Spaniards say “buenos dias;” Germans say “guten morgen” and “guten abend,” etc. We say “hello,” as well as “good morning,” “good afternoon,” “good evening” and “good night.” But what is hello? One of my largest dictionaries at least declares it doesn’t know, stating: “Etymology doubtful.” My amateur etymology guesses that it is somehow connected with “Hail” or “Heil” wishing the next person good health.

We find that connotation in our casual: “how are you?” which we contract to “hi_y’all, or just plain “hi!” The polite salutation: how do you do?” Raises some interesting questions, such as: “How do you do what?” This question is often contracted to “howdy.”

When we separate, most say “good-by” or “goodbye,” which is short for “God be with you;” and which we further shorten to “bye now” or “bye bye,” or even just plain “bye.” Sometimes we say “so long,” which can either mean: “It has been so long since we visited” or “Let it not be…” Incidentally, in Italian it is expressed by “ciao,” pronounced “chow.” Another “good-bye” we often use is “farewell,” a somewhat archaic use of the word “Fare” for “get along,” or “have food and drink.”

And then, or course, there is the Hebrew word “shalom,” which means “peace, hello and goodbye” of which the song suggests “Say hello with a little goodbye in it.

All the above, in which I actually barely touch on the subject of vocabulary, is only the tip of the iceberg of the idiomatic usages of the English language. I recommend you take some quiet time to explore the origins and multiple uses of words that interest you, for after all, words are what distinguish us from everything else in creation.
