Goldsmith was born in Chicago in 1923. His parents were Bertha and Max Goldsmith. He attended the University of Illinois and joined the U.S. Army in 1942. Following World War II, he returned to Chicago, but then moved to Los Angeles in 1952. After 25 years as president/CEO at Buckeye Realty and Construction Company – during which time he built more than 30 office towers in Beverly Hills – he was elected to the Board of Di-

Ellman-Garber told The Courier he began conversing with her group about his grandmother and his children, and asking the women about their families. “He was just kibbitzing with us, we had no idea who he was at first. All he told us was he works in music,” Ellman-Garber told The Courier. “We all had a great time and laughed a lot, he couldn’t have been sweeter.” At the end of their meal, the waiter informed Ellman-Garber’s group that The Game, born Jayceon Taylor – who posted the group photo on his Instagram (@losangelesconfidential) – had picked up their tab.
El Rodeo Cleared Of Seismic Risk By Laura Coleman The California Geological Survey (CGS) gave its final approval of the seismic investigations at El Rodeo school Monday and determined that there are no active faults at the school, giving the district the green light to move forward in developing the site as part of its Measure E school building program. In a letter addressed to former Beverly Hills Unified School District Superintendent Gary Woods on Feb. 29, CGS Engineering Geologist Brian Olsen wrote: “The conclusion that there is no active faulting at the campus appear to be supported by the data provided.” The final approval comes after CGS performed a second review of the engineering geology and seismology aspects of the consulting reports prepared for El Rodeo. For the supplemental fault investigation, the consultants drilled an additional seven continuously cored borings to depths ranging from 60 to 175 feet. They also provided geologic logs of four additional trenches at the site. “The BHUSD is gratified that CGS has confirmed our geological studies that there is no active faulting under El Rodeo School,” Board President Howard Goldstein said. “ This is also very good news for the entire Beverly Hills community since a finding of no faulting should give all property owners abutting the El Rodeo area peace of mind knowing that their properties are not located above active faulting.” BHUSD consultant Tim Buresh, who previously served as interim facilities chief, noted that the City is a “prime beneficiary” of the work. “CGS has embraced our findings regarding the West Beverly Hills Lineament and is now in the process of removing the West Beverly Hills Linea-
ment from its active fault map,” he said. As a result of the district’s comprehensive seismic investigations, Buresh said that Metro’s regional seismic model directly conflicts with the now proven reality. A preliminary investigation of El Rodeo several years ago indicated it was safe. However, four years ago, the district was forced to perform detailed investigations after the Metro fault investigation mapped one active fault zone pointed at the high school and one active fault zone pointed at El Rodeo. “When the district successfully cleared the BHHS site, MTA spun the message to declare that the district work at BHHS only served to reinforce the seriousness of the MTA fault pointed at El Rodeo,” Buresh explained. “Then the 9900 Wilshire fault investigation accepted by the City seemed to confirm the MTA mapping and specifically identified a broad band of active faults running directly under the main building at El Rodeo. In the face of this much information indicating the presence of active faults at El Rodeo, CGS took an extremely conservative approach to evaluating our investigations and their results.” Goldstein underscored that because Southern California is a seismically active region, the Education Code requires that geological studies be prepared before the construction or reconstruction to any school buildings. “For this reason the school district was mandated to perform geological studies to confirm that no active fault rupture hazards existed at the El Rodeo School site,” he said. “The final conclusion accepted by CGS is that there are no active faults at El Rodeo and that development of the site may proceed.”

New Beverly Hills Police Chief Spagnoli Faces Challenges As She Replaces Rivetti By Victoria Talbot With the official departure of interim Chief Dominick Rivetti from the Beverly Hills Police Department, Capt. Tony Lee will serve as interim chief until March 13 when Sandra Spagnoli takes over as police chief. Spagnoli comes to the City from San Leandro, where she has served as chief since 2011. According to a report from Rivetti delivered to City Council on Sept. 10, she will inherit a department with discipline and succession concerns based on a report from Management Partners (MP), a consulting firm hired by the City to investigate problems in the department. Rivetti has addressed some problems, but left some systemic issues to his successor. The MP report said the department lacked strategic vision, suffered from low morale and flawed hiring practices, employed poor disciplinary procedures and suffered from a lack of transparency in promotional practices and poor succession planning and team building. Employees indicated that they felt they did not have suf-
ficient opportunities to develop skills to compete for promotions to special assignments, nor do they believe there is a clear path to promotion or disciplinary procedures. MP suggested BHPD initiate a review of the promotional practices with employee involvement, create clear, measurable standards to be achieved with written competencies and associated factors in order to be considered for promotion. Last week, in an arbitration involving the appeal of the termination of Officer Stan Shen, an independent arbiter decided in favor of the Appellant in the second such case in as many years. A previous incident involved Sgt. Richard Ceja. In both cases, the arbitrations ended with the two officers ordered to be reinstated. Independent of one another, arbiters concluded that the testimony of their fellow officers, which resulted in their terminations, was untruthful. Rivetti did not address the possible Brady rule violations, but a prosecutor is required to notify defendants and their attorneys if a law enforcement
official involved in their case has sustained a record for lying in an official capacity; they have a duty to disclose exculpatory evidence to a defendant. In Shen’s case, the arbiter also concludes that Shen’s Police Officer’s Bill of Rights (POBOR) were violated. “Concerning the statute, California Government Code 33000-3313 [PBOR] finding here is that indeed, the Appellant’s rights under 3304 [d] were violated by the disciplinary action taken against him.” In Ceja's case, four officers who testified against him were found to be "not credible," and guilty of “false statements,” “lacking credibility,” “unreliable,” “inconsistent,” “in conflict,” and guilty of the "lies of omission," which led the arbiter to disavow their entire testimony. In Shen's appeal of termination, a second arbiter independently said the testimony was “unreliable,”“tainted” and “dishonest.” Shen was fired for reporting an incident two years after it happened at a bar in West (see ‘BHPD’ page 20)

Beloved Longtime El Rodeo Physical Education Teacher Robert “Bob” Craig Dead At 86 By Matt Lopez Longtime Beverly Hills teacher and youth sports coach Robert “Bob” Craig died Monday at age 86. Craig was a revered figure among Beverly Hills youth during his 32-year tenure as a physical education teacher at El Rodeo. In addition to teaching, he coached volleyball and basketball at Beverly Hills High School. Born in Idaho on June 26, 1929, Craig went on to star on the basketball court at BYU, where he was a member of the 1951 National Invitational Tournament (NIT) championship team. After graduating, he spent four years in the Navy and the next 20 years of his life in the Navy Reserves. He earned his Masters Degree in Education
Administration from UCLA before beginning his teaching career at El Rodeo in 1957, a position he held until his retirement in 1989. Craig would often take Beverly Hills kids to the Circle K Ranch in Colorado and the Rocking R Ranch in Utah – dude ranches that acted as summer camps for many Beverly Hills youth. “We respected the heck out of Mr. Craig. When you really got to know him, you realized how fortunate we were to have this unbelievable teacher and coach in our lives. I can’t say enough about him.” said BHUSD Superintendent Steve Kessler, who was a student of Craig’s from kindergarten through 8th grade. Craig is survived by Charlene, his wife of 65 years, his

Agress, MD, renowned for his life-saving cardiac research and his A-list Beverly Hills patients, passed away Feb. 24 in Santa Barbara. Born in Knoxville, Tennessee, to Max Agress and Jennie Bain Agress, Dr. Agress grew up in Dallas, Texas, where he was his high school valedictorian. He received his BA from Harvard and attended medical school at the University of Texas. After graduation, Dr. Agress interned at the L.A. County Hospital in medicine and pathology. During WW II, he served as a major in the U.S. Army Medical Corp. After the war, Dr. Agress worked with world renowned Dr. Myron Prinzmetal where he began his care of Hollywood’s most famous. His first two patients were Lana Turner and William Randolph Hearst. His client list went on to include Peter Sellers, Steve McQueen, James Mason, Anne Baxter, Gov. Pat Brown, Louis Armstrong, George C. Scott, Quincy Jones, Judy Garland, Elizabeth Taylor, Cornel Wilde, and so many others, even owning a yacht with Walter Matthau. He started the Cardiology Depart-
ment at Cedars-Sinai where he was also the principal investigator in cardiovascular research. He was acknowledged by the American Heart Association as the reDr. Agress search doctor responsible for Thrombolysis, dissolving clots out of obstructed heart arteries. His discovery was the basis of today’s treatment of acute heart attack that saves countless lives. A true Renaissance man, Dr. Agress painted beautifully. Beverly Hills Teen Sofia Miller Organizes Art Auction At Bonhams & Butterfields To Raise Money For Mental Health By Laura Coleman Thanks to the efforts of Beverly Hills High School junior Sofia Miller, high school students from throughout Los Angeles will participate in an art gala on Saturday, March 12 at Bonhams & Butterfields Auction Gallery on the Sunset Strip to raise money for mental health services. Sofia, who has been creating art since she was young, said she was motivated to do something meaningful with her time in an effort to give back to the community. “I’ve found that art helps people,” she explained. “I love how relaxing and therapeutic it is.” The Saturday evening gala, which takes place from 5:30-8 p.m., will feature photographs, drawings and paintings from 75 local young artists. By Victoria Talbot Some water consumers in the City of Beverly Hills – and parts of West Hollywood – who have expressed alarm at the increase in their water bills since the water penalty surcharges were approved will be glad to hear that, effective Tuesday, March 1, the penalty surcharge will be reduced. The result will mean a significant decrease in the penalty surcharges, but don’t celebrate yet. On Feb. 16, the City Council agreed to implement a previously approved five percent water rate increase (City Council, Oct. 20, 2015). Assistant City Manager George Chavez told City Council that the Public Works Department faced a budget shortfall, and the council approved the increase. But it has been the penalty surcharges that have most customers worried. Many water customers have contacted The Courier about their alarm of higher-than-anticipated bills. One woman, a senior on a fixed income with a family of five, was allotted only 11 units of water last billing period and her bill doubled with fines. The family has been conserving for three years, with buckets in the shower, water-saving appliances, and zero-landscape watering. But, the City showed a 25.9-percent reduction in water use in January, after penalties were implemented, compared to 12.3 percent in December. City Hall sources tell The Courier
the City has been inundated with calls from residents angry over the penalties. City spokesperson Therese Kosterman confirmed the City received 80 calls per day on the matter. For customers using between 71 and 87-percent of their 2013 baseline consumption target, the penalty was 1.59 times the base water rate. For users of 88-percent or more of their 2013 target, the first level penalty was 1.59 times the base water rate for usage between 71 and 87-percent, plus an additional 3.08 times the base water rate for water usage that is 88-percent or more. New penalty rates drop the 1.59 penalty multiplier to 1.25 times the base rate for customers with less than 30 percent conservation. For those customers with less than 12-percent conservation, the current 3.08 times the base rate would become 1.60 times the base rate. At Tuesday’s Study Session, Public Works Senior Management Analyst Caitlin Sims, and CFO Don Rhodes told the council repeatedly that the main purpose of the water surcharge penalties was “to change water consumption habits.” The penalties cover estimated budget shortfalls from a combination of State Water Resources Control Board fines and Metropolitan Water District (MWD) penalties for not meeting targets, as well as costs associated with implementing conservation measures such as turf removal incentives. Blood Donations Sought For Red Cross Month During Red Cross Month in March, the American Red Cross is seeking eligible donors to help its lifesaving mission by giving blood to help meet the needs of patients at approximately 2,600 hospitals nationwide. Donors of all blood types are needed to help accident and burn victims, patients undergoing organ transplants, those receiving cancer treatments and others who rely on blood products. Cycle For Survival Raises Funds For Cancer Research Interested cyclists can join actors Kristin Davis, Alison Brie, Dave Franco, Brittany Daniel, Chris Mintz-Plasse and more for the 10th annual Cycle For Survival, from 8 p.m.-5 p.m. tomorrow at Equinox West L.A., 1835 Sepulveda Blvd. More than 27,000 riders in 15 cities across the country are expected to take part in the event that raises funds for rare cancer research led by Memorial Sloan Kettering Cancer Center (MSK). Instructors from Equinox, Cycle for Survival’s founding partner, will lead riders, including doctors, researchers, patients, caregivers and survivors in the
indoor cycling event. The experience includes music, dancing, tributes, and stories about the impact Cycle for Survival has had since its inception. Since 2007, Cycle for Survival has raised more than $100 million. More Than 45 Businesses Rally Community CHLA Launches Inaugural #MakeMarchMatter Fundraising Campaign Children’s Hospital Los Angeles (CHLA) has launched its inaugural Make March Matter, a month-long community campaign to rally local businesses and individuals to raise $1 million in support of critical, life-saving care for children in L.A. Each year, CHLA treats more than 111,000 children with a range of health issues, from common illnesses to traumas to chronic diseases; advances research designed and partners with physicians across the nation. “Our mission of creating hope and building healthier futures pushes each one of us at Children’s Hospital Los Angeles to stretch ourselves to advance the field of pediatric medical care,” says DeAnn Marshall, CHLA senior VP and chief development officer. “The #MakeMarchMatter campaign is designed to rally businesses and our local community for one month out of the year in support of the commitment that we bring to our mission every day.” CHLA is asking the community to support the campaign, with details available at MakeMarchMatter.org., by: • Sharing 31 reasons that child health matters using the #MakeMarchMatter hashtag. • Make a donation. Bloomfield said at Wednesday night’s annual L.A. gala fundraiser for the museum, “What You Do Matters.” Such words are a stark reminder of the fact that modern generations can in fact be manipulated by propaganda to act in ways that are ostensibly unthinkable. Over 650 people, including 30 Holocaust survivors, attended the museum’s annual dinner at the Beverly Hilton, which honored actress Rosanna Arquette and her husband Todd Morgan, senior managing director at Bel Air Investment Advisors, with its National Leadership Award. “We believe inspiring people with these lessons can make a difference,” Arquette said. “It’s our responsibility to the memory of the survivors and those who did not survive,” Morgan added. USHMM Western Regional Office Director Steven Klappholz underscored that maintaining the evidence is fundamental to triumphing against Holocaust deniers, as well as educating future generations on how propaganda influenced so many people to become perpetrators.

In its national campaign “Never Again: What You Do Matters”, led by honorary chair Elie Wiesel, the museum seeks to make critical investments to keep Holocaust memory alive as a relevant, transformative force in the 21st century. “I am grateful to the Holocaust Museum for having the facilities to preserve the precious memories so that our messages may remain alive and be delivered to future generations,” Holocaust survivor Louis de Groot said on Wednesday. “My hope is that from our stories, they will learn how to live with one and other with more tolerance and compassion.” Honorary dinner committee members included Steven Spielberg and Barbra Streisand and James Brolin. The initiative amends The Beverly Hilton Revitalization Plan, which was approved by the City Council and Beverly Hills voters in 2008 following 19 public hearings and a referendum. In addition to creating the new Waldorf Astoria Hotel, now under construction at the corner of Wilshire and Santa Monica Boulevards, that plan allows Alagem to build two luxury residential buildings along Santa Monica and Wilshire totaling 110 condominium units. The initiative aims to reconfigure the already approved use of the property by eliminating the planned eight-story residental building along Wilshire in favor of a 1.7acre garden, to be designed by
award-winning landscape architect firm SWA. That residential square-footage, in turn, will be added atop the planned 18-story Santa Monica building, resulting in a single, 26story building designed by Robert A.M. Stern Architects. The proposed change also streamlines access to the site by eliminating an entry and exit point along Merv Griffin Way while likely slimming down the resulting traffic. “Beverly Hills voters determined the future of this landmark property back in 2008, and we think it is only appropriate for them to decide again between the already-approved plan with two residential buildings, or this new approach to create an incredibly beautiful open space destination that will be the Wilshire Gateway to Beverly Hills for generations to come,”Alagem said.

FUN WITH MUSIC—Pianist Hyung-Ki Joo and violinist Aleksey Igudesman, the comic duo known as Igudesman & Joo, are bringing their latest show And Now Mozart to The Broad Stage in Santa Monica at 7:30 p.m., Friday, March 11. A follow-up to their popular A Little Nightmare Music, this show is bigger and crazier,” says Joo, “and we even do magic.” In the “Gravity” sketch, the two take a piano apart, removing the lid support and one of the legs (the piano stays standing) and turning them into musical instruments for a heavy metal song. In the “Music Police” routine Igudesman accuses Joo of speeding through Chopin, and in a kind of inebriation test, makes the pianist unleash a rapid-fire, tour de force of styles, composers and techniques, from Tchaikovsky to Phillip Glass. While most of the concert is played for laughs, Igudesman & Joo do show off their considerable musical chops with compositions of their own or from the classical repertoire. “With us,” says Joo, “the music comes first and the zaniness is secondary.” The approach has made them popular guests with orchestras including the L.A. and New York Philharmonics. Large, 5-Story 772 Sarbonne Road Development Draws Concern From Bel-Air Residents By Matt Lopez Bel-Air residents are rallying to bring attention to a new project whose depth could rival that of the monstrous 901 Strada Vecchia, which has been in the crosshairs of residents and L.A. city officials over the last two years. In a community letter that went out to many Bel-Air residents this week, local homeowners were warned of the modern glass-looking structure in development that projects more than five levels. The top story is at street level, while the others are down the slope. Three of the levels are labeled as a basement, with two of them having full openings to the outside. The total height of the structure is presented as 30 feet, although the community
letter notes “we noticed the actual construction is 56 [feet] (as a comparison this is the same number of levels in a similar slope configuration as the Strada Vecchia construction which has destroyed a neighborhood in Bel-Air. This relates to what is considered as basement on the slope of the hillside.) The home is around 22,000 square feet with 7,500 square feet of residential floor area. The big question is whether the home will be able to stay under the 6,000 cubic yards of soil allowed to be hauled under the Interim Control Ordinance. The community letter points out that “the developer has been careful enough to declare that they will haul away 5,800 cubic yards...we noticed that a lot of the additional cubic feet of dirt

The park won final approvals Tuesday, and with it, approval to raise funds from the community to create a better park and an increase in funding to $600,000 as the council took responsibility for full remediation of the contaminated soil on the site. The Bosse family has led in fundraising throughout the City. In schools they have made substantial contributions to BHEF, KBEV, and the Beverly Hills High School library. The Bosses were leaders in the revitalization of the Lily Pond with the Friends of Beverly Gardens Park, the Enchanted Woods Children’s Library, The Wallis Annenberg Center for the Performing Arts and the 9-11 Memorial. The Beverly Hills Fire Department and Police Department have always counted on their generous support. “When you look at the list, to me, that is the core of our community. Having a dog park will be one of the centers that we are missing,”

Interestingly, four of the eight approved permits – including permits for grading/excavation, basement shoring, water features and the swimming pool – provide no contact information to allow the public to see who applied for the permits.

Bosse sees it as “an extension of ‘Walk with the Mayor,’” a weekly event that was part of her signature ‘Healthy City’ initiative, when, as mayor, hundreds of residents and friends joined her on weekly walks throughout the City. “A ‘Healthy City’ includes our dogs, kids and neighbors, and the connection of a passion shared. We will make this one of the best places in Beverly Hills.” The City originally estimated the park at $400,000 — $450,000. Costs include $110,000 for Consulting Studies, which included the environmental document for the Mitigated Negative Declaration and the architectural, mechanical, electrical, plumbing engineering, civil engineering, soil studies and site survey; $111,000 for construction and $14,000 for utilities. The remediation was estimated to be $187,000 at 12 inches deep. However, the city council is concerned that it will be a public park for use by people and animals. The remediation will likely be done to the fullest extent possible. That figure may change and will likely use up the contingency of $30,000. In addition, upon examination, the crumbling walls that surround the property must be replaced. The

The basic park includes four walls, a decomposed granite surface and three benches, which are to be divided between small and large dogs. To complete the park, $100,000 goes a long way. But more is needed. “Anyone who feels the sense of love and pride for our community and how our dogs change our lives should donate. The park belongs to all of us,” said Bosse. The Los Angeles Times in 2012 called Goldsmith the “Banker to the Stars” for a clientele that includes Frank Sinatra, Wolfgang Puck, Vin Scully, Robert Redford, Cher and Paul Newman. “My father was a remarkable man, truly one of a kind,” said his son Russell Goldsmith, City National’s current chairman/CEO. “We are all very proud of him, and he in turn was deeply proud of this company, what it does for its clients and the thousands of colleagues who made it what it is today.” Goldsmith’s many civic accomplishments include: serving as president of The Jewish Federation Council of Greater L.A. in 1969 and 1970, and chairing the 1965 Los Angeles United Jewish Fund Campaign. Today, The Jewish Federation’s Los Angeles headquarters is the Goldsmith Center. Goldsmith also was a national chairman of the United Jewish Appeal from 1970 to 1974, a boardmember of the Cedars-Sinai Medical Center from 1979 to 1999, and a boardmember of the Los Angeles Philharmonic Association. He was a lifetime trustee of all

Goldsmith also chaired the Wallis Annenberg Cultural Center Foundation and led the effort to renovate the old Beverly Hills Post Office, converting it to Wallis Annenberg Center for the Performing Arts. “It is the responsibility of every individual to help contribute to the growth and security of its neighbors and its opportunities,” Goldsmith told The Courier in a November 2014 feature profile. Goldsmith is survived by his wife Elaine, their two sons Russell and Bruce, and five grandchildren. There will be a public memorial service in celebration of Goldsmith’s life at 3 p.m. today in the Bram Goldsmith Theater at the Wallis Annenberg Center for the Performing Arts. The service will be followed by a reception in the same location. Sports Awards Honor Vin Scully, Special Olympics At The Beverly Hilton By Matt Lopez As Vin Scully prepares for his final season behind the microphone of Los Angeles Dodgers games, he’s been showered with praise left and right by fans, friends and peers. That continued last Friday night at The Beverly Hilton, when Scully was honored with a lifetime achievement award from the Los Angeles Sports Council at the 11th annual L.A. Sports Awards. Next season, Scully, 88, will begin his 67th and final year working as play-by-play man for the Dodgers, ending a career that began when the team was still in Brooklyn in 1950. Former Dodgers president Peter O’Malley presented Scully with the award. "We all can't be heroes.

Beverly Hills High School Boys Basketball Team Loses In CIF Semifinals By Matt Lopez Beverly Hills High’s boys basketball team ran into a 7foot roadblock on its path to a second-straight trip to the CIF Southern Section finals last Friday night. In the end, it was too tall a task to overcome. 7-foot center Roman Silva blocked Denzel Holt’s buzzerbeating, game-tying 3-point attempt, locking up a 48-45 win for Diamond Ranch over Beverly Hills in a heartbreaking, season-ending loss for the Normans in the CIF-SS Division 3A finals. Silva ended up being the difference-maker, dominating the game with a triple-double that saw him record 19 points, 19 rebounds and 10 blocks. Holt had 19 points to lead the Normans, who finished the 2015 campaign with a (21-9) overall record. Ron Artest III chipped in 12 points for the Normans. BHHS, the defending Division 3A champ, trailed for most of Friday’s contest but kept the game close. The Normans rallied from down seven points early in the fourth quarter to tie the game at 44 with two minutes left. BHHS had a chance to take a late lead when trailing by one in the final minute, but Silva altered an Artest III layup attempt that was converted into a basket on the other end. The loss marked the end of another stellar season of Normans basketball. The team will
bid farewell to 11 seniors next season, including players like Holt, Max Walder, Mason Daniels, Maddox Daniels and Amir Hajirsooli. Just like he did this season, on the heels of the program’s first CIF Southern Section title since 1969, expect coach Jarvis Turner to reload with another contending team next season, thanks in large part to strong junior varsity and freshman squads that he has built. Artest III, a junior, will be the Normans’ top returning player next season. Track and Field The BHHS track and field season officially began on Feb. 27 with the Ocean League Relays at Culver City High. To nobody’s surprise, Amanda Block dominated the pole vault, clearing an 11-0. On the track, girls runner Lia Danenberg-Helm took first in the 3,200 meter run in 12:56.07 seconds. On the boys side, two distance medley relay teams competed and took first and second place respectively. Beverly High’s “Team A” took first place in 11:11.45 while “Team B” took second in 11:37.94. Stanley Wu won the boys 100 meter hurdles in 16.43 and the boys varsity 4x100 relay team took second place in 44.88 seconds. The team returns to the track Saturday at 10 a.m. in the Culver City Invitational at Culver City High.
Community Services Kickoff Enrollment For STAR, Summer Camps And Classes By Victoria Talbot Beverly Hills Community Services Day at Farmers’ Market showcased upcoming spring and summer classes the whole community can enjoy last Sunday, with over 600 residents enrolling in summer camps and classes and taking advantage of the early bird discounts the City offers. The Showcase provided a glimpse into the many activities that will be offered for all ages as the weather heats up. Booths demonstrated some of the camps and classes, such as Professor Egghead Science Camp, Kitchen Kid and Playwell Technology Lego. The evening benefited the John Ritter Foundation for Aortic Health, Andy Transplant Foundation, and Diane Ladd’s Arts and Culture Task Force. Three legends of the screen were presented with “Icon Awards.” George Chakiris, who won an Oscar for West Side Story in 1961, Margaret O’Brien. whose Oscar was for 1944’s Meet Me In St. Louis, were joined in the honoree list by Paul Sorvino, a classic actor during the past 46 years. For the past decade, celebrity photographer Michael Childers and Jewish Family Service of the Desert (JFS) have provided the Coachella Valley with a gift … a gift good for “one night only.” The April 20 event, fittingly entitled One Night Only, was conceived and produced by Childers, who has raised some $13 million for a variety of charities, has a simple premise: bring together on stage an all-star cast of Broadway performers, having each sing one hit song. Simple, but unless you have Childers’ extensive Rolodex and a vast list of devoted friends and supporters, it would be impossible to pull off. This year’s production of One Night Only is themed “Sondheim In Love” with some of the best known, most romantic songs penned by the legendary composer, Stephen Sondneim. It features Christine Andreas, Brend Barrett, John Barrowman, Liz Callaway, Nancy Dussault, David Engel, Jason Graae, Hunder Ryan Herdicka, Barb Jungr, Millie Martin, Marilyn Maye, Howard McGillin, Julia Murney, Teri Ralston, Lee Roy Reams, James Snyder and Karen Ziemba. John McDaniel is the musical director while super-talented Lucie Arnaz (pictured) serves as the director. We wondered what motivated these hard-to-book performers to donate their appearances and decided to ask Desert resident Lucie. We caught up with her in Florida where she is performing, and asked her to explain how putting together such a star-studded ensemble cast is possible. Without hesitation, she gave two reasons: Michael Childers, calling him a “consummate professional” who produces an evening of entertainment as enjoyable for the performers as it is for the audience. plus performers wanting to giveback to the community. Active for 30+ years in the local Jewish community, JFS of the Desert provides services throughout the area to those in need, regardless of religion, age, income, ethnicity or life style. The Contractor and all subcontractors shall comply with the requirements set forth in Division 2, Part 7, Chapter 1 of the Labor Code. ABOUT THE TREES AND MORAL DECAY A malaise of corruption has engulfed City Hall. Its moral essence, at its core, has been compromised and is withering away into vapidity. The center is not holding; not when a majority of City Council members nod at senior staff malfeasance and deceit, wink at city attorney incompetence, and white-wash staff misconduct. The rule of law and credibility in our institutions are in jeopardy. An examination of immutable, foundational facts regarding the clear-cutting of trees from Parcels 12 and 13, memorialized in testimonial and written form, will aid immeasurably by illuminating current morally lapsed conditions. Let’s review briefly the chronology of events to determine the extent of Beverly Hills senior staff’s malfeasance and city attorney incompetence. Arsenic impacted soil above the level of concern is located on Parcels 12 and 13 in the area between the south side of Santa Monica Boulevard and Civic Center Drive stretching out eastward from City Hall for approximately five acres. This strip of arsenic contamination is zoned for transportation purposes only (T1). It is currently vacant and unpaved with scores of mature trees recently clear-cut without permission or authority from the California Environmental Protection Agency Department of Toxic Substances Control (DTSC). On June 17, 2015, the Department of Toxic Substances Control (DTSC) conducted a public hearing inside the Beverly Hills Public Library attended by Deputy City Manager David Lightner, property owner Lyn Konheim, and residents, regarding remediation of the arsenic contaminated land strip. DTSC is the lead agency which regulates and monitors contamination present on properties and is responsible for monitoring the soil conditions and overseeing any work that takes place on Parcels 12 and 13, the arsenic contamination strip. (The quoted portion is cited from page 3 of the Jan. 5, 2016 Agenda Report filed by the city attorney.) At the June 17, 2015, public hearing, DTSC representatives averred and admonished the parties present, on several occasions, that “when there is no development plan approved by the City, the property stays the same.” (The quoted portion is from page 29 of the Hearing Transcript from that public hearing.) No clean-up of the site would occur without DTSC approval, monitoring, regulating, and overseeing of the work. On Aug. 17, 2015, City Manager Mahdi Aluzri, wrote a letter to Tedd Yargeau, DTSC’s project manager of Parcels 12 and 13. By his letter, Aluzri acknowledged the jurisdiction of DTSC to control the remediation of all the property, both private and public, on the two parcels. He went on, further, in his letter to influence DTSC to redraft a revised Removal Action Workplan (RAW) to accommodate the City’s concerns. Most importantly, he took the position that “the remainder of the real property (that which is privately owned) involved in the RAW project (Parcels 12 and 13) is within the City’s jurisdiction.” On Sept. 4, 2015, having completed its review analysis of the draft Removal Action Work-plan (RAW), the DTSC thanked the parties for their participation and noticed, in writing, the City of Beverly Hills, senior city staff, the property owner et al., that DTSC has decided to postpone the approval of the draft RAW until a later date when there is a specific plan for the end use of the property. As the site is currently zoned for transportation use (T1), the City of Beverly Hills will have to review and approve any plans prior to the development of a new cleanup plan for the site. No new timeframe has been established for potential cleanup activities at the Site, however, any new cleanup plan would have to go out again for a 30-day public review and comment period prior to approval. (Emphasis added.) On Oct. 29, 2015, an email was sent by Steve Zoet, director of Community Services for the City of Beverly Hills, to City Manager Aluzri, stating: “Mahdi, the attached is a draft that I’d like your thoughts on to see if it has the content that you envisioned. We (nor Lyn) can initiate anything until we get a better understanding of what processes and practices will need to be taken as a result of the notice that the property is under regarding the arsenic findings. [Deputy City Manager] David L. is contacting DTSC for clarification but we’ll be in a holding pattern until we work through that issue.” According to DTSC, thereafter, it repeated its admonitions to the parties, the City and the property owner. Nevertheless, on Nov. 21-22. 2015, high level
City staff permitted the property owner to chop down, clear-cut the trees, approximately 196, along Santa Monica Boulevard on Parcels 12 and 13 in the arsenic impacted soil. In response, DTSC, sent the following letter to the property owner on Nov. 25, –portions of which are excerpted herein: “The Department of Toxic Substances Control was recently informed about the unauthorized removal of all the trees along Santa Monica Boulevard on [Parcels] 12 and 13 … (emphasis added) …. As you are aware, elevated levels of arsenic are present in surficial soils. Pictures were submitted to DTSC showing heavy equipment and tree removal personnel on both Parcels. DTSC did not authorize this work and, as stated to you and the City of Beverly Hills previously, any future work must be conducted under an approved cleanup plan and California Environmental Quality Act (CEQA) document.” (Emphasis added.) The mantra from City Hall in defense of its noncompliance and ignoring DTSC directives outlined above was “the trees were on private property, so we had to give the property owner a permit!” Yet, on Dec.15, 2015, the City finally acknowledged that, in fact, no such permit was issued. Moreover, the city manager notified the City Council about the tree-cutting at approximately 5:20 p.m. on the early evening the night before the removal. The City Council then requested that the city manager enlist the city attorney to engage in a probe of the matter listing a chronological timeline. On Jan. 5, 2016, the city attorney issued its report to the City Council and public. During the course of this alleged probe, the city attorney did not speak with or interview anyone at DTSC. Rest assured the city attorney did speak with the attorney for the property owner Lyn Konheim, as well as senior staff. Also, please note that nowhere in the City Attorney’s “investigative” report did she mention any of the DTSC admonitions and directives outlined above. So the staff created and disseminated a false narrative and the city attorney submitted an incomplete and incompetent so-called “investigative” report excluding key facts revealing staff malfeasance. On Jan. 21, 2016, significantly, the city attorney advised prominent counsel and lifelong Beverly Hills resident Lou Lipofsky, VP of the Beverly Hills North Homeowners Association Vic Bardack, and me that the clear-cutting was not to be distinguished from upsetting the soil. Her opinion was, simply stated, that the clear-cutting of the 196 trees rooted in arsenic-laden soil was just as much a remediation issue as uprooting the soil with a shovel. When the City Council members commented on the city attorney’s report, only Councilmember Willie Brien lavished praise. He continued his defense of the staff, City Attorney, and, his friend, Lyn Konheim. On Feb. 16, 2016, at an afternoon City Council study session, after the hearing was closed for public comment, Councilmember Brien lashed out and scolded, from his seat of power and authority, with scurrilous insinuations, fellow residents, myself included, as well as The Courier, and its outstanding, intrepid investigative journalist Victoria Talbot, who grew up in Beverly Hills. Full disclosure – I supported Dr. Brien both for re-election and during the Town Hall meeting on Jan. 27, 2016. I am disappointed he chose to besmirch fellow residents, knowing no one other than councilmembers would be permitted to speak and none of those he criticized would be able to rebut his mistaken impressions. Sadly, many of us expected a lot more from him. Finally, knowing all these immutable facts, how is it that this City Council proceeds business as usual, relying on senior staff that not only let down the residents of our City but also the City Council members from whom they seek direction. Presently, the senior staff, city attorney, and council have circled the wagons and are stonewalling requests for relevant documents regarding this sordid mess. Instead of transparency, the council is permitting staff and the city attorney to resort to an opaque blockage by denying legitimate requests for information pursuant to the California Public Records Act. The only hope for this “wretched madness” to end is for Councilmembers Lili Bosse and Vice Mayor John Mirisch to stand up for all those who are offended by the moral decay and give truth a chance.
