By Matt Lopez The California Geological Survey, the ultimate authority of the state of California responsible for evaluating geological information in the state, last Friday in a letter to the Beverly Hills Unified School District, affirmed that there are no active earthquake faults at or adjacent to Beverly Hills High School.

In a letter obtained by The Courier Hill, Farrer & Burrill, the law firm representing BHUSD, fired a 36-page letter to Metro’s legal counsel demanding it “set aside approval of phases 2 and 3 of the project

The Ordinance amends the 2010 California Building and Residential Codes, as adopted and amended by the City, and contained in Section 9-1-202 of Article 2 of Chapter 1 of Title 9 and Section 9-1-2A01 of Article 2 Chapter 1 of Title 9 of the Beverly Hills Municipal Code, as follows: • Extends the non-Class A wood roof replacement date to July 1, 2014 (from July 1, 2013) • Allows an option to apply a fire retardant spray by July 1, 2014 to non-Class A wood roofs in lieu of replacement of such roof • Requires a certified applicator to apply the fire retardant spray • Requires the replacement of non-Class A wood roofs upon the sale or transfer of the property for monetary consideration

City Of Beverly Hills Prepares To Take Over ESL Program From Beverly Hills School District By Laura Coleman The City is preparing to take over the final remnant of the Beverly Hills Unified School District’s Adult School, incoming Vice Mayor Lili Bosse confirmed to The Courier this week.

BHUSD currently spends $59,000 to continue its ESL program, Chief Administrative Officer Dawnalyn MurakawaLeopard said. That allocation will end this academic year, effectively dismantling the school district-funded English

language program that has served Beverly Hills and the surrounding community for the past six decades. “It is safe to say that we will be taking it over,” Bosse said. ”I have received many

Couple Jailed For Cashing In On Unemployment Benefit Scheme By Matt Lopez Believe it or not, it may just be possible to collect unemployment while sitting in a jail cell. A man and woman who cashed in on over $20,000 in unemployment benefits for a pair of incarcerated gang members were sentenced to state

prison on Tuesday. Juan Leonard Garcia, 48, of Pico Rivera and Sandra Muro Jaimez, 46, of Downey each pleaded guilty to making false unemployment insurance claims. Garcia and Jaimez submitted false unemployment insurance claims and cashed in (see ‘UNEMPLOYMENT’ page 27)

When Siblings’ Parenting Styles Collide; One Family, Two Religions Q: Dr. Fran, my brother’s parenting style is different than mine. We each think ours is the “best way.” This gets us into arguments at family celebrations and dinners. I don’t want my issues with my brother to start to impact the kids and their relationships with each other. What can I do? How should I handle it if my brother criticizes my parenting style? Penelope J. A: Dear Penelope, the reason sibling competition, jealousy and issues can get bigger in adulthood is because the feelings were not acknowledged or dealt with in childhood. Many parents unintentionally, or intentionally, create an arena of competition between siblings. They either think it can provide gasoline to fuel drive and ambition toward excellence, or one child excels in a particular area while the other excels in another. Either way, this leaves the children with feelings of never being good enough, disappointment, anger and sadness. Often, these feelings have no place to go but underground. The kids grow up and either figure out for themselves a better understanding of their family dynamics, or sit on my therapy couch for a year or two as adults. It is quite common for adult siblings to have different parenting styles. Below are my ”Top Tips For How To Handle Sibling Parenting

Styles.” • Recognize your own unfinished business (unresolved childhood issues). Accept that you are not a bad person for being human and having good and bad feelings. • Accept that each person’s birthright is to decide how to parent for themselves. No two people will parent the same way. • Build self-esteem by using words that support and motivate with empathy, rather than criticize. • If you intuitively sense that your sibling is not as open as you and will be defensive with any discussion about the issues, do not risk confrontation. Too many times I have seen working sibling relationships sour over failed attempts to discuss together. • Be kind and respectful in all of your communications with the other sibling(s). • Don’t get caught in powerstruggles or react defensively (explosive anger or denial). • Do not strive for perfection. Be “good enough.” • Absolutely, shield your kids from hearing or seeing fights between you and your siblings. • Equip yourself and your children with coping skills to deal with disappointments. We cannot protect or prevent life’s disappointments. The best we can do is equip ourselves and our children to deal with inevitable letdowns. • If your sibling criticizes your parenting style simply re

The UCLA Stroke Center was also an innovator with the establishment, in 2009, of its Telestroke Network Partner Program, which gives emergency departments at community hospitals across California the opportunity for direct, immediate, around-the-clock video consultations with UCLA stroke neurology experts. Within 15 minutes of being contacted, a neurologist can be interviewing and counseling a patient and family and performing a stroke-specific neurologic exam through a two-way video connection. The UCLA stroke specialist can view any local diagnostic images online as well. The commission’s certification shows that UCLA has achieved the highest standard of stroke care by ensuring that patients receive treatment according to nationally accepted standards and recommendations.

In an exclusive interview with The Courier, Mirisch spoke about his vision for the City as he takes over as Mayor. “It’s a time for us all to celebrate our own history and especially the people who made and make our Community so special,” Mirisch said of the centennial. “Local government is not a concept most people associate with ‘fun,’ but I am really hoping we have a lot of fun together as a community celebrating the Centennial.” While the significance of being Mayor during the Centennial is not lost on Mirisch, there will be plenty of serious work to roll up his sleeves and get done. Perhaps chief among those is the City's ballooning pension obligations, which are now at $106 million. “Employees need to contribute to their own pensions, which is currently not the case. In the early 2000’s our City – along with many other cities throughout the state – actually reduced retirement ages and increased pensions both prospectively and retroactively,” Mirisch told The Courier. “It was very short-sighted and we are now paying the price. We need to take action to correct the mistakes of the past and align pensions and salaries more closely with the private

sector.” For Mirisch, the financial particulars aren't all that need to be changed at City Hall. Mirisch seeks to reform the whole way of thinking, one that he has many times referred to as “treating the residents like an ATM machine.” Mirisch said City staff needs to focus on serving the residents. “Staff needs to focus on providing the best possible services for our residents and businesses, and on doing so in the most cost-effective way possible. We need to do more with less, and we need to focus on providing the absolute best value-for-money.” Mirisch said. Mirisch has publicly railed against the utility rate increases in the City, specifically a pair of 7 percent water rate increases voted approved last year. “I would like to try to get support from the new Council to reverse those increases. We should have never raised the rates to such an extent in the first place.” Mirisch told The Courier. Mirisch said that as Mayor, residents should expect him to continue defending the BHUSD against Metro’s push to tunnel under BHHS. Mirisch said the CGS’ findings of no fault under BHHS “simply shows the extreme lengths to which Metro went to rig the proceedings. As Metro Chair (Mike) Antonovich suggested, the entire process was like a

professional wrestling match, where you know the outcome even before the wrestlers step in the ring,” “Our Community supports the idea of mass transit, but, like everything, it needs to be done the right way,” Mirisch added. “I plan on introducing another resolution clarifying our position, and then I hope, together with the School Board, we can sit down with Metro and take another crack at getting them to listen and be more responsive.” Revitalizing the southeast is an issue close to Mirisch’s heart and says he hopes to develop the southeast into an “Arts and Theater district.” Mirisch said he understands “most residents want to keep two-hour free parking”, adding that the City needed to find a way to reduce its parking fund’s deficit. He also said the City should try to eliminate disabled placard abuse. On a lighter note, Mirisch, along with councilmember Lili Bosse, will continue the push for a dog park in Beverly Hills. “I’ve found that things sometimes move very slowly at City Hall.. I don’t know if the stars will align to open a dog park by the end of this year,” Mirisch said. “Hopefully, though, in the not-too-distant future; opening a dog park is something I’ve been hoping we could do since before I got elected four years ago”

ever made it to supermodel status, there actually was another model from India who blazed a trail down the catwalk during the late ‘70s. Her name is Kirat Young nee Kirat Bhinder, who, at 19 years of age, due to a chance meeting with Yves Saint Laurent in Paris, immediately became a fashion superstar. Little did she know, during that encounter, she was just the girl Mr. Saint Laurent was looking for to launch his Ballet Russes collection. The collection was revolutionary for the house of YSL and Kirat, known as his muse, was catapulted into the glamorous world of fashion and a jet set lifestyle. She soon became friends with Jerry Hall and Iman and she modeled well into the ‘80s for every top designer including Chanel, Valentino, and Oscar de la Renta.

Today, the ultra-chic Kirat has homes in Paris and England, and still maintains her jet-set lifestyle by visiting friends in some of the most exotic locations around the world. She also designs fine jewelry for her company which bears her name. “My business grew organically from a hobby,” she told us during her recent trip to Los Angeles. “I didn’t go to a traditional design school, I went to the school of YSL - he was a true genius and our working relationship lasted twelve years,” she continued.

The bold creations of Kirat Young feature natural pearls, exotic skins, and precious stones, which have attracted the discerning eyes of many well dressed socialites around the world. construction blocked. In response, the board decided to challenge the alleged “scientific evidence” with evidence of its own. District experts, led by noted engineer Tim Buresh, considered Metro’s data faulty and its research superficial at best. The only way to get a definitive answer was to dig trenches — very expensive but the “gold standard” in geologic investigations of this kind. Buresh was chief engineer for the multi-billion dollar Alameda Corridor Transportation Project, was an engineer on the Metro Red Line and former chief operating officer of the Los Angeles Unified School District. “We had no choice,” board member Lisa Korbatov told The Courier at the time. “We could not send kids to school unless we knew the campus was safe. There was no other choice. Metro told us there were faults under the high school. We had to find out.” The Board of Education then hired Leighton Consulting, Inc., to trench, core and evaluate. The trenching and coring showed no active faults underneath the Beverly High campus. Armed with this information, Beverly Hills Unified, joined by the City of Beverly Hills, asked Metro to delay a final decision so that it could consider the new data. Metro refused. The alleged

existence of these faults — the West Beverly Hills Lineament and the Santa Monica Fault — formed the sole scientific basis for Metro’s rejection of a Santa Monica Boulevard station and its selection of the corner of Constellation and Avenue of the Stars. This location requires tunneling underneath Beverly High for the Westside Subway Extension. In response, the Board of Education asked the CGS to review the trenching, coring, sampling and analysis. Now, the state of California confirms Beverly Hills Unified’s position of “no faults”: “The consultants [hired by the Beverly Hills Board of Education] performed a thorough fault investigation program at the subject site and it appears evidence of active faulting related to the west Beverly Hills Lineament or the Santa Monica Fault Zone was not encountered within the limits of this investigation . . . CGS has reviewed the interpretations and much of the original data provided by the consultants and finds that their conclusions are consistent with the available data.” CGS professionals visited BHHS and observed Leighton’s work. CGS also observed trenching north of the campus on the 10000 S. Santa Monica Blvd. property. CGS confirmed fractures and other features identified by Metro “are not related to active

faulting.” CGS reported, “[Leighton Consulting] conclude there are no active faults along [the campus]. This interpretation appears reasonable based on the data and explanations provided in the referenced reports and no additional information is requested.” Metro has used the alleged existence of these non-existent faults not only to justify the routing of the tunnels underneath the high school, but also to assert in its budgets that Metro would owe Beverly Hills Unified nearly nothing for taking the land underneath the high school for its campus. “This confirms our district’s belief that our campus is safe to build out and the MTA was patently wrong in their science and approach,” Board President Jake Manaster told The Courier. “I think any responsible governing body would have to pause and take this information into account.” “Having attended a lot of MTA meetings, there was a lot of discussion about letting the science prevail,” Manaster added. “It’s pretty clear that the option of Santa Monica that was summarily passed over... needs to be revisited.” Boardmember Brian Goldberg told The Courier he hopes “with this finally put to rest, and with new MTA leadership and a soon-to-be-elected new Mayor, we can get past personal attacks and misinformation and focus on the science.”

The members of the BHHS academic decathlon team also include: Annette Chang, Heidi Hart (who received a gold medal in history and a bronze in art), David Mnitsa (who won four medals), Hal Smith (who received a silver medal in math), Laurie Wang, Joye Yang, and Victor Lee, who won a special scholarship for having the highest combined math-science score in the nation. The team was coached by Dina Yoseph in the fall and Emily Smith in the spring. In all, 566 students representing 65 high school teams from across the state competed in this year’s California Academic Decathlon. Granada Hills Charter High School, national winner for the past two years, earned first place, and El Camino Real High School took second place, which means they will advance to the national competition to be held in Minnesota.

CONGRATULATIONS TO OUR SCHOOL BOARD AND TEAM Beverly Hills and its school district have been under attack for over two years from the Metropolitan Transit Authority for Metro’s Westside Subway Extension. To back its route under Beverly Hills High School, Metro concocted a charade–a superficial and professionally suspect “expert” report of the geology under Beverly High and adjacent. Surprise, surprise–that “report” said there were “active earthquake faults” which meant the “only” safe route was underneath Beverly High. Metro also claimed active faults under Beverly High would preclude remodeling, retaining or reconstructing the campus. To fight back, BHUSD retained top experts. This was not the “usual course” for a school district. School districts usually go for “cheap” because of worries about community gripes over cost. But you get what you pay for. Beverly Hills adopted the gold standard in experts and investigation. The district’s

experts concluded there are “no active faults” as alleged by Metro. That was not enough for Metro’s board, which steamrolled the decision without considering the school district’s data. Political contributions clearly outweighed science as Metro “pooh-poohed” the district’s findings. Now, the California Geological Survey–which is the top geological agency in California and dates to 1860 – has been heard from: the BHUSD’s team is correct, which means Metro is wrong. There are no active earthquake faults underneath Beverly High nor adjacent underneath Santa Monica Boulevard. There is neither “scientific” nor geological reason to tunnel under Beverly High. Congratulations to our Beverly Hills Unified Board of Education and its team of experts. You did it right. You paid the price to defend our only high school and you are winning – winning based on truth and science, not political payoffs.

THE PARADIGM SHIFT By Nancy Krasne Everything looks the same, but is it? Do you remember Haggerty’s, Bonwit Teller, I. Magnin, Blum’s, Robinson’s, Baskin-Robbins, Hamburger Hamlet, et. al? The one thing they have in common is… “they are all gone.” As Beverly Hills residents we have to ask ourselves… why? The big department stores came originally because our sales tax was lower than Los Angeles. It is once again and they happily provide free parking. Unfortunately, the paradigm shift has already occurred. People used to go to the stores, try things on, maybe think about the purchase, then buy them and go home. Now they look at the merchandise, check their iPhone ap to see where it is cheaper and buy it from home. That’s “brick and mortar” stores to “brick and click” purchases. No one will deny that Saks, Neiman’s and Bloomingdale’s all have enormous on line presences. But the final phase of the paradigm shift has come. We have now reached “click and ship.” I purchased an expensive car that way, because the wait time was too long at the Beverly Hills dealership. I never set foot in the other dealership and they just flat bedded the car to my door in 2000 and I handed them a check. We no longer need to leave the comfort of our home if we know what we want. We can go online, find it at the cheapest price, click and then have it shipped to our front door. In the face of this development, is there a way to keep our retail stores viable and attract new and exciting boutiques? What makes individuals leave their home, even if they don’t want to go anywhere? I think they have no choice when it is time to go to the doctor, dentist, the accountant, the specialist or attorney. When they want to go out to dinner, lunch and meet friends, they leave the house. Movies can be streamed on to our

flat screen TVs, all sports can be seen via the satellite or cable and we can watch in the comfort of our pajamas. We want our village to remain the unique variety of stores and boutiques that it is known for worldwide. Westwood Village is supported by UCLA and more than 150,000 people yet it has one empty store front after another. We have the opportunity to prevent this in Beverly Hills and remain an exceptional neighborhood which is a world class destination. The residents told us, but the City Council didn’t listen. First, we must keep two-hour free parking on all City lots. It is a loss leader that brings people back to our village. It gives them time to dine, go shopping and enjoy the stores and boutiques that exist nowhere else but here in Beverly Hills. The average time people eat and walk around is about 2 to 3-hours, (my estimation) then tire and go home. Nobody minds paying, if they get something for their money. The voters saw the problem and voted to make two-hour free parking a permanent fixture in the City, but City Hall became greedy and found a way around the voters. We can collect more from sales tax on big ticket items than we would ever achieve in charging $1 an hour….. Wake up, before we look like Westwood. Take a lesson from Century City, where now even on Friday nights there is ample parking since it started charging for parking in February. I encourage all of you to make your wishes known to the City Council, the Parking Commission and the City Manager Jeff Kolin.

Rabbi Jacob Pressman THE GOOD OLD DAYS At the ripe old age of 93 I believe I have earned the right to speak of them as “the good old days.” That they were old is a matter of fact. That they were good is a matter of opinion. It has to be tested against my own experience. In those good old days very few people had a telephone. We didn’t. Even the fortunate few who did had to share with some other stranger who was my party on the “party line.” This means that when I picked up the phone I might also hear someone’s voice – my party. If I was lucky my “party” was a pleasant person, and when I heard it I would either say “Excuse me” or else eavesdrop until he/she politely said: “ Get the hell off the phone.” If no one else was on my party line an operator would answer and I would give her the number to get for me. All this was succeeded by the single party line and the boon of the dial-up innovation. I had forgotten all this until the first time I visited what was to be the State of Israel. When I picked up the phone there a pleasant answer, “Shalom.” Once when I asked the operator for the number of a hotel for which we were reserved, she answered: “You won’t like that one. Let me put you in touch with a nicer one.” She did, and it was. The days of such familiarity are gone now and so is the personal touch. My computer calls your computer and we don’t get to hear a human voice. Oh for the good old days!

LETTERS TO THE EDITOR There were hundreds of cars wandering in and out of streets and alleys during the entire day last Sunday when we held the annual Los Angeles Marathon, which is only for the benefit of the runners and the person who holds the contract to operate it. The inconvenience that was caused by the race was also being felt by the citizens on the west side of the freeway...I know because because I was out there. The huge majority of Beverly Hills citizens is entitled to know why we are continuing to be subjected to this annual ridiculous race when no other city in the area is willing to be the host of this yearly event. I assume if we were offered thousands of dollars to allow it, we would say “never”...so why are we being annually inconvenienced by it now? Herbert Wallerstein ****** May I take this opportunity to thank The Courier and Lisa Korbatov for their tireless efforts on behalf of the students and residents of Beverly Hills regarding the struggle with the MTA. This week we received the news we have hoped for from the California Geological Survey, the definitive voice, on whether BHUSD has active faults under Beverly Hills High School. The answer is “no.” This is great news for the safety of our students and staffs and our plans to build out our campus with the Measure E Funds.

Publisher Clif Smith and the entire staff of The Courier staff have been instrumental in ensuring our community was getting the facts about this struggle. As a result he and The Courier have paid dearly. They have endured revenue cuts from advertisers and weathered personal attacks but always stood shoulder to shoulder with the Board of Education and our students and staff. Thank you. My colleague and friend Lisa Korbatov has been a tireless advocate on this issue and deserves special recognition and praise for her efforts. As her vice president I saw first hand the personal sacrifices and commitment of her time putting together a remarkable team of experts. She was personally attacked and belittled by supporters of the MTA but she stood tall. When the district did not have funds to pay for trips to Washington, DC or Chicago she paid out of pocket. As board president, I kept Lisa on as the point person for the district so I continued to have a front seat view into the depth of her passion and commitment for the safety of our students and staff, fulfilling her fiduciary role as a Board of Education member to protect the long term interests of our district. Thank you is not enough to express my appreciation and gratitude to The Courier and Lisa but it is a good start.
