Courier is an unbridled love of spending on the part of the superintendent, the Courier submitted a Public Records Act request in order to obtain a detailed view as to just how Bregy and his cabinet are spending public money when it comes to their expenses. The district’s response to that request, emailed to the Courier on March 15, stated in part that “the sheer volume of records sought by your request would be so great that it would constitute an unduly burdensome request under the ‘rule of reason’ implied in the Public Records Act.” In formulating a response, the Courier sought guidance (see ‘BREGY EXPENSES’ page 2)

These are among the litany of expenditures that Beverly Hills Unified School District Superintendent Michael Bregy is alleged to have made using public funds since taking the reins of the City’s public school system two years ago. Bregy’s initial three-year contract with the district gave him an annual salary of $265,000, plus a $7,200 annual car allowance, a $1,800 annual phone allowance and all health benefits. USC Hires Carol L. Folt As First Female President By Matt Lopez USC has hired a new president – the 12th in the history of the university – and the first woman to ever hold the position. Carol L. Folt, former chancellor at the University of North Carolina at Chapel Hill, was named president of USC on Wednesday by the Board of Trustees. Folt’s hiring comes on the heels of a college admissions cheating scandal that has rocked the university as it continues to face the fallout of sexual misconduct scandal against former campus physicians and trainers. “I'm taking this job exactly because of what I know,” Folt said. “I mean that with the fullness of my heart. I was called to ask to become the president of one of the greatest universities in the world and I believe so deeply in what it has done and what it can do. I am not afraid about taking on challenges.” Folt, who will begin her job on July 1, takes over for interim president Wanda Austin, who has been serving in the role since President Max Nikias’ departure last August in the wake of the sexual misconduct scandal.

This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA, Public Resources Code Sections 21000 et seq.), the State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et seq.), and the environmental regulations of the City. Upon review, the project appears to qualify for a Class 3 Categorical Exemption (New Construction or Conversion of Small Structures) in accordance with the requirements of Section 15303 of the state CEQA Guidelines. This exemption is applicable to a single-family residence in a residential zone as well as accessory (appurtenant) structures. Accordingly, the Planning Commission will consider a recommendation to find the project exempt from the environmental review requirements of CEQA pursuant to Section 15303 (New Construction or Conversion of Small Structures).

Second Beverly Hills Resident Named in College Admissions Scandal By Victoria Talbot Beverly Hills resident Robert Flaxman was one of 33 parents charged by Federal prosecutors in “Operation Varsity Blues,” along with resident Jane Buckingham, as reported in the Courier last week. The massive scandal has touched admissions at some of the country’s most elite universities, including Yale, Stanford, University of California at Los Angeles (UCLA) and the University of Southern California (USC).

The scandal is being called the largest college bribery scandal in history. At the center of the scam is William “Rick” Singer, 58, a Newport Beach resident who has been charged with racketeering conspiracy, money laundering conspiracy and obstruction of justice. He is the founder and owner of Edge College & Career Network LLC, known as “The Key,” a forprofit college counseling and preparation business Flaxman, founder/CEO of Crown Realty & Development,

was charged with conspiracy to commit mail fraud and honest services mail fraud by the Justice Department. According to court documents, in 2016, he is alleged to have paid $250,000 for his son’s recruitment by the University of San Diego as an athlete, though court documents do not name a sport. His son was allegedly supplied with an athletic resume that included volunteer work with a youth athletic team, according to documents. (see ‘ADMISSIONS SCANDAL’ page 27)

Man Arrested In Century City Mall Bomb Scare By Matt Lopez A Missouri man was charged Tuesday on allegations that he set fire inside the Amazon store at the Westfield Century City and pointed a gun at a store employee. The incident sparked a massive shutdown at the mall and several nearby buildings. Beverly Hills High School, just a few blocks east of the mall, instituted a temporary lockdown until the situation was cleared up.

Nicholas K. Oates was arrested Saturday in Venice and pleaded not guilty to six counts of arson, and individual counts of burglary and assault with a firearm. According to authorities, Oates went into the children’s section of the Amazon store on Friday and began setting books on fire. When confronted by an employee of the store, Oates brandished a handgun and ran out of the store. A burning package that

Beverly Hills City Hall Goes Red For Red Cross Month

By Matt Lopez Beverly Hills City Hall will be among four Los Angeles landmarks to be lit up in red next week in honor of American Red Cross Month. Cities, businesses and organizations all over the country are lighting their buildings red for a day next week to celebrate Red Cross Month. President Franklin D. Roosevelt first proclaimed Red Cross Month in 1943 to raise awareness of the organization and its

humanitarian mission. Beverly Hills City Hall will be lit red on March 27, beginning at 7 p.m. On that day, the Red Cross asks people to volunteer, donate blood, or learn lifesaving skills to help those in need. Other local landmarks lit red will be the LAX airport pylons and U.S. Bank Tower in downtown on March 27, and the Santa Monica Pier Ferris Wheel on March 26.

Joyce Anne Flint, Widow Of Israeli Air Force Co-Founder Mitchell Flint, Dies By Laura Coleman Joyce Anne Flint, widow to the late World War II hero and a founding father of the Israeli Air Force, Mitchell Flint, passed away Wednesday morning, March the 20th, at 83, after a yearlong battle with cancer. A descendent of the last Spanish governor of California, Pio Pico, Joyce was the definition of class and flourished in a variety of vocations. During the late MGM Golden Era of the mid-1950s, she excelled as a dress designer for Esther Williams and other MGM stars, having apprenticed under Helen Rose. After attending UCLA she transitioned to become a real estate broker and headed Flint Realty for nearly 50 years. She was also

Parent Pushes Back Against BHUSD Reaction To Student Incident By Laura Coleman Last year, before winter break for Beverly Hills Unified School District students, two six-year-old kindergarten boys were suspended for one week as a result of having viewed and touched the private area of a five-year-old girl in the school’s TK class. The principal’s response was swift and unequivocal, leaving no room for debate as to how the administrator felt such a matter should be handled. Short of expulsion, the punishment was among the most severe that the school district can dole out. The boys’ mothers were shocked with the response, one immediately reaching out to the Courier with the

expressed hope that the paper could shine a light on the incident. “They’re just kids,” the mother of one boy stated. “The behavior of the principal and the vice principal for me, it’s unacceptable.” The American Academy of Pediatrics (AAP) characterizes the touching or viewing of peer genitals, as well as exposing one’s own or touching oneself, as “normal, common behaviors” for children aged two through six years old. Asking to engage in specific sexual acts, however, is “uncommon” according to the APP. The school district has not (see ‘STUDENT INCIDENT’ page 15)

By Victoria Talbot A Community Profile prepared by the Department of Toxic Substances Control (DTSC) for the State of California and made available on its website Wednesday in preparation for a future work plan to remove the arsenic contamination in the soil on property known as Lots 12 and 13 contains gross inaccuracies and misinformation. The site is located at 9315 Civic Center Dr., comprising the two vacant lots at the eastern end of Santa Monica Boulevard. Because of the railroad use, arsenic contamination was found in concentrations well above the normal background for California soils, with a maximum concentration of 996 milligrams per kilogram, mostly detected in the shallow soil (five feet deep) but as deep as 45 feet below the surface in some locations. Because of the high concentration of contamination, the DTSC has jurisdiction over this site. No development or soil disturbances can take place without DTSC oversight. The Union Pacific Railroad has agreed to pay for the clean up. The information used to create the Community Profile, according to the document, is derived from “a variety of sources, including a Community Survey sent out May 23, 2017, for the El Rodeo School Project site located in close proximity to the Union Pacific RailroadBeverly Hills site, file reviews, internet searches, discussions with the DTSC

staff and demographic data.” The survey, which was intended to incorporate responses, “to help shape community outreach for this Site,” according to a cover letter,” was sent to the school furthest from the site, to families and homeowners least likely to be impacted. Questions on the survey probed how knowledgeable the respondents are about Lots 12 & 13, their level of interest, willingness to attend meetings regarding the site, concerns and willingness to speak to DTSC officials about the site. El Rodeo Elementary School, on the western most edge of the City, according to DTSC Project Manager Sara Vela, was also used in the surveys that took place in 2005 and 2014. However, the Beverly Hills School District has three elementary schools with families that are closer to the site and more likely to be impacted. These families, from Horace Mann, Hawthorne and Beverly Vista, were not surveyed. In the 2006 report it stated, “South of the site is predominantly commercial with some residential,” misinformation about the fact that directly south of the site are the City’s densest residential streets. In 2015, resident Lionel Ephraim discovered that the DTSC Community Profile created in 2014 described the site as a dirt lot without trees, bordered (see ‘DTSC PROFILE’ page 15)

Heather Tom and Jacqueline MacInnes Wood, both of The Bold and the Beautiful, were nominated for outstanding lead actress in a drama series, as were General Hospital’s Maura West and Laura Wright. Renowned jazz harpist-pianistvocalist Corky Hale will present a 102nd birthday show honoring Billie Holiday at 7:30 p.m., Thursday, April 6 at the Catalina Jazz Club, 6725 Sunset Blvd. in Hollywood. Hale is one of the few people still performing who was actually a close friend of Holiday's, playing for her on the Stars of Jazz TV show, and on several recordings and live appearances, and was the only female pianist to regularly accompany “Lady Day.” Special guests will include singers Freda Payne, Eloise Laws and Tricia Tahara, with Hale on piano and harp, Lyman Medeiros on bass and John Ciodini on guitar. Holiday, who was born on April 7, 1915 and died in 1959, was one of the most important and influential jazz legends of all time. CARRYING ON THE TRADITION—Catherine (Cate) Liesl Yusah, daughter of longtime Beverly Hills residents and actors Erin Carufel and Scott Yusah, was the 38th child and fifth generation in the Carufel family to wear the christening gown sewn by Erin’s great-grandmother Rosanna Carufel of St. Paul, Minn. in 1912. The gown has been worn by her six children, 12 grandchildren and nine great-grandchildren. Erin was the 28th child to wear the garment and Catherine wore it for her ceremony last month. Erin’s credits include such films as The Lincoln Lawyer (with Matthew McConaughey), Untraceable (with Diane Lane), and most recently, Peppermint (with Jennifer Garner). She also had a recurring role on Alan Ball’s HBO series Here And Now (shot in her hometown of Portland, Ore.) She is a former Miss Oregon American Coed, was the only female on USC’s PAC-8 ice hockey team and won two gold medals at the U.S. Open in Tae Kwon Do. Hammerstone Studios has announced that production is set to begin this summer on Bill & Ted Face The Music, with Keanu Reeves and Alex Winter reprising their roles as the eponymous duo. Temple Emanuel Accepting Offers On Building By Victoria Talbot “CBRE, Inc. is pleased to present a rare opportunity to purchase ±0.62 acres of land for the development of ±42 residential units (with Density Bonus) on Burton Way in Beverly Hills, California,” reads the ad on the CBRE website at www.cbredealflow.com. Temple Emanuel’s Youth Center building is for sale. Several sources have confirmed that the Temple is experiencing financial difficulties from declining membership and other issues. The property is currently underutilized and has not been a school for several years, according to sources. The building, located at 8844 Burton Way, was originally designed by Master Architect Sidney Eisenshtat and constructed as a school and youth center in the Late Modern style. The original temple is located one block south at 300 N. Clark Drive. On Nov. 19, 2018, Christine Lazzaretto of Historic Resources Group, submitted an application for a Director’s Determination of Ineligibility for Landmark Designation. The Director of Community Development, Susan Healy Keene, then reviews application materials to determine a property’s (in) eligibility within 30 days. It is not a public process, meaning it is not an agenda item for the Planning Commission or City Council the public can comment on, but the

documents are available to the public on the City’s website. The Historic Resources Group report determined that, “this structure does not represent an exceptional example of [Eisenshtat’s] work. The Youth Center building does not represent a remarkably superior example of architecture and it has not been recognized as such by the architectural community. The building does not represent an excellent or distinctive example of the Late Modern architectural style, particularly in comparison to Eisenshtat’s earlier work for the same client, or other commercial designs within Beverly Hills, and it does not possess exemplary design details.” The property met Section A criteria. It is over 45 years old, embodies distinctive characteristics of an architectural style or type, retains substantial integrity from its period of significance and it has continued historic value to the community, according to the report. However, it does not meet at least one criterion in Section B, according to the report, meaning it is not eligible for historic designation. It does not meet the following Section B requirements: it is not on the National Register of Historic Places; it is not an exceptional work by a Master Architect; it is not a work that was owned or occupied by a person of great importance nor connected to a momentous event in the person’s endeavors or

gala. This year, the Temple is honoring the history of the nation (which does not include births, deaths, social interaction and marriage); it is not an exceptional property owned and occupied by a person of great local prominence; it is not an iconic property and it has not been the subject of a landmark designation procedure expressly agreed upon by the owners. The property received a Certificate of Ineligibility for Historic Designation dated December 24, 2018, Christmas Eve, freeing a developer to demolish the building. The Board of Directors reads like a Who’s Who of Beverly Hills City politics. Former Mayor Barry Brucker is President, Health and Safety Commissioner Myra Lurie is Vice President. Co-VPs of Membership include Recreation and Parks Commissioner Judy Fenton, Jan Block, married to Planning Commissioner Alan Block, who was just conferred an extra year on the Planning Commission. Directors include Public Works Commissioner Jeff Wolf, Cultural Heritage Commissioner Noah Furie, former Recreation and Parks Commissioner and wife of Vice Mayor Lester Friedman Simone Friedman and Recreation and Parks Commissioner Julian Javor. Last year, Fenton and Alan Block were honored at the Temple’s annual

Planning Commissioner Andy Licht and his wife, and Commissioner/VP Myra Lurie. All of them received additional honors at City Hall from the City Council. Last year, Mayor Julian Gold invited Rabbi Jonathan Aaron and Cantor Lizzie Weiss to sing at his installation. On Tuesday, in City Council Closed Session, under the title “Emanuel Center,” the City Council considered “negotiations” of “price” and “terms of payment” for the property, according to the agenda. Agendas for the Closed Session are necessarily vague, so the exact nature of the discussion is unknown. Mayor John Mirisch characterized such discussions as generally informing the Council of properties that are for sale in the City that could be acquired for what he termed “Land Banking,” or the acquisition of more property that can be used as a public resource. The Brown Act prohibits discussion of a Closed Session agenda. Offered by Executive Vice President CBRE Laurie Lustig-Bower and Vice President CBRE Kadie Presley Wilson, the property is being advertised for redevelopment. U.S. Home Construction Rebounds In January Construction of new US homes jumped in January, reversing the declines seen in recent months, government data showed Friday. A flurry of activity in the South as well as in the normally frigid Northeast and Midwest sent construction of single-family homes up to its fastest pace in a decade for those regions, the Commerce Department reported. Meanwhile, new building permits, which are a sign of supply in the pipeline, showed a shift toward apartments and more weakening in the key single-family segment.

Total housing starts rose 18.6 percent to a seasonally adjusted 1.23 million units, overshooting economists' expectations. Construction started on single-family homes rose 25.1 percent to an annual rate of 926,000. Economists said December's sudden fall in construction was inspired by the rout on Wall Street, which decimated Americans' net worth. Stock prices have since recovered much of those losses. –– AFP

County Halts Use Of Popular Weed Killer On County Property The Los Angeles County Board of Supervisors on Tuesday directed all departments to stop using a popular weed killer until more is known about its potential health and environmental effects. Supervisor Kathryn Barger recommended the moratorium on glyphosate—a main ingredient in the herbicide brand Roundup. “I am asking county departments to stop the use of this herbicide until public health and environmental professionals can determine if it's safe for further use in L.A. County and explore alternative methods for vegetation management,” Barger said. Roundup was developed decades ago by Monsanto Co., now owned by Bayer, and is believed to be the most widely used herbicide worldwide. The motion, co-authored by Supervisor Sheila Kuehl, cites “a growing body of scientific study” of herbicide safety and the potential for negative impacts. “In a 2015 study led by 17 experts from 11 countries, the World Health Organization's International Agency for Research

on Cancer (WHO) concluded that glyphosate should be classified as “probably carcinogenic to humans,” Kuehl said. “That conclusion makes it imperative that we question any long- term use of this controversial herbicide, and that’s exactly what this motion calls for.” The WHO finding has been disputed by Monsanto, and other governmental agencies have stopped short of reaching the same conclusion. The federal Environmental Protection Agency says the weed killer has low toxicity for humans and concluded in 2017 that it is not likely to cause cancer in humans. California disagreed and tried unsuccessfully to force the company to label the weed killer with a warning. The Board of Supervisors directed the Department of Public Works to coordinate with public health and other personnel to survey current use of the chemical and explore alternatives, including identifying best practices followed by other jurisdictions. School Of Gymnastics Sets Open House For May 5, Spring & Summer Programs With Dance, Yoga, Crafts And More

T

he L.A. School of Gymnastics (LAGS)will open its doors, from 1-3 p.m. Sunday, May 5 for the school’s annual Summer Camp Open House. The free event will allow visitors to tour the facility, meet the safetycertified instructors, sample camp activities, win freebies and even meet and greet members of the USA National Team who will perform onsite. The 2019 Spring Camp program is now running though April 19. The 2019 12-week summer camp program, which will run from June 5Aug. 25, is the per fect answer for children’s need for structured activities during those long summer months. Participants can sign up for day sessions, 9 a.m.noon for half day and 9 a.m.-3 p.m. for full day, full weeks, extended hours for working families, 8 a.m.-6 p.m., or even take advantage of customized scheduling. The camps, organized in Kiddie Camp for children starting at 18 months, Day Camp and Teen Camp, with an 8-to-1 student-teacher ratio, are open for children of all skill levels and include daily gymnastics,

martial arts, crafts and a hot lunch available for purchase. At the summer camps, attendees have an optional swim day with a splash pool available for non-swimmers. A rhythmic gymnastics camp, for girls of all ages, led by guest trainers from the Russian national team, will be available for girls of all ages. “This is a unique opportunity to receive a highquality summer camp experience,” said Tanya Berenson, the school’s general manager. “At LASG we recognize we have a responsibility to continue to promote health and wellness to the community, especially the children,” explains Alla Svirsky, the school’s director. Instructors follow rigorous safely guidelines for training and are OSHA and infant CPR certified after extra-thorough background checks. As the largest gymnastics facility in California, campers can use three 3,000-foot spring tumbling floors, full-size trampolines, multiple beam bar stations, spotting belts and the foam filled pit to guarantee their endless energy can be

directed somewhere else other than the computer screen. Besides gymnastics, some of the camp activities include hip-hop with world-renowned dance instructors from UCLA, yoga, swimming and rock-climbing. “Nowadays children find enjoyment through tablets, cell phones and video games. Here at LASG we will redirect their enjoyment towards foam-filled pits and trampolines,” continues Berenson.

Amongst her proudest roles was being the wife and advocate for her late husband’s incredible role as one of the unsung heroes in the birth of Israel, having volunteered in 1948 to defend the infant nation state against certain extermination. Using his skills honed as a fighter pilot in the Pacific during WW2, Mitchell joined a band of volunteer airmen, both Jew and Gentile, from around the world, who united in the wake of the Holocaust to defend the Jewish people. In later years, Mitchell was recognized by both the U.S. and Israel for his heroic contributions to the 1948 conflict. A book on his exploits, Angels in the Sky by Robert Gandt, has become a best seller on Amazon and is in development to become a feature film. The Flints’ 58-year marriage, until Mitchell’s death in 2017, began like a Shakespeare play in Beverly Hills, while Joyce was on the balcony of her Clark Drive home. “He said, ‘Juliet, your Romeo would like to take you out,’” Joyce once told the Courier of her neighbor Bill Landis’ prelude to telling her the story of Mitchell who had arrived to take her out on their first date. “I almost fell over the balcony, his credentials were so fabulous. It was like instant love.” Joyce leaves behind numerous nieces and nephews, as well as her two sons, producer Michael Flint and his wife Cheri O’Laverty Flint, and son, Guy, an educator. She will be missed by all who knew her well.

by commercial activity. The report was withdrawn. A new report, according to the former project manager for the site, would have to be developed when a plan for development was presented. In the current report, the site is described as “a 5-acre, 2lot, vacant dirt plot of open space along a paved urbanized residential/commercial area, with Santa Monica Boulevard bordering the northern boundary of Beverly Hills.” The site actually runs through the middle of the City, which extends north and south from its location. It is not located at the northern boundary. It is in the middle of a residential area, with commercial space more than ¼ mile distant. In a section entitled “Surrounding Land Uses,” it says, “A park is located approximately ¼ mile north and west of the site beyond Santa Monica Boulevard. Residences are located north of the park. The site is in an area primarily

provided the Courier with any comparative data to better gauge the frequency of such behavior or previous associative consequences. In determining that the boys’ actions warranted suspension, the school’s assistant principal authored a report, which was dated Dec. 4, 2018, citing the violation of Education Code Sections 48900(k) and 48900(n). The first is the disruption of school activities and/or defiance of school authority; the second is for having committed or attempted to commit a sexual assault or sexual battery. As a result, for the rest of their pre-college years, both boys will now have the words “sexual battery” on their academic records. The report detailed that on three separate occasions, the boys asked to see the girl’s “private parts,” and that on at least one of those occasions, the girl pulled her pants down. All of those times the children were in a supervised environment, either by BHUSD employees or by employees with the City’s after-school Adventure Camp program. “[Redacted] and [redacted] asked if they could touch her genitals. Both boys reported that [redacted] said yes. Victim reported that she said no,” the report states. “According to [redacted], the boys put their hands down her pants, anyway.” Shortly after the boys were suspended, the school district’s communication’s director at the time assured the Courier that Superintendent Michael Bregy had confirmed that everything had been handled appropriately. According to the report, at some point in the process both Beverly Hills Police and the Department of Children and Family Services were contacted. The mother of one of the boy’s detailed how her son was subse-

comprised of residential land use, mixed-use commercial businesses, a car dealership and a café.” With residential immediately to the north of Santa Monica Boulevard and multifamily residential immediately to the south of the site, it is difficult to ascertain where the car dealership, café and mixed-use development are located. Surprisingly, the report states that the Beverly Hills Courier has had “little coverage about this particular parcel.” The Beverly Hills Weekly, it reports, has had a half-dozen articles “that reference this project and other area sites.” In fact, the Courier’s coverage on this site began in June, 2015, when “the Department of Toxic Substances Control (DTSC) invites you to review and comment on the draft Removal Action Workplan (RAW) for the Beverly Hills Lots 12 and 13 (Site) located at 9315 Civic Center Drive, Beverly Hills, California.” The RAW is a plan to remove the toxic soil to prepare the property for development, a

quently questioned by a forensic psychologist to see if he was being molested at home. Both of her daughters, also BHUSD students, were likewise questioned by social services. The boys’ families were soon informed that they were being expelled from the City’s after-school Adventure Program, where one of the three alleged incidents happened. At a loss to understand how she might advocate on her son’s behalf, one mother made an appointment to see Superintendent Bregy. They talked and immediately she felt that he fully empathized with her situation and that he was going to take measurable steps to remedy the situation; even working to remove the sexual predator type branding that was now tied into her son’s record. Similar to what both the principal and assistant principal had told the parents in attempting to minimize the stigma associated with sexual battery (attempted or committed), both mothers said that Bregy had likened it to the infraction of cell phone use going on their records. Still, after finishing her meeting with Bregy, one of the mothers believed he was completely on her side and would immediately help transfer her son to one of the other schools and help him re-enroll in the Adventure Camp program. Instead, she told the Courier, Bregy’s assurances of help came to nothing. The school’s treatment of the boys became even more disciplinary and Bregy eventually said that he would be unable to help get the boys back in Adventure Camp. Director of Community Services Nancy Hunt-Coffey, who was responsible for making and upholding the decision to expel the boys from Adventure Camp, told the Courier that she was unable to comment on any details due to the involvement of minors. Before the incident, and even up

The Courier covered that meeting, in which several residents expressed their opposition to the removal of trees on Lot 13 in order to perform the clean-up and opposition to the project. The Courier also broke the story when, on the weekend of Nov. 21-22, 2015, 196 trees were cut down during a Santa Ana wind event. City employees who spoke to residents who called to complain about the cutting down of the trees, were told that it was legal, it was on private property, there was a permit to cut down the trees and that it was safe, all of which was not true. The trees were on a strip of land that is a dedicated easement for the City of Beverly Hills, as well as on land belonging to the Beverly Hills Land Company and resident/developer Lyn Konheim. The winds and machinery kicked up dust potentially laden with arsenic, though no

Then suddenly, that changed. “If my son arrives one minute before 9:30 [a.m.], he‘s taken by a security guard to wait in the office. It’s heartbreaking. My six year old son is being treated like a monster,” she detailed. “As I walk my son to school, he is ashamed to be seen by the other kids. He feels like an outcast. He is developing feelings of shame and inferiority. My heart breaks every morning.” Once classes did begin, however, the boys were then escorted to class. Despite having since transferred to another BHUSD K-8 school, the mother who met with Bregy said the whole ordeal has so traumatized her son that she has decided to move out of the country back home to where she grew up, taking all three of her children who are now attending Beverly Hills schools. While this path may prove to be a blessing for her and her children, she still can’t shake the belief that this move was precipitated by a reaction on the part of the district that she believes was entirely too severe; and one which will have lifelong ramifications in her son’s life if she chooses to stay local. According to both boys’ mothers, there was nothing to suggest that the boys were emulating adult behavior or had been molested; nor was there any basis to believe that they were juvenile sexual predators. “Since when has the most natural curiosity in the world, turned out to be a sexual crime? He is six. He does not understand the severity of touching or allegedly touching a girl’s groin. He is pure naivety and curiosity,” one mother stated. “My son is a kindergarten boy, not a feral sexual offender.”

They did not have the permit to close down one lane on Santa Monica Boulevard. None of the workers were HAZWOPER (Hazardous Waste Operations and Emergency Response) certified. It is unclear if there are plans to develop the property. However, the Community Profile is intended “to describe the community… and assess potential community concerns about DTSC’s investigation of the environmental condition of the Site and the proposed clean up.” The document states, “DTSC will conduct a Community Meeting during the official Public Comment Period to present information contained in the Removal Action Workplan and receive Public Comment on the RAW and proposed cleanup activities.” Copies of the RAW will be at the Beverly Hills Public

Library and the DTSC office in Chatsworth. “There has always been a plan for a resubmittal of a remedy selection document. This is reflective of the remediation process. DTSC is encouraging all stakeholders to work together for a successful remedial process. The development or plan for development of the property is currently unbeknownst to me,” said Vela. “The stakeholders have an arrangement, which again, DTSC is not privy to, other than what is necessary for the remediation process. A RAW is a remedial selection document and a RAW was submitted prior by the previous owner. Again, we anticipate a remedial selection document submittal from the previous owners of the Site, Union Pacific Railroad, at some point in the near future. Beverly Hills ‘Last Cattle Ranch’s’ Earl Miller To Mark 80th Birthday Earl Miller, one of the founders of the Lang-Miller Ranch, Beverly Hills’ last cattle ranch, will celebrate his 80th birthday today with a Westernthemed celebration in Pacific Palisades. At its heyday, between 1977 and 1982, the ranch, a morethan-100-acre property sprawling around a canyon a few minutes north of The Beverly Hills Hotel south of Mulholland Drive, was home to horses, 125 head of Texas Longhorns, and ostriches, kudu, peacocks and more. Miller, who had retired as a CPA, and admits he “knew nothing about buying property and zoning,” partnered with Peter Lang on a handshake to buy the property that had once belonged to the Doheny family. “And for next five years it was a working ranch and I wore nothing but Western clothes,” he said. Miller and Lang started with six Longhorns on the property that was zoned for eight animals per acre. “Most cows are for meat or dairy and Longhorns are neither,” said Miller. “We spent a lot of time showing them at auctions and rodeos and winning awards,” said Miller, and they eventually acquired the 25-year-old bull, Mr. Marlboro, who became a sort of mascot for the ranch.

The animals became a local curiosity and while on his horse on Lake Drive one day, Miller ran into Katherine Hepburn admiring the livestock. “Marlon Brando liked to park his pick-up and watch the animals.” Unable to develop the property as a community of “ranchettes” because of permitting delays, Miller and Lang sold the land to the state, and it’s now part of the Santa Monica Mountains National Recreation Area with three popular hiking trails. Miller’s daughter Kelly and son Robert are Beverly Hills High School graduates, and two of his four grandchildren are current cheerleaders at the school. Lang is now the owner of the 400-acre Safari West in Sonoma County.

A quick glance around and it had clearly succeeded in alleviating what can be a painstakingly long event with smiles evident throughout the theater. When the show was over and Vincent and his father finally completed the Oath of Office, Mirisch spoke for about 25 minutes, touching on familiar themes such as Beverly Hills as Mayberry RFD, community and connection. But the theme turned somber in light of increasing incidents of anti-Semitism in the United States and throughout the world. Mirisch spoke eloquently of “tolerance” as a theme, of respecting individual differences, and segued into the threat from Sacramento politicians who are proposing hundreds of bills that would remove local control and reward developers with increased density and less oversight in what he terms Sacramento’s “density fetishism.” “They are attempting to use the housing affordability crisis

to eliminate single-family zoning,” said the new mayor. “It’s a war on communities in an effort to impose one-size-fits-all measures which would financially benefit developers who don’t like to play by the rules.” Mirisch passed out noisemakers to the audience, instructing spectators to participate by using them every time Mirisch pronounced the words “Sacramento politicians.” Throughout town, similar noisemakers, known as groggers, were used to celebrate Purim. A deafening cacophony of noise makers played along a dozen times throughout the speech. Mirisch closed with a short list of initiatives he is interested in continuing, including joining Mayor Julian Gold’s Strategic Planning Committee with the Southeast Task Force to create an arts and dining district in the southeast; creating a Municipal Autonomous Shuttle System, banning the sale of tobacco, expanding the Fine Arts Commission to create an Arts and Culture Commission and improving La Cienega Park. Sporting a microphone and a kazoo, Mirisch walked into the audience and alternated singing, the kazoo, and approaching audience members with the microphone, like a seasoned vaudeville performer. In an interview Thursday, the new mayor reiterated that he will not create a new initiative. His third term will focus on the existing projects he outlined in his installation speech. Chief among those will be his dedication to fighting Sacramento. “Sacramento is running amuck,” said Mirisch. “We want to decide for ourselves how our City should be run – not be controlled by special interests in the so-called San Francisco mafia. Let them do it in San Francisco. Sacramento is the problem. Community is the solution.” In keeping with his theme of Beverly Hills as Mayberry RFD, Mirisch’s first agenda item on the April 2 City Council Study Session will be the La Cienega Park and Community Center. “This is a priority,” he said. Mirisch first proposed the bridge across La Cienega when he took office in 2009, an idea that has blossomed in the pro-

posals brought forth for the redesign of the recreation complex. Mirisch wants to see it all, including all the current uses with the addition of a new community center, aquatics center, additional underground parking and basketball courts. One of his pet projects has been the permanent addition of the Baccarat Crystal chandeliers as part of the City’s winter holiday lighting celebration. Mirisch would like to make that one of the hometown festivals, “like Rockefeller Center,” that brings the community together around the chandeliers, which made worldwide press when they were used at the Centennial holiday celebration. Arts and Culture will include the completion of the theater at the Doheny Greystone Mansion, which Mirisch envisions as a space for the expanding role of arts and culture in the City. Mirisch was behind the Cultural Heritage Commission, which seeks to preserve the history of the built environment in the City. Now he is behind the expansion of the Fine Arts Commission to a wider role, the Arts and Culture Commission. Originally assigned to procure and manage public art, the commission would promote all

the arts. Close to his heart, Mirisch loves the sing-alongs. “This isn’t new. I did it before. I came to love it in Sweden. It’s a big tradition there. In Sweden, at the singalongs, everyone is having fun.” He proposes themed singalongs, such as “the Rat Pack,” or “Beverly Hills Songwriters.” Fun is a big part of Mirisch’s vision for the coming year. Though the City is going through growing pains as it continues to redefine itself as a community of residents, within the school district, around Metro, among developers and in the luxury market, the new Mayor wants to build community and connection. “Lili (Bosse) had Walk with the Mayor, Julian (Gold) had his Mayor’s Minute. I have singalongs,” he said. As if to offer additional special effects, the City Council Reorganization evening was marked by rainbows arched over the City as guests arrived at the Academy. A super moon, when the full moon is closest to the earth, greeted them upon departure, marking the first day of spring and the vernal equinox, the Iranian Nowruz celebration and the Jewish festival of Purim, signaling a new and auspicious beginning.

Roundup It was not the rain that marred the last weekend of the BNP Paribas Open at the Indian Wells Tennis Garden. The moisture was from the tears of disappointed tennis fans, who had been looking forward to seeing old champions replay old matches on their aces-filled journey to remain within the group of top-five tennis champions in the world. But it was not to be. Ranked No. 1 in the world, Novak Djokovic, was eliminated in a relatively early (for him) match. Then there was Rafal Nadel who withdrew for physical reasons, thereby defeating hopes for a semi-final match against fourth seed Roger Federer. But Federer wasn’t going anywhere; he was defeated in the semis. What to do? All the marquee layers were out of the match. That’s when it pays to have friends as Tournament Director Tommy Haas found out. Haas had an idea. He called on friends John McEnroe, Pete Sampras and Novak Djokovic to meet him on center court for a game of doubles. All that was missing was a chair umpire and comedian Jon Lovitz. It was as if a good fairy waived her wand over center court. McEnroe still had his touch at the net, and Sampras still showed why he had the best serve in the game. What did the tickets for their match cost? They were priceless.

LETTERS TO THE EDITOR A ban on gas-powered leaf blowers just became law in Washington, D.C. Once again, as with a smoking ban in restaurants, Beverly Hills led the way as our City Council passed an ordinance banning this type of leaf blower in 2011. Unfortunately, as best as I can tell, this ban has never been enforced. Gas-powered leaf blower use is ubiquitous in the City as anyone who is home during the day–retirees; parents of young children, and of course the children themselves; those working from home; and those at home because of illness– hear leaf blowers from morning until late afternoon, at one house or another on the block. Leaf blower noise travels far and penetrates windows and walls, and is impossible to ignore. as this noise disturbs phone conversations, sleep, rest, and concentration. What makes enforcement more feasible now than in 2011 is the availability of powerful battery-powered electric leaf blowers, which are much quieter and cleaner than two-stroke gasoline engines. I suggest a three-step program of education of homeowners and land care workers about the leaf blower ban, then warnings about gas-powered leaf blower use, and then enforcement of the ban with fines and perhaps confiscation of offending equipment with each phase lasting two to a maximum of six months. Nearby Santa Monica bans all leaf blowers,

Following his son’s admission, Flaxman received an invoice from Key Worldwide Foundation (KWF), an alleged non-profit organization that, according to court documents, was really used to launder bribes. A letter sent to Flaxman following the “donation” said that “no goods or services were exchanged” for the payment. Flaxman wired two payments of $125,000 each to KWF, which then paid tennis academy coach Martin Fox, also accused in the scheme, $100,000. Additionally, in 2016, Flaxman paid $75,000 for his daughter to receive “help” answering questions on the ACT test at a Houston Test Center, one of two testing sites Singer “controlled,” according to a cooperating witness described as a director of college preparation at a private prep school in Florida. Flaxman then wired an additional $75,000 to KWF. The cooperating witness flew to Houston to assist Flaxman’s daughter and another student in taking the exam, with an improvement from her previous score of 20 to 28 out of a possible 36. Flaxman is a real estate developer. His company developed projects in Arizona, including the Mountain Shadows Resort in Paradise Valley and the Montelucia resort in Scottsdale. The company has also been involved in the Wateridge Office Project in Culver City, the Stadium Crossing project in Anaheim, a project in Burbank in 1999 and the Venice Crossroads retail center located at Venice and

It was so well received so much that I believe singing during City Council meetings might increase the civility and decrease the rancor. I propose that all people addressing the City Council during its “audience comments” segment should be required to start their oratory by singing a lyric from the same song. In other developments, two Stanford students have filed a class-action lawsuit, suing the University of Southern California, Yale, the University of California at Los Angeles and other institutions. Erica Olsen and Kalea Woods claim to have been denied a fair opportunity to gain admission to their choice of elite university. They also claim that their degrees from Stanford University were devalued by criminal racketeering charges. Bay Area parent Jennifer Kay Toy has filed a lawsuit in San Francisco Superior Court asking for $500 billion from the parents who used Singer’s fraudulent services, allegedly blocking the way for her son Joshua, with a 4.2 GPA, to gain admission to some of the schools involved. According to the Los Angeles Times, multiple sources have reported that the federal prosecutors are pressuring some of the wealthy parents that have been charged in the scandal to make a deal with investigators. The Times reported Wednesday that prosecutors have offered a “short window to consider a deal or potentially face additional charges.” Prosecutors are interested in gaining more information on the scam. Investigators have stated that the investigation is ongoing. In Southern California, some prep schools have received subpoenas from prosecutors regarding students in the fraud case, though the schools are not targeted. USC announced this week that it has begun an investigation of the students involved in the fraud. The university has placed a hold on those

accounts, meaning that the students cannot register for classes or receive transcripts. The university has said that actions taken could include revoking admissions or expulsion. The two daughters of actress Lori Loughlin and fashion designer Mossimo Giannulli - social media influencer Olivia Dade and Isabella Giannulli - have reportedly withdrawn from USC after the actress and her husband were charged in the scam. Lori Loughlin has been fired from When Calls The Heart series on the Hallmark channel as a result of her alleged involvement and Hallmark announced last week that it has cut ties with the actress. Netflix announced it has dropped Loughlin from the fifth season of Full House. Loughlin allegedly paid Singer $500,000 in bribes to get their two daughters recruited on the USC rowing team, though neither had ever engaged in crew. Huffman, known for her role in the TV series Desperate Housewives, is married to actor William H. Macy (who has not been charged). She is accused of participating in a cheating scam to improve her daughter’s SAT scores. She is alleged to have bumped the score 400 points, afterwards deciding not to do so with her younger daughter. Loughlin has hired a team of lawyers from Latham & Watkins, including William Trach, Sean Berkowitz and Perry Viscounty. Huffman has hired Martin Murphy of Foley Hoag.
