By Laura Coleman Beverly Hills celebrated a new era in luxury last night with the start of the development of the Waldorf Astoria hotel at the corner of Wilshire and Santa Monica Boulevards. Designs unveiled at the Thursday’s exclusive party at the Beverly Hilton showed an elegant structure of curving white stone and intricate ornamentation that complements the iconic hotel Welton Becket designed for Conrad Hilton in 1953. “It’s going to be a beautiful, beautiful hotel...an island within the City of Beverly Hills,” said Beverly Hilton owner Beny Alagem, chairman, Alagem Capital Group. The nine-acre Waldorf Astoria is being developed through a partnership between a private investor group led by Alagem Capital Group and clients of Guggenheim Partners. Construction on the 12-story, 170-room 5Star hotel is slated to begin in summer with a 2017 opening. “This is a seminal moment in our growth,” said John T.A. Supreme Court May Reverse Hubbard Dismissal By Laura Coleman The California Supreme Court just granted review in the criminal case of former Beverly Hills Unified School District Superintendent Jeffrey Hubbard. The Court will decide whether the reversal of Hubbard’s criminal conviction of

misappropriating public funds was proper. The Supreme Court reviews only approximately 2 percent of criminal cases. Review by the Supreme Court Requires the consent of at least four of the seven California Supreme Court justices. Esteemed Community Icon Sooky Goldman Dies At 91 By John L. Seitz Sooky Goldman, a powerhouse community leader since moving to Beverly Hills in 1953, died last Sunday at age 91. The Philadelphia-native was born on Oct. 22, 1922 and attended high school there when she met her eventual husband of 72 years, Sam Goldman. On Long Sea Voyages With Young Children, Toilet Training Q. Dear Dr. Fran: We have 2-year-old twins and are planning a six-week Mediterranean Cruise this summer. Given this week’s close call incident where the sick baby was rescued from a crippled sailboat hundreds of miles at sea, do you think it is safe for us to go away for an extended period of time with our young toddlers? Leila H. A. Dear Leila: There are a few differences between your circumstances and that of the Kaufman family whose baby, Lyra, became ill with a high fever and a severe rash. They were alone on a small sailboat. You will likely be on a large cruise ship with a full staff equipped with a medic or nurse on board. There will be many other passengers, perhaps even a physician among the guests. Had this been a giant cruise ship with a medical doctor on board there would be no discussion or risk to the young 14-month-old baby, Lyra, and her 3-year-old sister. But, these children were too young to chance the unknowns of weeks to months alone crossing the Pacific Ocean. There are too many unanticipated possibilities of danger that could emerge even beyond rash and infection. Leila, I suggest you consult your pediatrician to see if your twins need any protective vaccinations, then go for it and enjoy your cruise! Q. Dear Dr. Fran: Why would a pottytrained child suddenly refuse to use the toilet? Was he trained too early?

Dr. Fran Walfish Answers Your Questions Might it be a physiological problem (e.g. constipation)? Rebecca M. A. Dear Rebecca: There are a few possible reasons why a potty-trained child may suddenly refuse to use the toilet. The first thing to rule out is the unlikely, but possible, chance that the child experienced a trauma such as sexual molestation or a major scare. This type of emotional shakeup can cause a regression. Of course, introducing potty training too early risks your child’s constriction and resistance. Many young children fear falling into the toilet. Many boys fear their penises will fall off and be lost down the toilet forever. The most common reason a pottytrained child suddenly refuses to use the toilet is that the child experienced “force,” or too much pressure, by his parents. The toddler phase of child development is critically important and rich with milestones the child must achieve. Mastering her own body functions (toilet training) is one of those primary milestones, along with self-feeding, putting oneself to sleep, self-soothing, speech and language development, frustration tolerance and delayed gratification. On some primitive level, the child

knows that he is master of his own body. If Mommy or Daddy presses too hard on toileting expectations you risk your child bearing down hard on the other side and creating an intense power-struggle. Often, that is what parents observe and label as “constipation.” It is really a case of your child “withholding”' bowels. What begins as a psychological issue can emerge into a physiological problem. Extended ongoing constipation can lead to days of withholding and trips to the pediatrician and child gastroenterologist who prescribe laxatives, stool softeners, and even invasive enemas. In the extreme exception, I have treated angry kids as old as 11 who were never fully toilet-trained. My best advice to moms who are dealing with this regression is to provide a two-prong position. First, be loving, supportive, and non-judgmental. Make it a “no big deal accident.” At the same time, you also want to provide some boundaries and motivate your child back into eliminating into the toilet. Do this by having your child participate in his own cleanup. Have him remove his soiled underwear, clean himself with wipes, even shower or bathe if there was leakage, and put on clean fresh underpants. Encourage and praise self-reliance. Let your child see that accidents and cleanups require much more work than sitting on the toilet.

after Sam completed service as a hydraulics instructor in the Army Air Corps during World War II, they moved to California and eventually settled in Beverly Hills, raising their children, all of whom attended the City’s schools. Sooky began her civic career in the Beverly Vista School PTA and Girl Scouts and eventually as Solicitations’ commissioner for the City. Her countless endeavors on behalf of charitable, educational and cultural organizations included helping found The Maple Counseling Center, Beverly Hills Theatre Guild, and PATH (People Assisting the Homeless). She served as chair of the Beverly Hills Diamond Jubilee Committee and the City’s committee for the United States BiCentennial Celebration in 1976, and as a delegate to the Democratic National Convention. One of her prime achievements was the preservation of Franklin Canyon and its 605 acres, shepherding it to become a part of the National Park system. She began this campaign in 1980 to prevent it from becoming a housing development, soliciting the aid of then-L.A. Mayor Tom Bradley, Rep. Howard Berman, the LADWP, Santa Monica Mountains Conservancy and the U. S. Department of the Interior. Today, it is an educational resource, enjoyed annually by more than 10,000 school children throughout L.A. County and the general public. It is also the home of the apply named Sooky Goldman Nature Center. Besides her husband, she is survived by her son David Goldman (Myra Lurie), daughter Kaye Goldman Clarke (Steve Johnson); and her seven grandchildren: Cary Clarke (Meri Dunn), and Max, Zack, Seth, Jessie, Eli and Jonah Goldman. Her son Joel Goldman predeceased her in 2002. B E V E R LY H I L L S R E A L E S TAT E Cultural Heritage Committee Sends Three Properties to City Council for Landmarking By Victoria Talbot The Beverly Hills Cultural Heritage Commission has nominated four properties for possible landmark status including Water Treatment Plant No. 1, the Helms Estate, 707 Walden Dr, and the Beverly Garden Apartments. Particularly fitting is the nomination of Water Treatment

Plant as the City celebrates the Centennial Independence Day April 24 with the historic importance of water to the City of Beverly Hills. The building, repurposed as the Academy of Motion Picture Arts and Sciences Fairbanks Center for Motion Picture Study, was once considered for demolition when the City of Beverly Hills

ceased to operate the plant in 1976. April 24 marks 100 years since the City of Beverly Hills incorporated, staving off the city of Los Angeles annexation attempts with its new water supply from the Owens River Valley. Annexation was defeated by a vote of 507 to 337 and the City purchased the Beverly Hills Utilities Corporation, paving the way for the its expansion. However, the City needed to purify its overly sulfurous water supply. Building began in 1927 on the Spanish Colonial Revival scheme created by Salisbury, Bradshaw and Taylor consulting engineers' traditional hacienda layout. Each portion of the Waterworks facility, including the tower, central unit, filter unit, aeration unit, and clarification and sediment tanks, corresponded to parts of a hacienda compound (chapel, owners' quarters, service buildings and workers' housing). The high tower is a disguised chimney used to burn off the sulfur in the water at a height great enough to keep the foulsmelling substance from offending the residents. The

Helms Estate at 135 Copely Dr. is an immaculate Spanish Revival by Master Architect Gordon Kaufmann. Owned by Paul H. Helms, baking industry executive and philanthropist, the property also features a landscape by Edward HuntsmanTrout. The Beverly Garden Apartments on Olympic Boulevard near South Canon Drive is a 1930 Spanish Colonial Revival courtyard apartment building. Courtyard housing was popular in the era in Los Angeles, and is a significant housing type associated with the region. The shared courtyard provides pedestrian access to the bunga-

The building is unusual for its height, shape, mass and composition in relationship to its setting and the features that are publicly visible that define the Spanish Colonial Revival style. The residence at 707 Walden Dr. is being considered for inclusion at the request of the owners. The property is a Spanish Revival Residence by Master Architect Rene Riverre in 1930. The property review will be expedited and may be considered in as little as a month at a special meeting of the Cultural Heritage Commission.

What Does This All Mean? The Courier spoke with Beverly Hills’ Chief Financial Officer Don Rhodes, who in the following quotes attempts to provide clear definitions of what the above columns mean. Rhodes was hired as CFO last March and pledged transparency with the City’s financial reporting. Some columns, like overtime, are obvious. However, a majority of the columns are methods of payment that many private sector employees may have never heard of.

Retro PERS/Retro Non-PERS: “Retro pay happens when after an employee group contract ends, sometimes it takes a while to come to terms on a new contract. Once that new contract is in place, if it was agreed to pay any increase retroactive to the last contract end date, that generates the retro pay.”

Cafeteria Plan: An employee health benefits plan that allows an employee to chose from a variety of benefit plans. “You really have to combine Cafeteria Plan and Health/Dental/Vision to get the total cost of (health care) benefit the City provides. The City provides a certain dollar amount for employees to buy health, dental and vision. If they don’t spend it all, or pick less expensive plans, they are entitled to the remainder of those Cafeteria Plan dollars back in cash, in their pay. So the Cafeteria Plan column is what they don’t spend, but get back in the form of additional wages.”

PERS Overtime vs. Overtime: “Some types of overtime, mostly public safety, fall under PERS rules. How that all came to be, I don’t know. I don’t know what the genesis of that is, that’s why we separate out what is PERSable with what isn’t, so you can clearly see what pay the retirement formula is being applied to. Say a firefighter works overtime on an actual holiday, that is subject to PERS. Regular overtime is not.”

Pay for Performance: “It’s a program for our management, professional and executive folks based on performance, goals and objectives that are set up at the beginning of the year. They are evaluated at the end of the year and depending on how well they met those goals and objectives, they would qualify for some amount of pay for performance, which can be all the way from 1 percent to 10 percent of a total pool of dollars. It’s the closest thing we have in the government sector to performance plans and that sort of thing.”

Management doesn’t get overtime pay, so it’s typically used for those employees in recognition of the fact that they don’t get overtime pay. It basically says ‘we’ll give you a certain number of hours per year that you can use administratively.’ It can be used much like vacation time, or can be used for whatever personal leave they have.”

The only way they add cost is if someone doesn’t use all their leave at the end of the year, so they want to cash it out. SCOPE OF THE WORK - The work to be done shall consist of furnishing all the required labor, materials, equipment, parts, implements and supplies necessary for, or appurtenant to, the construction and completion of the project indicated above in accordance with Standard Drawings and the Specifications prepared for this project.

PREVAILING WAGES - In accordance with the provisions of Section 1770 et seq., of the Labor Code, the Director of the Industrial Relations of the State of California has determined the general prevailing rate of wages applicable to the work to be done. The Contractor will be required to pay to all workers employed on the project sums not less than the sums set forth in the documents entitled "General Prevailing Wage Determination made by the Director of Industrial Relations pursuant to California Labor Code Part 7, Chapter 1, Article 2, Sections 1770, 1773, 1773.1".

In general terms, the contract work for this project shall consist of the following items of work:

A copy of said documents is on file and may be inspected in the office of the City Engineer, located at 345 Foothill Rd., Beverly Hills, California 90210. Attention is directed to the provisions of Sections 1777.5 and 1777.6 of the Labor Code concerning the employment of apprentices by the Contractor or any subcontractor under him. The Contractor and any subcontractor under him shall comply with the requirements of said sections in the employment of apprentices. Information relative to apprenticeship standards and administration of the apprenticeship program may be obtained from the Director of Industrial Relations, San Francisco, California, or from the Division of Apprenticeship Standards and its branch offices. PAYROLL RECORDS - The Contractor's attention is directed to Section 1776 of the Labor Code, relating to accurate payroll records, which imposes responsibility upon the Contractor for the maintenance, certification, and availability for inspection of such records for all persons employed by the Contractor or by the Subcontractors in connection with the project. The Contractor shall agree through the Contract to comply with this section and the remaining provisions of the Labor Code.

There is no charge or deposit required for this material; therefore, they are not to be returned to the City for refund. References in the project specifications to specific sections of the Standard Specifications refer to the book of "Standard Specifications for Public Works Construction", 2012 Edition, written by a Joint Cooperative Committee of the Southern California Chapter of the American Public Works Association and Southern California District of the Associated General Contractors of California. AMENDMENTS - The second paragraph of Section 3-2.2.1 “Contract Unit Prices”, of the Standard Specifications for Public Works Construction is deleted. The fourth paragraph of Section 3-2.2.1 “Contract Unit Prices”, of the Standard Specifications for Public Works Construction is deleted and replaced by the following: “Should any Contract item be deleted in its entirety, no payment will be made to Contractor for that Bid Item.” The following is in addition to the provisions of Section 2-9.1 of the Greenbook: The Contractor is required to locate and tie out survey monuments in the project area prior to construction involving street and highways, and to file with the County Surveyor a Corner Record of any such work. Prior to the issuance of a completion certificate, the Contractor is required to file a Corner Record for survey monumentation that is replaced. All such survey work shall be performed under the supervision of a California lincensed Land Surveyor or a Civil Engineer authorized to perform such work. The Contractor shall provide the City a copy of the office calculations and documents submitted to the County for filing in connection with the aformention work. The payment for surveying, related professional services, office calculation, and furnishing all labor, materials, equipment, tools and incidentals, and for doing work involved shall be considered as included in the various items of work, and no additional compensation will be allowed therefore. Section 3-3.2.2 shall be changed as follows: (a) Labor. The costs of labor will be the actual cost for wages of workers performing the extra work at the time the extra work is done, plus the employer payments of payroll taxes, health and welfare, pension, vacation, apprenticeship funds, and other direct costs, resulting from Federal, State, or local laws, as well as assessments or benefits required by collective bargaining agreements. The following will revise Section 3-3.2.3 of the Greenbook: (a) Work by Contractor. An allowance for overhead and profit shall be added to the Contractor’s cost as determined under 3-3.2.2 and shall constitute the full and complete markup for all overhead and profit on extra work performed by the Contractor. The Contractor shall be compensated for the actual increase in the Contractor’s bond premium caused by the extra work. INSURANCE AND BOND REQUIREMENTS - The Contractor shall provide insurance in accordance with Section 3-13 of the City of Beverly Hills, Public Works Department, Standard Contractual Requirements, included as part of these Specifications. All subcontractors listed shall attach copies of the Certificate of Insurance naming the Contractor as the additional insured as part of their insurance policy coverage. In addition, the Contractor shall guarantee all work against defective workmanship and materials furnished by the Contractor for a period of one (1) year from the date the work was completed in accordance with Section 2-11 of the Standard Contractual Requirements. The Contractor’s sureties for the “Performance Bond” shall be liable for any work that the Contractor fails to replace within a specified time. CONTRACTORS LICENSE - At the time of the Bid Deadline and at all times during performance of the Work, including full completion of all corrective work during the Correction Period, the Contractor must possess a California contractor’s license or licenses, current and active, of the classification required for the Work, in accordance with the provisions of Chapter 9, Division 3, Section 7000 et seq. of the Business and Professions Code. In compliance with Public Contract Code Section 3300, the City has determined that the Bidder must possess the following license(s): “A” or “C32” The successful Bidder will not receive a Contract award if the successful Bidder is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active. If the City discovers after the Contract’s award that the Contractor is unlicensed, does not have all of the required licenses, or one or more of the licenses are not current and active, the City may cancel the award, reject the Bid, declare the Bid Bond as forfeited, keep the Bid Bond’s proceeds, and exercise any one or more of the remedies in the Contract Documents. SUBCONTRACTORS’ LICENSES AND LISTING - At the time of the Bid Deadline and at all times during performance of the Work, each listed Subcontractor must possess a current and active California contractor’s license appropriate for the portion of the Work listed for such Subcontractor and shall hold all specialty certifications required for such Work. When the Bidder submits its Bid to the City, the Bidder must list each Subcontractor whom the Bidder must disclose under Public Contract Code Section 4104 (Subcontractor Listing Law), and the Bidder must provide all of the Subcontractor information that Section 4104 requires (name, address, and portion of the Work). In addition, the City requires that the Bidder list each Subcontractor’s license number and the dollar value of each Subcontractor’s labor or services. SUBSTITUTION OF SECURITIES - Pursuant to California Public Contract Code Section 22300, substitution of securities for withheld funds is permitted in accordance therewith. GENERAL INSTRUCTIONS - Bids must be submitted on the Proposal Form prepared for this project and shall be delivered at the office of the City Clerk within a sealed envelope and marked on the outside as follows: "PROPOSAL FOR CITYWIDE PAVEMENT AND CURB MARKINGS.” Each Bid shall be accompanied by a cashier’s check or certified check drawn on a solvent bank, payable to “City of Beverly Hills,” for an amount equal to ten percent (10%) of the total maximum amount of the Bid. In the temperate zone, we welcome springtime with many expressions of joy. Christians celebrate Easter and Jewish people celebrate Passover. In both cases, the religious overtones of the season reflect the sense of fresh beginnings. Here in sunny California, The Courier is proud to be a Education Partner we are blessed with a kind of everlasting springtime. It is a rare year in which we feel June gloom. It gives us both a blessing of perpetual springtime but also deprives us of the sharp demarcations that winter brings elsewhere in this land. All this makes a problem for the providers of goods and services. In other climates, people have to get fresh wardrobes because of the change of season. Here, however, we can get along with sameold, same-old and nobody will notice the difference. For many of us, the only thing that reminds us of springtime is that we have to fill our taxes! I still try to believe the human clock ticking within us informs Power is an actual thing. “Power” of a nation includes its financial strength, the size and us that a sweet pattern in the weather is now upon us. I still rememcapability of its armed forces, its technological prowess, and the dedication of its citizens. ber from my high school glee-class how much I enjoyed singing: When one nation has “power,” nations with less power tend to defer to those with power. “Welcome sweet springtime. Sing then, ye birds, O sing!” Ever since the departure of Ronald Reagan as president, this nation has failed to sustain its power. Whether the president was named Bush, Clinton or Obama, increasing our power has hardly been a priority. George H.W. Bush, who won the first Gulf War, stopped production of cruise missiles part way through concluding that we didn’t need them. He reduced Reagan’s military – especially his Navy – to save money. Bush The First then turned around and gave that money away in wealth transfers and growing government. Bill Clinton actually did a lot better. In the first place, Clinton faced no serious military threat as the power of the Soviet Union collapsed under the weight of Reagan’s buildup. China was not yet a player on the international scene, although it was hard at work preparing. Al Qaeda was hardly known outside counterterrorism circles. Then George W. Bush came to power just as the airplanes crashed into the World Trade Center and the Pentagon. Bush’s reaction is hard to be faulted. He faced down Al Qaeda and the Taliban right away. He had a buddy of sorts in Vladimir Putin. But then, as the financial troubles broke, Bush the Second continued to grow government even as Democrats whined about the “Bush Tax Cuts.” Well, at least Bush the Second “cut taxes.” What a tax cut really means is that the people who earn the money can keep more of it. This is different from a “tax increase,” which simply means that government takes more to give it away to people who do not produce. The net result, as we’ve seen under President Barack Obama, is that so much has been sucked Cartoon for The Courier by Janet Salter out of our economy by government that the private sector has too little to work with. That’s why we have over half the people on some sort of government assistance. As was reported this week, the United States has more people today on government assistance than the entire population of Great Britain. That is the legacy of President Obama. He has truly delivered “fundamental change” to this country. We are borrowed to the hilt. No one lends us money anymore. Instead, we just print it. Food prices are skyrocketing. Farmers cannot get water to grow crops or feed livestock. Our Navy has shrunk to pre-World War II levels and the same cuts are planned for the Army. Russia and China see this. Russia occupies the territory of another nation and is poised to invade that country and seize about half of it. Catherine the Great and Josef Stalin would be proud. China now claims massive tracts of offshore waters that have been international for centuries. When our Secretary of Defense, Chuck Hagel, this week called them on it in Beijing, they essentially told him to jump in those waters. The Chinese defense minister said, bluntly and clearly, the Chinese hegemony is non-negotiable. The New York Times reports that Japan, the Philippines, Vietnam and others are directly threatened as China for the first time in four centuries is building a deep water navy to match and take out ours. This is the legacy of Obama appeasement and weakness. It will get worse. In the meantime, government “wealth transfer payments,” meaning giveaways to those who will not work and produce, continue to increase. If the Republicans even try to slow this down, they are denounced in the mainstream media and academia as hurting the poor. Now we see those of college age borrowing a trillion dollars they can never repay just to survive. Everything is proving Margaret Thatcher correct: “Socialism fails because sooner or later you run out of other people’s money.” This week, we saw a minor stock market collapse. The “smart money” people are all saying we’re on the verge of a financial collapse worse than 2008. Let’s hope not. What is not open for discussion is that government confiscation of the product of private labor and capital is growing. What makes this tragic is the near or actual majority of Americans who don’t seem to mind. Freedom and liberty we are told by our Founding Fathers, actual fathers and grandfathers, that those who fail to defend their liberty will lose it. This should be a sobering thought for all of us as we watch militarists, dictators and totalitarian regimes grasp for territories, peoples and property.
