Mirisch’s Sunshine Task Force Holds First Meeting, Discusses Open Government Initiatives By Matt Lopez Mayor John Mirisch’s Sunshine Task Force finally saw the light of day Tuesday and used its first meeting to discuss various ways to create a more open, transparent government in Beverly Hills. Mirisch met at City Hall with Vice Mayor Lili Bosse and committee members Ed Brown, Chuck Aronberg, Thomas

White, Gerald Lunn, Stella Sarraf, Mark Eliot, Marilyn Gallup and Fred Fenster. On the docket for the task force during its initial meeting was how City government communicates with residents, in terms of engaging the community in issues and initiatives of concern to them. The task force also discussed best practices to en-

Beverly Vista’s ‘Surfs Up’ Spring Fair Raises $40,000+ By Laura Coleman Beverly Vista caught the fundraising wave this weekend with Sunday’s “Surf’s Up” Spring Fair, which banked more than $40,000 for the Beverly Hills middle school, fair co-chair Amie Deutsch confirmed to The Courier. But it wasn’t just the sunshine, the rides, games, food trucks, silent auction and community sponsorships that more than doubled the amount this year’s fair netted

over last year’s, it was the tireless efforts of the Deutsch, Cynthia Chang Park and Joann Green Winn who made this year a real success, according to PTA Council co-president Jennifer Terrell Schwartz. “They took the concept of what the BV fair to a whole new level,” she said. Beverly Hills Relay For Life Cancer Fundraiser Set For Saturday At El Rodeo School By Matt Lopez For one of Saturday’s Beverly Hills Relay for Life volunteers, the event is very, very personal. Since her 2008 diagnosis of breast cancer, Kathy Waller has dedicated her live to giving back and helping others affected, either directly or indirectly, by cancer. Waller will serve as the

Survivor Chair for the event, Saturday at El Rodeo School at 9 a.m., which aims to raise money and awareness to fight cancer. Waller is coordinator a “Survivor Breakfast” early in the morning for cancer survivors attending. When Waller learned of her cancer, her twin sister Karla was immediately at her side. The two formed an organiza-

tion called “Link of Support” that, essentially, helps provide support and guidance to others struggling with cancer. It’s a tricky question to answer, given that the nation’s fundamentals don’t support a longterm recovery. On top of that, the government is backing the vast majority of mortgages, still offered at historically low interest rates, which further gives the appearance that the U.S. is manufacturing an unsustainable longterm recovery. During a panel discussion entitled, “Housing: An Asset Class or a Place to Live?” on Tuesday, real estate entrepreneur Jeff Greene, who made a fortune by shorting sub-prime loans when he recognized the housing bubble in 2006, said unequivocably that the recovery was not real and in fact, America seemed to be forming yet another housing bubble. “We shouldn’t be so short-sighted,” he cautioned would-be buyers. “This is a government-subsidized recovery.” But even if the fundamentals needed to sustain a true recovery fold, nascent trends indicate that foreign buyers are increasingly looking to the U.S. as a place to invest. According to FivePoint Communi-

ties CEO Emile Haddad, who credited affordability, job creation and confidence with fueling the housing recovery, 80 percent of new homebuyers in Orange County are from Asia. Beverly Hills realtors support this trend, increasingly acknowledging that the number of foreign homebuyers is rising steadily. It’s an odd recovery, surmised panel moderator Rick Newman, chief business correspondent with U.S. News & World Report. He proffered the following trends: sales of new and existing homes have bottomed out and are rising, but the home ownership rate is down; mortgage rates are still close to historic lows, but the federal government is backing virtually all housing mortgages; affordability is “terrific;” and average homes home sale prices are up 9 percent over 2012. JHL Capital Group founder James Litinsky stated his conviction that the housing recovery was indeed real, but cautioned that those looking to capitalize on the rising prices for homes could find it to be a surprising investment when the tides change. “This single family rental business could very quickly turn to very low returns and you have to rely on very high housing appreciation,” he said.

Many Reasons To See Danish Delight Love Is All You Need; Few Good Reasons For Iron Man 3 Once you get past the overly exaggerated and naïve title, you will thoroughly enjoy the Danish made–Love Is All You Need. Written by Anders Thomas Jensen, directed by co-author Susanne Bier, and starring Pierce Brosnan and Trine Dyrholm, this is an enchanting and humorous story with strong performances all around, especially Dyrholm’s, which is, to put it simply—brilliant. She stars as Ida, a simple Danish hairdresser not in the best of health, who is married to a cheating husband and whose daughter is getting married. En-route to her daughter’s wedding in Italy, she literally bumps into Philip (Brosnan), a high powered business executive living in Denmark, in the airport’s parking structure. As fate would have it, Ida’s daughter is the woman who will be marrying Philip’s son. Okay, a coincidence, but not that far fetched, so go with it. They meet for the first time and those of you who are film savvy will try to predict the ending. You might be right or wrong in your assessment. Either way, you will not be disappointed as the journey, from the opening to the end credits, is an extremely pleasurable 110 minutes. You will laugh, perhaps cry and relate to the uncertainties of life and the adversities involved in moving on. It is not a perfect film. Judicious editing would have made it shorter and tighter and thus, even more enjoyable. However, Ida, who appears matronly at first, grows into a beautiful and most en-

And, how great is that? 3-1/2 bagels and lots of smear ****** There are a few good reasons to see Iron Man 3—the first one being that all the kids will be going and you'll finally have something to relate with them with at the dinner table. Secondly, the special effects are loud and creative. Third, humor is bountiful especially the witty comments from Robert Downey Jr. during his repartee with Army officer Don Cheadle. The fourth reason being the menacing “evil” mandarin, Ben Kingsley who turns into a Chassidic rabbi sans yarmulka halfway through the feature. Last, but not least, you can feast on the presence of Gwyneth Paltrow, People magazine’s “world's most beautiful woman”...although, I found co-star Rebecca Hall to be much more wholesome and alluring. 2 bagels out of 4

Beverly Hills Electric Fountain By Robbie Anderson Special To The Courier “Beverly Hills’ Stunning New Electric Fountain” was the headline appearing along with a picture of the new fountain on the cover of Los Angeles Saturday Night, which had a circulation of 12,000 in June 1931. The Beverly Hills Chamber of Commerce had also placed pieces in numerous newspapers and magazines including Modern Screen with a circulation of 2,000,000. After the fountain was turned on June 12, 1931 there was a big fight between those who felt slighted by all the press being given the new electric fountain–“with its everchanging spray with lights of various colors that seem to change from one combination to another so the appearance seems to never be twice the same”–at the intersection of Wilshire and Santa Monica Boulevards, had made those on the eastern boundaries of Beverly Hills feel less than adequate. Instead of saying “Do you live north or south of the tracks?” (referring to the trolley line which ran along Santa Monica), the new boundaries’ lines shifted to “Do you live east or west of Beverly Drive?” It was a matter of record that a petition had been circulated by those “Easterners” to install a similar colorful fountain at Doheny Drive and Santa Monica instead the existing one which was far less colorful.

As Beverly Hills approaches the 2014 celebration of the Centennial since its 1914 incorporation as a City, this is the first in an ongoing series of articles by historian Robbie Anderson which originally appeared in The Courier in the summer of 2005. These articles will run on a frequent basis.

The bronze plaque behind the Wilshire-Santa Monica fountain reads: “THIS GROUND WAS PURCHASED BY THE PROPERTY OWNERS OF BEVERLY HILLS NORTH OF SANTA MONICA BOULEVARD WHO HAVE DONATED IT TO THE CITY, ALL UNDER THE SPONSORSHIP OF THE BEVERLY HILLS RESIDENTIAL PROTECTIVE ASSOCIATION” whose directors’ and officers’ names appear on the plaque along with the architects and sculptor. The easterners’ statement was: “While the present fountain is attractive enough in itself, it does not offer the novel color effects and therefore stops less traffic than at ‘the point.’ Extra police officers had to be placed at “the point” during peak evening hours to move along the thousands of motorists whom had come to view the fountain. The contention was they had contributed to the bond issue and thus were entitled to the as much as the “west-enders.” There was a bond issue, but it was for the purchase of the land from the Rodeo Land & Water Company and beautification of this 2-mile strip of land. The fact was that the electric fountain, which cost $22,000, was paid for by the Harold Lloyd family and The Beverly Hills Women’s Club. The fountain was designed by architect Ralph Flewelling who was also responsible for the designs of the new Beverly Hills Post Office and Hawthorne School plus many

homes and commercial buildings in the City. Supervising the construction was Park Superintendent George Chapman who tried to appease the proponents of the Doheny Park in some small way by moving six small palms from around the electric fountain at the point and transplanting them around the Santa Monica and D o h e n y Fountain (at minimal expense). The City would also buy and plant six large Cocos Plumosa palms (which were guaranteed to be in good growing condition for a period of one year) that cost $480. This did little to appease the “easterners,” but did not inspire them to raise the money to build their own. The figure at the top of the structure is symbolic of an Indian rain prayer and the frieze around the base depicts the history of

Pot Linked To More, Worse Testicular Cancer— Again, Confirming Two Previous Reports USC Norris Cancer Center announced the results of its most recent study on the strong connection between recreational marijuana use and the most severe form of testicular cancer in young men. The American Cancer Society published the results in a peer-reviewed article in its regular journal, Cancer. The article cautions: “the findings suggest that the potential cancer-causing effects of marijuana on testicular cells should be considered not only in personal decisions regarding recreational drug use, but also when marijuana and its derivatives are used to therapeutic purposes in young male patients.” The study focused on men ages 18 –45

who self-reported their recreational drug use. The investigation found that men with a history of using marijuana were twice as likely to have the more severe subtypes of testicular cancer called “non-seminoma” and mixed germ cell tumors. These tumors usually occur in younger men and carry a somewhat worse prognosis than the seminoma subtype. The USC report’s findings confirm those from two previous reports in Cancer on a potential link between marijuana use and testicular cancer. The principal researcher was Victoria Cortessis, MSPH, Ph.D., assistant professor of preventative medicine at USC’s Keck School of Medicine.

Koba reported Tuesday that an antibiotic-resistant strain of gonorrhea—now considered a superbug—has some analysts saying that the bacteria’s effects could match those of AIDS. “This might be a lot worse than AIDS in the short run because the bacteria is more aggressive and will affect more people quickly,” said Alan Christianson, a doctor of naturopathic medicine. Even though nearly 30 million people have died from AIDS-related causes worldwide, Christianson believes the immediate effect of the gonorrhea strain is more direct.

know how teenagers only want to be with their friends.” This is a particularly hurtful statement because it triggers unnecessary separation anxiety in grandma. Enjoy today...why worry about tomorrow. • “Do you go to all their basketball games?...they may not always want a big cheering section.” Many grandparents reap pleasure from watching their grandchildren compete in sports. It’s mean to imply the kids may not always want grandma there. It’s also none of their bee’s wax. • “Mother’s Day is coming...they better honor you as you deserve.” This may be insensitive because it implies you give to your kids and grandkids with an expectation of something in return. Also, many young families mark Mother’s Day by making mommy feel special and honored. Grandmothers often take a backseat to mothers. “It’s no surprise that we’re focused on Africa,” Milken said to an audience of over 1,000 people Wednesday, noting that six of the world’s 10-fasted growing economies are in Africa. “This is an area of significant opportunity, not just for Africans, but for investors around the world.” Since 1998, the Milken Institute has been convening panels that focus on global issues such as finance, politics, health, the environment and media, to name a few, with the intention of advancing international understanding – a cornerstone to economic prosperity. Fueled in part by the positive strokes of an economic recovery and the recognition of just how much cash is waiting on the sidelines to invest, myriad panels at this year’s conference addressed everything from immigration reform to energy consumption to education – all with the underlying premise: How do we make the future a better place for our children? The story of Africa and its 54 sovereign countries is increasingly acknowledged to be the final large-scale global frontier in which there is money to be made, from an investment perspective, and a citizenry to be helped, from a social perspective. Gates highlighted that indeed, philanthropy and financial investment go hand-in-hand. Panelist Rhonda Zygocki, executive VP of policy and planning for Chevron, underscored that employee issues, such as the AIDS epidemic, by necessity become employer issues. “If we are going to serve the world’s demand for energy, we just can’t invest in resource development, we have to invest in capacity-building in the producing countries themselves,” she said. Zygocki said that due to Chevron’s direct involvement, over the past nine years in Angola and 12 years in Nigeria, there was not a single reported case of a Chevron employee transmitting the AIDS virus from mother to child. According to Milken, advances in health and wellness in Africa have primed the nation for greater opportunities for economic growth. “There is real opportunity for private sector investors today,” said Blair, who founded the Africa Governance Initiative, which advises governments on improving services and fighting poverty. Panelist Republic of Rwanda President H.E. Paul Kagame, whose country issued its first international bond last month, said that Rwanda’s history, notably the acute residual trauma from the internal atrocities carried out in the 1994 genocide, puts tremendous pressure on the East African state to deliver. “This is the part of the narrative of Africa we want you to hear; Africa is open for business,” he said.

Open only a few weeks, Raw already has regulars like the family that’s eaten there eight times. Chef Pisan also has a following that now comes to Raw for his appetizers and warm bites, raw dishes and salads, rolls, nigiri and sashimi. pring bridal fashion week wrapped up last week and the name Jenny Packham seems to be on the lips of every fashionable bride-to-be. The Londonbased Packham has been designing bridal and eveningwear for more than 25 years and was voted Best British Bridal Designer in both 2011 and 2012. She’s also known for dressing some of the most glamorous red carpet girls such as Angelina Jolie, Catherine Zeta-Jones, and Beyonce, and also counts the Duchess of Cambridge and Adele among her biggest fans. Jenny came to the American market a little more than three years ago and has rapidly earned a reputation for consistently designing a simply stunning bridal collection that exudes modest sensuality.

true test on City salary, pension and benefit reform. In 2009, the City Council converted retiree medical benefits for Beverly Hills Executive Employees from a defined benefit plan to a defined contribution plan. That reduced the amount of retiree benefits for executives, while benefiting the City in terms of cutting unfunded liabilities. The City does not pay lifetime retiree medical for firefighters after age 65, but for all firefighters aside from the fire chief and deputy fire chief, those payments are picked up by the Beverly Hills Firefighters Association. Fire chief and deputy fire chief are executive employees and thus, are not a part of the union’s bargaining group and ineligible for lifetime retiree medical contribution from the

City past age 65. Now, City staff is recommending footing the bill for the executives and reverting back to the pre-2009 policy, paying lifetime retiree medical for the two positions, an idea that Mirisch is turning the proverbial water hose on. Before Batallion Chief Ralph Mundell accepted a promotion to deputy fire chief in December, he admits did not look at the executive compensation plan before submitting his application and misread a portion of the plan regarding retirement payments after 65. He said he assumed Deputy Chief received lifetime coverage, as all other firefighters do. Mundell and the City are seeking a way to change the current policy and revert back to allowing the chief and deputy chief to receive lifetime retiree medical, which City Manager Jeff Kolin told The Courier would cost the City

$10,000 per year for the life of each retired employee. “I happen to be the poster child on this one, which is not my favorite place to be,” Mundell told The Courier. “The issue is that if the City doesn’t match what you can get as a Fire Association member, there isn’t much incentive to want to move up through the ranks.” Mirisch’s issue with the proposal stems from the uncertain financial situation it puts the City in. Mirisch’s hypothetical example was that Mundell is promoted, then retires after one year. The City is still on the hook for $10,000 each year for the rest he and his spouse’s lives. Additionally, a new firefighter would be promoted to fill that spot and would also be eligible for the $10,000 per year in retirement pay. When Fire Chief Tim Scranton retires, the same will be true for his replacement. Over time, such a scenario could cost the City hundreds of thousands of dollars. Mirisch said that rather than having the City throw money at the situation, he

would like to see the Firefighters Association get involved to pick up some of the cost, which would allow Mundell, or another employee, the ability to keep the coverage they currently have. “We suggested that we’d like to promote from within, but we need your help. Help us shoulder some of the burden,” Mirisch told The Courier. “The Firefighters Association has point blank refused to be a part of the solution.” Mirisch said the other option is to simply hire from outside the City for those key hires. “Someone who comes from outside would not have the expectation of getting whatever the current benefit is,” Mirisch said. “For certain people, nothing is too expensive and it’s just not fair to put the taxpayers on the hook for this.” Kolin confirmed to The Courier that the City asked the union to help with the costs, but that request was denied. Union head Dennis Andrews said it would not be in the best interest of the union to “take on the additional costs.” “Frankly, we were hoping

Andrews told The Courier he thinks it is only fair for the City to pick up the costs, because Beverly Hills police officers holding similar executive positions are eligible for lifetime benefits. “You lose administrative time, medical retirement, it gets to the point where there is less incentive for folks to move in and take those spots.” he said. Mundell said he didn’t believe the union should have to pick up those costs. “It’s not a good way to run a paramilitary organization,” Mundell said. “From an organizational perspective, it kind of grey's the boundaries.” Mirisch said he believes a major underlying issue for the firefighters is the loss of overtime pay they would receive once they move to executive positions, which are not eligible for overtime. Kolin told The Courier a batallion chief’s total overtime pay averages out to about $100,000 per year. That number is higher than the median household income for residents living in the 90211 zip code. “If this is all based on the fact that they might not get as much overtime, that indicates a systemic problem.” Mirisch said. Mirisch said the cost would be easier to swallow if the City were given a guarantee from Mundell, or other employees to come after him, that they wouldn’t just retire after one year in the executive post, an idea Mundell doesn’t seem keen on. “I’ve been an employee for 27 years, but I don’t know what the future holds, so it’s difficult for me to predict that.” Mundell said. The item was to come up at Tuesday’s formal City Council meeting, but because the City failed to produce a state-required actuarial report, it will be pushed back to a later meeting.

Frances Allen Desert Roundup If a photograph is a snapshot of a moment in time, then the collected work of internationally famed photographer Michael Childers (pictured below) presents a visual history of celebrity spanning the past halfcentury. But, for one night of the year, Childers’ talents as a producer presents the Desert with a true gift – an ensemble performance by a cast of Broadway and Hollywood stars, each performing one song for “One Night Only.” Childers began his philanthropic work throughout the southwest more than a decade ago, and since 2008 has sold out the 1,100-seat McCallum Theatre each year with his signature production benefiting Jewish Family Service of the Desert, a local non-sectarian, non-profit which provides counseling and social services to anyone in need, regardless of age, income, ethnicity or lifestyle. This year’s “One Night Only” cast, consisting of 28 individual celebrity performers and the Palm Desert High School Choir, featured the music that surrounded the excitement and love of Childers’ life, and contained a film narrated by him interspersed among the on-stage performances. Each year, in addition to the ultimate treat of attending the performance, there is a cast party for the entertainers and major event underwriters. This year’s party was at the Rancho Mirage estate of Helene Galen, underwriter and honorary co-chair. Who loves you? If you say Puff or Misty without a last name, most likely you are referring to a four legged creature. Romancing The Dog: The Struggle To Make A Pound Dog Happy In Beverly Hills is Marion Zola's love story. She and Sam, her husband, were married five years when they decided they both wanted a dog. Sam was inclined towards a poodle with a pedigree while Marion had her eyes and heart on those homeless dogs at Perfect Pet Rescue. With arguments that mutts have better health, she convinced Sam to look at Chips, who turned out to be a Tibetan terrier. (Beginning with Ted Goldstein's cover photo, one can't help but fall in love with this precious pooch.) For Marion, a noted TV/screen writer, it was love at first sight but for Sam it took a lot of neighborhood walking and discovering that pretty girls stop to look and talk to your dog. Chips had to learn his parents did not appreciate his chewing on the drapes even if he had separation anxiety. So what did Chips do when they left him alone, they installed video cameras. Enter the dog trainers, the dog whisperers, and Marion takes Chips everywhere she goes including studios and agents' offices. Alas, unlike Paris, local restaurants do not welcome dogs unless

you don’t mind sitting outside in the rain and cold. (Marion did tell me that in Carmel, the natives are much friendlier to dogs and that Chips has been written up in the local paper.) Life must go on for a couple with a dog and the vital requirement is a relative–in this case Sam’s sisterBerta–who will dogsit. Though he is photogenic and might actually have a future in commercials, despite having to respond to a trainer of the set, Chips is so homesick for Marion that any idea of a career and lucrative employment is out the window. Did anyone say “castration”? Somehow “neutered” is less offensive, so Chips is on the surgical table when they are told he has a rotten tooth, so end to end he is royally treated. However, one time when having his teeth cleaned, a new person accidentally but permanently damages his neck and back and he is forced to undergo an MRI with anesthesia. He develops a cancer and is now relegated to a child's stroller when going for a walk. Marion said that a dog in pain won’t eat, and so her question to the doctor was “how long does Chips have.” When told: “You will know.” She and Sam knew it was time to call Dr. Kelly to the house and bid farewell to their beloved Chips. Rabbi Jacob Pressman A FINE LINE Already in the fifth grade, I became aware there were boys and girls and that sometimes the fine line between them was blurred by nature. A fellow classmate showed feminine tendencies that were subjected to considerable teasing, being called “fairy,” “homo,” “butch,” etc. But its seriousness did not strike me until the end of my first year in college. A friend returned from a trip overseas, reporting he had married a girl in Paris and was awaiting her coming. One day, while walking across the high bridge over the railroad tracks near the University, he suddenly broke for the rail and started to climb over. I really had to struggle to pull him back, after which he lay on the sidewalk and wept. He said: “There is no bride, and there never will be. I’m a homosexual.” I had one girlfriend who was a high school class “girl athlete,” but with whom I maintained a pleasant puppy love relationship. I used to urge her: “Why don’t you give up wearing gym bloomers all the time and get a nice dress and let the world see how very feminine you are.” She tried, but it didn’t work out for her, and the last I heard she had been fired from her post high school job for “masculine tendencies.” I worked out for myself a kind of scale in life that ranges from Neanderthal masculinity to girly-girly femininity, with many stops in between. I’ve become a strong advocate for understanding the fine line in the realm of sexuality and how each of us is positioned by nature somewhere along that line. Through the years this helped me in my rabbinical counseling to give comfort and understanding to individuals that came to my study to pour out their hearts, who found themselves by nature a little closer to the center of that fine line.

The new City Council majority now enters budgeting. This is where the campaign pledges and differences will be proven or discarded as empty rhetoric. Last year, both current Mayor John Mirisch and Vice Mayor Lili Bosse voted against the staffproposed City budget. They objected to programs, certain hires and certain compensation. Of course, they were outvoted by the pro-staff majority 3-2. Now, with returning councilmember and former mayor Nancy Krasne on board, these three need to study the current budget with a magnifying glass and a skeptical eye. We trust they will. What is in this budget? What will staff present? Are there any reforms evidenced there? Is any restraint on pay, pensions and staffing present? We doubt it. Given the fact that there has been no change in the City bureaucracy, it is highly unlikely that any significant reforms will be presented by that very same bureaucracy. Wallerstein Before any new budget is approved, we ask the council majority to satisfy themselves that every staff position is necessary, not just “wanted.” We ask that the new budget incorporate serious pay and pension reforms. We call for the elimination of the “9/80”rule under which City staffers who work 80 hours in nine days get the 10th day off. (Staff calls this the “every other Monday or Friday off” rule). Why should residents and businesses find City Hall short-staffed two out of five business days? It is so easy just to spend an extra 30 minutes in the morning and hang around an extra 30 minutes in the evening to get a day off every other week. Private sector employees spend as much or more time, but without additional pay or time off. If the work demands the time, do the work. You are seriously, seriously well-paid. We call upon the council to take a look at private sector pay and benefits. That information is gathered every year by the California Employers’ Group (formerly the Merchants & Manufacturers Association). It is a well-respected non-profit around since 1896. The organization publishes extensive data on all private sector jobs in California. Its reports cost about $800. We ask the council to get the raw data themselves and not—at this time—hire some consultant who can “cook the books” on reports. We remain highly skeptical of most “consultants” because we just don’t know what they look at. We certainly hope that comparisons with other cities will be avoided—all city bureaucrats are in on “the scam.” We also know that practically every independent organization examining private vs. government pay concludes government pays about double the private sector, yet it is always the private sector that is called upon to pay more taxes. We commend Mayor John Mirisch for investigating recent staff demands for pay hikes and arrangements that violate California state requirements. (More on this later.) Without Mirisch asking some tough questions of City Manager Jeff Kolin and City Attorney Larry Wiener this week, those violations would have happened. Mirisch is on the job . . . and we’re sure Bosse and Krasne are also. (We do not expect either councilmember Willie Brien or Julian Gold to challenge or Cartoon forThe Courier by Janet Salter question anything presented by the City staff, if past performance holds true.) Lastly, we hope the new responsible council majority will reverse the trend to add to Beverly Hills’ unfunded pension liabilities. Those jumped an astonishing $23 million last year.
