The proposed Ordinance would amend the City of Beverly Hills development standards for single family properties located in the Central Area of the City. The amendments would (1) allow additions to the rear portion of homes with legally non-conforming rear setbacks provided that a minimum setback distance from the rear property is provided and a maximum coverage of the rear yard area was not exceeded; additions greater than fourteen feet (14’) in height would be permissible through issuance of a Central R1 Permit, subject to the required findings, (2) allow walls, fences, and hedges over three feet in height and located in the front yard setback area to be reviewed pursuant to the City’s Design Review Program which as set forth in Article 44 of Chapter 3 of Title 10 of the City of Beverly Hills Municipal Code when the home has architectural elements that project into the required front yard setback area, and (3) modify the development standards existing homes on corner lots located south of Santa Monica Boulevard must meet in order to extend the home in to the rear yard of the property subject to a Central R1 Permit and specific findings. This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. It can be seen with certainty that there is no possibility that the adoption and implementation of the Ordinance may have a significant effect on the environment. The Ordinance does not authorize construction and, in fact, imposes greater restriction on certain development in order to protect the public health, safety and general welfare. This Ordinance is therefore exempt from the environmental review requirements of CEQA pursuant to Section 15061(b) (3) of Title 14 of the California Code of Regulations. Temple Emanuel To Be Local Hub Of Big Sunday Community Service Program Temple Emanuel, 8844 Burton Way, will be the official Beverly Hills hub of Big Sunday (May 6). The mission of Big Sunday is “to build community through community service.” Begun in 1999 as a single Sunday, the weekend-long event now brings in more than 50,000 volunteers. This year, projects in the synagogue-hosted community service event include creating baby bundles for the Exceptional Children’s Foundation, a blood drive for Presbyterian Intercommunity Hospital, a book drive for Bookends, a clothing drive for the

residents of Ruby May Staine and Amity Foundations, creating care packages for Alexandria House, decorating flower pots for The Watermark & Carmel Assisted Living Facilities, making sandwiches for the Midnight Mission and making cards for Israeli soldiers. Temple Emanuel is also collecting new necessities for infants and babies, new travel -sized toiletries, new packages of white tube socks and gently used clothing of all sizes. Big Sunday will be from 9 to 11 a.m. at Temple Emanuel and all are welcome to take part. Actress Patricia Medina Dies At 92 Actress Patricia Medina, leading lady in 1950s movies, died last Saturday at age 92, according to her friend Meredith Silverbach. The British-born beauty began her career in England and married actor Richard Greene, whom she divorced in 1951 after coming to Hollywood. She appeared in a number of films opposite such names as Alan Ladd, Glenn Ford, Fernando Lamas, Louis Hayward and Karl Malden. In a 1960 ceremony at the Beverly Hills home of David O. Selznick and Jennifer Jones, she wed famed actor Joseph Cotton. The couple went on to co-star in Broadway plays until his death in 1994. Medina, who lived on the Wilshire Corridor, wrote an autobiography called Laid Back In Hollywood.

Flames are hot and frightening. ‘We must get out of here. Now!’ we shout, and beg Lilly to grab any reachable possessions before the fire roars through. We rescue her beautiful Persian cats, Jesse and Delilah. She leaps to unlock the cage holding her two pet parrots, and they fly – miraculously – to a girlfriend’s house in Point Dume.

Steve Kessler told the board the school had been formulating ideas to make sure the tower had an educational use. Kessler said one idea he had was to use the tower as a weather station. All four also agreed to eliminate a proposed marquee from the front of the school. Manaster noted at last Tuesday’s session that it could be a safety hazard for people driving by and said Wednesday that the size of the proposed marquee violated the City’s municipal code. Hall declined to give his thoughts on the design, stating his desire to see the designs given to the City’s Architectural Commission, which could give the board its thoughts before it proceeds with direction. Hall’s colleagues said they weren’t in favor of getting the city involved and Chief Facilities Officer Nelson Cayabyab said such a move could add months to the project.

tivists opposed to what they believe is “underhanded” behavior on the part of UCLA to sell the 1.5-acre Kyoto-style garden bequeathed to the University in 1964 by former UC Regent and UCLA alum Edward Carter. Just months after Hannah Carter died in April 2009 at 94, 13 years after her husband of 33 years died, the University began the process to overturn the First Amendment to the Agreement, dated June 17, 1982, that set forth the Regents legal obligation to maintain the Garden in perpetuity. The amendment also set forth seven specific endowments to be funded as “Carter Endowments” upon the eventual sale of the residence, including the priority $500,000 endowment to maintain the Garden. In an email dated Jan. 18, 2006, Sam Marabito, UCLA’s vice chancellor of Business & Administrative Services, wrote Assistant Provost John Sandbrook that because Mrs. Carter had a “special interest in the Gardens...it would seem that asking her to work with us on changing the amendment does not seem likely.” Sandbrook responded that same date: “Even if the university wanted to pursue a new amendment to reverse the 1982 amendment that required UC to maintain the Garden in perpetuity (such a reversal would pre-

sumably be sought on the grounds that the Gardens have no academic use for us any longer for horticultural research), I suspect that we would run into quite a buzz-saw with respect to the local Bel-Air Homeowners Association community (and UCLA volunteers) who have enjoyed the Garden as a local university “treasure” (and admittedly, have no appreciation for cost). I can just imagine the media coverage.” Three years later, the same month Hannah Carter died, a “Report of the Revenue Task Force” on April 24, 2009 chaired by UCLA’s Vice Chancellor Steven Olsen affirmed that significant research had been done to remove the restriction to sell the Garden. In July 2010, UCLA petitioned the Court “to authorize the sale of real property, in deviation from an agreement with the donor who funded the purchase.” According to UCLA spokesperson Phil Hampton, in addition to the Garden not having served an educational purpose since 1993, onerous maintenance costs ($110,000 annually) and lack of parking were the keystone factors to the university’s determination to sell the property. Using a letter written by Dean of Life Sciences Fred Eiserling in June 1993 to Vice Chancellor Alan Charles, UCLA partially based its argument to sell the gardens on Eiserling’s assertion that it did not serve a

BEVERLY HILLS research purpose and would be better suited for another use within the University. In 1965, the University’s Alumni magazine stated “the gardens will be used for instruction, conferences, and activities of many UCLA departments and University-related groups, especially architecture, art, botany, and theater arts.” According to Eiserling, who served as dean of Life Sciences from 1987 to 2004, the intent of his letter was not to pave the way for the university to sell the property. “I was never part of the planning operation,” he said. “I wanted to divest the Life Sciences of that garden...From our standpoint it had no educational value.” The Zen-like retreat that once provided free access for peaceful contemplation is located one mile from the campus - roughly a 20-minute walk. According to Hannah Carter’s son, Jim Caldwell, solutions exist to preserve the garden including using a portion of the interest from the estimated $9 million sale of the residence to pay both for maintenance costs and the use of a shuttle. The university currently provides complimentary shuttle service between UCLA and the Williams Andrews Clark Memorial Library 13 miles east of the campus on Fridays during the academic year. UCLA plans to publicly open all sealed bids on May 23.

Early renderings of the mural, done by artist Alix Soubiran, include characters from classic children’s novels like Red Riding Hood, Sleeping Beauty, The Three Bears and Puss N’ Boots. The mural will be painted in the “Enchanted Woods” room of the library. The Bosse’s previously donated to what is now the Lili and Jon Bosse Family Library at Beverly High. Bosse said helping local libraries is of the utmost importance to her family and said she wants to do all she can to help local libraries leave a legacy. “We’re very supportive of libraries and especially children’s libraries,” Bosse said. “We’re so excited about this project. The renderings look magical. It lets you become part of the story.” Soubiran said the mural would take about 13 to 14 weeks to finish once work begins. She described the renderings as being very modern, while still maintaining a classic look that will never go out of style. “This is truly magical,” Friends of the Beverly Hills Public Library President Charlotte HillSkura said. “You get a sense of awe just from looking at it. It’s going to be wonderful for the children.”

Harding was labeled a “504” student at Beverly High and says he spent much of his time at parties and different social events, disregarding his work in the classroom. The 504 refers to Section 504 of the Rehabilitation Act of 1973, which aims to provide students with disabilities equal access to educational services, programs and activities. Harding's mother Marla Paillet said he was never actually diagnosed with a disability, but the school district did notice he was taking more time to process information, which led to him finishing schoolwork and tests later than other students. It didn't help his classroom issues that, according to Harding, he spent much of his days living the “Hollywood nightlife” when not running track or playing volleyball and basketball for

the Beverly High varsity teams. “I viewed school as a day care and literally tried to get straight C's,” Harding said. “I did just enough to stay in school.” As a 504 student, Harding was given additional time for testing and teachers devoted more time to him to make sure he understood the work. The University of Houston was the only one of about 16 colleges Harding applied to which accepted him and it turned his life around upon enrolling. He took on leadership roles in several student and faculty organizations before being voted student body president. After next Friday's graduation, he'll begin working at ADP Payroll Services in Houston. Harding said he saw the University as a chance to start fresh. “I knew I had potential and could get good grades,” Harding said. “I still consider this whole experience a miracle and was finally able to realize my potential.”

Metro Starts Clock Running On Subway Lawsuit

The Metropolitan Transportation Authority filed the official document that starts the time period for legal challenges to the Westside Subway Extension. The “notice of determination” was filed April 26 with the LA County Recorder. That document is, however, ambiguous about whether it applies to the entire planned route to the Veterans Administration Hospital in Westwood or just that portion to the Wilshire/La Cienega station. The certificate itself recites it applies only to Wilshire/La Cienega. Despite the ambiguity, Beverly Hills Unified School District counsel Kevin Brogan of Hill Farrer & Burrill said the district “not take any changes. We will be suing” to stop the tunnel under Beverly Hills High School under the California Environmental Quality Act. Last week, the Metro Board of Directors approved the p r o j e c t through the terminus station at Wilshire/La Cienega along with stations at Wilshire/La Brea and Wilshire/Fairfax. They also “certified” Final Environmental Impact Statement/Environmental Impact Report (FEIS/EIR) for the entire project, thus the ambiguity.

According to Gibson Dunn CEQA attorney Amy Forbes, consulted by The Courier, once the notice of determination has been filed on an approved project, opponents have 30 days to file challenges. The Courier obtained a copy of the actual Notice of Determination (pictured) from the C o u n t y Recorder. The docum e n t describes the project to which the certificate applies as the “3.8mile extension… to a Wilshire/La Cienega station.” E v e n though the entire EIR was certified, the project is only described up through the first phase. T h i s makes it u n c l e a r w h e t h e r CEQA is triggered for the Constellation Station. Brogan said they aren’t taking any chances and will be filing a CEQA l a w s u i t . “ Th e y ’ve … only approved the project t h r o u g h Wilshire/La Cienega but the EIR contains the whole project,” Brogan said. “They have certified the whole [EIR] that means we have 30 days even though it describes the project as something different. We’ve never had this situation before [where an entire EIR was approved but the project was not].”

termining if the projects are consistent with the City’s General Plan such as repainting buildings and purchasing new police cars, street signs and parking meters. The revitalization of Roxbury Park is among the more prominent projects that was originally on the CIP list and one of the newest additions to the CIP is the building of a covered area to house additional mobile command center vehicles at BHPD. The commission voted to allow Mastro’s Steakhouse on North Canon Drive to pay the City a onetime fee of $896,000 to accommodate the 32 parking spots the restaurant is required to build to in accordance with its proposed 1,600-square-foot expansion. The “in-lieu parking” fee, priced at $28,000 per spot, is the only option available to restaurants that want to expand and opt not to build the required additional parking. Important issues, such as the Gateway Project (which will be coming before the Planning Commission May 24) may be seeing a later meeting start time. The City Council confirmed with Planning Commission Chair Corman and Vice Chair Brian Rosenstein that meeting times are discretionary. Corman told the council he felt the ability to change the time for important issues would “increase transparency” in the process. Issues impactful to the community will be on a small agenda to being at 7 p.m. while regular business, such as permit approval, will take place during the 1:30 p.m. meeting time. The City Council also discussed the possibility of outfitting room 280A with equipment to televise the Planning Commission meetings, however that will be discussed during the next CIP round. In the meantime, if an item is important enough to be televised, the commission will use the council’s chambers for its meeting.

As a father of three, summertime has inevitably become “a very big deal” at my house. It wasn’t always that way, because, as you know, the meaning of summer changes as one grows older. For kids, summer is a time to get outside, stay outside and soak in all the fun and adventure that they can. For teenagers and young adults, it’s about being cool—you know, doing stuff like surfing, watching movies, and just hanging out. For couples, summer is about rekindling the flame, vacationing in a romantic slice of paradise, and going somewhere that feels far from home, but that actually brings them closer together. When summertime would come around each year, I always had a wide variety of options of where to spend the season. Many of us face this same misery of choice, but over the past decade, there’s been only one place that my family and I return to every single summer. It’s the place that gives all of us exactly what we’re looking for. That place is Newport Beach. This family tradition started as just a hunch during some do-it-yourself vacation planning many years ago, but now, it’s an annual event that everyone looks forward to. You may not be aware of this valu-

I still have golfer blood running through my veins, so for me, it’s off to any number of the absolutely gorgeous courses carved right by the coast. Hours, even days, go by and it feels like merely minutes. For my wife, I guess she’s still got the brain of a shopping fanatic. And several days in Fashion Island, or the quaint shops and boutiques found on Balboa Island, put her mind at ease. This unique capital of capitalism has her totally enchanted. If there’s a brand name she’s looking for or a big name store, I know it’ll be there for her. At least it seems that way, judging by how many bags she brings home. After a couple weeks of paradisiacal bliss (and avoiding emails and calls from the office) the end of our adventure comes. We pack up, ship out and wave goodbye to Newport Beach. The memories are simply magical, and we all know that it won’t be long before we’re back again.

He said the City spends around .78 percent of its approximately $450 million annual budget on attorneys fees. “I thought it was interesting to see we spend less on legal expenses than the other full service Westside cities, both in total expenditures and as a percentage of our budget,” Wiener said. “Because of all the different things that Beverly Hills does...because it is involved in providing so many services and has a vibrant business community, we have greater legal expenses than most cities with a similar population.” The report ranked the City seventh in terms of per capita spending with $82 spent for each of the 34,136 people and 12th in terms of dollars spent on the fees with $3.359 million. Vernon had the highest per capita spending with $98,234, followed by Industry with $3,377. Signal Hill spent the highest percent of its budget on attorneys fees at 4.3 percent and Lakewood ranked lowest with 0.3 percent. Nearby, West Hollywood, which has approximately the same number of residents as Beverly Hills, spent $987,953 on average for attorney costs; Culver City spent $4.143 million and Santa Monica spent $9.340 million.

BEVERLY HILLS REPLIES TO THE LOS ANGELES TIMES Publisher's note: This reply appears in The Beverly Hills Courier because the Los Angeles Times refused to publish a response from the Beverly Hills City Council and Beverly Hills Unified School District Board of Education to the Times' editorial published Saturday, April 21, 2012. That editorial attacked both the City and school district of Beverly Hills for opposing a Westside Subway Extension tunnel under Beverly Hills High School. The Courier responded to the Times' editorial Monday, April 23, by refuting—point by point—the assertions made by that Los Angeles newspaper. The Times' editorial, as exposed by The Courier, was replete with factual errors, slurs and attacks on Beverly Hills. The Courier is proud to publish this reply from the Beverly Hills Board of Education’s Lisa Korbatov, Vice Mayor John Mirisch and Beverly Hills PTA Council Co-President Jennifer Terrell-Schwartz.

To The Community And The Los Angeles Times In its zeal to drill a subway tunnel directly under the aging classrooms of Beverly Hills High School, Metro has basically told the citizens of Beverly Hills to either get on board or get run over. As parents and elected officials, we are responsible for the safety and welfare of our children – and are not about to submit to an agency that happily collects our tax dollars and then blithely disregards our strong and unified voice. The donations of developers, the votes of labor unions and the questionable studies of longtime Metro contractors should not hold more sway with ambitious politicians than the very real threat current tunneling plans pose for the students of our only public high school. Metro has spent tens of millions of dollars trying to convince taxpayers that boring a relatively shallow tunnel right under the heart of the high school campus is the only way to bring a subway station to Century City. In fact, there are other, cheaper options that would not require putting children at risk or jeopardize the campus modernization plans that nearly two-thirds of Beverly Hills voters approved in 2008. Rather than seriously consider those options, though, Metro seems single-minded in its determination to take the unprecedented step of tunneling uphill beneath aging school buildings that sit on top of an unmapped and largely abandoned oil field so it can build a station in the basement of a skyscraper at Constellation Boulevard. That’s less than 1,000-feet from the long-planned station at Santa Monica Boulevard and Avenue of the Stars – a station that would cost tens of millions of dollars less to build and serve more riders according to Metro’s own data. For a few of the politicians on the Metro board, the Westside Subway Extension is considered a legacy project, but the legacy they are building in Beverly Hills is one of dysfunction and danger. Subterranean pockets of methane, toxic chemicals and oil wells represent real risks. Devastating methane blasts have occurred under similar circumstances. Metro claims that it can mitigate the risks through modern tunneling techniques. But it cannot eliminate them. When drilling under school buildings filled with thousands of students, this isn’t very reassuring. Nor is the “science” Metro publishes. Metro and its chief consultant on this project have been wrong before. This is the same team that brought Los Angeles the Red Line disaster in which an entire section of Hollywood Boulevard collapsed. And these same consultants became infamous in Massachusetts for overseeing Boston’s “Big Dig,” a project plagued by mistakes, misrepresentations and accidents. In the wake of Metro studies used to justify nixing the Santa Monica alignment, both the Beverly Hills City Council and the Beverly Hills Unified School District commissioned their own studies to fact-check Metro’s conclusions. The school district even conducted a far more thorough and conclusive sampling procedure under the direction the California Geological Survey to test Metro’s assertion that the area is riddled with faults. The early results: Metro is dead wrong about

certain conclusions. District engineers and seismologists are still poring over the data and will issue further reports in the coming weeks. But so far, whatever faith we had in Metro’s science is deeply shaken. Our preliminary research indicates Metro overstated the seismic risks along Santa Monica. If Santa Monica really poses such a seismic risk, why has it not been deemed an AlquistPriolo zone by the California Geological Survey? If Santa Monica was really so dangerous, why have several skyscrapers been approved for construction on the exact location where Metro claims it cannot build? One would think that Metro would take our data seriously as the agency proclaims safety to be its top priority. We’ve been trying to get a fair hearing to air our concerns for more than a year. The response from certain Metro elements has been to call us hysterical liars who don’t want transit in our City. They apparently forget that Beverly Hills has been an enthusiastic supporter of the Westside Subway Extension and will host more stations than any city other than Los Angeles. But facts don’t seem to matter when it comes to Metro. Remember, this is the same agency that repeatedly assured the elected officials of Beverly Hills that all routing options were on the table even as some board members were not so quietly telling people that the tunnel would run under the high school to Constellation – and that if Beverly Hills didn’t like it, it could sue. This is the agency the parents of Beverly Hills are supposed to trust to drill through the tangle of abandoned oil wells under the campus? Metro and its consultants aren’t even sure where all the old abandoned and unmapped oil wells are. Yet they claim that engineers can safely remove them and proceed to tunnel while thousands of our children are in class less than 50 feet above. This is part of the reason no permanent public school buildings are located above subway tunnels in California. Public school buildings in California are held to stricter design and safety standards than other structures. And there are almost always alternatives to building under schools – just as there is in this case. The “facts” Metro cites for insisting on an unnecessarily dangerous and expensive subway alignment simply don’t hold up to independent scrutiny. Nothing Metro says justifies taking the unprecedented risk of tunneling under classrooms. If Metro gets its way with BHHS, which high school might be next? Santa Monica? Culver City? Duarte? Lakewood? Glendale? How would the parents and citizens of those cities react if they faced the same threat? We are fighting to protect our school, but also to protect all schools. So when Metro presents us with the false choice of silence or litigation, we respond there is a third way – one which benefits the taxpayers of L.A. County, workers and property owners of Century City and the school children of Beverly Hills. But this third way requires Metro work with the citizens it supposedly serves. The folks who are getting the free stuff don’t like the folks who are paying for the free stuff, because the folks who are paying for the free stuff can no longer afford to pay for both the free stuff and their own stuff. And, the folks who are paying for the free stuff want the

free stuff to stop. And the folks who are getting the free stuff want even more free stuff on top of the free stuff they are already getting! Now... the people who are forcing the people who pay for the free stuff have told the people who are RECEIVING the free stuff that the people who are PAYING for the free stuff are being mean, prejudiced, and racist. So... the people who are GETTING the free stuff have been convinced they need to hate the people who are paying for the free stuff by the people who are forcing some people to pay for their free stuff and giving them the free stuff in the first place. We have let the free stuff giving go on for so long that there are now more people getting free stuff than paying for the free stuff. Now understand this. All great democracies have committed financial suicide somewhere between 200 and 250 years after being founded. The reason? The voters figured out they could vote themselves money from the treasury by electing people who promised to give them money from the treasury in exchange for electing them. The United States officially became a Republic in 1776, 236 years ago. The number of people now getting free stuff outnumbers the people paying for the free stuff. We have one chance to change that in 2012. Failure to change that spells the end of the United States as we know it. “A Nation of Sheep Breeds a Government of Wolves.” Pass it on.
