The career prosecutor’s credits include convictions in the Phil Spector and Mickey Thompson murder cases. Jackson now carries the title assistant chief deputy district attorney of the Major Crimes Division in the Los Angeles County District Attorney’s office. He’s now running for the top spot in the June 5 primary election when the 46-year-old prosecutor hopes to succeed retiring District Attorney Steve Cooley. “But more than simply being a litigator, the position carries with it the enormous responsibil-

By Marla Schevker Reporting directly from Metro Headquarters Expert testimony from Exponent Failure Analysis Associates at the Metropolitan Transportation Authority’s hearing yesterday on the Westside Subway Extension revealed that the transit agency failed to perform any risk analysis on its proposed site on Constellation or Beverly Hills High School. Instead, Metro simply said, “We don’t do risk assessments.” Beverly Hills experts disproved conclusions from Metro’s consultants, engineering and construction management firm Parsons Brinckerhoff during a hearing yesterday in front of the Metro Board of Directors. The hearing was demanded by the

City of Beverly Hills under Public Utilities Code 30639 regarding the location of Metro’s station in Century City. The Beverly Hills Unified School District, in conjunction with the City, fielded witnesses including Leighton and Associates Principal Geologist Philip Buchiarelli, Earth Consultants International President and Senior Partner Eldon Gath and former California High Speed Rail Authority Southern California Regional Director and BHUSD consultant Tim Buresh. Buchiarelli was on the team which spent almost four months trenching and conducting borings and cone penetrometer tests (cpt) at the Beverly Hills High School campus. Cultural Heritage Commission Debuts Wednesday By Laura Coleman The City’s newly formed Cultural Heritage Commission kicks off its inaugural meeting on Wednesday by reviewing its first application for a landmark

designation—The Beverly Hills Hotel—founding Chairman Noah Furie told The Courier. “It is exciting that such an important property in the City’s history will be the first property

considered for landmark designation,” Furie said. “The hotel is so much a part of our history.” The iconic site celebrated (see ‘CULTURAL HERITAGE,’ page 12)

City Council Raises Water Utility Rates By 7 Percent In FY 2012/13 By Marla Schevker The Beverly Hills City Council decided Tuesday to raise the City water rates by 7 percent in Fiscal Year (FY) 2012/2013 and an additional 7 percent in FY 2013/2014, which will result in an approximately $12 increase a month. Vice Mayor John Mirisch voted against this rate increase. “Sometimes you have to make a decision,” Councilwoman Lili Bosse said. “Right now it might hurt a little bit, but it’s the best decision for the

future.” Senior Management Analyst Christian Di Renzo said the increase is necessary to mitigate a reserve draw-down to under the council required 25 percent, in FY 2012/2013 as the water utility completes its capitol improvement project with an expenditure of $7 million. The revenue will help pay back the approximately $5 million in annual debt service, maintain an obligatory bond covenant ratio, absorb any in(see ‘WATER UTILITY RATES,’ page 12)

Sally Libow Dies At Age 81 Sally Libow, a Beverly Hills resident for nearly 50 years, died May 10 after a lengthy illness. She was 81. Born in Racine, Wisconsin on June 3, 1930, Libow graduated from UCLA with a degree in kinesiology and worked as a substitute teacher in the BHUSD system for years. The avid tennis player was also known for numerous philanthropic activities and as a

champion of persons and animals incapable of defending themselves. She is survived by Mitchell Libow, her husband of 57 years, her daughter Rebecca Weinberg and son Michael J. Libow. films - The Kid Brother (1927) and High And Dizzy (1920). Known as the “father of romantic comedy,” according to Harold’s granddaughter Suzanne Lloyd who oversees the archives, the films of the former Beverly Hills star always showcase the triumph of the good guy. According to the orches-

ucky we were to meet a Ziegfeld Follies beauty from Texas several decades ago. The late Jean Howard arrived in Hollywood and mesmerized MGM’s Louis B. Mayer. Legend has it that he was madly in love with her, married though he was. Traveling together in Europe, New York, etc. When Jean wed Charlie Feldman, the hotshot agent representing Garbo, along with superstars of that era, Mayer, insanely jealous about Jean’s marriage, banned Charlie from the MGM lot. But Garbo was a cash cow, Mayer needed her, and Lothario Charlie – famous for his dalliances! – wasn’t ousted very long.

ime and again we’ve heard about Jean and Charlie from their contemporaries. They hosted glamorous Saturday night soirees at their Coldwater Canyon estate. design, recycled and locally sourced materials, efficient water systems and a rooftop photovoltaic system that provides approximately 15 percent of the building’s energy needs. The three-story, 50,000-square-foot edifice houses eight operating rooms for outpatient surgery, a linear accelerator for radiation oncology, as well as space for future growth, a laboratory and a pharmacy. It also contains clinical offices for several UCLA Department of Medicine practices, including the Food & Drug Allergy Care Center, Center for Inflammatory Bowel Diseases, digestive diseases, pulmonary and sleep medicine and nephrology. The glass, steel, concrete and bamboo Modernist structure is formed by a pair of rectangular concrete volumes joined by an expansive glass box housing the naturally lit atrium. Landscape architect Pamela Burton & Company designed a series of green spaces there including a large garden with seating.

The building also features the West Coast’s first fully automated parking system that automatically parks and retrieves visitors’ cars while they wait in a nearby parking lobby. The state-of-theart system accommodates 385 cars in a footprint 50 percent smaller than conventional garages. Visitors pull onto one of six parking platforms, exit their cars and visit a nearby kiosk for their parking ticket. The system then automatically places the car into a compartment based on its size. When leaving the building, visitors swipe their ticket, make a payment and wait while the system retrieves the car. “It’s like a giant vending machine for your car,” explains Randall Miller, president of Nautilus Group, who developed the customized system based on technology in use on the East Coast and in Europe. Before its opening, the building captured awards for its innovative design from the AIA Academy of Architecture for Health, AIA/Los Angeles Chapter, Southern California Development Forum and Westside Urban Forum.

Until They Are Home Premieres On Memorial Day At Directors Guild By John L. Seitz Until They Are Home, a Vanilla Fire Productions’ documentary chronicling the search for the remains of missing U.S. Marines of World War II who were killed in the battle on the island of Tarawa in November 1943, will have its world premiere at 7:30 p.m. on Memorial Day (May 28) at the Directors Guild of America, 7920 Sunset Blvd. With narration by actor Kelsey Grammer and featuring an original song She Won’t Let Go by country star Clint Black, the film is directed by Steven C. Barber, produced by Matthew Hausle and Tamara Henry and executive produced by Tim Shelton. The film brings to light the dedication of the Joint POW/MIA Accounting Command (JPAC) team members, largely unsung heroes who, until now, have gone unrecognized. These young men and women returned in 2010 to the site of one of the most horrific battles of World War II in order to bring home the remains of a few U.S. servicemen and fly the remains back to American soil. The Pentagon activated the JPAC in 2003, to research and recover the remains of more than 83,000 unaccounted-for Americans from foreign wars in order to support the Department of Defense’s personnel accounting efforts. JPAC has more than a dozen teams who travel the globe on recovery missions, and Until They Are Home is the story of one of those missions. For Barber, the film is sequel to his previous effort 2008’s Return To Tarawa: The Leon Cooper Story, narrated by Ed

Harris, which won “best documentary” at film festivals in New York and Milan. Leon Cooper, now age 93, is one of the few remaining survivors of the battle of Tarawa and this first film tells the story of his 2008 return to the battlefield where he fought 65 years earlier as a U.S. Navy commander. During his 2008 return visit to Tarawa, he was able to confirm firsthand many disturbing conditions about that site where the remains of several hundred Americans still lie neglected and forgotten on the island. Deeply disturbed by what he saw there, Cooper dedicated his life to garner local support for his restoration plan to clean up the Red Beach and the entire island, including the building of a modern incineration facility to relieve the island’s issues of refuse disposal. His efforts gained the attention of Sen. Dianne Feinstein and local Rep. Henry A. Waxman who became involved in Cooper’s cause and were instrumental in presenting the issues to Congress in 2009, and having legislation written for a mandate to fund a JPAC mission to recover U.S. MIA remains. Although nothing was decided regarding the basketball courts, it was agreed they are important, but do not necessarily have to be inside. “I do think it’s nice to have two basketball courts there,” Mirisch said. “[But] we’re in southern California, it’s a nice day most of the year and we can use outdoor basketball facilities.” Last week the City received a cost estimate for the renovation from construction company C.W. Driver, which stated the modernization would cost approximately $6.1 million. This would include a major overhaul of the building including the HVAC components, roof structure and electrical systems. The building would also need to be upgraded to meet

This does not mean renovation is off the table. The council agreed to hire architecture firm RTK, at a cost of $157,000, to help with the basic drawings for the project. RTK was hired to peer review The Albert Group, which worked on the project that was rejected last December. This will allow the council to compare renovation to building new on an equal scale. Parks and Urban Forest Manager Ken Pfalzgraf told the

council he felt the playground equipment at the park would need to be replaced over the next three years, which will cost approximately $425,000 for the equipment and pouredin-place playground surface. Playground equipment needs to be replaced every eight years. He also told the council fixing the drainage would cost between $348,908 and$561,800. In an effort to create a long-lasting building, Bosse expressed concern over the storm drain underneath the park, feeling it would be advantageous to replace the drain while constructing the community center. Kahikina said she didn’t know the cost for replacing the storm drain and would bring the price and typical life expectancy to the liaison committee at its next meeting. Mayor Willie Brien said it is likely the Roxbury Park Community Center will be coming back before the council over the summer for additional direction.

One of the more pressing issues being faced by Los Angeles County is Gov. Jerry Brown’s “realignment” of the state’s prison system whereby certain convicted criminals are now sent to county jails. This has resulted in tremendous overcrowding in local facilities. Jackson’s proposed plan is to allow the counties to contract with out-of-state prisons to house the inmates, a policy enjoyed now by the state system. “There are many new problems which the next district attorney will have to confront, especially with the continuing poor economic climate,” Jackson acknowledged. “And the face of crime is changing, especially in the cyber area which we have to stay ahead of. “This requires new and often innovative answers as the same old, same old ‘passing the buck’ down the line won’t cut it anymore.” Sounds like Alan Jackson is just the new age prosecutor looking forward to putting such solutions into action.

Golden Dragon School Of Traditional Kung Fu Opening This Summer or more than 10 years, the Golden Dragon Martial Arts School has been teaching the basics of Kung Fu in Russia, Austria, Spain, China, and the U.S. The school comes to the Westside when the local studio holds its grand opening, Sunday, July 1 at 11677 San Vicente Blvd. Kung Fu is a gem of Chinese civilization and during the teaching process instructors strive to preserve its original purity. But this does not mean they are oblivious to everything that’s new and beneficial; it means that while teaching instructors pay great attention to even the tiniest details. They are persistent, demanding and always practice what they preach. The ancients called Kung Fu the art of life and at Golden Dragon its most important aspect is quality. Los Angeles County has already positioned itself as a leader in inventive solutions through its fleet of 2,800 buses powered by natural gas (second only to Beijing’s 5,600 natural gas-powered buses). Earlier this month, at the Committee of 100's exclusive 21st Annual Conference in Pasadena attended by roughly 340 Chinese-American business leaders, Berkshire Hathaway Vice Chairman Charlie Munger advised a policy of stockpiling foreign oil - no matter what the cost - as he anticipated that the incredible thirst for the finite resource was unlikely to abate in the near future. The tycoon is renowned for his investment acumen. “Petroleum's going to get short,” he said, noting that he advocated a policy of slow production with respect to producing domestic oil. “Oil and gas is absolutely certain to become scarce and [expensive].” At the Milken Global Conference, billionaire founder of oil and gas-focused BP Capital Management T. Boone Pickens suggested an alternative strategy to foreign oil acquisition, namely harnessing local energy resources to restore the nation’s

economic independence and create jobs across America. The oilman-turned-philanthropist has spent $100 million of his money in an effort to shift the nation's reliance from crude oil to natural gas. “Oil's going to get pretty tight this summer,” Pickens told The Courier. He predicted that a barrel of crude oil could hit $150 by summer, leaving the nation further at the whim of the Organization of the Petroleum Exporting Countries (OPEC). In 2011 oil averaged $103 a barrel. “When you turn down natural gas, you choose OPEC,” Pickens said. “I think we're just fools to continue to do that.” Boone said that within a few years technology would advance sufficiently to allow the nation to extract about half of its oil in place. As historically high oil prices continue to rise, countries around the globe increase their oil needs and conflicts blossom in the Middle East, the global oil situation is precarious, leaving America vulnerable to global uncertainty. One such example is the recent conflict with Iran over the Strait of Hormuz when the Middle Eastern nation threatened to disrupt oil shipments in response to sanctions imposed by the European Union in response to Iran's nuclear program. In 2011, the U.S. spent $460 billion on imported oil, roughly 3 percent of its $15 trillion GDP.

Under California law, a fault zone is considered active if it has been active in the last 11,000 years. Thus, if there are faults underneath the high school, which Buchiarelli said he doesn’t believe there are, they are not active. Only active faults result in heightened safety requirements. After Leighton and Associates submitted its report, Metro’s experts, Parsons Brinckerhoff, prepared a response which simply repeated its original study but also, Buchiarelli said, reported a different location moving the faults to areas not covered by the trenching data despite a lack of any new data. “If the data is subject to that amount of interpretation, we question how confident you can be in the faults’ [location],” Buchiarelli said. “It causes us concern because they’ve simply moved the faults to new locations based on, well… we’re not quite sure what.” Buchiarelli said Parsons

Brinckerhoff’s response moved the faults approximately 20 to 30-feet from their original report. He said this was a problem because when Leighton Inc. conducted its studies at the campus, they relied on the maps’ accuracy when looking for the fault lines Parsons Brinckerhoff said were there. So, if fault zones are not a problem, Buresh said the Santa Monica Boulevard station is clearly the better choice. Buresh said if Metro were to take students and those who live or work further than 600 feet into account, ridership at Santa Monica Boulevard would be similar today to Constellation Boulevard but higher in the foreseeable future. He also stated that according to the Final Environmental Impact Statement/Environmental Impact Report, a Santa Monica Boulevard station would cost at least $100 million less than the Constellation Boulevard station once all of the construction factors including gassy conditions are taken into account. Buresh also said “preconceptions can be buttressed by first impression” and can “lead to the wrong conclusion.” Metro was predisposed to finding faults and made the conclusions with inadequate evidence.

“If the only tool you have is a hammer, the whole world looks like a nail,” he said. “[It’s easier] to identify false positives [and there is] no sufficient reason at this time to exclude Santa Monica.” Los Angeles Deputy County Counsel for Metro Charles Safer did not call any witnesses during the hearing. He did, however, submit many of the previous Metro documents including: The Westside Subway Extension final EIS/EIR, The Century City Fault Area Tunneling Safety Report and Parsons Brinckerhoff’s responses to the Beverly Hills commissioned engineering and scientific consulting firm Exponent and Shannon & Wilson reports. According to Metro Board Chair and Los Angeles Mayor Antonio Villaraigosa, the Metro Board will make a decision on the location of the Century City Station and the alignment through Beverly Hills into Century City at “the next board meeting May 24 or sometime thereafter.” Beverly Hills City Attorney Larry Wiener concluded the City’s presentation by stating that Metro board lacks sufficient information to make any decision on a Century City station or alignment.

From the Publisher CLIF SMITH THE EXERCISE IN DEMOCRACY Please vote in our local elections. Please go through the exercise. Please do this even though the outcome of many “contests” are really fore-ordained because of the disappearance of the Republican Party in our area. Where Republicans have not disappeared completely, they have been rendered nearly irrelevant by the redrawing of district boundaries. That does not mean that there are no contests. Within the Democratic Party, there are some differences, but mainly variations on the same theme—government good, private property and free enterprise bad. Take your choice. The practical workings of politics these days involves mainly the wishes and manipulations of labor unions. The unions control the Democratic Party and thus government in California. We see the results, but The Courier realizes this is not going to change any time soon, if ever. That reality makes us realize that the coming split will occur between public sector unions, whose members are largely immune from financial and economic realities, and the true traditional unions of skilled and unskilled labor. Labor union members–the ones who still have to work for a living—have borne much of the damage caused by public employee unions backing Democrats for office who in turn have wrecked the economy of this state. Public employee salary, benefits and pensions have destroyed our state, yet their political clout grows every day. The outlook is not going to improve. We now see Governor Jerry Brown pitching another tax increase on the November ballot. Why? Well, government spending went up much more than he thought (surprise, surprise – to him, not us), and tax receipts went down (another surprise for him but not us). Those of us who see reality know that government in the hands of public employee union-backed Democrats can never recover. We know our state will never recover with these same people calling the shots. But that’s who we have and we will have into the distant future. The Courier also recognizes that our overwhelmingly Democratic readership will only vote Democrat —the only question being how far left each candidate is, not whether they even come within shouting distance of the middle. Nonetheless, we hope that some day this urge to continue our economic suicide ends. We certainly long for the days of Gov. Edmund G. “Pat” Brown (the current governor’s father), Assembly Speaker Willie Brown, and other responsible Democrats, as well as Republicans George Deukmejian and Pete Wilson . . . and of course Ronald Reagan. These leaders would never have allowed our state to become the disaster it is. So, even if it doesn’t really matter all that much, please vote. If for no other reason, please vote so we don’t have to read and hear about how “discouraged” you are from “partisan bickering.” There is no “partisan bickering.” The Republicans have disappeared and the only ones left around here are all Democrats.

Proposition 29 – NO* *This adds new taxes purportedly for “medical research,” but really mainly funds new bureaucracy with no guarantee any of the money will be spent in California.

LETTERS May I offer strong support for your resistance to the pressure, and most dangerous, intentionally misleading powers of persuasion brought by the MTA, in attempting to get permission for its tunneling under BHHS. As someone who has experienced the reality following the deceiving picture (i.e. “no noise, minimum vibration,”) distributed by the MTA to those who might oppose its plans, I urge you to follow your advisors’ engineering and environmental impact studies, not give credence to those from biased and debatable outside sources. As a witness of the “highpowered” pre-sell doled out to the public prior to the tunneling under Hollywood Boulevard to build the Red Line in 1993, which finally ended way over deadline, I lived 3 blocks away from the chaos, earblistering, nerve wracking noise of vibrating jack hammers, powerful drills, and monster trucks carting away soil 24/7 for 7 years!! The MTA is expert at promotion, paying millions to PR firms.

The MTA’s carefully tailored presentations to you in Beverly Hills will ensure the above factors are glossed over, minimized under technical verbiage designed to conceal, not reveal the reality behind underground tunneling in shale. This undertaking will ultimately benefit only the coffers of the MTA and its contractors. The selling point of the “Subway to the Sea” (think Disneytype dancers mentioned in the MTA brochure to celebrate the possible accomplishment of this nightmarish project) is palpably ridiculous and insulting to one’s intelligence. Presently, there are three excellent routes to go to or from downtown, Santa Monica and “the sea.” They are buses–cheap, swift, easy, clean and seldom crowded. I travel them each week. I urge City Council members

not to buckle under pressure. The decision is irrevocable once made. There is no turning back and you will lose everything that makes Beverly Hills unique, a gem, and a center of culture and civility–not just in California but globally. Elizabeth E. Cole ****** The first sentence should read: The Courier deserves a Pulitzer Prize for its coverage of this MTA issue, especially for uncovering the multimillion dollar “fix” that corrupt L.A. Mayor Antonio Villaraigosa and his allies gave millions of dollars to JMB by moving the subway stop to its corner. The question remains: how much would you trust the MTA–the very folks who gave us the MetroLink rail disaster, costly overruns on almost every project, illegal cuts to bus service for poor neighborhoods, can’t complete a rail line to LAX, and who run the world’s deadliest light rail line (the Blue Line) between downtown L.A. and Long Beach, etc., etc.–to build anything under almost anywhere, especially through an oil field in or near a seismic zone right under this City’s only high school? Rabbi Jacob Pressman THE ANGEL OF HARRITY LEE At my age I don’t always remember to whom I spoke last week, but Miss White I remember. We lived at 5642 Christian St., the only family of the Mosaic Persuasion on the whole long block of row houses across the street from the school. Why it was named Harrity Lee I do not know, but he or she must have been very important. In my second grade my permissive dear mother whose name, Dora, I do remember, stopped getting up early enough to take my hand and walk me across the street. As a result, in second grade my monthly report card always read: “Present: 20 days. Tardy 20 days, Achievement Excellent.” By February Miss White knew all 47 of my classmates by name and also that I was late every single day despite living 100 yards from my home room. She called me in, and said: “Jacob!” (That is when I learned that my real name wasn’t Jack.) “You are a very good student, but if you don’t come to school on time, I shall be unable to promote you. Now, I have some nice candies in my desk, and I shall give you one every day you arrive on time and allow you to suck it in class, but quietly.” Wow! My monthly report card changed to “Present 20. Tardy 0. Achievement Excellent.” However, I did develop some dental caries. That February, my friendly classmates ganged up on me in the schoolyard, yelling “teacher’s pet!” piled on top of me and slightly fractured my ankle. I convalesced at home for a month, during which every afternoon after school Miss White made her way across the slippery, snow-packed street and brought me my homework assignment. I was graded: “Present 20, Tardy 0, Achievement Excellent.” Miss White, wherever you are, (I wish I knew your first name, because I love you.) Thank you for turning me around and heading me toward a lifetime of punctuality, concern for the human race, and some measure of achievement. Would that all the teachers in the world were just like you. May God love you. I still do.
