Superior Court against the Metropolitan Transportation Authority. The lawsuit contends Metro’s CEQA process failed due to a “rush-to-judgment by the Metro Board designed to hurry the decision through without awaiting full and complete information needed by the decision makers and the public to make informed environmental choices.” After thorough research, BHUSD experts concluded there were no active fault zones underneath Beverly High; a fact which Metro experts still contend is false. NOTICE OF PUBLIC HEARING DATE: Thursday, June 14, 2012 TIME: 1:30 p.m., or as soon thereafter as the matter may be heard LOCATION: Commission Meeting Room 280A Beverly Hills City Hall 455 North Rexford Drive Beverly Hills, CA 9021 The Planning Commission of the City of Beverly Hills, at its REGULAR meeting on Thursday, June 14, 2012, will hold a public hearing beginning at 1:30 PM, or as soon thereafter as the matter may be heard to consider: A request to renew and modify an existing Conditional Use Permit (CUP) for a hotel restaurant located at 403 North Crescent Drive (Crescent Hotel). The request would renew a previously approved CUP, which allows the hotel’s restaurant to be open to the general public. In addition to renewal of the CUP, the applicant has requested that the CUP be amended to allow modifications to the outdoor dining area, and to allow modifications to the interior configuration of the hotel. No additional hotel rooms are proposed. This project has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The project qualifies for a Class 1 Categorical Exemption for minor changes to an existing commercial facility, and the project has been determined not to have a significant environmental impact and is exempt from the provisions of CEQA.
The Planning Commission of the City of Beverly Hills, at its regular meeting on Thursday, June 14, 2012, will hold a public hearing beginning at 1:30 p.m. or as soon thereafter as the matter may be heard, to consider: A resolution recommending the City Council adopt amendments to the following Beverly Hills Municipal Code Sections regarding the maintenance of hedges and restoration of views in the Trousdale Estates Area of the City: Beverly Hills Municipal Code Section 10-3-2616 regarding development standards for walls, fences, and hedges in Trousdale Estates and Beverly Hills Municipal Code Section 10-8-106 regarding Trousdale View Restoration Permit Procedures. The proposed Zoning Code amendments would amend the definition of hedge in Trousdale Estates only and would change the public notice requirements for a Trousdale View Restoration Permit. Trousdale Estates is defined in the zoning code as all property located north of Doheny Road and east of Schuyler road, except that land zoned R-1.X, and that portion of lot A of the Doheny Ranch Tract northwesterly of Tract Numbers 24485 and 24486, commonly referred to as the Greystone Mansion Property. The amendments propose limited changes to the previously adopted Trousdale View Restoration Ordinance and the related Trousdale Wall, Fence and Hedge Ordinance for which a Negative Declaration was adopted after the project was assessed in accordance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City and no significant environmental impacts were identified. Copies of the staff report, Negative Declaration, and all documents referenced in the Negative Declaration will be available in the Planning Division and can be reviewed by any interested person at 455 N. Rexford Drive, Suite 100, Beverly Hills, CA 90210. Copies of the documents will also be available for review in the Beverly Hills Public Library Reference section. Any interested person may attend the meeting and be heard or present written comments to the Commission. IPic Theatre Readies For Beverly Hills By Laura Coleman Beverly Hills moved closer to getting its own blockbuster movie theatre when the Planning Commission Liaison Committee continued to support efforts to develop an IPic theatre at 257 N. Canon Dr. on Wednesday. The proposed 38,000-square-foot building would be developed on the only remaining vacant piece of
substantial land in the triangle. Wednesday’s hour-long liaison meeting builds on guidance and support offered at last week’s Planning Commission meeting where architect Hamid Gabbay presented plans for the four-story building. The currently proposed 59.5-foot structure is lower than the project that was previously entitled for the site.

There, the ship will be transformed into an interactive floating museum by the nonprofit Pacific Battleship Center. A reunion of USS Iowa vet-
erans is scheduled to be held at the Port of Los Angeles from July 2 through 6, and the city has plans to celebrate the museum’s public grand opening on July 7. The new museum, which will be open from 9 a.m. to 5 p.m. daily, will highlight the contributions of the battleship and its crew during World War II, the Korean War and the Cold War. Public ticket sales for the July 7 grand opening and beyond began last week. To purchase tickets online or for more information, visit www.pacificbattle ship.com. The CVB has been independent since 2008 when the City Council voted to strip the Chamber of operating the CVB as a result of an extensive independent analysis prepared by outside consultants. Last Thursday, the Metro Board of Directors approved the last two phases of the Westside Subway Extension including a station at Constellation Boulevard and Avenue of the Stars in Century City and a tunnel underneath Beverly Hills High School. This action happened despite Beverly Hills experts recommending the Metropolitan Transportation Authority conduct additional studies after disproving the information released by Metro’s experts, at a hearing in front of the Metro Board of Directors May 17. At the hearing, requested by the City of Beverly Hills under Public Utilities Code 30639, the City combined efforts with the Beverly Hills Unified School District to present six experts who testified that the studies Metro has relied on were insufficient. Among those witnesses were Leighton and Associates Principal Geologist Philip Buchiarelli, who spent four months studying the Beverly High trenches and concluded

prejudice by the actions of Metro in that the Project was approved without the full disclosure and analysis of the Project’s environmental impacts and, if the project proceeds, there will be severe unmitigated adverse impacts” on the City. According to the lawsuit, the final EIS/EIR disclosed “substantial changes had been made to the design of the project” including but not limited to the change of the locally preferred alternative route from Santa Monica Boulevard to Constellation Boulevard; the change of tunnel depths from 50 to 100 feet to 35 to 100 feet underground without addressing “where the shallow tunnel depths would occur;” and the addition of a terminus station at Wilshire/La Cienega without sufficient study of the impacts. The lawsuit alleges the final
BHUSD LAWSUIT (Continued from page 1)
Metro also used potentially flawed and erroneous studies to discredit and rule out a potential station location at Santa Monica Boulevard and Avenue of the Stars because it favored a Constellation station location. The lawsuit points to the fact that numerous geologists and other experts have questioned Metro’s seismic studies and findings because, among other things, they involved no soil dating work or open trenching, the only reliable method to determine active faulting. Board of Education President Brian Goldberg noted that “BHUSD’s experts are convinced, and their studies have proven, that a Santa Monica Boulevard station location would be a safe and viable option." “My hope is the CEQA challenge will force the MTA to do a complete and thorough study of both Constellation and the Santa Monica Fault Zone, which to date they have not done,” Goldberg said. “To date, they have not done that and it’s
that Metro’s experts had interpreted the data wrong when they stated there were faults underneath the high school; and former Southern California High Speed Rail Authority Regional Director Tim Buresh, who said that if fault zones weren’t an issue, Santa Monica would be a far better choice for a station. Metro did not present any witnesses, nor did they give any new data for the BHUSD to look at. Instead, their witnesses were present at the May 24 Board of Directors meeting when they were not subject to cross examination. The Metro Board of Directors approved the Westside Subway Extension final Environmental Impact Report/ Environmental Impact Statement in April when they also expanded Phase 1 to include a terminus station at Wilshire/LA Cienega instead of Wilshire/Fairfax. Both lawsuits ask the judge to set aside Metro’s approval of the final Environmental Impact Statement/Environmental Impact Report for the Westside Subway Extension because of alleged California Environmental Quality Act violations.
EIS/EIR also did not sufficiently analyze the risks associated with a Constellation Boulevard station or the alignment associated with that station. The studies that Metro used to discredit the Santa Monica station were not properly vetted through a public comment process and the lawsuit states that “Metro's Subsequent Studies were not based on sufficient technical or scientific investigation” and instead of complying with the CEQA requirement to revise and recirculate the final EIS/EIR to include the new studies, “Metro rushed to certify the final EIS/EIR and approve the project.” The City requested a public hearing pursuant to the Public Utilities Code and the lawsuit contends that Metro violated CEQA in connection to the hearing. In addition, according to the lawsuit, Metro “improperly set the May 17 hearing” by not consulting the City before setting the date for the hearing
and then refusing to move the date even though two of the City’s experts would not be available. The lawsuit also states there was not a quorum of the Metro Board present at all times during the hearing. The major points stated in the lawsuit include that Metro failed to recirculate, “in whole or part” the “significant new information” added to the EIR after the public review period; failed to include a clear and stable project description; and failed to analyze the potential impacts associated with the Constellation Station. Beverly Hills City Attorney Larry Wiener said despite coordination between the City and the BHUSD, the two entities filed separate lawsuits to include issues that are unique to each entity. However, the goal is the same. “The lawsuit is intended to compel Metro to follow the state law and comply with CEQA,” Wiener said. “It is our
belief that when [Metro is] forced to do that, the CEQA process will reveal that there are options for Metro that make sense and don’t involve an alignment that goes under Beverly Hills High School.” Wiener said the next major step in the litigation is a mandated CEQA settlement conference that requires the parties to meet and attempt to resolve their differences. Councilwoman and Legislative Liaison Committee member LIli Bosse said she believed the CEQA lawsuit was a strong first step. “We should do anything and everything to prevent the subway from going under the high school,” Bosse said. “As far as I’m concerned, there will be no subway under the high school. I think Metro made many errors in terms of their environmental analysis… [and] needs to know that the schools and the City are prepared to fight.”
one of the biggest deficiencies.” The lawsuit alleges Metro “rushed” the alignment decision without awaiting full and complete information because it had “precommitted to the Constellation Location for political or other reasons.” The lawsuit states that in January, the BHUSD discovered nearly a year-and-a-half before the release of the draft EIS/EIR, “Metro staff submitted documents to the [Federal Transit Administration] to justify New Starts funding that only included documentation for the Constellation Station Alternative—not Santa Monica Boulevard. “It appears that Metro staff had long before selected the Constellation alternative and that all of the reports it prepared and issued since were a slanted, post hoc rationalization for that decision.” The BHUSD claims Metro violated CEQA in a variety of ways including an inadequate project description, by not disclosing the Constellation Boulevard station option until after the draft EIR/EIS had been released; inadequate analysis of seismic impacts, by not waiting until the California Geological
Survey had rendered an opinion on the fault zones underneath Beverly Hills High School and instead trusting the expert opinion that only supported the Constellation Station; refusal to prepare and recirculate a supplemental draft EIS/EIR, instead stating the original draft EIS/EIR had all of the environmental analysis necessary to make an informed decision; and bias in precommitment to the Constellation station. Kevin Brogan, attorney for the BHUSD, said that Metro forced the lawsuit because of its insistence on moving forward and voting on the project prior to the completion of all relevant scientific studies. “The BHUSD supports the Westside Subway Extension and did not want to file this lawsuit. But Metro’s purported consideration of the Santa Monica Boulevard station location was nothing more than lip service, and its headlong rush to approve the alignment before all studies were finalized left BHUSD no choice,” Brogan said. Brogan said by filing the petition for Writ of Mandate, one possible outcome is the
courts could order Metro to recirculate the EIS/EIR so there could be further public comment. He said the court process could take anywhere from four to 10 months. “The hope is Metro will have more information on which to make a better decision,” Brogan said. “The whole purpose of CEQA is to have them... determine whether or not [Metro] did [the environmental process] the right way. If they didn’t do it the right way, the court can tell them how to do it.” The CEQA suit is not the only option the BHUSD has for fighting Metro. Goldberg said they are also looking into a National Environmental Policy Act challenge and an eminent domain challenge. “This is a political process and politics butt into every aspect of the decision making by the Metro Board,” Goldberg said. “We intend to continue our efforts at getting support from the PTA’s, state and federal representatives, the attorney general and the governor. We will use all means necessary to protect our legal rights.”

To celebrate the donation tomorrow, a group of teen patients will gather in the hospital’s Teen Lounge to test out the PS Vita’s five-inch OLED touch screen, rear touch pad, front and rear-facing cameras and dual analog sticks. PlayStation developers will also be on hand to surprise patients with an exclusive look at PS Vita games that are still in development, including LittleBigPlanet and Sound Shapes, making the children among the first consumers to play these titles before they are available in stores. Additionally, Children’s Hospital Creative Art Therapists will use the PS Vita systems to test a virtual group art therapy session for Cystic Fibrosis (CF) patients. Cystic Fibrosis is a disease that causes a thick, sticky mucus to build up in the lungs, digestive tract, and other areas of the body and makes patients highly susceptible to lifethreatening infections and other serious problems. Because of the nature of their disease, CF patients cannot physically interact with those they relate to most—other CF patients. Using other applications available on PS Vita, such as Skype, CF patients will be able to safely share their art and interact with each other. The PS Vita units will be divided between the h o s p i t a l ’s Child Life Program and the Mark Taper-Johnny Mercer Artists Program. Both programs have specialists and certified therapists who use various forms of play, art, music and other methods to support the social, emotional and developmental needs of children dealing with the stress of illness and hospitalization.

More Than Self Defense At Gracie Jiu-Jitsu t Gracie Jiu-Jitsu Academy, selfdefense is the least important aspect. “We prepare people for life,” says Rener Gracie, part of the Gracie dynasty that created the martial art form, now used by everyone from women to bullied children and police officers. Because, as Gracie says, “it’s not a sport, it’s a lifestyle;” there are people who train at Gracie for 10 years or more, even after mastering the techniques, because of the constant challenges. “We teach people how to overcome the impossible,” says Gracie. “If someone has you in a headlock, you think, ‘how am I going to get out of this?’ Gracie continues, “We give you three options and you think, ‘how beautiful. I thought it was impossible, but now I know an easy and effective way to get out.’” The opponent may outweigh the Gracie student by 100 pounds, but following the Gracie philosophy students know they’ve been in worst places and that in facing and overcoming challenges there is a solution. What separates Gracie Jiu-Jitsu from the hundreds of martial arts out there? While all have their strengths, not all are effective. Rener's grandfather Grand Master Helio Gracie created the discipline of Gracie Jiu-Jitsu so the smaller and weaker have a more realistic chance
A
to win. His father, Rorion Gracie, the world’s foremost exper t in selfdefense, created the Ultimate Fighting Championship In 1993 to determine which fighting system was the most effective in a realistic “no-holdsbarred” confrontation. Rorion chose his younger, smaller brother Royce, to represent Gracie JiuJitsu against all comers and highlight the superiority of their father’s art. And Royce won all his matches. Says Rener: “My father said, ‘can you lift a truck with one hand? No? I can. Give me a jack, give me leverage.’” The Gracie system is so successful because it can be used by anyone, especially those with limited physicality. The programs don’t make over or change a student’s body, but allow him or her to maximize what they have. “We give people a big enough lever,” says Gracie. “Then all they need is patience to master the techniques.” • Gracie Combatives, a signature program for adults, dates to 1994 when the Army Rangers asked for a defense program that could be taught in one week. The Gracie brothers analyzed hundreds of fights and narrowed 600 techniques down to 36 that were used in every fight. The result is a system used by all federal law-enforcement agencies. “We perfected an energy-efficient technique that forces the big guy to
tire out and burn everything,” says Gracie. “A beast exhausted is useless. Then we take our pick on how to make him submit.” • Gracie Bullyproof teaches children ages 5-14 a non-violent, pure defense way to control a bully in a humane way. • In Little Champs, for children ages 5-7, Gracie Games teach kids 10 basic self-defense techniques while instilling the foundational principles of leverage and control. • Jr. Grapplers, for children ages 814, focuses on 33 non-defense techniques that teach children to “control and negotiate” with bullies. Children’s classes also offer the added bonus of character development. For two months, sessions focus on a specific desired trait—health, respect, caring, citizenship, for example—and besides in-class discussions, students are given a wall sheet to take home with tasks related to the theme. So if the subject is health, students earn points for exercising instead of watching TV, drinking water instead of soda and eating fruit instead of junk food. Parents award points, 10 points for each completed task; 20, if children do it on their own. Students who earn enough points are eligible for Gracie Game Day, two hours of fun and games on a Saturday. “I have had parents say, ‘my child never made his bed before,’” relates
Gracie. “Now he does it all the time.” Whereas other schools promote the accomplishments of their most gifted and talented students, at Gracie, “our indicators are based on the smallest and weakest,” says Gracie. And while they want the classes to be “the most fun experience of the week” for participants, Gracie says, the emphasis is in always making sure the learning is safe and effective. • Women Empowered teaches 15 time-tested techniques to counter the most common types of assaults against women. “The more women learn the less likely they are to be the victim of an assault and to actually use the training,” says Gracie. “Attackers choose who to attack; and it’s not the woman walking and acting confidently.” Grand Master Helio Gracie wanted to make his system welcoming, useful and accessible, says Gracie, so visitors to the studio will see working professionals and people of all ages. “Small weak and unathletic people are the ones who need it the most,” Gracie adds. Gracie Academy Beverly Hills is at 324 S. Beverly Dr. Grand opening week starts Monday, June 4 with free selfdefense seminars all week. Pain Center Provides Relief, Improvement In Function For Those Suffering From Chronic Intractable Pain Beverly Hills resident Jeanette Vesley, was in good health—except for her constant abdominal pain. The pain, from a previous hernia repair, increased with physical activity and when she was lying down. For five years Vesley had tried various treatments and visited numerous facilities without much success. Vesley’s pain, also termed “post hernia repair abdominal pain” is generally considered an intractable pain condition for which there are no effective treatments. Apart from the abdominal pain, Vesley also suffered from toe pain for 20 years, and couldn’t wear shoes with heels because it was so painful. Vesley read about Advanced Interventional Pain Center (AIPC) in The Courier and decided to give it a try. After a comprehensive evaluation by Drs. Amit Gupta and Pattanam Srinivasan, Vesley underwent novel injection treatments for her abdominal pain. After just one treatment session, she realized her abdominal pain had been cut by 90 percent. After two weeks, Vesley underwent a separate treatment for her toe pain that ended 20 years of suffering pain in her toe. Drs. Gupta and Srini-vasan note that a number of pain patients in the country are left without effective treatment solutions. They also note that the elderly population has increased tremendously because of good healthcare and preventive medicine. At the same time, many suffer from chronic pain which when left untreated becomes intractable. Many elderly want to stay physically active without pain, but this is not always possible. “Pain medications mask pain symptoms and do not offer a treatment solution for pain patients,” says Dr. Srinivasan adding that AIPC is the only pain center of its kind that does not use addictive medications in its treatment regimen. What are the options for treating pain? Usually they start with rest and taking OTC medications. If pain symptoms persist, the next step would be to consider minimally invasive procedures. Joint replacement surgery can be considered
when minimally invasive procedures don’t provide any relief. Certain joints like the Sacro-iliac joints, facet joints that cause back pain, cannot be replaced with artificial joints, therefore minimally invasive procedures are the best way to treat pain in these joints. At Advanced Interven-tional Pain Center, several minimally invasive procedures are used to provide long-term pain relief (four to six months or more). Permanent relief from elimiJeanette Vesley nation of the pain-causing disease process is also possible at AIPC, which is the nation’s only pain center that can effectively treat certain incurable pain conditions. For those who cannot tolerate conventional injection-based treatments, AIPC offers novel laser treatments called Low Intensity Laser Ablation (LILA). Not yet approved by the FDA, this treatment is only available at AIPC on a case-by-case basis. AIPC has helped num-erous patients avoid surgery which has either been prevented or postponed through its minimally invasive procedures. In several other cases, procedures at Advanced Interventional Pain Center have helped patients who failed surgical treatments. For one patient who sustained severe knee injury while serving in the armed forces, surgery had failed to bring any pain relief. After undergoing treatments at AIPC, he found immediate relief that lasted several months. Another patient who underwent two knee surgeries didn’t get any relief because of a failed artificial knee joint. This joint was treated with minimally invasive procedures resulting in immediate and sustained pain relief; and the patient was able to walk without pain. Vesley can now wear her high heels without pain. “This is something I could have never done without my treatments at AIPC,” she says. For more information on pain treatments at Advanced Interventional Pain Center visit www.interpain.com or call 310-272-9630

Astrology
By Holiday Mathis TODAY’S BIRTHDAY (June 1). Life is a flow, and you're moving along with it better than ever this year. An act of surrender will bring you a bit of magic this month. You'll make important decisions in July affecting where and how you live. Practice and training are featured in September. October investments reap rewards in February. Cancer and Virgo people adore you. GEMINI (May 21-June 21). You'll be inspired by someone else's journey, and it makes you want to go out and try harder. Ask for help or maybe even some kind of sign to point you in the right direction. The communication lines are open. CANCER (June 22-July 22). There is such a thing as expressing emotions way too vividly. Your heart goes out to one whose feelings are amplified and on display. You have a calming, stabilizing effect on this person. LEO (July 23-Aug. 22). Your opportunity radar is in full swing. Consider your past mistakes, as they hold the clues you need to make the most of what's being presented. You'll find solutions where none existed before. VIRGO (Aug. 23-Sept. 22). You'll get a head start on a situation, but don't rely on your advantage. Remember the tor-
toise and the hare. Don’t run so fast that you burn out and need a nap. Pace yourself and avoid distraction. LIBRA (Sept. 23-Oct. 23). Some say that friendship with yourself is needed before you can be friends with anyone else. But it doesn’t always go in that order. Today, a good friend teaches you to befriend yourself. SCORPIO (Oct. 24-Nov. 21). The adrenaline rush of romance isn’t always related to another person. Today, you could just as easily fall in love with an idea, activity or story. Whatever your focus, the sensation is sweet. SAGITTARIUS (Nov. 22-Dec. 21). If you’re being offered a grim or simply uninspiring array of choices, refuse to choose. Walk out. There are better choices somewhere else. CAPRICORN (Dec. 22-Jan. 19). The attainment of lightweight goals provides little reward. Insurmountable goals can never be attained, so what's the point? Deep satisfaction comes from aiming for what's substantial and doable. AQUARIUS (Jan. 20-Feb. 18). This isn't a game show. You have the right to change your decision. It's easier to do when you don't fully commit to any option in the first place. Keep your

schedule and your mind open. PISCES (Feb. 19-Mar. 20). Authority figures might be just as clueless as the ones they’re trying to manage or lead. Your answer is as good as anyone’s, and probably a lot better, so trust yourself. ARIES (Mar. 21-Apr. 19). Some say security is illusory, and it doesn’t exist on this earth at all. To feel safe is a basic human need. You supply a feeling of safety to another person to whatever degree you possibly can. TAURUS (Apr. 20-May 20). Unlike the relationships portrayed in the media, the real issues between people usually can’t be resolved within a halfhour episode. But today’s case might be an exception. It actually could be just that simple.

Talks Books William Davidow has penned Overconnected: The Promise And Threat Of The Internet (Delphinium Books $14.95). An electrical engineer by training who earned degrees from Dartmouth, Cal Tech (where he sits on the board) and Stanford, Davidow cut his Internet teeth at Intel, Hewlett-Packard and G.E. It was ironic the day after talking with him, the latest economic debacle–J.P.Morgan Chase –surfaced. Davidow’s goal for his book was to explain “…how overconnected environments perform, feed upon themselves, and be-come unpredictable, accident-prone, and subject to contagions.” The Internet covers the globe without any universal checks and balances. He focuses on the need for more, not less regulations, since at such times the internet fosters greed and fearmongering. Dav-idow explains how Iceland’s three biggest banks failed and the value of its currency fell 75 percent when banks offered higher interest on deposits on the Internet than those in Great Britain were offering, but, to fulfill the rush of deposits, made risky investments which would not pay immediately. When depositors wanted their money and were made to wait, guess how fast that news hit the Internet. As for the Lehman Brothers’ collapse, he discovered on a trip to India that the Indian outsourcing contractor was doing due diligence on financial offerings that Lehman planned to market to investors. How safe was this?

restaurant, lounge, and eight auditoriums each with 40-45 plush seats and full meal and bar service delivered at the push of a button. The upscale theatres are currently in nine locations across the country, including one in Pasadena. Rosenstein, who sits on the Liaison committee with Commission Chair Craig Corman, Mayor Willie Brien and Councilmember Lili Bosse, said all favored the concept. “The general consensus at the end from the Liaison [meeting] is that we are all very much like the concept of the movie theatre,” he said. “The theme was, ‘The devil was in the details.’” The area of most concern for the commission deals with parking. The current proposal provides for 119 parking spaces, sufficient if the restaurant patrons are not counted separately from moviegoers. In order to determine if the restau-
cial guest appearance by Jay Leno. The Backdraft Ball is the main source of fundraising for the Post-Retirement Medical Benefit Trust Fund, which provides medical insurance to firefighters and their families post retirement. The silent auction will begin at 6 p.m. and dinner will start at 7:30. Tickets for the event are still available, starting at $1,150 for two and going for up to $6,500 for a table for 10. For more information, contact FTA Events at 310-288-1755 427 N. Canon Dr., #108, Beverly Hills, CA 90210. rant will primarily be used by people going to the movies, the Liaison committee requested empirical data from other IPic theatres about how many people are going just to the restaurant. Property owner Marc Bohbot said he anticipated that if all went smoothly, his tenant could begin construction by the end of the year and open the theatre 18 months after getting approval from the City— just in time for the City’s centennial year. “We have to address a few issues like parking,” he said. “But we have also fulfilled all the basic requests.” Rosenstein said the cost for the formal application could be substantial because the project doesn’t conform to code and would involve a General Plan Amendment and possible zone change to allow for additional height. In 2011, the applicant proposed a 78-foot building which the commission firmly opposed.

MUD SLINGERS, WASH YOUR HANDS

From the Publisher CLIF SMITH IT’S NOW US AGAINST THEM If you read the Los Angeles Times–and fewer and fewer do–you would see in its news pages article after article about the poor designs, bad safety record, and endless delays that characterize the Los Angeles Metropolitan Transportation Authority, “Metro.” Its new Expo Line, that took almost as long as the Panama Canal to build, exposes people to unnecessary dangers and has poorly designed tracks – if you believe the Times. The one place it seems the Times believes Metro has a perfect record is about building a subway tunnel under Beverly Hills High School. For years, almost everyone in Beverly Hills subscribed to the Times. Then, about a decade ago, the Times turned reflexively anti-Israel and lost thousands of subscribers here. Then, a couple of years ago the Times blasted the Beverly Hills Unified School District for refusing to take in thousands of Los Angeles Unified School District students on flimsy excuse transfer permits. The Times lost even more subscribers here. Now, its market share is approaching a measly 30 percent–down from nearly 90 percent at its peak. The Times’ coverage of the tunnel under Beverly Hills High School is a perfect example of a daily newspaper losing touch with both its readers and reality. This week, it editorialized that Beverly Hills should just quit complaining and let the tunnel come under our only high school. That editorial could have been written by the Metro press office. The Times wrote that “dangers”on Santa Monica Boulevard from a supposed earthquake fault rendered that site “unsafe.” Nowhere in its reporting or editorial was there one serious mention of risks from this supposed earthquake to sites only a few hundred or couple of thousand feet away. Since when does the impact of a major earthquake stop at the crosswalk? Nowhere in any of its articles was there one serious mention of methane gas risk. The Times’ editorial is sloppy and snarky beyond belief. It fails even to attempt to judge the facts (gee, what else is new over there?). There is an answer to this: look at the name of the newspaper. It is the “Los Angeles” Times, not “Southern California” or “Beverly Hills” Times. Except for selling advertising to Beverly Election Recommendations (Limited) Proposition 28: No. Leave terms limits alone. Proposition 29: No. We hate cigarette smoke and worry about cancer like anyone else, but this is just another tax with most of the money going to a new bureaucracy. U.S. Senate: Democrat– Sen. Dianne Feinstein; Republican – Nachum Shifren Los Angeles County District Attorney: Alan Jackson Assistant Chief Deputy District Attorney, Major Crimes Division Los Angeles County Supervisor: Second District – Mark Ridley-Thomas Third District - Don Knabe Fifth District – Mike Antonovich Superior Court: Office 10 – Judge Sanjay Kumar Office 78 – We note that four local daily newspapers–the Long Beach Press-Telegram, Pasadena Star-News, Whittier Daily News and San Gabriel Valley Tribune–have endorsed challenger, retired prosecutor Ken Hughey. The Los Angeles Times endorsed his opponent, James Otto.
Hills realtors and merchants, it has zero interest in the health or well-being of Beverly Hills or any of its citizens. While it tells us to “spend the money on the kids,” it condones the squandering of hundreds of millions on its own illiterate schools. What is their failure rate? What are their academic and graduate results? Those are a scandal. Where is that story? Nope. They are so anxious to stick it to us and our few thousand students that they tell us to get out of their way. They deride our science and dismiss our concerns. If you attended the City’s and school board’s technical presentation to the Metro Board of Directors, you would know for a fact that the science developed by the Beverly Hills USD and the City of Beverly Hills is impeccable. You would also have noted the “science” provided by Metro is shoddy, incomplete and superficial. Beverly Hills employed licensed experts–Metro did not. We now need to close ranks in this City to defend our schools and our community. This newspaper uncovered the fact that the “fix” was in on the tunnel in August 2009. Despite that conspiracy, we believed at the time and still believe that a forceful City Council could have prevented the current battle. We believe that the City Council majority forfeited any chance of changing the “fix” by its temporizing, delays, obstructions and insults hurled at the school board. Well, at least now they are in the fight and we welcome them. For those who remember World War II or know history and the disastrous appeasement policies of Neville Chamberlain, please recall that even he finally had to vote for war against Germany. (Of course, he had the decency to resign in favor of Winston Churchill whom he had long derided as “hysterical.”) The dispute now moves to the Superior Court. Thanks to the foresight and diligence of our school board, we are prepared for this fight. The Courier hopes that our community will close ranks and understand that we are not the “penny to be crushed on the tracks” like the Los Angeles Times describes us. How do you like being a “crushed penny”?
I am embarrassed! I am distressed! I am ashamed of what has happened to the process of electing the leaders who will be occupying the White House come January, 2013. The names, the reputations, the persons of the nominees of their respective political parties have been dragged through the mud of character assassination, accusations of dereliction of duty, and disqualification for leadership of these glorious United States for the past two years since we last voted. The U.S.A. has responsibly worn the mantel of leadership of the free world, and paid a heavy price in raising our national debt, and the loss of life by thousands of our servicemen and women. Now, given the political smears and jeers of our leaders and leaders to be, read and instantly viewed on TV around the world, how can we expect those others to respect our future White House incumbents? We have already spent hundreds of millions of dollars discrediting any and all would-be candidates, and are currently collecting millions more preparing for the campaigns. Oh, how jealous I am for those monies! How I wish we were using them to bolster our schools, reduce the high cost of colleges, create jobs, and save peoples homes. But, no! We’ll probably just squander them finding new ways to label candidates as unfit stumblebums. Can we put a moratorium on character assassination and let the world regain its respect for our leaders, whoever they may turn out to be? I pray –and I mean, pray- that we may come to our senses from now to November. Enough mud-slinging. Let’s go back to being what we are: the Land of the Free and the Home of the Brave.

LETTERS TO THE EDITOR Metro is a money-making outfit which will go to extreme lengths to get what it wants. Take a look at its plans for a tunnel under BHHS. It is very clear that their “friends” such as JMB Realty and others have a hand in the money pot known as the Beverly High tunnel. Metro's interests are self interest more than that of our children. What is disturbing is the children in question are ours here in Beverly Hills. I walked around BHHS this week and the students have a concern about the proposed tunnel. I live near the school and know many of the students and their families. Very few of them have even been able to talk to representatives of Metro. All anyone gets are rushed meetings with little time allowed to voice concerns. I am angry and want answers. Metro talks big and acts like a friend, but its real friends are those who have real estate value along the tunnel path. My City is not for sale and neither is yours. George Vreeland Hill ****** I commend you for your intelligent and accurate editorial. You are right on. Hopefully readers will see what you are saying. You are absolutely correct re your comments concerning the public employee unions, primarily their leaders, and what they have wrought on the economy of the states and the nation. Until this corruption on the part of the leaders–union and governmental–is corrected, we
will continue heading over a fiscal cliff. My view: only the reluctant admission–based on fiscal reality, an empty cookie jar/checkbook–by the leaders will bring change. And they will change only because they are forced to, not because they volunteer to change. Throw the rascals out! Bruce Carradine ****** “Great” article in The Courier last Friday. You should be proud of yourself. Why don't you continue to separate BH from all of Los Angeles by building some sort of fence around it? That way, the people of your little City can only interact with one another. Why are you trying to divide the classes? Why do you think the BHUSD should spend millions of dollars in legal fees to fight the MTA, and at the same time lay off teachers due to “lack of funds”? Safety of the students should be of the utmost importance, and I appreciate that is your concern, but please get off your high horse thinking that Beverly Hills is such a great place. The political environment of BH is just as screwed up as the one in L.A., it's just not as known due to the small population. Thanks for making me ashamed of being a resident, and being affiliated with the type of people who think they are better than others based on the money they have in their bank account.
