By Marla Schevker Despite freezes on rank-andfile city workers, the Beverly Hills City Council last night tried to give City Manager Jeff Kolin a 2 percent cost-of-living pay hike without debate or discussion. The item, showing up only on last night’s consent calendar, gives Kolin an increase of $5,610 to his $280,499 annual salary. The raise also increases his pension payout. Reform Vice Mayor John Mirisch told The Courier he would pull the item off the consent calendar and force a debate on it. Mirisch said, “We’re faced with tremendous economic chal-
lenges and leadership needs to show their willingness to make sacrifices and change the system.” Under his employment agreement with City, Kolin's salary is reviewed annually. The increase, however, is not required under the agreement. The discussion of Kolin’s raise fell on the same night as the City Council’s discussion about the City budget. In the proposed 2012/13 budget, the police department will be taking a $253,300 cut and the police administration a $23,600 cut.
The Beverly Hills City Council refused to go the extra mile yesterday to stand up for Beverly Hills High School against the Metropolitan Transportation Authority. The City Council refused to write a resolution dictating, in no uncertain terms, that Beverly Hills’ support for the Westside Subway Extension is
predicated on the alignment not going underneath Beverly Hills High School. Vice Mayor John Mirisch requested the City Council write a new resolution in light of the Metro Board of Directors approving the Constellation Boulevard station location and tunnel underneath (see ‘RESOLUTION’ page 22)

It can be seen with certainty that there is no possibility that the adoption and implementation of the Ordinance may have a significant effect on the environment. A Final Environmental Impact Report including the Draft Environmental Impact Report and Comments and Responses has been prepared for the Gateway project. Updated technical studies have also been prepared to document any changes in impacts associated with the proposed Overlay zone for the three parcels at 9900 Santa Monica Boulevard, 9844 Wilshire Boulevard and 9817 Wilshire Boulevard and the immediately adjacent commercially zoned properties. The Planning Commission held several hearings on this project and has recommended certification of the Final EIR and adoption of a mitigation monitoring and reporting program, adoption of the General Plan Amendment; adoption of the proposed Overlay Zone; and adoption of a statement of overriding considerations finding that the benefits of the project outweigh any adverse environmental impacts. Copies of all relevant material, including the project specifications, the environmental initial study and all documents referenced in the EIR are available for review in the offices of the Community Development Department of the City of Beverly Hills. At the public hearing, the City Council will hear and consider all comments, and may introduce the ordinance. All interested persons are invited to attend and speak on this matter. Philanthropist Audrey L. Wilder Dies At Age 89 Oscar-winning movie, The Lost

Wilder, wife of legendary movie writer/director Billy Wilder (Sunset Boulevard, Double Indemnity, Some Like It Hot, etc.), died May 31 at Cedars-Sinai Medical Center after a long illness, according to her longtime friend Jolene Brand Schlatter. She was 89. Born in Los Angeles on Oct. 30, 1922, Audrey Young was a singer with the Tommy Dorsey Orchestra and was under contract with Paramount Pictures when she met her husband in 1944 on the set of his
Weekend. The couple eventually married in 1949 and were together until his death in 2002. The following year she donated $5 million to the UCLA Hammer Museum and the UCLA Film and Television Archive which subsequently named The Billy Wilder Theatre at the Westwood museum in his honor. She also established the Billy and Audrey L. Wilder Foundation as the basis for their many charitable contributions. Audrey Wilder was interred yesterday at Pierce Brothers Westwood Village Memorial Park adjacent to her husband.

BHHS Band To Hold Fundraiser For London Trip By Matt Lopez Two months ago, the Beverly Hills High School Marching Band received the honor of an invitation to participate in the prestigious 27th New Year’s Day Parade/Festival in London
in January 2013. Now, the band needs a little help making the trip a reality. On June 14, the band will hold a special fundraising event on campus next to the

Pirates Clinch Little League Majors Championship The Little League Majors team the Pirates finished its undefeated season by winning the championship, 5-3, over the Cardinals Tuesday at La Cienega South ballpark. Manager Tom McLarnon

Worker Death Prompts City To Act By Laura Coleman In the wake of a construction worker’s death last month at a Benedict Canyon home, the City is increasing efforts to educate residents about the importance of using a licensed contractor. On May 10, Baron DeJesus Lopez-Orozco, 23, was exca-

Himself a golfer par excellence, John auctioned off the golf package for $7,000 to Stephen Taylor, the entrepreneur based in Los Angeles and in the Chicago area where he and his family manage major investments.

f ever in need for an emcee, John O’Hurley is as good as it gets. This time around, he rocked the crowd of 800. His quick Irish wit, informative repertoire and manup personality had our Share ladies remembering that John’s followed in the hallowed Boomtown footsteps of emcees Johnny Carson, Bob Hope, Frank Sinatra. A favorite on Dancing With The Stars, Family Feud and Seinfeld, John’s appeared in other shows too numerous to mention, including hosting the National Dog Show on Thanksgiving Day since 2002.

Missoni Boutique Leaves Beverly Hills By Laura Coleman Missoni’s abrupt closure last Thursday of its distinctive 7,500-square-foot flagship Rodeo Drive boutique has local market experts surmising that the retail space was too large for the brand. U.S. Missoni representatives were tight-lipped on the reasons for closing the shop at 469 N. Rodeo Dr. after just two years.
A typed note posted on the inside of the door read: “Closed due to dispute with landlord.” Designed by David Chippenfield with a white woven aluminum ribbon facade and opened in Feb. 2010, the Italian luxury store received the Rodeo Drive Walk of Style award last year. Seminar To Discuss Treatments For Enlarged Prostate Dr. Robert Reiter, professor of urology at UCLA, will present and discuss the latest outpatient laser treatment for benign prostatic hyperplasia (BPH) or enlarged prostate at a free seminar from 6-7 p.m., Tuesday June 19 at the Ronald Reagan UCLA Medical Center Tamkin Auditorium, 757 Westwood Plaza. BPH is a condition that affects more than half of men over 60 and can lead to frequent, painful or weak urination. The new outpatient treatment, called GreenLight Laser Therapy, utilizes a new XPS laser that effectively removes enlarged prostate tissue to help open the urine channel to improve flow. The 2010 filing omitting all data for the Santa Monica Boulevard location was prepared by Parsons and Brickerhoff, the same firm that wrote the report finding earthquake faults there. The risk assessment predates all socalled Metro “fault studies” of Santa Monica Boulevard by more than one year and even pre-dates Metro’s draft Environmental Impact Report, which was released in September 2010. It is thus clear that at no time has Metro ever filed any papers with federal authorities that studied or considered a station on Santa Monica Boulevard despite constant public statements to the contrary by Metro Chief Art Leahy and directors L.A. County Supervisor Zev Yaroslavsky and L.A. Mayor Antonio Villaraigosa. The implication is inescapable that the so-called “safety” issue was always a diversion. Without supporting documents for alternative stations, no federal agency would consider those alternatives. The submitted document proves that Metro never intended to consider any location except Constellation in Century City, despite discussing multiple stations in other areas. The contrast with a proposed Westwood station location is clear. On page 3-3 of the report, it states the Westwood/VA Hospital Station has two alternative station locations… both which were “being evaluated as a part of the EIS process but the station south is the Metro currently

preferred alternative.” Comparatively, despite the Century City Station also having two alternatives… “only the Century City (Constellation) Station is currently in the estimate.” There was no explanation as to why Metro was only considering the Constellation Station, only that it was the preference and the other station was not being considered. The explanation came over a year later with the fault studies. Attorneys for the Beverly Hills Unified School District uncovered the Metro filings in Washington, D.C., and they form part of the District’s California Environmental Quality Act lawsuit against Metro.
They said this proves that Metro had a direct bias towards Constellation, showing they weren’t serious enough about the Santa Monica station to include it in the federal paperwork. In the New Starts Financial Assessment on the LACMTA Westside Subway Final Report, by the FTA from March 14, 2011, only the recommended option for each station was taken into consideration for funding. Although the Santa Monica Boulevard station has proven to be almost $100 million less than the Constellation Station through Metro’s own estimates, these figures were never given to the FTA.

Jarvis Turner’s boys basketball team took the stage to accept the award for “Team of the Year.” This year’s boys basketball team made one of the best runs in program history to the CIF Southern Section Division IIIAAA semifinals before losing to eventual CIF champion Pasadena.

Prop 29, the initiative to tax cigarettes an additional dollar per pack to fund cancer research lost by 1.4 percent of the vote. Voters chose to limit legislators’ terms in office with 61.4 percent voting for Prop 28. Voters helped shepherd incumbent Sen. Dianne Feinstein back into office with 49.3 percent voting for her to return to the Senate over Republican contender Elizabeth Emken. All county supervisors up for re-election retained their seats, with 2nd District’s Mark Ridley-Thomas and 4th District’s Don Knabe both running unopposed. In the 5th District, Michael D. Antonovich nabbed 79.4 percent of the vote. Nearly 80 percent of Republicans chose Mitt Romney.

When recalling the history and glamour of the resort destinations in the Coachella Valley, Desert Hot Springs is mentioned as an afterthought, much like an unwanted stepchild. But two, not unrelated things, have made it unique. One is the superb quality of its water … hot and cold; the other is Cabot Abram Yerxa. The son of Frederick Yerxa, owner of the largest mercantile business in Boston at the turn of the 20th century, and named after his maternal uncle and Massachusetts Brahman, Henry Cabot Lodge. At age 16, Cabot traveled to Alaska to sell Yerxa cigars, his family’s brand. There he immersed himself in Inuit culture and language, (he also spoke Sioux, Spanish, English and French), and wrote the first InuitEnglish dictionary, now on display in the Smithsonian Institute. Cabot’s family lost its fortune in 1913 and after years of wondering the young man found his way to the Desert where he homesteaded 160 barren acres, now part of Desert Hot Springs. There, as the story goes, an Indian approached Cabot’s campsite and, drawing a map in the sand, told the new arrival where to find water. Imagine his surprise when he drilled his first well and up bubbled hot water. Then, he drilled a second about 600-yards away and the water came up cold. Cabot could have been quite content to rest on his accomplishment of finding hot and cold running groundwater. After all, he had become a living legend in the city he helped create. But, at age 57, Cabot began building an artist compound, named Cabot’s Old Indian Pueblo. Today, this is the site of Cabot’s Museum. However, unlike most museums which erect a building and mount their collections on the interior walls, or display artifacts in cases, Cabot’s Museum, which was his home until his 1965 death, is all a preserved bit of history … from buildings and furnishings, mostly hand-made, to the tins of food on the shelves. The museum has been spruced up and open for visitors. Earlier this month, the sixth annual Celebration & Barbecue was held, not only in recognition of Cabot but saluting those who have supported the museum and the Desert community. Under the guidance of honorary co-chairs Barbara and Jerry Keller, the event honored Donna and her late husband, Cargill Mac Millan, Jr., Rep. Mary Bono Mack and museum volunteer Barbara Maron. Also remembered at this western-attired event were two major supporters who passed away since last year’s barbeque: Jackie Lee Houston, the queen of Desert philanthropy and Richard Milanovich, the chairman of the Agua Caliente Band of Mission Indians. TWO GUEST EDITORIALS Why I Voted ‘No’ By Lili Bosse Beverly Hills City Councilmember Our City Council has spent the last month analyzing the $375 million operating budget and $41 million capital improvement program for fiscal year 2012/2013. Four meetings took place to allow staff and department heads the opportunity to present their proposed budget and requested budget enhancements. The “budget,” as people think of that word, causes most of us to cringe as our nation's and local economy have been mirroring our local issues of skyrocketing pension costs and attempts to find innovative ways to boost the economy. Our wonderful City has had a positive year. Our hotel tax dollars (“Transient Occupancy Tax”) have increased significantly, and our revenues have experienced growth. All in all, it's been a great year for us financially. With our centennial year approaching, I am optimistic that the best is still yet to come for our City. That's the good news. The rain on the parade took place at our City Council meeting yesterday. I had to vote “no.” “No” to new staff hires at $163,900 annually, “no” to another parking service manager at $94,100 annually, “no” to the $10 million public works warehouse that will not benefit our residents or business community and lastly, “no” to a cost of living increase for our city manager's $286,110 base salary when our beloved public safety employees sacrificed theirs this year . . . they said “no.” Yes, I voted “no.”
Why I Voted ‘No’ By John Mirisch Beverly Hills Vice Mayor While we’ve made some moves in the right direction over the past years, this year’s budget stops well short of the systemic changes that need to be made within our City’s bureaucracy. Perhaps this shouldn’t surprise us. Bureaucracies, by definition, often seem to be agents whose main goal is to protect the institutional status quo. In the context of this year’s budget, our past efforts seem to be “nibbling around the edges,” almost in the hope that things will get better and we can go back to the old ways with unsustainable salaries and benefits. This year’s budget increases the number of full-time employees at a time we should be looking to reduce staff and increase efficiencies. I have been pushing for significant pension reform for over three years, both at the City level and at the state level in my role as a member of the League of California Cities Employee Relations Policy Committee. Again, while we have made some progress here, it seems we’re trying to do just enough to get by until the economy recovers so that the system can go back to “business as usual.” Yet if anyone had any doubts about both the need and the public’s desire for true and meaningful pension reform, one only needs to look at this week’s election results in both San Diego and San Jose. In both cities, by landslide margins, residents overwhelmingly voted to fix a system which was both unsustainable and placed an undue burden on those cities’ budgets. Rather than offer some of the rich public pensions that are not available anywhere in the private sector, new hires will be put on 401k-style pension plans – like most of the rest of us. Isn’t it time that we also get with the party? In the meantime, the City’s bureaucracy continues to treat our residents like ATM’s. The city manager will likely get a 2 percent salary increase this year, with the justification that 2 percent matches the CPI index. And yet if inflation is “only” 2 percent, why are we increasing our water rates 14 percent over the next two years – after already having raised them by more than 50 percent in the last few years? I don’t have a problem if we overhaul the system in a gradual and deliberate fashion, but this year’s budget does not seem to me to be a step in the right direction. Increased staff, increased salaries and benefits, and increased fees to the residents are, in my opinion, simply bad policy and I cannot vote for a budget which both avoids necessary systemic changes and which continues to treat the residents like ATM’s.

Rabbi Jacob Pressman LET’S TAKE A TRIP THROUGH TIME For the benefit of any youthful readers of this column, may I add some words that have begun to drop out of your vocabulary? There used to be something called “smog.” The atmosphere above greater Los Angeles was thick with pollution. It hung over the basin like a malignant cloud causing us to weep because of the way it stung our eyes. There used to be a news announcement daily as to the degree of the smog for the coming day. Happily, it is no longer a part of your vocabulary because it is now gone. A word in more common usage was “graffiti.” Every available wall was painted with symbols and mottos and invective so that the whole basin was almost an anthology. The graffiti is mostly gone now, except for an occasional beautiful work of art done by some gifted anonymous person, and one may walk through the area without fear of being offended by profanity or hate slogans. “Hollywood”, formerly peopled by aloof and unapproachable movie stars, now means a number of motion picture and television actors and actresses who devote enormous amounts of their time and money to wonderful works of repairing the torn places of the fabric of our society. Almost every prominent star has associated himself or herself with some worthy cause for which he or she invests a great deal of time and money. “Spanish”: As the number of our Latino citizens grew, Spanish has become a very respectable first or second language, and the Latino influence in the world of commerce and creativity has grown. Spanish language TV and radio stations are on the air, and commercials are as likely to be in that language as in English. Open-air streetcars we called “trolleys” crisscrossed the area and provided delightful and scenic rides almost everywhere. One could travel from downtown Los Angeles to Santa Monica on an open trolley, breathing in the pure air and enjoying the changing neighborhoods through which they ran. They were used not only for business and visiting, but for sheer pleasure. I suspect that the auto industry had an unseen hand in getting rid of the people-friendly transportation and replacing it with the glut of automobiles and trucks which now make our not very free freeways a multi-lane parking lot at rush hour. Oh, for the good old days.
LETTERS TO THE EDITOR Congratulations to the Los Angeles Times for finding the only resident to write that Beverly Hills is against the subway. Here is the letter I wrote to the (Times) editor, which did not get in the paper......ummmmm I wonder why! Mark Elliot, your head is buried in the sand. Do you see any sign in Beverly Hills saying “No subway?” Of course not! Everyone I've spoken with do not want a subway under the school. No, I haven’t spoken to all 35,000 residents, but a lot of my colleagues have also talked to people. I don’t know anyone that wants the subway under the school, except, maybe an attorney or two who can profit from the real estate investment. We are not against the subway. Originally, the subway was to go down Santa Monica Boulevard. That was a great location. We just don’t want our kids in harm’s way. I think, Mr. Elliot, you should take your head out of the ground and read what is really going on! Sherry (Berk) Tedeschi ****** Several months ago, Marta Waller wrote a piece in The Courier warning about “Smart Meters” which I just read and agree with 100 percent. I received a letter from Southern California Edison on Tuesday stating that (1) because I had been placed on the opt-out list back in 2011 and (2) because I refused to let them change my meter on my 17-year old home, Edison is now–with the blessings of the CPUC–charging me $75 (a one-time opt-out fee which really is some kind of way to tax me), and have to pay $10 per month extra so a meter reader can swing by and read the meter. I mentioned the fact a meter reader has come by every month during those 17 years. I thought I had already paid monthly for that service, having previously been told once when I questioned my billing. Interestingly, “Smart Meter” customers do not have to pay anything–monetarily, that is. In the long run, they are giving up precious freedoms, and, don’t even know it. I am going to pursue this.
