AN ORDINANCE OF THE CITY OF BEVERLY HILLS AMENDING SECTION 10-3-3107 OF THE MUNICIPAL CODE REGARDING DEVELOPMENT STANDARDS FOR ROOFTOP USES. The proposed ordinance would allow for unenclosed architectural features to be constructed up to 15 feet above the adjacent roof deck without requiring a setback from the edge of the building, subject to review by the Planning Commission. Current code allows architectural features to be constructed up to 15 feet above the adjacent roof deck, but they must be set back from the edge of the building by an amount equal to the height of the architectural feature. The ordinance would also clarify the types of rooftop structures/uses that can be permitted in conjunction with a rooftop lunchroom. Current code allows the construction of rooftop lunchrooms, if approved by the Planning Commission, but does not specify the types of ancillary uses that may be included in rooftop lunchroom structures. This ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The City has determined that the ordinance will not have a significant environmental impact and is exempt from CEQA pursuant to Section 15305 of Title 14 of the California Code of Regulations. At the public hearing, the City Council will hear and consider all comments. All interested persons are invited to attend and speak on this matter. Gov. Brown’s Preliminary Budget Offers Ray Of Hope For Beverly Hills Unified School District By Laura Coleman Sacramento’s latest funding formula is expected to yield $800,000 a year for the next four years for the Beverly Hills Unified School District as a result of the passage of Proposition 30 last November, Superintendent Gary Woods confirmed to The Courier.
“We’re still combing through the fine print,” he said. “The only positive thing I can say now is that it looks like we’re being held harmless for anything deeper.” Gov. Jerry Brown is expected to finalize the $96.3 billion state budget on July 1. However, Woods cautioned that fur-
ther amendments could trickle down and subsequently shift the approximate forthcoming funds. Board of Education Member Brian Goldberg said the “good news” is an opportunity for the district to think strategically on how to best use the funds.

On Tuesday afternoon, hundreds of Brazilians lined up at the corner of Wilshire and La Cienega Blvd. outside the Flynt Building where the Brazilian Consulate is located. It was one of 55 rallies set up in major cities all across the country. hen the American Film Institute honored director John Huston with its eleventh Lifetime Achievement Award at The Beverly Hilton in 1983, Ava flew in for the tribute. John directed her in 1964 as the blowzy hotel owner Maxine Faulk in Tennessee Williams’ The Night Of The Iguana. They filmed on the coast of Mexico with Richard Burton playing a defrocked Episcopal priest. Critics lauded Ava’s performance.

ohn came by our table after the AFI honors and the many wonderful recollections about his life from the celebrated guests. We congratulated John, who we’d written about a number of times and who became one of our favorite noholds-barred interviewees, along with Peggy Lee and Truman Capote. Steven Emerson, a pro-Israel activist, entrepreneur and philanthropist, was awarded an honorary doctorate from the Technion-Israel Institute of Technology this month in recognition of his devotion and generosity to the university. Perhaps no vehicle at Sunday’s event personified the theme of “The Jet Age” more than Grundfor’s jet-powered vehicle. “All the big tail fins you see at this show, started with ‘Gilda’, so it’s one of a kind,” Grundfor said. “Nobody is more worthy of Best of Show than Scott,” Rodeo Drive Concours Chairman Bruce Meyer said. The Streamline X Coupe was just one of hundreds of extremely unique cars that tens of thousands of visitors got to view Sunday. Another crowd-favorite was Tonight Show host Jay Leno’s 1963 Chrysler Turbine-powered biodiesel car, one of only two in the world. “I don’t think there’s anyone on planet earth who supports the hobby more than Jay,” Meyer said. Leno’s unique Chevy Turbine won the Jet Age Award. “Anybody with the hair the same color as mine remembers those when we were kids, it was sort of the car of the future. Said within all 10 years all cars would be turbines and all that stuff, but it never quite worked out,” Leno said. “But it was a pretty cool idea.”

It was no surprise that Barris’ Batmobile won the “Rockstar Award” for Most Outrageous. “I know Batman will be happy to know about this,” Barris joked. “This is a happy car. We made it a people car.” Rodeo Drive Committee President Jim Jahant told the Beverly Hills City Council on Tuesday that Sunday’s event was one of the most successful in the event’s history. Jahant said the committee estimated that some 30,000 people lined the streets Sunday for the Concours. Mayor John Mirisch kicked off the afternoon awards ceremony by presenting the Mayor’s Award for Most Elegant to Tony Hart for his 1931 Cadillac. “What you’re seeing today is actually incredible. It has become a six-hour curated museum exhibition that is fun, elegant, historical and with this year’s Jet Age theme, very forward-thinking,” Mirisch said. The Jet Age theme was, of course, based around Flexjet’s brand new Learjet 85, which was parked on Rodeo Drive.

This is the same council majority that voted to increase the water rates. It seems to be standard operating procedure – stick it to the residents.” Vice Mayor Lili Bosse, who voted against the last two fiscal year budgets, called the budget a step in the right direction. “I’m pleased the enhancement requests are primarily deferred maintenance issues. I agree with the Mayor there are concerns about staffing and benefits,” Bosse said. “Some of the issues we’re unable to change at this moment, because we have MOUs.” One step the City did take toward curbing some of its un-
funded liabilities was voting to spend $1 million to pay down unfunded OPEB medical liabilities and another $1 million to pay down PERS unfunded liabilities. “That is absolutely a step in the right direction.” Bosse said. Major change could be on the horizon, as the City voted to fund a pair of $50,000 studies, one on effects of 2-hour free parking and another on Beverly Hills public employee salary and benefits compared to that of the private sector. “There are some very good things in the budget, but it missed the big picture, salaries and benefits. True, there are some limitations related to MOUs, but we still have latitude we haven’t taken when it comes to staffing levels,” Mirisch said. “I’m certainly not suggesting reducing services, but doing more with less rather than less with more.”

Beverly, which Rodeo Drive Committee President Jim Jahant tells The Courier is nothing short of a horrible idea. “It’s a problem because if customers can’t turn left there, they’re going to have to turn left on Beverly Drive, right on Brighton way, right on Rodeo, right on Little Santa Monica, and right to get into the alley,” he explained. “Think of all the trucks that use that alley for deliveries…that’s going to force more traffic onto Rodeo Drive which is already backed up with tourist buses.” To add insult to increased traffic woes, Assistant City Manager Mahdi Aluzri told attendees at yesterday’s Government Affairs Committee meet-
ing that three proposed metered space bring garner just $15,000 per space in annual revenue, if parkers don’t use placards that exempt them from feeding the meter. “There’s enough controversy that it will go to the City Council,” Aluzri said. Earlier this month, the Rodeo Drive Committee, which is made up of some 80 retailers, landlords and hotels, sent a letter to City Manager Jeff Kolin emphasizing its “vehement” opposition to removing the left turn lane and underscoring that “tenants and landowners in the area are in total opposition to the measure.” On Mar. 21, the City at its own expense conducted a sixhour study of the legal left turn lane. The study found that on that particularly Thursday, over 117 vehicles used the left-hand turn lane during three 2-hour “peak” blocks of time. Aluzri said he was unable to “ballpark” the cost to conduct the study but would investigate the matter further and respond to The Courier next week. Aluzri said that further studies would be done at the expense of two property owners requesting the installation of the meters. The owners are represented by former Beverly Hills Mayor Steve Webb who declared at yesterday’s meeting that he was not a lobbyist.

Millions of people each year have polyps successfully removed during colonoscopies. But when a suspicious polyp is bigger than a marble or in a hard-to-reach location, patients are referred for surgery to remove a portion of their colon — even if doctors aren’t sure whether the polyp is cancerous or not. Since only 15 percent of all polyps turn out to be malignant, many patients are unnecessarily subjected to the risks of this major surgery. Now there is an alternative. A UCLA team of surgeons and gastroenterologists has been performing a new, minimally invasive procedure to remove large and hard-to-reach polyps while keeping the colon intact. recently passed legislation mandates that all babies born in California hospitals be screened for CCHD starting July 1. “This test enables us to discover critical congenital heart disease in some babies at a time when they are not yet showing any other signs or symptoms,” said Dr. Jeffrey Smith, a professor of neonatology at the Mattel hospital who oversees screenings there. “Early detection gives the baby the best chance for a good outcome.” The simple, non-invasive, low-cost test takes only a few minutes to perform. UCLA researchers are seeking adults 18 and older with mild to moderate facial acne, for a study about the effects of Vitamin D on the skin and immune system. Our oldest boy is extremely aggressive and seems to be taking his anger out on his 5year-old brother. My wife thinks it’s no big deal just normal brotherly roughhousing. I am concerned. The 5-year-old is small and cannot defend himself. I work full time and my wife is a part-time teacher. Do you think I am over-reacting or do we have a real problem with our oldest and youngest boys? Simon U. A. Dear Simon: a new study out this week in the Journal Of Pediatrics addresses the findings from a national survey of children and their caregivers. It found that, just like bullying by peers, bullying by siblings causes significant mental distress and worsens the victims’ emotional health. Bottom line: The authors concluded that parents, pediatricians and the public should treat sibling aggression as potentially harmful, and not dismiss it as normal, minor, or even beneficial, and this message should be included in parenting education. Simon, you need to take your gut intuition seriously. There is a power differential between a 5-yearold and a 13- year-old. If you allow the little one to get pummeled he is likely to either become depressed or go to school and find a smaller child to displace his anger on. Steps Parents Can Take To Address It: 1) Have an open family discussion about equal love for each of your children and establish zero-tolerance for hurting each other with our hands or our words. 2) Define acceptable and unacceptable behavior in your family. 3) Set clear firm rules and consequences for unacceptable behavior. 4) Establish special time with each child individually to build upon trust and bonding. This also helps diminish sibling jealousy and rivalry.

His reaction and response will be your first indicator of how this scenario will play out. The procedure, which combines two minimally invasive techniques, has currently been performed at only a handful of medical centers in the U.S. In the June issue of the journal Surgical Endoscopy, the UCLA researchers present their experiences using the new technique—known as CELS, for combination endoscopy and laparoscopy surgery— and offer the first comparison of the new technique and standard surgery. “The CELS approach combines the best of minimally invasive techniques and may prove to be a viable option for select patients,” said senior author Dr. James Yoo, an assistant professor of surgery and chief of the colon and rectal surgery program for the UCLA Health System and the school’s David Geffen School of Medicine. The new technique starts out like a colonoscopy, with a gastroenterologist advancing an endoscope inside the colon. The endoscope, a device with a small video camera and a light attached, lets doctors look inside the body cavity. Once a polyp is in sight and the gastroenterologist is ready to remove it, the surgeon uses minimally invasive surgical tools, inserted through two to four tiny incisions in the abdomen, to carefully maneuver and manipulate the colon, allowing the gastroenterologist better access to the polyp.

And for the relationship to continue grow and be strengthened, Seligmann added, “Most importantly, we have to begin to trust each other. We have to really understand that it’s in our enlightened self-interest to do this together.”

“You’re Gonna Miss Me When I’m Gone,” is the musical sentiment that comes to mind upon the announcement that after more than two decades of high-energy, vaudeville-style entertainment, The Fabulous Palm Springs Follies will be closing its doors forever after the upcoming 2013-2014 season, opening Nov. 1. By the time co-founder, producer and master of ceremonies Riff Markowitz – who has never missed a single Follies performance since its premiere in 1992–takes his final bow, more than 3 million patrons will have attended at least one presentation of the Follies celebrating the music and dance of Mid-Century America with a cast ranging in age from 55 to 83. Known for its incomparable, lavish Broadway-caliber production numbers, the Follies not only employs a staff of more than 100 on-stage and back-of-the-house talent, but has on more than one occasion been credited with saving and revitalizing downtown Palm Springs by creating an attraction that literally has theatergoers arriving by the car and bus loads to line up outside the historic Plaza Theatre before every performance. It was even the subject of an Academy Award-nominated short-subject documentary. The Follies have never done things by halves and Markowitz has stated that the 23rd season will feature a “greatest hits” version of the show highlighting the best dance production numbers and variety acts of past years along with three iconic headliner (to be announced) packed into one last spectacular season. Knowing Markowitz, it will be a fitting and exciting last hurrah. Then there is the question of what to do with the historic Plaza Theatre. Opened in 1936 for the world premiere of the motion picture Camille, with Greta Garbo reportedly in the audience, the Plaza has also featured performances by such stars as Bob Hope, Bing Crosby and Frank Sinatra. Talks are now underway between Palm Springs International Film Festival Chairman Harold Matzner and Palm Springs Mayor Steve Pougnet concerning a retrofitting and ways to insure that the Plaza Theatre continues to be an attraction in its own right. Every evening and matinee performance of the Follies’ The Last Hurrah! Is sure to be a sellout. The performances will run from Nov. 1 to next May 18. Honestly, I did not expect to enjoy the movie but figured, what the heck, I’ve got to see at least one zombie flick and, besides, my wife promised she would hold my hand. Not only did she hold my hand, but punched it, squeezed it to the bone and, with her nails, permanently scarred it. To say the action sequences of thousands of zombies coming to life and climbing over and on top of each other as directed by Marc Foster are intense is like saying driving the 405 is a breeze. Brad Pitt has his hands full as a former UN operative who must travel throughout the world to stop the onslaught of the dead brought back to life from taking over the universe. Based on the novel by highly imaginative, Max Brooks, the film moves at breakneck speed with zombies scourging the earth and its inhabitants. The absurdity, notwithstanding, it is highly entertaining and never lets up. Unfortunately, as all good things, the excitement cools off near the end and leaves you with a feeling that Pitt and his production staff didn’t exactly know how to bring WWZ to a satisfying conclusion. Regardless, World War Z is the best zombie movie I have ever seen and recommend it to those who are not sissies like me, to go and appreciate the special effects and Foster’s sure handed direction. Contractors may submit prequalification packages during regular working hours on any day that the offices of the CITY are open. The hearing shall be conducted by a panel consisting of three members of the Department of Public Works & Transportation senior management staff (the “Appeals Panel”). The Appeals Panel shall consider any evidence presented by the Contractor, whether or not the evidence is presented in compliance with formal rules of evidence. The Contractor will be given the opportunity to present evidence, information and arguments as to why the Contractor believes it should be pre-qualified. Within one day after the conclusion of the hearing, the Appeals Panel will render a written determination as to whether the Contractor is prequalified. It is the intention of the CITY that the date for the submission and opening of bids will not be delayed or postponed to allow for completion of an appeal process.
The CITY may refuse to grant prequalification where the requested information and materials are not provided by the due date indicated above. There is no appeal from a refusal for an incomplete or late application, but re-application for a later project is permitted. Neither the closing time for submitting prequalification packages for this Project will be changed in order to accommodate supplementation of incomplete submissions, or late submissions, unless requested by the CITY in its sole discretion. In addition to a contractor’s failure to be pre-qualified pursuant to the scoring system set forth in the prequalification package, a contractor may be found not prequalified for either omission of or falsification of, any requested information. Where a timely and completed application results in a rating below that necessary to pre-qualify, an appeal can be made by the unsuccessful Contractor. An appeal is begun by the Contractor delivering notice to the CITY of its appeal of the decision with respect to its prequalification rating, no later than two business days following notification that it is not prequalified. The notice of appeal shall include an address where the Contractor wishes to receive notice of the appeal hearing. Without a timely appeal, the Contractor waives any and all rights to challenge the decision of the CITY, whether by administrative process, judicial process or any other legal process or proceeding. If the Contractor gives the required notice of appeal, a hearing shall be conducted no earlier than five business days after the CITY’s

ABROGATION / NULLIFICATION By Robert K. Tanenbaum In 2008, the people of Beverly Hills in a special election voted to approve a school bond issue designated Measure E. The ballot statement provided, inter alia, in relevant unequivocal terms the following proviso: “To provide safe and modernized school facilities . . . the Beverly Hills Unified School District shall issue bonds at legal interest rates subject to mandatory audits, independent citizens oversight without an estimated increase in tax rates.” The bond was valued at $334 million. During the course of the 2008 election Measure E campaign, the Board of Education representatives promised and recited with precision the ballot language, time after time, both at public forums and memorialized in campaign literature, that there would be NO increase in our property tax rate. Many of the voting public relied on that promise and cast their ballots given that assurance approving Measure E. That was then–but, now, BHUSD officials seek to accelerate the bond payment schedule that will trigger an increase in our property tax rate. At present, our property taxes are set at $49.71 per $100,000 of assessed value. On Tuesday, June 25, the school board plans to vote to increase in our property tax rate from $49.71 to $114 per $100,000 of assessed value. The title: “June Gloom” has usually been attached to this month. After “April Showers” and “May Flowers” along came “June Gloom.” It was a month of low temperatures and overcast skies–whetting our appetite for a warm summer. This year has been unpredictable in many ways, including a very ungloomy June. In fact, it has been a month of very high temperatures and sunny skies. The sustained heat has made our forests bone dry with the resultant raging forest fires in the West and floods in the East. It makes me wonder: what kind of July shall we have? The fact is that weather is always changing, and what happens in the Los Angeles basin can be affected in what happens in Japan or Alaska or wherever, and these influences are affected by what happens still elsewhere. I cannot tell you how many times I was engaged to perform a garden wedding ceremony in “sunny” July, only to have it rain heavily that day and that day only. I vividly recall one Sunday in June years ago when a groom, who would one day head a local television station, invited me to perform his wedding at a friend’s beach house in Malibu. I brought along my portable Huppah (wedding canopy) and erected it on the porch of the house. It was a very romantic setting. However, just as the couple was ready to march to the Huppah, it suddenly began to drizzle. We bustled about, taking down the Huppah and arranging it indoors. The minute we were ready the sun burst out over the ocean. The groom begged me to reset the Huppan outdoors. We did. And would you believe it ? The minute we were ready it began to rain again, heavily. Down went the Huppah and we fled indoors where the service finally took place accompanied by the clatter of the raindrops. I wish I could say that all this bustle resulted in a peaceful marriage but it did not. They were divorced not long after, leaving me with conflicting memories of a day in unpredictable “June Gloom” many years ago.

The fundamental operating coherent which underlies our political and civic institutions as well as our personal relationships is that concept we call credibility/trust. Today, more so than in recent memory, those responsible for maintaining the integrity of our institutions have too often betrayed the trust reposed in them by the people. We witness it on a national level and now here at home in our City. If the Board of Education membership believes in good faith that the acceleration of the payment schedule of the Measure E bond issue is necessary, then each board member owes it to the people of our City to put their latest proposal on the ballot and have it undergo campaign scrutiny and potential approval by our voting residents. We expect our Board of Education members to reflect the highest standards of conduct as role models for our children and for all our people. Certainly, we are a moral people; we try to institutionalize virtue. To so engage, enhances not only the dignity of our institutions but adds immeasurably to the quality and character of us all. Almost 50 years ago, President Kennedy was to deliver his last planned speech in Dallas. The last words of that address are especially appropriate relative to this school board crisis: “Except the Lord from the city and the watchman waketh but in vain.” Editor’s Note: Mr. Tanenbaum is a former mayor of Beverly Hills
WHAT THE SCHOOL BOARD FACES
By Lewis Hall My colleagues and I know that school-age children in the Beverly Hills Unified School District who do not or cannot opt for private or home school are legally required to enter one of the five campuses that we represent as trustees. We have a moral obligation to make our schools as safe as possible and to correct any and all deficiencies. And we have an obligation to do this as quickly as possible. Lately, your school board has spent many hours in study sessions and ad hoc meetings with consultants and architects to shape a plan that meets the needs for all schools within the budget that Measure E provides. We have produced an 80-page informative that was inserted in this newspaper and distributed to over 17,000 residents. We have conducted four public meetings to explain the plan and the need to complete construction on the school facilities as quickly as possible. Also, we have listened to concerns of the residents and we appreciate the strong support we have received. Voting to accelerate the bond is a difficult decision and requires a choice between something bad (increasing property taxes) and something worse (leaving our students in substandard facilities). We were elected to make not just the easy decisions but the hard ones too. Board members have made two trips in the last two weeks to Sacramento to testify before the Senate Education Committee in support of our Measure E bond. Obviously, we care about the students AND we care about the community. We regret the controversy about the tax rate and we regret the short-term cost it means.
