Stettinski’s first few weeks have been spent getting to know Beverly Hills and the Chamber of Commerce. he summer months have always been about travel for my family. As soon as the summer solstice arrives, tickets are purchased, suitcases packed and we're off for our annual adventure. Human Relations Commission Completes Final Noise Hearing By Marla Schevker The Beverly Hills Human Relations Commission finished its fifth and final noise hearing last Thursday. While the commission took three separate polls regarding times, it was unable to reach a consensus. “I had hoped we would reach a consensus but the commissioners differing viewpoints about the times do reflect the diverse opinions expressed by the community at our meeting,” Human Relations Commission

Chair Sharona Nazarian said. Nazarian and commissioner Yar Meshkaty were in favor of extending the ordinance to 10 p.m. on Sundays through Thursdays and midnight on Fridays and Saturdays. Commissioner Rochelle Ginsburg was in favor of extending the ordinance to 8 p.m. on Sundays through Thursdays and 10 p.m. on Fridays and Saturdays. Commission Vice Chair (see ‘NOISE,’ page 14)

Longtime B.H. Civic Activist Peggy Kaus Dead At Age 88 By John L. Seitz Feisty civic activist Peggy Kaus died from complications of cancer in her Beverly Hills home Tuesday at age 88. Born on Feb. 8, 1923 in Frankfurt, Germany, she and her family left her native country in 1933 just after Adolf Hitler came to power. She attended boarding school in England where she first met her future husband, Otto. After coming to America in 1939, the two reconnected at UCLA and were married in Cape Cod five years later. The couple originally lived in Westwood, but in 1959 built a home on Spalding Drive

where she has resided ever since. Otto M. Kaus went on to become an attorney, judge and associate justice of the California Supreme Court. During her lifetime, Peggy Kaus took up a number of causes effecting Beverly Hills. She was particularly vehement in attempting to stop the ongoing reclamation project at Roxbury Park, claiming that some members of the City Council were “degrading Roxbury while building a monument to themselves and overriding the needs of the residents.” She had an ongoing fight with a former city manager whom she believed was “milk-

ing the City while building a large bureaucracy for himself.” Peggy Kaus is survived by two sons: author/journalist Robert “Mickey” Kaus and attorney Stephen Kaus, of Berkeley, and grandsons Jason and David. Plans for a memorial will soon be announced by the family.

School Board Approves Transitional Kindergarten By Marla Schevker At a Board of Education meeting last Tuesday, the board unanimously approved the implementation of a transitional kindergarten for the 2011/2012

academic year. Transitional kindergarten classes will have a maximum class size of 20 students. The class will follow the same hours and calendar as the reg-

Hubbard, Christiansen To Stand Trial In August By Marla Schevker The trials of former BHUSD Director of Planning and Facilities Karen Christiansen and former BHUSD Superintendent Jeffrey Hubbard have been scheduled for Aug. 4 and 15 respectively in Judge Stephen Marcus’ courtroom, department 102 of the Clara Shortridge Foltz Criminal Justice Center.

Both Christiansen and Hubbard were in court on June 29. At that time, Christiansen was assigned to Judge Marcus’ courtroom and a date was set for the trial to begin. Deputy District Attorney Max Huntsman said the trial was postponed to accommodate Judge Marcus’ schedule. Hubbard was in court for a

pre-trial conference. His attorney Salvatore Ciulla requested additional time and Judge Marcus’ agreed to schedule the trial within 22 days of Aug. 15. Christiansen is being charged with four counts of conflict of interest and Hubbard with two counts of misappropriation of funds.

HOSE TEST—The Beverly Hills Fire Department completed its once a year pump hose test two weeks ago. Hoses from all the fire trucks were laid out on the ground in large concentric circles. They were then brought up to high pressure for five minutes to check all fittings, connections and hoses for any damage or leaks. Any hoses not up to standard were pulled from the inventory. Royal Couple To Visit Hilton Today By Brenton Garen Prince William and his wife, Catherine, who arrive in LA today, will make their first official stop at The Beverly Hilton for the Variety Venture Capital and New Media Summit late afternoon. BHPD traffic bureau Lt. Mark Rosen said security would be provided by the California Highway Patrol and the Department of State for the Duke and Duchess of Cambridge.

“For us, it’s really maintaining the traffic flow around the hotel and making sure the residential population isn’t adversely impacted by the media or the onlookers,” Rosen said. Arrival time at the hotel is speculated to be around 4 p.m., but depends on their arrival and peak hour traffic traveling from LAX at 3:30 p.m. The royal couple will be in Los Angeles until Sunday, staying at the British consul general’s residence in Hancock Park. SALE—The L a n g e Foundation will hold an estate sale to raise money for animals at the Lange Foundation.

Lange Fundraiser This Weekend The Lange Foundation will hold its largest fundraiser of the year from 10 a.m.-4 p.m., Saturday and Sunday and continue during following weekends indefinitely. All proceeds directly benefit the animals at the Lange Foundation. The foundation will be selling a wide arrange of donated items including vintage and designer clothing and accessories, antique furniture, fine

art, jewelry, china and other collectibles. The Lange Foundation hopes to save more than 500 animals this year. The sale will be located down from the Lange Foundation animal shelter, at 2216 S. The Beverly Hills Boys Under 14 All-Star Team took first place in its division at the North Valley Classic soccer tournament in Granada Hills last weekend. On Saturday, although playing with only 10 boys, the team won its first game against Castaic 4-1 and tied 1-1 vs. San Pedro. On Sunday, the All-Star Team beat Pasadena 4-1 in the

early game. Coming into the fourth and deciding game against North Valley, the team needed to win by at least a two-goal advantage to win first place. The game started badly for the team after conceding an early goal and being down 0-1 for most of the first half. But like multiple other games throughout the season, the team kept its poise and was

able to deliver a comeback that started with a tying goal at the last minute of the first half. That momentum carried to the second half where the team scored the two needed goals for a 3-1 win to clinch the championship trophy. The team ended its season with three tournament champions, two second-place and two third-place trophies/medals.

anhattan-born Peter grew up in Ossining, New York. His father was a haberdasher, mom was on the Metropolitan Opera Board. Peter excelled in sports at school, and was voted high school president. He cooked during his service in the Merchant Marine, graduated with a political science degree from the New School of Social Research. After earning his master’s degree in public administration from Syracuse University, Peter was hired as an efficiency expert in Hartford, Connecticut.

omehow, amateur theatrics grabbed him. He studied with the grande dame of the American theater, Eva Le Gallienne, in Westport, before relocating to Manhattan to launch his acting career. A handsome 5-foot-6, Peter’s good looks bring to mind those rugged features of Spencer Tracy’s. “I’m always hired,” Peter’s commented, “because I’m tall.”

nd 1962 is the year Marilyn Monroe was found dead from “apparently overdosing” on sleeping pills. Coincidentally, both Marilyn and Peter are at rest at the Westwood Village Memorial Park Cemetary.

e last laughed with Peter when his wife, Shera Danese, who he wed in Los Angeles during a Catholic ceremony in 1977, hosted a dinner of pizza, pasta and whatever else at Goran Milic’s cozy Divino restaurant in Brentwood. (Italian cooking being Peter and Shera’s favorite.)

eter had the table in stitches, the guests being Kathleen Turner, starring then in a standing-ovation performance in Who’s Afraid Of Virginia Woolf? at the Ahmanson Theatre; Mitzi Gaynor, who presented Peter with his first Emmy; celebrity hairstylist Yuki Takei; manabout-town Carl Hall, who had Peter laughing out loud all evening long. “Where did this great guy come from, why have I missed him … is he a stand-up comic?”

eter himself was a riot, describing accidentally bumping into Shera in her native Philadelphia, hitting on her with every ploy imaginable. “She gave me a hard time … her looks knocked me out. No way I’d let her get away.”

S

hera stood fast. No deal. As often happens in life, a moment arrived when Shera figured what the hell, give the guy a break for one date. And in Shera’s words, “Before I knew it, I was getting a kick out of him.” Onward and upward to their marriage and a life that included Shera’s 14 dogs at their luxurious Beverly Hills mansionette, where he added an art studio. Peter’s one-man shows at our local galleries inevitably sold out.

KBEV’s City Limits Wins Two Tellys By Claire Selvin The KBEV television program City Limits has received two bronze Telly awards for “Best T.V. Talk Show” in the category of film and production. City Limits received the awards for two episodes: one including an interview with Candy Spelling and the other an interview with Richard Bernstein, a civil rights attorney. “All interviews are a different experience and all are amazing,” said Karen Kahen, executive producer and host of City Limits. “It took a long time to get Candy Spelling on the show and that was a really good experience because she is a BHHS alumna.” Kahen, who graduated from BHHS in 2010, started the program in her junior year. “(I was inspired to start the show) because I loved doing broadcast journalism,” she said.

Kahen writes, conducts, and arranges all interviews on the program. Other students working on City Limits handle camera, audio and graphics work. The show aims to educate students with interesting topics and interviews, such a 2010 episode featuring an interview with a holocaust survivor that won Beverly High’s first silver Telly award. Funding for City Limits is unnecessary because KBEV provides filming equipment and interviewees are unpaid for appearances on the show. Kahen personally paid for transportation and make-up for guests. “It’s a great feeling (to win the awards). Winning the first one fueled the drive to work harder and try to do more,” said Kahen. City Limits reaches 100,000150,000 local residences and has a YouTube channel for online viewing.

tion according to leading experts. This week, The Courier talked with Louis Pandolfi, a methane gas detection expert

from Geo Science Analytical Incorporated (GSA). Most people remember the methane gas fires and explosions that rocked the Fairfax-area Ross Dress for Less

BEVERLY HILLS the store and injured 31 people. These types of explosions occur naturally. Pandolfi said a build up of methane gas and a hot-water heater pilot light or spark are all it takes. A room with 5 percent overall methane gas and a source of ignition will explode “like a massive bomb.” The danger zone for methane explosions ranges from 5 to 15 percent of the total volume in a room. Under 5 percent, an explosion is unlikely; above 15 percent leaves too little oxygen to explode. However, opening a door, window or vent will add in enough oxygen and make it dangerous again. Natural methane gas is odorless and colorless. Most of us know the gas company adds an odor so that we can smell a leak. That added odor does not exist in nature. That makes methane hard to detect and explosions can happen with little or no warning. Beverly High is not the only location on the proposed Westside Subway Extension route that has active oil wells and methane gas problems. Pandolfi told The Courier there were two methane explosions in Century City during construction of the MGM building. During excavation for the building, the construction company drilled a hole in the ground and placed a steel cover over the hole for the night. Methane built up and exploded, causing the steel plate to shoot up approximately 15 feet in the air “like a cannon,” Pandolfi said. There is also methane gas under the Century Plaza hotel. Pandolfi said the hotel runs fans around the clock in the parking garage to keep the gas out of the hotel. The BHHS site presents a greater problem because of the number of unidentified unproducing oil wells remaining there. Today, when a well is no longer produced it is filled with hundreds of feet of cement thus sealing the well. Years ago, drillers just walked away from the wells after removing some pipe just below the surface leaving the well bore open and leaking. Safe tunneling through an oil field requires reliable maps of well locations, which the BHHS site lacks. Pandolfi said there are three types of oil wells. The first type is the simple vertical well, which is drilled down directly and the most obvious of the three. The second type is a horizontal well that has a drill island and then a web of as many as 30 to 40 wells. That type is typical of the BHHS oil field. The mapping of horizontal wells is rough at best, there is no way to know exactly how many wells are attached to one drill island and where they are located. The third type is known as wildcat wells, which are old drill sites that were never marked and may have been left (see ‘TUNNEL,’ page 13)

Local Gallery To Feature Spanish Masters By Claire Selvin Picasso is making his way to Rodeo Drive. Galerie Michael will present an exhibition, “España The Spanish Masters: An Impassioned View,” beginning July 14 (through Aug. 30) featuring the works of Pablo Picasso, Salvador Dali, Francisco Goya and Joan Miró. At the VIP reception next Thursday, scholars will discuss the artists and their work. “We have assembled the most comprehensive collection of works on paper in our gallery’s history of these modern masters,” said Galerie Michael Founder Michael Schwartz, who emphasized the importance of not overlooking the works of Miró and Dali compared with Picasso. “We feel the market for Miró and Dali is still undervalued compared to Picasso. Some of the finest and desired Miró works on paper are his large and visually arresting ‘Carborundums’ of which there will be several in our exhibition. They are still modestly priced given the artist’s historical significance and they sell for a fraction of what Picasso’s finest works on paper command,” he said. Schwartz said without the presence of Picasso, Dali and Miró in Paris in the 20th century, art history would have “taken a greatly different direction.” In addition to these three modern masters, the collection will feature works by Goya, a Spanish Romanticist who lived in the 18th century. “His work greatly influenced and inspired all three other Spanish masters,” said Schwartz, who founded Galerie Michael in 1978 when his interest in European art led him to realize the need for an international gallery in L.A.

Shortly after finishing his graduate work, Stettinski got a job teaching middle and high school at the Pilgrim School, a private K-12 school on Commonwealth, east of Vermont. He has also worked as a fundraiser for Crossroads School and as an account executive at a public relations firm. Although these jobs may seem mismatched and random, Stettinski said he believes one thing has led to another throughout his life. The link to all of his jobs, he said, is talking to and inspiring people. “I see myself as a communicator and a connector, building communities,” Stettinski said.

BEVERLY HILLS The bridge will be widened about 10 feet according to the Metro I-405 Sepulveda Pass Improvements Project website. To reduce major traffic, The Mulholland Drive Bridge project will be completed in two parts. First, the southern half of the bridge will be torn down and rebuilt in about 11 months. Then the northern half will be demolished and reconstructed using the same process.

Stettinski now has to answer a series of questions to figure out how to best represent the Beverly Hills business community through his role as executive director. “What do our businesses need so (I) can represent them properly,” Stettinski asked. “Who is my target audience? Who are my constituents? Who are the people that I represent? How can I bring them together and create a strong platform of communication?” Stettinski said he believes the Beverly Hills Chamber of Commerce plays an important role in the business community. “The chamber is the strongest voice businesses can have in a community, and I want to make sure it is utilized,” Stettinski said. “Everything (I have done in my life) so far has prepared me for this task.”

open by the drillers. Unmarked wildcat wells that were never completed are also typical of this kind of older oil field. So, it is impossible to know exactly where the oil wells are under Beverly High and just how many of them would be in the way of the tunnel. Because of that lack of knowledge, “an accident at Beverly High is inevitable,” Pandolfi said. Metro expects to encounter wells during construction, but the draft EIR states “the presence of existing oil wells is not considered a hazard for design or operation of the tunnels.” Based on his more than 25 years of experience, Pandolfi states unequivocally: “There will be an incident. The question is: do they have an incident when the school has children or when no one is there? Can they contain it quickly or will it spew for a while?” According to Metro’s Fact Sheet #4 on its Westside Subway Extension website, Metro has conducted an analysis of known oil fields. It states it has documented active or abandoned oil wells from oil well maps. “These will be further mapped during Preliminary Engineering and relocated, if necessary, during the construction phase of the project. If any unmapped or unknown wells are

July 8, 2011 | Page 13 encountered during construction, there are established procedures, regulated by government agencies, for dealing with them safely,” the website said. Pandolfi cites another danger: even if an accident is avoided during construction, which is unlikely, vibration from the subway can cause the casing of the wells to rupture and methane gas to escape. The lifespan for an oil well is approximately 150 years and many of Beverly High’s wells are approaching the end of their life. Santa Monica Boulevard also has oil wells but Pandolfi said tunneling under streets is always safer. “Deeper is Not Better” The Courier also wanted to address a widely-publicized myth. At a Century City press conference June 9, L.A. City Councilmember Paul Koretz said Metro should dig the tunnel deeper so it won’t “disturb” the school. The claim is that a deeper tunnel would actually resolve the issues BHUSD has with tunneling under the high school. The deeper tunnel, it is also claimed, would make building easier and without added costs. However, BHUSD expert Tim Buresh–who was in charge of large portions of the current Los Angeles subway system construction—told The Courier that a deeper tunnel would be significantly more difficult for Metro to accomplish. High is lower in elevation than Constellation and Avenue of the stars by approximately 50 feet. Trains do not run uphill well and the station itself must be more than 1,000 feet long on perfectly level ground. After reaching Century City, the tunnel must turn north for its journey into Westwood. Turns can only be so tight. The tunnel would need to go under the BHHS campus deep enough to avoid any impact on the school’s foundations. That level is dozens of feet deeper than now planned, but the tunnel still must rise up to a reasonable station level for Century City. It cannot physically run at an incline greater than 3 percent, which is the maximum allowed by Metro. A tunnel deep enough to avoid impacting BHHS cannot rise up in a short enough distance to allow the Century City station to be built unless the station is dug very, very deep. That is a proposal Metro and Century City developers vow not to follow. Deeper is always more expensive and accessing the deeper tunnel and station creates serious problems and costs of their own. Changes to the enforcement part of the ordinance include a fence standard so that fences may be built at upslope property lines but cannot exceed 36 inches, expand hedge height limitations to the entire slope of a downslope property, change the definition of hedges to include tree hedges and define a maximum height for hedges on slopes that allows hedges higher than currently allowed by code. The code enforcement portion is not intended to address all obstructed views, but is intended to resolve some of the more egregious conditions. Vice-Mayor Willie Brien conceded along with his fellow councilmembers that this code enforcement was not perfect, but it was a starting point where tweaks could be made in the fu-

ture. “Will there in fact be issues that we have not anticipated in this, for sure, that’s going to occur,” Brien said. “Is this better than what we have now in terms of trying to create mechanisms to preserve and improve and preserve views, I believe this is absolutely so.” Councilmember Lili Bosse said it was day she had been looking forward to as she had worked on the issues since day one when she was on the Planning Commission. “I feel there comes to a point when you are about there,” Bosse said. “I think there’s going to be a few things here and there that need to be worked out, but there isn’t really any more twisting and turning, I think everything has been done.” Mayor Barry Brucker said the Planning Commission had to be active so Phase Two (Permit Process) of the ordinance could be brought back to the council for review in early fall.

This would give Beverly Hills City experts an opportunity to evaluate the data in the final EIR before taking further action. The council said the $350,000 would be used for tunnel and geotechnical experts, consulting firms, public relations firms and legal services. This $350,000 represents an initial first quarter allocation, which can be later augmented if necessary. The council rejected a staff recommendation to strip money from the City's Tourism and Marketing budget derived from the hotel tax, or Transient Occupancy Tax. Doing so would break a 30 year pledge to the City's business community. The staff wanted to take $50,000 from holiday décor, $250,000 from the Centennial Anniversary Fund and/or $150,000 from contingency programs. Councilmember Lili Bosse requested staff look into funding sources that do not deal with the

TOT and Councilmember John Mirisch stated he did not think the full $350,000 should come from the TOT. The city has already promised the business community this small rebate of their own money and stripping the remaining TOT money would betray pledges made since the 1970's. The City's annual budget exceeds $418 million. The City Council expressed an interest in working with the Beverly Hills Unified School District in the fight. At its June 28 meeting, the Council allowed 45 days to meet with the school board and gather data. City Manager Jeff Kolin said the City Council approached the BHUSD about getting their studies. According to Kolin, the BHUSD cited legal issues as the reason they could not share their data. The Courier has learned that Kolin in fact demanded confidential expert data compiled by BHUSD experts and attorneys. The BHUSD offered to share that information under a formal joint defense agreement to protect the confidentiality of the data, but that the City refused to enter into that agreement. BEVERLY HILLS U.S. Senators Dianne Feinstein and Barbara Boxer announced the U.S. Department of Transportation took a major step in approving a key federal loan for the Los Angeles Metropolitan Transportation Authority (LA MTA) to extend its subway system into West Los Angeles. The project is one of only eight nationwide invited to move into the final approval phase. Last week, Mayor Barry Brucker wrote a letter to Metro CEO Art Leahy informing him that Beverly Hills will be reevaluating their support America’s Fast Forward, also known as the 30/10 initiative if Metro refuses to drop plans to tunnel under BHHS. It is that initiative that will provide the speedy funding for the Westside Subway Extension. The City of Beverly Hills has been a strong backer of the Westside Subway Extension based on Metro’s original plan to put the subway down Wilshire Boulevard to Santa Monica Boulevard with the Century City station located on Santa Monica Boulevard. Two years ago, Century City developers brought pressure to change the route to one block closer to their buildings, meaning a tunnel under BHHS.

From the Publisher CLIF SMITH THE GREATEST PONZI SCHEME IN HISTORY The United States government is running the greatest Ponzi scheme in history. Trillions and trillions of dollars that do not exist have been promised to millions of Americans. Many, if not most, will never get those dollars. As long as new fools give us money, we can keep up the fraud. Maybe it will continue forever. Maybe it won’t. As long as we get ours, who cares? That is the funding theory behind Medicare, Social Security, public employee pensions at every level of government, and our entire nation. Right now, the Obama federal government is borrowing every penny or yuan it can find anywhere in the world. Those have just about run out. Next step is just to print money, which is what they are also doing. Today, the national government is squabbling over whether to keep right on going, as President Obama and the Democrats demand, or try to reduce the spending somewhat, which is what the Republicans are trying. The bogeyman is “federal default.” Well, that won’t happen regardless. Debt service on the national debt is $20 billion a month. Receipts are more than $200 billion a month. The debt will be paid. It’s the other stuff they are trying to finance. The ideological conflict gets more intense. The President states: “Unless we raise taxes, we will have to cut federal programs.” Common sense tells us: “Well, then cut government. It’s already got more money than has ever existed in the history of the world.” It is crystal clear that anything adopted by the federal government is sacrosanct to these people. For them, government must prevail above everything. So, we get bridges to nowhere and multi-million dollar grants to study who-knows-what insect. Treasury Secretary Timothy Geithner says that raising taxes on small business owners is OK because: “We already spend too much on them,” meaning the taxes leave something for the small business. He believes 100 percent of everything we earn belongs to the government.Thus, when government leaves anything behind it is a gift. That is so backwards as to defy response, yet that is the prevailing theory of the Democrat Obama government. Is it working for you now? In the meantime, more and more small and medium-sized businesses are closing. People continue to lose their homes. Joblessness continues unabated. H.L. Mencken wrote about FDR’s New Deal, that it divided America into “those who work for a living and those who vote for a living.” The “vote for a living” now outnumber the “work for a living” by a wide margin and the workers are running out of energy and money. Whether it matters or not will depend upon whether you care or not. If your children can get a job with government or with a big charity, they will get big salaries and fat pensions. That will be OK. The rest of everyone will find the money to keep that part of the Ponzi scheme rolling. If they cannot get a job with government, maybe they will have to work for a living. That just might turn them into Republicans, which as we know, is a fate worse than death.

Last Monday was the 4th of July, also known as: “Independence Day “ – or was it “Fireworks Day?” Or was it “Picnic Day?” Or was it “Who Can Swallow the Most Frankfurters in a Given Time Day?” Or was it “Let’s Go to the Beach Day?” Or was it “Barbeque Day?” Let’s say it is best known as: “Independence Day.” Well, from whom are we independent? We look it up and with difficulty discover that it is independence from the British Empire! “You mean England?” Shucks, we like England. Why, its most popular prince is over here, right now, after visiting Canada, and we’re delighted to see him and his beautiful bride, what’s her name. What is all this business of being independent of little England? Well, maybe we should look up some of the facts about the 4th. It seems that on July 4, 1776, a group of men from the various Western Hemisphere colonies of what was then the British Empire, finally signed a declaration document stating they were no longer colonies of the British, but

On one hand, the mayor is impressed on how “well respected and how grand the Beverly Hills brand is” because 100 receptionists, waiters, and volunteers in Baltimore wear a Beverly Hills lapel pin for four days. On the other hand, this same mayor is reluctant to stand in unison with the school board and in solidarity with all the residents and B.H. organizations demanding to stand up to the MTA against the proposed subway tunnel under Beverly High and to protect their property. I hope the mayor will eventually get his priorities straight. The exchange of ideas at the Conference of Mayors is without a doubt a major benefit. However, I suggest “the significant use of electric vehicles” be carefully reviewed before any serious consideration is given to it. President Obama is on record for saying that, under his
