No one likes to sue or be sued in court, but the Beverly Hills Unified School District Board of Education has managed to do the near-impossible: make money on its litigation. After spending approximately $2.2 million with outside lawyers over the last six months, the district can now count over $10 million coming back in the
form of damages and restitution awards from Johnson Controls Inc. (JCI) and former Director of Facilities Karen Christiansen. Liaison Committee To Discuss Roxbury Monday By Matt Lopez The Parks and Recreation Liaison Committee will attempt to make headway on the Roxbury Park decision-making process when it meets Monday, July 23 at 3 p.m. The liaisons will engage
further discussion on what to do about potential basketball courts and whether to build an indoor gym or a “multipurpose room”. At the last liaison committee meeting two weeks ago, the committee agreed to further

City Moves Toward Plastic Bag Ban By Matt Lopez The City of Beverly Hills is ready to take the next step in a potential citywide plastic bag ban. The Public Works Commission was updated on plans for the ban by Senior Management Analyst Daniel Cartagena Thursday morning. He presented the commission with a list of 2,100 businesses that the City plans to reach out to in the coming weeks with
a survey to figure out how often the businesses use plastic bags and to gauge interest on potentially banning plastic bags. “We’re prepared to release the survey and we’re looking at a 10-minute survey,” Cartagena said. “The idea is to give a flavor for how such an ordinance would impact their business.” The issue of banning plastic bags (see ‘BAGS’ page 15)

According to top executives from both stores, the collection will include more than 50 limited-edition gifts in men’s, women’s, children’s apparel and accessories, as well as other categories that some of the designers are getting into for the first time, such as sporting goods, home decor, pet accessories and accessories for electronics. “We have been talking to Target over the years about doing some sort of collaboration, but we never found the right time or right way to do it,” until this year, Karen Katz, president and chief executive officer of Neiman Marcus Inc. told WWD in an exclusive interview. “This is kind of ground-breaking. Neiman Marcus and Target share a passion for great design and delighting customers in new and unexpected ways.” “Target and Neiman Marcus are known for charting new terrain and, by joining forces for the holiday season, we’ve set the stage for a redefining moment in retail,” said Gregg Steinhafel, chairman, president and ceo of Target Corp., who visited Neiman’s Dallas headquarters earlier this year,
with some of his top executives, to get the project off the ground. Likewise, Katz led a trip with some of her lieutenants to Target’s Minneapolis headquarters, and lots of meetings with the working teams were held subsequently in both cities, as well as New York to meet with designers. “We are going to merchandise it all together as one shop. Both Target and Neiman’s will be shop concepts,” Tesija said, unlike last year’s Missoni collection at Target where products were spread out in different areas of the store. Target miscalculated the demand which was so enormous that Target’s Web site crashed. To celebrate the partnership, Target and Neiman Marcus are donating a total of $1 million to the Council of Fashion Designers of America. “I can think of no better finale to CFDA’s 50th anniversary celebration than through this extraordinary designer collaboration,” said von Furstenberg, president of the CFDA. “As designers, creativity is our best gift, and with the generous support of Neiman Marcus and Target, we are happy to have created specially designed products as a thank you to share with our consumers and friends.” WWD Qatar Group Acquires Valentino Mayhoola for Investments, an investment vehicle backed by a private investor group from Qatar, has agreed to acquire Valentino Fashion Group SpA. Terms of the deal were not disclosed, but Milan-based sources peg the price tag at around 700 million euros, or $858 million at current exchange rates. The agreement was inked between Mayhoola and Red & Black Lux Sàrl, a company indirectly controlled by the Permira Funds in partnership with the Marzotto family. Through the acquisition of VFG, Mayhoola will acquire Valentino SpA and the M Missoni license business, while MCS Marlboro Classics is being carved out from VFG and will remain under the ownership of Red & Black. A Mayhoola spokesperson stated: “Valentino has always been a brand of unique creativity and undisputed pres-
tige. …Our vision is to back management for the long term to exploit the full potential of this exciting brand. We believe Valentino is ideally suited to form the basis for a global luxury goods powerhouse.” Valentino closed the first half of the year with revenues of 186 million euros, or $240 million at average exchange, up 23 percent compared with the first half of 2011. Both statement are completely false, according to Thomas White, chairman of the Municipal League of Beverly Hills, and several other HOA presidents and members. When pressed about the quotes after White spoke to the city council at its July 3 meeting, Kolin claimed Woodrow Clark, a member of the Muni League board, asked for a vote and the members present “spontaneously voted for it”. White told The Courier no formal vote was ever taken at the meeting and no agreement or endorsement was made on the presentation in any way. He said while Clark is a member of the Muni League board, he does not represent the board. White said the meeting was simply a discussion between the HOA and staff and White himself expressed

White said he wanted to make it clear the City’s various HOA’s do not support the rate increase and to make sure residents knew about the inaccuracies in the City’s reporting of the issue. “At a minimum, we are entitled to independent, objective and unbiased information in staff presentations and written reports,” White said. “Instead, we’re too often receiving skewed and incomplete data, and blatant sales pitches.”

Online classifieds site Craigslist.org warns users in bold letters to never make a transaction via Western Union or MoneyGram, saying most who ask for funds wired that way are scammers. “It's a cyclical scam, they
go away for a while and then come back,“ Lt. Mark Rosen told The Courier. “We want the public to be aware there are scammers out there and to verify who the person is by asking questions or calling a relative.“ Rosen said many seniors in the City had contacted the BHPD warning about the scammers without falling prey to it, but said that a few residents had been duped. Rosen acknowledged that its often difficult to find the perpetrator of these types of scams and said the BHPD's main motivation was to help prevent residents from getting victimized.

Ice Age: Continental Drift–My Granddaughter Loved It–Me, Not So Much I took my 6-year-old granddaughter, Cleo, to a screening of Ice Age: Continental Drift. She came equipped with a lunch box filled with cookies and other assorted goodies. I took a seat on the aisle because, as I found out a few screenings ago, when bored she takes off for the bathroom and refreshment stand. Fortunately, there are no refreshment stands at screenings, hence the lunch box, so that issue was academic. When we entered the room, production notes and 3D glasses in hand, she sat herself down and asked me when I thought lunch boxes first were invented. I told her many years ago. “When you were younger?” I told her even before I was born. She was floored with that statistic. The lights lowered and Ice Age: Continental Drift came on the screen featuring my favorite character, Scrat, the sabertooth squirrel. All the kids, including me, squealed with delight and laughed at his antics. I had hoped, as I have in the past, that the film would evolve about Scrat. It didn't but every so often, he floated in and out of the screen. Although the stories of the subsequent Ice Age movies don't live up to the promise of the original for me, Cleo was taken with each character and adventure. The 3-D glasses never came off her adorable face and she never once asked me to take her to the bathroom. I would have welcomed the brief respite but was very happy that she was loving every moment of the on-screen adventure. At this time may I extend a hand of thanks to Ray Romano, John Leguizamo, Denis Leary, Queen Latifah, Peter Dinklage, Jennifer Lopez, Nick Manaj, Wanda Sykes and Keke Palmer for making it possible for this reviewer to spend some terrific quality time with my darling Cleo. When I dropped her off at her mommy's, she gave me a kiss on the cheek, a “thank you” and “I love you.” There is no reward greater on this earth than to receive those beautiful and meaningful words from a grandchild. Mom, dad, grandfather, grandmother, your reaction to the movie might be cold but when you hear those words of appreciation as I did, you will melt as sure as the driven snow on a blistering hot day. The Peninsula Makes Ex-GI’s Food Dream Come True After 41 Years At The Peninsula Beverly Hills, Executive Chef James Overbaugh often gets special requests from guests – usually for dishes that are low sodium, gluten free, or vegan. The guest request that chef received recently, however, was so special, he called upon Managing Director Offer Nissenbaum to help fulfill it. Orange County resident Richard Emmons had called to say that he was driving to Los Angeles with his wife to go shopping. He wanted to make a reservation for lunch, and wondered if the chef could recreate the garlicbutter prawns dish he had eaten at The Peninsula Hong Kong in July 1971. Emmons explained that 41 years ago, when he was 24, a U.S. army sergeant in Vietnam, he had wandered into the iconic hotel on his last day of R&R. Awed by its elegance, he decided to splurge on dinner. Though The Peninsula’s Verandah Restaurant had a dress
code, the maître ‘d wouldn’t hear of turning him away. He lent Emmons a tie to wear with his “civvies” and invited him in. Emmons recalled enjoying a fabulous lunch of prawns in a luscious garlic-butter sauce,
the restaurant staff seeing to his every need. “I said to myself, ‘Enjoy every minute of this, because tomorrow you’ll be eating army glop back in Vietnam,” he said. “I skipped dessert because I couldn’t afford it, but left the restaurant a happy man.” On Emmons’ way out, a staff member asked if he need-
ed a ride. “I didn’t have money for a taxi, so I told him I was going to the PX–I would walk.” The staff member insisted. He escorted Emmons to The Peninsula’s gleaming Rolls Royce, which whisked him away. “I never forgot the gracious welcome The Peninsula had shown a young GI,” said Emmons. Cut to July 10, 2012: Emmons dined with his wife Marta at The Peninsula Beverly Hills’ Belvedere Restaurant – Caesar salads followed by Chef Overbaugh’s modern rendition of garlic-butter prawns, with forbidden black rice. Emmons thanked the chef for a wonderful lunch. “I was lonely when I dined at The Peninsula Hong Kong, but today, at The Peninsula Beverly Hills, I enjoyed it with my wife,” said Emmons. “Since the war I have been blessed with a rich life – an education, a career in government, a happy marriage – I have much to celebrate today.” Emmons was surprised when the chef refused to give him a lunch check. He was even more surprised when the latter escorted the couple outside, to the hotel’s Rolls Royce Phantom. Instead of the PX, the Emmons’ destination was Bloomingdale’s. “It was an honor and a privilege to cook for Mr. Emmons, both as an American and as a member of The Peninsula team,” said Chef Overbaugh, as the Rolls Royce whisked them there in Peninsula style.

San Francisco was the first city to ban plastic bags in California when it did so in 2007. Santa Monica instituted a plastic bag ban in September. The L.A. County Board of Supervisors passed an ordinance to ban plastic bags in July 2011. The ordinance calls for a 10-cent charge when a paper bag is given to a customer. Cartagena told the commission that the council could decide to
state a large up-front sum, followed by annual residuals. The “pay for play” option was declared to be unconstitutional. What was not considered unconstitutional was the destruction of redevelopment agencies. What is important to note is that the $151 million due July 12 is just a portion of proceeds that cities are generating, through liquidation and other means, to the state of California. The following is a brief list of local L.A. County cities and the amounts they owe: City of L.A., $51.8 million; Santa Monica, $12 million; Industry, $6.1 million and Long Beach, $8.2 million. L.A. and Santa Monica City officials did not respond to The Courier’s request for comment. Some cities, such as Bakersfield, are reportedly considering taking legal action against the state.

UCLA’s Heart Transplant Program Reaches 2,000 And Counting The UCLA Heart Transplant Program performed its 2,000th heart transplant surgery in June, becoming the first program in the western U.S. and only the second in the world to achieve this remarkable milestone. “It is extraordinary that 2,000 donor hearts have been transplanted at UCLA, giving new life and new hope to pediatric and adult patients ranging in age from two weeks to 77 years,” said Dr. Abbas Ardehali, professor of cardiothoracic surgery and director of the heart and lung transplant program at UCLA. “Not only is this historic

Children’s Hospital L.A. Reseacher Discovers Micro RNA Mechanism Required For Growth, Spread Of Cancer And Other Immune System Diseases; May Have Major Clinical Implications A previously, little knownmechanism for the growth and spread of cancer has been reported by Muller Fabbri, MD, first author on the paper that recently appeared in the early edition of the Proceedings Of The National Academy Of Sciences. This mechanism may have implications for all types of cancer and other diseases of the immune system. Though the study is preclinical, it provides a rationale for the development of new cancer treatments. “To design innovative treatments against diseases like cancer, researchers need to identify potential vulnerabilities in how the disease develops. Dr Fabbri and his colleagues have accomplished that goal,” said Brent Polk, MD, director of The Saban Research Institute of Children’s Hospital Los Angeles. “In this study we discovered a completely new mechanism used by cancer to develop, grow and spread,” said Fabbri, a researcher at the Children’s Center for Cancer and Blood Diseases at CHLA. (He is also an assistant professor of Pediatrics and Molecular Biology and Immunology at USC’s Keck School of Medicine. “But what is even more exciting is now we have identi-

Finally, we show this mechanism involves TLR8, a fundamental receptor of the immune system, suggesting the implications of this discovery may extend to autoimmune and other inflammatory diseases.” Scientists have shown that small fragments of RNA (called
micro-RNA or miRNA) are present in the blood of cancer patients at different levels than in healthy patients. This has led to the conclusion that miRNAs are excellent biomarkers for the diagnosis of cancer, since they can differentiate a cancer-bearing patient from a healthy one. Cancer cells release miRNAs both into their surrounding micro-environment and into the circulation. This is the first report showing a previously unknown cross-talk
between cancer cells and immune cells, mediated by cancer cell-released miRNAs, represents a new mechanism for the growth and spread of cancer cells. “This study reveals a new function of microRNA, which we show binds to a protein receptor,” said Carlo Croce, MD, director of Ohio State’s Human Cancer Genetics program. “This tells us some cancer-released microRNAs can bind and activate a receptor in a hormonelike fashion, and this has not been seen before.” Fabbri, Croce and their colleagues demonstrated that lung cancer cells are able to secrete miRNAs inside of small vesicles, called exosomes, and the surrounding immune cells normally present in the tumor are able to capture and engulf these exosomes and the miRNAs contained in them. They found that two miRNAs contained in the exosome (called miR-21 and miR-29a) are able to bind to a receptor, called toll-like receptor 8 (TLR8). Once miRNA binds to TLR8 in the immune cells, it activates the receptor and causes therelease of interleukin-6 (IL-6) and tumor necrosis factor alpha (TNF-a), resulting in proliferation and increased metastatic potential of
the cancercells. The study also shows immune cells within a tumor, may be unable to destroy cancer cells and may actually be necessary for their growth and dissemination. The clinical implications of this discovery are significant since identifying a completely new mechanism used by cancer cells provides an opportunity for therapeutic intervention. Developing drugs that interfere with the cancer cell’s ability to release this miRNA-mediated signal to the surrounding immune cells may effectively interfere with the ability of cancer to grow and spread. Stuart Siegel, MD, director of the Children’s Center for Cancer and Blood Diseases commented: “As new technology allows researchers to ‘peel the onion’ back on how cancer cells actually grow and spread, discoveries such as the one described by Dr Fabbri and his colleagues help us put this complex puzzle together, and offer new paths to launch attacks on the basic mechanisms controling the deadly behavior of these cells. “We hope to take advantage of these discoveries and develop more effective treatments for cancer in children and adults.”

“Backstage at the Geffen” was a star-studded event at the Geffen Playhouse and the preshow host committee dinner by Executive Chef Dakota Weiss at W Westwood’s The Backyard restaurant, all of which grossed more than $1 million for the Geffen’s education, outreach and artistic initiatives. The funder honored Carol Burnett and Jim Gianopulos, chairman/CEO of Fox Filmed Entertainment, and was co-chaired by Willow Bay and her husband Robert Iger, chairman/CEO of The Walt Disney Company.
In introducing his long-time friend and sometime co-star Carol Burnett, presenter Dick Van Dyke referred to the comedic legend, who received the “Distinction in Theater” award as “born with a funny bone imbedded in her body.” He also shared some wild moments forgetting their lines on stage in Same Time Next Year. Then Burnett reminisced about her early lean years in NYC when she managed to talk her way backstage at a performance of The Pajama Game in hopes of talking one of the stars into finding her an agent. Meanwhile, Warren Beatty did the presenting honors for Jim Gianopulos and the latter’s “Distinction in Service” award. Jim’s career at Fox has ranged from Titanic to Avatar as well as Bullworth, the 1999 film which won an Oscar nomination for Beatty. Warren and Jim, as did most of the participants including Annette Bening, paid tribute to Geffen Playhouse’s founder/producing director Gil Cates, who passed away last October. He was remembered in a moving video narrated by Laurence Fishburne and created by local Geffen supporter Barbara Schroeder. A few of the highlights included actor Andy Garcia paying tribute to his Cuban roots by performing an impromptu solo on the bongo drums with his pal, jazz musician Arturo Sandoval, whom he portrayed in For Love Of Country: The Arturo Sandoval Story; Monica Mancini’s stunning rendition of The Shadow Of Your Smile; and Beth Behrs, currently one of the Two Broke Girls, who began her career at the Geffen stuffing gift bags, opening the evening with Someone To Watch Over Me. Emcee Jane Lynch (Glee) kept the event flowing with laughter, striking the perfect chord between honor and irreverence. She called Dame Helen Mirren “hot,” while the latter took aim at the angst-ridden turn

Page 22 | July 13 , 2012 ORDINANCE NO. 12-O-2625 AN ORDINANCE OF THE CITY OF BEVERLY HILLS REQUIRING CONVENIENCE STORES TO OBTAIN A CONVENIENCE STORE CONDITIONAL USE PERMIT AND AMENDING THE BEVERLY HILLS MUNICIPAL CODE THE CITY COUNCIL OF THE CITY OF BEVERLY HILLS HEREBY ORDAINS AS FOLLOWS: Section 1. The City Council hereby finds that it can be seen with certainty that there is no possibility that the adoption and implementation of this Ordinance may have a significant effect on the environment. This ordinance has been assessed with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. This Ordinance does not authorize construction, and in fact imposes the same restrictions on development as already exist under Urgency Ordinances 11-O-2608 and 11-O-2609 in order to protect the public health, safety, and general welfare. This Ordinance is therefore exempt from the environmental review requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of Title 14 of the California Code of Regulations. Further, this Ordinance is exempt from CEQA on the separate and independent ground that it is an action of a regulatory agency (the City) for protection of the environment, because it will protect residential neighborhoods and commercial uses from impacts associated with intensification of commercial uses, and thereby qualifies as a Class 8 exemption pursuant to Section 15308 of Title 14 of the California Code of Regulations. The Section 2. Ordinance is consistent with the objectives, principles, and standards of the General Plan. General Plan Policy LU 5.8 “Encroachment of Incompatible Land Uses” strives to protect residential neighborhoods from intrusion of incompatible uses and disruptive traffic. Section 3. The City Council hereby amends Section 10-3-100 of Article 1 of Chapter 3 of Title 10 of the Beverly Hills Municipal Code by adding the following definition between the terms “Common Property Line” and “Corner Lot” as they presently appear in 103-100, with all other definitions in the Section remaining unchanged:

The City Council hereby amends Section 10-3-100 of Article 1 of Chapter 3 of Title 10 of the Beverly Hills Municipal Code by adding the following definition between the terms “though lot” and “Trousdale estates” as they presently appear in 10-3-100, with all other definitions in the Section remaining unchanged: “TOBACCONIST: Any retail business with at least ninety percent of its retail floor area dedicated to the sale of tobacco products such as cigarettes, tobacco, and pipes. Section 6. The City Council hereby amends Section 10-3-1604 of Article 16 of Chapter 3 of Title 10 of the Beverly Hills Municipal Code regarding uses conditionally permitted in the C-3 Zone by adding “Convenience Stores not occupying a tenant space whose primary entrance opens into the interior of a commercial building” between the uses “Educational Institutions” and “Hotels, subject to the provisions of article 28.6 of this chapter” as they presently appear in 103-1604, with all other uses in the Section remaining as previously adopted.

Section 8. The City Council hereby amends Section 10-3-1802 of Article 16 of Chapter 3 of Title 10 of the Beverly Hills Municipal Code regarding uses conditionally permitted in the C-3B Zone by adding “Convenience Stores not occupying a tenant space whose primary entrance opens into the interior of a commercial building” between the uses “Clubs” and “Driveup, drive-in and drivethrough facilities, subject to the provisions of section 10-3-1612 of this chapter” as they presently appear in 103-1802, with all other uses in the Section remaining as previously adopted. Section 9. The City Council hereby amends Section 10-3-2003 of Article 16 of Chapter 3 of Title 10 of the Beverly Hills Municipal Code regarding uses conditionally permitted in the C-5 Zone by adding “Convenience Stores not occupying a tenant space whose primary entrance opens into the interior of a commercial building” between the uses “Car washes that: A. Are enclosed in a building; B. Exclusively serve a business whose operation is primarily devoted to the sales, long term leasing or rental of automobiles or other motorized vehicles; C. Are located on the site of the business being served; and D. Do not exceed twenty feet (20') in width or forty feet (40') in length. When reviewing the conditional use permit application for such car washes, the planning commission shall consider the conditional use permit criteria set forth in section 10-31613 of this chapter” and “Educational institution uses teaching grade levels one through twelve (12)” as they presently appear in 10-3-2003, with all other uses in the Section remaining as previously adopted.
Section 10. The City Council hereby adds a new Section 10-33800.1 to Article 38 of Chapter 3 of Title 10 of the Beverly Hills Municipal Code establishing a Convenience Section 7. The City Store Conditional Use Council hereby amends Permit: Section 10-3-1702 of Article 16 of Chapter 3 “10-3-3800.1 of Title 10 of the Beverly CONVENIENCE STORE
CONDITIONAL USE PERMIT. Where authorized in the zone, the City may permit Convenience Stores as a conditional use in the same manner that it would process an application for a conditional use permit pursuant to this Article 38. The City may impose any conditions on a Convenience Store conditional use permit that are necessary to preserve the public health, safety, or welfare, or to mitigate any potential adverse impacts resulting from the establishment of a Convenience Store including impacts associated with congregation. The City shall not approve a conditional use permit for a Convenience Store unless it makes all of the following findings: 1. The proposed use will contribute to and enhance the character of the neighborhood and location, and will promote harmonious development in the area, and will contribute positively to the branding and image of the city; 2. The proposed use will have adequate buffering between the use and residential areas, schools, parks, and locations where children gather, and will not adversely interfere with the use and enjoyment of residential properties in the vicinity of the proposed development; 3. The proposed use will not result in detrimental impacts to existing or anticipated residential or commercial development in the vicinity of the project with regard to traffic levels, traffic safety, pedestrian-vehicle conflicts, pedestrian safety hazards, parking demand, parking design, and loading or manner of operation; 4. The proposed use will not create excessive noise, unpleasant odors, noxious fumes, excessive lighting, increased litter, or substantial interference with neighboring properties or uses due to the activities associated with the proposed use or its hours of operation; 5. The proposed use will not create an overconcentration of convenience stores in the vicinity.” Section 11. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, the remainder of this Ordinance shall be and remain in full force and effect. To the extent that the discretionary process to require a convenience store conditional use
permit, or any part thereof, is determined to be invalid, a convenience store use shall be construed as prohibited in the commercial zones. Section 12. Repeal of Interim Ordinance. The City Council hereby repeals Interim Ordinance No. 11-O2608 and Ordinance No. 11-O-2609 as last extended by Ordinance No. 12-O-2621, which repeal shall become effective only upon this Ordinance taking effect Section 13. Publication. The City Clerk shall cause this Ordinance to be published at least once in a newspaper of general circulation published and circulated in the City within fifteen (15) days after its passage in accordance with Section 36933 of the Government Code, shall certify to the adoption of this Ordinance, and shall cause this Ordinance and his certification, together with proof of publication, to be entered in the Book of Ordinances of the Council of this City. Section 14. Effective Date. This Ordinance shall go into effect and be in full force and effect at 12:01 a.m. on the thirty-first (31st) day after its passage. We know that, politically, “guilt” is a big motivator. “Envy” is the flip side of “guilt,” and both when used together are powerful. It is now clear President Barack Obama and the Democrats will wage all-out class warfare based largely on guilt and envy. Republicans will try to blunt those attacks, as they usually do, by making some sort of lame rejoinder like “We need to grow the economy,” but still act guilty about being successful. Democrats will respond by repeating (endlessly) the usual guilt trip they place on higher income earners. Republicans will then pretend they don’t make that much money. (Actually, Democrats make up more of the “1 percent” than Republicans, but who’s paying attention?) While we wish that Americans would again celebrate success instead of demonizing it, that’s a wish for another day. That’s not the point of this column. This column is strictly about facts and our wish for you to consider them. Please, “take a moment” and look at the facts. The Congressional Budget Office is about as close as we get to an unbiased impartial source. What about income “disparity”? What about “fair share taxation”? What about “justice”? The results are in and . . . guess what? Beverly Hills need not feel guilty! Are you paying your “fair share” of taxes? What are the facts? Hurray! You have actually done more than your share! You’ve done almost EVERYBODY’S share! The top 20 percent of wage earners in the United States now pay 94 percent of all income taxes! You are way ahead on points! You’re in great shape from the “social justice” point of view. Not only that, but when it comes to the deficit, your “Bush tax cuts” hardly added to the deficit at all. In fact, based on CBO numbers, your share of the “deficit” was less than 4 percent. The other 96 percent came from new spending and its consequences. Most of “deficit” spending went to the lower 60 percent of wage earners and government workers at all levels. Specifics: Two new government reports analyzed deficit growth from 2001 through 2011. Those reports show how a 2001 projected 10year surplus of $5.6 trillion turned into an actual $6.1 trillion deficit over the same period. It was not your failure to pay taxes. The first report, found at http://cbo.gov/sites/default/files/cbofiles/attachments/06-07-ChangesSince2001Baseline.pdf , shows the tax policies enacted a decade ago (the “Bush tax cuts”) are responsible for just 16 percent of the swing from surplus to deficit. Furthermore, given that only about one-fourth of the tax cuts went to upper-income earners, just 1/25th of the switch from projected surpluses to actual deficits came from upper-income tax cuts. (NOTE: Given that CBO does not take into account any of the positive impact of tax cuts on investment, savings and economic growth, the percentage was actually even smaller than the 1/25th estimate).
So, be happy! Remove your guilt! It’s not your fault! President Bush’s “help the rich” tax cuts hardly show up in the deficit. In truth, the economic growth you provided more than offset any “help the rich” tax cuts you received. You were good stewards. You took the small additional amount of your own money the federal government allowed you to keep and earned a ton of money from it – and paid the taxes accordingly. But what about that deficit? Isn’t that somehow your fault? Nope. The CBO answered that question, too. Answer: new spending and interest on the (massive new federal) debt created 75 percent of the deficit. That also means that you selfish, greedy, guilty, rich Beverly Hills residents–getting richer off the Bush tax cuts–can only be blamed for about 1/12th of the deficit. So, it was NOT your fault after all! And did you get any of that government money? No. Of course not. If you are in the upper 20 percent of wage earners in the United States, you are only supposed to pay, not get. Well, that’s exactly what you did. You paid, and paid, and paid, and paid. You did not “get.” Will any of you look up these reports? They’re pretty easy to read. If you are on our eedition at www.bhcourier.com, just put your cursor on the links and click. If you don’t want to look at these reports, or really don’t want to know facts that relieve your guilt, then please don’t look. The results are so clear and easy to see that, for the guilt-ridden, you won’t like it. We all know some people who revel in guilt and we don’t want to spoil their revelry. For those with an open mind, however, but who are committed Democrats or statists, this may be traumatic. The entire campaign pitch of President Obama and the Democrats is based on supposed unfairness, injustice, income disparity, discrimination, victimhood, and all the other liberal buzz words. The fact that none of these accusations are real should trouble you (but only if you read the facts). Even if you read the facts, absorb them and still don’t care because you want to “get even” or “be fair” or “help the poor,” there is hope, there, too. If the attitude of “soak the rich” prevails, you will shortly be deprived of your earnings and your wealth. There will be no “top 20 percent” to pay for everyone else and you will have no reason to feel guilty! Why? Because most of that “top 20 percent” will become “everyone else” and there will be no one left to pay for everyone else. If you still have any money left, you can always travel to Greece or Spain or Portugal where they’ve already eliminated the top 20 percent and there is no one left to pay for “everyone else.” France and Italy are racing to see who’s to go broke next. Or, if you just want a budget trip, visit Mammoth Lakes, San Bernardino or Stockton – they’re already bankrupt so you would feel right at home. We hear there are good deals on houses in Maryland, too, because nearly all of that state’s “rich” have left. But these are just the facts. If knowing the facts spoils your guilt trip, then just ignore them. We cannot ignore the facts. Sorry – we just can’t. We’d like to (sort of like a fantasy that USC will some day have a championship basketball team), but we just can’t. Whether you look at the facts or not, the message is clear: “Beverly Hills – rejoice! It’s not your fault!”
Rabbi Jacob Pressman DO YOU KNOW YOUR ACRONYMS? Dear Erudite Reader: While reading last week’s edition of The Courier, I was struck by how many acronyms I saw there. What’s an acronym? It is a word made up of the initials of other words in order to be brief. You know many. For example, our television call letters: ABC is short for American Broadcasting Company. IOU is short for “I owe you.” We see many acronyms in the press. I went for a search for them in our own newspaper, and while I came across 25 of them I am not certain I saw them all. Nor do I know what each of them meant. There are at least 5 whose meanings escape me.
