The turnout came after the council majority followed the liaisons recommendation to further study a plan that effectively turns back the clock and ignores many concerns residents had about the project when it started several years ago. Eyewitnesses Back Up Courier’s Report That City Staff Falsified Water Rate Increase Documents By Matt Lopez and Courier staff In its July 13 issue, The Courier reported that City of Beverly Hills staff falsified information it provided to the City Council that community groups support a City-wide water rate increase. The article was entitled, “City Staff Falsifies Water Rate In-

crease Documents.” City Manager Jeff Kolin wrote The Courier asserting the staff did not falsify the report and demanded a “retraction.” The Courier has reexamined its article, spoken with elected officials of the groups cited by the City staff, and reconfirmed its reporting. City staff falsified

the report in question. The Courier stands by its reporting in full. The issue in question centers on a staff report about an April 24 meeting between Homeowners Association (HOA) presidents and board members, along with Kolin and City staffers to discuss a

the favored plan for a new community center. Plan D was one of four plans presented to the liaison committee Monday and the one the committee unanimously favored. This just-under 20,000square-foot plan calls for a 4,500-square-foot “multipurpose room” to allow for large banquets and other events and might also include a middle school-sized regulation basketball gym that many community members have spoken out against for years. Feeding The Beast Daily we are bombarded with reports of another city, county, state or nation running out of money. Almost nowhere to be seen is a proposal to cut back government employees, their benefits or compensation to balance them with the private sector. In Beverly Hills, as one citizen leader after another comes forward, we hear the same thing – bloated staff, bloated compensation, huge retirement payouts, and reduced service. Beverly Hills prides itself on an excellent city government. We certainly have a police department other cities envy and a fine fire department. We have no quarrel with public safety. cided that it still isn't ready to make a decision on the Gateway Overlay Zone. While the council commended the planning commission on the months it spent working to develop a concrete

Hannah Carter Garden Ruling Expected Today By Laura Coleman L.A. Superior Court Judge Lisa Hart Cole is today expected to rule on whether to halt UCLA’s pending sale of the Hannah Carter Japanese Garden. Cole postponed judgment earlier this month on issuing a preliminary injunction opposing the sale, which was filed

by the heirs of Hannah Carter on June 13, until she was able to determine whether the university is a charitable trust or a public entity. The Kyoto-style Bel Air garden, bequeathed to the university by former UC Regent Edward Carter with the stipulation that it be maintained “in perpetuity”, has been em-

broiled in controversy since UCLA undertook proceedings to sell the property just months after the death of Hannah Carter. The garden is currently listed by Coldwell Banker together with the adjacent residence, also donated to the university by Carter, for a total of $14.7 million.

Wells Fargo Reveals Surprising Retirement Trends Wells Fargo & Company last week released the findings from an in-depth analysis survey that examines the retirement planning choices and concerns of Los Angeles County residents. The report compares adults ages 25 to 75 in Los Angeles County to adults

ages 25 to 75 nationwide and reveals large disparities due to poor retirement planning by Los Angeles County residents. Almost half of pre-retirees in Los Angeles County say their biggest fear about retirement savings is that they will do all the right things to save and still

a career where he has overseen a myriad of arrests, the delivery of two babies, and the CPR rescue of a parks and recreation worker, Rosen will now be primarily behind his desk. Capt. Rosen will oversee the Investigative Services Division, which includes detectives, special enforcement, undercover officers working narcotics and a crime task force. He will also oversee the High Tech Crime Lab and the CSI lab. Rosen said he still plans to don the uniform and ride around the City at least once a month in a patrol car. Rosen joined the department at age 15 as an explorer, then was brought on as a cadet after graduating Beverly Hills High School. At age 21 he became a reserve officer where he went through the academy and received training before he was hired full-time after graduating from college.

In addition, Woods underscored that it was a “district property” and would be used for district functions. “If we are going to not just survive but enhance the quality of the education we provide, we must find new sources of revenue,” Goldberg said.

“I grew up in this town and in this department and I love working in this City,” Rosen told The Courier. “It’s one of the greatest cities to work in.” Rosen worked his way up through the ranks in the BHPD, starting as a patrol officer before becoming a detective. After about 7 years on the job, he stepped away from the department for a year to take care of family business obligations and upon returning, learned he couldn’t be brought back on because of a hiring freeze. In the meantime, Rosen started a mortgage brokerage business and was gone from the BHPD for a total of 8 years before returning in 1996. After starting out as an officer, he quickly worked his way up to lieutenant. In October, Rosen became the BHPD’s Executive Officer and Public Relations/Information Officer, a liaison between the department and media outlets. “I’ve been here since I was 15 and I really have never left,” Rosen said. “I love this place.”

Barry Brucker agreed to forge ahead with their favored “Plan D,” the council unanimously agreed to look at a new “Plan E.” that will be brought to the council by City staff in two weeks. The only question left for residents after Tuesday’s meeting is whether or not “Plan E” will actually get serious consideration from the council majority. The proposed “Plan E” would call for a new community center design built on the exact same footprint the current center resides on at the same exact size and dimensions. It’s an idea that for years, many thought wasn’t legally possible. The council learned of this game-changer when City Project Manager Donielle Kahikina revealed that City staff had received information that a storm drain that runs under the current building could be rerouted for an estimated cost of $250,000. In earlier stages of the Roxbury Park redevelopment process, dating back several years, it was believed the City could not build over an existing storm drain or even re-route the drain that currently exists. Despite Brien’s desire to “move forward” with the project under Plan D as he stated

Tuesday, Mirisch and Bosse immediately questioned City staff as to why a new plan taking into account the rerouting of the drain under the existing footprint had not been drafted. Building over the existing footprint is what most residents in the community have long desired. Staff said RTK Architects could return to the council with a new “Plan E,” built to the exact dimensions of the existing building, at the Aug. 7 City Council meeting. The council unanimously approved to take a look at the new “Plan E” in two weeks before making any further definitive decisions on “Plan D.” “I understand everyone is eager to move forward, but let’s do it right,” Mirisch said. “If the best possibility for the community is on the existing footprint, with a courtyard and built with quality, we owe it to ourselves and the community to look at it.” Bosse said it would be unfair to the community to not give both the council and community members a chance to at least look into the possibility. “The community was told we couldn't build on the current location because of the storm drain and now we’re finding out it’s a possibility,” Bosse said. “It would be unfair to the community to not at least look at it.”

“Traffic is our single greatest issue,” Councilmember Julian Gold said. “We have terrible traffic there so we have to figure out, what are we going to do about traffic?” Reform Councilmember Lili Bosse called for traffic studies beyond what is covered in the proposal, specifically requesting that Charleville Boulevard be studied beyond just Lasky Drive. Bosse also called for traffic studies on Gregory Way and the ingress and egress of North Santa Monica Boulevard. “That was not studied in the EIR and we are not told that is an option,” Bosse said. “To make this a thorough EIR, we need to have that study. It needs to be addressed in order for me to adopt any EIR that has to do with these parcels.” The council also expressed concern about the uniformity among the three parcels. Bosse noted that each parcel has a significant meaning to the City. “Parcel 1 is important in terms of character because it’s obviously a gateway, it’s supposed to transition into Beverly Hills from Century City,” Bosse said. Bosse noted the proposal for Parcel 2 could impact views from The Peninsula hotel. She also said Parcel 3, which sits at the intersection of

Wilshire and Santa Monica Boulevard, is important not only because of traffic generation, but because it serves as a gateway to the City. “It’s hard to capture three projects in one plan, the needs of each are slightly different and each owner is different,” Gold said. Discussion Tuesday centered on the three T-1 parcels at 9900 Santa Monica Blvd., 9848 Wilshire Blvd. and 9817 Wilshire Blvd. The overlay zone proposal the council considered allows development of a one-story building that can be up to 18 feet tall. T-1 properties developed adjacent to a C-3 property would be allowed three stories at a maximum of 45 feet with a 1.5 floor area ratio (FAR). There was also concern among the council about the idea that certain projects, with approval from the planning commission, could extend up to 60-feet high (only on the two parcels west of Wilshire Blvd). Corman said at a previous meeting that approving such a building would help to maximize the area’s green space by making the building’s footprint smaller. “I don’t see much of a justification for 60 feet, especially in the locations we’re talking about,” Bosse said. “I’m uncomfortable with 60 feet.”

BEVERLY HILLS To prevent impacts the gateway overlay zone could potentially have on traffic at Wilshire and Santa Monica boulevards, Vice Mayor John Mirisch proposed reducing the floor area ratio (FAR) for the parcels to 0.7. Councilmember Barry Brucker suggested reducing 1.0 to 1.25 FAR for the parcels. Mayor Willie Brien directed the council planning liaisons (himself and Bosse) to help with the development of a revised proposal after the council gave feedback. The planning commission laid out 14 objectives any project proposal must meet for development in the gateway overlay zone. Among the requirements is the project must include elements for public benefit. Mirisch noted he struggled to see the public benefit in the plan viewed by council. “The only reason for rezoning is when there’s a tremendous public benefit and right now there’s not enough specificity about what that should be,” Mirisch said. “It’s just not there.” “Just because this process has been drawn out is not a reason why we should agree to this proposal or any proposal for that matter,” Mirisch said. “It’s incumbent upon us to do the right thing.”

That amount does not include the $327,000 in additional expenditures the board authorized at its last board meeting. “There’s not enough fat on the bone now, we’ve hit bone,” the board’s President Brian Goldberg said. “Difficult decisions are going to have to be made.” Among items that were considered for reduction by at least three boardmembers were displacing eight returning students by removing all home school/returning student guarantees and laying off several teachers for a $298,008 expenditure reduction, negotiating to furlough 6 non-instructional days for a savings of $996,637, and laying off one adult education teacher for an $82,000 reduction. “It’s ‘Sophie’s Choice’,” boardmember Lisa Korbatov said, likening the World War II story of an unthinkable choice with the staff-generated list of possible areas of reduction totally $15.63 million. Indeed, the “menu” of options to balance the budget is so unpalatable that board VP Jacob Manaster suggested the district go below the required 3 percent reserve rather than slice programs and positions from next year’s budget. The board, without the support of boardmember Lewis Hall, directed staff to have a meeting with LACOE that BHUSD is looking at submitting a qualified budget in November. Submitting a qualified budget is the first step before the district would be required to explain to LACOE why the state shouldn’t take over Beverly Hills schools. “The message needs to be nothing’s going to be cut and we need to figure out how to fund this,” Manaster said, noting that it could take four to five years to recover from additional cuts. “We have cut waste where we can...I cannot possibly see us coming up with $2 to $3 million in cuts and still having a functioning school district. “Why not send a message back? ‘You know what LACOE, come and get us.’” The board also explored alternative solutions to budget cuts to fund the upcoming budget which included fundraising efforts targeting philanthropic high net-worth residents, having residents bequeath their mineral rights to the schools and selling district property. “Maybe this community will wake up,” Korbatov said. proposed water rate hike. City staff reported to the May 15 city council meeting that HOA members “broadly supported the rate increase” at their April meeting. When pressed on the issue by reform Councilwoman Lili Bosse, Kolin went even further, stating the HOA members “spontaneously” voted in favor of the increase. Beverly Hills Municipal League Chairman Thomas A. White spotted the misstatement in the report and reported it to council in open session on May 15. White reconfirmed to The Courier that no agreement or vote took place. “A responsible council would have, at the very least, investigated when an obvious discrepancy is specifically brought to their collective attention in an open public meeting,” White told The Courier. White went on to add, “The misstated report went through at least four levels of staff review before it was released. Taxpayers are paying an above-market premium for staff services, so our residents and businesses might well ask why the standards and quality controls were so lax.” Steve Dahlerbruch, president of the Beverly Hills Roxbury Park HOA, also recon-

firmed to The Courier that the City’s statements of broad support, including a vote, are simply untrue. “We didn’t support it and we didn’t turn it down. We didn’t act on anything, it was not an actionable matter and we are not an actioning group,” Dahlerbruch told The Courier. Judy Okun, a member of the Southwest HOA board, also reconfirmed her previous statements to The Courier that no vote or agreement took place at the meeting. “We did not take a vote,” Okun said. “We sat there for the presentation but we didn’t vote to say ‘okay that’s good’ in any way.” Ken Goldman, president of the Southwest HOA, was not at the April 24 meeting, but told The Courier a vote never takes place at these meetings. “I’ve attended these meetings since the very first meeting and I can tell you that we’ve never taken a vote on anything,” Goldman said. “We get reports and share information, but that’s all it was ever intended to be.” The Courier spoke to at least one other HOA board member who wished to remain anonymous, but confirmed with fellow HOA members that no agreement or vote ever took place. The Courier stands by its reporting.

Though the majority of survey respondents feel they have a better chance of retiring at age 65 than the Dodgers winning the World Series by the time they turn age 65, no more than 1 in 5 respondents in L.A. County has a detailed plan for their retirement finances. Only 30 percent have increased the allocation to their retirement savings in the past year.

Other residents expressed a similar fear for the future of Roxbury under the council majority's current directive. “It's a question of what's appropriate and turning Roxbury into La Cienega Park is simply not right,” resident Marilyn Gallup said. Administrators with the Beverly Hills Basketball League spoke out in support of “Plan D” Tuesday, stating that the high school was considering giving local leagues less time in the Swim Gym than it previously had to allow for more practice time for school sports teams. Under a Joint Powers Agreement between the City and the school district, the City pays BHUSD $10 million annually to use the school's facilities for recreational or athletic events. Board President Brian Goldberg told The Courier that Beverly High Principal Carter Paysinger informed the BHBL that if it was willing to push back the time of its adult bas-

At Monday's liaison meeting, City staffers said the room could also be used for exercise classes (although the current proposal calls for a 2,000square foot exercise studio) and senior activities (residents noted that the proposed senior drop off point is located at the complete opposite end of the multipurpose room in the proposed floor plan for the nearly 20,000-square foot complex). “I just don't understand the multi-purpose room at all,” Rose Norton told the council. “If seniors want to use the multipurpose room, they have a long haul. We can't afford to build over 4,000-square feet and take away park land.” Mayor Willie Brien praised the design's net gain of about 2,100-square feet of green space, which has long been a desire of residents. Many residents noted, however, that the green space gained is adjacent to the parking lot, a less than desirable spot for picnics or children to play.

I’m completely self-taught. My grandmother taught me how to knit when I was about 11 and I was always making and selling things, so my business side and artistic side were sort of intertwined. I studied geography and economics at university in England and whenever I became bored, I would knit and make sweaters. Friends started to become my first customers and my business grew from there. I started off as a knitwear company about 12 years ago and then the president of Bergdorf Goodman discovered me in London and my clothes eventually went into Neiman Marcus. The rest is history ... the line has a huge following. There’s not a specific shape or size of our customer and all of my silhouettes are


timeless. I don’t follow trends. Also, my customer tends to be very artistic and well traveled, so they understand how I draw inspiration from various cultures. I do a great Japanese pant. I do Moroccan robes, dresses and peasant layer skirts,” he added. Another signature trademark of an Eskandar creation is the softness and quality of the fabrics. Each season he works closely with the notable Italian fabric manufacture Loro Piana in designing his fabrics, and pre-washes the Belgian and Irish linens to assure each piece has that unique down-to-earth feel he’s become so famous for.

The Mannequins was established in 1943 to provide modeling and fashion shows from couture designers as well as their costume collection of 100 years of fashion. We are left wondering about the mathematical chance of a movie audience dying before dawn We are aware and reminded again of the proliferation of guns in the United States–guns easily purchased over the counter or on the Internet, guns in the hundreds of thousands, possibly in the millions on the shelves of the purveyors of such lethal weapons. After we have asked ourselves: “How could this have happened?” we then proceed to wonder what can be done about it. The Second Amendment of the American Constitution states our right “to keep and bear arms,” assuming as it does, that private citizens will have to protect themselves always. We are left to ponder what, if any, changes will take place as a result of this gory episode. I remember as a youngster gazing in awe at the local officer on the beat in our neighborhood. He had a wicked-looking baton, but no gun. In those days we still felt safe and protected by our policemen. It is very possible that when this bloody news becomes yesterday’s old story we will not be thinking about our vulnerability until the next such tragic incident.
