School Board To Fine Tune New Bond At Tuesday Study Session By Laura Coleman One of the most important decisions this current Board of Education will make, namely bringing a new school-building bond to the November ballot, is slated to take place at its upcoming formal meeting on Aug. 9. In order to qualify for a Proposition 39 bond, which requires 55 percent voter approval to pass the measure, four members of the five-member board must vote to put the bond on the ballot. “This is an issue that has been studied and debated for the last eight years,” Board President Howard Goldstein emphasized. “I feel it is important to
remember that our school board is comprised of taxpayers who have seriously considered many alternatives and yet have unanimously come to the same conclusion, our schools need to be upgraded to make them seismically safer, more secure from acts of violence and environmentally healthier for the long term protection of our students, staff and community members that utilize our facilities everyday,” he added. At last week’s formal meeting, only Goldstein and members Noah Margo and Lisa Korbatov expressed support to move forward with a November bond measure. (see ‘SCHOOL BOND’ page 23)
Daniel Paul Ryan, Van Cleef And Arpels Pioneer, Dies At 89 By Matt Lopez One of the driving forces in bringing luxury jeweler Van Cleef and Arpels to Rodeo Drive, Daniel Paul Ryan, died last Thursday at his home in Los Angeles at age 89. Born in Saint Nazaire, France, Ryan spent his childhood in Brittany, before moving to Paris and Casablanca. He moved to the United States in 1955. It was one year later, in 1956, that Ryan joined Van Cleef and Arpels in New York and was quickly appointed director of their Palm Beach Salon in 1961. At Ryan’s prompting, Van Cleef and Arpels soon opened their salon on Rodeo Drive in 1969, becoming the first French firm to do so. Ryan was appointed director and vice president of the Beverly Hills salon and became an instrumental force in transforming Rodeo Drive from a quaint shop-

Beverly Hills Waldorf Astoria, MATT Construction Win Coveted Cal/OSHA Safety Award By Laura Coleman Building a prestigious 5star hotel in the heart of one of the world’s most famous cities is no small task, but it’s an endeavor the development team behind the Waldorf Astoria Beverly Hills is excelling at as the 2017 opening date grows ever-closer. In recognition of just how safe the construction site of the 170-room hotel nearing completion at the corner of Wilshire and Santa Monica is, Cal/OSHA presented its coveted SHARP (Safety and Health Achievement Recognition Program) award to MATT Construction and the Beverly Hills Waldorf Astoria yesterday at the construction site. The award is given to just a handful of projects each year to recognize outstanding achievements in safety and health on construction sites. According to Cal/OSHA Area Manager Dan Leiner, the accolade is given to just over a dozen businesses each year. “It’s actually an inspiration
[to others],” he said, noting that there are approximately 1.5 million businesses throughout the state that could be candidates for the valuable award, which also gives recipients added perks. “It’s a method of recognizing companies that have great programs.” Leiner said the project is a likely candidate to earn an even higher accolade from Cal/OSHA called the VPP (Voluntary Project Program), so long as the contractor maintains its excellent safety and health programs. “We are confident that we’re doing the right thing with respect to safety, but confirmation from an outside source like Cal/OSHA is good affirmation that we are tracking toward our zero-injury goal,” said Joe Gregorwich, MATT’s safety director. There are approximately 450 people working on the project each day construction on the 12-story luxury hotel takes place. “We are partnering with
the project owner to go above and beyond Cal/OSHA requirements, and ensure a safe and healthy environment, not only for construction personnel, but for neighbors in the surrounding community,” Gregorwich added, underscoring that the team is dedicated to the goal of zero injuries for the duration of the project. Presented by the Horace Mann PTA, the community open house begins at 3 p.m. for Horace Mann families, staff and special guests, with the public invited to view the new state-of-the-art school building from 6-7 p.m. “We are thrilled to celebrate the highly anticipated opening of our new school building with the entire Horace Mann Community,” said Jamie Halimi, Horace Mann PTA President. “Our new state-ofthe-art environment will prepare our students for 21st century learning.” The Modernization Construction Project, which began in fall 2014, includes a brand new classroom building to house both elementary and

Beverly Hills Police Stay On Cusp Of New Technology With Robot By Kate MacCary In recent weeks, an uptick of violent events has sparked national conversations regarding various aspects of law enforcement–from technologies used by officers to how agencies interact with various groups in the community. Police robots made headlines following the July 7 standoff between Dallas police officers and a sniper where a robot was used to detonate a bomb to kill the sniper. Although Beverly Hills sees little violent crime, its police department does actually have one robot. BHPD Lt. David Hamel, an emergency services officer, said the department purchased a Robotex Avatar Tactical robot several years ago for its Special Weapons and Tactics (SWAT) team to “give the officers greater operational capabilities.” Simply called “Avatar,” the robot is most often used in training exercises. Hamel called it the department’s “most significant piece of
equipment.” “We utilize any technology that will give us an edge,” he added. A small, black box on four wheels, this robot looks more akin to souped-up off-road remote control vehicle than R2D2. With the ability to traverse over multiple types of terrain, this small but powerful device has the ability to inspect life-threatening situations and deliver a fatal blow (via specific programming and equipment) to aggressors. “Situations where we would deploy it [robot] is checking something without putting a human at risk,” said Hamel, adding that the department is fortunate to have it so heavily used in training instead of in real-life situations. However, it is less flashy technology that the BHPD relies on for day-to-day law and order. Congressional Candidate Ken Wright Holds Forum on Homeless Township Option By Victoria Talbot Candidate for the 23rd District Kenneth Wright, a renowned pediatric ophthalmologist at Children’s Hospital Los Angeles, held a forum Sunday at Santa Monica’s Third Street Promenade to present voters with his Home for the Homeless – the Township Option. “Despite a huge allocation of resources the homeless problem is just getting worse. The Township Option deserves a look,” said Wright. Wright was joined by Homeless activist Ted Hayes, founder of the Dome Village, a concept of building small townships designed specifically for the homeless. “The Dome Village worked,” said Hayes. eeting Mr. H became a lesson in Never Give Up. When we called Universal Studios – cold – and asked for his assistant, she dissuaded us from pursuing our idea. Mr. H would not discuss food and wine. Only movies.
We offered then to write
a letter, since she was hesitant to bug him. After a pause or two she agreed. “Okay, but I’m telling you that he’ll never go for it.”

oon enough, our phone rang, and the assistant asked when would we like Mr. H’s car to pick us up the next day. For a meeting at his studio bungalow. Admitting her astonishment, she was very gracious when we finally met.
We toured his wine cel-
lar, the walk-in temperaturecontrolled refrigerator for his imported delicacies in his mansionetternce overlooking the Bel-Air Country Club golf course. We were invited to a Sunday night dinner at the venerable Chasen’s, where he savored Dave Chasen’s “hobo steak” (ordered with a dab of
English mustard). Cooked over a high flame with a layer of salt to preserve the sweet juices.

invited to the luncheons and black-tie dinners with Betsy and Alfred, whose taste reflected their appreciation and love of a good table.

Chiuri Becomes First Woman To Lead Dior By Anne-Laure Mondesert Dior on Friday named Italian designer Maria Grazia Chiuri as its new creative director, making her the first ever woman to lead the iconic French fashion house. The 52-year-old said the appointment was both a “great honor” and a “tremendous responsibility” to be the first woman in charge of a fashion house “so deeply rooted in the pure expression of femininity.” She will present her first show in Paris on Sept. 30, the company said, following in the steps of legendary founder Christian Dior and such designers as Yves Saint Laurent, Gianfranco Ferre and John Galliano. “The House of Dior is delighted to welcome her and to have a woman, for the first time in its history, as artistic director for the womenswear collections,” the fashion house said in a statement. Dior had been without a leader since the shock departure of the Belgian Raf Simons last October, which sparked

The “endless wealth” of Dior's heritage “continues to be a constant source of inspiration for fashion and I cannot wait to express my own vision,” Chiuri said. Together, Chiuri and Piccioli were credited with giving Valentino back its fizz, making it one of the most profitable de-
signer brands in Europe. They presented their collection for Valentino on Wednesday at its Paris haute couture show, which Vogue magazine hailed as an “unforgettable farewell.” Chiuri, whose mother was a dressmaker but whose parents strongly disapproved of her going into fashion, took over at Valentino with Piccioli when its colorful founder Valentino Garavani retired in 2008. Valentino, the “Sheikh of Chic,” had poached them from the rival Roman label Fendi nearly a decade earlier. Chiuri is known for her love of exquisitely embroidered creations, with the silken applications on one of the gowns in Wednesday's Paris show taking 480 hours to attach. Cher’s Former Beverly Hills Equestrian Estate Hits Market For $85 Million By Matt Lopez The lavish, sprawling Beverly Hills estate formerly belonging to pop queen Cher is on the market for a reported $85 million. Aaron Kirman of John Aaroe Group is listing the 11bedroom, 17-bathroom Benedict Canyon Drive home with 20,000 square feet of main house and 16 acres of equestrian estate. In the 1970s, as The Sonny And Cher Comedy Hour catapulted Cher and husband
Sonny Bono back to fame, Cher purchased four acres of land on Benedict Canyon Drive to build the mansion that now sits on the property. Cher eventually sold the property to Eddie Murphy, who in turn sold it to the current owners in 1994. According to toptenrealestatedeals.com, the current owners then began gobbling up surrounding land to begin developing the 16 acre equestrian space. The equestrian area includes a group of stables, a
pair of white-graveled riding rings and a tennis court with a seating area among lavishly landscaped grounds. Jackie Collins’ Longtime Beverly Hills Home Goes For $21 Million

By Matt Lopez The longtime mansion of prolific novelist Jackie Collins was sold in Beverly Hills this month for $21 million. The 21,784-square-foot, eight bedroom, 10 bathroom North Beverly Drive home was sold by the estate of Collins, who died in September at age 77 after a long bout with breast cancer. The Wall Street Journal reported this week that the buyer was commercial real estate tycoon Ben Nehmadi, whom Variety reported also acquired a smaller estate next door, also from Collins, who had leased the home for the last decade or so to Al Pacino.
Citing “people with knowledge of the transaction,” Variety reports that both properties went for around $30 million. Collins custom-built the home in 1991 on just under an acre in the flats. The home is gated and set back from the street, featuring a large motor court and six-car garage. The interior features a more-than-100 foot art gallery which connects to a guest apartment, offices, gyms, a screening room and much more. The property was sold by Hilton & Hyland’s Brett Lawyer.

U.S. Home Price Gains Slow; New Home Sales Pick Up US home price gains slowed to a more sustainable pace in May as more properties, including newly built homes, hit the market, S&P Dow Jones Indices reported Tuesday. S&P's Case-Shiller index for home prices in the 20 top cities fell 0.1 percent from April and was up 5.2-percent from a year ago, slower than the 5.4 percent pace the previous month. The strongest markets continued to be the northwest hubs Seattle and Portland, as well as Denver, Colorado. Previously hot markets New York and Washington, D.C. have slowed as buyers resist higher prices. "Overall, housing is doing quite well. In addition to strong prices, sales
of existing homes reached the highest monthly level since 2007 as construction of new homes showed continuing gains," said David Blitzer of S&P Dow Jones Indices in a statement. Meanwhile, the Commerce Department reported that new home sales across the US accelerated in June to the fastest pace in eight years. June sales rose 3.5-percent from May to an annual rate of 592,000 units. "Much stronger than expected, with no sign of any loss of upward momentum," said Jim O'Sullivan, chief US economist at High Frequency Economics. –– Agence France-Presse

Twitch Upon A Star Is Bewitching Journey Into Elizabeth Montgomery’s Life By Danielle Berris Onetime Beverly Hills resident Elizabeth Montgomery, an inspiration to many for her role as Samantha in Bewitched, is revealed as more than just a leading lady in Herbie J. Pilato’s Twitch Upon A Star. The biography is Pilato’s second foray into Montgomery’s life story after his first book, Bewitched Forever. “I wanted to reveal her humanity in every way; her faults, and her good points, with dignity,” he said. “She was so complicated and so loved, and yet it was my experience of her that I published objectively.” Pilato is the founder and executive director of the Classic TV Preservation Society. In lieu of recounting Montgomery’s story in typical biographical fashion, the book relates the events that made the world-famous actress who she was and relates them to her life’s journey. The biography travels through Montgomery’s life before, during and after Bewitched. In Pilato’s depiction, Montgomery’s personality is strikingly similar to the character she portrays, Samantha. “She took that down-to-earth personality and brought it to Bewitched and everyone fell in love with her,” he said. Pilato takes the reader through Montgomery’s four husbands and describes her unstable relationship with her father. He also expands on her formative education, which included attending Westlake School for Girls and The Spence School in New York City. Her parents, Elizabeth and Robert, moved to Beverly Hills in 1932, approximately

one year before she was born. When her brother Skip arrived in 1936, the family moved to Holmby Hills, and eventually to New York. Franchot Tone, a former co-star of Montgomery’s father in a few movies, bought the Beverly Hills home from the family. Despite the fact that the Bewitched actress wanted to buy the house back once she was married to Bewitched Producer/Director Bill Asher, Tone would not sell it back. Instead, the couple purchased another estate in Beverly Hills, where she remained through her fourth marriage with Bob Foxworth until passing away on May 18, 1995. Pilato, who said he has been greatly influenced by Montgomery in all of his endeavors, befriended the actress in the mid-1980s. He underscored how Montgomery’s role as Samantha in Bewitched uplifted many spirits in the 1960s. “The world was in great turmoil and there was Samantha, who could twitch her nose and make the bad things go away,” he stated. Bewitched proved, he continued, that, “no matter if you’re a witch or a mortal, you can fall in love.”

In Two Shows, Felder Brings Composers Irving Berlin & Leonard Bernstein To Life Author, actor, pianist and singer Hershey Felder has made a name for himself in one-man shows like George Gershwin Alone and Monsieur Chopin recreating the lives of famous composers. Now audiences will have the chance to see two of his most popular shows almost back to back. The public is invited to attend a preliminary “scoping” meeting on Tuesday, August 9, 2016 at 6 p.m. to comment on environmental issues that should be addressed in the Draft EIR. Project Location: The project site is a relatively flat, rectangular area of 15,876 square feet (0.36 acres) located on the southwest corner at the intersection of Wilshire Boulevard and S. Almont Drive in the City of Beverly Hills. The project site is currently developed with a one-story retail building and a two-story retail building, on the northern portion of the project site. The two buildings cover an area of 6,832 square feet, approximately 43% of the project site. A paved parking lot approximately 5,500-square feet in size is located behind the buildings, adjacent to the alley. The buildings are served by an existing access drive on S. Almont Drive and via the alley at the rear of the site. Project Description: The project would involve demolition of the existing two commercial buildings and the removal of the paved parking lot. The two-story building on the east side of the site is currently occupied by an antique/art shop, and the one-story building on the west side of the site consists of three retail spaces that are occupied by a nail salon, café, and vape shop/lounge. After demolition, construction of a new 31,702 square-foot building would occur, which would consist of with three stories of commercial office development and four levels of subterranean parking. The table on the next page summarizes the characteristics of the proposed commercial building. The Ruth Flinkman-Marandy and Ben Marandy Multidisciplinary Research Laboratory Building was dedicated in a ceremony that also included the inauguration of the Ruth Flinkman-Marandy and Ben Marandy Chair in Quantum Physics and Nanotechnology. The new building provides needed lab space for new recruits engaging in cuttingedge research at the university with some 20,000 students on campuses in Beer-Sheva, Sede Boqer and Eilat in Israel’s southern desert. BGU supporter Jim Breslauer was also honored during the four-day event at the University’s Board of Governors meeting. The Jim Breslauer Pavilion was dedicated at the Center for Digital Innovation (CDI) in Beer-Sheva’s Advanced Technologies Park (ATP), adjacent to BGU’s Marcus Family
Campus. Breslauer was also the mastermind behind the building of the ATP as a whole. JVS presented its “Inspiration Award” to three JVS clients whose successes illustrate the mission of the agency to help lift people out of poverty and over significant barriers to employment. This year’s recipients included Roland Williams, a formerly homeless veteran now employed as an apartment maintenance technician; Deborah Smith, a survivor of domestic violence who now works for Wells Fargo; and James Acosta, a formerly out-of-school, unemployed youth now employed at Starbucks and working toward his high school diploma.

Even in summer, it would take something really outstanding to bring this Desert rat into Los Angeles for a birthday party. Renee Kumetz is just such a person, and the smiles were worth traveling the miles. I invited several good Desert friends, and one husband, Sherman Fridman; the singularly-named jeweler, Parker; the gracious philanthropist Diane Deshong; and seated next to her a radiant Kumetz and her beau, Robert Hirsch, to Craig’s for a birthday dinner in her honor. Seated next to us in this A-list West Hollywood celebrity restaurant, were the stars of Dog, The Bounty Hunter and their entourage. To be frank, Kumetz is not a big fan of reality TV and had no idea whom Dog is. In fact, wearing his traditional attire of long, dirtyblonde hair and black leather wardrobe, she thought Dog was a homeless person who just happened to wander into the restaurant. In true “you-cannot-tell-a-book-by-its-cover” fashion, Dog (Duane Chapman) turned out to be a kind, gentle, compassionate mountain of a man who, ignoring the paparazzi stationed outside, asked if he could have a picture taken with the birthday girl. I wonder if that picture will show up as a prop in the next episode of Dog’s Hawaiian-based thriller?

The disclaimer must also display the City’s website, listed in ads, where voters can obtain more detailed information. Garvey said the same rules apply for presentations and phone banking. “Complying with this ordinance severely limits our ability to educate the public about the benefits of the initiative,” Garvey said. "This lawsuit challenges a 2010 requirement from the City's Municipal Code,” said Beverly Hills City Attorney Laurence Wiener. “The Code requires that any advertiser, pro or con, disclose financial information as well as the title of the initiative, which was issued in March. In this case, the title of the initiative points out that the project involves a 26 story building and a 1.7-acre private garden with public access, subject to reasonable restrictions by the property owner. Both requirements serve a substantial governmental interest in alerting the voters to critical information regarding the initiative. For this reason, we hope the judge upholds the requirement." The State Lawsuit On Wednesday, a second lawsuit was filed by resident and former mayor Linda Briskman and resident Bruce Corwin in the California State Superior Court for a Writ of Mandate and injunction challenging the “False, misleading, and illegally biased Ballot Question for the Initiative prepared and approved by the Council”. Key examples in the complaint alleged to be false and/or misleading in the Ballot Question include the word “Tower,” in the introductory “title” statement, the character-

ization of open space and publicly accessible garden and the statement regarding a reduction in graywater use requirements. The Ballot Question was prepared by the City Attorney and presented July 19 to the City Council for approval and was adopted by a majority of the City Council, including Mayor John Mirisch and Councilmembers Julian Gold and Kathy Riems, and opposed by Councilmember Lili Bosse and Vice Mayor Nancy Krasne in absentia. “I felt I must abide by the election code section that states that the ballot question ‘shall neither be an argument, nor likely to create prejudice for or against the measure,’” said Councilmember Lili Bosse. “The question chosen, in my opinion, did not guarantee that goal.” The “Ballot Question” refers to the question voters read when casting their vote on the initiative. It should be factual and impartial. The state Election Code requires that ballot questions for local measures constitute “a true and impartial statement of the purpose of the measure in such language that the ballot title shall neither be an argument, not likely to create prejudice for or against the proposed measure (Elec. Code §§9051, 10403). The Ballot Question reads: HILTON CONDOMINIUM TOWER INITIATIVE – SHALL AN ORDINANCE BE ADOPTED ALLOWING A 26 STORY (345 FEET) RESIDENTIAL BUILDING INSTEAD OF TWO RESIDENTIAL BUILDINGS OF 8 STORIES (101 FEET) AND 18 STORIES (218 FEET); INCREASING OPEN SPACE FROM APPROXIMATELY 1.25 ACRES TO 1.7 ACRES FOR USE AS A PRIVATE GARDEN THAT IS GENERALLY OPEN TO THE PUBLIC SUBJECT TO REASONABLE RESTRICTIONS DETERMINED BY THE PROPERTY OWNER; PROHIBITING ANY DISCRETIONARY ARCHITECTURAL REVIEW; AND REDUCING GRAYWATER USE REQUIREMENTS? Mayor John Mirisch has been very public about his opposition to the initiative, making public appearances opposing the height, the alleged reduction in graywater requirements, public access to the garden and that the initiative “undercuts the City’s authority by going directly to the voters,” according to the lawsuit. During the signature gathering campaign to become eligible for a ballot initiative, Mirisch sent a letter as the Mayor on City stationary telling residents that they could rescind their signatures of support for the measure by contacting City Clerk Byron Pope. Mirisch has been using his role as mayor to crusade against the initiative.
The lawsuit also alleges that the City Council, over a period of months, participated in improperly noticed closed session discussions to create the ballot initiative question (above). “By approving a ballot question that is false, misleading, biased and in violation of California Election Codes the city council majority has left us no choice but to file this petition,” said Briskman. “There are legal protections for cases where government officials try to take sides in elections and negatively influence voters. We are asking the court to revise the ballot question to be fair and impartial and comply with state law.” Briskman and Corwin, the Plaintiffs, are asking that the question be replaced with the following: SHALL AN ORDINANCE AMENDING THE BEVERLY HILTON SPECIFIC PLAN TO COMBINE THE 8 STORYWILSHIRE CONDOMINIUM BUILDING WITH THE 18 STORY SANTA MONICA CONDOMINIUM BUILDING RESULTING IN ONE 26 STORY BUILDING WITH ADDITIONAL HEIGHT AND TO REPLACE THE WILSHIRE BUILDING WITH 1.7 ACRES OF GARDEN OPEN SPACE THAT IS GENERALLY OPEN TO THE PUBLIC SUBJECT TO REASONABLE RESTRICTIONS DETERMINED BY THE PROPERTY OWNER BE ADOPTED? “This lawsuit challenges three aspects of the Ballot Question. It challenges the use of the term “Condominium Tower,” the statement regarding open space and the statement that the project would reduce graywater use requirements. However, the latter two statements come directly from the specific plan and therefore appear to be straightforward and clear. Furthermore, the use of the term “Condominium Tower” comes from the fact that they use “Wilshire Tower” to describe the 8 story building that houses the original Hotel. Considering this building is more than three times the height of the original building, the use of the term “Tower” seemed appropriate. As to their remedy, they asked the judge to substitute the original title issued in March for the Ballot Question. Interestingly, this is the title that they seek in the Federal lawsuit to have stricken from their advertisement. We hope that the judge will abide by the law and reject the challenge,” said City Attorney Wiener. From sources, the Courier learned as it went to press that the City is in negotiation with Hilton attorneys to resolve the issues because the City does not feel certain that they could prevail in a court of law.

“Measure 2P in Beverly Hills is being virtually paid for by a wealthy medical developer who feels that governmentsubsidized free parking helps them justify their sky-high rents,” wrote Mirisch in the Huffington Post on May 3, 2011. Declaring that “ballot box budgeting” for parking was “bad for business,” Mirisch referred to it as “self-entitlement of certain special interests,” that he said “knows no bounds. The special interests seriously think the City should blow an extra $1.3 million a year on free parking,” he wrote. Mirisch proposed changes to the City’s election code that would reveal the people behind the initiative. But the free parking initiative passed by a large margin because residents wanted free parking when visiting their doctors. It has arguably been great for business and perhaps helped to sustain the City during the hard times of the recession because people continued to visit their doctors and stayed to shop, according to Vice Mayor Nancy Krasne. Mirisch’s ordinance also passed, 5-0. The ordinance lowered the threshold for political reporting to accommodate a small city, made it mandatory to use the full name of the initiative (instead of ‘Friends of Sally,’ for example), and stipulated language to be used in disclaimers for film, print and telephonic messaging. The title is: An Initiative Measure to Amend The Beverly Hilton Specific Plan To Combine The 8 Story Wilshire Condominium Building With The 18 Story Santa Monica Condominium Building Resulting In One 26 Story Building With Additional Height And To Replace The Wilshire Building With 1.7 Acres Of Garden Open Space That Is Generally Open To The Public Subject To Reasonable Restrictions Determined By The Property Owner.” The Residents for the Beverly Hills Garden and Open Space Initiative are now suing the City because they believe the title, which is 64 words long and must be accompanied by the financial disclosers in 14-point type (The Courier uses 10-point type), “severely limits our ability to educate the public about the benefits of the initiative. . . and dilutes the campaign message” with “prominent portions of our advertising to be set aside for a campaign message.... that includes a subjective description written by a local government official.”

If only three members vote to move ahead with putting the measure on the ballot, it will go on as a General Obligation bond, which will require passage by two-thirds of voters. According to consultants from TBWB Strategies and Godbe Research, who were hired to conduct a bond measure feasibility survey, passing the much needed schoolbuilding bond measure will not be without its challenges. Just over 50 percent of voters polled supported passing a new bond. Board VP Mel Spitz said he could conceivably become the fourth “yes” vote as long as he’s given an opportunity to be part of the process and able to agree to the slate of specific projects and costs before going out to the voters. The first construction phase, now in process, was signed off by the prior board, which didn’t include Spitz or

board member Isabel Hacker. “This current school board has never reviewed and agreed on the construction projects for this school,” Spitz told the Courier. “That’s the purpose of [the study session.] To see on what we can agree and what those projects should be.” Goldstein confirmed that in January this current board authorized completion of Horace Mann, re-construction of four buildings at El Rodeo, and renovation of multiple buildings at the high school. Spitz said he was concerned about several construction elements in the second phase of construction, such as underground parking at the high school. On July 19, the board opted to table a vote to place a $400 million Prop. 39 bond on the upcoming ballot in favor of having a study session with the hope of getting the needed four votes. Goldstein told The Courier that it was likely the board would go out for a $260
million bond, although that decision will be made Tuesday. The school district is currently in the midst of revitalizing El Rodeo, Horace Mann and Beverly Hills High School utilizing money from the passage of the $334 million Measure E bond in 2008. However, that amount accounts for roughly half of what is needed to fully renovate all five schools. “We need to make a final decision on everything on Tuesday,” Goldstein said. He underscored that given the school facilities’ age and the region’s vulnerability to earthquakes it is critical to complete renovations as expeditiously as possible. Community members who would like to participate or observe the process are encouraged to attend Tuesday’s upcoming study session, which will run from 2-5 p.m. at the district’s Administrative OfficeBoard Room located at 255 S. Lasky Dr.

MARCIA WILSON HOBBS LETTERS TO THE EDITOR Last month I attended my first Beverly Hills City Council meeting and was deeply disappointed. I'm neither a public speaker nor a politician, and definitely not a great writer, however after what I experienced this evening I felt the need to put my thoughts out there. The night’s agenda included the Beverly Hills Garden and Open Space Initiative ballot language question and related topics. There were many residents in attendance some of which were against it and many of which were for it. Many were older residents and a handful were just young college kids who wanted their opinions heard. All seemed to be asking for the same thing - for the City Council to be unbiased to either side and allow the residents of BH to form their own opinions on this initiative without being swayed by the mayor who is uncharacteristically very vocal about his opposition, and other councilmembers who have expressed their personal opinions. Among the issues was to vote to change the verbiage on the ballot so there are no derogatory or negative words used. Simple right? Bland basic words to explain the initiative, how hard can that be? Very hard though when you’re trying your best to sway public opinion. It was so obvious during this meeting that most of the councilmembers had formed their own opinion against this initiative and were really uncaring of what the residents had to say. Most infuriating though was their attitude and obvious lack of respect for residents that were there to support the initiative. The worst was the few younger residents who got the courage to go up and voice their opinions - I should say not so much their opinions being to support the initiative but their requests to the councilmembers to remain impartial and allow residents to form their own opinions based on facts. What I witnessed was such a lack of respect for these kids. Not one of the council member even acknowledged their presence, as each one spoke the majority of the council members just looked down, preoccupying themselves with whatever paperwork was in front of them. Where was the respect of looking at someone and acknowledging them as they speak? Aren't the councilmembers supposed to represent the City and residents and not so much their personal feelings and agendas? Only councilmember Bosse appeared completely impartial, and stressed the importance of not showing any bias. However at one point even her opinions were quickly dismissed. What happened to empowering our youth? What are we teaching them? That if the councilmembers do not personally agree with what you are saying that you will just be ignored? Aren't we supposed to be encouraging our children to stand up for what they believe in, even if we believe otherwise? As parents we teach our children to stand up for their beliefs, we teach them to educate themselves on matters they believe in and give them the tools to do so. They are the next generation of homeowners, business owners and policy makers in Beverly Hills and what did we teach them today? The exact thing this generation is rebelling against. We showed them that their opinion doesn't matter and is not respected. Today we taught them that personal opinions of policy makers overrule any opinion
that they may have. It was heartbreaking watching those kids walk away from that podium with their heads down, not because their opinions were opposed but because they were treated as if they were invisible. It was obvious at the end when the council voted on the initiative’s ballot measure that they took zero consideration of the opinions of the residents who spoke. I've been a resident of Beverly Hills the past 25 years and had great pride in our City. I’ve raised my children here and taught them to love, respect and be active members of this community. That night I lost a big part of my respect for this City. I’ve come to realize that personal agendas come before the rights and respect of our community. I hope our children have better leaders in the future, who will empower them, encourage them to speak their minds, and equally important, show them by example that we are a community that respects each Vered Nisim other. ****** The Beverly Hills Garden and Open Space Initiative is a classic example as to how one with great wealth can use it to deceive the citizens of Beverly Hills. Beny Alagem's use of ads about the garden to be developed is wonderful except he will own and control it, not our citizens. The gardens’ use by persons other than guests of his hotel will be totally dependent upon his allowing such use. He owns and controls it, not the City of Beverly Hills. There are no guarantees as to its use by our City's residents. He distorts how his contemplated new structure will have no impact because it contains the same square footage. Increasing the height of such a structure places enormous stress on it while being built. And to be able to do so by a vote of the public without any architectural control nor review by the City is sheer madness. Note that the picture of the purported development never shows the true height of his contemplated project. Once such a monstrosity is allowed to be built, it will forever change the skyline of our City and only result in more such developments in the future. If one loves the City, one must vote against any ballot favoring such development. Donald Leve
