Longtime Beverly Hills Elected Official, Community Leader Frank Fenton Dies At 78 By Matt Lopez Frank Fenton, a community leader and longtime Beverly Hills elected official, passed away Thursday at age 78 from complications of Parkinson’s Disease. Fenton’s life as a Beverly Hills public servant spanned nearly three decades until he retired in 2009, but not before he was briefly installed as mayor of Beverly Hills, making him the City’s only elected official to have served as a Beverly Hills Unified School District board member, City Treasurer and Mayor. As a child, Fenton escaped from Germany in the midst of World War II, arriving in Cuba before heading to the United States. He attended elementary school in the U.S. before his family moved to São Paulo, Brazil, where he spent half his high school years

Beverly Hills High Oil Well Still Contentious, Superintendent Calms Concerned Families By Laura Coleman It’s been 13 years since the court ruled against Erin Brokovich’s allegation that the Beverly Hills High School oil well caused cancer in former students and staff, but there are still many today who fervently believe that oil-extraction at the site remains highly problematic. This week, Beverly Hills High School alum Marty Halfon (Class of 1976) took to Facebook to allege that the current Board of Education is failing to demonstrate that the high school is safe. By Victoria Talbot The City of Beverly Hills has reached a settlement agreement with “Residents for The Beverly Hills Garden and Open Space Initiative” over the City’s disclosure ordinance regarding the Hilton Initiative for the Nov. 8 ballot. The agreement affects all advertising for the initiative and associated campaign disclosures. The federal lawsuit, filed last week, “raised a serious question whether the ordinance violates the First Amendment as applied to certain of Plaintiff’s intended political advertisements,” according to the stipulation. “The balance of equities and public interest weigh in favor of protecting Plaintiff’s

and states: “I want evidence.” To emphasize his point that the high school’s air quality is suspect, Halfon highlights the BHHS oil well currently operated by Venoco, the 25 abandoned oil wells under the school, and steam coming from a nearby “power plant,” which Superintendent Steve Kessler subsequently clarified is actually a “chilled water distribution center.” After being informed of what was taking place in the digital realm, Kessler notified families via email on Wednesday, Aug. 3 that they have nothing to worry about in terms of the school’s air quality. Further, he wrote, there have been no findings that support any belief that there is cause for concern (see ‘OIL WELLS page 15)

By Victoria Talbot The City has posted the “impartial analysis” by City Attorney Larry Weiner, the argument in favor and the argument opposed to the Hilton Initiative, on the City website at www.beverlyhills.org. Sources tell the Courier that the City has been receiving calls asking if the entire City Council indeed, agrees with argument against the project. Both Vice Mayor Nancy Krasne and Councilmember Lili Bosse have gone on record to say that they will not disclose their position in favor or against the project, and that they do not wish to be included in either group. The argument includes language such as, “the Beverly Hills City Council urges you to Vote No,” and a signature, “John Mirisch Mayor, City of Beverly Hills for the City Council.”

Another signature, “The Municipal League of Beverly Hills by: Thomas A. White, Chairman,” has created commentary from members of the Muni League who did not vote to support or deny the issue. Chairman White explained that the annual meeting in June, held at the Peninsula, was held before it was known that the initiative was to go on the ballot. The Nov. 8 ballot initiative will also have the following “impartial analysis”: This measure concerns the 8.97 acre parcel bounded by Wilshire Boulevard, Merv Griffin Way, and Santa Monica Boulevard. On the property today is The Beverly Hilton Hotel and under construction is the Waldorf Astoria Hotel. In 2008, the City of Beverly Hills approved “The Beverly Hilton Specific Plan” (see ‘HILTON ANALYSIS’ page 16)

NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that on Tuesday, August 16, 2016 at 7:00 p.m., or as soon thereafter as the matter may be heard, in the Council Chamber of the City Hall, 455 N. Rexford Drive, Beverly Hills, CA 90210, the Council of the City of Beverly Hills will consider adopting an ordinance entitled: AN ORDINANCE OF THE CITY OF BEVERLY HILLS REGULATING LANDFORM ALTERATIONS, EXPANSIONS OF LEVEL PAD AREAS OF LOTS, AND DEVELOPMENT OFF THE LEVEL PAD OF LOTS IN THE HILLSIDE AREA OF THE CITY The proposed ordinance includes the following measures, which would apply to Hillside development projects until such time that permanent hillside development regulations, which will be studied by the City over the next several months, are adopted: •

No more than two thousand (2,000) cubic yards of earth material may be imported or exported from a site in the Hillside Area that is immediately adjacent to a street that is less than twenty four (24) feet wide, unless a Hillside R-1 permit is issued pursuant to Section 10-3-2550.A. of the Beverly Hills Municipal Code. The current limit of export/import before an R-1 permit is required is 3,000 cubic yards per 5 year period. The current regulation does not include provisions regarding the width of adjacent streets (BHMC § 10-3-2521). A level pad area must contain a level square-shaped area with minimum dimensions of twenty (20) feet per side for the level pad to be used to calculate the maximum permitted cumulative floor area of buildings and structures in the Hillside Area pursuant to Section 10-3-2502.B. of the Beverly Hills Municipal Code. The current BHMC standards do not include a minimum level pad size to qualify for use in maximum floor area calculations. The maximum cumulative floor area of the portion of any buildings and structures located off the existing level pad of any lot in the Hillside Area of the City shall be one thousand (1,000) square feet, unless a Hillside R1 permit is issued pursuant to Section 10-3-2550 of the Beverly Hills Municipal Code. For purposes of this Ordinance, “level pad” shall have the meaning set forth in Beverly Hills Municipal Code Section 10-3-100, and “existing level pad” shall mean the level pad in existence on the date this Ordinance takes effect. There is currently no limit to floor area developed off the level pad before an R-1 permit is required.

This Ordinance has been preliminarily assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The City Council will consider the adoption and implementation of the Ordinance to be exempt from CEQA pursuant to Section 15061(b)(3) as there is no possibility that adoption and implementation of the Ordinance may have a significant effect on the environment because the Ordinance does not authorize construction and it would impose greater restrictions on certain development in order to protect the public health, safety and general welfare. Additionally the City Council will consider if adoption and implementation of the Ordinance is eligible for a Class 8 categorical exemption pursuant to Section 15308 of Title 14 of the California Code of Regulations for actions taken to assure the maintenance and protection of the environment. Any interested person may attend the meeting and be heard or present written comments to the City Council. At the public hearing, the City Council will hear and consider all comments. Sam Grundwerg Replaces David Siegel As Consul General Of Israel In L.A.

He was named by Israeli Prime Minister Benjamin Netanyahu in April 2016 to replace David Siegel, who just finished serving here for the past five years. By Victoria Talbot Ex-Beverly Hills Mayor Barry Brucker is raising the ire of Sacramento attorney Gary Winuk. In a letter to the City, Winuk says that final approval of the $1.2 billion One Beverly Hills project should be denied because Brucker became a paid lobbyist for them after leaving office. Brucker served 2008-9, 2011-12, and then defied the City’s “revolving door” policy that prohibits former officials from taking a compensated position by a project that was voted on while the official was in office. Municipal Code 1-9-203.B states that: “Representation By Former Elected Official: No former elected official shall represent, for compensation, any person or entity, by making any communication to the city, if the communication is related to a land use matter which was voted upon by the elected official during his or her term of office. “The violation by Mr.

Beverly Hills Residents Fred, Andrea Fenster Venture Into The Wine Business With Pete Rose By Olivia Lipari Beverly Hills residents Fred and Andrea Fenster are swinging for the fences with their new Hit King Wines, which sells Pete Rose-themed wines. Like a fine wine, the idea had been fermenting for years following a playful exchange between the Fensters and their longtime friend Rose, the alltime Major League Baseball hit leader. Recalled Fred Fenster: “I once mentioned how funny it would be to name a wine Pete Rosé.” Fast forward to 2014, when rosé wines started to grow in demand throughout the state. “It seemed like the perfect opportunity to launch the Pete Rosé,” Fred Fenster said. With the green light from Rose to pursue an eponymous wine, the Fensters pitched their idea to Summerland Winery last year, and thus Hit King Wines stepped into the batters box.

To date, there are three varieties: Charlie Hustle Red, a Cabernet; Hit King White, a Pinot Grigio; and of course, the Pete Rosé, made from Grenache. Even though the bottles are geared for collectors, with the Pete Rosé “Legacy Edition” including Rose’s famed signature, Fred Fenster emphasized that the wines are actually delicious. “We served the Pete Rosé at a party and the people who drank it said it was the best rosé they had ever tasted,” he said.

Beyond the tasty kitsch value, the wine is also doing some real good in the world. Fenster said that Rose is donating his net proceeds from Hit King Wines to Hustle for Heroes, a non-profit foundation dedicated to improving healthcare and employment opportunities for veterans. Board Of Education Yet To Agree On New School Bond By Laura Coleman Following a three-hour study session Tuesday intended to hammer out details for a new school-building bond, the five-member Board of Education failed to reach consensus on asking residents to support the district’s renovation plans. The school district is now actively revitalizing El Rodeo, Horace Mann and Beverly Hills High School utilizing money from the passage of 2008’s $334 million Measure E bond. However, that amount is less than half of what is needed to fully renovate all five schools. Following years of investigations by architects, engineers, consultants and stakeholders, experts determined that the district needs around $400 million more than it now has available. In addition to fully transforming all five public schools to withstand strong earthquakes, that amount includes a plan to integrate technological advances to maximize 21st century learning opportunities, while also preserving historic architectural features. “I would vote for the $400 million today,” board member Noah Margo said at Tuesday’s meeting. The board has until Aug.

12 to inform the L.A. County Registrar of Voters of the bond particulars in order to qualify for a November ballot measure. Otherwise, the board must wait until 2018 before going out to voters with a new bond measure. At last week’s formal meeting, Board President Howard Goldstein emphasized that given the school facilities’ age and the region’s vulnerability to earthquakes, it is critical to complete renovations as expeditiously as possible. In 1994, the Northridge earthquake destroyed most of Beverly Vista, which was rebuilt following the passage of Measures S and K. Board member Lisa Korbatov, who joined the board six years ago following an election campaign that vowed to clean up the dilapidated high school, emphasized that local children will return to the City’s public school system once the classrooms actually reflect 21st century learning. In truth, one needs only to visit parts of the school district to see firsthand that the quality of the buildings is not commensurate with legacy. Bel-Air’s Lucy Meyer Tapped As Icon Girl For Perverse Sunglasses By Laura Coleman Local Bel-Air resident hero Lucy Meyer, 17, is once again using her special brand of enthusiasm and commitment to raise money for children with disabilities after being named the inaugural “Icon Girl” for Perverse sunglasses. All proceeds from a limited edition line of Perverse sunglasses, which were created, designed, and modeled by Lucy, will be donated to UNICEF. By Victoria Talbot Pulitzer Prize winning journalist Russell Carollo has filed a Petition for Writ of Mandate and Complaint against the City of Beverly Hills for access to public records for, “Detailed information required to be culled from all writings prepared in response to or investigation of all complaints and calls for assistance received by Beverly Hills Police Department involving John Alan Mirisch, mayor of Beverly Hills, including but not limited to incidents occurring on 1/24/2008 and 2/28/2010 involving alleged incidents of domestic violence.” Carollo has instituted proceedings for a Writ of Mandate to enforce the public’s right to obtain information from the City of Beverly Hills, and a Complaint for Declaratory and Injunctive Relief. “I've filed public records requests for decades and feel strongly that the public has a right to records documenting how the government works,” wrote Carollo in an email to the Courier. In response to Carollo’s California Public Records Act (CPRA) request, the City furnished a copy of two incident reports, “which contain nearly none of the information required to be disclosed by law,” according to the action. “The City will be withholding exempt records and redacting those

portions of records that are exempt from disclosure, because records of complaints to, or investigations conducted by, local police agency are exempt from disclosure pursuant [to] California Government Code Section 6254(f),” wrote Sylvia Gelfman, records and jail manager, custodian of records for the BHPD, in an email response to the CPRA. The two incidents Carollo referred to in his CPRA request involve Mirisch and then-wife Magdalena Mirisch. The first report is for the evening of Jan. 24, 2008 for a Keep the Peace incident type with Officer Moreno. The second is on the evening of Feb. 28, 2010 with officers Arriaga and Williams, which the “incident report” attached to the complaint lists as “Corporal Injury/Spouse.” But the City provided no further details. In cases of reported Corporal Injury to a Spouse or Cohabitant (Penal Code 273.5(e)(1)) it can be either a misdemeanor or a felony to inflict force or violence on an intimate partner. Sources confirm that an officer must arrest if there is injury to one or both parties when there is an allegation of corporal injury to a spouse or intimate partner. If there is no evidence of physical trauma, the officers would have to document the scene carefully if (see ‘CPRA’ page 18)

BAD IN BEL-AIR – Another week, another new renegade construction project for Bel-Air residents to contend with. This time, it comes from Quigg Builders’ 454 Cuesta Way, where the project is alleged to have skirted several rules regarding parking in noparking zones, extended periods in 2-hour parking zones, and having more access points than is allowed by the Zoning Administrator. Crews have parked trucks blocking neighboring gates, and residents – who wish to remain anonymous – have told the Courier that workers have been rude and threatening to residents. L.A. Department of Building and Safety spokesman David Lara did not respond Thursday when asked if the LADBS has issued any violations to the project, but it appears that the department is not able to enforce its own rules on this project.

they decide not to make an arrest. “A serious question arises as to the completeness of the agency’s assistance involving serious allegations of domestic violence by a high ranking public figure. Public access to this information is also important to assess whether special treatment was afforded a public official with substantial decision-making power and influence over police department budgetary matters,” said Carollo. Carollo is a freelance journalist based in Colorado who specializes in computer-assisted reporting, Freedom of Information Act, public records, the military and long-term investigative projects. Sources tell the Courier that he has also requested files on former Police Chief Dave Snowden and former Mayor Barry Brucker. The suit claims that in a declaration filed by Mirisch in 2012, he said his wife called the BHPD at the end of 2009 alleging violence. It also claims that Magdalena Mirisch’s declarations filed in their divorce proceedings, “recount numerous other instances of alleged abuse,” which resulted in the court issuing a temporary restraining order against Mirisch that was discharged in Jan. 2012. Carollo’s suit claims that the City returned only “skeletal incident reports” for his CPRA request and an “Incident Report,” “which contained no details about the agency’s response, the factual circumstances surrounding the crime or incident, or the injuries sustained.

Gov’t Code §6254(f)(2).” In an e-mail, Carollo told the Courier: In this case, according to the Beverly Hills Police Department, five units were dispatched to the home of current Beverly Hills Mayor John Mirisch in February 2010. At the time, Mirisch was a city council member, a position that gave him significant influence over the city’s police department. The BHPD incident report cites the reason for the call as Penal Code 273.5, which is corporal injury to spouse, a felony. Did the BHPD investigate this alleged abuse by Mirisch as it should have? They’re not providing the records that could answer that question. In response to my public records request and several follow-ups, the department failed to provide any of the investigative records that are typically produced in cases such as this. Either BHPD didn’t investigate the alleged spousal abuse or they are improperly withholding the records. The public has a right to know which it is. Mirisch and his former wife were married in 2006 and purchased property in Beverly Hills in 2007. They were divorced in 2013, and Magdalena has recently remarried. City Attorney Laurence Weiner said that he could not comment on the case.

UCLA Medical Center Ranked Nation’s 5th Best Hospital, 3 SoCal Providence Centers Recognized UCLA Medical Center, with hospitals in Westwood and Santa Monica, ranked fifth in the nation this week on U.S. News and World Report’s Best Hospitals Honor Roll, a slight drop from last year when it tied for third. The Mayo Clinic topped the list, followed by the Cleveland Clinic, Massachusetts General Hospital and Johns Hopkins Hospital in Baltimore. The Honor Roll highlights 20 hospitals out of nearly 5,000 nationwide for their expertise in treating the most challenging patients in at least six medical specialties. Now in their 27th year, the rankings help guide patients to hospitals that deliver outstanding care across 25 specialties, procedures and conditions. The Best Hospitals methodologies include objective measures such as patient survival, the number of times a given procedure is performed, infection rates and adequacy of nurse staffing. “By any measure, UCLA Health delivers the highest quality care available,” said Johnese Spisso, president of UCLA Health. “We are honored to be recognized

Rather than expend time and resources litigating the matter in court, the parties have agreed on terms of a mutually acceptable preliminary injunction that clarifies and modifies the operation of the ordinance. The revised rules will apply to all advertisements for the November 8, 2016 Beverly Hills ballot measure election — both for and against the proposed initiative. After the election, the City will work with all Beverly Hills residents to revise the City’s campaign advertising ordinance. This settlement does not affect the legal challenge brought in state court challenging the City’s proposed ballot question relating to the Beverly Hills Garden and Open Space Initiative.” According to their joint statement, following the election, the City is to work with Beverly Hills residents to revise the campaign disclosure ordinance. Judge James Chalfant has been named to hear the state lawsuit filed last week, which addresses the actual ballot language on the Initiative Question. In addition, Vice Mayor Nancy Krasne is expected to file a writ to block the submission of the argument against the initiative by Mayor John Mirisch, on the grounds that he has written it on behalf of the entire City Council. Vice Mayor Krasne has stated publicly that she will neither support nor oppose the project. Councilmember Lili Bosse has also stated that she will not support or oppose the project, but has not joined the writ.

Beverly Hills City Attorney Laurence Weiner told the Courier that Brucker had asked him when the City’s revolving door policy restrictions against lobbying would expire. “Mr. Brucker asked me about the

expiration of the 30 month prohibition on lobbying. We did not discuss his participation in the Wanda project.” Gary Winuk manages the Sacramento office of the Kaufman Legal Group. He joined the practice last year after serving as Chief of the Enforcement Division at the Fair Political Practices Commission from 2009-2015. He currently focuses on providing campaign and governmental ethics advice to candidates, elected officials, ballot measure campaigns and other political entities. He is a recognized expert in the field and gives frequent lectures and media commentary on these issues, in addition to serving as an Adjunct Professor on campaign and ethics issues at the

McGeorge School of Law, according to his firm’s website. Former mayors frequently attend planning commission hearings as lobbyists and often have good relationships with commissioners and City staffers, formed over years of working together. They bring institutional knowledge, personal experience and working relationships with commissioners and staff to their job. Residents often report feeling outgunned when they appear to protest development and its affects on their own neighborhood. “Having former public officials be compensated to continue work on a project they voted for is unconscionable,” wrote Winuk. “It raises questions of whether their initial

vote was made in order to ‘feather their nest’ for the future. It also raises questions of undue influence when a former elected official comes back to lobby their former colleagues. It makes the whole process tainted and destroys public trust in their government.” Winuk did not reveal who his clients are except to say that he wrote on behalf of himself and “individual City of Beverly Hills residents.” “The ordinances only provide for a single remedy when such a violation occurs: rejection of any contract, approval, permit or transaction related to any such violation,” said the letter. Weiner responded that, “Mr. Winuk is not correct. The lobbying ordinance does not mandate that a project be denied. Instead, whenever a City official or former elected official violates the restrictions of Title I, Article 9, the code permits the City Council to deny the project. The Council has discretion to evaluate the significance of the violation.” Eric W. In addition to the existing hotel, the Original Plan authorizes two residential buildings, the Waldorf Astoria Hotel, conference facilities, accessory structures and landscaped open space. In 2016, a petition was circulated and signed by the requisite number of voters to place an initiative on the ballot to amend that Original Plan. Among other changes, this amended plan (Initiative) would combine the two residential buildings into one building with additional height, and create a private garden generally open to the public. RESIDENTIAL BUILDINGS. The Original Plan authorizes two residential buildings totaling 110 residential units. One is an 8 story building (101 feet) at the Merv Griffin/Wilshire corner. The second is an 18 story building (218 feet) at the Merv Griffin/Santa Monica corner. The Initiative combines these two residential buildings into one 26 story (345 feet) tower at the Merv Griffin/Santa Monica corner. It also adds 10 “accessory staff rooms” to the 110 approved residential units. The accessory staff rooms will be no greater than 500 square feet each and will not have kitchen facilities. OPEN SPACE. The Original Plan includes a Sculpture Garden and Subtropical Garden as open space at the Merv Griffin/Wilshire corner. These gardens occupy approximately 1.25 acres. The Initiative replaces these gardens and the 8 story building

The Original Plan authorizes a two-story Conference Center (41 feet) along Wilshire Boulevard. The Initiative replaces that Center with a one story “Conference/Hotel Facilities Addition” (22 feet) that contains meeting rooms, a restaurant, and ancillary hotel uses. It moves the hotel pool for the Beverly Hilton to the roof of this addition. Pool amenities may be 18 feet above the roof for total height of 40 feet. DESIGN REVIEW. The Original Plan requires the developer to obtain design approvals from the City’s Architectural Commission. The Initiative removes the Architectural Commission’s discretion and requires the Commission to approve any final designs that substantially conform to the Initiative. WATER. To reduce the project’s water demands, the Original Plan requires all new buildings to be served by a “graywater system.” The Initiative requires collection of graywater from new buildings; but it only requires graywater to be used on gardens and landscaping. A YES vote on the measure implements the Initiative. A NO vote on the measure leaves the Original Plan in place.

Clippers Eye West L.A. For New Arena By Matt Lopez Clippers owner Steve Ballmer is believed to be eyeing potential sites in West L.A. to build a new arena for the Clippers, ESPN reported last Wednesday. “One NBA source said that an area that piques the franchise’s interest is Los Angeles’ west side,” ESPN’s Kevin Anovitz stated.

Along with the Lakers and Kings, the Clippers have been co-tenants of Staples Center, owned and operated by Anschutz Entertainment Group (AEG), since it opened during the 1999-2000 season. The Clippers agreed to a 10-year lease extension in January 2013 which will keep the team in Staples Center until June 2024.

Thanks to the Courier’s online edition, this column enjoys an international readership. I am often asked by residents of cooler climes what do we do in the summer to survive heat that often exceeds 110 degrees on consecutive days, if not the occasional week or two. Alice from Birmingham (England) emailed asking what it had been like surviving here a couple hundred years ago, and were there permanent residents of the Desert way back then? The answer is yes, there were permanent residents from various tribes living in what is now the Coachella Valley for centuries. But, much like today’s residents, they got away from the valley floor during the summer. Yesteryear’s residents made their way up into the surrounding mountains where temperatures were cooler and clean water was abundant. When it was time to return to the desert floor, the Native Americans chose to live around a palm tree shaded oasis where it was a few degrees cooler and cool water still flowed down from the San Jacinto Mountains.

Water was kept cool by putting in anolla (an unglazed ceramic jar) and hanging it from a nearby tree. Refrigeration was also provided by a frame made of burlap that they dripped water onto allowing the process of evaporation to keep whatever was placed inside cool. Burlapdraped windows served the same purpose. Even adobe had a special purpose in the Desert–making thick-walled structures, some of which remain today. Now, we have proper refrigeration, of course, but a major portion of our population still heads out-of-town following in the footsteps of earlier Desert settlers. So, nothing changes. 2016 National Night Out

On Tuesday evening, City residents descended upon Rexford Drive to meet the Beverly Hills Police & Fire Departments and learn about living a safe life during National Night Out, an event that hundreds of communities across the country stage. Beverly Hills’ event showcased the various units of the City police and fire departments, the Health and Safety Commission, and City emergency management units, among other things. Attendees could take a ride in an earthquake simulator, sit on a police motorcycle, learn how to operate a fire extinguisher, learn the basics of CPR, and meet police dogs. Dogtown Dogs, Baby’s Badass Burgers, and Sprinkles Cupcakes provided food for this fun and informative event.

LETTER TO THE EDITOR Whatever is going to be built by The Beverly Hilton, the Wanda Group, and wherever the Century City's Metro station is going to be located, something will be built. The tower at 10,000 Santa Monica Boulevard is nearing completion, and construction at the Westfield Century City Mall is well under way. What we need now is something to tie it all together, something like the High Line in New York City. How about an elevated walkway, with a ramp leading to the street level at the eastern end and connecting with the main outdoor level of Westfield Century City Mall at the western end? From Moreno Drive westward, there is an existing median strip above which the walkway could be built. East of Moreno Drive, it might hug the north side of North Santa Monica Boulevard, or perhaps cold be incorporated into the redevelopment of the commercial properties between South and North Santa Monica Boulevards. In places, the walkway

could be wide enough to allow restaurants, retail stores, tourist services, etc. It would be planted with trees, gardens and perhaps small areas of droughttolerant grass. A bicycle path might be incorporated into it. Such a walkway would elevate (both literally and figuratively) pedestrians above the traffic on Santa Monica Boulevard. (It is currently not a pleasant walk between Beverly Hills and Century City.) I could reduce vehicular traffic and encourage pedestrian and bicycle traffic on this congested, heavily traveled corridor. I would envision construction and management by some joint public-private partnership involving Beverly Hills, Los Angeles, the Hilton/WaldorfAstoria, the Wanda Group, 10,000 Santa Monica Boulevard, and Westfield Century City Mall. I am not a city planner. I am not an architect. But I have seen enough, including the High Line in New York City, to know a good idea when I steal one. Daniel Fink

During their time in Little League, the Fenton’s championed to take the empty lot on Le Doux Road and Olympic Boulevard and turn it into a sports field. In 2009, La Cienega Park’s baseball field was named Frank Fenton Field. In 1983, at the urging of many, Frank ran a grassroots campaign that ended with him being elected to the Beverly Hills Board of Education. He was re-elected in 1987, and is credited with helping keep the board together during a tumultuous teachers’ strike. After ending his term on the school board, Frank chaired the Beverly Hills Education Foundation before moving on to serve on the City’s Parks & Recreation Commission. In 2001, when the city treasurer’s seat became available, Frank jumped at the opportunity and served in the position for four years. “Through his leadership and financial acumen, Fenton developed and helped implement a financial strategy for Beverly Hills which has kept us on solid ground, even in today’s challenging economic times,” said City Treasurer Eliot Finkel in

Fenton met his future wife Judie, who was volunteering at the hospital while finishing school. After her graduation, the pair married. Frank went on to graduate from Cal State Los Angeles with a degree in business administration and immediately went on to become a stockbroker at Sutro, where he was eventually promoted to become the youngest manager in the company’s history before leaving to take a position at Smith Barney, where he was named senior VP. It was on Feb. 9, 1971–the day of the Sylmar earthquake–that Frank and Judie packed up and moved their family to Beverly Hills, enrolling children Mindy, Gary and Steven in Horace Mann and kickstarting what would be decades of service in Beverly Hills by the Fenton family. The Fenton family instantly became a fixture in the community, joining the Horace Mann PTA–where Judie was later named president. The Fentons helped lobby on behalf of Horace Mann–which at the time was known as the “forgotten school”–to receive newer textbooks to put it on par with El Rodeo, Beverly Vista and Hawthorne. Soon after, sons Gary and Steven joined Beverly Hills Little League, which Frank became president of in 1978. The Fenton family forged a strong commu-

Throughout my career I have worked to follow both the letter and spirit of all laws, especially our Beverly Hills ordinances. In July of 2015, I wrote to City Attorney Larry Weiner confirming that the time limits in the City’s revolving door policy would no longer apply to me after September 27, 2015, and he responded affirmatively. I believed that due to the at least three ownership changes of the site located at 9900 Wilshire, along with the change of use, that the project that was being undertaken was not the same as the project that I voted on when I a 2009 Courier interview. Fenton contemplated running for a third term as treasurer in 2005, but, at the urging of residents, was elected to the City Council in 2005. On the council, Fenton served on several key ad-hoc committees and helped lead the campaign to bring two-hour free parking back to Beverly Hills. In addition to his roles with the BHEF and Beverly Hills Little League, Frank also served on the Maple Counseling Center’s Board of Directors; the Beverly Hills Police and Community Together (PACT) organization; the Wilshire Boulevard Temple, American Red Cross, West Los Angeles. He received the Outstanding Community Service Award from the Maple Counseling Center in 1986. Frank is survived by Judie, his adoring children and grandchildren Mindy (Dennis) Fenton Samuels, Kelly Samuels, Sean Samuels, Gary (Katie) Fenton, Brady Fenton, Carter Fenton, Steven (Leeza) Fenton, Nate Meadows, Troy Meadows, Leksy Bell, Jennifer (Ryan) Smiley, Kaden Smiley, Parker Smiley and his dedicated caregiver and trusted companion, Daisy Sorto. In order to qualify for a Proposition 39 bond, which requires 55-percent voter approval to pass the measure, four members of the five-member board must vote to put the bond. If the board doesn’t get the four votes needed on the dais to qualify for a Prop. 39 bond, as long as three members vote to move ahead with putting it on the ballot, it will go on as a General Obligation bond, which will require passage by two-thirds of voters. Perhaps the only necessity related to the bond the entire board agrees on is that they really do need those four votes. According to consultants from TBWB Strategies and Godbe Research, who were hired to conduct a bond measure feasibility survey, just over 50 percent of voters polled this year supported passing a new bond. Wanda has applied to the Planning Commission for a Supplemental Environmental Impact Report (SEIR), NOT a new Environmental Impact Report (EIR). That is because their claim is that it is not a new project, but rather a supplement to the original. City Codes regarding change of usage such as the addition of hotel rooms and the big increase in retail square footage will likely require a new EIR.

ported moving forward with a November bond measure, Board VP Mel Spitz said he could conceivably become the fourth “yes” vote as long as he was given an opportunity to help shape the details surrounding what specific projects the district intends to move forward in building as part of the new bond measure. Tuesday’s study session was intended to shore up the specifics, however it was unsuccessful, with Spitz stating that there was more to discuss at Tuesday’s upcoming meeting. Boardmember Isabel Hacker seemed even less inclined to vote for a new bond any time soon following this week’s meeting, although she has publicly said that the board does need those four votes. At the close of Tuesday’s meeting, Goldstein, Korbatov and Margo expressed support in placing a $290 million bond measure on the upcoming ballot. That amount includes $30 million for technology and reflects a plan to delay work on renovating BHHS building A (at an estimated cost of $109 million) in favor of renovating Hawthorne (at an estimated cost of $91 million.) At next week’s upcoming formal meeting on Aug. 9, the board will vote on moving forward with a plan to ask Beverly Hills residents to decide on just what the City’s public schools will become.
