FASHION’S NIGHT OUT—Fashion’s Night Out will take place at Rodeo Drive on Sept. 8 from 6 to 10 p.m. Pictured is the 2010 Fashion’s Night Out with the iconic Ferris Wheel, which will return to this year’s event. Attendees can receive complementary rides on the Ferris Wheel with a proof of purchase from participating retailers on the day.
The Rodeo Drive Committee has announced that Fashion’s Night Out will return to Rodeo Drive and the 90210 as a part of the global shopping event on Thursday, Sept. 8, from 6 to 10 p.m. The iconic ferris wheel which won rave reviews last year and became the symbol of the West Coast’s participation is back for complimentary rides with proof of purchase at participating retailers in 90210 on that day. The three-block stretch of Rodeo annually accounts for approximately $360 million in sales or over $1 million per day. This year, there will be a variety of specialty performers including flamethrowers and stilt walkers turning Rodeo into a virtual midway. The evening’s festivities include 67 instore events, numerous cocktail parties, celebrity appearances, extended shopping hours, flamethrowers, stilt walkers, 15 of L.A.’s top gourmet food trucks and Cirque Du Soleil’s Flipbook Experience where visitors have the chance to insert (see ‘FASHION’S NIGHT OUT,’ page 12)

The City Council’s ban on oil wells on the Beverly Hills High School campus caused a rare joint meeting of the Beverly Hills Unified School District Board of Education and the Beverly Hills council jointly Tuesday.
Both elected bodies were unanimous in their opposition to continue presence of oil wells on the campus. The ban would cause the existing oil wells to be shut-in and production stopped (see ‘OIL WELL EXPIRATION,’ page 9)

I
t isn't a mystery where GRETA, the high-end Beverly Hills ladies boutique draws its inspiration from. It's the owner herself; Greta Feigler. Simply put, the immaculately attired, classically adorned, charming sophisticate is a genuine, original “class act”. “W hat a lovely place”, I effuse after Greta greets me with a rare and old fashioned warmth that makes me feel like we're old friends. “Oh, it keeps me out of trouble” she chuckles. As I learn later in our chat, that's quite the understatement. Greta opened her Beverly Drive store in the 1950’s and has walked to work every day since. She came to California with her husband, fell in love with Beverly Hills and never strayed. “Is your husband still alive”? I enquire. “No, but I have a boyfriend of 37 years” she smiles a little wickedly.

RETA recently celebrated its 50th Anniversary with much fanfare (this is a lady who loves to host a party) and we chat about the comings and goings she’s seen over the past half-decade in the world of fashion and one of the worlds’ iconic fashion cities; Beverly Hills. She talks with fondness about her inspirations and love of Italian couture, her idol Gianni Versace and her favorite designers; Armani, Valentino and Vivienne Westwood. “Also my mother" Greta adds. "My mother dressed simply, and understated, but was always chic. She was a mainstay in the store, the shop mascot”.

fter reminiscing about the past, our conversation turns to the future. “What’s next”? I ask, expecting a blow-out retirement party somewhere in her response. Her eyes light up and she excitedly shares plans that are underway to open a new “store within a store”. Using her keen eye for the unusual and beautiful, Greta and her co-pilot of 30 years; Iris, are launching “Melange” during the fall of 2011. A collection of antiques, vintage accessories, paintings and collectibles, “Melange” sounds like an emporium of gorgeous treats and treasures.
Ibyamthosein awe of this lady. An adventurer, a pioneer, a tailor and designer, fashion buyer, entrepreneur, wife, mother, fabulous party-thrower and adored fortunate enough to know her. At the grand age of 87, Greta is still going strong, and apparently has several more champagne bottles to pop. Cheers!

Commission Discusses View Preservation Project By Marla Schevker The Planning Commission discussed the second part of the view preservation project at their meeting last Thursday. During the meeting, Commissioner Noah Furie and Vice Chair Craig Corman proposed a “two track procedure on the View Preservation Ordinance.”
Commission Chair Dan Yukelson said the proposal will give view owners the “option” to obtain an “advisory opinion” from the City at any point in the process before applying for a Planning Commission hearing. “If a view owner obtains an ‘advisory opinion’ they will
then be prohibited from applying for a Planning Commission hearing for 18 months,” Yukelson said. “I think this was an excellent proposal made by (Furie and Corman) as it gives view owners flexibility and a less expensive option to resolve their view issues without (see ‘TROUSDALE,’ page 11)

Thursday Morning Bomb Scare On Camden Drive By Brenton Garen Beverly Hills police had to call on the Los Angeles County Sheriff’s bomb squad yesterday morning when a suspicious briefcase was left in front of an office at 468 Camden Drive. A man dropped off a locked briefcase at 9:14 a.m. in front of the office then left, apparently with the intent of
having someone in that office open the brief case hoping his “script” would be reviewed. A security officer took the briefcase to an alley between Camden and Rodeo Drive. BHPD Lt. Tony Lee said officers cordoned the area and evacuated nearby offices and businesses. Lee said the bomb squad arrived at around 10:30 a.m., and the area was
deemed safe at about 11 a.m. “The Bomb Squad detonated the briefcase and rendered it safe at the scene,” Lee said. “Investigation revealed the contents contained a lap top computer and several items of paper.” The man was located, detained at the scene by officers, and released once they determined no crime had been committed, Lee said.

California’s Franchise Tax Board To Begin Auditing Head Of Households The Franchise Tax Board (FTB) announced mailing more than 135,000 audit letters to taxpayers to verify their “head of household” filing status of their 2010 state tax return. Taxpayers who don’t qualify will have their tax reassessed at either single or married filing separate filing status. Each year FTB reviews tax returns of taxpayers who claim HOH filing stats because the qualifications are commonly misunderstood. This filing status generally results in lower tax liabilities for unmarried taxpayers who
care for a dependent. The qualifying person must be related to the taxpayer and meet the requirements to be a qualifying child or relative. The FTB advises taxpayers who receive an HOH letter to respond promptly by completing the enclosed questionnaire. Failure to respond could result in a tax assessment and penalty. Questionnaires can be submitted electronically at ftb.ca.gov, by fax at 866-223-8195 or by mail using the preaddressed envelope provided with the audit letter.

Cowboys & Aliens Delivers Fun, Suspense By City resident Adam Sherman With a title like Cowboys & Aliens, one expected this to be one of the more popular popcorn movies of the summer. Though so far it has not been the anticipated box office smash, for the most part it succeeds artistically. Within moments of the opening, the film grabs you and tells the tale of an amnesiac man, Zeke Jackson (Daniel Craig) who awakens with a strange contraption on his wrist in the middle of the Old West. He then stumbles upon a town and is arrested by the local authorities after being mistaken for a fugitive. However, an alien attack/abduction on the town forces the authorities, led by Col. Dolarhyde (Harrison Ford) and Jackson, to cooperate in order to rescue the abductees. On the plus side, one of the most
striking features of the film is the acting. Craig manages to successfully convey the vulnerability of the protagonist with ease. Olivia Wilde also works spectacularly as Ella, a femme fatale with a few secrets. Another strong point of the movie is the special effects. Zeke’s strange wrist contraption makes for a very unique weapon. Ultimately, Cowboys & Aliens is this year’s Revenge Of The Fallen, only with better acting, better directing and better characterization. Fast paced, humorous and cleverly written by the highly skilled screen writing team of Roberto Orci and Alex Kurtzman, Cowboys & Aliens succeeds in providing the fun, suspense and entertainment value for audiences of all ages.

The issue was the subject of fierce battle seven years ago after movie-fame personality Erin Brockovich and attorney Edward Masry filed suit claiming the oil field produced illness in Beverly High students. That battle ended with the Superior Court throwing out the lawsuit on the basis that Brockovich produced zero evidence of harm. Still, the hysteria surrounding the issue has resurfaced. Norma Zager, former editor of The Courier, covered the story then, winning two prestigious Los Angeles Press Club awards for her articles in The Courier. She recently distilled The Courier’s copyrighted stories into her own book recounting the controversy. Current Mayor Barry Brucker headed the school board at the time and the current oil well ban can be traced directly to the dispute. Zager appeared at the session. The nature of the debate as a political “hot potato� was clear as all 10 elected officials agreed that a high school campus is no place for an oil well. That said, the BHUSD board will be left with a $1 million or more annual hole in their budget if oil produc-
tion is stopped. The wells have produced for nearly 100 years and continue to provide large royalty payments for the school district and over 3,000 local property owners. Councilmember John Mirisch said while there are revenue-generating opportunities for that spot, it is the City’s responsibility to make sure the district gets the money. “The revenue is important to the schools, $1 million is a tremendous amount for the schools and the schools are important to us,â€? Mirisch said. “I think we have a responsibility to the schools, not to say ‘this is your problem’ but to say ‘we’re the ones creating the ordinance, we are going to make you whole.’ “The City should commit itself to making sure the schools aren’t suffering‌ In my opinion, we (should) make you whole, whatever it takes.â€? Vice Mayor Willie Brien, a former school board president, demurred that the city has no responsibility to make up the revenue to the school district even though the revenue loss will result solely from city council action. Mayor Barry Brucker said he was pleased with the tone and civility between the council and the board. Brucker said he believed that, based on various re-
marks, there was no dollar amount that would allow oil production to continue adjacent to the campus. “The only concern left on the table is how the City can be of assistance and help the school district recover potential revenue royalty losses after 2016,� Brucker said. “Is it the City’s responsibility to make up the shortfall? I don’t believe so. Both the City and the schools have the potential to realize a shortfall and in addition, the royalties are variable from year to year and one doesn’t know when the tap will dry out. “Furthermore, we have known about this contract expiration term since 1978 and both the City and the schools need to project anticipated changes beyond 2016. Is it the City’s goal to be as helpful in assisting the school board in finding other revenue sources? Always. We are always there to dialogue and be as supportive as possible.� The two elected bodies discussed setting up a liaison committee to meet in the future to discuss ways to make up the revenue loss. Brucker appointed Councilmember Lili Bosse to the committee but the rest of the committee members were not publically discussed during the meeting. Some ideas include slant drilling or remediating the
land for commercial property uses, however with the lack of experts present at the meeting it was impossible to determine whether or not these ideas were actually feasible. School Board Vice President Brian Goldberg reminded the session that the revenue loss in years becomes a reality for the BHUSD much sooner. “Yes we do have five and a half years, but we have to plan three years out on our budgets for (Los Angeles County Office of Education),� Goldberg said. “This is at least $1 million in revenue from our general fund the district has relied on to provide programming. If the council goes forward on this moratorium, that would be factored into LACOE’s analysis of our budget.� Korbatov said she was grateful to be a guest in the City Council chambers and to have the opportunity to cochair a pleasant forum but it didn’t quite get to the level of detail she had hoped. “There were no experts or data in the room,� Korbatov said. “I hope future meetings will be more detail driven and more fact based. It’s obvious to everyone we all would have chosen something else to be at the rear of the campus. But, we have to figure out what to do about the loss of revenue if we’re not going to
August 12, 2011 | Page 9 continue drilling.� The school board and council agreed it was necessary to meet again not only to continue the discussion on the oil well but also to talk about the proposed MTA subway tunnel under the buildings of Beverly Hills High School. The City Council continues to seek privileged confidential information of the district but refuses to protect the confidentiality of that information. Korbatov reminded the council the BHUSD cannot share any information protected under attorney client privilege, as the City has not signed a joint-defense agreement, but said she believed a meeting on MTA would be more pressing and pertinent to issues the BHUSD is currently facing. Korbatov said she hopes these meetings will take place in September and October, but they have not yet been scheduled. Council majority members Brucker, Brien and Julian Gold, M.D., have refused to enter into that agreement, which reform councilmembers Mirisch and Lili Bosse support. The majority gave themselves 45 days to decide whether to take action to oppose the Beverly High tunnel. That time expires next week.

Set in Jackson, Mississippi, circa 1963, Kathryn Stockett’s bestseller is brought to the screen with a message that should always be revised because we have a tendency to forget the past. The film opens at a shameful time in our history, when black maids were treated like chattel without the decency to be given the right to feel free or voice an opinion in a white family’s household. The black people were beginning to feel less vulnerable when, sadly, Medgar Evans is murdered in his driveway. A few maids watch the grisly scene and realize that they have been dealt a severe blow. However, Aibileen (brilliantly portrayed by Academy-nominee Viola Davis) refuses to let this setback alter her personality. She is strong and defiant, and brings up the children entrusted to her as if they were her own. A pretty, white, young college graduate, Skeeter (the always capable Emma Stone) lands a job as a journalist on the local paper. Although bred and grown up in Jackson, she is a spirited woman who decries the injustices and gets permission to write about the plight of the unfortunate household servants. The maids led by Aibileen and Minny (an Oscar-worthy performance by Octavia L. Spencer) head up a list of stellar performances. Bryce Dallas Howard plays the tyrannical Hilly Holbrook to the hilt and the good-natured Celia Foote (Jessica Chastain) who, because she harbors no prejudices, is scorned by the rest of the group of upper crust women. Chastain’s performance is touching, very funny and simply outstanding. The Help won’t solve the unending plight of those who suffer the throes of inhumanity, but it is a lesson to be learned and savored. 3 Bagels out of 4

seeking what might be a more expensive process of a Planning Commission meeting and potentially indemnifying the City to enforce the commission’s decision.” During the meeting, staff asked the commission to consider the importance of shade in assessing views which Yukelson said the commission determined was not as important as other factors such as the stability of the hillside, privacy and integrity of the landscaping. The commission ultimately decided to increase the height of the plan from 14 to 16 feet. “At our meeting, we had extensive discussion on numerous aspects of the proposed ordinance,” Yukelson said. “I think we now have something that can be recommended to City Council. The View Preservation Ordinance will return to us at our next meeting, and I am hopeful we can pass a resolution and send it off to City Council for consideration.” Last week, the City Council unanimously approved the first reading of changes in the municipal code to further protect the views for Trousdale homeowners. The proposed ordinance includes a fence standard so that fences may be built at upslope property lines but cannot exceed 36 inches, expand hedge height limitations to the entire slope of a downslope property, change the definition of hedges to include tree hedges and define a maximum height for hedges on slopes that allows hedges higher than currently allowed by code. Trousdale resident Michael Rosen said he didn’t agree with the ordinance because he felt it would get in the way of the “natural negotiations” that take place between him and his neighbors. “Through the natural order of living with my neighbors, we’ve negotiated reasonable accommodations towards one another,” Rosen said. “The neighbor to the north of me, who feels some of (my) trees are blocking his view pay for the trees and I pay for my neighbors to the south to take care of their hedges. What’s going to happen now is the natural order of nego-
August 12, 2011 | Page 11 tiation is going to be completely upset.” Trousdale Homeowners Association president Alan Berlin said the biggest complaint the association receives is views being blocked by trees. “We’ve tried to mitigate between neighbors many times,” Berlin said. “Sometimes (we have) success but (not with) most. Trousdale is a view area. It should be maintained that way. Negotiations between neighbors do not work and we need an ordinance that’s enforceable.” Councilmember John Mirisch expressed concerns about the new ordinance positively affecting non-Beverly Hills residents who live in the area. City Attorney Larry Wiener recommended to allow for a situation where the adjacent upslope and downslope neighbors can reach an agreement and that would override any complaints made by people not directly affected by a downslope neighbors hedges or trees. Senior Planner Michele McGrath said staff estimates the proposed ordinance would cost approximately $130,968 annually and the average cost to enforce a hedge height complaint in Trousdale would be approximately $2,032. The second part of the view restoration ordinance will be back before the planning commission Sept. 8.
ProjectDox Approved For City Planning Department Through an item on the consent calendar at the City Council meeting last Tuesday, the council approved an agreement with Alvolve Software Corporation to provide ProjectDox, an electronic plan check submittal and review system, including application software, implementation services, interfaces and related hardware and equipment. ProjectDox is a web-based application that allows residents and staff to access a centralized, online site through which plans are submitted, reviewed, checked and approved.
Applicants are automatically alerted by e-mail when their plans have been approved or noted for required corrections and re-submittal. Developers and contractors can track the processing of their plans during the review process via the internet. According to the staff report on the consent calendar, the total anticipated cost for the new plan check submittal and review system is $318,000.This includes $123,000 for the application software, $56,000 for the implementation services, $23,900 for application inter-

other parents,” Bilak said. “I got involved with the mechanics of the school system.” After seeing the inner workings of the BHUSD, Bilak knew she wanted to run for the board to make changes. She has had previous experience on other boards, such as her synagogue Westwood Kehilla, and was a founding board member of the international network of children of Jewish Holocaust survivors. She also has training as a domestic relations/divorce lawyer. “I understand policymaking, analysis, consensus building, public relations and political negotiations in depth,” Bilak said. “Currently with a lot of the issues facing the school board I think my background definitely can help the school board at their current moment in BHUSD’s history. I believe the combination of my professional skills and passion as a school mom can be quite valuable to the community.” Bilak said she is looking to get down to the “nitty gritty” and has three key issues she will be committed to pursue if elected to the school board. First and foremost, she said, was helping the BHUSD in the fight against the MTA. Second is continuous improvement to the BHUSD education including improving technology, the addition of smart boards in every classroom and laptops for every student. Third is to create, adopt and enforce a sensible bullying policy that is enforced equally throughout the district. Bilak’s husband and fatherin-law are products of the BHUSD. Although Bilak herself grew up in Maryland, she wants her children to be as proud of attending BHUSD schools as her husband and father-in-law are. “I have a 6-year old and an 11-year old, and am going to be part of the school system for a long time,” Bilak said. “I want the school system to only get better. I think there is so much we can do to make Beverly High as grand as it once was and want to be part of it. I want (my children) to be as proud of (graduating from Beverly High) as my husband is.”

A team at The Saban Research Institute of Children’s Hospital Los Angeles has made crucial discoveries about the role of key proteins in wound healing in the tiny air sacs in the lungs known as “alveoli” that could lead to new therapies for children and adults. “Understanding the composition of the alveolar microenvironment at the protein level may allow us to design treatments to enhance repair of the alveolar surface,” said David Warburton, DSc, MD, director of Developmental Biology and Regenerative Medicine The study—“The Milieu of Damaged AEC2 Stimulates Alveolar Wound Repair By Endogenous and Exogenous Progenitors”— earned the investigators a featured story in the American Journal Of Respiratory Cell And Molecular Biology. The research team looked at a littlestudied component of the lungs—damaged alveolar epithelial cells type II (AEC2). These cells lie in the corners of the alveoli, which is comprised of millions of tiny air sacs where the exchange of oxygen and carbon dioxide takes pace. Cumulatively, the alveoli have a vast surface area, equivalent in size to a tennis court in an adult human. AEC2 cells are responsible for the synthesis and secretion of surfactant, a complex lipid (fat) and protein mixture that reduces surface tension in the lungs and helps make the alveoli more stable. This material protects the alveoli from
collapsing during exhalation. Premature babies often lack sufficient surfactant to breathe normally at birth. Working in the lab, The Saban Research Institute team examined the cytokine (protein) profile in an injured AEC2 environment, theorizing that these molecules might promote surface cellular repair. They discovered that two major cytokines secreted by damaged AEC —CINC-2 and ICAM— were “chemoattractive” to AECs, meaning that these cytokines could attract other AEC to the site of damage to assist in repair. These protein molecules then expedited wound healing—a novel finding that Dr. Warburton calls “potentially highly significant because it could lead to new therapies.” In a related finding, the investigators also determined that the damaged AEC2 environment was chemoattractive to uncommitted human amniotic fluid stem cells (hAFSCs). Migration of the hAFSCs to the AEC2s increased 20-fold over normal, and the stem cells not only attached themselves within an in vitro AEC2 wound, they accelerated its healing. “We are actively exploring the application of hAFSCs to enhance tissue repair in several organs, including the lung and the kidney,” explained Warburton. “The finding that they respond positively to specific components of the alveolar milieu is highly encouraging.”

FIGHTING DEFICITS The Beverly Hills City Council is now holding closed-door bargaining sessions with its public employee unions. From what we’ve been told directly, not one of our elected councilmembers of this council or the past few councils really knew what the taxpayers of Beverly Hills pay its employees. The distribution of taxpayer money between salary, bonus, auto allowance, overtime, “administrative leave” (overtime pay for highly paid execs and supervisors), sick time, “9/80 days” (every other Friday or Monday off), regular holidays, health care benefits, full dependent health care coverage for free, and everything else, confused and diverted them all. The Courier published that information, so now the City Council has no way to hide from the fact that City employees receive exorbitant pay in most cases, absurd amounts of paid time off, and huge tax-free retirement contributions. Every single paid staff position in the City of Beverly Hills costs vastly more than any comparable position in private industry. No private job comes close to the retirement pay and conditions of City employees. The word is: “We all want those jobs.” The hard part now comes – what will our City Council do about this? There is no place left to hide. The obstacle is the public employee unions and, perhaps even more so, the expectations of City staffers saturated with years of this kind of deal. If “mark to market” is the principle, based on the private sector, City staff should pay their half of their retirement, that retirement should be based on contributions not “highest salary ever”; vacations and time off must be cut by 2/3s, City staff reduced accordingly, retirement age raised to 65, and the taxpayers need to get what they pay for with. If those reforms, most proposed by City Treasurer Elliot Finkel’s Task Force, Beverly Hills would never see another budget deficit. Not everything should be cut, however. One of the items we gladly pay for, even if it could be done at less cost, is police protection. As a matter of policy, Beverly Hills wants an oversized police department. We are targets and our force under Chief Dave Snowden justifies the cost. We feel the same way about our paramedic services, but must each one cost $275,000 per year? Maybe the City can outsource to Cedars-Sinai Medical Center or UCLA Medical Center to have full-fledged operating room M.D.s in our ambulances. Don’t know. In fairness, no one wants a cheap doctor and no one wants a cheap paramedic when you’ve had a heart attack. That leaves six-figure recreation department supervisors, assistant librarians and hundreds of others in the six-figure category. City Manager Jeff Kolin wrote us confirming that the average cost to taxpayers of each City of Beverly Hills employee is over $150,000. And this number goes up with inflation and other “adjustments” every year. In 2010 alone, nearly 100 City staffers cost us over $200,000 each. How many more will cross that threshold just by the passage of time? Next year another 10, 20, 30? Where do we get this money? As we look down the road, we see massive unfunded costs, a pending huge increase of our tax burden, and continued abovemarket compensation. We accept that our staff are fine people, but taxpayers are fine people, too. The current setup is just plain unfair. The pressure on councils to raise taxes on local businesses will intensify. We already get 78 percent of our income from our dwindling number of businesses (note nearly 20 percent commercial vacancy rates). The resident taxpayers of the City of Beverly Hills are entitled to strong advocacy from their City Council members. We know that most of them quake in their boots about taking on the unions and collective bargaining units. Despite rhetoric to the contrary, the reality is that there will not be one penny of “give back” by the unions...certainly nothing significant. They will hold fast and firm. There will be a battle if the council actually tries reform. We already know which council members will represent the taxpayers and which ones will serve the union pay scale and 13 weeks time off. What we don’t know is how resolutely our councilmembers will represent the taxpayers. One thing is for sure – thanks to The Courier everyone now knows what our local government costs. Remember that when you’re told “They’re not in today” at City Hall.

HEMALE SHEMALE I am so emotionally drained by a roiling stock market, a vacationing government, famine, flood, earthquake and broiling temperatures that I have decided to give my brain a week off to contemplate issues grammatical; and frivolously I dub them “Semitis Samantics.” Sometimes I think that those who create words get their genders mixed up so I have made up some new constructions; as for example: I believe that the word HYSterectomy, meaning “Surgical removal of the uterus” should really be called HERsterectomy. And HYSterical is more often HERsterical HIStrionics, or “dramatics” is more properly described as HERstrionics. A HERmaphrodite could also have been created as a HIMaphrodite.
LETTERS I read your reporting over the last few weeks on City payroll expenses. You should be commended for helping the citizens understand how far out of line compensation practices are in Beverly Hills compared to corporate America. It would be interesting to see a comparison (based on revenues of the City compared to revenues of a publicly traded company) of salaries between the public and private sector. Such a study would enrage our citizens even further. I am happy to help you design such an analysis so it can stand up to rigorous criticism. Mark N. Schwartz ****** It’s gratifying that the demolition of the Kronish house has been temporarily postponed, and the City Council and the property owners--along with their representative Mitch Dawson--certainly deserve commendation for the reasonable agreement they were able to come to on Tuesday night. What remains quite troubling about the situation, though, is what it reveals about the requirements for demolition permits in Beverly Hills: namely, the procedure to obtain one is not very much more complicated than getting a dog license. Under the current municipal code, demolition permits are ministerial actions that require no staff discretion for issuance. The only requirements that someone seeking to demolish a building needs to meet involve the conduct and aftermath of demolition itself: the safety of the process, a bond assuring that it will paid for by the property owner, and regulations about the quality and landscaping of the fencing that will surround the future demolition site. In other words, there’s no need for a replacement project to be approved before a demolition takes place; no need for an environmental impact report on either the removal or what, if anything, will be built in its place afterwards; no evaluation of how likely it is (very likely in the case of a commercial

structure) that the clearing of the property will result in a replacement of vastly increased size; no need for any input by the council or the Planning Commission, and no opportunity—except in extraordinary cases like this one, when information is ferreted out and protests are mounted—for input by the public. No matter how significant or long-ranging the consequences of a demolition—even leaving aside the architectural or historical worth of any structure and considering simply, say, the neighborhood disruption involved in the construction on its eventual replacement, which could go on for years--permission for it is simply a matter of an over-the-counter document. Like many people, I’m greatly heartened by the prospect of a historic preservation ordinance for Beverly Hills. The council’s instruction to the Planning Commission to start drafting one was a true high point of the meeting on Tuesday night. While we’re celebrating the prospect, however, it’s important to be realistic about how lengthy and politically complicated this task will be, and point out how easily the situation can be remedied in the meantime—as well as being applicable in instances where historic preservation is not the primary issue. If the City simply required, as the majority of cities do, that a development permit be in hand before a structure could be demolished, then the demands of the California Environmental Quality Act would be triggered, as they currently are not. Then questions of historical and architectural value could properly be invoked and examined in a context that provides for exploring them, and spokespeople for all sides of the issue would have a chance to make their views heard in an orderly and formal fashion before the Planning Commission, rather than having what existed this time—a situation where news of a pending demolition had to travel by stealth through the grapeline through news of a sewer cap permit, encouraging an atmosphere of emergency
and stress. Property owners are almost always badly served by the kind of publicity that ensues in these cases, which invariably makes them into bad guys, and tends to provoke agitation for last-minute restraining orders. Rather, the more level the field for the presentation of points of view, and the more equal the opportunity to hear various opinions on an issue, the less likely it is that emotion will flare up and take over. If this one simple procedural change were made, Beverly Hills itself would be less at risk of deliberate tear-downs and vacant lots, which are unsightly; and when there are legitimate cases of historical and architectural treasures, they would have a chance to have arguments made on their behalf. This doesn’t mean that they’d always be preserved... it doesn’t even mean that the advocates of preservation always should prevail. It would just mean the City would have opened an avenue for rational, balanced decision-making, rather than the alarmingly random system that’s in place now. Jamie Wolf ****** I feel there is discrimination in City of Beverly Hills. How do you feel when you buy a home here, try to remodel it and the Planning Commission does not give you a construction permit. It took me one and half years trying to get a simple permit and still I was refused by the commission. As a taxpayer and resident for more than 25 years, I have found out that if the commission doesn’t like your face, your plan would be refused while your architect gets full runaround. The City Council is very weak and just a puppet by not doing anything about this. It’s time the residents make a complaint and even hire a good lawyer for their own side to remove these Planning Commission administrators who have seized power and rejected new homeowners from remodeling their houses.
