County Museum of Art, bequeathed the stunning Kyoto-style garden named for his wife to UCLA with the caveat that it be “maintained in perpetuity.” When L.A. Superior Court Judge Lisa Hart issued the injunction last July, she called UCLA “duplicitous” in its attempt to sell the garden just months after the woman for whom it was named died. "The rational and reasonable thing for the regents to do at this point is just to keep their promises," said plaintiffs’ attorney Walter Moore of John R. Walton Law Offices, who represents the heirs of Hannah Carter in a lawsuit that seeks to have the university maintain its promise to maintain the garden. The hillside garden, designed by Nagao Sakurai in 1959, boasts a traditional

The existing Municipal Code allows for lot line adjustments to be granted only when the lots affected by the adjustment will comply with all applicable minimum lot standards once the adjustment is complete. As such, legally nonconforming lots cannot adjust lot lines unless the resulting lots conform to all current lot standards. The proposed ordinance would allow for existing legally nonconforming properties to request lot line adjustments so long as the proposed adjustment will result in either a decrease or no change in the degree of any existing nonconformity, and will not create a new nonconformity. This ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The City has preliminarily determined that the ordinance will not have a significant environmental impact and is exempt from CEQA pursuant to Article 5, Section 15061 (b)(3) of Title 14 of the California Code of Regulations. Boffo Cinema Debut Baffles Beverly Hills A proposal to build a luxury cinema, complete with a restaurant and bar, leather lounge chairs and rooftop dining adjacent to the parking structure at Montage Beverly Hills caused some backpedaling to smooth ruffled feathers at Tuesday’s City Council meeting. A new council policy is to review preliminary project pro-

posals prior to entering the permitting process seems to have caused some confusion. With the policy, the council hopes to be able to make recommendations in advance of spending time and money on the permitting process. But no one told the Montage, and Montage developer, Jay Newman of The Athens Group, was visibly upset.

agreement to send the proposal to their respective legal departments for review. Last week, Metro declined to participate in mediation, said the mayor. City Attorney Larry Wiener confirmed that. The meeting took place at

Union Station and, besides Mirisch and Leahy, was attended by Metro Deputy CEO Paul Taylor, and Beverly Hills Assistant City Manager Mahdi Aluzri. Metro did not return calls for comment.

School Board Candidate Dohm Ends Campaign

By Laura Coleman Beverly Hills resident John Dohm, the fourth and final candidate to enter the race for one of two seats on the Beverly Hills Board of Education, announced Tuesday that he would discontinue his campaign for the Nov. 5 school board election. “I concluded that I did not have sufficient time to plan and run a strong campaign in the short amount of time until the election,” Dohm

said in a statement sent to The Courier by his wife, Sharon. “I remain interested in serving on the Beverly Hills Unified School District Board and look forward to exploring an opportunity to run at a future date.” Dohm's name will remain on the ballot along with candidates incumbent Board of Education member Lisa Korbatov, Howard Goldstein and James Fabe. The deadline to withdraw from the race was Aug. 9.

Young Guru is known for shaping some of the biggest talent in hip hop. A frequent collaborator with Jay-Z, he has mixed 10 of his albums. The British Can Write Scripts. Why Can’t We? By now, it’s hard not to get impressed, even obsessed, with British entertainment—for good reason. We’ve taken game shows and talent contests from them and they’re hits. But in American television, the 40-minute drama episodes have become more about quantity than quality. Even the ones copied from the Brits fall short. Our writers care less about welldeveloped storylines with believable characters and more about filling a coveted time slot. Does this say something about the American people that there are more sex scenes on our airways than actual stories? Let’s compare American and British television. This is what I found. 1. Young American TV actors/actresses are too “pretty” to be realistic. (The CW, anybody?) 2. The British know how to tell a story. 3. New American shows are too crass and vulgar to be bearable. 4. If you’re not a high fashion model, you cannot be a police officer or firefighter. 5. American shows have too many characters and most get killed-off before a real plot develops (think The Vampire Diaries.)

6. Leaving something to the imagination is better than airing near-porn (maybe True Blood?). 7. The Brits can make audiences laugh and cry at the same time. We generally just crash cars, shoot someone or blow up something. I’m not anti-American, I just call it what it is. I have a few examples for our television writers to follow. • Broadchurch. Rave reviews for this 8-episode miniseries. A small English town is rocked by a local boy’s murder. Everyone is a suspect, even his family and Detective Inspector Alec Hardy and Sgt. Ellie Miller head the investigation. The murder mystery, starring David Tennant (Doctor Who) and Olivia Coleman (The Iron Lady), boasts a well-developed plot that leaves audiences guessing the murderer until the last episode. In fact, show writer and creator, Chris Chibnall, wanted his characters’ personalities to be so realistic that the cast itself had no clue of the murderer’s identity until they reached the fifth episode. If that’s not dedication, I don’t know what is. The series is so well-received that the Americans have ordered a U.S. remake, which I am sure will not be as good as the original.

• Sherlock. The BBC series (available on Netflix), starring Benedict Cumberbatch (Star Trek: Into Darkness) as Holmes and Martin Freeman (The Hobbit) as Dr. Watson, is complex, but so brilliantly written that even my cynical father who loves the “original” ‘30s’ films with Basil Rathbone was impressed. Everyone I know who knows anything about Sir Arthur Conan Doyle’s books couldn’t stand the Americans’ attempt to tell the story of Sherlock Holmes in Elementary. The British version treats Doyle’s works with respect and dignity, but concedes nothing to bringing it into today. Writers and co-creators Steven Moffat and Mark Gatiss (Doctor Who) bring an ultramodern approach to the mysteries solved by Holmes and Dr. Watson. Sherlock is a consulting detective (a self-created occupation) who aids friend Inspector Lestrade (Rupert Graves, Death At A Funeral) solve the crimes, with Dr. Watson’s help, of course! Each episode has a new mystery, often with the appearance of Sherlock’s 007-esque older brother, Mycroft ( played by co-writer and creator Mark Gatiss). Sherlock’s witty—but often rude and insensitive— monologues are incredibly well-delivered by Cumberbatch. • Doctor Who. We know what this series delivers. Without William Shatner, Leonard Nimoy et al. to deliver the original Star Trek, this decades-long BBC series brings back some real sci-fi. These shows set a standard we seldom see in the new offerings of U.S. television. With exceptions of Castle, Person Of Interest and much of Law & Order, maybe our current crop of writers should spend a few weeks watching the Brits.

The elaborate spectacle is studded with historic references and features some of the worldâ&#x20AC;&#x2122;s most iconic horses. By Victoria Talbot The Beverly Hills City Council unanimously approved the Wilshire landmark Saban Theatre for historic designation under the Mills Act Tuesday, the first time Beverly Hills has entered into such a Mills Act contract. The building, owed by Temple of the Arts, is widely considered an excellent example of classic early century theater architecture. Built by S. Charles Lee in 1930, the Art Deco palace boasts more than 140 events a year, including cinema, theater and musical performances. Temple of the Arts founder, Rabbi David Baron, was pleased that the designation came in time for the upcoming Beverly Hills Centennial Cele-

bration. “Its been a long process; three years since we first worked with the Architectural Commission to last night at the City Council,” he said. Upcoming renovations include updating the ancient heating and air conditioning system and replacing the oldstyle marquis with an electronic version. “The guy has to get up on a ladder to change the letters,” explained the rabbi. Though electronic, the new marquis will reflect old-style design and remain in black and white only. “This is another milestone in historic preservation,” said Mayor John Mirisch. “It is appropriate that it (the Saban) is the first.” For further information, visit: www.sabantheatre.org.

Interrupting Cancer Cell ‘Conversation:’ Putting The Brakes On Cancer While great strides have been achieved in cancer treatment, scientists are looking for the next generation of therapeutics to stop the second-leading cause of death nationwide. A new approach to disrupt the “conversation” between cancer cells that promote tumor growth has been developed through a collaborative effort linking chemists at NYU and pharmacologists at USC. In a study appearing this week in the Proceedings Of The National Academy of Sciences, the research groups of Bogdan Olenyuk of the USC School of

Pharmacy and Paramjit Arora of the NYU College of Arts and Sciences explain their development of a synthetic molecule, the “protein domain mimetic" —representing an emerging frontier in cancer research that is distinct from the typical search for small molecules that target cancer cells. Rather, this synthetic molecule targets the interaction between two proteins, at the point where intracellular signaling converges resulting in upregulation of genes that promote tumor progression. Reduced Traffic Pollution Exposure Possible With Ventilation Setting Choices, Study Says As millions of California children return to school in September, many will be driven there on freeways. Based on a new study, USC environmental health researchers have advice for parents who want to reduce their child’s exposure to harmful traffic pollutants: The car ventilation choice they make can be effective in reducing exposure to on-road particle pollution. Scott Fruin, D.Env., assistant professor of preventive medicine, and Neelakshi Hudda, PhD, research associate in the environmental health department of USC’s Keck School of Medicine, recently conducted the first systematic measure-

ments of in-vehicle exposure that included a full range of car types and operating conditions, and for all types of particulate pollution. “Short of driving less, putting your ventilation to ‘recirculate’ is the best way to reduce exposure to all types of vehiclerelated particulate pollution,” said Fruin, senior author on the study. “Otherwise, an hour-long commute to work or school can double your daily exposure to traffic-related particulate air pollutants.” The recently published article in Environmental Science & Technology, titled “Models for (see ‘POLLUTION,’ page 15)

Multi-Million Dollar Gift Establishes New UCLA Melvin And Bren Simon Digestive Diseases Center A multi-million-dollar gift has allowed the UCLA Division of Digestive Diseases to support new, minimally invasive treatment procedures, and funded state-of-the-art gastroenterology research. The gift, from the Melvin and Bren Simon Charitable Foundation, was made in memory of Melvin Simon, cofounder of the Simon Property Group, one of the largest shopping mall companies in the U.S., and longtime co-owner of the NBA’s Indiana Pacers. As well as a tribute to Simon’s achievements, the gift furthers his wife Bren’ advocacy, and establishes the Melvin and Bren Simon Digestive Diseases Center at UCLA, an umbrella structure for all the clinical operations and centers for excellence of the UCLA Division of Digestive Diseases. The center will provide resources to strengthen a practice group of 60 physicians and medical staff, provide

patients with the new technologies and support key division programs. “We are pleased to be able to contribute to the work and future of digestive diseases care at UCLA,” said Bren Simon, who wanted to give back to the division in thanks for its care for Melvin, who died of pancreatic cancer in 2009 at the age of 82. “We thank the Simons for their tremendous generosity,” said Dr. Gary Gitnick, the Fran and Ray Stark Foundation chair in Digestive Diseases and chief of the Division of Digestive Diseases at UCLA’s David Geffen School of Medicine, which is a leader in the diagnosis, treatment and research aimed at combating debilitating and deadly disorders affecting the gastrointestinal tract. UCLA Researchers Describe New PostDiverticulitis IBS The discovery of this new condition, called Post-Diverticulitis Irritable Bowel Syndrome (PDV-IBS), validates the irritable bowel symptoms that many patients report long after suffering a bout of diverticulitis, but that many physicians wave off as being part of the original condition, said study senior author Dr. Brennan Spiegel, an associate professor of medicine at UCLA’s David Geffen School of Medicine. “We’ve known for a long time that after some people develop diverticulitis, they’re a different person. They experience recurrent abdominal pains, cramping and diarrhea that they didn’t have before,” Spiegel stated. The study appeared last week in the early online edition of the peer-reviewed journal Clinical Gastroenterology And Hepatology. The discovery of PDV-IBS could mean better attention to patients complaining of symptoms after diverticulitis, symptoms that up until now may have been dismissed by physicians, Spiegel said. When Angry Teenage Boys Hate Their Parents Q. Dear Dr. Fran: I have two teenage boys, they are not bad boys, but are always threatening us that once they turn 18 they will leave the house. We are not strict, but not lenient either. For example, their last report card was not the best and you can tell they slacked off, especially my eldest who is 17 and now has a girlfriend. So we grounded one for a week and the worst one for two weeks with no phone. They hated us and said they wanted to leave the house. I honestly don't know what to do? Are we being too strict? Is this behavior normal. It seems as though they really hate us the way they talk. Help. Cynthia P. A. Dear Cynthia: It seems to me your teenage boys threats about leaving home and expressions of hatred toward you and your husband may be their reactions to you and your husband having difficulty setting and holding clear boundaries. They don’t like that you grounded them. You are unsure and questioning your own judgment. I feel for you. This is truly not easy, particularly since the boys are growing rapidly and they (or at least the older boy) will be 18 years old soon. First, you need to rule out the possibility that concentration and any particular subject is not a learning challenge for either boy. You may be able to

Often though, it requires a specific kind of psycho-educational testing that can be obtained by Beverly Hills Unified School District or by a private neuropsychologist. You will need to go to the principal’s office at your boy’s local public school and request an I.E.P. (Individualized Educational Plan). Be sure to request it in writing and ask the principal to sign it and stamp the date on it. If either boy has a learning or attention challenge, the school district will identify it and make appropriate recommendations for help. Let’s assume for now that there are no learning disabilities causing the boy’s dip in grades. You need to sit with them and discuss a plan that works for both them and for you. You need to create a plan rather than leaping to punishments which breed anger in the boys. Here are some points for your plan: • “Homework Time” must equate with a time frame instead of homework being done when it is finished. That just invites

rushing to get finished and often involves careless mistakes made in the rush. In other words, the boys are required to sit for two hours as “Homework Time.“ Juniors and seniors are often given two hours of homework. • Prior to beginning “Homework Time,” the boys are required to hand over all their electronic gismos. This includes cell phones, electronic games, iPods, and any additional potential distraction from concentrating on their work during “Homework Time.” At the end of the two hours, you return their electronics. Both boys need opportunities to talk with you and your husband about what feels comfortable for them and they need to hear what feels comfortable to you. When you say they seem to “hate” you. Maybe so. In my dictionary “hate” means “super angry.” Maybe they don’t hate you. Maybe they are really, rally mad at you. It all needs to be talked about in a straight-forward manner. Try talking as a family. If you run into interference, you might consider having a family meeting with a counselor who can help facilitate and referee the discussion.

The council will respond with conditions that reflect the best interests of the City and its inhabitants, including a provision that only one Sunday be included in the 10-day-period. Litigation over the Metro Extension's planned route beneath Beverly Hills High School is ongoing. It is not known if an MCA will impact the litigation.

BEWARE OF METRO BEARING GIFTS – WILL OUR COUNCIL GET FOOLED? This could be our report in a few months: “Angry residents filled the City Council chambers Tuesday night to protest unannounced street blockages, excavations and parking restrictions imposed by Metro. When contacted by The Courier, a Metro spokesperson said: ’We’re acting pursuant to our development permit agreement with the City of Beverly Hills.’ When The Courier tried to locate the permit issued by the City, The Courier was told by City staff that no permit was required by Metro. Mayor John Mirisch told The Courier he was stunned by that statement: ‘Metro must get a permit for all activities in Beverly Hills. This violates our agreement with them. I tried to get the council to make Metro come to us [the council], but they refused. My colleagues said we could have our protections in an agreement.’ Councilmember Willie Brien said: ‘We cannot interfere with the efficiency of Metro’s operations.’ Vice Mayor Lili Bosse and councilmember Nancy Krasne said: ‘We thought Metro had to come to the council.’ City Manager Jeff Kolin responded through his deputy assistant communications director’s executive assistant, ‘Metro’s actions are in keeping with our agreement so there was no reason to bring anything to the council.’” Is this far-fetched? Not if you look at any place in Los Angeles County where Metro has conducted operations. Already in Beverly Hills, Metro has punched holes, set-up parking restrictions, blocked streets and done whatever it liked. In every case, if a permit was issued no one on the council knew about it. In every case, little or no advanced warning was given by the city or Metro.“Well, it’s only a couple of blocks.” “This won’t affect many people.” “We have to be good regional citizens”—those are the excuses we have heard and will hear. Then that’s okay, just hit and hurt a few people at a time. The reality is that Metro’s own environmental impact report and recent presentations confirm: seven years of hundreds of dump trucks, seven to nine years of torn-up streets, blocked driveways, equipment haulers, cement trucks. All coming and going from La Cienega to Rodeo Drive to Beverly Hills High School. Even if this City is willing to put up with that, what requires us to concede all control over actions that disrupt every minute of every day? What proof can Metro offer that it will honor one single commitment to the people of Beverly Hills? None. Ask residents and businesses along the Metro Expo Line. Ask business and property owners in Hollywood, or Westwood, or Brentwood, or Culver City, or along the 405. Talk to property owners in Downtown Los Angeles where they are going to build their “regional connector.” You cannot find one single person who will tell you that Metro pays the slightest attention to its agreements, promises or anything that would lessen the hardships placed on local residents. Tuesday night, the city council instructed staff to ask Metro to propose a written development/permit agreement that would streamline Metro’s construction actions in Beverly Hills. Many councilmembers took the position that “it doesn’t hurt to negotiate. We’ll have a strong agreement.” Mayor Mirisch was the one warning about this. What happens when the City signs this agreement and Metro simply chooses to ignore it? Like they have done all over Los Angeles County? Will our City staff notify the council of violations? What about the staff issuing permits without telling the council first? What if Metro claims “the agreement allows us to do this” and we just sit and watch them do it? Will the Beverly Hills Police Department arrest Metro’s workers and contractors? Will Metro then get an injunction to stop Beverly Hills from enforcing this to-be-written agreement? Remember, when the Beverly Hills Unified School District simply tried to obtain Metro’s seismic and geology workup for the tunnels, the court said “no” even though most legal authorities believed that information was public record. Metro will fight us in court at every turn. Based on past history, we fear a court would conclude: “I interpret the contract [between Beverly Hills and Metro] to contemplate these hardships and Beverly Hills waived its objections.” Beverly Hills is an independent city. We have jurisdiction within our own borders. Metro and the City staff (strongly supported by Councilmember Brien) just want this to happen “smoothly.” “Smoothly” does not mean “smoothly” for Beverly Hills businesses or residents. It means “smoothly for Metro.” Why be an independent self-governing city if we do not protect our own citizens inside our own city limits? With the BHUSD retaining former U.S. Sen. Joseph Lieberman’s law firm to help in the fight against the tunnels, the last thing this City needs is for a complaisant or compliant City Council and staff to “smooth out” anything for Metro. Metro never acts in good faith. Metro even just refused Mirisch’s offer to mediate the dispute after its CEO said it would mediate. Metro still intends to put two tunnels a few feet underneath our only high school. They have never said one word to change that. They are forcing our school district to spend hundreds of thousands of dollars to protect our kids. Even Lieberman said: “The BHUSD is right and Metro is wrong.” Metro is after one thing and one thing only in Beverly Hills: ignore Beverly Hills and do whatever it pleases whenever it feels like it in any manner it chooses. Any other assumption or conclusion is belied by every fact and circumstance. If the City Council does in fact enter into any agreement with Metro, when Metro’s abuse starts all we can say is: “We told you so.” Cartoon for The Courier by Janet Salter

Rabbi Jacob Pressman KOL NIDREI – MOST SACRED JEWISH EVENING The most sacred day of the Jewish calendar is Yom Kippur. Its most solemn moment is the opening evening prayer: Kol Nidrei. In actuality, it is a formula asking that “all the vows, renunciations, bans, oaths, formulas of obligations, pledges, and promises that we vow or promise to ourselves and to God, from this Yom Kippur to the next be cancelled and annulled” so that the entire congregation may begin the New Year with a clean slate. It was intended that the beginning of a new calendar year also should begin with conscience clear and the feeling of a fresh start characterizing the atmosphere. It would be a crushing burden for human beings to carry a whole load of all past errors, of all past years – which I suppose, some people do. It has therefore become a part of the Jewish practice to clear the air once a year, for God’s indulgence and forgiveness, and thereby attempt to avoid the errors of the past. Otherwise we would presumably be carrying guilt all our lives. This process enables us to live our lives in the future without a crushing burden, without a sense of guilt, without living needlessly in the past.

LETTERS TO THE EDITOR I have serious concerns about the lack of transparency by Howard Goldstein and Stewart Horowitz regarding their family relationship. Mr. Goldstein is a candidate for BHUSD Board of Education and Mr. Horowitz is the current president of the Beverly Hills Education Association, a union which has endorsed Mr. Goldstein in the upcoming school board election. Members of the school board must negotiate important issues that impact our district and more importantly our students. These include annual salaries, curriculum, teacher evaluations, school year calendar, professional development, instructional minutes, playground supervision, graduation requirements and human resources to name a few. Is there a legal conflict?– I do not know. Is there an ethical or moral conflict of interest?–possibly. Will Mr. Goldstein recuse himself from votes regarding the district’s negotiations with our teachers? Will Mr. Horowitz recuse himself from negotiations? Will Mr. Goldstein and Mr. Horowitz engage in inappropriate conversations outside the official negotiating process? I do not know the answers to these or other questions about the impact of their family relationship but do know my concerns are only exaggerated by the fact that in every article written to date regarding the BHEA endorsement, no mention has been made of the two of them being related to each other. Howard L. Feinman ****** In 2009, my son and I fulfilled a lifelong dream to become residents of Beverly Hills. During that first year here, I thought we had made the most stable, life-changing move possible. We found a great little apartment and it seemed as though no school district could come close to ours. Two years ago, however, I was about to be vacated from a soon-tobe demolished building where we had resided for 18 months. My main concern was that the tenants of the five buildings being vacated for demolition, including myself were not receiving any relocation fees. In Beverly Hills, buildings that vacate tenants for remodels must pay relocation fees. However, those that vacate for demolition do not require tenants be paid relocation fees. I was heart-broken to lose our home and in a frenzy to find another place to live so my son could continue going to school here. Now South Reeves is facing the same issue with two buildings being razed. When is the City Council going to start protecting the south half of the City? Need I remind its members BH is 50+ percent renters mainly residing on the south end? Need I remind them, we too spend our money in the City? Who do they think is supporting the “shop local” campaign? So here are my issues with our perfect City: 1. The City Council doesn’t appear to care about south side residents. Some alleys have potholes large enough to bend a rim. 2. I have had to move every 1.5 to 2 years just to beat the rent increases and condo-ization. 3. The beautiful buildings in our City aren’t being preserved. These eclectic structures differentiate us from say, Sherman Oaks. 4. There are no tenant rights in Beverly Hills. Why would any family move here and put their kids in the schools if they rent? We can quickly lose our homes within 60 days due to demolition and within 30 days due to rent increases and soon we will have streets filled with one 1940 building next to one 2013 building next to one 1970 building next to one 1980 building. Please stop, stop ripping down our City. We are losing the charm. Things to do check list: Implement slower growth policies to prevent condo-ization. Add all pre-1960’s buildings to the Historic Preservation Act to limit defacing the City’s beauty and charm, include retail land so we don’t lose more spaces like the Brown Derby. Lower the rent increase rate to a maximum of 4 percent once a year. Make building owners pay tenants of demolished buildings the same relocation fees that tenants of remodeled buildings get. The City of Beverly Hills is the diamond of L.A. County and from corner to corner it should be treated as such. In addition, the residents who pay to live in this diamond of a city should be protected on all levels. Jennifer Brugger
