Last Saturday, current Dancing with the Stars contestant and Emmy-winning personality Carson Kressley hosted the inaugural American Humane Association Hero Dog Awards at The Beverly Hilton. Teens Host Forum To Quiz Board Candidates On Issues By Sayeh Mohammadi The Teen Beverly Hills Education Foundation hosted a Candidate Forum in the John Cherney Lecture Hall at Beverly High Wednesday. These teens launched this forum to “actively engage, identify challenges within the five schools, suggest solutions and advise and confer with BHEF.”

The candidates were incumbent Brian Goldberg, Frances Bilak, Lewis Hall and write-in candidate Noah Margo. Topics of the forum ranged from campus security to college admission and required candidates to provide timed responses. The candidates discussed (see ‘TEEN BHEF FORUM,’ page 18)

Council Still Refuses ‘United Front’ To Fight Subway Courier By

Staff The Beverly Hills City Council rejected repeated attempts by the Beverly Hills Unified School District to create a united front to protect BHHS from a tunnel the Metropolitan Transit Authority threatens to dig under the school and dozens of local homes for its Westside Subway Extension. The rejection came in a letter sent late last week signed by City Manager Jeff Kolin. The tunnel, pushed by L. A. Mayor Antonio Villaraigosa and Third District Supervisor Zev Yaroslavsky, reneges on the route supported in 2007 by a Beverly Hills Citywide committee formed to study the subway. The committee, whose findings were endorsed by the then city council, dealt with the only route proposed through Beverly

Hills—a route that would not approach the high school. The route is subject to approval by the Metro board later this year. Kolin's letter came as Mayor Barry Brucker continues to complain BHUSD is unwilling to share technical data about the proposed Beverly High tunnel. The district has continually promised to share data if it is protected by a joint defense agreement. Last week, the City Council refused to hire experts to conduct its own studies, but instead will rely on a “peer review” by a Northern California firm of the Westside Subway Extension Environmental Impact Report when issued later this year. The City will thus not prepare any evidence or data for defense of Bev(see ‘MTA,’ page 16)

City Shares Helpful Parking Tips By Krystal Leach de Amante The City of Beverly Hills has identified some helpful parking hints The on-street credit card meter features continuous communication, reporting to City parking operations providing them the ability to quickly identify meter malfunctions. “If someone’s experienced a problem with the meter and gotten a ticket and they’re very detailed about what occurred, these are things we can look at in the database and adjudicate their ticket,” said Director of Parking Operations Chad Lynn. The meters also have a

special failsafe to protect the patron by not allowing meter purchases past the posted tow away zone hours. Another beneficial aspect of the credit card meters is the escrow feature. “You can actually begin paying the meter a hour before it goes into effect,” Lynn explained. For example, if meter hours begin at 8 a.m., a patron can deposit money at 7 a.m. and it will save the payment and begin charging at 8 a.m. City garages offer a credit card payment at entry, exit or (see ‘PARKING,’ page 18)

Great California Shakeout Oct. 20 By Krystal Leach de Amante Beverly Hills is encouraging all local residents, businesses, schools and places of worship to participate in the annual Great California Shakeout Oct. 20 at 10:20 a.m. The two-minute “Drop, Cover and Hold On” safety drill is the largest in the country with more than 7.9 million registered participants. The Shakeout’s overall goal is to prevent the next earthquake from becoming a major catastrophe by allowing individuals and businesses the opportunity to test their emergency response preparedness in a controlled environment.

According to seismologist experts, there is a 97 percent chance a 6.7 or above magnitude earthquake will occur in the next 30 years, causing extensive damage and loss of life. So at 10:20 a.m. on Oct. 20, nearly 8 million participants will drop to the ground, take cover by getting under a nearby sturdy desk or table and hold on. Individuals, families, businesses and other organizations wishing to participate in the drill can register at www.shakeout.org/resgister/. The website also provides instructions and resources on preparing for the two-second drill.

ALL SAINTS MUSIC PROGRAM BENEFIT—Singer Jan Daley, who sang with Bob Hope on several of his USO tours abroad, gave a performance to an audience of more than 400 including members of the active military, veterans and the USO during a benefit concert for the All Saints Beverly Hills Music Program. Some of her songs were But Beautiful, Till Love Touches Your Life, and one of Daley’s own compositions about a soldier’s girl waiting for him to come home, One She’s Been Waiting For. During the evening, Tony-winner Michael Maguire (Les Miserables) joined her on stage. He sang Music Of The Night was outstanding and then they dueted with All I Ask Of You, both songs from Phantom Of The Opera. The All Saints' Choir added the final touches to a evening. Citizen-Led Committee On Police Contracts Set By Krystal Leach de Amante Former two-term Beverly Hills mayor and opthalmologist Dr. Charles Aronberg and attorney Lessing E. Gold announced the formation of a citizen-led committee to expediently moderate contract negotiations between the Beverly Hills Police Officers Association and the City. Aronberg informed The

Courier the committee plans on asking other civic leaders to join. He also emphasized the committee’s role was to take no particular side on the issue, only aid in achieving a swift resolution. Long-time residents Aronberg and Gold, also recommended that despite the economic issues, both parties must make a concentrated effort to

reach equally satisfying terms. This announcement took place 15 days after Police Officers Association attorney Stephen Silver aggressively approached the City Council regarding the proposed salary and pension cuts being discussed during negotiations. . Board To Discuss Hiring Library Media Teachers By Marla Schevker The Board of Education, at the request of President Lisa Korbatov, will be discussing hiring two K-8 library media teachers at its next meeting, Oct. 11. If approved by the board, the district will begin the

process of hiring the two teachers for the four K-8’s. Korbatov said she believed reading is an important lifelong skill for school achievement, college readiness and 21st century careers. “Librarians teach those skills directly and daily while

supporting teachers and collaborating on curriculum,” Korbatov said. “Would the district consider replacing certified classroom teachers with teaching assistants? Would the community allow it? Of course not. Council To Sponsor Bike Event By Simone Sobel The Beverly Hills City Council unanimously voted on Sept. 27 to sponsor the Gran Fondo USA bike event for a minimum of one year. Although the council agreed to lend its support, the decision to grant official sponsorship awaits further details about finances and marketing provisions. The preliminary estimates to cover the event are approximately $25,000.

The event’s grand kick off location is tentatively scheduled for the 300 and 400 blocks of North Rodeo Drive, concluding on North Crescent Drive. Financial details on how the Gran Fondo specifically benefits the local community and City will be discussed at future council meetings. Mayor Barry Brucker explained that any future proposals will be sent to the entertainment committee for consideration. Horace Mann PTA To Sponsor First Annual T-Shirt Contest The Horace Man PTA is sponsoring inaugural Horace Mann T-Shirt Design Contest. Three designs will be chosen and the Husky Nation will wear these shirts throughout the 2011/2012 school year. The PTA will be accepting entries through Oct. 28. By Marla Schevker A pre-trial conference for former BHUSD Superintendent Jeffrey Hubbard occurred last Friday in Judge Stephen Marcus’ courtroom at the Clara Shortridge Foltz Justice Center. Hubbard’s trial was tentatively set for Nov. 10. Deputy District Atty. Max Huntsman told Judge Marcus he intends to bring additional charges in front of the Grand Jury against Hubbard. Huntsman said he had not previously been able to present to the grand jury because his witness was “unable to appear.”

In early September, Huntsman told The Courier the additional charges had to do with former BHUSD Human Resources Coordinator Nora Roque. After the grand jury has made a decision on the additional charges, Hubbard’s attorney Salvatore Ciulla said they may be filing a 995 motion, or a request to have a judge review what happened during the grand jury to evaluate whether enough evidence was presented. Both factors will determine whether the case can be sent to trial. As of now, Judge Marcus

said the trial should begin within 11 days of Nov. 10. A trial readiness conference for former BHUSD Director of Planning and Facilities Karen Christiansen is tentatively set for Oct. 28 with a tentative trial set for early November in Judge Marcus’ courtroom. Hubbard’s trial is expected to last seven days and Christiansen’s trial is expected to last up to five weeks. Christiansen is charged with four counts of conflict of interest and Hubbard is charged with two counts of misappropriation of funds.

City Hall, Services Open Late Mon City Hall and other City of Beverly Hills offices will open at 11:00 a.m. on Monday, October 10, because of an all-employee training session in the morning. The Library will open at 1 p.m. Normally, City offices open at 7:30 a.m. and the Library opens at 10 a.m. For the past five years, an all employee training session has been held on the second Monday in October to focus on improving customer service to

enhance how the City serves its residents and businesses. Police, Fire and Public Works essential services will continue normal operations on October 10. Classes and programs at Roxbury, Coldwater Canyon and La Cienega parks will also take place as scheduled. Visitors to the Civic Center area on the morning of October 10th should enter the Civic Center parking structure from Civic Center Drive.

Milken Jewish Educator Awards Presented To Outstanding Teachers The 2011 Milken Jewish Educator Awards were presented to four outstanding educators at Jewish day schools in recognition of their significant contributions to education. erly High and city homes until it is too late to gather data. “The City has considered the district’s request for a joint defense agreement and declines to participate...at this time,” the letter stated. “We believe it is important to have the benefit of the information contained in the Final Environmental Impact Report and the technical studies before... consideration of such an agreement.” The “technical studies” Kolin refers to are Metro's own studies, none of which have been released, despite efforts by the BHUSD to obtain them. Metro has also firmly rejected requests by the City to see that data.

Mayor Barry Brucker said he was not comfortable with a joint defense agreement at this point, due to what he alleges is a lack of clarity in what the agreement would entail. The City has not requested a draft agreement and has not proposed one. “Without a clearly defined agreement of roles and responsibilities with respect to who our point person will be, who is charged with speaking on behalf of both entities and how the financial decisions will be made I could not support it,” Brucker said. “Any challenge to a Metro decision must be methodical, professional and well thought out. In my opinion taking a hysterical grenade tossing approach will not advance our ultimate goal and objective.”

The reference was to Brucker’s continued slurs against BHUSD board members for their stance against Metro. The Courier has not found any witnesses to corroborate Brucker’s accusation, which he has made for many months. While the approaches are different, Brucker tried to claim the City and the district are working towards the same goal. “The City is taking a ... low key methodical and surgical approach to achieving our mutual goal,” Brucker said. “We are ready and willing to share data with the district at any time. Unfortunately, the district has elected to not share data with us claiming (it) may be privileged attorney work product.” Data sharing without a joint defense agreement destroys the attorney/client privilege for the information thus allowing Metro full access. The City has no such data to share and has refused to gather any. On many occasions, data and information provided by the BHUSD to the City has

ended up in the hands of Metro and formed the basis for press releases and other countermeasures. Brucker told The Courier a joint defense agreement may be beneficial in the future, depending on what the “independent analysis comes back with.” The decision will be made after the EIR is reviewed by Exponent and Shannon & Wilson, geotech and engineering firms hired by the City. “I think (we) just need to wait until we get the independent analysis from our experts and consultants,” Brucker said. “We have never been closed to communicating and sharing data with the school district. We’ve offered to send our engineers and City personnel to the school district to... review any technical data thus gathered.” No City personnel are qualified as experts to testify in court on tunnels and school construction over those tunnels. Despite the unannounced abbreviated tour with L.A.

BEVERLY HILLS County Supervisor and MTA Boardmember Mark Ridley Thomas facilitated by Brucker, Vice Mayor Willie Brien and Kolin, should the City “need to schedule a tour of school district facilities and include information known only to the district and its technical experts” they will “of course, contact the appropriate district personnel,” Kolin’s letter stated. This latest refusal to form a joint defense agreement was discussed in City Council closed session. Councilman John Mirisch said he felt the City should be doing a better job of working together with the schools. When brought up in open session two months ago, the council voted 3-2 to reject a joint defense agreement. Brucker, Brien and Councilmember Julian Gold voted to refuse the agreement; Mirisch and Councilmember Lili Bosse voted in favor. “I’ve never made any secret of it,” Mirisch said. “I’ve been continuing to try to push for more and better communication with the schools. But, the council majority was not in favor of it.” If a tunnel under Beverly High is “inevitable,” Brucker said he believed it would be “irresponsible” to make certain all safety and construction challenges are mitigated and paid for by Metro. He gave no information on how such a goal could be accomplished. Metro contends their current plans for either tunnel are safe. Last week, Brucker cited “health risks” in voting to remove the 60-year-old oil wells from Beverly High. None of the councilmembers presented any new evidence of risk to students, faculty or anyone else on the campus. As Board of Education president at the time, Brucker was adamant Brockovich had no evidence of any harm and there was no risk at all. The Los Angeles Superior Court agreed and dismissed the case. “If at the end of the day, it is determined that the alignment is going under the high school and there are no remedies left to preclude it from being built, then my goal and objective will be to make certain that the high school has the ability and financial guarantees to modernize and build safely and efficiently so that our kids can be serviced for the next 50 plus years,” Brucker said. All experts, including the California Division of State Architect, have stated that rebuilding or modernizing a public school above a subway tunnel has never been done in California. Board President Lisa Korbatov said the district believed a joint defense agreement would be beneficial. “The BHUSD continues to believe that our mutual goal of protecting Beverly Hills High School will be better served by working in unison with the City Council, instead of on two different tracks,” Korbatov said.

machines installed throughout the facility prior to returning to their parked vehicle. “You can actually enter and exit the facility with your credit card and not even take a ticket, which is a ‘green’ feature we’ve added,” Lynn said. Although the new green feature currently works, it is still undergoing network updates. Other green initiatives have recently been implemented at the five parking structures on Santa Monica Boulevard, where receipts are now optional. Patrons can pay for their space at any of the four machines located at each lot. According to Lynn, the most questions he receives regard parking tickets. Cited in-

dividuals have three appeals for each parking ticket; an initial review, a hearing and a court appeal. Lynn recommends if opting to contest, do so immediately by mail, online or in person to “stop the clock on the ticket.” He also recommends providing as much information and documentation as possible to increase the likelihood of receiving adjudication from the city on the ticket. Contrary to popular belief, the city is not focused on receiving fines through parking citations. In fact, the city offers a courtesy dismal for overnight parking citations. “It’s about educating people about our program, not about writing a citation,” Lynn said.

A large portion of the discussion was targeted at rewarding good teachers, providing aid for struggling teachers and forming a strategy to eliminate teachers unable to meet the standards. “One thing I would do is talk to the union about forming a task force that could support teachers who are having difficulties. While it may not feel like fall, our postman’s mailbag is getting heavier due to the increase in the number of autumnal, pre-season “save-thedates” he is duty-bound to deliver. One of the earliest gala announcements came from the Barbara Sinatra Children’s Center, which will celebrate its 25th anniversary Nov. 14, at the Hyatt Grand Champions Resort, Villas & Spa in Indian Wells. More than 17,000 child victims of abuse have been helped since the center, founded and funded by Barbara and Frank Sinatra, opened in 1986, to provide community education and counseling. This year three very instrumental ladies consistently committed to the mission of the center will be honored: namesake, Barbara Sinatra, local philanthropist and major USC benefactor Helene Galen; and, Barbara’s BFF and tireless advocate for the center, Nelda Linsk. WE WILL NOT BACK OFF BUT WE WILL KEEP SMILING You know what happens when you go against the “insiders” in Beverly Hills? Whisper campaign, slurs, allegations that “he’s not one of us,” and non-sequitur arguments that would make a political spin doctor proud. They also start making policy disagreements personal, and find all kinds of faults you probably have but others previously had the politeness not to point out. The reason for this is they don’t have the facts or merits on their side, so they go personal. A personal attack ALWAYS means the person attacked is probably right. OK. So Beverly Hills has human beings in it. That’s fine. Most of the time–to your face–people here smile and are civil to each other–a characteristic not uniformly practiced elsewhere. Just another reason why we love Beverly Hills. We invited Mayor Barry Brucker to visit our editorial board to discuss his positions. To date, he has refused to defend our school district from the Metro tunnel under dozens of homes and our high school. He has ordered thousands of dollars of legal work to try to find a way to circumvent the clear requirement of an Environmental Impact Report about the massive new buildings he wants at Roxbury Park. He’s had citizen meetings about the Roxbury building cancelled after City staff promised more sessions. He and the majority of the council decided that all-of-a-sudden the old oil wells on the Beverly High campus must go–in 2016–because of “health hazards,” hazards that apparently did not exist eight years ago when Erin Brockovich, et al., were suing about them. He OK’d sending our paid staff on our dime to Bell to help them do something (raise salaries to our levels? get them “under control”? turn the lights on/off?) He and Vice Mayor Willie Brien constantly defend City staff–when they can find them–for poor work and bad advice. According to the mayor, the City has no money for CPR, Rodeo Drive and promotions, but has $4.2 million to recarpet the library. When G&L Realty wanted two hours free parking (like just about everyone else in Beverly Hills), instead of accepting a money-generating compromise he dug in and brought about the Measure 2P/3P election and spent massive amounts in legal fees to fight it. There is nothing personal about these issues–he’s the mayor and we as the newspaper of Beverly Hills find his reasoning and decisions highly suspect. To us, they signify an authoritarian approach contrary to how he campaigned and previously served. We also believe that every one of these decisions is bad for Beverly Hills. In this, we are joined by thousands. Were it not for his previous record of fine service, we would dismiss these decisions as just plain bad judgment. Since “bad judgment” contradicts his prior record, we’d like him to explain why he has thrown out years of open government to force these things on all of us? Because of his past record, which his current record contradicts, The Courier invited Mayor Brucker to visit our editorial board. Barry has visited our editorial board twice before–for both runs for City Council. As far as we know, he enjoyed the experience and believed (and said) we were very fair, well-prepared and accurate. We have not changed. We have an editorial board because we actually have a number of editors, unlike other publications around here. They are skilled, qualified and experienced. They run The Courier and do a great job. “Editorial boards” are the traditional way in which newspapers visit with elected officials and candidates. That means any exchange is truly between the official or office-seeker and the newspaper, not a personal matter. Mayor Brucker declined our invitation in what is actually a very flattering way: he offered to have a one-on-one with this writer. Now, we in the newspaper business believe we are doing the people’s work, and stand for “reelection” with every issue, but it is seldom that an elected mayor actually offers equal billing on a stage or studio with a newspaper publisher and then wants to provide the stage (the City’s TV studio). That is very flattering. No. We follow the tenets of the newspaper industry and our invitation is to appear before our editorial board. That invitation remains open to Mayor Brucker. As for our policy, we absolutely will not stop defending Beverly Hills. Our citizens thoroughly vetted the subway proposal and in 2007 endorsed the Wilshire to Santa Monica route. No tunneling under our homes or our schools was ever proposed. Metro is pulling a bait-and-switch on Beverly Hills and the ultimate victim is Beverly High. Brucker refuses to prepare to fight. Brien and councilmember Julian Gold, violating a firm campaign pledge, also refuse to prepare to fight. Instead of fighting Los Angeles City Hall and Supervisor Zev Yaroslavsky for the bait-and-switch, Mayor Brucker attacks our school board and tries to usurp their authority. He plants stories about “hysterical grenades” and perpetuates stereotypes. He throws out arguments based on technical information without having that information, then refuses to fund getting that information. He’s now bringing up the “cost” of fighting, as though the City lacks the funds. Why? We believe the people have a right to know and he’s not telling it straight. In the meantime, The Courier will not back off. This really is a fight. It is a knock-down political battle with Villaraigosa, Yaroslavsky and the real estate interests of Century City. Pretending it is only a matter of polite conversation, as does Brucker, does not protect Beverly Hills. The future of our City is at stake. So, we’ll just have to put up with people being people. We’ll just expect more of the same slurs and whispers since they lose on the merits. We can smile, too. [It must be noted that despite policy differences, the mayor was kind enough to invite this writer to join him on the annual New York City trade and tourism mission to help promote Beverly Hills (I am a director of the Conference & Visitors Bureau and would attend in that capacity as well). We have done that before and, from personal experience, Barry does a fine job representing our interests there as did former Mayors Linda Briskman and Jimmy Delshad.]

LETTERS TO THE EDITOR It is a puzzle how the City Council leaders–who have served years on the BH Board of Education and initiated the most ambitious funding support through a JPA–can be so elusive regarding their decision to refuse to cooperate with the school board’s opposition to the MTA’s plan to tunnel under Beverly High . The Courier’s article (“Council hires firm for peer review of subway project” on the subject tells all in the last paragraph: “Remaining unanswered is the question of why the Beverly Hills City Council majority refuses to take serious action to oppose the tunnel . . “ So, when can we the voters expect an answer? Either the council leaders think the City cannot fight the MTA on this issue or the tunnel actually is in the interest of the City. If we don’t get a direct answer or if the answer is not in our interest, the voters will have to select new leaders. Roy Young ****** I am surprised no one has written to express their concern about the closure of all but daytime ESL classes in the Beverly Hills Adult School. As a property owner, builder, resident and father here in Beverly Hills, I feel the community has been negatively impacted by closing the longtime, vibrant adult program, which serviced our residents and non-native residents in a meaningful way. The non-academic classes of

The academic subjects, such as foreign languages and English as a second language, were even more profound in their impact. I understand the school district has budget concerns, and the non-academic subjects could no longer be sustained, but, in particular, closing the English as a second language program and leaving only a handful of daytime classes simply doesn't make good business sense. When non-native residents take English classes, they are better able to help their children with schoolwork and boosting test scores. When non-native visitors take English classes, then return to their native countries, they spread the goodwill and good name of our lovely City. They also spend money here, which helps local businesses. Through my foundation, I have sponsored scores of European young people, bringing them here to study English. It was a joy to know they could take daytime and evening classes in a safe, charming, supportive environment with truly dedicated

teachers. I am shocked there is now only one teacher left, who, luckily, is the former and quite capable ESL Coordinator Esther Caporale, a strong teacher who’s always been an asset to our community and a strong advocate for non-natives. The young people I sponsored were already college graduates, did not need college credits, and simply needed to learn more English. Why should I have to send them to Santa Monica or other cities when I am a taxpayer, homeowner and voter here in Beverly Hills? During these challenging economic times, learning English is more important than ever to make non-native individuals more employable and parents more capable of protecting and educating their children. I hope the Board of Education will consider keeping and expanding the ESL program to provide this vital service to Beverly Hills. Please do not “lump” learning English with learning to do yoga’s “downward dog”– they are not in the same category of lifelong and life-altering learning.
